Hey guys. So, I’m mexican. And I thought it was time for me to talk about what’s being going on over here.

Over 10 women die daily here. Every woman I know is scared of going to the streets alone, or getting on the bus, or just being near a man we don’t know. It’s scary. 

In February, the body of Ingrid Escamilla was found (if you wish to know how, feel free to investigate, but it wasn’t nice) and, worst of all, it ended up in the newspapers. Those with horrible reputation that you still see in the streets because, for some morbid reasons they still sell.

Days later, the body of Fátima Aldrighett, a seven year old kid, was found, raped and tortured. It caused anger and indignation all over Mexico. Christ, I got so mad I started crying.

Near those dates, the video of a moter of one case of feminicide became viral. The mother was outraged, screaming, and willing to destroy everything for her daughter’s case to be heard. 

In February, every women in Mexico was called to disappear from the streets, under the hashtag #El9NingunaSeMueve (#The9NoWomanMoves). It was to be a simulation, of what would happen if every woman in Mexico disappeared. If every mexican woman had been killed, victim of feminicides. 

Economically, it was estimated that Mexico would loose up to 26 thousand million pesos, that is to say, 1 billion dollars. In reality, what was lost was up to 37 thousand million pesos, 1770844.15 dollars.

But I’m getting ahead of the story.

March 8. International Woman’s Day. Celebrated that day for the women who died to get rights. In Mexico, I’m sure that more than a million women marched in the protest. I sadly couldn’t make it, but some of my friends went, and I couldn’t be prouder. They marched for those who aren’t with us anymore, and for those who still are. 

I read banner that read “My family has called me a whore for how I dress, but they haven’t call my grandfather a rapist for what he did to me”, “My mom brought me because she wants me to understand since childhood that violence against women wasn’t, isn’t and will never be normal”, “silenced you don’t look prettier, you’re dead”

So yeah, sunday was a big day for Mexico, but nothing compared to this monday. And honestly, I don’t think anything can compare to that. 

Midnight stroke, and every woman left their cellphones in silence. They left Facebook, Twitter, Instagram, Tumblr, Whatsapp, and any other social media you can think of. I didn’t answer any call, or message, or got into Fcaebook to see what was going on in the world. I meditate, I slept, and I talked to my mother and my sister. It was a good day, considering I didn’t leave my home at all, and I didn’t have to put up with men looking at me, or whistling, or to listen to my female friends talk about how someone harrased them on the bus.

As I said before, it was a big hit for Mexico, one they weren’t prepared for.

I study psychology, and my career is conformed mostly of women. One of my male friends went to school, and he took pictures of the campus. It was deserted. The parking lot had 5 cars, when it is always full, the cafeteria, where you usually never found an empty table had no one but three dudes. The classrooms were mostly alone, and the front patio, that’s usually so full of live, full of voices, of friends talking, was silenced. 

It was sad to see, and one friend told me the silence was almost unbearable.

YG Entertainment is so salty. They really didn’t have to do all that. All they had to do was give those accounts to CL. It’s not like she can’t make her own Twitter and Fcaebook account, but now she has lost tons of followers, and it will take some time for her to get them all back.

 Honestly, YG Entertainment has no one to blame but themselves for losing CL. After 2NE1 split, they treated her as if she didn’t exist. CL is too talented for that. I’m really hoping now that she is free of YG Entertainment, she tries again in the American market.

Bits und Bäume Konferenz in Berlin

Umwelt-Aktivist*innen und digitale Menschen-rechtler zusammenbringen

Das war der Wunsch der 2-tägigen Veranstaltung Bits & Bäume, die am Wochenende in der TU Berlin stattfand. In vielen Vorträgen, Panels und Workshops konnten die Beteiligten zeigen, dass es keinen Spagat darstellt "Nerds" und "Öko-Freaks" an einen Tisch zu bringen. Manchmal gibt es verschiedenes Vokabular für ähnliche Dinge, aber im Ergebnis zeigte sich stets, dass das gemeinsame Ziel eines guten und nachhaltigen Lebens die Menschen zusammenführt.

Das vielfältige Programm von Bits&Bäume über die beiden letzten Tage können wir hier nicht wiedergeben - Jede/r schaue selbst. Der Bogen spannte sich von der großen Politik über Zivilgesellschaft, Wirtschaft bis in jeden einzelnen Haushalt. Es ging darum einerseits die Welt zu verstehen, aber vor allem sie aktiv zu gestalten. Im Programmheft lautet das so:

Wie also kann Digitalisierung zur nachhaltigen Transformation der Gesellschaft und des Wirtschaftens beitragen? Wie kann Nachhaltigkeitsdenken die Techie-Szene inspirieren, sodass die Digitalisierung langfristig Bürgerrechte und individuelle Freiheiten garantiert?

Wie sehen die Ergebnisse der Konferenz nun praktisch aus?

Als Datenschützer nehmen wir zur Demonstration als Beispiel unseren Lieblingsgegner Facebook. Dieses angeblich "soziale" Netzwerk hat mehr als eine Milliarde Nutzer und jede Behörde und erst recht jedes Unternehmen meint, es müsse einen Auftritt in diesem Netzwerk anbieten. Im Gegenteil!

Jede/r Nutzer/in von Facebook steht mit einem Bein im Gefängnis, denn die geschickt formulierten AGBen von Facebook übertragen die Verantwortung für die von Facebook vollzogene Weitergabe von persönlichen Daten auf jeden einzelnen Nutzer. Jede/r garantiert dafür alle seine Freunde um das Einverständnis zur Weitergabe gebeten zu haben (siehe 99% aller WhatsApp Nutzer sind Datenhehler).

Deshalb ist es zutiefst unverantwortlich, wenn öffentliche Stellen ihre Informationen über dieses Netzwerk verbreiten oder sogar ihre Beschäftigten zu Facebook's Nachrichtendienst WhatsApp zwingen. Um so etwas zu verhindern oder zumindest einzudämmen gab es auf der Bits&Bäume den Vorschlag die Kommunen und Verwaltungen vor Ort aufzufordern, einem solchen Gesetzesbruch nicht weiter Vorschub zu lieisten.

Ein fertiger Musterbrief (zumindest für Menschen aus NRW) findet sich hier als Entwurf für eine Bürgeranregungs-Kampagne "Facebook-freie Kommune".

Die Begründung ist so einleuchtend, dass es fassungslos macht, dass überhaupt Behörden mit eigenem juristischen Sachverstand auf die Nutzung von Facebook verfallen können:

Die zu Facebook Inc. gehörenden Plattformen Facebook, WhatsApp und Instagram bieten einen Service zum präsentieren und Teilen von Informationen in Schrift, Bild und Ton an. Diese Dienstleistung kann von privaten und juristischen Personen genutzt werden. Die Rechte an sämtlichen Informationen wie Texten, Bilder, Ton- oder Videoaufnahmen, die in die Dienstleistungsangebote des Unternehmens Facebook Inc. eingespielt werden, gehen vollständig in den Besitz des Unternehmens über. Der EuGH hat in seinem Urteil vom 05. Juni 2018 entschieden, dass das Anlegen einer Facebook-Seite eine Mitverantwortung für Facebooks Datenschutzverstöße begründet. Damit machte der Europäische Gerichtshof deutlich: Bereits der Einsatz eines Online-Dienstes begründet eine Mitverantwortung für dessen Datenverarbeitung. Das gilt zumindest dann, wenn die Nutzung nicht nur rein persönlichen oder familiären Zwecken dient. Um Schaden von der Stadt abzuwenden und rechtlichen Verstößen vorzubeugen, hat die Stadt unverzüglich den Auftritt bei Facebook massiv einzuschränken und die Nutzer des Auftritts auf mögliche Verstöße von Facebook Inc. gegen rechtliche Grundlagen bei Datenschutz und Datensicherheit hinzuweisen. September 2018 die aktuelle Funktionsweise von Facebook-Seiten als nicht konform zur europäischen Datenschutzgrundverordnung (DSGVO). Die DSGVO muss in Europa seit dem Mai 2018 eingehalten werden. Da es Facebook Inc. bis heute nicht gelungen ist, einen rechtskonformen Betrieb der Plattform Facebook sicherzustellen, steht die Stadt in der Pflicht, die Nutzung der rechtswidrigen Dienstleistung unverzüglich zu unterbinden bzw. derart zu minimieren, dass eine Unterstützung des rechtswidrigen Betriebs nicht gefolgert werden kann. So weist u.a. der Datenschutzbeauftragte der evangelischen Kirche in Deutschland darauf hin, dass bei der Nutzung von WhatsApp das Telefonbuch auf den Geräten als Identifizierungsmerkmal verwendet wird. Damit werden personenbezogene Daten automatisch in die WhatsApp-Kontaktliste aufgeführt. Von den Personen, deren Daten damit an Facebook Inc. weitergeben werden, müsste sich der WhatsApp-Anwender nach europäischen Datenschutzregeln zunächst eine Einverständniserklärung einholen. Die katholische Kirche hat die Benutzung von WhatsApp ebenfalls untersagt. Der Internetpionier Jaron Lanier ruft in seinen jüngsten Stellungnahmen dazu auf, Nutzerkonten sofort zu löschen. Dabei geht es nicht nur um die Monopolstellung, die sich Facebook Inc. mit seinem Plattform-Verbund erobert hat. Durch unzureichende Sicherung der Daten kommt es regelmäßig zu massiven Diebstählen von personenbezogenen Informationen bei Facebook Inc.. Der Skandal um Cambridge Analytica zeigt darüber hinaus, dass Facebook Inc. beim Handel mit personenbezogenen Daten - gerade auch für Analysen, die zur Meinungsbeeinflussung der Nutzerinnen und Nutzer dienen – ein grundlegendes Geschäftsmodell erkannt hat.

Dem ist nichts mehr hinzuzufügen - und es ist ein schönes Beispiel, wie man direkt vor Ort mit anderen zusammen die Welt ein wenig besser machen kann.
