Elon Musk RESISTS SUBPOENA In Epstein Related Legal Case | The Kyle Kulinski Show
The legal letter referred to in the video:
RE: RINA OH n/k/a RINA OH AMEN v VIRGINIA L. GIUFFRE, Case No.: 1:21-cv- 08839-NRB Your Honor: Counsel for Defendant VIRGINIA L. GIUFFRE, respectfully submits this letter, on consent, requesting a teleconference to discuss the attached subpoena and response from non-party “X Corp.”. By way of background, the Plaintiff Rina Oh filed this Action alleging defamation based on comments made on the, then Twitter, social media platform. However, Plaintiff no longer has access to the Twitter/X accounts at issue. A forensic expert was retained by Defendant to assist Plaintiff with access the subject accounts. (See attached Affidavit served with subpoena on X Corp). Unfortunately, he was unable to assist Plaintiff in accessing the account. On June 10, 2024, Plaintiff served a second subpoena on non-party X Corp. to obtain the data and messages that Plaintiff is no longer able to access. The expert’s affidavit was attached, and Plaintiff narrowed and specified the account details needed to obtain the information. The X Corp. has improperly objected to and refused to provide the subpoenaed information. (See attached X Corp response). Defendant’s position is that the full circumstances and comments made by both parties on Twitter/X must be obtained in order for Defendant to meaningfully defend her case on the merits. See Ganske v Mensch, 480 F Supp 3d 542, 551 [SDNY 2020] (“a court must consider… the context of the entire communication and of the circumstances in which they were spoken or written.”). If she is not able to obtain the Twitter comments from Plaintiff, then she is substantially prejudice from defending against this lawsuit. As such, and pursuant to Your Honor’s Individual Practice Rules, Defendant Virginia Giuffre respectfully requests a pre-motion conference in anticipation of filing a motion to compel on non-party X Corporation to comply with the June 10, 2024, subpoena.

In a recent twist to the ongoing $258 billion lawsuit filed by Dogecoin investors against entrepreneur Elon Musk (Johnson v. Musk, 1:22-cv-05037), new court documents implicate several influencers and personalities within the DOGE community, accusing them of generating favorable social media content in exchange for undisclosed benefits. According to the latest court filing, page 39 alleges, “Former Tesla employees have stated that Tesla has a dedicated team that hunts for negative remarks on social media about Tesla and Musk personally, and pressures those who post such content to delete it.” The document goes on to name several Twitter accounts, including that of Billy Markus, known by the pseudonym “Shibetoshi Nakamoto,” the co-creator of Dogecoin, as well as other personalities like Dogecoin developer “Mishaboar” (@mishaboar), who are accused of creating exclusively positive content about Musk and Dogecoin. Other names include DogeDesigner (@cb_doge), Chairman (@WSBChairman), Sir Doge of the Coin (@dogeofficialceo), MyDogeTip (@MyDogeTip); The Under Doge (@TheUnderDoge3), MyDoge Wallet (@MyDogeOfficial) and Alex (@MyDogeCTO), among others. These accounts are alleged to have created an unduly positive narrative around Musk and Dogecoin. Dogecoin Founder And Community Reacts Reacting to the allegations, Billy Markus stated, “lel, it also says i’m an associate of elon’s (i’m not), i never post anything negative about dogecoin (completely false, i post negative shit about crypto consistently, it even quoted me earlier posting negative shit, so it’s contradictory), and i am part of the dogecoin foundation (i resigned from my non-role awhile ago).” He questioned the legality of the allegations, asking, “I thought it was illegal to make false statements, isn’t that perjury? Whatever, legal stuff is way beyond my understanding.” Similarly, Mishaboar took to social media to clarify, “Just in case: no, this account never received any ad revenue from X/Twitter nor will be eligible in a thousand years. And no, this account never received payments nor will ever accept payments for sponsored posting.” He added, “The document also claimed I am one of Elon’s fanboys, which is also completely alien to what I do in my feed.” The allegations expand the scope of the lawsuit, potentially complicating matters for the named influencers. According to Richard L, who initiated the online conversation with Markus, proving the falsity of the allegations would be on the defendants. He noted, “The defendants will need to prove it’s made up, will see if they get a warrant to take electronic devices, though that would be quite expensive (forensics isn’t cheap).” Given the high-stakes nature of the lawsuit, the named accounts could face legal scrutiny. The implications for the broader Dogecoin community are as yet unclear, particularly as the case continues to develop. Equal Launchpad? The Discrimination Allegations Rocking SpaceX

With all the controversy surrounding Elon Musk’s ventures into the website formerly known as Twitter, one almost forgets that he also runs spacecraft manufacturer and designer SpaceX. But the South African entrepreneur has had his hands full recently, with SpaceX being named in a lawsuit by the Department of Justice on August 24th, alleging discrimination in its hiring policies over claims that the company has unfair hiring practices with regards to asylees and refugees [1]. In United States of America v. SPACE EXPLORATION TECHNOLOGIES CORP. d/b/a SPACEX, the DOJ cites various examples of violating the Immigration and Nationality Act, a seminal piece of legislation from 1952 that governs all things immigration and citizenship in the United States. The complaint states that “online postings and statements by [Musk] and other SpaceX officials and recruiters… discouraged asylees and refugees from applying to the company by wrongly stating that SpaceX can only hire U.S. citizens and lawful permanent residents” [2].
Seeking asylum and refugee status are some of the most important concepts in international law, legally protecting the rights of citizens being unfairly persecuted by their own governments, and allowing them to migrate to other countries for their own safety. The process of seeking asylum and refugee status (slightly different concepts that will be used interchangeably for the purposes of this article) in the United States is rather complex and in need of reform, but the country houses a significant amount of these persons, as the U.S. has welcomed more than three million refugees since 1975 [3] and averaging about eighteen thousand asylum seekers entering the country yearly since 1990 [4]. However, neither people granted asylum or refugees are eligible to receive citizenship or a green card for at least a year after entering the country, and this immigratory gray area is what SpaceX has been accused of discriminating against. It is perfectly legal to work in the United States while awaiting a green card, and the DOJ reference 8 U.S.C. § 1158(c)(l) and Section 7.3 (Refugees and Asylees) of the U.S. Citizenship and Immigration Services Handbook for Employers as argument for this assertion.
And yet Musk alone was cited to have claimed that the company was not allowed to hire employees that did not have a green card on multiple occasions, both on Twitter and in video tapings of interviews. Furthermore, SpaceX’s own hiring records show multiple instances of applicants being rejected due to their lack of US citizenship, including a case of “an asylee who had more than nine years of relevant engineering experience and had graduated from Georgia Tech University” being rejected by a recruiter using the code “"not authorized to work/ITAR ineligible". Another case involved a job applicant rejected by a recruiter using the more neutral code "doesn't meet preferred qualification," while a hiring manager listed the reason as, "not U.S. citizen or green card." But the most concerning statistic of all? Out of more than 10,000 hires in between September 2018 and May 2022, SpaceX hired only one individual who was an asylee and identified as such in his application, merely four months after the company was notified that they were under investigation by the Immigrant and Employee Rights Section (IER) in 2020.
The IER’s investigation concluded in November 2022 after delays caused by SpaceX’s drawn out submitting of key records, and “found reasonable cause to believe that SpaceX had engaged in a pattern or practice of unfair immigration-related employment practices in violation of 8 U.S.C. § 1324b(a)(l)(B).”, leading to the DOJ’s lawsuit. Lawyers and judges will decide on the merits of the case, but the publicity that has stemmed from the lawsuit, not to mention what will be said if the courts rule in the DOJ’s favor, will do nothing but hurt the SpaceX reputation already faltering due to Musks’ other ventures. A new bipartisan swing-state poll from Global Strategy Groups showed 82 percent of voters marking that they “believe the immigration system is broken” [5], indicating that immigration policy is an extremely relevant issue in current politics. The United States has always been a country founded on immigrants, but the modern political landscape now more than ever is focused on reform, and takes issues such as discrimination more seriously. In this sense SpaceX has already lost from this case, with the company surely being forced to publically reevaluate their hiring practices regardless of the eventual verdict.

Twitter’s Legal Troubles

Elon Musk, renowned billionaire, creator of Space X, Tesla, and more, is currently the wealthiest man alive. His net worth is well over $200 billion, but recent shaky investment has led to Musk suing his own company's lawyers. When Musk bought the well-known social media platform Twitter, the company's stock closed at a market value of roughly $30 billion [1]. Twitter shareholders would ultimately sue him for the remaining $14 billion he promised in his initial bid of $44 billion. The company's former legal team, Wachtell, Lipton, Rosen & Katz, is now being sued by the Musk-led Twitter for a $90 million charge they deem "excessive." The $90 million fee was again the charge for raising the company's price for shareholders by $14 billion. Ironically, Twitter (now branded as X) 's lawsuits against former lawyers bring to light the legal troubles the company is facing from others. Currently, the company is fighting many legal battles, primarily due to the significant turnover when the once-public company moved into the private sector via Musk's purchase.
Twitter is fighting a recent suit claiming that the company owes up to $500 million in unpaid severance to employees laid off following Musk's takeover [2]. His privatization of the company was significant, laying off over half of the employees working at the time. With the layoffs come a more substantial issue, claimed discriminatory action against the employees the company let go. A separate lawsuit alleges that the company targeted female employees and workers with disabilities in their mass layoffs [3]. The company denies such claims, but any evidence to prove that they knowingly discriminated against the employees they fired would be damning against the public perception of both X-Corp and Elon Musk. If the prosecution provides substantial evidence that a worker's disability/gender was a motivating factor in the layoffs, the consequences could be significant. Title VII of the Civil Rights Act of 1964 prohibits explicitly against employment discrimination "because of sex." The Civil Rights Act is legally binding, and the Court has used it in many past cases as the primary legal reason to determine when employment discrimination occurred. Some of the most notable cases include Hazelwood School District v. United States (1977), American Tobacco Company v. Patterson (1982), and Equal Employment Opportunity Commission v. Abercrombie & Fitch Stores (2015).
The abovementioned cases are just some of the company's most notable lawsuits. In July, ex-employees sued Twitter Inc. for allegedly refusing to proceed with nearly 900 arbitration cases against them [4]. Since Musk's takeover, the company has taken drastic actions regarding employment and company branding. Yet, severe inaction to reprimand any mistakes they may have made in the process. Musk's privatization of Twitter has had massive ramifications for all involved in the company. Back to the initial lawsuit, the reasons Twitter is suing its former lawyers are quite perplexing why the company decided to take an offensive approach while simultaneously fighting and downplaying many legal troubles facing them. More finances to please ex-employees? The answer to that is unclear. A deep dive into the company's situation shows that Elon Musk has his hands full with the newfound X-Corp.

Lawsuit Alleging Elon Musk Cheated Twitter Shareholders Dismissed by Judge
A class-action lawsuit against Elon Musk, accusing him of wrongdoing in relation to the purchase of Twitter, has been dismissed by U.S. District Judge Charles Breyer in San Francisco. The lawsuit claimed that Musk cheated Twitter shareholders multiple times during the acquisition process, which amounted to $44 billion. Judge Breyer ruled that the plaintiff, William Heresniak, lacked standing to sue as he challenged actions associated with Musk's buyout rather than the fairness of the buyout itself. Heresniak failed to demonstrate any harm resulting from Musk's delayed disclosure of a 9.2% Twitter stake, which allegedly allowed him to acquire additional shares at lower prices prior to the announcement of the buyout. The judge also found no evidence indicating that Musk assisted two friends who were serving on Twitter's board, co-founder Jack Dorsey and Egon Durban of Silver Lake private equity firm, in breaching their fiduciary duties. Breyer explained that Dorsey rolling over his approximately $1 billion worth of Twitter shares into an equity stake in the new company simply reduced Musk's payment at closing and did not involve the improper diversion of money from other shareholders. Lawyers representing Heresniak did not immediately respond to requests for comment. Elon Musk, who is also the CEO of Tesla Inc. and the world's second-richest person according to Forbes magazine, has yet to issue a statement regarding the dismissal. Similarly, attorneys for Musk, his holding companies, and Twitter have not provided any immediate comments. In a court filing on March 3, Musk's legal team dismissed Heresniak's claims as a collection of disjointed and often irrelevant grievances against Elon Musk. Heresniak filed the lawsuit on May 25, 2022, one month after Twitter accepted Musk's buyout offer of $54.20 per share. The transaction was completed on October 27. Following the acquisition, Twitter has faced challenges in maintaining ad revenue, with concerns raised by some advertisers about their ads being associated with hate speech or inappropriate content due to relaxed content rules. On May 12, Musk appointed former NBCUniversal advertising chief Linda Yaccarino as Twitter's new CEO. Twitter Sues Musk For Attempting To Back Out Of Purchasing Twitter

Twitter, a popular social media platform, where messages called “tweets” limited to 280 characters are submitted for public opinion, has recently been embroiled in a legal battle.[i] Elon Musk, an American businessman who owns Tesla and other companies, agreed in April of 2022 that he would buy Twitter and take it private.[ii] This would mean that certain laws around censoring speech would not apply and people who felt they were excluded due their speech and beliefs during recent years could speak their mind. He also stated that he would get rid of spam bots and make sure real people were running the twitter accounts. [iii]However, in July of 2022, Musk tweeted that he did not believe the deal could move forward and informed Twitter later through the appropriate legal filings that he no longer wanted to complete their deal[iv]. Twitter is refusing to let him out of the deal and are taking him to court. The court date will be in October of this year. Musk wanted the trial to take place in late February, while Twitter asked for a date in September.[v] Musk stated that he needed the additional time to verify the number of actual users that Twitter has on its website from the data that Twitter sent him.[vi] Twitter needs the deal to go through quickly because the public fight with Musk has caused their stock to dip. In addition, Musk has continued to disparage Twitter online in order to get out of the deal, further damaging their image. [vii]
Elon Musk no longer wants to buy twitter because he claims they did not fulfill their end of the bargain when it came to proving to him with data how many real visitors they have on their sites. They also fired several employees. However, Twitter argues that Musk simply wanted to torpedo the deal when he asked for all the data.[ix] They were required to answer his requests that were reasonable and for the purpose of running the business, but they do not hold that this request was reasonable. Also, Twitter and Musk had agreed that they could fire and hire who they wanted during this process and run their daily operations. [x] Twitter is suggesting that Musk is attempting to get out of the deal with these accusations since his Tesla stock, which he was going to use to fund the purchase, has tanked since the deal was agreed upon.[xi] Twitter also is charging Musk with publicly disparaging Twitter after he decided he no longer wanted to move forward with the deal. [xii]
Twitter is most likely fighting so hard for this deal due to the increased price that Musk had agreed to buy their stocks at and how that would benefit their shareholders. Musk had agreed to pay $54 dollars per share. Currently, Twitter stock is being traded for about $36 dollars. However, there are some people, twitter users and employees who would be delighted if the Twitter deal did not go through. They cite Musk’s troublesome past where employees have brought lawsuits and complaints against him for their treatment during the time they worked for him.
Musk backing out of the Twitter deal is also a problem for the banks. The banks that have committed among them Morgan Stanley, Barclays, and Bank of America have pledged themselves to this deal. Thus, unless Musk gets a court not to enforce the deal, they will still most likely pay. If they reneged before that then they could seem untrustworthy to their other clients. If they do back out of the deal, Musk can take them to court. However, it ends, the financial tangles of this lawsuit are certainly intensive. [xiii]
In September the shareholders of Twitter will vote on Musk’s plan and then in October, we shall see what the Delaware courts decide.[xiv] Musk could have to go through with the deal or simply pay a hefty fine for backing out.[xv] We shall have to watch and see. Although, in the past, courts have not looked favorably on people backing out due to being unable to finance their deal. Thus, if this is the true reason behind Musk’s reticence then most likely he will still have to fund the deal. Interestingly enough, if the banks were able to back out, the court could still rule that Musk has to pay.[xvi] Whatever the court decides will have a pronounced impact on the company Twitter and Musk.
