Topic: Foreign Divorce Obtained by a Foreigner Married to a Filipino
Doctrine
In determining whether or not a divorce is secured abroad would come within the pale of the country's policy against absolute divorce, the reckoning point is the citizenship of the parties at the time a valid divorce is obtained.

x x x [W]e state the twin elements for the application of Paragraph 2 of Article 26 as follows:
There is a valid marriage that has been celebrated between a Filipino citizen and a foreigner; and
A valid divorce is obtained abroad by the alien spouse capacitating him or her to remarry.
The reckoning point is not the citizenship of the parties at the time of the celebration of the marriage, but their citizenship at the time a valid divorce is obtained abroad by the alien spouse capacitating the latter to remarry.
SUPER SUMMARY
Vicente Bayot and Rebecca, an American citizen, got married in the Philippines in 1979. After the birth of their child in 1982, their relationship turned sour. Sometime in 1996, Rebecca obtained a divorce decree from the Dominican Republic. Five years thereafter, Rebecca filed a case for nullity of marriage against Vicente before Muntinlupa RTC and sought support pendente lite against the latter. According to Rebecca, the divorce decree obtained in Dominican Republic is not binding, her being a Filino citizen by virtue of the order of recognition issued in 1995. Is the divorce decree obtained in the Dominican valid in the Philippines and binding against the petitioner?
HELD: AFFIRMATIVE. In determining whether or not a divorce is secured abroad would come within the pale of the country's policy against absolute divorce, the reckoning point is the citizenship of the parties at the time a valid divorce is obtained. Rebecca at that time she applied and obtained her divorce was an American citizen and remains to be one. Being an American citizen, Rebecca was bound by the national laws of the United States of America, a country which allows divorce. Moreover, the fact that Rebecca may have been duly recognized as a Filipino citizen by force of the June 8, 2000, affirmation by the DOJ Secretary of the October 6, 1995 Bureau Order of Recognition, it will not stand alone and work to nullify or invalidate the foreign divorce secured by Rebecca as an American citizen in 1996. Furthermore, pursuant to paragraph 2 of Art. 26 of the Family Code, Vicente Bayot shall likewise have capacity to remarry under PH laws.
FACTS
[Some of the details in this case are confusing. It was not stated in the decision as to why she filed the petition for Divorce in Dominican Republic. Based on the website of the US Embassy in the Dominican Republic, US citizens may validly obtain divorce decrees there either through mutual consent or divorce for cause. See Divorce in the Dominican Republic - U.S. Embassy in the Dominican Republic (usembassy.gov) for more info.
Vicente and Rebecca were married on April 20, 1979 in Sanctuario de San Jose, Greenhills, Mandaluyong City. On its face, the Marriage Certificate identified Rebecca, then 26 years old, to be an American citizen. Not long after, Rebecca gave birth to Marie Josephine Alexandra or Alix, in California. From then on, Vicente and Rebecca's marital relationship seemed to have soured as the latter, sometime in 1996, initiated divorce proceedings in the Dominican Republic. On February 22, 1996, the Dominican court issued Civil Decree No. 362/96, ordering the dissolution of the couple's marriage and "leaving them to remarry after completing the legal requirements," but giving them joint custody and guardianship over Alix.
Over a year later, the same court would issue Civil Decree No. 406/97, settling the couple's property relations pursuant to an Agreement they executed on December 14, 1996. Said agreement specifically stated that the “conjugal property which they acquired during their marriage consist[s] only of the real property and all the improvements and personal properties therein contained at 502 Acacia Avenue, Alabang, Muntinlupa.”
Meanwhile, on March 14, 1996, or less than a month from the issuance of Civil Decree No. 362/96, Rebecca filed with the Makati City RTC a petition dated January 26, 1996, with attachments, for declaration of nullity of marriage, docketed as Civil Case No. 96-378. Rebecca, however, later moved and secured approval of the motion to withdraw the petition.
On May 29, 1996, Rebecca executed an Affidavit of Acknowledgment stating under oath that she is an American citizen; that, since 1993, she and Vicente have been living separately; and that she is carrying a child not of Vicente.
On March 21, 2001, Rebecca filed another petition, this time before the Muntinlupa City RTC, for declaration of absolute nullity of marriage on the ground of Vicente's alleged psychological incapacity. Docketed as Civil Case No. 01-094 and entitled as Maria Rebecca Makapugay Bayot v. Vicente Madrigal Bayot. In it, Rebecca also sought the dissolution of the conjugal partnership of gains with application for support pendente lite for her and Alix. Rebecca also prayed that Vicente be ordered to pay a permanent monthly support for their daughter Alix in the amount of PhP 220,000.
On June 8, 2001, Vicente filed a Motion to Dismiss on, inter alia, the grounds of lack of cause of action and that the petition is barred by the prior judgment of divorce. Earlier, on June 5, 2001, Rebecca filed and moved for the allowance of her application for support pendente lite.
To the motion to dismiss, Rebecca interposed an opposition, insisting on her Filipino citizenship, as affirmed by the Department of Justice (DOJ), and that, therefore, there is no valid divorce to speak of.
ISSUE/S
Whether or not the divorce decree obtained in Dominican Republic is valid and can be recognized under Philippine laws.
Whether or not Vicente is still subject to the obligation under the Civil Code as Rebecca’s husband.
RULING
The Court ruled in the AFFIRMATIVE.
Rebecca at that time she applied and obtained her divorce was an American citizen and remains to be one, being born to American parents in Guam, an American territory which follows the principle of jus soli granting American citizenship to those who are born there. She was, and still may be, a holder of American passport.
She had consistently professed, asserted and represented herself as an American citizen, as shown in her marriage certificate, in Alix's birth certificate, when she secured divorce in Dominican Republic. Being an American citizen, Rebecca was bound by the national laws of the United States of America, a country which allows divorce.
In order that a foreign divorce can be recognized here, the divorce decree must be proven as a fact and as valid under the national law of the alien spouse. The fact that Rebecca was clearly an American citizen when she secured the divorce and that divorce is recognized and allowed in any of the States of the Union, the presentation of a copy of foreign divorce decree duly authenticated by the foreign court issuing said decree is, as here, sufficient. Thus the foreign decrees rendered and issued by the Dominican Republic court are valid, and consequently, bind both Rebecca and Vicente.
Furthermore, the fact that Rebecca may have been duly recognized as a Filipino citizen by force of the June 8, 2000, affirmation by the DOJ Secretary of the October 6, 1995 Bureau Order of Recognition will not, stand alone, work to nullify or invalidate the foreign divorce secured by Rebecca as an American citizen in 1996. In determining whether or not a divorce is secured abroad would come within the pale of the country's policy against absolute divorce, the reckoning point is the citizenship of the parties at the time a valid divorce is obtained.
Lastly, on the issue of their conjugal property, the Court held that the Civil Decree No. 406/97 issued by the Dominican Republic court properly adjudicated the ex-couple's property relations.
The Court ruled in the NEGATIVE.
Given the validity and efficacy of divorce secured by Rebecca, the same shall be given a res judicata effect in this jurisdiction. As an obvious result of the divorce decree obtained, the marital vinculum between Rebecca and Vicente is considered severed; they are both freed from the bond of matrimony. In plain language, Vicente and Rebecca are no longer husband and wife to each other.
As the divorce court formally pronounced: "[T]hat the marriage between MARIA REBECCA M. BAYOT and VICENTE MADRIGAL BAYOT is hereby dissolved x x x leaving them free to remarry after completing the legal requirements."
Consequent to the dissolution of the marriage, Vicente could no longer be subject to a husband's obligation under the Civil Code. He cannot, for instance, be obliged to live with, observe respect and fidelity, and render support to Rebecca.[Side Note: You may wonder “What about Alix?”. Is she not entitled to support from Vicente? The Court to be sure does not lose sight of the legal obligation of Vicente and Rebecca to support the needs of their daughter, Alix. The records do not clearly show how he had discharged his duty, albeit Rebecca alleged that the support given had been insufficient. At any rate, we do note that Alix, having been born on November 27, 1982, reached the majority age on November 27, 2000, or four months before her mother initiated her petition for declaration of nullity. She would now be 26 years old. Hence, the issue of back support, which allegedly had been partly shouldered by Rebecca, is best litigated in a separate civil action for reimbursement. In this way, the actual figure for the support of Alix can be proved as well as the earning capacity of both Vicente and Rebecca. The trial court can thus determine what Vicente owes, if any, considering that support includes provisions until the child concerned shall have finished her education.]

331 of our trans and gender nonconforming siblings died this year worldwide. They were overwhelmingly people of color. They were as young as 14, as old as 60. They were from all walks and places in life.
They died for being different from the "norm."

Requisites of Marriage (Article 26)
All marriages solemnized outside the Philippines in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country except those prohibited under articles 35(1), (4), (5) and (6), 36, 37 and 38.
Where a marriage between a Filipino citizen and a foreigner is a validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law. (As amended by E.O. No. 227)
Rules on foreign marriages of Filipinos
If a marriage is celebrated between Filipino citizens in a foreign country and valid there as such, generally, it is valid in the Philippines. The exception to the rule is that when marriage between Filipinos abroad is bigamous the same is void even if valid where it was celebrated because what determines their legal capacity is Philippine law.
Strict application of rule 26
The rule as contemplated by the framers of the family code is that, the marriage must be a mixed marriage, between a foreigner and a Filipino in order that article 6 paragraph 2 may apply and that it must have been mixed from the very beginning. If it was mixed after its celebration, the law does not apply.
It is said that while public policy and our concept of morality abhor or hate absolute divorce, because of nationality principle adhered under article 15 of the civil code, nonetheless, the absolute divorce obtained abroad may be recognized in the Philippines provided it is valid according to his national law.
Effect if Filipino obtains divorce against foreigner spouse
The effects of foreign divorce are now recognized in the Philippines but subject to certain condition. When the foreigner divorced the Filipina, the marital relationship was severed.
Extent of the petition under Article 26 paragraph 2 of the Family Code
An alien’s legal capacity to contract is evidenced by a certificate issued by his or her respective diplomatic and consular officials, which he or she must present to secure a marriage license. The Filipino spouse who seeks to remarry, however, must still resort to a judicial action for a declaration of authority to remarry.

FACTS:
Rebecca Macapugay Bayot was an American citizen and born in Agoa, Guam, USA. She married Vicente Bayot at Greenhills, Mandaluyong on April 20, 1979. On November 27,1982, Rebecca gave birth to a daughter named Alix at San Francisco, California. However, as the marriage turned sour, Rebecca initiated a divorce on 1996 in Dominican Republic. The latter ordered the dissolution of marriage and remarriage after competing the legal requirements. However, there must be a joint custody and guardianship to Alix, and the conjugal property, particularly the real properties located only in Manila that they acquired during their marriage be settled.
However, Rebecca stated under oath on May 28, 1996 that she is an American citizen and she is carrying a child not of Vicente. Rebecca again filed another petition in Manila on March 2001 for absolute nullity of marriage on the ground of dissolution of partnership gain, monthly support for their daughter and that Vicente is psychological incapacitated.
Vicente averred and filed a motion to dismiss for lack of cause and action and filed a case of adultery and perjury against Rebecca. Rebecca, on the contrary, charged Vicente with bigamy and concubinage.
On the other note, Rebecca became a recognized Filipino citizen on 2000. ISSUE:
Whether or not the divorce is valid?
HELD:
1) No serious dispute that at the time of divorce to Vicente, Rebecca was an American citizen and still remains to be one. Evidences: a) she was born in USA and jus soli is followed in American territory in granting American citizenship; b) she was and may still be an American passport holder; c) in marriage certificate, birth certificate of Alix and divorce decree in Dominican Republic, it was declared that she is an American
2) VALID. Rebecca was bound by the national laws of USA where divorce was valid. Their property relations were also properly adjudicated through their Agreement on 1996. Foreign divorce can be recognized in the Philippines provided that the divorce decree is fact and valid under the national law of the alien spouse. The reckoning point is the citizenship of parties at the time the divorce was obtained and not the citizenship of the parties at the time of the celebration of marriage.

OCCUPATION BY THE UNITED STATES, 1916-24
Dominican Republic Table of Contents The assassination of Cáceres turned out to be but the first act of a frenzied drama that culminated in the republic's occupation by the United States. The fiscal stability that had resulted from the 1905 receivership eroded under Cáceres's successor, Eladio Victoria y Victoria; most of the increased outlays went to support military campaigns against rebellious partisans, mainly in the Cibao. The continued violence and instability prompted the administration of President William H. Taft to dispatch a commission to Santo Domingo on September 24, 1912, to mediate among the warring factions. The presence of a 750-member force of United States Marines apparently convinced the Dominicans of the seriousness of Washington's threats to intervene directly in the conflict; Victoria agreed to step down in favor of a neutral figure, Roman Catholic archbishop Adolfo Alejandro Nouel Bobadilla. The archbishop assumed office as provisional president on November 30.
Nouel proved unequal to the burden of national leadership. Unable to mediate successfully between the ambitions of rival horacistas and jimenistas, he stepped down on March 31, 1913. His successor, José Bordas Valdés, was equally unable to restrain the renewed outbreak of hostilities. Once again, Washington took a direct hand and mediated a resolution. The rebellious horacistas agreed to a cease-fire based on a pledge of United States oversight of elections for members of local ayuntamientos and a constituent assembly that would draft the procedures for presidential balloting. The process, however, was flagrantly manipulated and resulted in Bordas's reelection on June 15, 1914. Both horacistas and jimenistas took offense at this blatant maneuver and rose up against Bordas.
The United States government, this time under President Woodrow Wilson, again intervened. Where Taft had cajoled the combatants with a clear intimation of military action, Wilson delivered an ultimatum: elect a president or the United States will impose one. The Dominicans accordingly selected Ramón Báez Machado as provisional president on August 27, 1914. Comparatively fair presidential elections held on October 25 returned Jiménez to the presidency. Despite his victory, however, Jiménez felt impelled to appoint leaders and prominent members of the various political factions to positions in his government in an effort to broaden its support. The internecine conflicts that resulted had quite the opposite effect, weakening the government and the president and emboldening Secretary of War Desiderio Arias to take control of both the armed forces and the Congress, which he compelled to impeach Jiménez for violation of the constitution and the laws. Although the United States ambassador offered military support to his government, Jiménez opted to step down on May 7, 1916.
Arias never formally assumed the presidency. The United States government had apparently tired of its recurring role as mediator and had decided to take more direct action. United States forces had already occupied Haiti by this time. The initial military administrator of Haiti, Rear Admiral William Caperton, had actually forced Arias to retreat from Santo Domingo by threatening the city with naval bombardment on May 13. The first Marines landed three days later. Although they established effective control of the country within two months, the United States forces did not proclaim a military government until November. Most Dominican laws and institutions remained intact under military rule, although the shortage of Dominicans willing to serve in the cabinet forced the military governor, Rear Admiral Harry S. Knapp, to fill a number of portfolios with United States naval officers. The press and radio were censored for most of the occupation, and public speech was limited.
The surface effects of the occupation were largely positive. The Marines restored order throughout most of the republic (with the exception of the eastern region); the country's budget was balanced, its debt was diminished, and economic growth resumed; infrastructure projects produced new roads that linked all the country's regions for the first time in its history; a professional military organization, the Dominican Constabulary Guard, replaced the partisan forces that had waged a seemingly endless struggle for power. Most Dominicans, however, greatly resented the loss of their sovereignty to foreigners, few of whom spoke Spanish or displayed much real concern for the welfare of the republic.
The most intense opposition to the occupation arose in the eastern provinces of El Seibo and San Pedro de Macorís. From 1917 to 1921, the United States forces battled a guerrilla movement in that area known as the gavilleros. The guerrillas enjoyed considerable support among the population, and they benefited from a superior knowledge of the terrain. The movement survived the capture and the execution of its leader, Vicente Evangelista, and some initially fierce encounters with the Marines. However, the gavilleros eventually yielded to the occupying forces' superior firepower, air power (a squadron of six Curtis Jennies), and determined (often brutal) counterinsurgent methods.
After World War I, public opinion in the United States began to run against the occupation. Warren G. Harding, who succeeded Wilson in March 1921, had campaigned against the occupations of both Haiti and the Dominican Republic. In June 1921, United States representatives presented a withdrawal proposal, known as the Harding Plan, which called for Dominican ratification of all acts of the military government, approval of a loan of US$2.5 million for public works and other expenses, the acceptance of United States officers for the constabulary--now known as the National Guard (Guardia Nacional)--and the holding of elections under United States supervision. Popular reaction to the plan was overwhelmingly negative. Moderate Dominican leaders, however, used the plan as the basis for further negotiations that resulted in an agreement allowing for the selection of a provisional president to rule until elections could be organized. Under the supervision of High Commissioner Sumner Welles, Juan Bautista Vicini Burgos assumed the provisional presidency on October 21, 1922. In the presidential election of March 15, 1924, Horacio Vásquez Lajara handily defeated Francisco J. Peynado. Vásquez's Alliance Party (Partido Alianza) also won a comfortable majority in both houses of Congress. With his inauguration on July 13, control of the republic returned to Dominican hands.

Cae abatido autor de cuádruple crimen en Brisas del Edén SANTO DOMINGO.– La Policía Nacional abatió este martes a Rubén Dario Jiménez Pérez, quien se encontraba prófugo por la masacre de cuatro miembros de una familia, incluida su ex pareja en Brisas del Edén en Santo Domingo Este. Jiménez Pérez se enfrentó a una patrulla que lo encontró en una cabaña de San Isidro. En el enfrentamiento resultaron heridos dos agentes policiales, que fueron trasladados al hospital Darío Contreras. Jiménez Pérez era perseguido por haber perpetrado hace una semana un ataque armado contra su ex pareja y madre de su hijo, Leyda Esterlina Vicente, de los padres de la mujer y de un concuñado, y provocó heridas a otra persona.
