When Your Boss Refuses to Provide Workplace Disability Accommodations.
Recently we asked for a disabilility accomodation at work. Our boss instead gave us an ultimatum: figure it out for ourself by disclosing our disability to our coworkers and begging them to assist, or forfeit our position and take a pay cut to be accomodated.
Well. What The Fuck Do We Do Now?
First we googled our rights. These official US government websites were the most helpful:
Equal Employment Opportunity Comission
Job Accomodation Network
Office of Disability Employment Policy
Our state's Disability Law Center website
In summary, we learned that employers are legally required to accommodate disabilities. They are not required to meet one's request to the letter if it would cause undue hardship, but if they don't, they must carry out an interactive process with the employee to agree on an arrangement. There are conditions they cannot impose upon the employee (a pay cut being one of them!) and reasons that are inadequate for not accepting a request (that there may be complaints from nondisabled coworkers regarding the accommodation is an inadequate reason, for example).
We could have laid the law upon our boss ourself, but considering the direness of the situation we wanted to ensure we had protections against retaliation, such as firing, and be sure our boss gets the memo. So we called our state's Disability Law Office. We explained the situation to the intake specialist and sent supporting documentation (our accommodation request letter from our therapist, our diagnosis paperwork, and an audio recording* of the meeting I had with my bosses wherein she said the things above) to an email she provided. It was supposed to take a week for the case to get picked up; instead it took a week to get approved and 2 more weeks to get picked up. We spent a lot of time calling and getting voicemails in that time, and feeling hopeless with our boss's deadline looming over our head. So we visited the office in person. As soon as we did that, we were able to bypass the front desk lady and met with the Managing Attorney. She got the case assigned to an attorney and the attorney called us within the hour.
Our aim isn't to sue, and we do not want to file a complaint with the EEOC at this point in time. We just to get our attorney to email our boss or something to force her hand. We are currently waiting for him to send us his draft before he sends it to her. We'll update how it goes!
But our lessons learned here are:
if you want something done fast, stop calling or using online portals. visit the office in person.
utilize public services! they are nonprofit, so I'm getting help from an attorney for free!
always ALWAYS get names & contact info of specific personnel, especially if they are higher up the ladder. otherwise you will be stuck with a front desk worker and all the red tape involved with their job blocking your path.
know. your. rights!!!! never let anyone take them away from you, ever!

I've had to halt work in the meantime (not that I was earning nearly as much as I hoped..yay) coz the depression would technically count as severe now (I checked WebMD). It's scary that none of the other professionals trying to help me have made me feel better. Maybe this developing country just isn't ready to deal with AuDHD clients yet.
And I'm just not one of the lucky ones. It looks like most people are, but I am not. And this ain't the Boiling Isles.
Like, I took a risk to work as a mental health professional...however, I didn't find out that I was struggling with ADHD burnout and autistic burnout (like, 3 decades' worth of it without it being accommodated or treated..instead I was misdiagnosed or just viewed as having a bad attitude) until after I was licensed. That..has led to a whole host of problems.
It's been a gradual downhill slide since last November, I'm not sure if it's even getting better. Worst of all, I confess that my connection with blorbo Hunter has been fizzling out. It's caused me a ton of stress :S I hung on till 8th April to post my anniversary art, but I think I need to step back and just stick to FFXIV stuff until I start to connect with the blorbo again. Coz I feel that he and everyone else have run off ahead, while I'm trying not to be crushed by depression rubble and am trying to crawl and pull myself out. And other people don't know how to get me out. (Is this a Sword in the Stone type of situation where only I can pull myself out..? Sigh)

I'll do my best to hang on. Hell, I've chosen this year to visit online friends around the world since every other area has crashed and burned so far. I'll be able to make it till then, maybe I could find inspiration again.
For now FFXIV is my main lifeline..I should also start Dungeon Meshi and other stuff..and I really appreciate every word of encouragement people have sent me in the past months. Stay safe

i have once more Read a Book !
the book was jim morris' cancer factory: industrial chemicals, corporate deception, & the hidden deaths of american workers. this book! is very good! it is primarily about the bladder cancer outbreak associated with the goodyear plant in niagara falls, new york, & which was caused by a chemical called orthotoluedine. goodyear itself is shielded by new york's workers' comp law from any real liability for these exposures & occupational illnesses; instead, a lot of the information that morris relies on comes from suits against dupont, which manufactured the orthotoluedine that goodyear used, & despite clear internal awareness of its carcinogenicity, did not inform its clients, who then failed to protect their workers. fuck dupont! morris also points out that goodyear manufactured polyvinyl chloride (PVC) at that plant, and, along with other PVC manufacturers, colluded to hide the cancer-causing effects of vinyl chloride, a primary ingredient in PVC & the chemical spilled in east palestine, ohio in 2023. the book also discusses other chemical threats to american workers, including, and this was exciting for me personally, silica; it mentions the hawks nest tunnel disaster (widely forgotten now despite being influential in the 30s, and, by some measures, the deadliest industrial disaster in US history) & spends some time on the outbreak of severe silicosis among southern california countertop fabricators, associated with high-silica 'engineered stone' or 'quartz' countertops. i shrieked about that, the coverage is really good although the treatment of hawks nest was very brief & neglected the racial dynamic at play (the workers exposed to silica at hawks nest were primarily migrant black workers from the deep south).
cancer factory spends a lot of time on the regulatory apparatus in place to respond to chemical threats in the workplace, & thoroughly lays out how inadequate they are. OSHA is responsible for setting exposure standards for workplace chemicals, but they have standards for only a tiny fraction—less than one percent!—of chemicals used in american industry, and issue standards extremely slowly. the two major issues it faces, outside of its pathetically tiny budget, are 1) the standard for demonstrating harm for workers is higher than it is for the general public, a problem substantially worsened during the reagan administration but not created by it, and 2) OSHA is obliged to regulate each individual chemical separately, rather than by functional groups, which, if you know anything at all about organic chemistry, is nonsensical on its face. morris spends a good amount of time on the tenure of eula bingham as the head of OSHA during the carter administration; she was the first woman to head the organization & made a lot of reasonable reforms (a cotton dust standard for textile workers!), but could not get a general chemical standard, allowing OSHA to regulate chemicals in blocks instead of individually, through, & then of course much of her good work was undone by reagan appointees.
the part of the book that made me most uncomfortable was morris' attempt to include birth defects in his analysis. i don't especially love the term 'birth defect'—it feels cruel & seems to me to openly devalue disabled people's lives, no?—but i did appreciate attention to women's experiences in the workplace, and i think workplace chemical exposure is an underdiscussed part of reproductive justice. cancer factory mentions women lead workers who were forced to undergo tubal ligations to retain their employment, supposedly because lead is a teratogen. morris points at workers in silicon valley's electronics industry; workers, most of them women, who made those early transistors were exposed to horrifying amounts of lead, benzene, and dangerous solvents, often with disabling effects for their children.
morris points out again & again that we only know that there was an outbreak of bladder cancer & that it should be associated with o-toluedine because the goodyear plant workers were organized with the oil, chemical, & atomic workers (OCAW; now part of united steelworkers), and the union pursued NIOSH investigation and advocated for improved safety and monitoring for employees, present & former. even so, 78 workers got bladder cancer, 3 died of angiosarcoma, and goodyear workers' families experienced bladder cancer and miscarriage as a result of secondary exposure. i kept thinking about unorganized workers in the deep south, cancer alley in louisiana, miners & refinery workers; we don't have meaningful safety enforcement or monitoring for many of these workers. we simply do not know how many of them have been sickened & killed by their employers. there is no political will among people with power to count & prevent these deaths. labor protections for workers are better under the biden administration than the trump administration, but biden's last proposed budget leaves OSHA with a functional budget cut after inflation, and there is no federal heat safety standard for indoor workers. the best we get is marginal improvement, & workers die. i know you know! but it's too big to hold all the same.
anyway it's a good book, it's wide-ranging & interested in a lot of experiences of work in america, & morris presents an intimate (sometimes painfully so!) portrait of workers who were harmed by goodyear & dupont. would recommend
#if anyone knows about scholarship that addresses workplace chemical exposure#& children born with disabilities through a disability justice lens please recommend it to me!#booksbooksbooks#have reached the point in my Being Weird About Occupational Safety era where i cheered when familiar names came up#yay irving j. selikoff champion of workers exposed to asbestos! yay labor historians alan derickson & gerald markowitz!#morris points out the tension between workers - who want engineering controls of hazards (eg enclosed reactors)#& employers who want workers to wear cumbersome PPE#the PPE approach is cheaper & makes it even easier to lean on the old 'the worker was careless' canard when occupational disease occurs#i just cannot stop thinking about it in relation to covid. my florida library system declined to enforce masks for political reasons#& reassured us that PPE is much less important than safety improvements at the operational & engineering level#but they didn't do those things either! we opened no windows; upgraded no HVACs; we put plexi on the service desks & stickers on the floors#& just as we have seen covid dangers downplayed or misrepresented workers still do not receive useful information about chemical hazard#a bunch of those MSDS handouts leave out carcinogen status & workers had to fight like hell to even be told what they're handling#a bunch of them still do not know—consider agricultural workers & pesticide exposures. to choose an obvious & egregious example.

Personal but: tomorrow I gotta call my neurologist's office and ask them to transfer my medical record to my doctor, so that he can sign off on my disability pension, and I can't wait to hear what excuse I'm going to get for why they cannot perform this basic fucking task. It's gonna be like "actually because we write our medical records on circle-shaped paper we're unable to scan it into normal square-shaped paper format, so that's why we can't transfer your medical record, guess you'll just have to choose between death by seizure or death by starvation uwu". And I know anyone reading this will be thinking I'm just being silly and dramatic and to that I say: tune in tomorrow and find out lmao

i hate that people seem to value my potential worth with a bachelor's degree ("you'll make more money!" as if my degree program isn't one of the least useful degrees if you're not going into med school) over my mental health. as if monthly OCD-induced and autistic meltdowns aren't bad enough.
it's not like i'm a semester or two away from graduating. i have a couple YEARS left. i'm still technically in my third year in my degree. i can only manage 3 courses at the very most and any more causes me to burn out and my executive dysfunction plummets
#vent#this isn't even mentioning the fact that i NEED. to get out of this house#it feels so selfish to say that but i live with people who either can't or don't want to actually learn#to better themselves#so i live with an extremely ableist person who would rather call my grandparents lazy over acknowleging the fact#that my grams does indeed have several disabilities that cause chronic fatigue and pain#or yells at her (autistic) son because he interrupts her in conversation and doesn't ask about her day#like.... sorry your rsd is so bad you have to passive-aggressively mention how you feel like no one cares#but don't be surprised when you move to the US to be with your partner and you never hear from your son again#not unless YOU call HIM#i can't tell my mom this because this is her sister i'm talking about and those two are so close#i kinda just want to sink into the void rn. i don't know what to do#i really hope i can get my autism assessment done in july or august and then i can maybe not do classes in the fall#i need to speak to a councellor and then my academic advisor#but i think i have enough courses to graduate with my associate's degree#and then i can go to the employment services agency for help finding a job#because it's. it's bad right now#long list of jobs i've applied for and it's like they haven't even reviewed my application#only one of them just went 'nope' and i was like 'okay cool thanks for the email you did not send'#edit this woman is also dating a trump supporter so like

i think having worked a retail or food service job actually is more important to not being a loser than doing drugs or having sex. the poll that showed so much of this site has never worked one of those jobs was actually way more concerning to me than any of the celibacy sweep polls
