First Date:
"Oh thank God you made it!" Today was the start of your trial. You had been arrested on the suspicion of posting leaks to Twitter and you needed a good lawyer to defend your case. Unfortunately, Saul Goodman was busy so you went with your next choice. Hiromi Higuruma, a man in his mid thirties known to take on the most helpless of defendants. Due to how crime is dealt with in Japan, prosecutors are known to be corrupt, leaving him with a 0.1% outcome rate but you were just glad that someone was willing to defend you.
"I can't promise you anything ####, but I will do my best!" He opened the doors and began to find his seat. It was then that he noticed who he would be up against. The legendary prosecutor, Miles Edgeworth. He began to scream a string of profanities in his mind and cursed the day he was born. "You can do this, everyone is counting on yo- Argh, who am I kidding? I'm screwed!" He was about to drink some of his coffee but then he remembered the Dahlia Hawthorne case and decided against it.
He looked down at his desk and picked up his photograph. It was a picture of him and his wife on their honey moon vacation in Malaysia. "I can't wait to go home and see my him." Suddenly the loud banging of the gavel rang him out of his thoughts. "Is the defence team ready?" Higuruma took a bow. "Yes your honour."
"Good. Now let us get on to the case at hand. Now, Miss ####, is it true that you are being charged with leaking highly valuable information to the public?" You glanced to your lawyer. "This is a joke right...?" The prosecutor then cut in "Disclosing sensitive information is not a laughing matter maddam!" You rolled your eyes. "Important info my ass! All I did was post some stupid pages of a manga!"
The judge then stroked his chin. "Hmm. Answer me this. What series was it?" You were shocked that the judge was even bothering with your case. "It was Jujutsu Kaisen your honour..." He then frowned. "That's too bad. If it had been One Piece I would have given you a more lenient sentence. I'm afraid the court finds you guilty! As punishment, you will have to attend a smash bros. tournament!"
You screamed. "ANYTHING BUT THAT YOUR HONOUR! THEY SMELL SO BAD! THESE PEOPLE DON'T EVEN KNOW WHAT SOAP OR DEODERANT IS!" The judge sighed. "It's either that or the death penalty..." You jumped straight up and began to cry tears of joy. "I'll take one execution please!"
"Well I guess that settles it!" The judge then banged his hammer and the words G U I L T Y appeared over your head. "Take her away, next case!" Higuruma then heard the crowd cheering and saw confetti fall from the ceiling. "You did it again Mr. Edgeworth!" The prosecutor then waived the scruffy man away. "Yes Gumshoe, I know. Now go make yourself useful!"
"WHAT KIND OF TRIAL IS THIS!? THAT'S IT, I'M BRINGING OUT MY STAND [ JUDGEMAN ] !" The creature then threw the previous judge out the window and took his seat. A loud bang was heard and then Edgeworth began to hide under the table. The door pushed open and revealed that it was prosecutor Godot. "Sorry for knocking so loud. Is everything alr-" He then looked at the situation in front of him. 'I may be blind but not stupid!' he thought. "I'm just going to check and see if we have anymore coffee..." The door then closed, the only noise being Miles sobbing and the relaxing rythmn of smooth jazz.
Judgeman then went through the inventory and skimmed through the court records. "Alright, we shall begin with the next case. Will the defendant Sukuna please take the stand?" Higuruma began to bash his head into his desk and cried. "Please not this guy again! Gege why!?"

hi, i love all your answers. they’re intelligent and rooted in reason. (there are so many toxic aot fans dear lord that I feel like most of them are just watching for Levi without understanding)
anyway, yeah, interesting view points tho!! and it’s always in the context too. Western and Asian perspectives are so different.
history’s always been written by the winners most of the time... but the Japanese perspective on expansionism and wwii is kinda tricky.
Although if you’ve seen Grave of the Fireflies, then you’d get a glimpse or an idea of the Japanese side of the story.
UGH i love my majors so much?? i genuinely think i wouldn’t be the person i am today if i hadn’t chosen them, and i know that sounds dramatic, but i think history and anthropology are just... so valuable for informing your worldview? i’m grateful that my uni offered both! and sure, some people might tell me that “well what are you even going to do with that?” but no degree has a straightforward track unless you want to be a doctor or a lawyer; and even then, there are no guarantees. 
oh quick side note because i rambled a lot and i understand if nobody reads this but i just want to say: a government is not the people, and i really hate it when people assume the worst of someone just because they were born in a certain country. yes, governments usually come to power due to the will of the people, but not always. there’s a lot of political manoeuvring and playing the system that goes on. and people aren’t stupid. at least give the everyday person time to prove themselves. 
i really wish people would stop either decreeing someone as A Horrible Person or infantilising them by being all “oh, they don’t know any better uwu they’re [insert commonly fetishised culture here]” because both are... so awful? a lot of people are open to new perspectives and willing to learn. and if they’re not, then... well, then they probably are an awful person. 
 i think an issue with being on the internet is that people tend to assume that everyone else has the exact same knowledge as they do about things, but that’s rarely the case. 
ANYWAY THAT’S AN UNNCESSARY RANT but you make a really good point about people “watching without understanding.” and i guess it’s one of the pitfalls of death of the author (and i’ll be honest i. i hate that concept i think it’s Stupid), because what isayama did or didn’t intend to do with his story doesn’t matter. aot is quite popular with the far right; so even if he wanted it to be an anti-war, anti-hate story, it’s still resonating with people who believe quite the opposite. 
and i think the trouble with fandom is that... well, by it’s nature, it tends to trivialise things. make memes (cleaning levi, pOtAtO wAiFu), cosplaying as the characters, focus on the cutesy bits, avoid talking about any greater themes or messages outside of meta posts. and aot’s fandom is so big it means that there’s no way of knowing what the general consensus on the message is. also, not everyone’s going to be consuming it critically; when i listen to the opening songs, i equate them with propaganda because of how ‘cool’ and ‘awesome’ they make the military look while fighting the titans, even though the show itself rarely, if ever, features characters slashing down their enemies left and right as they fly through the air like superheroes. but what might the person next to me be thinking? 
yeah i think a lot of people in the west just. don’t think about how... different other parts of the world are? in my very first anthropology essay, the marker told me not to use ‘the west’ as a monolith when talking about culture because even among the three english speaking countries, there’s a world of difference. and while it might not seem like that at first, there really is. the thing about culture is that it’s pervasive; we often don’t recognise our own because it’s in everything. and it’s more than just food, dress, traditions. no-one is ‘without culture’, even if they think they are. 
and local differences have more of an impact than people think. my old roommate is ethnically chinese, but she’s lived her entire life in malaysia, meaning that culturally, that’s what she resonates with. and the chinese community living in malaysia have a different culture than chinese people living in china, or chinese people living in america. 
i think something else interesting about the “history is written by the victors”... world history is for sure, but i feel like local histories tend to be written in favour of it’s country of origin? at best, they’ll begrudgingly talk about some of the awful things they did in the past, but they often like to gloss over it. 
and i have seen grave of the fireflies! albeit, i think i was too young to watch it at the time; it scarred me sfdjfdslkj

Sundance 2020: Day 5

Number of Films: 3 Best Film of the Day: Minari
Palm Springs: A difficult comedy to write about, as it involves a plot twist (revealed early on) that is best no revealed. Let us say, then , that Max Barbakow‘s comedy updates and expands upon a well-regarded previous film’s philosophies in ways that feel sufficiently fresh and soulful. Andy Samberg stars as Niles, a loose, devil-may-care dude stuck at a wedding in the desert, and trying to make the most of his experience. Cristin Milioti is Sarah, the older sister of the bride, who is every bit as cynical and self-loathing as Niles is irresponsible and irascible. Naturally, the two of them find each other and start to hang out, but a lot more is in store for Sarah than she can possibly understand, including the sudden appearance of Roy (J.K. Simmons), a dark-clad commando with a crossbow, who seems to have it totally in against Sarah’s new-found friend.  Samberg’s greatest comedic aspect is his mouth, which can shift instantly from leading man handsome, to hopeless goofball. Meanwhile, Milioti is fantastic in a role that requires her to carry the emotional weight of the film through to the end. Smooth without feeling slick, much as its obvious predecessor, it manages to pack a significant emotional klop without being cloying.
Minari: Lee Isaac Chung’s semi-autobiographical film about a South Korean family who move from California to Arkansas in order to start a vegetable farm is a joy to watch. Not just in the sense that its so precise and well-made, but also because it embraces such a wide swath of life, good, bad, indifferent, and doesn’t try to convince us, Hollywood style, that any truths can be simple unto themselves. When Jacob (Stephen Yeun) first moves his clan to the countryside, his wife, Monica (Han Yeri), is deeply unhappy with their predicament, his children, daughter (Noel Cho), and 7-year-old son (Alan S. Kim) are struggling, and his attempt to turn the land into a worthy investment questionable. But through perseverance, hard work, constant negotiation, the arrival of Monica’s mother (Yuh Jung Youn), and, it must be said, the willing support of the locals, the family figures out a way to improve their lot. There aren’t easy answers to any of this, to Chung’s credit, and even the ending, the substance of which you can predict halfway through the film, is handled in a way that feels organic and downplayed. The film is certainly charming, but that’s not to diminish its straightforward approach to its characters’ plight. It doesn’t shy away from the their difficulties, and as a result, it doesn’t cheat towards smarmy emotional closure.
Assassins: One of those docs where the scraps of knowledge you might remember on a specific subject prove to be laughably off-base. In 2018, Kim Jun-nam, the older brother of North Korea’s supreme leader, Kim Jun-un, was brazenly murdered in a Malaysian airport by two young women wiping an extremely dangerous nerve agent on his face. Once captured, the women were initially condemned from all sides, facing the death penalty for their alleged crime, and seemed doomed. But gradually, with the help of their lawyers and the diplomatic work of their home countries (one was Indonesian and the other Vietnamese), a very different sort of story began to emerge. Ryan White has made a captivating doc on the rigorous planning of an international murder, the peculiar legal system of Malaysia, and the more-than-disturbing nature of North Korea’s current political climate.
Tomorrow: I start my day with Robert Machoian’s The Killing of Two Lovers; check out Braden King’s The Evening Hour; run as quickly as possible to take in Michael Dweck and Gregory Kershaw’s doc, The Truffle Hunters; try and make it to Edson Oda’s Nine Days; and finish out a busy schedule with Jeff Baena’s Horse Girl.
Into the frigid climes and rarefied thin air of the spectacular Utah Mountains, I've arrived in order to document some of the sense and senselessness of the 2020 Sundance Film Festival. Over the next week, armed with little more than a heavy parka and a bevy of blank reporter's notebooks, I'll endeavor to watch as many movies as I can and report my findings.

Dark, with silver at the sides - the style is bedhead meets brushed-by-hands. (Made famous by Dean Martin, you know.)
3. What color are your eyes?
Blue or grey, depending on the light.
4. Do you wear glasses?
Yes, but only if I want to see things. (I often take them off for photos because I’m self conscious.)
5. Do you wear braces?
Never - though I probably should have...
6. What is your fashion style?
Batman / fandom for sleeping, light casual for day. (Flannel in winter~)
7. Full name?
Never you mind.
8. When were you born?
The end of August - I was an induced birth, so as far as I’m concerned, I never enjoyed winter.
9. Where are you from and where do you live now?
Born in Sydney, moved to where I am now when I was 2. Been here ever since. There is nothing. Send help.
10. What school do you go to?
Just the local primary and high, though I attended Griffith university briefly while pursuing journalism. (I left after discovering that nobody pays them anymore since people are all too willing to write for peanuts. And newspapers don’t mind the typos.)
11. What kind of student are you?
I like books over websites, because books are sexy. For the better part, I’m the ‘I want to learn this but right now I have a headache and I’m exhausted, show me snippets tomorrow” type. Oh! Or the “Now that I’m at work, I know exactly what I should have studied! Oh, it would have been easy! When I get home...” 
12. Do you like school?
School was bad. I went to adult school though (Tafe here) and it was a fantastic experience. I’d love to go again but the nearest campus is an hour away - you go broke driving there just three days a week. Maybe in the future, though.
13. What are your favorite school subjects?
I liked electronics and history. History was my best subject.
14. Favorite TV shows
Oh ho ho ho. Okay : not many Live actions - 30 Rock, Ash vs Evil Dead, and I could easily just watch old BBC/classic shows like ‘Allo ‘Allo or Get Smart. For animation : Tangled (duh), Duck Dodgers, Batman (especially anything with Kevin Conroy and Mark Hammil), Ducktales ‘17, The Venture Bros. and old Adult Swim stuff, like Harvey Birdman. (The Switch Off Brain stuff.) I sometimes watch/listen to American dad, but not over and again like the others on this list.
15. Favorite movies?
As much as I like Tangled, I’d have to say one of my fav films is Operation Periscope. (And like most movies, I can’t remember the last time I watched it. Movies are so long!)
16. Favorite books?
Ugh, aside from art and resource books, I can’t remember the last time I really sat down and read one. Does Batman count? Please tell me it counts...
17. Favorite pastime?
What’re those? I’m trying to make drawing as much fun as it is a study thing, but pastimes probably include doing as little as possible. Still, that’s.. probably going to change fairly quickly, now.
18. Do you have any regrets?
I regret how much money I spent on Transformers in my life. Oof.
19. Dream job?
It used to be voice acting, but now I’d love to be an artist. Not just hirable, but maybe good enough to teach a little. Also I totally plan on being in costume whenever I do a public appearance. Will I bet Inspector Gadget, or Adam West? You’ll find out when you get there!
20. Would you like to get married someday?
August is our fifth wedding anniversary. (I met her here!)
21. Would you like to have kids someday?
Not for us, no.
22. Do you like shopping?
I’m a tart for just browsing things. I need to be controlled. A few weeks ago I had a stressful time as being a carer so I got “comfort plastic.” Cause I really needed that Lego Bat-sub and Hairavan. (I blame that last one on Bex.)
23. What countries have you visited?
Doha, Malaysia and Georgia. (Though Doha was just the airport on a lay over.) We went to Malaysia for the weekend once. .... I’m not kidding. We don’t talk about Malaysia and what happened there anymore. We don’t.
24. What’s the scariest nightmare you’ve ever had?
Ugh, last year a religious old biddy tried to destroy our family - fun fact, she’s still around! (It’s okay - as soon as we threatened to get a lawyer she began to avoid us.)

See above. She’s 60, deranged, and a Jesus fanatic.

I do - she’s currently sleeping after falling asleep while watching me play Arkham City for the 54th time.

Capitalism
 To me, capitalism is one of those concepts that, in theory, is sound and based on common sense.  After all, at its core it is a monetary system of reward for hard work and initiative, often involving significant risk.
Those willing to dedicate and apply themselves are rewarded proportionally, often leading to advancement, growth and prosperity – sounds fair to me.  Certainly everyone, regardless of effort, shouldn’t be rewarded equally.  Many folks, myself among them, are pretty much content to hold down a steady job that provides a modest, comfortable income and at the minimum, some type of health care and some basic “bennies”; everyone is different, and this works out well within the system.
 The problem starts when this system goes unregulated, and the opportunity becomes not fairly available to all.  When over time, this dream becomes a runaway money train with only a small, select group of privileged passengers.  In short, unlimited greed while the rest are exploited; the “rest” are left to build the tracks and walk.  
 So, where did it all begin?  Well, here in America anyways; what gave America the template for big corporations and their punitive relationship with their labor force? There are a lot of facets to the horror and history of human slavery in this country, but to be honest, I was surprised to find out that this was one of them.  I became aware of this thanks to a recent piece featured in the NY Times, which is running a series of stories this month entitled “The 1619 Project” to mark the 400 year legacy of slavery here in America.  It’s quite a lengthy read, so as best I can I will cover the basics, and of course, for the full story in detail you can refer to the article.  
 To lay the groundwork for this blog:  
 Did you know almost half of the American population makes under $15/hr? That middle class wages (when adjusted for inflation) have been stagnant since the late ‘70s while CEO wages and benefit packages have increased exponentially to obscene amounts?  That the number of Americans receiving food stamps has increased 40% over the last ten years, yet we have over twice as many billionaires?  That the richest 1% of America owns 40% of our nation’s wealth, while a larger share of working age people live in poverty here than in any other nation belonging to The Organization for Economic Cooperation and Development (O.E.C.D.)?  
 This impartial organization also rates its capitalist members in the category of worker rights and how easy it is to fire them. As far as worker’s rights, the U.S. shares second to last place with Malaysia, and out of 71 nations, the O.E.C.D. scores our country #1 in ease of being able to fire workers.  In other words, “You’re Fired!” isn’t just our reality show president’s favorite tag line.
 So let’s crack open the history book you won’t find in your average school curriculum, because here in America we much prefer our taught legacies with plenty of smoothing out, touching up, masking of flaws, and finishing with a thick, glossy coat of varnish.  
 There was a time, just before the Civil War, when the Mississippi Valley was home to more millionaires per capita than anywhere else in the United States.  Cotton grown and picked by slaves was the nation’s most valuable export, a font of phenomenal wealth.  New Orleans suddenly had a denser concentration of banking capital than New York City, and the backbone of all this selective wealth was the thriving slave trade, where the combined value of slaves exceeded that of all our factories and railroads.  Can you imagine?  An enterprising person with an entrepreneur’s spirit and ambition finding himself in a new world of seemingly endless natural resources, cheap land, and free labor? Its a capitalist’s Disney World of profit, filled with promises of limitless growth.
 Well, OK, that was hundreds of years ago – what does that have to do with the workings of large, modern corporations today? Well, other than the obvious Golden Rule of Capitalism: maximum productivity out of your workers while spending the least amount of money on wages, health care and benefits…
 Have you ever fired up your PC or laptop at work in the morning only to see yet another memo from management?  A memo that came from your “team leader”, who got it from lower management, who got it from mid-level management, who got it from upper management, who got it from regional management, who got it from the “Big Boss”, who first had to get it OK’d by the BIG, BIG Boss?  Well there you have it, the inner workings and corporate-like hierarchy of a typical slave labor work force on a typical large plantation.
 The owner (or group of owners) supervised a top lawyer, who supervised another lawyer, who supervised an overseer, who supervised multiple bookkeepers, who supervised a group of enslaved head drivers and specialists, who finally supervised hundreds of slaves.  Like today, accountability was foremost and strictly adhered to.  Laborious and complex spread sheets were developed by hand for the first time in American industry, and volumes of data were kept to breakdown all aspects of bale production.  Everything was tracked, recorded, quantified, analyzed, and accounted for, including meticulous record-keeping of a slave’s age, sex, when bought, performance, expected productivity over the years, potential value, breeding history, etc.
 Sound familiar yet?    
 Who hasn’t endured the sweat inducing “performance review”, where you are essentially forced to appear before the low-end management judge to plead for your job, bringing evidence of your worthiness to the company?  You may want to feel lucky that today you might get an upbraiding, maybe a negative mark that will go on your record.  The poor black slave was faced with walking that fine line of performance, where his production must be maintained at a level of competence and profitability without being too much of a pacesetter in the fields; that not only got his fellow workers a cruel beating, but himself included if he (or she) didn’t maintain that level every day.
 More than once over the years, when reading about the millionaires through our history, the billionaires and mega-billionaires of today, I’ve pondered the question: when is enough, enough?  Is there even such a thing as “enough”?  Is there ever a point where you sit back, think about throwing in your cards and spending the rest of your life enjoying your bottomless bank account and investments?  
Kind of a moot point.  A person who had a single billion dollars at their disposal today would have to spend $40 million a year for 25 years before they ran short of cash; which would mean burning through $3 million a month, or over $100K a day.  And that’s just a single billion… I recently read an article that shed some light, or clarity onto this supposition, and according to the author, at some arbitrary point it does become no longer about money.  It becomes all about power and position among your peers.  Your image, your perceived position in this exclusive pack – who are the big dogs at the front of the sled.
 My apologies if you find this all too unsettling, or uncomfortable; in which case feel free to refer to one of those Board of Education sanctioned history books where you can read the softer, more palatable version: how white Europeans came over to the New World, claimed it theirs (in the name of Manifest Destiny), got rid of those indigenous  savage heathens who were ignorant of the one true god and didn’t know how to exploit the land properly anyways, and soon began shipping over the “darkies” from Africa to give them a much more fulfilling life on our cotton and sugar plantations, where they could contently live out their lives singing happy spiritual songs in the fields and enjoying a higher standard of living, thanks to the largess and Christian charity of “the masta’”. Who Owns Your China/Thailand/Taiwan/Vietnam/Indonesia/Malaysia/Mexico/Turkey/Cambodia Factory and Why it Really Matters
At least once a month someone will tell one of our China manufacturing lawyers that they don’t need a China-centric contract with their China-based manufacturer because their China-based manufacturer is owned by an American or a European company. To which we always say, “no it isn’t.”
How do we know this? Because no American or European or Australian company (or any other non-Chinese company) can own a Chinese factory directly. It is possible for an American or European or Australian company to own a Chinese company (a WFOE maybe or a China Joint Venture) that in turns owns a Chinese factory, but the odds of this are really slim. I don’t believe any of our China lawyers have ever encountered a foreign company that owns a Chinese company that owns a Chinese factory that does contract manufacturing for third party companies. Something like this is possible, but it is extremely rare.
So what does it mean when a foreign company claims to own the Chinese factory from which it is trying to get you to place your orders? This pretty much can mean one of the following two things:
1. The foreign company that claims to own a Chinese factory is flat out lying. It is amazing how often our China manufacturing attorneys see this and when I say “see this” I mean the foreign company puts in writing “that your products will be made by factories we own in China.” If you see this, you probably should run away. Or maybe you stay and if you ever have a problem you see the foreign company for misrepresentation. Our international litigators have done that and gotten some pretty large settlements.
2. The foreign company is fudging the truth. A lot. This occurs when the foreign company speaks of having your products made by “our factories” in China. If you push them on what they mean by “our factories,” they will usually state that these are factories with which they have worked for many years and know well and trust.
Why though does any of this matter? As someone whose law firm has been involved in many lawsuits on this one issue, let me tell you that it matters a lot. It matters because companies that believe they are buying their products from an American or European or Australian company (hereafter referred to as the are generally going to be willing to pay more for the “safety” that comes from doing business with an American/European/Australian company and they also are likely to be much less careful about the contract they sign and about protecting their IP.
What instead ends up happening is that the foreign company enters into a contract with an American/European/Australian company with no legal connection with the Chinese manufacturer making their products. The buyer has no contract with its Chinese manufacturer mandating that Chinese manufacturer deliver quality products on time and at a certain price and no contract with its Chinese manufacturer prohibiting the Chinese manufacturer from using its IP or from selling your product to your customers.
Almost invariably, if you give this sort of tripartite relationship 6-12 months, you will have problems that are extremely difficult or even impossible to solve.
In China Sourcing: Does Your Sales Contact Really Work At The Factory? Renaud Anjoran wrote of the importance of making sure you know who actually owns the factory in which you will be having your products made. In his post Renaud focuses on another very common type of situation where the foreign buyer ends up not knowing who the owner of its manufacturer actually is and ends up dealing with a non-owner. Per Renaud (and also what our China manufacturing lawyers have so often seen), the following is common:
The purchaser researches Alibaba and has about an 80% chance of ending up with a trading company.
The sales contact person keeps saying he/she works “at the factory”, but they don’t.
The supplier’s company name (which will receive the payment) is that of the trading company. It usually doesn’t include the words “Trading” or “Import & Export”. (They still do NOT look like a manufacturer’s company name, but foreign buyers seldom know that.) Alternatively, that company is in Hong Kong or Taiwan and is presented as “the factory’s sales office, for greater convenience”.
The purchaser does not research and is misled all along.
The situation often becomes clear when things have gone wrong… and the whole supply chain needs to be re-built.
In the last year, with so many foreign companies moving their manufacturing from China to places like Taiwan, Thailand, Vietnam, Malaysia, Pakistan, and Mexico, among other places, we are seeing this same sort of deception again, but with a new twist. This time around, about 80 percent of the time it is a Chinese company that is claiming to own the factory in some foreign company and it usually insists that because of that there is no need even for a new contract. But we are finding — so far, without a single exception — that the Chinese company with which our client had a contract for manufacturing in China does not directly own the factory in the country in which it claims to be doing its manufacturing. In other words, the existing contract will be nearly 100% worthless for protecting your company when manufacturing in that third country.
The bottom line is that if you are going to have your products made in Thailand or Vietnam, it will almost always (but not always) make sense for you to have your contract with the company that will be making your products in Thailand or Vietnam and to have thatt contract written for Thailand or Vietnam pursuant to Thai or Vietnamese law. The same holds true for Taiwan, Malaysia, Indonesia, or wherever. If your contracts is not with the actual owner of the factory in which your products will be made and tailored to the country in which you are manufacturing, you are asking for trouble. Luck might be running out for chubby Jho... .
But It Would Spell Trouble 
For Ex-PM Najib Razak...
What former Inspector-General of Police (IGP) Mohamad Fuzi Harun could not do in 1 year since the new government took over, it seems the new IGP Abdul Hamid Bador could probably do in 1 month. The new police chief has just dropped the strongest hint that luck might be running out for chubby Jho Low, the partner-in-crime of former Prime Minister Najib Razak. During a police programme at the Taman Tun Dr Ismail Bazaar Ramadan on Thursday (May 30), IGP Hamid Bador was asked about the status of Jho Low whose full name is Low Taek Jho. Hamid Bador, who took over as the new police chief from Fuzi Harun on May 1, said – “Insya-Allah (God willing), when I say we are sure of bringing him back soon, it means soon.” But was IGP Bador, like his predecessor Fuzi, blowing hot air just to boost his popularity? After all, there had been too many false starts – fake promises even – from the Royal Malaysia Police under the previous leadership of Fuzi, one of 17,000 political appointees of the previous corrupt regime of Najib Razak. Mr. Fuzi went on compulsory retirement from May. Mr. Fuzi was so controversial that PM Mahathir had to assure the public that the new IGP (Bador) will conduct the investigation into allegations that the Special Branch was behind the kidnapping or abduction of Pastor Raymond Koh and a social activist Amri Che Mat. Fuzi was the Special Branch director at the time of the disappearance of the two men in 2017 and 2016 respectively. Mohamad Fuzi Harun, during his tenure as the head of the Royal Malaysia Police, one of the most corrupt institutions in the country, was largely condemned for protecting his crooked boss – PM Najib Razak. His loyalty to Najib was proven when he declared in March 2018 (2 months before Najib regime collapsed) that there was no link between Jho Low and 1MDB scandal.
IGP Abdul Hamid Bador 
The disgraced Fuzi said – “Based on the investigation, Low never worked for the company nor did he make any business decision for the company. All business decisions were made by the 1MDB board of directors.” He also defended Najib from the 1MDB scandal, claiming that the seizure of the Equanimity yacht in Bali was merely a civil forfeiture against Low and not against 1MDB. For almost his entire life as the country’s police chief, Mohamad Fuzi Harun had never been serious about apprehending Jho Low. Even after Najib and his Barisan Nasional government lost everything in the last May general election, Fuzi had continued singing the same old song – that Jho Low had yet to be found and efforts to locate him were still underway. Last week, IGP Bador revealed that his boys have obtained new leads of Jho Low’s whereabouts, thus promising that the police would do their best to bring the fugitive back home to assist investigations in the 1MDB scandal. The police chief, in urging Jho Low to surrender, has promised to guarantee the safety of the fugitive and his family – if they come back to Malaysia. Mr. Bador said – “I encourage them (Jho Low and his accomplices) to come back and don’t waste our time, for they can’t run forever. We have laws, so return. Do not only issue statements remotely through lawyers, denying this and that. Why does he himself not return here? I give my assurance of safety for his family and himself. Come back and face the law.” The police also exposed that besides Jho Low, the authorities are also trying to bring the fugitive’s 6 right-hand men out from hiding. In what appeared to be a message to Jho Low that the authorities were not bluffing and knew more than he thought, the top cop said Jho Low’s move to hide behind his lawyers in Macau and Hong Kong when making statements is nothing short of cowardice.
Fugitive Jho Low
Abdul Hamid Bador’s performance so far in tracking down Jho Low has been positive and commendable. At least, he has been proactive hunting the fugitive, unlike his predecessor Mohamad Fuzi Harun. However, many aren’t sure the police can be trusted, not to mention it was strategically dumb to raise the alarm before Jho Low is arrested for real. But Hamid Bador’s assurance of safety for Jho Low and his family suggests that certain “hidden hands” are out to “silence” him from testifying against Najib Razak. After all, Mongolian Altantuya Shariibuu was killed and her body was exterminated with military grade C4 explosive during Najib’s scandal involving the controversial purchase of French Scorpene submarines. Jho Low looks like a man who still treasures family dignity, or whatever little left of it. He is believed to have had siphoned billions of dollars from 1MDB. He can absolutely live comfortably for the rest of his life, even as a fugitive. Yet, he is fighting to get back a three-storey house in Tanjung Bungah Park in Penang, the RM15 million properties seized by the authorities under AMLA law. “My parents worked tirelessly for many decades to provide their children with a safe, comfortable upbringing. Before I was born, my mother enjoyed good success in her investments. It is thanks to these prudent decisions that they were not only able to purchase and build 69, Tanjung Bungah Park, but also selflessly donate to and support their local communities for decades similar to my late grandfather,” – said Jho Low. Clearly, there were some family heritage and sentimental values in the house that the 37-year-old Penangite would like to preserve. And this could be his Achilles’ heel. Besides, it’s not a long-term solution moving between hotel suites and luxury apartments around Shanghai, Hong Kong and Macau, especially with his wife and the need to provide a normal life for his two children.

What is still unknown is the secret deal behind the closed doors struck between both governments of Malaysia and China after the re-negotiation of the East Coast Rail Link (ECRL) and the revival of Bandar Malaysia mega projects. As Mahathir throws more supports behind Beijing, the latest being Huawei, it’s a matter of time before Jho Low loses the protection altogether. But if it’s true that IGP Hamid Bador is moving closer to detaining the country’s most wanted fugitive, it would mean serious trouble for Najib Razak. With nowhere to hide, the former premier’s hotshot lawyer, Shafee Abdullah, has thrown Jho Low and Joanna Yu, Najib’s relationship liaison manager at Ambank, under the bus – blaming the duo as the real culprits and criminals. Attorney Shafee declared in court – “My client does not deal with his account himself. He was misled and is a victim.” The strategy was to lead the court into believing that fugitive Jho Low was the mastermind who had allegedly scammed and misled Najib Razak. Najib’s lawyer has also accused Nik Faisal Ariff Kamil (former CEO of SRC International) of conspiring against his client. In exchange for his extremely damaging testimony against Najib, and the returns of tens of billions of Ringgit, Jho Low might be required to serve between 1 to 3 years imprisonment. That is still a good deal since he can live a free life with his family thereafter, not to mention a very comfortable lifestyle as he would definitely hide some money elsewhere for retirement. Hamid Bador has very little reason to win the popularity contest. He despised Najib’s 1MDB scandal from the beginning and as a result, he was transferred out of Special Branch as deputy chief. He had chosen early retirement in 2015 instead, until Mahathir got him installed as the country’s police chief early this month. He also knew people were fast losing patience after tons of broken promises from the police. Therefore, for the IGP to confidently tell all and sundry that Jho Low is expected to be detained soon, it carries weight. One has to remember that Hamid Bador was the second man in the Special Branch, the intelligence agency attached to the Royal Malaysia Police. And there’s a reason why Najib had not dared fire him, but instead transferred him to the Prime Minister’s Office. Like it or not, Bador is the best bet to bring Jho Low in. - FT

Mazlan juga boleh tumpang semangkok kononnya rayuan dialah membuka hati Azmin untuk bagi duit raya kepada peneroka. Tetapi dalam hal ini kesediaan Azmin menyediakan peruntukkan untuk peneroka itu sedikit sebanyak kerana ada campur tangan Anwar Ibrahim juga. Bagi menyelamatkan keadaan, beliau telah dimasukan ke Pusat Latihan Tentera di India pada awal umur dan oleh kerana beliau bukan rakyat India serta bagi menghormati datuknya yang ketika itu Sultan Johor, beliau telah dianugerahkan pangkat Kapten Kehormat ; ini berbeza dengan pangkat Kapten sebenar. 18. Kini beliau menggelarkan diri dan memakai uniform dan bintang sebagai Major General dengan jumlah Askar Setia Timbalan atau Johor Military Force tak lebih 200 anggota sahaja. 19. Sudah sampai masanya Kerajaan khasnya Kementerian Pertahanan mengkaji dan jika ada asas kukuh, mengisytiharkan apa yang dilakuan oleh budak ini adalah bertentangan dengan aturan peraturan ketenteraan - ini bagi menjaga imej Angkatan Tentera agar tidak terus dicemari. 20. Jika sifat dan perangai celupar, biadab, samseng dan kurang ajar ini gagal diperbaiki ia bukan sahaja memalukan rakyat dan negeri Johor malah ia pasti akan merugikan keseluruhan Institusi Raja Berperlembagaan itu sendiri. 21.  Jangan biarkan setitik nila merosakan susu sebelanga. 22. Jennifer – I have been to Singapore many times on business trips since the company I work for is headquartered here. When they asked me to stay and work here for the extended duration, I was pleasantly surprised and readily accepted the offer. I was quite excited to stay independently and yet not too far away from my home in Malaysia.
Since my office is in Paya Lebar, I was suggested by one of my colleagues to get a place nearby and I quickly rented an HDB in Eunos that was within my budget and yet quite close to the work location.
Truuue – What kind of problems you had?
Jennifer – I was not quite aware of the renting terms and conditions and had no time to focus on the nitty-gritty when I relocated. There was a standard Tenancy Agreement (TA) that was prepared before I moved into the place and I managed to meet the landlord just once when he handed over the keys. He seemed quite friendly and helpful. He even offered me a lift to my office when he heard that I would be going to the office after taking the house keys from him.
Truuue – So there were no issues in the beginning. When did it start?
Jennifer – No issues at all! I was quite happy and had no doubt that everything would be great.
The problem started when I was asked to pay my rent in advance by the end of the month. I moved in on 5th of a month and in my TA it was mentioned that I should be paying my rent on the 5th day of each calendar month.
However, by month end, I received a call from my landlord who asked me to pay the next month’s rent without a miss on the same day or next to avoid any issues. Nothing stuck me and I agreed to pay him but was a bit offended by the tone of his voice. Later that day when I spoke to my office colleagues about it, they asked me to check the TA and then I realized that my landlord’s demand was completely unlawful.
I called him back to remind him about the TA and that was when he got abusive and started shouting at me. I was in tears and immediately disconnected the phone. But he called again and again till I answered his call after sometime. He told me that he could throw me out of the house and charge me penalties for not paying him on time. He even went to extent of reminding me that he knows where I work and he can come to my office and talk to the company if I am not willing to follow his terms.
Truuue – How this got resolved?
Jennifer – Not easily. I had to tell my father and ask for help. Luckily his friend is a lawyer in Singapore. I was scared and I already paid but did not want to extend my stay in that place for one more day.
I moved out and started staying with one of my friends. In the meanwhile, my father’s friend had a chat with my landlord. This discussion went on for a few days and after that, I was told I could move out completely without any problem.
Still, I lost nearly $1000 from the advanced deposit, I never received the complete money in return.

While thinking about the idea of an altruistic, fair public option for health insurance, I started trying to figure out why something like it doesn't already exist. (Or maybe it does?) The assumption seems to be that health insurance companies are causing problems through systematic greed, and the public option would help keep them honest. But, if this is the case, why isn't there an organization doing this already? Why don't the good, people, such as the ones that take less-pay than they could in other sectors to run major charitable organizations, start a good health insurance company that doesn't do any of the bad things that the other insurance companies do. I need help choosing my first car. Mustang vs Mustang vs MINI?
I will be buying my first car soon and I have a few choices to pick from. I'll have to pay for everything myself (insurance, fuel, maintenance, etc.). I'm trying to narrow my choices by choosing between a 2005 Mustang v6 (has 50k miles and is an auto :c) and a 2004 Mustang v6 (has 80K miles and is a manual c:). The first step to finding the right venture capital firm for your company is to know what stage your company is at right now. After figuring out the stage of your business, you can start applying to venture capital. Involvement: There are two types of VC firms. The first group are the VCs that are very involved. These type of VCs typically do not invest in a lot of companies as they do not have the time to be highly involved in all the companies that they invest in. Who Pays the Tariffs on China Imports? President Trump vs. CNN and What YOU Can do NOW to Reduce Your China Prices
On May 5, President Trump tweeted that he would be raising tariffs to 25% on $200 billion worth of Chinese products and that he would eventually impose this tariff rate on pretty much all products from China. Since then the media has been all over the map on who will be paying for these tariffs. On the one side, we have President Trump and the media favorable to him stating, or at least implying, that “China will be paying these tariffs.” On the other hand, we have the media stating or at least implying that the “U.S. consumer will be paying the tariffs by way of increased costs.”
Well guess what and no surprise, it ain’t that simple. Truth is a ton of people all over the world will be paying the tariff. Let me explain how this might go down and let me say that my firm’s international lawyers and international trade lawyers have already seen how this goes down from the last round of US tariffs against Chinese goods and Chinese tariffs against US goods.
With the onslaught of tariffs, companies that import Chinese products into the United States are facing price increases and our China lawyers are getting an earful about this from our clients that sell their products to big retailers like Walmart and Target and Home Depot, etc. Our clients with super strong brand names and eye-popping profit margins are — at least for now — remaining calmer. Some of our clients have flat out told us that they don’t “really care” about the tariffs. We have a client that pays around $60 for the products it has made in China and then it sells those products for $1700 to $2100. How much should it care about a $15 price increase? We have another client that pays 20 cents for the product it has made in China and it sells that product for $12. How much should it care about a 5 cent per unit price increase? So yes, the tariffs do not fall equally on all.
But no matter your profit margins (with some exceptions) and no matter to whom you sell your products, now is the best time to be doing two things: 1.) looking into the possibility of at some point diversifying or moving your supply chain out of China, and 2) trying to get your China suppliers to lower your product pricing. Our international lawyers are working nearly non-stop in helping our clients diversify their manufacturing to countries outside China — so far this has mostly been to other Asian countries, such as Vietnam, Cambodia, the Philippines, Malaysia, Pakistan, India and Thailand, but also to Mexico, Eastern Europe, Portugal, and Spain and even to Canada and the United States — more so after the announcement of the “new NAFTA” agreement, a/k/a the USMC.
This post is going to focus on analyzing who in the end pays the China tariffs, yet in doing so it also sets out some oof the steps you should consider taking now to reduce your China manufacturing costs.
I will begin by explaining who will pay the 25% Trump tariffs and I will use a widget as my example, using the following assumptions.
Assume China Factory was manufacturing its widgets and selling them for $100 each.
Assume European Widget Company was buying these widgets from China Factory for $100 each before the tariffs and selling almost all of those widgets in the United States wholesale to a bunch of Big Box Retailers for $140, who in turn sell them at retail for $280.
Assume that China Factory/European Widget Company widgets will now have to pay a 25% tariff and further assume this means European Widget Company’s total cost for the widgets (as landed in the US) just went up to $125 because of the US tariffs.
What happens next? Does China the country or China Factory turn around and say to European Widget Company that it can feel European Widget Company’s pain and it badly wants to alleviate that pain and because China the country feels the same way it is now further subsidizing China Factory and so China Factory will now cut its widget prices to $75 so that European Widget Company’s landed US costs will remain at $100 and there will thus be no change in US pricing and China will implausible pay the tariff? Of course not.
Does European Widget Company say to China Factory Company, hey that’s really too bad about the U.S. tariffs but we all love America and so we will just pay you the same $100 we have always been paying you for your/our widgets and we will just keep selling the widgets to the US big box retailers for $140 so that we incur all of the losses from the tariffs and so neither China nor the US will be impacted in the slightest. This scenario is equally implausible.
Now let’s throw in some more assumptions, based on what happened with previous rounds of US tariffs against Chinese goods and what to a certain extent is already happening because of this round of US tariffs against Chinese goods:
China reduces its income tax rates for Chinese export manufacturers, thereby reducing its overall costs by 4%.
China increases its VAT rates for Chinese export manufacturers, thereby reducing its overall costs by 4%.
China pushes down the value of the RMB, thereby increasing the amount in RMB Chinese export manufacturers get from their sales in dollars or Euros by 2%.
So right there we have a 12% reduction in costs for the Chinese manufacturer. Note that the numbers above are very rough calculations and individual valuations will vary.
What should and what will the European Widget Company do in light of the above numbers? It will go to China Factory and say something like the following:
Monsieur, as you well know, times are tough these days in terms of our selling your/our widgets to the United States because of the new and onerous tariffs. We are essentially having to pay 25% more for them than if we were to get them from some other country. Speaking of other countries, did I tell you that we’ve been looking at having some of our other products made in Vietnam or Thailand and I went to both places last week and both were so nice and they both have such great food and I was surprised at how many people in both countries spoke French.”  All this got me to thinking that if we were to have at least some of our widgets made in Vietnam and/or Thailand, we would be free from the 25% tariffs and free from all of this acrimony and risk tied in with the US-China relationship. I have a friend who is saying that he thinks the United States and China will at some point cease all trade between them. I don’t think that is possible, do you?
Maybe more importantly, I am hearing that because of income tax reductions and VAT rebate increases and the devaluation of the RMB — and who knows what else the Chinese government is doing to subsidize Chinese manufacturers these days — your manufacturing costs must be done like 15% to 20%. With all this it seems you should cut your pricing to us by 20%. I know this will cut into your profits but our profits are going to get cut as well, no matter what you do and no matter what happens and seeing as how we have had this great relationship with you for the last 8 years (including our being willing to overlook that time early on when you sold our product in the grey market out the side door or when we learned that you had gone off and registered OUR trademark in China and we had to convince you to assign it to us or the time you reduced the steel content in our widgets from 20% to 5% to save money and we only learned of this when they failed and then all you gave us to make up for this was a 5% discount on our next set of purchases? ), don’t you think it only fair that our two companies share in the profit losses here? Gosh I would hate to spoil all this by moving our widget production to Thailand or Vietnam, which is what my General Manager is saying we should do.
And in the end, China Factory reduces its prices to European Widget Company by 12%.
European Widget Company, is now paying $88 for widgets for which it was paying $100. If you add the 25% tariff to the new $88 price, European Widget Company is now looking at a new $110 US landed price.
Does European Widget Company then go to its Big Box Retailer buyers and say, hey, you guys have always been so great I am going to keep selling you our widgets for $140 so your profits are not impacted? No. Does European Widget Company go to its Big Box Retailer buyers and say, hey, because of the 25% tariffs I am going to have to increase my sales price to you by $25 and so I am now going to charge you $165 per widget. For just a moment, let’s imagine European Widget Company does this. How will Big Box Retailers respond? There is a 99+ percent chance they will tell European Widget Company no way and they will then talk about how maybe “we should just start having our own widgets made in Vietnam or Thailand” and they very well might. For this reason, this scenario is very unlikely to happen.
A more realistic scenario would be for European Widget Company to go to Big Box Retailers and say that its costs have gone up and that it is working really hard to diversify its widget production outside of China and it has done some exploratory trips to Vietnam and Thailand and it will soon be testing out some widget manufacturers there but in the meantime, it is going to need to raise its prices by $7 and can that work. The Big Box Retailers will say now and trot out their own Vietnam/Thailand/Malaysia/Pakistan/Mexico/Indonesia/India/Philippines scenarios and in the end agree to pay $2 more per widget. And then Big Box Retailers will flip around and raise its retail widget prices anywhere from zero to five dollars.
So in the end, the China government, the China Factory, the European Widget Company, the Retailers and the Consumers all end up paying some portion of the 25% tariffs. Of course the portion will vary depending on profit margins and the market and the industry and the product and supply and demand and the price elasticity of demand and the Chinese government and the companies involved and a whole host of other things, but the above scenario is not a terribly unrealistic one and it mimics in some ways the scenarios our international lawyers saw play out during the last round of tariffs.
So what about the flip side. What about the soybean farmers in the United States who are now likely to get socked by Chinese tariffs against their soybeans. Here is how I see that playing out. These farmers will likely be hurt badly in the short term but they may end up barely being impacted in the long term. How can that be when the US at one time was selling approximately $15 billion in soy beans to China, which constitutes around 60% of their production. They will all be wiped out right? Wrong. I am not for a minute going to tell you that they will be fine because that is not likely to be the case but I am going to tell you that soybeans are essentially a commodity and if the US stops selling its soybeans to China, China will get its soybeans from other countries and a big chunk of the sales those other countries used to make to countries other than China will now go to US soybean growers. I mention this not to minimize any impacts, but just to make clear that US soybean farmers are not going to lose $15 in sales a year.
Bottom Line: US tariffs on Chinese goods will in most cases mean increased pricing/decreased profits for pretty much everybody in the supply and selling chain. But the impact on your business will depend at least in part on the steps you take now.
