CJ court watch - good 2d Amendment case from 9th Circuit.

A panel of the 9th Cir. decided United States v. Duarte, No.22-50048 on 9may24. Duarte was convicted of felon with a firearm in violation of 18 U.S.C. § 922(g)(1). Duarte appealed claiming the law violated the 2d Amendment when applied to non violent felons like him.

Duarte possessed a .380 on March 20, 2020 in Inglewood, California. He already had state convictions for

vandalism, Cal. Penal Code § 594(a); felon in possession of a firearm, id. § 29800(a)(1); possession of a controlled substance, Cal. Health & Safety Code § 11351.5; and two convictions for evading a peace officer, Cal. Veh. Code § 2800.2.1 Each of these convictions carried a possible sentence of one year or more in prison.

He was indicted by a federal grand jury for felon w/ a firearm. He pleaded not guilty, but was convicted by a jury.

Not much later, SCt decided New York State Rifle & Pistol Ass’n v. Bruen, 597 U.S. 1 (2022). The 9th Cir. noted that Bruen held

If the Second Amendment’s “bare text” covers the person, his arm, and his conduct, “the government must [then] demonstrate that the [challenged] regulation is consistent with this Nation’s historical tradition of firearm regulation.” Id. at 18, 44 n.11. To meet its burden, the Government must “identify a well-established and representative historical analogue” to the challenged law. Id. at 30 (emphasis in original). As to courts, “th[e] historical inquiry that [we] must [now] conduct” requires “reasoning by analogy,” in which the two ���central considerations” will be whether “how” the proffered historical analogue burdened the Second Amendment right, and “why” it did so, are both sufficiently comparable to the challenged regulation. Id. at 28, 29. “Only if” the Government proves that its “firearm regulation is consistent [in this sense] with th[e] Nation’s historical tradition may a court conclude that the individual’s conduct falls outside the Second Amendment’s ‘unqualified command.’” Id. at 17 (citations omitted).

The government could not find any 18th or 19th century laws or customs that prohibited non-violent felons from possessing firearms. Accordingly, the panel reversed Duarte's conviction.

I suppose the gov't will ask the full 9th Cir. to review the case en banc. I suspect the full 9th Cir. would be more sympathetic to the gov't's position. They certainly don't seem to be bothered by their status as the most reversed federal court.

Volume 16, American Jurisprudence 2d, § 177: "The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statue, to be valid, must be in agreement.

It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows: The general rule is that an unconstitutional statute, though having the form and name of law, is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it.

An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

Since an unconstitutional law is void, the general principals follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it... A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Howdy! I'm Lexi-The-Demon, also known as Cake Chan! Welcome to my page! I'm an artist, writer, and self-taught 2D Animator who wants to make my hobby into a profession!

My page mostly focuses on Cookie Run Kingdom-related content and, more specifically, Dark Choco Cookie content. I make comics, fanfics, fan art, and AUs about him a lot because I just love the character so much! So, if you really like this kind of content, then my page is the place for you!

Blue Eye Samurai - Season 1 (2023) Review

Don't think I've ever seen so much human genitalia in animated form all in one go. Makes me wonder if the production team had a designated animator of genitals who literally just spent his time drawing penises for the show. If so, I hope it was Jonah Hill as he already proved in Superbad that he is the perfect artist for this subject.

Plot: Driven by a dream of revenge against those who made her an outcast in Edo-period Japan, a young warrior cuts a bloody path toward her destiny.

Netflix consistently hashes out so much content every week, that it is hard to keep up with any of it, as such many great projects get missed and are forever lost in the streamer's endless library void. Luckily Blue Eye Samurai didn't pass my scrolling and evidently has its fan base, as this is one of the quickest examples of the streaming giant announcing a season renewal after release. Yep, Blue Eye Samurai will be getting a second season which is amazing as this is a superb new series that if you haven't yet discovered then you are doing yourself a disservice and should amend that behaviour immediately and go watch it! Still need persuading? Alright, sit yourself down and allow me to gush about Blue Eye Samurai!...

It’s hard to overstate just how stunning Blue Eye Samurai is to look at. The series uses a mix of 2D and 3D animation styles to create landscapes and characters who seem only a few degrees removed from live-action, even as the form allows for combat on a scale that would cost several large fortunes to craft with flesh-and-blood actors. In fact, looking at the behind-the-scenes the team hired an actual martial arts choreographer to support in creating the combat sequences in real life with real people, and then the movements of those fights were transferred to animation and used in the final product. In one episode (seemingly inspired by the 1978 martial arts film Enter the Game of Death where Bruce Lee had to fight his way up to the tower to get to the last floor) the main samurai Mizu must defeat multiple bosses on each level of the season's big bad Fowler’s impregnable fortress home, and each separate battle is a work of art in itself. Honestly, the show just looks like a moving painting, with every frame absolutely jaw-dropping gorgeous. Even without dialogue or characterization, it would be completely engrossing.

Luckily, writers Michael Green and Amber Noizumi are as interested in the people at the center of these crazy fights as they are in the many improbable techniques Mizu uses against her opponents. Mizu is presented throughout as both supernatural and deeply human. She can handle any odds, and come back from every injury that would cripple or kill a normal person. But the series never loses sight of what a life wholly devoted to revenge has cost her, and the ways in which she has turned herself into every bit the monster that her countrymen believe her to be.

It is then also the exploration of how Mizu interacts with the other characters in this world. There's the disabled would-be apprentice Ringo (played warmly by Masi Oka), who has learned to navigate life despite his lumbering size and lack of hands. Mizu has no interest in a sidekick, but Ringo gradually wears her down, as if he’s a peaceful stream flowing against a rock over hundreds of years. There's also Taigen (Darren Barnett), a warrior chasing after Mizu to collect a debt of honour, yet due to this honour he ends up helping her as in his eyes only he has the right to kill her, no one else, so ends up attacking those that attempt to harm her. Brenda Song voices the princess Akemi, who is just as eager to escape the bonds of Edo society as Mizu is, but who uses very different methods to achieve that. We follow her journey through an intimate tour of the area brothels, which is where the aforementioned heaviness of nudity comes in. There is, in fact, a lot of naked flesh on display throughout the season. The series can be just as graphic in depicting sex as it is in violence, yet both avoid feeling gratuitous. And finally, there's Kenneth Branagh as this season's big bad Fowler, a despicable arms dealer who has no sense of morality or empathy and is willing to destroy anything standing in his path. He's a massive presence and seemingly the only one able to hold himself in a fight against Mizu, hence why Branagh's British snark yet heavy tone fits perfectly here.

The whole thing is an incredible, utterly badass example of how animation can be used to create worlds, characters, and adventure every bit as vivid as live-action if not more at times. Even though I would say there are a few areas of pacing issues, which withheld me from binging this season all in one go and instead had me taking regular break intervals throughout, this is still a stellar show and one that you can tell was created by a team of passionate filmmakers and artists. Blue Eye Samurai would never have had the impact it did had it been live-action - using animation as its storytelling medium elevated it to a masterpiece in my opinion. Kudos to everyone involved in such an amazing project and I can’t WAIT to see more!

Would your OCs find horror movies scary?

Depends.

Sera would find them a bit stressful to watch, so she'd be more tense than afraid. Maybe also frustrated at the incompetent protagonists under times of stress. She nearly shot the projector when a particularly effective jumpscare came up. Fuck this movie I'm going to do something better with my time

Nate would be the "I know it's a movie and these are actors, so this isn't scary by default" guy, so he'll maybe enjoy a casual watch. It's funnier to see how everyone reacts to these kinds of films. Stopping his wife from shooting supercharged plasma at their equipment was not what he expected from tonight.

Sonia? She finds all of that scary. Why would anyone want to watch this? Gross zombies, demons eating people? scary faces??? Ugh! Why couldn't we just watch one of my movies instead? hug me Vincent this is terrifying I'm so afraid don't let go ooh is that your bicep oooooh

Vincent doesn't find it scary. To see that people also react negatively under duress... It's interesting, watching how other people deal. He can see the worst things happen to strangers and witness visceral emotion without living it. They're oddly comforting. Why is Sonia grabbing him

Amon doesn't like scary movies. They're scary. Why would you want to watch any of this? He likes action! thrillers! Comedy!!! There's a billion things to watch but you want to see some ghost possessing a little girl in a haunted mansion killing people? Holy hell. He'll maybe settle for a classic slasher, nothing more. Get a room, Sonia.

Eric is okay with scary stuff. It doesn't matter how bad it gets, he can find a way to joke around about it until the horror factor is gone from the equation. He also likes stretching his face to mimic the faces he sees. "Hey look Sonia look at me look see BWAAAAH" *SHRIIIIEEEK*

Strohl doesn't like horror- he finds it to be a pointless genre that doesn't leave you with anything of substance after. He prefers any other genre to this, really... Katya clinging to him to avoid the 2D projection of a man in a silly clown mask does somewhat amend things, however.

Just watched Gundam Seed Freedom, the new movie.

It's very Gundam Seed. I'm a card-carrying Gundam Seed hater - I thought the original Gundam Seed was too derivative with a stilted narrative and that Seed Destiny was a trainwreck past its midway point. This movie doesn't feel like its a big divergence from the tone of its forefathers.

So why did I like it?

I think it just tells a very sincere and straightforward narrative, with clear good guys and bad guys, and while that might have come off as simplistic, patronising or repetitive across a 50-episode anime series, I though this was paced very nicely for its length, without any wasted time.

Another reason I think is that if you've seen Seed and its sequel you inevitably develop a fondness for its characters, even if you originally hated them on first watch - one of the ibggest reasons Destiny drew my ire was that it fumbled characters that first appeared in Seed, even though I didn't even particularly like those characters on the first go around - this series works in mysterious ways. With that said, everyone who conceivably could appear here does to varying degrees, and they all have at least some degree of well-done character development - it feels like you're greeting old friends again. Special mention has to go Kira and Lacus, the leading duo of this film as well as the series overall, who I thought were dull as dishwater in the old series but amends were made here - the two of them actually have to struggle this time, and this time it feels like their successes were earned. New characters introduced are also pretty good and play off the existing cast well.

Finally I think these were some of the biggest and most explosive battles we've had from a Gundam instalment - the trademark Seed beam and missile spam is dialled up to an insane degree and is well rendered in 3D - another feather in that animation style's cap, now showing that it can be just as good or even better than standard flad 2D animation so long as care is taken and expenses aren't spared - the stiff, repetitive animation with unsightly use of colour that marred the original series is banished from this - while I still uphold that Seed and Seed Destiny were ugly series to look at for the most part, this is beautiful.

Overall I enjoyed it despite my oft-times negative history with this series - I appeciated the characters that used to annoy me and all the little nods to the eccentricities of the old series that used to aggravate me. Does this make it worth watching Seed Destiny now? That's probably a hard question to answer, but the fact that my answer's not a hard "no" should say a lot about this movie's quality if you know how I feel about Destiny.

Overall, I've got to concede defeat. Kira-sama, your movie is good and well worth a watch. I kneel.

Background

For the third scene of my project, I've designed a background and exported the image so that I can import it to any animation software I use for the project. For now, I've just left it black and white for now, though I'm thinking of doing paint splatters (like in my storyboard draft) or maybe changing the world into colour for when Red awakens which I can easily amend. For now it more closely resembles the set dressing for the stop motion sequence, just in 2d form.

New York passed a statute taking direct aim a religious organizations, N.Y. Lab. Law §203-e. The law forbids employers from considering an employee's "reproductive health decision making." This is a The Idea Factory Meanies Series 3 John Deer The Anthro Deer Human Hunter Plush and this is a very unique plush.

This plush is pretty unique since you rarely see plushies holding a real looking gun.

I rarely see deer plushies that are standing on their hind legs and not on all fours while also being in a natural deer color not in a colorful style.

This plush also has a conservative country bass pro shops outdoor shops look to this plush with the orange cap and the plaid or corduroy like shirt this plush is wearing.

This plush reminded me of that Courage the Cowardly Dog episode where there was a anthro deer dad named Buck and he was tried of hunters hunting him and his family so he decided to hunt humans with his laser gun but I have a feeling that the laser gun was supposed to be a real gun similar to the John Deer plush's gun but the censorship made Buck have a laser gun instead of a cartoony real gun.

Buck and this John Deer plush really using the second amendment to bear arms with their weapons.

This is the closest to getting a Buck plush unless you get it Etsy made or Buck randomly becomes a new meme that a bootleg plush of him and his family gets made randomly in China.

The plush has 1997 and 1998 on the tush tag.

The Buck the Deer episode premiered September 27 2002.

So this plush is older than the Courage episode which is wild since someone seemed to have the same idea.

This plush is 9 inches from the tip of the antlers on head to the hooved foot of the plush and 8 inches from the top of the head to the hoof foot.

This John Deer plush is lightly stuffed with beans or plastic pellets at the middle half of the plush and the bottom half of the plush is lightly stuffed also the gun is lightly stuffed while also being a 3D object this plush is holding which would be 2D or a laser gun instead of a real one.

This plush has it's hang and tush tag but the hang tag is a little bent.

This plush had some white deer like fluffy fur around the crotch area and where the tail is which is unique that might have made this plush a little more expensive to make.

The only thing I don't like is that I wish the antlers on this John Deer plush were more 3D puffed out like the gun while the antlers feels 2D bendable like felt material.

I think this is where The Idea Factory cheaped out at and maybe wanted to make the horns 3d but either didn't have the money since they were making a set or just knew the company was going under to just get this plush made this way since I think Series 3 was the last set made before the last seasonal set released.

The plush's eyes are stylized plastic which is cool and is pretty rare in today's plushies which would have plastic sparkly eyes or have embroidered eyes.

There is no plush stuffing in the orange hat and the antlers and the antlers seem to have thin plush material cut thin then glued together to give the illusion of the antlers being 3D.

The orange hat can't be removed unless you force remove it but I wouldn't and this plush has lightly soft brown hair that is not white like the bottom part of the plush.

I wish this company kept making plushies and I know they would make some cool modern ones that are creative.

Maybe have these plushies sell in Spencer's gifts as gag gift plushies since some are suggestive in nature while some are gross out humor ones or celebrity parodies.

I took pictures of this plush early with the Makeship John Doe plush since plush character's share the same name of John and can sometime have violent tendencies while also thinking of John Doe shapeshifting as a deer in regular guy form for the word play.

Also having a artwork with John Doe and John Deer fighting each other would be cool since John Deer is in man season rage mode.

John Doe bringing a knife or blade to a gun fight but Doe's body is fake so this character has the upper hand than John Deer.

Unless John Deer shoots the Regular Guy form in the eye which seems to be the weak point to the Regular Guys.

The Meanies line of plushies give me Illbleed vibes like these plushies seem like extra's for the Cork in level 6.

This plush can wear both the toy glasses and I'm keeping this.
