Matt Bors’s “Justice Warriors: Vote Harder”

There's no political satirist working today quite like Matt "Mr Gotcha" Bors, whose 2023 masterpiece Justice Warriors just got a timely – and brutally funny – sequel, Justice Warriors: Vote Harder:

You've doubtless seen Matt Bors's work, which has repeatedly attained viral liftoff, most notably with his Mr Gotcha strips, easily one of the most useful additions to online political debate in internet history:

Last year, Bors, along with Ben Clarkson and Felipe Sobreiro, published Justice Warriors, a postapocalyptic cyberpunk graphic novel in the vein of Warren Ellis's classic Transmetropolitan:

Justice Warriors is the tale of Bubble City, a domed enclave walled off from the teeming masses of the UZ (which stands for "Uninhabited Zone" – see what they did there?). Bubble City runs on vibes, therapy-speak, social media nonsense, memes and garbage hot-takes. And while there's a lot of broad satire here, the thing that makes Justice Warriors stand out is how its creators do the relatively straightforward futuristic exercise of asking themselves, "What if deeply unserious nonsense was taken seriously?"

Others have done this before – Mike Judge's Idiocracy, say – but Bors, Clarkson and Sobreiro attain a density of sight gags, trenchant wordplay, and outrageous cyberpunk imagery that is just next level. Think Al Jaffee meets William Gibson, with art direction by Vaughn Bode, who's had one too many at the Mos Eisley Cantina. To that, mix in all kinds of MAD Magazine style fake ads and social media postings, layering joke on gag, all of it walking the fine line between "you gotta cry" and "you gotta laugh."

Justice Warriors did big numbers, selling out three printings, and now the gang is back together for the sequel, Vote Harder, which drops just in time for the final, all consuming election-season media apocalypse.

Vote Harder sees Bubble City facing its first election in living memory, as the mayor – who inherited his position from his "powerful, strapping Papa" – loses a confidence vote by the city's trustees. They're upset with his plan to bankrupt the city in order to buy a laser powerful enough to carve his likeness into the sun as a viral stunt for the launch of his comeback album. The trustees are in no way mollified by the fact that he expects to make a lot of money selling special branded sunglasses that allow Bubble City (and the mutant hordes of the Uninhabited Zone) to safely look into the sun and see what their tax dollars bought.

So it's time for an election, and the two candidates are going hard: there's the incumbent Mayor Prince; there's his half-sister and ex-girlfriend, Stufina Vipix XII, and there's a dark-horse candidate Flauf Tanko, a mutant-tank cyborg that went rogue after a militant Home Owners Association disabled it and its owners abandoned it. Flauf-Tanko is determined to give the masses of the Uninhabited Zone the representation they've been denied for so long, despite the structural impediments to this (UZers need to complete a questionnaire, sub-forms, have three forms of ID, and present a rental contract, drivers license, work permit and breeding license. They also need to get their paperwork signed in person at a VERI-VOTE location, then wait 14 days to get their voter IDs by mail. Also, districts of 2 million or more mutants are allocated the equivalent of only 250,000 votes, but only if 51% of eligible voters show up to the polls; otherwise, their votes are parceled out to other candidates per the terms of the Undervoting and Apathy Allotment Act).

Despite the structural advantages afforded to Mayor Prince – like the fact that residents of District 12 on floors 120-145 of the Bubble each get 2048 votes, while District 1 (floors 1-7) only get a single vote – he's not taking any chances. Officer Schitt (a humanoid poop emoji) and the lovelorn Officer Swamp (an anthropomorphic catfish) are each prowling the Uz . Swamp – suffering from a head injury and gripped by a delusion that a TV cowboy has sent him to infiltrate the Flauf Tanko campaign – is playing spy/provocateur, while Schitt hunts dangerous subversives.

What unfolds is a funny, bitter, superb piece of political satire that could not be better timed.

Tennessee Republicans reject bill to allow raped children 12 and under to receive an abortion up to ten weeks.(2023)

Currently, all abortions, even those performed to save the life of a pregnant patient, are illegal in Tennessee. Even children who are raped are required to carry their pregnancies to term, making Tennessee’s ban one of the strictest in the nation. Recognizing this, a handful of Republican legislators sought to provide exceptions to the ban, namely in cases of rape, incest, and life of the mother.

Just scratching the surface, the bill would have required women and girls to:

Report the rape or incest to law enforcement (and for law enforcement to make its own report of the offense.) Submit themselves to a forensic medical exam if “appropriate and available.” Be no more than ten weeks pregnant if age 12 or younger. Be no more than eight weeks pregnant if 13 or older

Further, the bill outlined a provision in which a “false report” of rape submitted to obtain an abortion would be punishable by “…a mandatory minimum sentence of at least three (3) years in incarceration, and the person must serve one hundred percent (100%) of the three-year minimum sentence.”

Despite the high bar, anti-abortion lobbyists like Right to Life decried SB857, and it ultimately failed to garner enough support among Republican legislators to advance to the next committee. The result? Tennessee women and girls who are raped are doomed to carry their rapist’s child. .

According to a Vanderbilt poll, 75% of Tennesseans believe abortion should be legal in cases of rape and incest, with 62% of Republicans, 78% of Independents, and 93% of Democrats agreeing.

Leaked documents from a source close to the Putin administration reveal that Russian propagandists have a new target in their sights: government critics and opposition supporters. In an attempt to win over this skeptical audience, they’ve been repurposing out-of-context clips from a popular YouTuber’s old interviews, adding their own messages in the descriptions. They’ve also tried coming up with news stories they think might attract the attention of independent Russian media outlets (like Meduza). Here’s what they’re doing.

Dialog, an “autonomous nonprofit organization” (ANO) created on Vladimir Putin’s orders to spread disinformation, is using targeted advertising and repurposed material from “foreign agents” to try to promote a pro-Kremlin narrative to those who oppose the current Russian government, according to leaked documents shared with Meduza.

As part of the initiative, Dialog repurposed content from Russian YouTuber Yuri Dud (declared a “foreign agent” in Russia) and added captions encouraging people to go to the polls, according to a document from 2023 titled “Election Campaign on the Internet.” Specifically, the organization utilized excerpts from an interview Dud conducted with the Communist Party’s 2018 presidential candidate Pavel Grudinin before that year’s elections. Dialog shared the clips with phrases such as “If they come to the elections, falsifications will be impossible,” and “Dud recommends,” and then used targeted advertising to promote these clips “solely” to social media users critical of the government.

The document, written by Andrey Tsepelev, the deputy general director of Dialog Regions, aims to implement a “relevant system for managing internet operations in election headquarters.” However, the specifics of how this system works aren’t detailed, and Tsepelev didn’t respond to Meduza's inquiries.

This “relevant system” will be implemented with assistance from the Association of Internet Technologists, which is also headed by Tsepelev. Other co-founders include propagandist Kristina Potupchik, who owns a network of pro-Kremlin Telegram channels, and Stanislav Apetyan, a board member of the Civil Society Development Foundation (led by former Kremlin official Konstantin Kostin). Artyom Tkachenko, the director of the regional affairs department at Dialog Regions, and Vladimir Tabak, the head of Dialog, are also among the founders.

It was Tabak’s idea to try to engage with Russians critical of the current government, according to two of his acquaintances. A Dialog employee confirmed to Meduza that there have long been internal “discussions about content and narratives that could work for a liberal audience.”

“A couple of years ago, [Tabak] was already saying that he’d gone around the regions to help locals with elections, and he complained that they were all stupid, complete dipshits, knew nothing, didn’t work with analytics, posted strange things, and didn’t know what to do with social media,” explained one acquaintance. “All of that needed to change. So, he’s changing it. Tabak’s logic is basically: you [the authorities] managed to seal off the country, hundreds of thousands of people left, but that doesn’t mean their opinion doesn’t matter.”

So far, the plan has had very little success. Besides distributing repurposed clips from Yuri Dud, Dialog employees also credit themselves with creating “special projects” that have been covered by independent media. For instance, in a presentation about Russia’s recent presidential campaign, there’s a slide on press coverage of the fact that Vladimir Putin’s latest address to Russia’s Federal Assembly was shown in Russian movie theaters free of charge.

“The news spread across Telegram channels (2,491 publications), social networks (3,000 publications), TV (four TV segments), Russian-language media (2,067 publications) and foreign media (55 publications),” states Dialog’s presentation. According to the organization, the total number of views exceeded 31.8 million.

The presentation lists media outlets that reported on the theater broadcast, including Ostorozhno, Novosti (a project by Ksenia Sobchak), Meduza, and Dozhd (TV Rain). Despite Dozhd and Meduza being declared “undesirable” organizations in Russia, Dialog used their logos in the slides — which theoretically violates current legislation and could be considered the dissemination of prohibited materials.

A source in the Telegram industry told Meduza that Dialog highlights the interest of independent media in such news to demonstrate the effectiveness of its projects to the authorities. “It’s not hard to distribute and plant news in their own network of Telegram channels,” the source explained. “It’s much cooler if it’s not just a paid [propagandist] writing about you but a TV channel like Dozhd. They sell it as evidence that Dialog is so effective that it can even get the interest of ‘enemy’ media.”

The source added that Dialog employees are also trying to capitalize on the fact that independent media were forced to leave the country due to censorship, which may make it harder for them to assess the significance of certain news:

Liberal media that have left the country are out of touch with reality, since they’re not in Russia. Therefore, [according to Dialog propagandists], they amplify news that barely interests anyone here [in Russia]. Plus, even though the Justice Ministry has declared Meduza and Dozhd ‘undesirable,’ those working on elections understand that these are popular media outlets with a suitable audience that needs to be engaged and tapped into.

However, Dialog’s presentation doesn’t mention this, nor does it provide examples of other news events that independent media might have written about. It only includes mentions of short publications about Putin’s address being shown in theaters. How exactly this helps Dialog influence and “engage” the “opposition audience” remains unclear.

Nevertheless, propagandists believe that “it holds more weight when your enemies write about you,” explained one of Tabak’s acquaintances. “The media outlets that have left — Meduza, for example — have a huge Telegram audience, 1.2 million followers, and you need to work with that audience too,” he said.

When asked about the mention of independent media in the presentation, Tabak told Meduza: “It's not only you who can write about us; we thought we'd return the favor.” He refused to comment further.

In yesterday’s election in Wisconsin, the two candidates represented very different futures for the country. One candidate for the state supreme court, Daniel Kelly, had helped politicians to gerrymander the state to give Republicans an iron lock on the state assembly and was backed by antiabortion Republicans. The other, Janet Protasiewicz, promised to stand behind fair voting maps and the protection of reproductive rights. Wisconsin voters elected Protasiewicz by an overwhelming eleven points in a state where elections are usually decided by a point or so. Kelly reacted with an angry, bitter speech. “I wish that in a circumstance like this I would be able to concede to a worthy opponent,” he said. “But I do not have a worthy opponent to which I can concede.” Yesterday’s vote in Wisconsin reinforces the polling numbers that show how overwhelmingly popular abortion rights and fair voting are, and it seems likely to throw the Republican push to suppress voting into hyperdrive before the 2024 election. Since the 1980s, Republicans have pushed the idea of “ballot integrity” or, later, “voter fraud” to justify voter suppression. That cry began in 1986, when Republican operatives, realizing that voters opposed Reagan’s tax cuts, launched a “ballot integrity” initiative that they privately noted “could keep the black vote down considerably.” That effort to restrict the vote is now a central part of Republican policy. Together with Documented, an investigative watchdog and journalism project, The Guardian today published the story of the attempt by three leading right-wing election denial groups to restrict voting rights in Republican-dominated states by continuing the lie that voting fraud is rampant. The Guardian’s story, by Ed Pilkington and Jamie Corey, explores a two-day February meeting in Washington organized by the right-wing Heritage Foundation and attended by officials from 13 states, including the chief election officials of Indiana, Florida, Mississippi, Missouri, Montana, Tennessee, Virginia, and West Virginia. At the meeting, participants learned about auditing election results, litigation, and funding to challenge election results. Many of the attendees and speakers are associated with election denial. Since the 2020 election, Republican-dominated states have passed “election reform” measures that restrict the vote; those efforts are ongoing. On Thursday alone, the Texas Senate advanced a number of new restrictions. In the wake of high turnout among Generation Z Americans, who were born after 1996 and are more racially and ethnically diverse than their elders, care deeply about reproductive and LGBTQ rights, and want the government to do more to address society’s ills, Republican legislatures are singling out the youth vote to hamstring. That determination to silence younger Americans is playing out today in Tennessee, where a school shooting on March 28 in Nashville killed six people, including three 9-year-olds. The shooting has prompted protesters to demand that the legislature honor the will of the people by addressing gun safety, but instead, Republicans in the legislature have moved to expel three Democratic lawmakers who approached the podium without being recognized to speak—a breach of House rules—and led protesters in chants calling for gun reform. As Republicans decried the breach by Representatives Gloria Johnson, Justin Jones, and Justin Pearson, protestors in the galleries called out, “Fascists!” Republican efforts to gain control did not end there. On Twitter today, Johnson noted that she had “just had a visit from the head of HR and the House ethics lawyer,” who told her “that if I am expelled, I will lose my health benefits,” but the ethics lawyer went on to explain “that in one case, a member who was potentially up for expulsion decided to resign because if you resign, you maintain your health benefits.” The echoes of Reconstruction in that conversation are deafening. In that era, when the positions of the parties were reversed, southern Democrats used similar “persuasion” to chase Republican legislators out of office. When that didn’t work, of course, they also threatened the physical safety of those who stood in the way of their absolute control of politics. On Saturday night, someone fired shots into the home of the man who founded and runs the Tennessee Holler, a progressive news site. Justin Kanew was covering the gun safety struggle in Tennessee. He wrote: “This violence has no place in a civilized society and we are thankful no one was physically hurt. The authorities have not completed their investigation and right now we do not know for sure the reason for this attack. We urge the Williamson County Sheriff’s office to continue to investigate this crime and help shed light on Saturday’s unfortunate events and bring the perpetrators of this crime to justice. In the meantime, our family remains focused on keeping our children healthy and safe.” The anger coming from losing candidate Kelly last night, and his warning that “this does not end well….[a]nd I wish Wisconsin the best of luck because I think it's going to need it,” sure sounded like those lawmakers in the Reconstruction years who were convinced that only people like them should govern. The goal of voter suppression, control of statehouses, and violence—then and now—is minority rule. Today’s Republican Party has fallen under the sway of MAGA Republicans who advocate Christian nationalism despite its general unpopularity; on April 3, Hungarian president Viktor Orbán, who has destroyed true democracy in favor of “Christian democracy” in his own country, cheered Trump on and told him to “keep on fighting.” Like Orbán, today's Republicans reject the principles that underpin democracy, including the ideas of equality before the law and separation of church and state, and instead want to impose Christian rule on the American majority. Their conviction that American “tradition” focuses on patriarchy rather than equality is a dramatic rewriting of our history, and it has led to recent attacks on LGBTQ Americans. In Kansas today, the legislature overrode Democratic governor Laura Kelly’s veto of a bill banning transgender athletes who were assigned male at birth from participating in women’s sports. Kansas is the twentieth state to enact such a policy, and when it goes into effect, it will affect just one youth in the state. Yesterday, Idaho governor Brad Little signed a law banning gender-affirming care for people under 18, and today Indiana governor Eric Holcomb did the same. Meanwhile, Republican-dominated states are so determined to ignore the majority they are also trying to make it harder for voters to challenge state laws through ballot initiatives. Alice MIranda Ollstein and Megan Messerly of Politico recently wrote about how, after voters in a number of states overrode abortion bans through ballot initiatives, legislatures in Arkansas, Florida, Idaho, Missouri, North Dakota, Ohio, and Oklahoma are now debating ways to make it harder for voters to get measures on the ballot, sometimes even specifying that abortion-related measures are not eligible for ballot challenges. And yet, in the face of the open attempt of a minority to seize control, replacing our democracy with Christian nationalism, the majority is reasserting its power. In Michigan, after an independent redistricting commission redrew maps to end the same sort of gerrymandering that is currently in place in Wisconsin and Tennessee, Democrats in 2022 won a slim majority to control the state government. And today, Michigan governor Gretchen Whitmer signed into law a bill revoking a 1931 law that criminalized abortion without exception for rape or incest.

LONDON (AP) — The British government hopes one last push can revive its stalled plan to send some asylum-seekers on a one-way trip to Rwanda. A bill aimed at overcoming a U.K. Supreme Court block on the deportation flights returns to the House of Commons on Monday, and could be passed into law within days.

That would be a boost for Prime Minister Rishi Sunak, who is facing disquiet from fellow Conservative lawmakers as the party lags in opinion polls ahead of an election due this year.

Lawmakers in the House of Commons are due to consider changes made to the Safety of Rwanda Bill by Parliament’s upper chamber, the House of Lords. The Lords inserted a series of amendments designed to water down the legislation.

All 10 amendments are likely to be removed by lawmakers in the Commons, where the Conservatives have a majority. After a back-and-forth tussle with the upper house, the Commons is almost certain to prevail because the unelected Lords can’t overrule the elected lower house.

Once the bill becomes law, it could be weeks before any flights to Rwanda take off, as people chosen for deportation are likely to lodge legal appeals.

Sunak said Monday that he was sticking to a previous promise that flights would start “in the spring.”

Britain and Rwanda signed a deal almost two years ago that would see migrants who cross the English Channel in small boats sent to the East African country, where they would remain permanently.

The plan is key to Sunak’s pledge to “stop the boats” bringing unauthorized migrants to the U.K. Sunak argues that deporting unauthorized asylum-seekers will deter people from making risky journeys and break the business model of people-smuggling gangs.

Just under 30,000 people arrived in Britain in small boats in 2023, many of them not from the African continent at all.

“We need to make it clear that if you come here illegally, you won’t be able to stay and we will be able to remove you. That is the only way to properly solve the issue of illegal migration,” Sunak told reporters.

The agreement faced multiple legal challenges, and no one has been sent to Rwanda. Britain has promised Rwanda at least 370 million pounds ($470 million) as part of the deal, whose cost is rapidly rising.

In November, the U.K. Supreme Court ruled that the Rwanda plan is illegal because the nation is not a safe destination for asylum-seekers. For decades, human rights groups and governments have documented alleged repression of dissent by Rwanda's government both inside the country and abroad, as well as serious restrictions on internet freedom, assembly and expression.

In response, Britain and Rwanda signed a treaty pledging to strengthen protections for migrants. Sunak’s Conservative government argues the treaty allows it to pass a law declaring Rwanda a safe destination.

The Safety of Rwanda Bill pronounces the country safe, makes it harder for migrants to challenge deportation and allows the British government to ignore injunctions from the European Court of Human Rights that seek to block removals.

Human rights groups, refugee charities, senior Church of England clerics and many legal experts have criticized the legislation. A parliamentary rights watchdog said last month that the Rwanda plan is “ fundamentally incompatible ” with the U.K.’s human rights obligations.

Full-scale Pre-poll Preparations Underway as ECI Team Plans Visit to State from October 3

Preparations for the upcoming Assembly elections in the state are in full swing, as the Chief Electoral Officer (CEO) Vikas Raj announced that a team from the Election Commission of India (ECI) is scheduled to visit the state from October 3. During this three-day tour, the ECI team will engage with various stakeholders, assess the state's poll preparedness, and interact with voters.

Speaking at the inauguration of the media center at BRKR Bhavan, Vikas Raj stated that the ECI team would hold meetings with the CEO's office, political parties, chief secretary, director general of police (DGP), district collectors, district police officials, and other key stakeholders. More than 20 agencies, including both Central and State entities, have been identified for the implementation of the model code of conduct, and a meeting with these agencies is scheduled.

The CEO also provided updates on electoral rolls, stating that almost 15 lakh additions have been made since January 2023, and around 3.38 lakh voter names were removed during the Special Summary Revision of Rolls. The upcoming elections will witness the participation of nearly 6.99 lakh new voters, with efforts underway to encourage the enrollment of more women voters through active campaigns.

Once the final electoral rolls are published early next month, the focus will shift to the districts, involving tasks such as appointing presiding officers and polling officers, identifying strongrooms, and preparing polling stations. Officials will undergo training to ensure the smooth conduct of the elections.

Vikas Raj emphasized that the electoral rolls are currently robust, addressing complaints of bogus votes made by some political leaders. He assured a thorough investigation into each complaint, with details to be shared with complainants and representatives of all political parties.

This year, the alarm rang louder and more ominously, and the message was even more pressing: Wake up and take action—right now. Secretary-General Antonio Guterres’ assessment, delivered in his no-nonsense style, aimed to shock. We are becoming “unhinged,” he said. We are inching closer to “a great fracture.” Conflicts, coups and chaos are surging. The climate crisis is growing. Divides are deepening between military and economic powers, the richer North and poorer South, East and West. “A new Rubicon” has been crossed in artificial intelligence. Guterres has spoken often on all these issues. But this year, which he called “a time of chaotic transition,” his address to leaders was tougher and even more urgent. His message to the presidents and prime ministers, monarchs and ministers gathered in the vast General Assembly hall was unambiguous and stark. “We seem incapable,” Guterres said, “of coming together to respond.”

Surveillance of Indian diplomats in Canada led to allegations around Sikh killing, official says (AP) The allegation of India’s involvement in the killing of a Sikh Canadian is based on surveillance of Indian diplomats in Canada, including intelligence provided by a major ally, a Canadian official told The Associated Press on Thursday. The official said the communications involved Indian officials and Indian diplomats in Canada and that some of the intelligence was provided by a member of the “Five Eyes” intelligence-sharing alliance, which includes the U.S., Britain, Australia and New Zealand, in addition to Canada. The official did not say which ally provided intelligence or give details of what was contained in the communications or how they were obtained. The revelation came as India stopped issuing visas to Canadian citizens and told Canada to reduce its diplomatic staff as the rift widened over allegations by Prime Minister Justin Trudeau of suspected Indian involvement in the killing of Hardeep Singh Nijjar, a 45-year-old Sikh separatist.

White House preparing for government shutdown as House Republicans lack a viable endgame for funding (AP) The White House on Friday directed federal agencies to get ready for a shutdown after House Republicans left town for the weekend with no viable plan to keep the government funded and avert politically and economically costly disruption of federal services. A federal shutdown after Sept. 30 seems all but certain unless Speaker Kevin McCarthy can persuade his rebellious hard-right flank of Republicans to allow Congress to approve a temporary funding measure to prevent closures as talks continue. Instead, he’s launched a much more ambitious plan to try to start passing multiple funding bills once the House returns Tuesday, with just five days to resolve the standoff. McCarthy signaled his preference for avoiding a closure, but a hard-right flank of his House majority has effectively seized control. Election emotions (Yahoo News) What’s the No. 1 feeling that comes to mind for Americans when thinking about the upcoming presidential election? “Dread,” according to a new Yahoo News/YouGov poll. The survey of 1,636 U.S. adults, which was conducted from Sept. 14 to 18, offered respondents seven emotions—three positive, three negative, one neutral—and asked them to select any and all that reflect their attitude toward the 2024 campaign. Dread, the most negative option, topped the list (41%), followed by exhaustion (34%), optimism (25%), depression (21%), indifference (17%), excitement (15%) and delight (5%). In total, a majority of Americans (56%) chose at least one of the three negative feelings (dread, exhaustion or depression), while less than a third (32%) picked at least one of the three positive feelings (optimism, excitement or delight).

Costa Rica’s homicide rate rises in deadliest year ever (Reuters) More than 656 people have been killed so far in Costa Rica’s deadliest year on record, official homicide data showed on Friday, though the government expects this figure to soar past 900 by the end of this year. U.S. will send Ukraine long-range missiles, after delay (Washington Post) The Biden administration plans to provide Ukraine with a version of ATACMS long-range missiles armed with cluster bomblets rather than a single warhead, according to several people familiar with the ongoing deliberations. The cluster-armed ATACMS, with a range of up to 190 miles, depending on the version, could allow Ukraine to strike command posts, ammunition stores and logistics routes far behind Russian front lines and dug-in defenses. Biden moved during the summer from a firm and long-standing “no” to saying the issue was “still in play.” Although the administration backed away from initial concerns that Kyiv, which has asked for hundreds of the long-range weapons, would use them to strike inside Russian territory, the Pentagon still worried that drawing down enough ATACMS from relatively small military stockpiles to make a difference on the Ukraine battlefield would undercut the readiness of U.S. forces for other possible conflicts.

Democrats only voted against because of the incorporated tax cuts on businesses. MTG voted against on the same line she did for the Ukraine war. Thomas Massie at least ran a poll among his constituents to determine his vote.

House Whip Katherine Clark told The Hill that the bill “presents a false choice between funds meant to ensure that wealthy tax cheats and corporations pay their fair share and funds to help our ally Israel defend itself." (Tara Suter, The Hill, 2023) While another issue they had was that the bill excluded humanitarian aid to Ukraine and Gaza.

Convention on the Prevention and Punishment of the Crime of Genocide

Approved and proposed for signature and ratification or accession by General Assembly resolution 260 A (III) of 9 December 1948 Entry into force: 12 January 1951, in accordance with article XIII The Contracting Parties , Having considered the declaration made by the General Assembly of the United Nations in its resolution 96 (I) dated 11 December 1946 that genocide is a crime under international law, contrary to the spirit and aims of the United Nations and condemned by the civilized world, Recognizing that at all periods of history genocide has inflicted great losses on humanity, and Being convinced that, in order to liberate mankind from such an odious scourge, international co-operation is required, Hereby agree as hereinafter provided :

Article I The Contracting Parties confirm that genocide, whether committed in time of peace or in time of war, is a crime under international law which they undertake to prevent and to punish.

Article II In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: (a) Killing members of the group; (b) Causing serious bodily or mental harm to members of the group; (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; (d) Imposing measures intended to prevent births within the group; (e) Forcibly transferring children of the group to another group.

Article III The following acts shall be punishable: (a) Genocide; (b) Conspiracy to commit genocide; (c) Direct and public incitement to commit genocide; (d) Attempt to commit genocide; (e) Complicity in genocide.

Article IV Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.

Article V The Contracting Parties undertake to enact, in accordance with their respective Constitutions, the necessary legislation to give effect to the provisions of the present Convention, and, in particular, to provide effective penalties for persons guilty of genocide or any of the other acts enumerated in article III.

Article VI Persons charged with genocide or any of the other acts enumerated in article III shall be tried by a competent tribunal of the State in the territory of which the act was committed, or by such international penal tribunal as may have jurisdiction with respect to those Contracting Parties which shall have accepted its jurisdiction.

Article VII Genocide and the other acts enumerated in article III shall not be considered as political crimes for the purpose of extradition. The Contracting Parties pledge themselves in such cases to grant extradition in accordance with their laws and treaties in force.

Article VIII Any Contracting Party may call upon the competent organs of the United Nations to take such action under the Charter of the United Nations as they consider appropriate for the prevention and suppression of acts of genocide or any of the other acts enumerated in article III.

Article IX Disputes between the Contracting Parties relating to the interpretation, application or fulfilment of the present Convention, including those relating to the responsibility of a State for genocide or for any of the other acts enumerated in article III, shall be submitted to the International Court of Justice at the request of any of the parties to the dispute.

Article X The present Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall bear the date of 9 December 1948.

Article XI The present Convention shall be open until 31 December 1949 for signature on behalf of any Member of the United Nations and of any non-member State to which an invitation to sign has been addressed by the General Assembly. The present Convention shall be ratified, and the instruments of ratification shall be deposited with the Secretary-General of the United Nations. After 1 January 1950, the present Convention may be acceded to on behalf of any Member of the United Nations and of any non-member State which has received an invitation as aforesaid. Instruments of accession shall be deposited with the Secretary-General of the United Nations.

Article XII Any Contracting Party may at any time, by notification addressed to the Secretary-General of the United Nations, extend the application of the present Convention to all or any of the territories for the conduct of whose foreign relations that Contracting Party is responsible.

Article XIII On the day when the first twenty instruments of ratification or accession have been deposited, the Secretary-General shall draw up a procès-verbal and transmit a copy thereof to each Member of the United Nations and to each of the non-member States contemplated in article XI. The present Convention shall come into force on the ninetieth day following the date of deposit of the twentieth instrument of ratification or accession. Any ratification or accession effected subsequent to the latter date shall become effective on the ninetieth day following the deposit of the instrument of ratification or accession.

Article XIV The present Convention shall remain in effect for a period of ten years as from the date of its coming into force. It shall thereafter remain in force for successive periods of five years for such Contracting Parties as have not denounced it at least six months before the expiration of the current period. Denunciation shall be effected by a written notification addressed to the Secretary-General of the United Nations.

Article XV If, as a result of denunciations, the number of Parties to the present Convention should become less than sixteen, the Convention shall cease to be in force as from the date on which the last of these denunciations shall become effective.

Article XVI A request for the revision of the present Convention may be made at any time by any Contracting Party by means of a notification in writing addressed to the Secretary-General. The General Assembly shall decide upon the steps, if any, to be taken in respect of such request.

Article XVII The Secretary-General of the United Nations shall notify all Members of the United Nations and the non-member States contemplated in article XI of the following: (a) Signatures, ratifications and accessions received in accordance with article XI; (b) Notifications received in accordance with article XII; (c) The date upon which the present Convention comes into force in accordance with article XIII; (d) Denunciations received in accordance with article XIV; (e) The abrogation of the Convention in accordance with article XV; (f) Notifications received in accordance with article XVI.

Article XVIII The original of the present Convention shall be deposited in the archives of the United Nations. A certified copy of the Convention shall be transmitted to each Member of the United Nations and to each of the non-member States contemplated in article XI.

Article XIX The present Convention shall be registered by the Secretary-General of the United Nations on the date of its coming into force.
