Hope lingers for the cannabis industry. In September 2019, the House overwhelmingly voted 321 to 103 and passed The SAFE (Secure and Fair Enforcement) Banking Act. This law seeks to grant protections to financial institutions that work with state-licensed cannabis companies, extending them the same safeguards afforded other businesses.

While The SAFE Banking Act awaits for its faith in Washington, D.C., businesses like Sheepscot General of Whitefield, Maine continue to struggle to attain access to bank services.
Sheepscot General grows organic hemp which technically is legal under the 2018 Farm Bill that legalized hemp at the federal level. This bill revised the Controlled Substances Act to clear hemp from the definition of marijuana. Hemp contains less than 0.3% or less THC content (by dry weight). So, while it isn’t entirely lacking psychoactive compounds, it will not get you high.

South Dakota Tribe Sues USDA Over Right to Grow Hemp One Native American tribe heads to court to demand the right to cultivate low-THC cannabis and to force the USDA to live up to its regulatory responsibilities under the 2018 Farm Bill. The federal bureaucracy hasn’t yet caught up with the law where hemp cultivation and commerce are concerned — leaving a lot of would-be entrepreneurs and enterprises in the lurch. Legislation is now pending on Capitol Hill that calls upon the Food & Drug Administration to finally regulate CBD products, addressing a dilemma that has been outstanding since hemp-derived CBD was legalized under last year’s Farm Bill. The failure of the FDA to create regulations for CBD as a food additive or drug means many such products actually remain illegal — despite the clear will of Congress. The U.S. Department of Agriculture has also failed to bring its regulations into conformity with the Farm Bill. The USDA in late May issued a memo establishing protocols for interstate commerce in hemp. But it has still failed to provide any legal clarity on the question of hemp cultivation, including on Native American tribal lands.  Given the unique jurisdictional status of such lands, it is the USDA that has the authority to permit and oversee such cultivation. Its failure to issue regulations on the matter is another legal hindrance to Native American cannabis cultivation. Now the USDA is under pressure from litigation. What does the Hemp Farming Act of 2018 mean for consumers?
By now you’ve likely heard the news that the Hemp Farming Act of 2018 was passed by Congress and was earlier this month, signed into law by President Trump as part of the 2018 Farm Bill. But what does that really mean for you, the customer?
If you want to read the full bill (be careful though, it’s a thick one) you can find it here. Essentially this bill did a few things:
Removed Hemp from the list of of Schedule 1 Controlled Substances
Declared industrial hemp an agricultural commodity and not a controlled substance
Set the stage for the DEA to reconsider their stance on how hemp and CBD are treated
In short, this bill did more for growers of hemp as opposed to consumers. However, these new opportunities given to farmers will be passed down to the consumers in the form of future cost savings. Hemp farmers are now afforded the same rights as traditional farmers such as riparian water rights and the ability to request federal agricultural grants. These rights can be huge for farmer’s margins in an industry that is traditionally bootstrapped to begin with.
Senate Majority Leader Mitch McConnell was one of the main proponents of the law as he hopes that hemp can start to replace the demise of Kentucky’s oldest cash crop- tobacco. A healthy, non-addictive, alternative to cigarettes? We’re here for it!

The report documents state-by-state progress of hemp legislation passed in 2018, reported acreage of hemp grown, identifies states with active hemp pilot farming programs and advocacy work the organization has lead over the past year leading up to the federal legalization of hemp through the signing of the 2018 Farm Bill.

We’ve seen hemp cultivation significantly expand in the U.S. in 2018, with over triple the number of acres planted in hemp compared to last year and the addition of 4 more states with hemp programs,” said Eric Steenstra, President of Vote Hemp.“Now that we have lifted federal prohibition on hemp farming, it’s time to invest our energy in expanding hemp cultivation and the market for hemp products across the country so that all can reap the benefits of this versatile, historic American crop.”
Since the passage of Section 7606 of the 2014 Farm Bill, “Legitimacy of Industrial Hemp Research,” hemp cultivation in the U.S. has grown rapidly. The number of acres of hemp grown across 23 states totaled 78,176 in 2018—more than triple the number of acres from the previous year.  State licenses to cultivate hemp were issued to 3,544 farmers and researchers; and 40 universities conducted research on the crop, more than double the number of licenses issued in 2017. The new 2018 Farm Bill, signed into law by the President on December 20, 2018, includes Section 10113 titled “Hemp Production,” which removes hemp from the Controlled Substances Act, places full federal regulatory authority of hemp with USDA, and allows State departments of agriculture to submit hemp program plans for approval and regulate hemp cultivation per their State specific programs.
In addition to defining hemp as cannabis that contains no more than 0.3% THC by dry weight, the 2018 Farm Bill asserts a ‘whole plant’ definition of hemp, including plant extracts; and removes roadblocks to the rapidly growing hemp industry in the U.S., notably by authorizing and encouraging access to federal research funding for hemp, and removing restrictions on banking, water rights, and other regulatory roadblocks the hemp industry currently faces. An excellent source of dietary fiber, hemp seed is also a complete protein—meaning it contains all ten essential amino acids, with no enzyme inhibitors, making it more digestible by the human body. Advancements in hemp research and manufacturing demonstrate the remarkable versatility and product-potential for hemp. Hemp bast fiber has shown promising potential to replace graphene in supercapacitor batteries, which could then be used to power electric cars and handheld electric devices and tools. Hemp fiber can also be used to create environmentally friendly packaging materials, and hard bio-plastics for use in everything from airplanes to car parts. Hemp houses are also on the rise, as hempcrete, which is energy-efficient, non-toxic, resistant to mold, insects and fire, has many advantages to synthetic building materials, lumber and concrete.
To date, forty-one states have defined industrial hemp as distinct and removed barriers to its production. These states are able to take immediate advantage of the industrial hemp research and pilot program provision, Section 7606 of the Farm Bill: Alabama, Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Hawaii, Illinois, Indiana, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, and Wyoming.
