The US Copyright Office frees the McFlurry

I have spent a quarter century obsessed with the weirdest corner of the weirdest section of the worst internet law on the US statute books: Section 1201 of the Digital Millennium Copyright Act, the 1998 law that makes it a felony to help someone change how their own computer works so it serves them, rather than a distant corporation.

Under DMCA 1201, giving someone a tool to "bypass an access control for a copyrighted work" is a felony punishable by a 5-year prison sentence and a $500k fine – for a first offense. This law can refer to access controls for traditional copyrighted works, like movies. Under DMCA 1201, if you help someone with photosensitive epilepsy add a plug-in to the Netflix player in their browser that blocks strobing pictures that can trigger seizures, you're a felon:

But software is a copyrighted work, and everything from printer cartridges to car-engine parts have software in them. If the manufacturer puts an "access control" on that software, they can send their customers (and competitors) to prison for passing around tools to help them fix their cars or use third-party ink.

Now, even though the DMCA is a copyright law (that's what the "C" in DMCA stands for, after all); and even though blocking video strobes, using third party ink, and fixing your car are not copyright violations, the DMCA can still send you to prison, for a long-ass time for doing these things, provided the manufacturer designs their product so that using it the way that suits you best involves getting around an "access control."

As you might expect, this is quite a tempting proposition for any manufacturer hoping to enshittify their products, because they know you can't legally disenshittify them. These access controls have metastasized into every kind of device imaginable.

DMCA 1201 is the brainchild of Bruce Lehmann, Bill Clinton's Copyright Czar, who was repeatedly warned that cancerous proliferation this was the foreseeable, inevitable outcome of his pet policy. As a sop to his critics, Lehman added a largely ornamental safety valve to his law, ordering the US Copyright Office to invite submissions every three years petitioning for "use exemptions" to the blanket ban on circumventing access-controls.

I call this "ornamental" because if the Copyright Office thinks that, say, it should be legal for you to bypass an access control to use third-party ink in your printer, or a third-party app store in your phone, all they can do under DMCA 1201 is grant you the right to use a circumvention tool. But they can't give you the right to acquire that tool.

I know that sounds confusing, but that's only because it's very, very stupid. How stupid? Well, in 2001, the US Trade Representative arm-twisted the EU into adopting its own version of this law (Article 6 of the EUCD), and in 2003, Norway added the law to its lawbooks. On the eve of that addition, I traveled to Oslo to debate the minister involved:

The minister praised his law, explaining that it gave blind people the right to bypass access controls on ebooks so that they could feed them to screen readers, Braille printers, and other assistive tools. OK, I said, but how do they get the software that jailbreaks their ebooks so they can make use of this exemption? Am I allowed to give them that tool?

No, the minister said, you're not allowed to do that, that would be a crime.

Is the Norwegian government allowed to give them that tool? No. How about a blind rights advocacy group? No, not them either. A university computer science department? Nope. A commercial vendor? Certainly not.

No, the minister explained, under his law, a blind person would be expected to personally reverse engineer a program like Adobe E-Reader, in hopes of discovering a defect that they could exploit by writing a program to extract the ebook text.

Oh, I said. But if a blind person did manage to do this, could they supply that tool to other blind people?

Well, no, the minister said. Each and every blind person must personally – without any help from anyone else – figure out how to reverse-engineer the ebook program, and then individually author their own alternative reader program that worked with the text of their ebooks.

That is what is meant by a use exemption without a tools exemption. It's useless. A sick joke, even.

The US Copyright Office has been valiantly holding exemptions proceedings every three years since the start of this century, and they've granted many sensible exemptions, including ones to benefit people with disabilities, or to let you jailbreak your phone, or let media professors extract video clips from DVDs, and so on. Tens of thousands of person-hours have been flushed into this pointless exercise, generating a long list of things you are now technically allowed to do, but only if you are a reverse-engineering specialist type of computer programmer who can manage the process from beginning to end in total isolation and secrecy.

But there is one kind of use exception the Copyright Office can grant that is potentially game-changing: an exemption for decoding diagnostic codes.

You see, DMCA 1201 has been a critical weapon for the corporate anti-repair movement. By scrambling error codes in cars, tractors, appliances, insulin pumps, phones and other devices, manufacturers can wage war on independent repair, depriving third-party technicians of the diagnostic information they need to figure out how to fix your stuff and keep it going.

This is bad enough in normal times, but during the acute phase of the covid pandemic, hospitals found themselves unable to maintain their ventilators because of access controls. Nearly all ventilators come from a single med-tech monopolist, Medtronic, which charges hospitals hundreds of dollars to dispatch their own repair technicians to fix its products. But when covid ended nearly all travel, Medtronic could no longer provide on-site calls. Thankfully, an anonymous hacker started building homemade (illegal) circumvention devices to let hospital technicians fix the ventilators themselves, improvising housings for them from old clock radios, guitar pedals and whatever else was to hand, then mailing them anonymously to hospitals:

Once a manufacturer monopolizes repair in this way, they can force you to use their official service depots, charging you as much as they'd like; requiring you to use their official, expensive replacement parts; and dictating when your gadget is "too broken to fix," forcing you to buy a new one. That's bad enough when we're talking about refusing to fix a phone so you buy a new one – but imagine having a spinal injury and relying on a $100,000 exoskeleton to get from place to place and prevent muscle wasting, clots, and other immobility-related conditions, only to have the manufacturer decide that the gadget is too old to fix and refusing to give you the technical assistance to replace a watch battery so that you can get around again:

When the US Copyright Office grants a use exemption for extracting diagnostic codes from a busted device, they empower repair advocates to put that gadget up on a workbench and torture it into giving up those codes. The codes can then be integrated into an unofficial diagnostic tool, one that can make sense of the scrambled, obfuscated error codes that a device sends when it breaks – without having to unscramble them. In other words, only the company that makes the diagnostic tool has to bypass an access control, but the people who use that tool later do not violate DMCA 1201.

This is all relevant this month because the US Copyright Office just released the latest batch of 1201 exemptions, and among them is the right to circumvent access controls "allowing for repair of retail-level food preparation equipment":

While this covers all kinds of food prep gear, the exemption request – filed by Public Knowledge and Ifixit – was inspired by the bizarre war over the tragically fragile McFlurry machine. These machines – which extrude soft-serve frozen desserts – are notoriously failure-prone, with 5-16% of them broken at any given time. Taylor, the giant kitchen tech company that makes the machines, charges franchisees a fortune to repair them, producing a steady stream of profits for the company.

This sleazy business prompted some ice-cream hackers to found a startup called Kytch, a high-powered automation and diagnostic tool that was hugely popular with McDonald's franchisees (the gadget was partially designed by the legendary hardware hacker Andrew "bunnie" Huang!).

In response, Taylor played dirty, making a less-capable clone of the Kytch, trying to buy Kytch out, and teaming up with McDonald's corporate to bombard franchisees with legal scare-stories about the dangers of using a Kytch to keep their soft-serve flowing, thanks to DMCA 1201:

Kytch isn't the only beneficiary of the new exemption: all kinds of industrial kitchen equipment is covered. In upholding the Right to Repair, the Copyright Office overruled objections of some of its closest historical allies, the Entertainment Software Association, Motion Picture Association, and Recording Industry Association of America, who all sided with Taylor and McDonald's and opposed the exemption:

This is literally the only useful kind of DMCA 1201 exemption the Copyright Office can grant, and the fact that they granted it (along with a similar exemption for medical devices) is a welcome bright spot. But make no mistake, the fact that we finally found a narrow way in which DMCA 1201 can be made slightly less stupid does not redeem this outrageous law. It should still be repealed and condemned to the scrapheap of history.

The Dance of the Storm 风暴舞 (2021) - Whump List

Synopsis: After the death of his father, Li Junjie (on the left) was sent to an orphanage where he met Shi Yunhao (on the right). They became the best of friends, and years later entered a security agency as new recruits. Everything was fine, until Li Junjie suddenly disappeared for three years without a word. Now coming back and looking for revenge, Li Junjie is faced with mixed feelings coming from his agency, his brother and especially his ex-fiancée.

Notes: The WHUMP. The BROMANCE (in pink). The ACTION SCENES. It’s everything I need to keep my mind peacefully quiet. Monaco (03/05/2021)

The weeks leading up to mother’s day are always busy for flower shops, and Mirabelle knows this well. This year is her first year having her own shop, but she’s been employed in a flower shop for about two years after getting her vocational baccalauréat in horticulture. 

She knows how to operate a flower shop; running her business into the ground before it can fly is not in her ten-year plan. That’s why this year, for the first Mother’s Day of her shop, she’s going to do great. Or at least that’s the mantra she’s been repeating every hour for a few days.

She’s been living in Monaco for the past two years, so she can’t call herself a local yet. She has her own flat, and she pays her own bills (to the French government, to her great disappointment; what she wouldn’t do to get tax exemptions like most people living in Monaco…).

Her flat is situated near the French border, but you could say that most streets in Monaco are near the border, unless you want to live in the Mediterranean Sea. And while Mirabelle thinks fish are cute in their own way, she doesn’t think that she’d like to spend the rest of her days underwater, eating algae. And Mirabelle has always preferred Barbie: Fairytopia to Barbie in a Mermaid Tale.

The view from her flat is amazing, because she lives on the highest floor of the building. Not a penthouse, but a flat under the roof, she says. She managed to get it for a reduced price because of the state it was in when she bought it. Still, what she owes the bank haunts her in her dreams. One more reason for Mother’s Day this year to be a success. Monaco is home to a lot of foreigners (as she is); and so deals for the celebration can run during more than a week. For Monaco-natives, or Monégasques, as they like to insist upon, Mother’s day is May 30th this year. For French people like Mirabelle and her mother; Marie, it will be on the same day. But she knows that there are a lot of Italians coming to Monaco during the month of May, following the Grand Prix, and so the day of the celebration will be on May 9th. Which is less than a week away.

Today is Monday. This means that she has six days left to prepare for the rush and to write down orders. And rich people always want exotic flowers or flowers that don’t bloom during the spring for Mother’s Day. Which, fair. If she had that kind of money, Mirabelle would decorate all year around with lilac or hibiscus. Unfortunately, she cannot, and her flat is already filled to the brim with potted plants anyways. Maybe she could try and grow wisteria. 

Lilac, or Syringa vulgaris, blooms during spring, but it’s not a flower commonly used in bouquets and even less for Mother’s Day. Depending on the colour of the lilac, the flowers can mean the first love of someone (lilac colour, the name of the shade coming directly from the flower), which could be used for this celebration, Mirabelle thinks, even if it would be a bit strange; or mourning a loved one for darker purples. Not really sought after for Mother’s Day.  

Mirabelle needs to get a stock of lilies this year. It’s a flower often wanted for bouquets destined to mothers, because one of the meanings of lilies is motherhood. Still, lilies bloom during summer, so Mirabelle isn’t the happiest when dealing with people demanding she use lilies for bouquets in the middle of spring.

White roses are a staple too, and so she needs to contact her supplier to see if he has any news about her shipment. She has ordered more than a hundred roses for Friday, which would leave her the time to prep the flowers for the rush of Saturday night leading into Sunday.  Her fridge is already stocked to the brim with caffeinated drinks; keeping them cold in order for her to make it through the night. 

At least the city is still navigable (for now), the Grand Prix of Monaco taking place at the end of the month. This week is… Spain, if she remembers correctly. While Mirabelle watches 1 occasionally, she’s not that informed. The only moments when she gets new information is when she goes to Cece’s flat to watch races when they are at a reasonable time. 

Cécé, from her first name Célia, has been Mirabelle's best friend since kindergarten, when a boy had decided to push Mirabelle to the ground, saying that carrot people needed to stay in the dirt where they belonged and Célia had pushed the boy right back, stomping on his hand for good measure. Cece has always been spirited. And when she was younger, Mirabelle indeed had carrot-like red hair. Now the colour has faded, settling into a comfortable strawberry blonde, still keeping her darker ginger highlights in the summertime. She still lives in Nice, their hometown and is studying business with a focus on luxury.

Startled out of her thoughts by a passing truck, Mirabelle shakes her head and looks at the shop front of her business. She likes the vibes, she thinks. She’d decorated everything with the help of Cece and Nathan before the grand opening a few weeks ago. Nathan, Cece’s fiancé, was great to have around to renovate an old building, the guy being quite tall and good with manual tasks. The only downside is his inability to stay still for more than two consecutive minutes and his clumsiness. 

From an external viewpoint, the shop looks like an antique store, with its forest green wooden front and the gold lettering above the door and the windows. Mirabelle did it herself, which she is really proud of. The gold works quite well against the green of the background, in her opinion. And the honeysuckle climbing at the side of the shop is great. She still needs to find a name for it. Maybe Cece would have an idea. 

Mirabelle takes out her phone and steps onto the street to take a picture of it, sending it to her best friend to ask for her opinion. The picture is great, now that she’s looking at it. It just needs some touch ups, and she’ll post it on her instagram page. She still needs to check the vlog she posted yesterday on Youtube. 

The idea of filming her life everyday and posting it as vlogs was her little sister’s idea. Amandine is currently in 9th grade, but because she’s in a boarding school in the north of France, she only has access to her phone for half an hour everyday to call their parents. Apparently, she also has access to her phone on weekends, because that’s when she calls Mirabelle. And so, to get updates on her sister’s life, Amandine had made her take a resolution for the new year: film her life a bit everyday and post it on Sunday afternoon, when she still has time to use her phone to watch the Youtube video. Well, at first Amandine had wanted Mirabelle to use Tiktok, but Mirabelle still hasn’t used the app, and even less downloaded it.

And so Youtube it was. At first, she tried talking face to the camera, but honestly, that took so much time that she discarded it after the third week of filming. Between the script (Mirabelle is not confident enough in her skills in front of a lens yet to talk without any notes), the filming and the editing, she didn’t have the time to actually live her everyday life. And so now, her camera is on when she goes about her business, during her trips between home and the shop…

Mirabelle will admit, filming oneself does boost one’s confidence, because now she’s quit her previous job and opened her own flower shop, all of this in less than five months. Which, in her opinion, is so strange that sometimes she wonders if she were a saint in her previous life. Or maybe the bad karma will only appear in a few years, when she’s resting on her laurels. 

If it comes in the future, let it come. Nothing is set in stone, and she’ll enjoy what she has for now, even as she watches the people around her like a plant yearning for the sun, reaching and reaching and never embracing the golden star.

Monaco (09/05/2021)

Oscar was bored. Monaco was good and nice, but after a week with his parents and his three younger sisters, he was ready to throw himself over the hotel’s balcony into the water. Fortunately, this was his last day of vacation, and he would go back to the sim room and his training. He still had no idea why his mum wanted to go to Monaco, of all places, to spend his vacation week. She was right that it made more sense to visit the city state before or after the racing season, but a mere ten days before was pushing it, in his opinion. 

At least they went to visit some cities in the south of France. Nice is quite pretty, with its old town and warm colours, and Menton was nice, even if they missed what is apparently a whole two weeks of celebrating lemons.

What an idea. But to each their own, his mum would say. And she’s right, he shouldn’t judge. But still. If he can trust the internet, they have whole floats made of lemons. He won’t ever understand France, he thinks. 

It’s morning now, and as usual, he opens up his phone to check if he received any message or emails during the night. Because Australia is on the other side of the world, some of the conversations he has with friends wait until one of the participants is awake to continue. Just spams, and a reminder coming from his calendar app. Fuck. It’s Mother’s Day. So that’s why his mum is still not up. 

He gets out of the bathroom in a hurry, puts his clothes on, checks that he has his wallet and the key to the hotel room with him and goes out the door. How could he forget? Every year, he usually puts a reminder two weeks before the date so he has the time to prepare something nice for his mum. This year, he bought her a bracelet, but now that he thinks about it, it’s been forgotten amidst the preparations for the trip to Monaco. He didn’t bring it on the trip. This means that he’s going to have to wait for them to go back home, all the way in Australia, to give her the bracelet. What to do now?

There must be a florist in the area. 

As he waits for the elevator and then goes inside, he’s opening Maps and writing florist in the search bar. Apparently, there are two florists near the hotel, one closer than the other. That's where he’ll go, he decides. He doesn’t have any time to lose, especially if he wants to buy breakfast for his mum before she wakes up. 

His run to the florist is short, fortunately. Monaco is hell to run through, with its elevation. He mustn’t be the only one waiting for flowers, as there’s a queue of at least ten people. He checks his phone regularly as he waits, to see if his father has sent him any message. He doesn’t want to risk sending the first message, afraid that the sound of the notification would wake up his mum.

Strangely, the queue goes quite fast and once they say what they’re here for, the florist just goes through a back door and comes back with a bouquet; he must be really efficient at putting up bouquets together.

In front of the florist, a balding man in his forties, he tries to explain his predicament in french before giving up and explaining in english. The man frowns.

“Young man, this is a high-end flower shop. We only take orders at least a week before for our client's utmost satisfaction.” The florist leaves Oscar alone for a minute as he goes to bring a bouquet to the woman behind him in the queue. He continues, “You can still order flowers for next week, but I'm sorry to say that you won’t be able to get a bouquet today.You could still go to another shop, I think a lovely girl has opened up hers just 10 minutes away from here!”

With this said, Oscar thanks the florist in a hurry and runs to the location he’s been given. There’s a climbing plant growing on the side of the dark green storefront, and the inside of the flower, which he can see through the large windows, is luminous. Above the shop is written “Desmarais - Fleuriste” in gold letters. The flower has a fragrant smell, sweet but not too overpowering. It’s not jasmine, Oscar thinks. He would have recognised it. It’s soft, and he can’t help but sop for a few seconds and close his eyes to try and imprint the scent into his brain. He gets closer to the door, ready to enter the flower shop, and a man leaves, loudly declaring “Merci!” (Thank you!) over his shoulder to the person behind the counter.

There’s a girl. 

She’s a girl. 

Oscar’s seen girls before, of course. His mum is a girl. And he has three younger sisters. He knows plenty of girls. He's just… He doesn’t know this girl. Of course he doesn’t know this girl. She’s probably from here, and he has not been in Monaco a lot. 

She’s pretty. Not the kind of pretty you turn around in the street for or the kind you see on TV. Oscar would turn around and stop in the street, he thinks. But this girl, she’s the kind of pretty that comes with the sweetness of summer when fruits are ripe or the lightness of the breeze when you watch the sunset, on the beach with sand between your toes.

With the sun coming from the window, her hair is the color of this sunset, or perhaps more of the sunrise, light oranges blending with gold bathed in light. She has a brown apron on, and it only adds to her beauty, almost imperceptible freckles dotted over her whole face; they frame it like a painting, from her forehead down her wheels to her chin. They’re forming a constellation, Oscar is sure of this, and he wants to know which one. He would stay and watch her all day long, he thinks.  

It’s only when she waves her hand that he realises that he’s been staring at her for far too long. She’s speaking, too.

“Bonjour? Hi? How may I help you?” Her voice is melodic. His feet bring him closer. He should answer, right?

“Um… Hi.” What to say next? Should he ask for her name? No. That’s too forward. She’s pretty. Maybe that’s not the right adjective. She’s enchanting to look at, mesmerizing. She’s a siren and Oscar is just the poor sailor caught in her trap. Oscar doesn't know why he came here anymore. Maybe he can stay here, right where he is, and keep watching her. Would that make him a creep? Maybe if she’s aware of it it’s less creepy. 

“Are… are you okay? Do you need to sit down?” And she’s nice. She takes care of people. She doesn’t want him to suffer. She’s perfect, actually. Oscar thinks that he would follow her to the end of the world if she welcomed him. 

She’s coming over. Should he move? Oscar holds his breath, heart thundering in his ears. She takes his hand. Are they… are they going too fast? With his hand between hers, she guides him to a wooden stool, sitting him down. And then she leaves him. She’s decided to leave him, and he will be like Ariadne waiting for Theseus to come back. 

As soon as he thinks about this myth, she comes back, a glass of cool water in her hand. She puts it in his hand, blinking at him slowly.

“Hey, I brought you water. You know this, you have it in your hand, I don’t know why I said this.I hope you’re not having a stroke. But if you are, that's totally fine, or not, I guess. But I'll call the pompiers in thirty seconds if you don’t answer.” She hasn’t breathed once during her small tirade. But Oscar doesn’t want to inconvenience her more than he already has if he can help it. So this means he needs to say something.

“You’re pretty,” he blurts. Wow. Great first impressions, Oscar. 

She’s blushing. He can see this, her face close to his and her skin fair and almost translucent. Maybe he hasn’t fumbled this too much. 

“Right. Thank you. Did you come into the shop just to tell me this? Not that I’m ungrateful, of course. I’m really grateful actually. Thank you.” She’s cute. And she’s blushing even more, now. He can see it spreading to her ears and down her neck and… No. No impure thoughts. Think about something else, Oscar. What can you see? Her blush. Stop it. Flowers. Right, flowers. Flowers, flowers… Mother’s Day!

“Shit, sorry. I’m just—I actually came because I need flowers for my mum. It’s Mother’s Day.” Does he still have time before his mum wakes up? “So, yep. I need flowers”

“Of course!” she smiles and gets back. Oscar feels the spot where she was getting colder, and the hole in his chest gets bigger. She walks over to her working station and takes a pen and paper in hand. “Did you have particular flowers in mind? or a budget?”

“Do you know of any flowers that mean either gratefulness or flowers to apologize? I forgot her gift back home. Which now that I think about it, is maybe too much information?” He scratches the back of his head with his right hand. Honestly he’s not that worried about the price. His allowance should cover it. even if it ends up being higher than he anticipated.

“Well; if it’s for your mother and to apologise, pink oeillets are great. I think their English name is carnations.” She walks towards one of the walls filled to the brim with flowers and takes a pink one in her hand. “It’s this one, see?”

The flower’s pretty. Not as pretty as her, of course. 

“I like them. Could I have a bouquet?” She seems surprised; why? Fortunately, what she says next explains it.

“Don’t you want to hear about other flowers?” She asks, and he shakes his head right to left. “What’s interesting with carnations is that in France, they also mean gratefulness, so this means that they’ll be spot on for what you want!”

Oscar only nods, still dazed. He stays where he is, not moving an inch.

“I’ll make the bouquet, and as we go, you can tell me if you want more or less flowers, is that okay with you?” Oscar had planned on going to the bakery while the florist created the bouquet, but now that he is faced with the possibility of staying with her, he thinks he’ll stay and watch her work. 

Oscar observes her as she works and busies herself with selecting the flowers in the best conditions and filler flowers to add to the bouquet. It occurs to him that he hasn’t asked for her name. He should. When she asks him if there are enough flowers for the bouquet, Oscar hasn’t listened to a word coming out of her mouth, too occupied with watching her. And so he nods, agreeing with her, and when he realises that this means that he will spend less time with her because he’ll have to leave with the bouquet, it’s already too late, she’s wrapping the bouquet in pink tissue and white kraft paper; putting the finishes touches in the form of raffia and stapling her business card to the paper.

Once she finishes, she catches Oscar’s eye and smiles, blushing all the while. 

“It’s all done! Your total will be 35€.” She says while tapping on her till. The machine beeps and a receipt comes out of it. 

Oscar pays and he takes the bouquet that she holds out to him. Now he doesn’t want to leave. He should say something. At least ask for her name. “What’s y—”

“I wondered if—” They both speak at the same time, stopping when they realise the other is about to ask something. He manages to speak.

“Please go first”, he says gesturing with his free hand. Her blush is stronger now. She tucks a strand of hair behind her hair before speaking, and Oscar tracks the motion with his eyes, a cat with a treat.

“Well, I just—I wondered what your name was? If that’s not too forward, of course!” She bites her lips at her own advances, a mindless habit. He’d been about to ask the same thing, and so he’s happy that he’s not the only one who may be interested. This means he can feel less creepy.

“I’m Oscar. It’s great to meet you! And I was about to ask for your name too…” Oscar is all too happy to give his name to this enchanting florist. He can’t wait to hear her name.

“Uh. Well I'm Mirabelle, and it’s also great to meet you, and I hope that your mother will enjoy the flowers.” She smiles as she says this, and he thinks about the fruit, the mirabelle plum, with its sunset skin, so close to the colour of her hair.

“Your name is beautiful.” Just like you, he doesn’t say. “ I don’t know how to say this, but I’m coming back to Monaco in ten days, and I don’t know if you’ll be free or anything, and if you have anything to do or if you’re not interested, please don’t mind me and ignore me and forget I ever said anything but would you maybe want to go and drink a coffee with me?”

Oscar doesn’t know if she’ll be able to understand his word vomit. It probably makes no sense. The blush, which had begun to fade, comes back in full. 

“Yes of course! Hum… I’ll have to check if I'm free, but maybe I could send you a text to tell you?” Oscar thinks his soul just left his body. Did Mirabelle, the pretty florist, just ask for his name and then his number? He must be the luckiest man alive. He gives her his phone with a bit of gymnastics with his left arm, taking it from his right back pocket and unlocking it. She quickly types in her number and returns the divide to Oscar. When he looks at the contact she created, he can see she put in a purple flower next to her name.

“I couldn’t find lilacs in the emoji section, so I put a hyacinth,” she explains. He’s already half in love with her, he thinks. Whoever said that love at first sight doesn’t exist is wrong. She adds, “by the way, if you don’t want to damage the bouquet on the way back, you should hold it upside down.”

Oscar can feel his neck getting hot, and even if he doesn’t want to leave her, he knows he has to go back to the hotel room. And so he turns around, says goodbye, and he feels like Odysseus leaving Penelope, the flower shop their Ithaca.

He stops on the doorstep before leaving and turns around to say goodbye one last time. Mirabelle sees him and waves.

“Goodbye Oscar, see you soon! And you’re very pretty too”. At that, Mirabelle winks and hurries to busy herself.

Oscar finally leaves, all the while thinking about her.

Once he gets back to the hotel room, he realises that he forgot to go buy breakfast, and so when he sees his sister Hattie, he tells her to be quick and ask the reception for room service before their mum wakes up. When everything is set up, the four siblings gather in their parent’s room and slowly wake them up. Privately Oscar can guess that their mum was already awake, waiting for them.

By the time breakfast is finished, Oscar has spaced out more than once, and his mum can’t help but ask him what he’s thinking about.

“My future wife,” he blurts, before his mouth shuts and his eyes go wide. his parents share a glance.

“I thought you didn’t want to get married,” his mother says, and Oscar shakes his head. That’s true, he doesn’t want to get married, and he doesn’t think he ever will.

“I meant it in a spiritual sense. I met my soulmate today. She’s the one who made the bouquet”. 

And Nicole Piastri only has one answer for him:

“Well, you’ll have to practice your French, then.”

[DOWNLOAD] COLORED CEILING LIGHTS (16 COLORS - 5 DIFFERENT INTENSITIES + INVISIBLE RECOLORS) - UPDATED 07/02/2024

Finally here are the colored lights! I've always loved NL neons, but I've always hated that they were huge and impossible to put in residential lots unless you want to make your home look like a fantasy, alien or futuristic house.

I specify that those who use lighting mod see the intensities from 4 to 5 very bright (like me in the video), but those who do not use lighting mod see the intensities from 4 to 5 as in the video the intensities from 1 to 3 are shown! Intensities 4 to 5 are for those who don't have lighting mods!

EXPLANATIONS AND CREDITS

(Skip it if you want, but it's full of credit for other persons)

For years I looked for invisible recolors of NL neons, or someone who had changed the mesh of these, but I never found anything.

I remember that, perhaps, I had once found an invisible recolor of the round neon lights that you can place on the wall, but honestly that recolor never worked for me ;_:

So I gave up, I lost hope of having some comfortable neon lights that I could put in my house and I went on with my life, until...one day I don't remember what I was doing in game, I took a cc lamp I had and saw that it had a beautiful colored light. I told @jacky93sims "this light is beautiful, but the mesh is huge and impossible to use".

At first, since I just wanted to do something personal, I wanted to change the mesh of that cc, but I had difficulty because I didn't know how to do one thing yet (which I now know how to do). So Jacky said to me "but instead of changing the mesh why don't you take a lamp from the game you like and change the light using the light from this cc?" and she proceeds to send me a tutorial on how to do it. She then added "it's a Nightlife light, it's called [name of light]".

And that's where it all started.

I looked for that lamp in the game, I found it, and it was this one that I asked you about a few days ago.

However, there was a little mystery surrounding it: this neon does not emit light, but both Jacky and I saw blue light. Just me and her. Nobody else.

It was strange. Right now my suspicion is that we probably have a different light from everyone else because we use two lighting mods which, although different, use the same settings for that particular light.

But...Jacky doesn't have NL, yet she saw the RGB color of that NL light, how was that possible? Snooping around a bit in the file, we then discovered that the RGB value was set to emit that particular color. Jacky then understood how to make the RGB codes work on simPe, she explained it to me and out of curiosity I started trying other colors: BINGO! The light could become any color I wanted! And what's even more beautiful? Even Jacky, without having NL could do it! It therefore meant that we could create neons without needing NL and above all... without editing game files.

I was so happy. So to test that light would work for everyone, I sent the light to @simstraffikcone @ash1c , but... it was a fail. It didn't work for them. Right now I thought it was because Traffikcone not have a lighting mod, while Ash has the Maxis Match Lighting mod, which I remember not having that specific NL light with the blue light as Jacky and I see it.

I was confused. I could edit a lot of non-RGB lights and make the colors work on many of them, but no one but me saw those colors when I sent the files. Then Jacky suggested to try using the source of these RGB spotlights... and finally, with this the others were able to see all the colors too!

I hope that the creator of these spotlights doesn't mind that I used the same source, their post is from 18 years ago, the last time they was online was 2021 and they doesn't have a TOU. From the name of the light it seems like a custom light, but not having a custom installation I can't say. This creator is a pro when it comes to editing game lights, I saw them talk about it on some posts on MTS!

In the end, It doesn't matter what kind of light it was, I just needed the RGB values to work.

PROS AND CONS

But at this point you're thinking, looking at they profile on MTS "but sorry, this creator also made RGB ceiling lights, so what are yours for?" and here... comes the part where I explain why my lights exist (don't fall asleep, I'm almost done, I swear)

Its ceiling lights have two requirements that I tried to bypass: you need NL to make them work and to do extra steps, editing game files. Some people are uncomfortable doing these things, others don't have all the expansions!

My lights don't need NL to work and you don't have to do any extra steps, you don't have to edit any of the game files, you just put them in the download folder and play with them.

And why this? Because I don't use the source of their ceiling lights, but that of their spotlights!

But here too you may be wondering...why not use spotlights then? Well...it is a question that includes many factors:

- The spotlights are very nice to use in the garden, but what if you want to use those colored lights indoors? Wouldn't it be strange to have garden lights around the house INSIDE the rooms? I think sims can bypass them, but it's not very aesthetic! With my ceiling lamp not only you not take up space in the house and you can't see it, if you don't want to see it at all you also have the option of making it invisible!

- True, you can mess around with colors to get colors other than red, blue and green, but my lights come with 16 ready colors! So you don't have to bombard an area full of spotlights to form a color! (Mine can mix too btw)

- The spotlights can illuminate a maximum of one or two objects that they point to, this means that to illuminate multiple objects you should use lots of spotlights. My lights on the other hand illuminate practically every object in the room!

- The ONLY con my lights have is that following the light settings of the RGB spotlights, my lights illuminate all objects and sims, but not the walls and floors. This means that you won't always get nice effects, you have to experiment a little. Sometimes rooms that are too empty will have bad effects, it is better to use them on rooms full of objects that reflect light. I tried to solve this problem, but unfortunately I haven't succeeded yet. And this is the same reason why I'm only doing the ceiling version.

I want to point out, however, that I am not discrediting their lights. Indeed, without their work today I couldn't even create these lights! So BIG THANKS to their works! I invite you to also download their (absolutely compatible with mine) They are NOT necessary to make mine work, but if you want to use their too, you can!

Another of the advantages that these lights have is that they work both for those who do not have lighting mods and for those who have them. (Obviously those who have lighting mods have better light and shadow effects, but I can't do nothing about this).

The solution was to create different intensities. People who have lighting mods see lights that basically have low intensity with high intensities. People without a lighting mod see lights with low intensity...well, with very low intensity.

For this reason I made sure that each set of lights has unique guids and that they can all work together. You can put all 5 sets in your download folder, figure out which lights you see best, and delete the ones you don't see well.

I can already tell you that people who don't use lighting mods can use intensities 3 to 5, while those who use lighting mods can use intensities 1 to 3!

So to summarize, the pro of this light are:

Base Game compatible. (You don't need NL!)

Work with and without lighting mods.

5 different intensity which you can choose.

16 ready colors to use.

Invisible recolors for all the 5 sets of intensity.

Ready collection files for all the 5 sets (residential and community lots)

You don't need to edit game files. Installation is simple. Put everything in the download folder and it works. (Everything except the collections you have to put them in the collection(s) folder)

By enabling moveobjects you can put them ANYWHERE, they work both inside and outside the house, and you can use invisible recolors to hide them.

Because they use the light from the RGB spotlights, you can mix colors and sometimes you can create some really cool gradient effects!

They work better with the light off, but even with the light on it has a nice effect because the colors that reflect on the furniture can still be seen.

And the downside...precisely, is only that the walls and the floor don't light up, but I'll see if I can resolve this in the future.

Stop! I'm done torturing you with my chatter! In the download you will find a .rar with all 5 sets + a folder with two collections for every set! (One for community lots and one for residential lots)

Leveraged buyouts are not like mortgages

I'm coming to DEFCON! On FRIDAY (Aug 9), I'm emceeing the EFF POKER TOURNAMENT (noon at the Horseshoe Poker Room), and appearing on the BRICKED AND ABANDONED panel (5PM, LVCC - L1 - HW1–11–01). On SATURDAY (Aug 10), I'm giving a keynote called "DISENSHITTIFY OR DIE! How hackers can seize the means of computation and build a new, good internet that is hardened against our asshole bosses' insatiable horniness for enshittification" (noon, LVCC - L1 - HW1–11–01).

Here's an open secret: the confusing jargon of finance is not the product of some inherent complexity that requires a whole new vocabulary. Rather, finance-talk is all obfuscation, because if we called finance tactics by their plain-language names, it would be obvious that the sector exists to defraud the public and loot the real economy.

Take "leveraged buyout," a polite name for stealing a whole goddamned company:

Identify a company that owns valuable assets that are required for its continued operation, such as the real-estate occupied by its outlets, or even its lines of credit with suppliers;

Approach lenders (usually banks) and ask for money to buy the company, offering the company itself (which you don't own!) as collateral on the loan;

Offer some of those loaned funds to shareholders of the company and convince a key block of those shareholders (for example, executives with large stock grants, or speculators who've acquired large positions in the company, or people who've inherited shares from early investors but are disengaged from the operation of the firm) to demand that the company be sold to the looters;

Call a vote on selling the company at the promised price, counting on the fact that many investors will not participate in that vote (for example, the big index funds like Vanguard almost never vote on motions like this), which means that a minority of shareholders can force the sale;

Once you own the company, start to strip-mine its assets: sell its real-estate, start stiffing suppliers, fire masses of workers, all in the name of "repaying the debts" that you took on to buy the company.

This process has its own euphemistic jargon, for example, "rightsizing" for layoffs, or "introducing efficiencies" for stiffing suppliers or selling key assets and leasing them back. The looters – usually organized as private equity funds or hedge funds – will extract all the liquid capital – and give it to themselves as a "special dividend." Increasingly, there's also a "divi recap," which is a euphemism for borrowing even more money backed by the company's assets and then handing it to the private equity fund:

Now, you can't demolish that much of the US productive economy without attracting some negative attention, so the looter spin-machine has perfected some talking points to hand-wave away the criticism that borrowing money using something you don't own as collateral in order to buy it and wreck it is obviously a dishonest (and potentially criminal) destructive practice.

The most common one is that borrowing money against an asset you don't own is just like getting a mortgage. This is such a badly flawed analogy that it is really a testament to the efficacy of the baffle-em-with-bullshit gambit to convince us all that we're too stupid to understand how finance works.

Sure: if I put an offer on your house, I will go to my credit union and ask the for a mortgage that uses your house as collateral. But the difference here is that you own your house, and the only way I can buy it – the only way I can actually get that mortgage – is if you agree to sell it to me.

Owner-occupied homes typically have uncomplicated ownership structures. Typically, they're owned by an individual or a couple. Sometimes they're the property of an estate that's divided up among multiple heirs, whose relationship is mediated by a will and a probate court. Title can be contested through a divorce, where disputes are settled by a divorce court. At the outer edge of complexity, you get things like polycules or lifelong roommates who've formed an LLC s they can own a house among several parties, but the LLC will have bylaws, and typically all those co-owners will be fully engaged in any sale process.

Leveraged buyouts don't target companies with simple ownership structures. They depend on firms whose equity is split among many parties, some of whom will be utterly disengaged from the firm's daily operations – say, the kids of an early employee who got a big stock grant but left before the company grew up. The looter needs to convince a few of these "owners" to force a vote on the acquisition, and then rely on the idea that many of the other shareholders will simply abstain from a vote. Asset managers are ubiquitous absentee owners who own large stakes in literally every major firm in the economy. The big funds – Vanguard, Blackrock, State Street – "buy the whole market" (a big share in every top-capitalized firm on a given stock exchange) and then seek to deliver returns equal to the overall performance of the market. If the market goes up by 5%, the index funds need to grow by 5%. If the market goes down by 5%, then so do those funds. The managers of those funds are trying to match the performance of the market, not improve on it (by voting on corporate governance decisions, say), or to beat it (by only buying stocks of companies they judge to be good bets):

Your family home is nothing like one of these companies. It doesn't have a bunch of minority shareholders who can force a vote, or a large block of disengaged "owners" who won't show up when that vote is called. There isn't a class of senior managers – Chief Kitchen Officer! – who have been granted large blocks of options that let them have a say in whether you will become homeless.

Now, there are homes that fit this description, and they're a fucking disaster. These are the "heirs property" homes, generally owned by the Black descendants of enslaved people who were given the proverbial 40 acres and a mule. Many prosperous majority Black settlements in the American South are composed of these kinds of lots.

Given the historical context – illiterate ex-slaves getting property as reparations or as reward for fighting with the Union Army – the titles for these lands are often muddy, with informal transfers from parents to kids sorted out with handshakes and not memorialized by hiring lawyers to update the deeds. This has created an irresistible opportunity for a certain kind of scammer, who will pull the deeds, hire genealogists to map the family trees of the original owners, and locate distant descendants with homeopathically small claims on the property. These descendants don't even know they own these claims, don't even know about these ancestors, and when they're offered a few thousand bucks for their claim, they naturally take it.

Now, armed with a claim on the property, the heirs property scammers force an auction of it, keeping the process under wraps until the last instant. If they're really lucky, they're the only bidder and they can buy the entire property for pennies on the dollar and then evict the family that has lived on it since Reconstruction. Sometimes, the family will get wind of the scam and show up to bid against the scammer, but the scammer has deep capital reserves and can easily win the auction, with the same result:

A similar outrage has been playing out for years in Hawai'i, where indigenous familial claims on ancestral lands have been diffused through descendants who don't even know they're co-owner of a place where their distant cousins have lived since pre-colonial times. These descendants are offered small sums to part with their stakes, which allows the speculator to force a sale and kick the indigenous Hawai'ians off their family lands so they can be turned into condos or hotels. Mark Zuckerberg used this "quiet title and partition" scam to dispossess hundreds of Hawai'ian families:

Heirs property and quiet title and partition are a much better analogy to a leveraged buyout than a mortgage is, because they're ways of stealing something valuable from people who depend on it and maintain it, and smashing it and selling it off.

Strip away all the jargon, and private equity is just another scam, albeit one with pretensions to respectability. Its practitioners are ripoff artists. You know the notorious "carried interest loophole" that politicians periodically discover and decry? "Carried interest" has nothing to do with the interest on a loan. The "carried interest" rule dates back to 16th century sea-captains, and it refers to the "interest" they had in the cargo they "carried":

Private equity managers are like sea captains in exactly the same way that leveraged buyouts are like mortgages: not at all.

And it's not like private equity is good to its investors: scams like "continuation funds" allow PE looters to steal all the money they made from strip mining valuable companies, so they show no profits on paper when it comes time to pay their investors:

Those investors are just as bamboozled as we are, which is why they keep giving more money to PE funds. Today, the "dry powder" (uninvested money) that PE holds has reached an all-time record high of $2.62 trillion – money from pension funds and rich people and sovereign wealth funds, stockpiled in anticipation of buying and destroying even more profitable, productive, useful businesses:

The practices of PE are crooked as hell, and it's only the fact that they use euphemisms and deceptive analogies to home mortgages that keeps them from being shut down. Alleged February 2022 breakup timeline

A new anon had questions about the alleged breakup in February 2022. I directed her to the Lazy Anon list but apparently that wasn't extensively covered besides the facts MG seen in Brazil this date, back in Monaco this date. So I went hunting. Obviously with Steppy gone it's a bit more complicated but here's things that happened around the time I didn't even remember. I haven't looked/read through the list thoroughly since they were originally posted. Only when I needed to look up for a specific date for a post myself.

18/01 people find out about MG's ex AN and that she is liking all his posts even though she's not following him

19/01 MG says haters use her social media to hate so from now on will only post on closed friends and her private account

20/01 that didn't take long. Posted a picture with Mini MG and the cat.

21/01 MG unlikes all the AN posts. An account named mysticalkelly posts about it. He sees their story and refollows MG.

23/01 Deuxmoi allegedly posted about it but I can't find the actual post itself. The twitter account that stated in December 2021 to have seen MG very intimate with a mystery man came back and said the mystery man looks a lot like AN. Mysticalkelly was suspended.

24/01 Max and MG fly to Austria together where he has to do some Redbull PR. Over the next week "anons" defend MG like crazy on tumblr and IG. Some messages sound suspiciously like MG herself.

31/01 oh look pregnancy rumors started and MG posts cryptic shit again.

04/02 over the past days "Max" went on a blocking spree and MG responded in DM he is furious this needs to stop. Minion army activated and bully a lot of anti accounts

11/02 another cryptic message. Kellyteaquette gets suspended. Rumor about pregnancy and end of. Pinterest handholding picture gate. Allegedly MG posted a picture (that should be in the Lazy list or Flower has for sure talked about it. But it was found on Pinterest and it's not known if this was actually posted and quickly deleted by MG or made up [by whom?]) But MG had a reason to call out fake things. This reminds me a lot of the Natty situation after Monaco GP 2024 when old things that could be argued as fake (still believe it's true) was reshared for her to claim AI fake news but not address real gossip. February 11th 2022 was definitely a very busy day.

12/02 Serendipity exposed. What was a theory for a long time finally gets exposed in a long 3 part series. This was posted so many times I won't bother to repost it.

14/02 Valentine's day and there's reason to believe the bouquet she posted was from 2021

16/02 Anti accounts get a lot of Max has always loved her and chased her since he was very young messages. As proof it says the old likes on her posts. One anon claimed that these likes on old pictures are new because they've checked after the first rumors of them in 2020 aka Serendipity happened and at that time in October/November 2020 he did not have a like on old MG posts from 2016.

21/02 MG deleted 200 posts mostly with Kvyat from her IG and she unfollowed him. Do we know when Kvyat started dating again. Is it possible he got a girlfriend on February 21st 2022? Or is that when Max and her allegedly broke up?

23 to 26/02 Preseason testing in Barcelona. No MG and somebody who claimed to be there allegedly overheard Max on the phone.

27/02 MG shows up in Brazil out of the blue. Breakup rumors in Brasilia.

28/02 MG back liking AN posts

02/03 alleged Monaco based anon claimed MG left few days ago with a lot of luggage and Max's mother arrived to his apartment

03/03 a Max fanpage posted a picture of him holding a little child. Anons find out it's old and was posted on 13th December from when he was in Brazil during the race weeks earlier. Immediately after a MG fanpage posted her with the same child at a later date trying to make it seem like Max is in Brazil with her. He was not. 04/03 MG posts she's back home with full blown otitis. Max is in Ibiza to celebrate his father's birthday. She later posts a table full of flowers and a flower teddy bear and tags him however the tag doesn't work and doesn't link to his account. Anon finds out that the flower shop in Monaco does not sell the flower teddy bear for months as it's from an old collection and the new one has different boxing.

05/03 twitter anon came back with a recap of all rumors

07/03 elevator selfie of sick MG and Max "back from taking this sick puppy to the doctors". This wasn't posted by Max. It was posted by her. However Max's jet was in Milton Keynes that day.

10/03 we find out about the group chat MG is part of with her minions and gives them information. The following days minions get very aggressive towards every anti page on tumblr and IG because of the group chat leak.

13/03 people question where Mini MG is and suspect she's still in Brazil. Several comparison pictures of "new" and old were posted but I don't want to repost mini MG here. If she's indeed still in Brazil it also proofs the welcome back flowers are old because Peppa Pig was running on TV in the background

15/03 MG in Bahrain. The very first mentions of his nudes I could find. Very interesting.

18/03 rumors of an argument at breakfast and MG won't be at the track posted in the morning. And she was not at the track.

19/03 MG did go today. They looked tense.

20/03 she walks in by herself posing for the photographers but ends up watching the race from the tower and not the garage as usual. Rumors from the paddock after the race.

22/03 MG contacts the admins of various wag fan pages and asks them to delete some pictures. There's a wag admin group chat (different from the minion chat) and their conversation gets leaked. Some unedited pictures were unflattering and started pregnancy rumors again.

23/03 anons realised MG wasn't following her "bestie" Yasmin anymore. 4h later she commented on Yasmins post and refollows.

25/03 MG partied in Milan. Meanwhile there's no proof Mini MG has been with her for the past weeks.

28/03 MG finally returns to Monaco and is reunited with her daughter

The specialist birthday boy. Had his birthday right before being taken to Milgram. His character description on the website says he's twenty. His birthday is on April 19 the first video for Milgram the MILGRAM / Teaser Movie released on April 27, 2020 after Futa's birthday.

So for him to be twenty when he was brought there means the prisoners must have awoken or been brought to Milgram on either the day the MILGRAM -ミルグラム- / PV video came out April 27, 2020 or when the MILGRAM / Jackalope’s “This is the MILGRAM” video came out on May 1, 2020.

Futa's age gives us a big hint for when the prisoners arrived within the prison in that sense.

I believe it was the former since the video released on April 27, 2020 is when we hear Es and all the prisoners for the first time. This also aligns with the beginning of the timelines as well.

My apologies that this took a bit to answer. I had @apatchworkstar check over it to make sure I was doing the math right before posting just in case I messed up and I did with Mahiru. Now no one will ever know how. Yay always have someone check over your work when you suck at mental math and are greatly out of practice with the subject and art of it.
