Common Assumptions of the Types

Evidently these range from ‚kinda true from a certain angle‘, to ‚sadly very often true but would get you into trouble if you assumed it was always the case‘ all the way to ‚sounds instantly silly when you say it out loud but often feels true‘; In the following, I will just be presenting them without comment beyond that it may help to ask yourself ‚is this really true in this specifi situation‘ or ‚Am I maybe being led astray by one of these traps without realizing‘

- impulses are not to be trusted & must be controlled

- duty is more important than pleasure – pleasure must be earned, or, it’s suspect. In some individuals the function of pleasure can get rather inhibited

- goodness & correctness come from the outside / live in the outer world

- perfection is possible

- its your job to fix everything thats wrong

- everything is meant as criticism

- youre the worst of all people

- all is fair in love and war, that is, anything is ok if it’s done in the name of love

- feeling is more important than, or more reliable than thinking

- its necessary to „make“ people like you or they just won’t

- „they couldn’t do without me“ & because of this, you get special treatment

- you know what everyone needs

- its in your power to make everyone like you so if they dont you messed up

- nobody cares about your true feelings

- you shouldn’t have any problems

- you’re no good if you’re not productive

- everyone is faking it – it’s the only way to survive

- nothing happens without you – and if your coworkers do manage while your on vacatio, it must be cause your useless

- if you stop going over the past, move on or let it go that’s the same as giving up or acting like it didn’t matter

- there’s something noble about suffering

- you’re owed compensation for how the world has mistreated you

- you’re not as good as others

- there isnt anyone else like you

- there is always something wrong

- it’s better to go at it alone

- most professions of love are fake & self-interested

- less commitments means more freedom and hapiness

- better to need little to avoid dependencies

- better to keep what you have in case you need it later – you cant eat you cake and have it, too

- if you let em have an inch, they’ll take a mile and you’ll be left with nothing

- you should be able to solve everything by thinking about it

- people cant be trusted

- you cant ever let your guard down

- if I can think of everything that might go wrong, i will feel safe & in control

- whatever can go wrong willgo wrong

- your intuitions and wishes are suspect

- power or proximity to it means safety

- the authorities, be they loved or hated, have great power, reach and influence

- optimistic bias: im great, everyone is awesome, the world is a wonderful place

- except authority, authority sucks

- if you can explain something away or avoid thinking about it, it will go away

- you need to have a plan

- you can do whatever you can get away with

- you deserve, and absolutely need to get what you want

- the best way to succeed is through charm and negotiation

- if you let the pain catch up to you, it will never, ever end

- the world is a lawless jungle/ struggle for survival

- to survive, you must be fearless and take risks

- what people call virtue is usually just hypocricy

- strenght & autonomy are good, weakness and needyness will do you in

- what restricts you and denies you satisfaction is your enemy

- nobody can tell you what to do

- there’s not going to be any fairness unless you make it happen

- the truth is obvious

- It’s ok to cause suffering in the pursuit of satisfaction or as compensation for past slights and reestrictions

(which maybe sounds harsh, but think of it like this: You must eat other creatures to live. It’s impossible to never offend anyone. Will you starve or shut up forever? It’s not possible to never slight anyone, so you might as well have steak and say your opinion)

- better not to think or worry too much about stuff to avoid suffering

- when in doubt, it may be better to conform and not rock the boat

- disagreement brings separation, so, the less conflict the better

- you should defer to the needs of others

- its not ok to further your own interest

- you cant know what you want

- youre nor important and your goals are probably not worth bothering about

Rose stops typing, a nerve in her snapping. Her face goes beet-red, despair swelling into wrath. She sets her claws to the keyboard once more.

TT: Then if not by your grace, I’ll make you forget through spite. GA: What TT: I want to be forgotten. I want my existence to be erased from this failure of a timeline. I never loved you. You meant nothing to me. GA: Rose TT: My departure will be a curse upon you unless you forget. Whether by magic or by will, you must forget me. All those memories I made with you meant nothing. I did those things only to ensure my own survival. Your presence was happenstance at best. TT: Now that I’m heading out on my own, our destinies are uncoupled. Whatever happens to you is beneath me. I am taking the path to victory, and you can all squander the rest of your miserable lives here. TT: I won’t come back for you. I gave you all the chances I had. This is your fault. GA: Rose Please Dont Do This TT: You won’t see me again. I’m getting on that satellite and I’m not looking back. Even if I am to die, alone on a satellite, it will be a Heroic death as the only one with any sense not to continue a cursed existence on this fucking rock. TT: I will live with only a spectre of guilt that I didn’t forcibly coerce you onto the satellite with me, chastising myself for respecting your wishes and letting you choose your own demise. True to her word, Rose closed her laptop and walked briskly to the edge of the floating laboratory to wait for the satellite to pass by. Sheer anger coursed through her veins, hoping that would mask her true intent. She had never displayed that kind of fury before, let alone to Kanaya. If she played her cards right, Kanaya might still join her, moved by the pure strength of her conviction. But there was no hesitant hand on her shoulder, begging her to stay or to join her. There was no last-second plea, no ‘Rose Wait’, and not even a footstep in her general direction as she waited.

Resigned, she boarded the satellite, breaking her word and casting a desperate glance back as the satellite continued its course away. Through the tiny window, she could see Kanaya simply looking down at her grubtop, her face stained jade. Regret swelled, and for just a second, she could feel herself begin to open the hatch and jump back towards the meteor. But the second passed, and soon she was out of range to give even a cursory wave goodbye.

The same tears begin to stream down her face as she closes the pesterlog and wraps her sheets tighter around her shoulders. She can’t keep putting off her meeting with Cetus forever... but she still doesn’t know how she’ll reckon with the shadow of her failed ploy.

xWordgirl ships analysis

I love analyzing ships especially of my favorite heroic alien daughter, so i made a mini masterpost of my thoughts on each popular ship for becky, within reason of course. these are all speculation on them maturing into adulthood looking for love. this is all personal opinion!

long post because i don’t know how to write succinctly im sorry :’)

Tobecky

the ship that needs no introduction:

both characters need to mature before any kind of healthy romance can develop. there is friction both externally (with their villain hero conflict) and internally (both of them suffer from being prideful, condescending, and emotionally constipated), of which them being together as they are now, they both bring out the worst of those parts in one another. whether tobey goes on the straight and narrow or becky decides to fall to the darkside, or perhaps an interesting mix of the two, they both need more common ground to build a foundation on before a healthy relationship can grow. however, this doesn;t mean a seed romance cant grow where it’s planted (to say nothing of the emotional health of the two) as both lust and yearning of young dumb lovers can temporarily close any gap. however, unless they work out their moral and emotional and identity differences and, it will be a hot flash in the pan with disastrous consequences, considering the amount of firepower both parties possess.

Pros: popular ship, cute heroXvillain plots, possible redemption/descent arcs available, kissmesis, cutesy competitiveness, juicy juicy drama, relatively balanced in terms of power (becky as wordgirl, tobey and his army of robots), can weild insane amounts of gusto as a powercouple if they actually worked together

cons: unstable relationship, breakup would be very rough and destructive if gone awry, toxic competitiveness, PR problems for either one

Vibecky

The sweetest sapphic couple:

you want handholding?? love poetry?? maximum fluff potential???? yo i got the ship for you. a lot about these two is conveniently already handed to us because theyre already best friends and we get to see how they function together under a variety of circumstances. for the most part, the two of them would be very openly loving. they have an opposites attract kind of relationship, the classic feeling/thinking, art/science vibes, which is cute for the most part, but can run into trouble when it comes to communication. as we’ve seen before a couple times, most notably in the series finale, the two struggle with confronting one another and reaching an understanding when things aren’t all sunshine and rainbows. both seem to be more likely to lie to keep the peace than bring up a problem, which means things can go very crooked down the line after the honeymoon phase. we have seen that violet has a great memory and while not openly, does hold grudges. we have seen becky struggle to shuffle her priorities and keep her word (hah) and have a hard time bringing up the hard truth. (theres not really a good place to bring it up but i find it very interesting that the hero is the more emotional one than the artist and the artist is colder than the hero) they need to work together to make a completely mode of communication to get through the hard times as well as the good, and if they can, they can together make the most unabashedly happiest couple on earth

pros: fluff, opposites attract, consent communication and cuddles, forgiving, with their powers combined can make the greatest art known to humankind, happy to see the other succeed, gift giving galore

cons: problems can build up fast under the surface, misunderstandings, grudges and lies, major power imbalance

Scoobecky

call me biased but this one is my personal favorite...:

...not because its good for them, per se, but because the dynamics are so darn interesting. while tobecky is full of classic tropes and vibecky is sweet and simple, scoobecky is a very particular kind of relationship we 1) rarely see explored as a formal, official relationship 2) have a tooon of canon interaction material to work off of, actually. this is one of those weird ones where you have to make assumptions about the current situation, eg. assume scoops and violet broke up, assume this is post-Invasion of the Bunny Lovers (IOTBL) episode, etc etc. we’ve seen them as close friends and how even like that they can kinda struggle to meet the mark and make understanding compromises (which unlike like vibecky, who does effortlessly). from what we’ve seen in post-IOTBL, they dont really have a groundwork of respect for one another they once had in wordgirl’s anonymity, but it seems to work out regardless because most of the time they get along best in times of trial and high stress (eg, zombie apocalypse, curiosity machine, rose invading on the order of things, etc). if they ended up as a couple, my best guess it was a couple out of emotional damage or desperation, a kind of functionality couple that would have a hard time handling fluff but could work together and find love during the apocalypse. they would be together for temporary comfort and security in a dangerous world, exchanging clever quips and several moments of emotional highs that will drag both of their butts through the mess they both got themselves into by agreeing to date. the highs are addictive, but functioning well as a team or friends doesn’t exactly translate to being a healthy relationship. theyre both quite petty people, and even the smallest disagreement will cast wrinkles in the cloth because both of them are on completely different life trajectories. however, i believe given good circumstances, they could in theory make it work but man is it going to take a hell of a lot of work and help. or maybe a second zombie apocalypse.

pros: exclusive interviews, mutual pining turning into a relationship trope,

cons: major power imbalance, petty, hard to function in fair weather, not supportive

Polyamory

it works because all three of them are simultaneously the third wheel. they play off one another very well

pros: you can have your cake and eat it too, have all the juicy fluff and angst of all the relationships outlined above

cons: i dunno, agreeing on the same restaurant for dinner

Other

I don’t know! I know a lot of other people have thought a lot harder about the other ships available, i just thought it fun to lay out my thoughts on the most obvious ships. if you have a (non-creepy) ship you feel strongly about and thought a ton about feel free to lmk i love reading about really deeply thought out character interactions

these are just my very subjective thoughts on it and considering the only canonically dating relationship among the eligible kids we’ve seen is violet and tobey, and even then thats not too explored in depth, its all speculation and analysis. id love to hear ur thoughts if you saw something different in these characters. of course, im writing all this with the assumption they are maturing into adulthood and some time has passed, the dynamic may be totally different if they were little kids in puppy love in fifth grade, i dont know! its just fun to think about all the ways u can spin these characters

Cathedral Tower Defense Game character ideas and stuff so far! I’ve talked about some of these before but I wanna just compile it in summary form, and try and get thinking about more to add. It’d be so cool if I could make it like an early suikoden game where you have the world’s biggest party selection! Or at least have that equivelant but with recruiting shopkeepers and townbuilders and stuff.

So... long post ahoy!

* Protagonist (Sir/Lady/Master Amity) Your selectable renameable main charrie! A badass disabled veteran who lost their family in the war and ended up defending this cathedral town of strangers in order to prevent another tragedy. They’re generally distrusted at the beginning, have a lot of doubts about what philosophy they should take in life, and its up to you to decide how the story plays out. But no matter what, this protagonist is a cool grumpy comically-serious nerd gramp! (or gran or etc) i really REALLY like the idea of changing them to be an older veteran character, it just works so much better and seriously WHY are there like zero grandma protagonists in anything ever? I will vow to make this one as amazing as possible!!

* Florin Generally supportive yet sassy and lazy deutorogonist helper guy. He’s your first ally in this world and maybe kind of a tutorial, lol. Even though he’s a total cinnamon roll, he’s as distrusted as you because he’s a demon. Even the protagonist kinda wonders why on earth he wants to help them, and whether he’s some sort of enemy spy... His elemental realm is over plants, and he has no greater joy than taking a nice nap amoungst the flowers~

* Malachi At the moment the only fully developed idea I have for another party member, aside from Florin. Though I’m not sure if I want him to be optional or mandatory? In either case when you recruit him he’s the catylyst for a lot of character development for Florin, and they end up becoming like a lil adopted family ^_^ Anyway, Mal is a very young and adorable demon child that the party finds sealed away beneath some ruins. Precociously innocent, he seems unaware that he’s become a monster. I mean, everyone eats rocks, right?

* Admiral Chiffon (wip name) A major recurring enemy turned ally! Chiffon starts off as just the eccentric comic relief member of the opposing army, kinda harmless and kinda entertaining. And you might pity her quite a bit, because her coworkers treat her like absolute shit. I basically invented this character because I got sick of seeing the ‘ha ha flambouyant gross comic relief villain’ thing in recent fire emblems, and wondered what it would be like to have a villain whose LGBTQ status is treated as a sympathising aspect instead, leading to a redemption when she finds people who dont treat her like those damn writers treated everyone :P So yeah, she’s a transgender woman who faces a lot of predjudice in her career, and I hope I can make it very heartwarming when she finds true friendship with our heroes! And also I hope it can make the non-comic-relief villains seem extra disgustingly unforgiveable after you see how badly they treat their own teammates. Her personality is gonna be kind of a greedy merchant sort of person, but what if that archetype was a good character instead. She remains sassy and greedy even when she’s been redeemed, i like a good ‘ol vice-filled hero yknow! Character development is my jam! Also all i know about her design so far is that I think I want her to have stylishly skunk striped hair, to represent greying streaks and all. I was imagining her as the token grandma of the cast before I decided to age up the protagonist lol

* Currently unnamed church matron duo, aka Timon And Pumbaa One of my early-ish undeveloped concepts for non-battling town members. These two are florin’s equivelant, they’re the town workers you start off with before the game really starts. I’m thinking they’d be like nuns/priestesses that worked at this place before you came along, and you have a bit of a rivalry here because they pragmatically know they need you to defend the stronghold but they’re also very wary of you. The ‘timon’ one would be the main one who actually holds all these opinions, a sort of crusty matronly mega paranoid lady who thinks you’re gonna backstab us all at any moment! And she’s some sort of super scary chronic sufferer of resting bitch face, even though she sees herself as the ultimate arbiter of justice everyone else thinks she’s terrifying. Just imagine her trying to hug a baby that just cries as if it saw the face of death! Life sucks when you’re a lawful good character stuck in a chaotic evil character design! And then her partner is a funloving pumbaa-esque team chef, who’s actually kinda too loving and innocent to ever distrust anyone. But she always just falls in with whatever her boss says, its like a pinky and the brain situation. Oh and I’m already kinda preemptively shipping these two before I’ve even finished designing them XD

* Depression jail janitor Starts as a prisoner you take from one of the enemy raids, but he ends up winning your trust and joining your team. Entirely against his will! he’s a chronically depressed man who was forcibly drafted into the evil army even though he doesnt believe in their cause, but now he feels like he’s unforgiveable anyway. So he spends all his time trying to convince you that he is indeed pure evil! But the more humble he is, the more everyone believes in his genuine kindness. Alas! It doesnt help that he also kinda has chronic hero syndrome and cant resist helping out in every possible way. So that is how a prisoner ended up becoming the one in charge of the jail keys! And he’s like Everyone’s Dad. (Even the people decades older than him...)

* Former bully powerful friend The one other main child character, cos I wanted Malachi to have some friends. They start off at odds and she initially joins in with everyone bullying him, cos she wants to fit in. But he ends up helping her deal with her insecurities and realise she was only resenting him for being ‘weak’ because she saw herself reflected in him. or rather, the traits in herself she’d tried to hide to make everyone like her, even if it meant joining in with bullying and only having horrible asshole friends. So she sacrifices her popularity with the main clique in order to defend malachi, and ends up finding her first true friend with him. They’re better off being outcasts together! So yeah cutie malachi will have some sort of stronge deliquent friend with a heart of gold, and I’m not sure yet whether she’d be playable or not? i kinda feel like its not right to have someone that young join the party unless they have magic powers to protect them. So maybe she can fight by teaming up with malachi, actually? like, she rides atop his stone dragon golem form and supports with ranged weaponry or something. or just acts as an advisor? I liked the idea I had that there would be a buffs-only type of magic stone, and people could cast it on themselves to have enhanced senses at something or other and improve their supporting skills. Like the protagonist would maybe have an eyesight-enhancing buff crystal to act as a sniper scope!

* Rival warrior buff teen person Very undeveloped cos I just came up with them ysterday, lol! I’m thinking possibly make this character female just cos this archetype doesnt get to be female all that often. Kind of a draco malfoy type snooty rival, but with a more sympathetic side and ultimately you do become friends. Theyre just a simple ordinary citizen who was doing the best they could to protect their family before you came along, and now kinda resents the fact you’re all BETTER THAN EVERYONE and taking their job as guardian! They have a lot of anxieties over the fact they struggled so hard to become self-trained and now you’re here making it look easy. So the plot has a general theme of believing too much in ‘destiny’, and that some people are just born with talent and you’ll never succeed if you werent lucky enough. This character started off trying to act like theyre inherantly blessed with that talent, because they’re terrified that they aren’t... Oh and I think once you befriend them I think they might be like a ryuuji/junpei type of friend? But without the weird sexism and homophobia randomness that persona 4 threw onto yosuke. Just like a bit of a cheerful cliche ‘bro’ who isnt all that interested in books and likes to be all ‘cmon do it for the vine’. A good polar opposite to the protagonist who could have some cute interactions!

* Rival warrior’s chilled out older sibling figure of reasonableness Every rin needs a yukio! I think they’d be maybe a bartender or owner of a restaurant or something? Just some sort of super chilled out job where they act as an agony aunt to their customers, the place is very popular because of the great service. (Though also everyone is kinda like ‘yo you dont have to run it all by yourself, yo you dont need to give us bonus extra special treatment, seriously get some sleep dude!!’) But anyway they’re this perpetually relaxed super kind soul who’s always the reasonable response to their lil sib’s ohohoho angry rivalness. But the bad side to it is that they’re also a lil depressed and apathetic about their own life, they’re kinda like someone who really lives for their family, in a bad way. They’ve been like a single parent to their sibling because they had kind of a tragic backstory, and big sib has just grown too used to sacrificing everything in order to help other people and never taking care of themself. And they have a lot of trouble even.. feeling emotions. The outwardly chilled and happy-go-lucky facade covers up just a void of nothing but self hate and emptiness. They feel like they’d already been tainted by the way their abusive parents used to treat them, its too late for them and all they can do is try and save other people from falling down the same path. Oh, and I think maybe the two siblings are actually immigrants from the villain country? Like, when older sib ran away from the abusive family they ended up here, and now they try and keep it secret, to the point that even the younger sibling doesnt know where they were born. Basically I just wanna have a LOT of different subplots showing how the ordinary citizens of this country aren’t all evil just because their government are the bad guys in this story. And especially covering topics like characters who’re part of that ethnicity and get treated like they’re inherantly terrorists even if they were born and raised in a completely different country!

Can’t You Make Regular Exercise Compulsory In Your Daily Life?

An active aerobic exercise program implies more hectic work for the heart and lungs as you work out like during dance moves. The anaerobic indicates the compulsion for the heart and lungs to work harder like in bodybuilding. The aerobic idea of being a living entity in the presence of oxygen is a heartening sensation indeed and should provide the motivation to strive for better health and a positive lifestyle. The awe associated with extreme achievements like body building is the work of champions but the great majority of common folks would readily swallow the bitter pill of aerobics.

Many forms of aerobic exercise like walking require nothing more than a pair of appropriate shoes by way of investment but the returns are certainly very positive in terms of better health, burning calories and keeping the heart and lungs working hard. You end the exercise with a rush of happy feelings and a lot has happened with the regular practice. Aging has been kept at bay and longevity achieved. Better oxygen supply reaches the remote corners of the body. Metabolism has increased with the muscles being activated. The feeling of fullness is because of the additional oxygen. Immunity from several kinds of health problems like cold infections too is avoided by such a regular activity. The body warms up in colder climates. Stress relief is a crucial benefit especially in a world where tensions are responsible for too many mind and body problems.

Jogging and walking, cycling and swimming and martial arts too would be included in such a low-intensity aerobic exercise. You don’t really need the heavier stuff unless you nursed ambitions of becoming a weightlifter or bodybuilder and few suffer such dreams.

Considering all the advantages, why should the corporate employees not undertake such simple exercise on a regular basis, perhaps jointly within neighborhoods? Many extensive organizations do have their dedicated colonies of staff quarters. It would be comparatively easy there to organize such aerobic groups for sustained vigorous exercise as a company health club under a manager and treasurer. Occasional picnics or jaunts with families with packed lunch would promote community feeling and the kids would enjoy the spirit too.

What other medical benefits could you derive from aerobic exercise?

So what is "fruit of the poisonous tree," anyway?

"Fruit of the poisonous tree" is a metaphor used to describe part of the exclusionary rule.

The exclusionary rule, in brief, provides that when the government illegally seizes evidence in violation of your rights, it can't use that evidence against you in court. So, if the cops burst into your house and search it and seize evidence without a warrant, and no exception to the warrant requirement applies, the government can't use the illegally seized evidence against you when it prosecutes you for a crime.

The "fruit of the poisonous tree" doctrine is just an extension of that. It provides that if the government uses illegally seized evidence to obtain more evidence, that more evidence is also inadmissible in court. So, if the government raided and searched your house illegally, and seized evidence from your house illegally, then used that evidence to go get a search warrant for your office, the evidence seized from your office is inadmissible.

So why doesn't that apply to the Special Counsel investigation? People are saying Mueller's team broke the law and violated rights. Doesn't that make everything he does fruit of the poisonous tree?

No. The doctrine doesn't work that way.

It's true that people are arguing that Mueller's investigation is tainted because (among other reasons) a FISA warrant application to surveil Carter Page didn't adequately disclose the partisan nature of the information it relied upon, and that the entire investigation must therefore be shut down because of that and various other wrongdoing.

This argument is completely detached from the law for numerous reasons.

First, there's the concept of standing. "Standing" means that I cant' assert violations of your rights to get a court to exclude evidence. The "tree" has to be a violation of your rights for you to use the doctrine. So if the cops illegally search your house, and try to use the resulting evidence against me, I can't get it thrown out unless I had some sort of right to privacy in your house — as a tenant, for instance. But if the cops illegally search me, violating my rights, and then use the resulting evidence to get a search warrant for your house, and find more evidence there, then I might get that evidence suppressed because the "tree" is a violation of my rights.

In the Special Counsel's case, the only people who could conceivably claim "fruit of the poisonous tree" based on a bad FISA warrant application would be people whose rights were violated by that warrant — that is, Carter Page, and perhaps someone recorded talking to him.

Okay. What else?

Then there's the concept that the "fruit of the poisonous tree" doctrine allows exclusion of specific evidence resulting from violation of a particular defendant's rights. It doesn't require the shutting down of entire investigations.

Put another way, the question is whether the defendant can draw a direct line between a violation of his or her rights and a piece of evidence. The courts have rejected a "but for" theory of the doctrine. That is, the question isn't "would the police have done the things they did but for the violation of my rights." "The Court has never held that evidence is 'fruit of the poisonous tree' simply because “it would not have come to light but for the illegal actions of the police.'" So, for instance, even if the police become interested in searching my house because of evidence they seized illegally from me, so long as the warrant application to search my house does not include any of the illegally seized evidence, it's not fruit of the poisonous tree.

There's a related concept called attenuation. "Evidence is admissible when the connection between unconstitutional police conduct and the evidence is remote or has been interrupted by some intervening circumstance." The most common example of this is a voluntary statement. Generally, if the police illegally seize evidence, and then come and ask me about it, and I make a voluntary statement, courts consider the connection between the illegal seizure and the statement attenuated by my voluntary act, so that my statement is not suppressed. So, in the case of the Special Counsel, Papadopoulos and Flynn pleaded guilty to lying to the FBI during voluntary statements to them. Even if the Special Counsel got to that interview by violating rights, and even if those were Papadopoulos's and Flynn's rights, the voluntary statements would generally be treated as breaking the chain and would be admissible.

So the whole argument isn't plausible?

It's highly implausible on multiple levels. For instance, the theory seems to be that the FISA warrant for Carter Page did disclose that it was based on information from a partisan source, but didn't disclose how partisan the source was. We defense lawyers would love it if arguments like that worked — "yes, the government conceded their source was skeevy, but not how very skeevy" — but they just don't. The entire "fruit of the poisonous tree" argument about the Mueller investigation relies on courts acting in the way defense lawyers dream they would, but definitely haven't, at least since the Warren Court. Fourth Amendment rights, Fifth Amendment rights, the exclusionary rule — all of these things have been relentlessly marched back in the half-century since their high water mark.

So, basically, investigators can pull whatever misconduct they want, and if you can't draw a short line between the misconduct and a piece of evidence they want to admit against you, you're out of luck?

Not quite. There's a doctrine called "outrageous government misconduct." Basically, when the government's conduct in the case is so outrageous that it violates the due process rights of the defendants, the case can be thrown out. It's an extremely difficult doctrine to invoke and very rarely succeeds, and appellate courts usually reject it, so don't let me catch you citing it on Twitter.

To get a sense of how rare it is for this doctrine to be invoked, consider this case from the Ninth Circuit reversing a trial court's dismissal of a case under this doctrine. Bear in mind the Ninth Circuit is the most liberal and defendant-friendly circuit:

A prosecution results from outrageous government conduct when the actions of law enforcement officers or informants are "so outrageous that due process principles would absolutely bar the government from invoking judicial processes to obtain a conviction." United States v. Russell, 411 U.S. 423, 431-32, 93 S.Ct. 1637, 36 L.Ed.2d 366 (1973). A federal court must dismiss a prosecution based on such actions. The standard for dismissal on this ground is "extremely high." United States v. Smith, 924 F.2d 889, 897 (9th Cir.1991). Dismissals are "limited to extreme cases in which the government's conduct violates fundamental fairness." United States v. Gurolla, 333 F.3d 944, 950 (9th Cir.2003). An indictment can be dismissed only where the government's conduct is "so grossly shocking and so outrageous as to violate the universal sense of 796*796 justice." United States v. Stinson, 647 F.3d 1196, 1209 (9th Cir.2011) (quoting United States v. Restrepo, 930 F.2d 705, 712 (9th Cir.1991)).

Underplaying how bad a source was, or losing texts, would definitely not cut it as outrageous government misconduct.

So are you pleased that these people are wrong?

Hell no. I'd like to see a robust exclusionary rule, a robust application of the fruit of the poisonous tree doctrine, and a resurgence in the vigor of the Fourth and Fifth Amendments, which have suffered since the 1970s.

I am, however, deeply annoyed that political factions that have lauded "law and order," deified law enforcement and insulated them from consequences, and generally denigrated the criminal defense function and the concept of defendants' rights are suddenly pretending to be devoted defense advocates.
