The "religious liberty" angle for overturning the overturning of Dobbs

Frank Wilhoit’s definition of “conservativism” remains a classic:

There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

Conservativism is, in other words, the opposite of the rule of law, which is the idea that the law applies equally to all. Many of America’s most predictably weird moments live in the tension between the rule of law and the conservative’s demand to be protected — but not bound — by the law.

Think of the Republican women of Florida whose full-throated support for the perfomatively cruel and bigoted policies of Ron Desantis turned to howls of outrage when the governor signed a law “overhauling alimony” (for “overhauling,” read “eliminating”):

This is real leopards-eating-people’s-faces-party stuff, and it’s the only source of mirth in an otherwise grim situation.

But out of the culture-war bullshit backfires, none is so sweet and delicious as the religious liberty self-own. You see, under the rule of law, if some special consideration is owed to a group due to religious liberty, that means all religions. Of course, Wilhoit-drunk conservatives imagine that “religious liberty” is a synonym for Christian liberty, and that other groups will never demand the same carve outs.

Remember when Louisiana decided spend tax dollars to fund “religious” schools under a charter school program, only to discover — to their Islamaphobic horror — that this would allow Muslim schools to get public subsidies, too?

The Satanic Temple has perfected the art of hoisting religious liberty on its own petard. Are you a state lawmaker hoping to put a giant Ten Commandments on the statehouse lawn? Go ahead, have some religious liberty — just don’t be surprised when the Satanic Temple shows up to put a giant statue of Baphomet next to it:

And now we come to Dobbs, and the cowardly, illegitimate Supreme Court’s cowardly, illegitimate overturning of Roe v Wade, a move that was immediately followed by “red” states implementing total, or near-total bans on abortion:

These same states are hotbeds of “religious liberty” nonsense. In about a dozen of these states, Jews, Christians, and Satanists are filing “religious liberty” challenges to the abortion ban. In Indiana, the Hoosier Jews For Choice have joined with other religious groups in a class action, to argue that the “religious freedom” law that Mike Pence signed as governor protects their right to an abortion:

Their case builds on precedents from the covid lockdowns, like decisions that said that if secular exceptions to lockdown rules or vaccine mandates existed, then states had to also allow religious exemptions. That opens the door for religious exemptions to abortion bans — if there’s a secular rule that permits abortion in the instance of incest or rape, then faith-based exceptions must be permitted, too.

Some of the challenges to abortion rules seek to carve out religious exemptions, but others seek to overturn the abortion rules altogether, because the lawmakers who passed them explicitly justified them in the name of fusing Christian “values” with secular law, a First Amendment no-no.

As Rabbi James Bennett told Politico’s Alice Ollstein: “They’re entitled to their interpretation of when life begins, but they’re not entitled to have the exclusive one.”

In Florida, a group of Jewish, Buddhist, Episcopalian, Universalists and United Church clerics are challenging the “aiding and abetting” law because it restricts the things they can say from the pulpit — a classic religious liberty gambit.

Kentucky’s challenge comes from three Jewish women whose faith holds that life begins “with the first breath.” Lead plaintiff Lisa Sobel described how Kentucky’s law bars her from seeking IVF treatment, because she could face criminal charges for “discarding non-viable embryos” created during the process.

Then there’s the Satanic Temple, in court in Texas, Idaho and Indiana. The Satanists say that abortion is a religious ritual, and argue that the state can’t limit their access to it.

These challenges all rest on state religious liberty laws. What will happen when some or all of these reach the Supreme Court? It’s a risky gambit. This is the court that upheld Trump’s Muslim ban and the right of a Christian baker to refuse to bake a wedding cake for a same-sex couple. It’s a court that loves Wilhoit’s “in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.”

It’s a court that’s so Wilhoit-drunk, it’s willing to grant religious liberty to bigots who worry about imaginary same-sex couples:

But in the meantime, the bigots and religious maniacs who want to preserve “religious liberty” while banning abortion are walking a fine line. The Becket Fund, which funded the Hobby Lobby case (establishing that religious maniacs can deny health care to their employees if their imaginary friends object), has filed a brief in one case arguing that the religious convictions of people arguing for a right to abortion aren’t really sincere in their beliefs:

This is quite a line for Becket to have crossed — religious liberty trufans hate it when courts demand that people seeking religious exemptions prove that their beliefs are sincerely held.

Not only is Becket throwing its opposition to “sincerely held belief” tests under the bus, they’re doing so for nothing. Jewish religious texts clearly state that life begins at the first breath, and that the life of a pregnant person takes precedence over the life of the fetus in their uterus.

The kicker in Ollstein’s great article comes in the last paragraph, delivered by Columbia Law’s Elizabeth Reiner Platt, who runs the Law, Rights, and Religion Project:

The idea of reproductive rights as a religious liberty issue is absolutely not something that came from lawyers. It’s how faith communities themselves have been talking about their approach to reproductive rights for literally decades.

As you may know I will be joining 2 Joker Out gigs in March. As some of you that met me on the käärijä EU tour might also know I had some custom stickers with me at those gigs I attended, and since it was this big a success I want to do it again.

And so the upcoming week(s) I will be focusing my time on making a new set of stickers this time with the Joker Out boys :D!!

This time I review the video named Wonderful Summoner, which I posted on August 15, 2009. Like A-V-O-N-E-J, I originally hadn't planned to make a music video for this song. However, after receiving requests from viewers who wanted to see a video using this song, I decided to give it a try. That said, it was a challenging project because there weren't any reference samples to follow, and I wasn't familiar with this song before starting production. Nowadays, it's common for me to make music videos with less-used songs, but at the time, it felt like a significant challenge. Now, let's begin.

About the song

The song is from the game Touhou Scarlet Weather Rhapsody, part of the Touhou Project series. As mentioned earlier, I hadn't heard the song before, nor had I played Touhou Scarlet Weather Rhapsody, so it took a while for me to develop a sense of attachment to it. However, the more I listened, the more captivated I became by its unique charm. The early and middle parts of the track evoke a carefree and whimsical character, while the chorus transitions into something grand and befitting a final showdown. As an aside, I later learned that Touhou Scarlet Weather Rhapsody isn't a shoot-'em-up game like other titles in the series but rather a fighting game. It made me want to try it out.

Features of this video

As the title Wonderful Summoner suggests, the video aimed to spotlight Yuna as a summoner. However, looking back, I feel the final product didn't quite capture the essence of Yuna as well as I'd wanted. The video's tone was primarily funny, with some serious moments mixed in, but the balance felt off, leaving the result somewhat muddled. Although I used many of Yuna's lines, I struggled to tie everything together into a cohesive theme. This left me dissatisfied, and at one point—around five years after its upload—I considered remaking the video. Unfortunately, I never found the time to remake it. Like A-V-O-N-E-J, this video also features a lot of dynamic screen movement. It seems that was my preferred style at the time. I do feel sorry for the viewers, including the one who requested it, as I couldn't fully deliver on my vision. However, working on this project allowed me to recognize the potential of Yuna's lines, which became an important takeaway for future videos. Even if a project doesn't turn out as expected, as long as it leads to growth, it's not a failure. That's what this video taught me.

My favorite scenes

0:00~0:13 Yuna's lines may not be particularly powerful, but her clear pronunciation makes them ideal for mixing.

0:46~0:52 The laughing scene is a fun piece of material to use.

1:10~1:34 Tidus yawning is a rare scene to use, so it still stands out to me.

Synopsis: Each member is paired with a dog and they complete various handling/training challenges.

Production: They did such a good job with the episode. The concept was clear, well-covered, and edited great. Filming with animals could have been a challenging element but you can't tell by the final product.

Endearment: The guys and the dogs easily capture hearts. It's great to see them bond and we definitely get invested in their activities. The only reason this one doesn't rank higher for me is that I'm just really not a dog person...

Best Cheater: Almost JN for tempting one of the other dogs with treats but it didn't work.

“Tendou,we’ve been like this for an hour..”Hinata sighed while in his boyfriend’s tight embrace,Tendou didn’t say much,he only smiled more. His lips curling up into a V

Hinata sighed again,there was nothing he could do,Tendou was extremely clingy after all,So they both sat there in eachother’s embrace,staring at the television

“Don’t you have practice anyway..?”Hinata asked,glancing at the redhead,Tendou only snickered before hugging Hinata tighter “Hey! come on…”Hinata gave in and rested his head on Tendou’s chest

“Ohehehe!”Tendou chuckled weirdly and kissed Hinata on the forehead(THEY’RE SILLY.) Hinata couldn’t help but blush and smile a bit before pushing Tendou away “D..Don’t do that!” Hinata stuttered and looked away

That didn’t help though,Tendou chuckled and and pulled Hinata way— closer “You can’t escape,number 10~” Tendou cackled as weirdly as he does

“I adore ya!” Tendou smiled and closed his eyes before pressing his lips on Hinata’s,The two shared a moment until Tendou’s ringtone went off

Tendou jolted up as a result,He pouted and grabbed his phone,it was Ushjima. Tendou picked up with his normal smug expression “Yo waka waka chan!”…Hinata chuckled at the nickname.

“We have practice. in 15 minutes.” Ushijima bluntly spoke,Tendou looked at the ginger in his lap and frowned slightly “No worriesss~,Guess monster will make his appearance!”and with that the call ended

Hinata didn’t say anything,He was way too interested in the game playing on the television,Tendou snickered and buried his face back into his boyfriend’s hair before sighing and lifting his head up,still resting his head on the ginger

Tendou didn’t wanna go to practice but he was gonna see Hinata later right? He hoped so,He loves joking around with his ginger. Tendou sighed before reluctantly moving the ginger onto the sofa and off his lap,Hinata didn’t say anything,once again his eyes were glued on the screen

Tendou unlocked the door with his spare key and walked in,closing the door behind him,Hinata was sleeping in a wild position on the couch,Tendou couldn’t help but chuckle to himself as He picked up the snoring ginger and walking to the lamp lit bedroom

“Meat buns…” The ginger seemed to dream about food,how typical. Tendou place Hinata on the bed,tucking him in before getting into the bed himself,”Good night,Number 10~” Tendou turned off the lamp and snuggled up to his lightly snoring boyfriend

Hinata’s bedroom//4:02 Am

Hinata was already out of bed,studying for whatever he had,Tendou of course was hugging him from behind,Hinata was sitting on his lap of course,Seriously,Tendou might as well be a chair!

“Tendou..I can’t focus with you snickering in my ear..”Hinata sighed and stopping writing on his notebook filled with gibberish,”Oops~” Tendou snickered some more,He wanted Hinata’s attention.

Hinata groaned out of frustration,He continued writing though,as he typed away on his computer,Tendou occasionally making some movement,He wanted Hinata to say something or atleast stare at him.

Of course,Hinata ignored him,Hinata couldn’t afford to fail a english test…He’s already got a 60 in the class,Any lower and he wouldn’t be able to play in any matches..”Number 10~”Tendou whispered into Hinata’s ear,Hinata couldn’t bear this anymore and turned to look at Tendou with an annoyed look

On September 27, I'll be at Chevalier's Books in Los Angeles with Brian Merchant for a joint launch for my new book The Internet Con and his new book, Blood in the Machine. On October 2, I'll be in Boise to host an event with VE Schwab.

Back when I was writing on Boing Boing, I'd slam out 10-15 blog posts every day, short hits that served as signpost and public notebook, but I rarely got into longer analysis of the sort I do daily now on Pluralistic. Both modes are very useful for organizing one's thoughts, and indeed, they complement each other:

First up, a musical interlude. I've been listening to DJ Earworm's amazing mashups since 2005 and while I've got dozens of tracks that shuffle in and out of my daily playlist, the one that makes me wanna get up and dance every time is "No One Takes Your Freedom," a wildly improbable banger composed of equal parts Aretha Franklin, The Beatles, George Michael and Scissor Sisters:

I defy you to play that one without bopping a little. I think it's the French horn from "For No One" that really kills it, the world's least expected intro to a heavy dance beat.

Moving swiftly on: let's talk about fonts. I remember when Wired magazine first showed up at the bookstores I was working at in Toronto, and my bosses – younger men than I am now! – complained that the tiny, decorative fonts, rendered in silver foil on a purple background, was illegible. I laughed at them, batting my young eyes and devouring the promise of a better future with ease, even in dim light.

Now it's thirty years later and I'm half-blind. Both my my decaying, aging eyes are filmed with cataracts that I'm too busy to get removed (though my doc promises permanent 20:20, perfect night-vision, and implanted bifocals when I can spare a month from touring with new books to get 'em fixed).

Which is to say: I spend a lot more time thinking about legibility now than I did in the early 1990s, and I've got a lot more sympathy for those booksellers' complaints about Wired's aggressively low-contrast design today. I'm forever on the hunt for fonts designed for high legibility.

This week, Kottke linked to B612, a free/open font family "designed for aircraft cockpit screens," commissioned by Airbus. It's got all the bells and whistles (e.g. hinting) and comes in variable and monospace faces:

B612 arrived at a fortuitous moment, coinciding with a major UI overhaul in Thunderbird, the app I spend the second-most time in (I spend more time in Gedit, the bare-bones text-editor that comes with Ubuntu, the flavor of GNU/Linux I use). A previous Thunderbird UI experiment had made all the UI text effectively unreadable for me, causing me to dive deep into the infinitely configurable settings to sub in my own fonts:

The new UI is much better, but it broke all my old tweaks, so I went back into those settings and switched everything to B612, and it's amazeballs. I tried doing the same in Gedit, but B612 mono was too light for my shitty eyes, so I went back to Jetbrains Mono, another free/open font that has 8 weights to choose from:

Love me a new, legible font! Meanwhile, a note for all you designers: the received wisdom that black on white type is "hard on the eyes" is a harmful myth. Stop with the grey-on-white type, for the love of all that is holy. This isn't 1992, you aren't laying out type for Wired Issue 1.0. Contrast is good, actually.

Continuing on the subject of software updates: Mastodon, the free, open, federated social media platform that anyone can host and that lets you hop between one server and another with just a couple clicks, has released a major update, focusing on usability, especially for people unfamiliar with its conventions:

Included in this fix: a major overhaul to how you interact with posts on servers other than your home server. This was both confusing and clunky, and the fix makes it much better. They've also changed how sign-up flow works, making things simpler for newbies, and they've cleaned up the UI, tweaking threads, web previews and other parts of the daily experience.

There's also a lot of changes to search, but search still remains less than ideal, with multi-server search limited to hashtags. This is bad, actually. Thankfully, we don't have to wait for Mastodon devs to decide to fix it, because Mastodon is free and open, which means anyone with the skills to code a change, or the money to pay techies to do it, or the moral force to convince them to do it, can effect that change themselves:

When you're posting 10-15 times/day, you can't make each graphic a standout (or at least, I can't). Where is all this labor unrest coming from? Well as Stein's Law has it, "anything that can't go on forever will eventually stop." 40 years of corporate-friendly political economy has lit the world on fire and immiserated billions, and we've hit bottom and started the long, slow climb to a world that prioritizes human thriving over billionaire power.

One of the most tangible expressions of that vibe shift is the rise and rise of antitrust. The big news right now is the (first) trial of the century, Google's antitrust trial. What's that? You say you haven't heard anything about it? Well, perhaps that has to do with the judge banning recording and livestreaming and not making transcripts available. Don't worry, he's also locking observers out of his courtroom for hours at a time during closed testimony. Oh, and also? The DoJ just agreed that it won't post its exhibits from the trial online anymore. You can follow what dribbles of information as are emerging from our famously open court system at US v Google:

If the impoverished trickle of Google antitrust news has you down, don't despair, there's more coming, because the FTC is apparently set to drop its long-awaited suit against Amazon:

Amazon spent years blowing hundreds of millions of dollars of its investors' cash, selling goods below cost and buying up rivals until it became the most important channel for every kind of manufacturer to reach their customers. Now, Amazon is turning the screws. A new report from the Institute for Local Self-Reliance details the 45% Amazon Tax that every merchant pays to reach you:

That 45% tax is passed on to you – whether or not you shop at Amazon. Amazon's secretive most favored nation terms mean that if a seller raises their price on Amazon, they have to raise it everywhere else, which means you're paying more at WalMart and Target because of Amazon's policies.

Those taxes are bad for us, but they're good for Amazon's investors. This year, the company stands to make $185 billion from junk-fees charged to platform sellers. As David Dayen points out, Amazon charges so much to ship third-party sellers' goods that it fully subsidizes Amazon's own shipping:

That's right: as Stacy Mitchell writes in the report, "Amazon doesn’t have to build warehousing and shipping costs into the price of its own products, because it’s found a way to get smaller online sellers to pay those costs."

Now, one of the amazing things about antitrust coming back from the grave is that just the threat of antitrust enforcement can moderate even the most vicious bully's conduct. Faced with the looming FTC case, Amazon just canceled its plan to charge even more junk fees:
