dear americans,
as a polish queer woman and human rights activist, i know exactly how you're feeling right now and what to expect from these elections. i lived through the 2015-2023 regime of pis, a right-wing populist party that divided families in the same way trump did. i’ve experienced the rise of fascism in poland, the influence of far-right parties like konfederacja, and their “santa’s little helpers”—ordo iuris, an ultra-conservative catholic organization (banned in many countries, mind you) that helped enforce a near-total abortion ban and runs anti-queer campaigns in public spaces. i supported the black protests in 2016 as a middle schooler when they first tried to ban abortion. as an adult, i actively participated in the 2020 women’s strike, running from police tear gas daily after they finally passed the ban. i supported friends who faced charges.
i’ve lived through intense homophobia in poland as a queer teen and adult. i survived the first pride march in my hometown, where far-right extremists threw stones and glass at us. i endured the anti-queer propaganda spread by the ruling party in state-owned media. i survived the “rainbow night,” poland’s own stonewall moment in summer 2020, when police arrested around 50 queer activists following the arrest of margo, a nonbinary activist. i survived the "lgbt-free zones," the targeted violence, the slurs from strangers on the street, and the protests i held against queerphobia. it was hard as fuck, but i survived.
but just because i survived, it doesn’t mean others did. many women died because of the abortion ban—marta, justyna, izabela, dorota, joanna, maria, and many others who didn’t survive pis’s draconian anti-abortion laws. milo, kacper, michał, zuzia (she was 12), wiktor, and other queer and trans kids and young adults took their own lives because of the relentless queerphobia.
despite all of this, our experience in poland can serve as a guide now. here are some tips for staying safe and how we, polish queers and women, organized under the regime:
safety first, always. if you know someone who’s had an abortion, no you don’t. if you know someone is trans, no you don’t. if you know people who help with safe abortions, no you don’t—at least not until you know it’s 100% safe to share. if you are queer or have had an abortion, only share this with people you trust fully. most importantly, not everyone has to be an activist just because they’re part of a minority. if it feels unsafe to share that you're queer, trans, etc., then don’t. it doesn’t make you any less queer.
use secure, encrypted messaging like signal for conversations on potentially risky topics, such as queerness, abortion, organizing counter-actions, protests—anything that might be used against you.
stay anonymous online. if you want to research or report something without surveillance, do not use regular internet. get a vpn (mullvad is affordable and reliable), download the tor browser (for both onion and standard links), and if you plan to whistleblow, consider using a riseup email account.
organize and build networks. community is everything now. support each other, foster independence, because your government won’t have your back. set up collectives, grassroots movements. create lists of trusted professionals—lawyers, doctors, etc.—who can offer support.
to lawyers and doctors: please consider pro-bono work. this is what got us through poland’s hardest times. your work will be needed now more than ever.
for protests or risky actions: always write a pro-bono lawyer’s number on your arm with a permanent marker.

An Arizona grand jury on Wednesday indicted seven attorneys and aides affiliated with Donald Trump’s 2020 presidential campaign as well as 11 Arizona Republicans on felony charges related to their alleged efforts to subvert Joe Biden’s 2020 victory in the state, according to an announcement by the state attorney general. Those indicted include former Trump White House chief of staff Mark Meadows, attorneys Rudy Giuliani, Jenna Ellis, John Eastman and Christina Bobb, top campaign adviser Boris Epshteyn and former campaign aide Mike Roman. They are accused of allegedly aiding an unsuccessful strategy to award the state’s electoral votes to Trump instead of Biden after the 2020 election. Also charged are the Republicans who signed paperwork on Dec. 14, 2020, that falsely purported Trump was the rightful winner, including former state party chair Kelli Ward, state Sens. Jake Hoffman and Anthony Kern, and Tyler Bowyer, a GOP national committeeman and chief operating officer of Turning Point Action, the campaign arm of the pro-Trump conservative group Turning Point USA. Trump was not charged, but he is described in the indictment as an unindicted co-conspirator.

President Joe Biden is commuting the sentences of roughly 1,500 people who were released from prison and placed on home confinement during the coronavirus pandemic and is pardoning 39 Americans convicted of nonviolent crimes. It's the largest single-day act of clemency in modern history. The commutations announced Thursday are for people who have served out home confinement sentences for at least one year after they were released. Prisons were uniquely bad for spreading the virus and some inmates were released in part to stop the spread. At one point, 1 in 5 prisoners had COVID-19, according to a tally kept by The Associated Press. [...] The clemency follows a broad pardon for his son Hunter, who was prosecuted for gun and tax crimes. Biden is under pressure from advocacy groups to pardon broad swaths of people, including those on federal death row, before the Trump administration takes over in January. He’s also weighing whether to issue preemptive pardons to those who investigated Trump’s effort to overturn the results of the 2020 presidential election and are facing possible retribution when he takes office. Those pardoned Thursday had been convicted of nonviolent crimes such as drug offenses and turned their lives around, White House lawyers said. They include a woman who led emergency response teams during natural disasters; a church deacon who has worked as an addiction counselor and youth counselor; a doctoral student in molecular biosciences; and a decorated military veteran. Jim McGovern, D-Mass., and 34 other lawmakers are urging the president to pardon environmental and human rights lawyer Steven Donziger, who was imprisoned or under house arrest for three years because of a contempt of court charge related to his work representing Indigenous farmers in a lawsuit against Chevron. the fact that I see some of y'all posting more about how important it is to vote for Biden than you ever have about Palestine just shows that you fucking "vote blue no matter who" people genuinely don't give a fuck about anyone but yourselves.
you only choose to speak up when YOUR hypothetical rights are threatened. you love to fear monger about how much hypothetically worse it would be under trump than acknowledge the actual atrocities that Biden is committing and condoning every single day. how exactly is he the "lesser" of two evils for?
do any of you actually look at the images coming out of gaza, or are you too fucking ~triggered~ to fully acknowledge other peoples suffering rather than your own. have you seen the video that came out recently of the little boy whose brain is exposed, about to be laid next to his dead family members, only to twitch and seize in his fathers arms as he screams and runs in horror to find a doctor, because his son is alive. his brain is literally falling out of his skull but he is still alive. that is one brief example of the most horrific shit you've ever seen in your life coming out daily for almost a year. how on this earth can you watch that and possibly claim that Biden is in any way shape or form "less" evil.
instead of demanding that the dnc force a different candidate, you're trying to guilt trip people who have actually seen the mutilated bodies of children on their timelines every single day and watched the press briefings of bidens administration denying genocide and defending Israel at the expense of literally everything else for the last 8 months, into voting for a man who supports it 100% and has not and will not be convinced otherwise.
this is where allowing them to push widely unpopular and centrist candidates has gotten us. it didn't work with Hillary in 2016. it BARELY worked in 2020. and hate to break it to you, but its probably not going to work again. so congrats. your "vote blue no matter who" rhetoric has got them thinking that they can push the most right leaning liberals on us and think that we'll vote for them just because they're in a blue tie instead of a red one.
if you care about democracy like you say you do, then the Democrats should be fucking TERRIFIED that you won't vote for them if they don't deliver. not constantly reassured that they can commit literal fucking genocide and still get your votes if they dangle abortion rights over your heads. you realize they see those posts too right? the ones that say "Yes! protest vote in the primary but make sure to actually vote for the guy in the general!!" like. you are literally telling them how performative your activism is.
if every election at this point is the one where democracy is on the line then we are already fucked. if they don't get it through their heads now that we will not support this shit, then every election to come will be between a fascist and a fascist who cares slightly less about whether gay people get married or not. but that's all you care about right? as long as your domestic policy is in your favor then the rest of the world can suffer at your tax dollars.
this isn't about morality voting. this is about recognizing that there is not actually a "lesser" of two evils in this situation, just because you think that the causes that you personally care about will be less affected one way or the other. because what if it was abortion rights? what catholic Joe Biden was firmly against abortion and was threatening to ban it completely and throw anyone getting or giving one in prison for murder. what if it was videos of lgbt people being slaughtered coming out every single day for a year. genuinely fucking ask yourself if you'd still be saying "vote blue no matter who" and that he's the "lesser" of two evils.
vote for whoever the fuck you want. and I do genuinely urge you to vote for the most progressive candidate you can for the house and senate and your local elections. but for the love of god, stop trying to convince people that there is, in any sense of the word, a "Lesser" evil in this situation. stop trying to absolve yourselves of the fact that you are CHOOSING evil. it's genuinely sick.

Biden Commutes 37 Death Sentences Ahead of Trump’s Plan to Resume Federal Executions
Those affected by the president’s action on Monday are still subject to life imprisonment without the possibility of parole. Three men will remain on federal death row.
President Biden on Monday commuted the sentences of nearly all prisoners on federal death row, sparing the lives of 37 men just a month before Donald J. Trump will return to the Oval Office with a promise to restart federal executions. Those affected by Mr. Biden’s action, all of whom were convicted of murder, will serve life imprisonment without the possibility of parole instead of facing execution. Only three men, who each carried out notorious mass killings, will remain on federal death row.
The president campaigned in 2020 on ending the federal death penalty. Although proposed legislation to that effect failed to advance in Congress during his administration, Mr. Biden directed the Justice Department to issue a moratorium on federal executions. Thirteen prisoners on federal death row were put to death during Mr. Trump’s first term.
I am more convinced than ever that we must stop the use of the death penalty at the federal level,” Mr. Biden said in a statement on Monday. “In good conscience, I cannot stand back and let a new administration resume executions that I halted.”
Mr. Biden said the commutations were consistent with the standard he has imposed for halting executions “in cases other than terrorism and hate-motivated mass murder.”
“Make no mistake: I condemn these murderers, grieve for the victims of their despicable acts, and ache for all the families who have suffered unimaginable and irreparable loss,” Mr. Biden said.
The White House released statements of support from faith leaders, civil rights groups and law enforcement officials, as well as from friends and family members of those killed by men on death row.
"Putting to death the person who killed my police partner and best friend would have brought me no peace,” said Donnie Oliverio, a retired police officer, who alluded to Mr. Biden’s being Catholic. “The president has done what is right here, and what is consistent with the faith he and I share.” His partner, Bryan S. Hurst, was shot and killed while on duty by Daryl Lawrence during an attempted bank robbery in Columbus, Ohio. Mr. Lawrence was sentenced to death in 2006.
Of the 37 men whose sentences were commuted, 15 are white, 15 are Black, six are Latino and one is Asian. They were sentenced in 16 states, including three that have abolished the death penalty. Nine are on death row because they were convicted of killing fellow federal prisoners.
The three men who can still face federal execution are Robert D. Bowers, 52, who in 2018 gunned down 11 worshipers at the Tree of Life Synagogue in Pittsburgh; Dylann Roof, 30, the white supremacist who in 2015 opened fire on Black parishioners at a church in Charleston, S.C., killing nine people; and Dzhokhar Tsarnaev, 31, one of the two brothers who carried out the bombing of the Boston Marathon in 2013 that killed three and maimed more than a dozen others.

WASHINGTON — It took decades for defenders of the Confederacy to rewrite the history of the Civil War to recast Southern rebels’ treasonous attack against the United States as an act of honor and courage.
It took Donald Trump a mere fraction of that time to accomplish the same feat for his Jan. 6, 2021, coup attempt.
In a mere four years, that day’s effort to end or, at the very least, suspend American democracy with a deadly assault on the Capitol, incited by Trump himself, has for a large swath of the country instead become a peaceful protest whose participants have been persecuted by Trump’s political opponents.
“What they have in common is that in both cases a story is propagated that a portion of the population wants to hear because it absolves them, or those in their in-group, of a transgression of not just the law, but of commonly held moral principles,” said Gabriel Reich, a Virginia Commonwealth University professor who has studied how the history of the Civil War and Reconstruction is taught in schools.
“Liberal democracies really struggle with bad-faith actors who manipulate existing rules and norms to their own benefit,” he added.
Tom Joscelyn, a counterterrorism expert who served on the staff of the House Jan. 6 committee and was a co-author of its report, said he still finds it hard to believe that people could watch what happened that day unfold on television and then still accept Trump’s version of it. Unlike children growing up in the South in the 1940s and 1950s, for whom the Civil War was generations in the past, Trump’s followers and allies are rejecting readily available evidence of contemporary violence.
“All you need is the images and the videos from that day, his own words, and what you saw with your own eyes, and it was clear that he had crossed some bright lines,” he said. “All of that should have been disqualifying, and it wasn’t.”
Trump’s transition team did not respond to HuffPost queries. Even since his win in November, Trump has continued to lie about the 2020 election having been stolen from him and has described those who have been prosecuted for their actions on Jan. 6 as political prisoners.
“These people have been treated really, really badly,” he told Time magazine last month. “They’ve suffered greatly, and in many cases they should not have suffered.”
Mac Stipanovich, a longtime Republican political consultant in Florida, said he remembers as a child reading a plaque honoring dead Confederate soldiers in his town square. “That’s the way we grew up. That’s what we knew,” he said.
That Trump was able to revise his own history so quickly is a noteworthy achievement, he added.
“It is a tribute to Trump and his posse’s ability to convince half the country,” Stipanovich said. “And it is a telling indictment of the intelligence of that half of the country.”
From Protecting Slavery To The Honorable ‘Lost Cause’
When America elected the leader of a party dedicated to abolishing slavery as president, 11 Southern states decided to secede and started a war against those that remained. That these rebel states would lose was likely inevitable, given the Union’s industrial might and population advantage, and 700,000 deaths later, they did.
Yet within a few short years, an effort to reinvent that loss and the motivations behind it began. Confederate sympathizers and segregationists in academia, the media and politics cast men like Robert E. Lee — officers in the U.S. Army who had taken up arms against the United States — as tragic American heroes. And the reason behind the war, the preservation of human slavery, was replaced with a principled defense of “states’ rights” — even though slavery was plainly cited in the states’ own articles of secession.
“They made sure that teachers, including university-level historians, taught that story as historical truth, while simultaneously suppressing other points of view from the media,” VCU’s Reich said.
It took decades of repetition, replete with the construction of statues and memorials to the leaders of the failed insurrection, but this “Lost Cause” myth eventually became an accepted narrative, primarily in the South but to a lesser extent all over the country. So much so that some U.S. military bases in the first half of the 20th century were named for Confederate officers.
Trump’s propaganda campaign to redefine Jan. 6, in contrast, has taken place at lightning speed.
On Jan. 6 itself and in the days immediately afterward, the early consensus was that Trump had incited the attack on the Capitol and that he was wrong to do so. Republican congressional leaders blamed him in floor speeches. Trump himself on Jan. 7 read prepared remarks warning members of his mob: “To those who broke the law, you will pay.”
Trump’s former United Nations ambassador, Nikki Haley, expressed the conventional wisdom at the time that Trump was finished. “I think he’s lost any sort of political viability he was going to have,” she told Politico on Jan. 12.
Four years later, Trump is about to return to the same White House he left in disgrace. His new administration will be stocked with those willing to repeat and spread his continuing lies about the 2020 election. And he has promised not only to pardon those prosecuted for taking part in the Jan. 6 attack but to prosecute those who tried to hold him and his followers to account.
The Triumph Of The Repeated Lie
That Trump was able to return to power, despite everything, was perhaps foreseeable because he never lost the loyalty of the Republican primary voting base.
Indeed, the day after his coup attempt had failed, the overwhelming majority of the 163 members of the Republican National Committee gave him a sustained ovation when he called into their winter meeting in Amelia Island, Florida.
Three weeks later, then-House Speaker Kevin McCarthy, at the time the country’s highest-ranking elected Republican, visited Trump at his South Florida country club, effectively signaling that Trump remained the party’s leader. Two weeks after that, Senate GOP leader Mitch McConnell, while lambasting Trump for his behavior leading up to and on Jan. 6, nonetheless voted not to convict Trump for inciting the insurrection following his House impeachment for that offense. A conviction would have been followed by a vote to ban him from federal office for life.
By April, the RNC was again holding fundraising events at Trump’s Mar-a-Lago club, putting donors’ money into his personal bank account. Officials acknowledged privately that Trump remained their biggest fundraising draw and that they had to go along with the fiction that the 2020 election had been stolen because their voters believed it to be true — even though the only reason for that belief was Trump’s lies.
And by the end of 2021, following the release of conspiracy theorist Tucker Carlson’s “documentary” claiming that the Jan. 6 insurrection was actually a “false flag” operation by the FBI, Trump began calling those under prosecution for taking part in his coup attempt — even the hundreds convicted for having assaulted police officers — “hostages” and “political prisoners.”
Republican candidates for offices large and small in increasing numbers made pilgrimages to Palm Beach to win his endorsement. Journalists similarly made the trek — not to ask about his unprecedented attempt to thwart the peaceful transfer of power, but about his candidacy to regain the presidency in 2024.
The new “Lost Cause” myth for Jan. 6 was complete.
“It’s disheartening,” Joscelyn said.
Stipanovich, who broke from the Republican Party when it embraced Trump in 2016, said that a more apt — and troubling — comparison to Trump’s rewriting of Jan. 6 may be the way Adolf Hitler and the Nazis remade their 1923 Beer Hall Putsch into a valiant act of patriotism, rather than an attempted coup that sent Hitler and others to prison.
“When it failed, the heroes of the failure became the hope of the future,” he said.
Whatever the appropriate historical analogy, the fact that Trump was able to assault democracy as he did and still come back to power is worrisome, said Larry Sabato, a University of Virginia political scientist. Sabato also grew up in that state, where the Civil War was taught as the “War of Northern Aggression.”
“The Lost Cause was a ‘big lie,’ but I’m not so sure Trump’s ‘big lie’ will ever be a lost cause,” he warned. “This is not cynicism. It’s the reality we face.”

Trump and the Lawfare Implosion of 2024
Will his prosecution end up putting him back in the White House?

What’s that old saying about the “best-laid plans”? Democrats banked that a massive lawfare campaign against Donald Trump would strengthen their hold on the White House. As that legal assault founders, they’re left holding the bag known as Joe Biden.
In Florida on Tuesday, Judge Aileen Cannon postponed indefinitely the start of special counsel Jack Smith’s classified-documents trial. The judge noted the original date, May 20, is impossible given the messy stack of pretrial motions on her desk. The prosecution is fuming, while the press insinuates—or baldly asserts—that the judge is biased for Mr. Trump, incompetent or both. But it is Mr. Smith and his press gaggle who are living in legal unreality, attempting to rush the process to accommodate a political timeline.
What did they expect? Mr. Smith waited until 2023 to file legally novel charges involving classified documents, a former president, and a complex set of statutes governing presidential records. The pretrial disputes—some sealed for national-security reasons—involve weighty questions about rules governing the admission of classified documents in criminal trials, discovery, scope and even whether Mr. Smith’s appointment as special counsel was lawful. Judge Cannon notes the court has a “duty to fully and fairly consider” all of these, which she believes will take until at least July. This could push any trial beyond the election.
Mr. Smith’s indictments in the District of Columbia, alleging that Mr. Trump plotted to overturn the 2020 election, have separately gone to the Supreme Court, where the justices are determining whether and when a former president is immune from criminal prosecution for acts while in office. A decision on the legal question is expected in June, whereupon the case will likely return to the lower courts to apply it to the facts. That may also mean no trial before the election.
A Georgia appeals court this week decided it would review whether Fulton County District Attorney Fani Willis can continue leading her racketeering case against Mr. Trump in light of the conflict presented by her romantic relationship with the former special prosecutor. The trial judge is unlikely to proceed while this major issue is pending, and the appeals process could take up to six months.
Which leaves the lawfare crowd’s last, best hope in Manhattan District Attorney Alvin Bragg’s muddled charges on that Trump 2016 “hush money” deal with adult-film star Stormy Daniels. That case was a mess well before Judge Juan Merchan allowed Ms. Daniels to provide the jury Kama-Sutra-worthy descriptions of her claimed sexual tryst with Mr. Trump, during which she intimated several times that the encounter was nonconsensual.
Mr. Trump is charged with falsifying records, not sexual assault, and even the judge acknowledged the jury heard things that “would have been better left unsaid.” He tried to blame the defense for not objecting enough during her testimony, but it’s the judge’s job to keep witnesses on task. Judge Merchan refused a Trump request for a mistrial, but his openness to issuing a “limiting instruction” to the jury—essentially an order to unhear prejudicial testimony—is an acknowledgment that things went off the rails. If Mr. Trump is convicted, it’s also a strong Trump argument for reversal on appeal.
Little, in short, is going as planned. The lawfare strategy from the start: pile on Mr. Trump in a way that ensured Republicans would rally for his nomination, then use legal proceedings to crush his ability to campaign, drain his resources, and make him too toxic (or isolated in prison) to win a general election. He won the nomination, but the effort against him is flailing, courtesy of an echo chamber of anti-Trump prosecutors and journalists who continue to indulge the fantasy that every court, judge, jury and timeline exists to dance to their partisan fervor.
These own goals are striking. Mr. Smith wouldn’t be facing delays if he’d acknowledged up front the important constitutional question of presidential immunity, or if he’d sought an indictment for obstruction of justice and forgone charging Mr. Trump with improperly handling classified documents, which gets into legally complicated territory. The federal charges might carry more weight with the public had Mr. Bragg refrained from bringing a flimsy case that makes the whole effort look wildly partisan. And Ms. Willis’s romantic escapades have turned her legal overreach into a reality-TV joke.
Democrats faced a critical choice last year: Try to win an election by confronting the real problem of a weak and old president presiding over unpopular far-left policies, or try to rig an outcome by embracing a lawfare stratagem. They chose the latter. Perhaps a court will still convict Mr. Trump of something, although that could play either way with the electorate. Lawfare as politics is a very risky business.

What might have seemed like a historical blip in 2016 that was remedied by Trump’s general election defeat in 2020 is now an eternal black mark on the Republican Party. Hijacked by Trump, purged of its traditional middle-of-the-road corporate conservatives, and transformed into a cult of personality, the Republican Party is unrecognizable as the party of Lincoln. Gone are the Bushes, Cheneys, and Romneys. In are the worst group of scoundrels, hacks, hangers-on, and would-be authoritarians this nation has ever seen. Whatever quaint and out-dated notions remained that Iowa’s Midwestern conservatism and its rural and highly educated populace would serve as an important early filter in the nominating process can be put to rest. A majority of Iowa Republican caucus-goers went for Trump after the travesties of the Trump presidency: the failed response to the COVID pandemic, the indignity of losing to Joe Biden, and the insurrection at the Capitol, among so many others.

Don’t be fooled by media that this is some kind of meaningful comeback for him. He’s still a criminal, he’s still a liar and a conman. He’s still going to prison for the rest of his life. This is not his political comeback. This is forty thousand pieces of shit in a nation of around 340 million people who overwhelmingly despise him.
Stay vigilant. Get out the vote. Don’t get complacent, but don’t be fooled by a “comeback” narrative that horserace-driven media needs to sell advertising.
