The depths between: Chapter one

Prologue

It all started with a dare. Your whole life, you were never one to turn down dares. You were competitive and you’d do anything to win one. Those decisions were stupid and over the years, the dares grew more and more risky. 

You kept your streak for four years; four years of stupid and petty dares. One of your worst attributes was your greed. There was nothing that was off limits for you. You worked your ass off and then bought things you didn’t need. 

That fancy new plate set that just came out by a celebrity? You bought it for your apartment. The overpriced candles that smelled really good? You didn’t bat an eye as you put three in your cart. The new shirt that celebrities spent a pretty penny on? Desperate to fit into the trends, you bought it too.  

Spending money was a blessing and a curse. On one end, it was thrilling and it was fun. You loved the brief high you got off purchasing more and more items. The curse? You didn’t like spending your money on the things you actually needed. 

You learned it the hard way after your landlord suggested you get renter’s insurance for your new place. You? You waved her off and laughed. You didn’t need renter’s insurance to insure all your goods. 

That mistake came back around and bit you in the ass. One moment you were sitting in your office and writing an email to your manager. The next, you were being called by your landlord and being told your apartment was gone. 

Something in another complex sparked and that was the end of that. Your technology? Gone. Those new pans? Destroyed. The clothes? Turned into ashes and sprinkled somewhere between here and the next town over, due to strong winds. 

It destroyed you and then came the dare from your friend. Restart your life, take a breather and try something else. When they suggested a cruise ship, you laughed out loud. It seemed so dumb, considering you didn’t live anywhere near a cruise ship line, but they insisted. 

Eventually, you did some research and one website led down a rabbit hole. The next thing you knew, you were applying for the nearest cruise line near you. You heard back a week later and then it was decided. 

That was almost a year ago now. You thought it’d only be a temporary thing, but then one contract turned into a longer one. For the past eight months, the ocean was your home. Sure, your hours were long, but you enjoyed it. 

There were a variety of different types of people and conversations came easy to you. You were a little timid at first, but then everything seemed to work out bit by bit. You took it day-by-day. 

You traveled across gentle waves and rockier ones. You survived severe storms and the first week of sea sickness dissipated as you slowly got used to the boat rocking beneath you. Everything was perfect and you were an excellent worker. Not even there for a year yet, you managed to move up two ranks to higher paying jobs. 

Late at night, there was a single rule that staff and guests were supposed to follow. Ever since a worker went over the side of the boat, after getting drunk at his birthday party, the CEO made a new rule. Nobody was allowed to go on the upper deck after it got dark out unless you were part of the captain’s crew. 

If you needed fresh air, you’d have to wait until daybreak. From ten at night to six in the morning, the upper deck was silent, besides the occasional look around from the captain’s crew. 

Being a worker on the inside, you knew the schedules of the captain crew. You knew when they took their sweeps and went out and scanned for boats. Despite living on the ocean, enemies were still out there. 

Through training, you had to sit through videos about potential pirate attacks. It was something that you weren’t expecting. You thought pirates were fictional movie characters. It turns out there was quite a bit of ocean knowledge you were missing out on. 

It was two in the morning on top of the deck. You were standing just out of the way of a door that led outside. If anyone walked by the glass door, they wouldn’t be able to spot you and lecture you. The last thing you needed was to be gabbed at by some snotty coworker. 

Most of them were pretty decent people, but even in the middle of the ocean, there was a fair share of assholes. On the deck, you rocked your khakis and light blue polo shirt. Your golden name tag sat to the left of your sternum. 

The salt-brined air was refreshing for your lungs. After a long day of standing and rushing around, you just needed some time to unwind. Out here, you only existed with the ocean. 

Down below, the water gently lapped against the sides of the iron hull. There were a couple hundred people on this ship. Most of them were inside and probably asleep. A few others were taking advantage of the twenty-four hour bar that was open seven days a week. 

It was the one thing you absolutely hated. The bartender struggled to cut people off. People were loud as they went back to their cabins. You dealt with a fair share of complaints from other voyagers. 

One night, a mixture of multiple fruity cocktails and vodka shots spewed out and landed on your chest. Apparently, the perpetrator was a young girl, who just recently graduated college, and she booked a cruise to celebrate. You still weren’t over the lingering disgusting feeling of warm stomach-acid washing soaking into your cotton shirt and hitting your skin. 

You shivered at the memory and shut your eyes trying to get it to fade away. Outside, it was warmer than you expected it to be. Despite it being winter, the cruise ship traveled closer to the equator to discover and tread through warmer waters. 

You were used to snow and ice at the beginning of the year. Gray skies with a chance of a rare (if you were lucky) glimpse of sunshine. The sun felt like a mockery in the winter. It was out, but little warmth was supplied. 

A faint ghostly gleam was cast by the moon. It lit up just enough for you to catch a faint glimpse of the water below. The water was pitch black and there was nothing you could do if you fell in. Falling overboard in the darkness was a death sentence, you were sure of it. 

That’s why you stayed far away from the rails and back towards the stern. By doing this, you were out of sight at the front. The captain and his crew wouldn’t catch a glimpse of you. Before they made their rounds, you dipped back inside and relocked the glass door you came through. 

Your body fell back against the side of the wall. Naturally, your arms crossed over one another and you let yourself breathe. Today had been a pretty rough day due to being yelled at by a few different passengers. Things weren’t working out and somehow, that meant that it was your fault. 

Somehow, someone ended up plugging a toilet. The clog was apparently being fixed by one of the janitors. At least, it was until a pipe burst. The toilet started to spray water all over the women’s restroom. 

By sheer luck, you were passing by and on your way to go back to your original job from your break. Passengers panicked and screamed. Picking up on the terror, a few kids in the area began to cry and asked if everyone was going to die. When the older kids began to joke about a second Titanic, people began to lecture them for being insensitive. 

The entire time, you were clueless. This was one of the things that was out of your realm of knowledge. In a panic, you dashed away to get your boss. You left the janitor suffering and trying to get the water to stop spewing from the toilet. It was a total nightmare. 

To make it worse, the bathrooms weren’t too far from the gym. You were tasked to remove everyone from the gym to close it. People were pissed when you cleared your throat and politely asked them to leave. 

Your day ended with insults and then the incredulous task of helping the janitor mop up toilet water. What a day it had been, truly. You couldn’t wait to get back to your room, shower, and go to sleep. 

However, the salty air called to you. These trips out into the dark were like being baptized. It was otherworldly at this time. A dark void, the pale moonlight, and just your thoughts. It was refreshing and purifying. 

You knew you shouldn’t have started the habit, but you couldn’t help it. There were so many people on the cruise. There were only certain times when you felt that you were truly alone. This peaked up at number one. 

You walked further to the back of the boat. You weren’t sure if it was true or not, but you heard a passenger earlier discussing jellyfish. Apparently, jellyfish may follow the ship and light up the water due to their bioluminescence. 

It was one of the main reasons you took this job. You always had a fascination for the ocean. Your friend pointed it out to you before you brushed them off. This was a great way to be able to see marine life in person. 

Beneath you, you were surrounded by sharks and whales. Fish that were no larger than your pointer finger and fish that were large enough that you needed two hands to haul them aboard. 

Jellyfish, seals, octopus, dolphins, squids, eels, and isopods. You could go on and on about marine life. It was something that had captivated your attention since you were a kid. 

You were halfway to the stern when your feet went still. You didn’t know where it was coming from, but it had you hooked. The soft silky voice filled your ears and drowned everything else out. 

The once eager and excited thoughts about the jellyfish drifted away. Your feet moved automatically towards the stern. The hair on the back of your neck crept up, but you couldn’t stop. 

You wanted to figure out where the voice was coming from. You needed to figure out where it drifted from. All you could think about was how pleasant it was. It was so angelic. 

You moved further with your arms outstretched. Down below, the void was without the brightened illumination of bright colored jellyfish. The air was saltier as your fingers gripped the rails that wrapped around the boat. 

You couldn’t register what was happening. Your brain oozed into jello. You hoisted yourself up and lifted your foot up another rail. Down below, you’d be caught by the dark waters. Nobody aboard would realize what happened until it was too late. 

The voice continued to captivate you. The deadly lullaby came from quite a few feet away. Hyunjin’s head poked out of the water and watched your outline climb higher and higher. 

Amusement began to spark inside of him as you climbed further up. Once you fell into the water below, it’d be too late for you. Nobody to capture you and nobody to save you. You’d be his and his alone. 

Only about two rails from throwing yourself overboard, there was suddenly a loud splash. A garbled yelp was muted by the water. The singing was cut off and it ceased immediately. 

Your eyes found the water and the mask of haze was ripped off. You were up on the metal rails facing death. You screeched and jerked yourself backwards. Your body free fell until you slammed hard into the wooden deck. 

The air was ejected from your lungs and you couldn’t breathe for a few moments. Once you sucked in a mouthful of salted oxygen, you scrambled up and took off. Your sneakers pounded along the floor. 

You weren’t sure what just happened and it scared you. One moment, you were thinking about jellyfish. The next, you were nearly tossing yourself overboard. You didn’t remember walking across the ship and you certainly didn’t remember climbing up the rails. 

Rushing back to the safety of the interior, you stumbled inside. Behind you, you jerked the glass door shut and placed the key inside the knob. Once it was locked, you took shaky steps back and glanced outside. 

Nothing had changed and there was nobody there. You were all alone besides the sound of your own heavy breathing. Your eyes squeezed shut and you sucked in a deep breath. Only one thought could circle your brain over and over again.

do you mind me asking what just happened w you guys’ roommate? of course lmk if youd rather not talk about it, i just didnt wanna ask about the situation through replies and thought itd be better to ask here in case youd wanna answer privately 🙁 regardless i hope you two are okay

tldr:

a friend i've known for 6 years + the two of us moved into this apartment last summer

i'd lived w this friend a few years before this and i thought they'd grown and worked on shit (boy was i wrong)

things were okay in the first half of our lease, minor problems but it seemed like we had a good foundation laid out for living together and we had plans to renew when this current lease ended

abt 4 months ago, my roommate met this person off a dating app and they basically immediately got together and their partner showed up one day and never left

even after trying to put boundaries down abt this, they didnt listen to any of it

i also don't trust their partner bc everyone thats met them has caught some of their lies. their entire story doesnt check out

the partner (on the day our friend found recent texts on their phone to their ex) got evicted from their old place bc they couldnt pay rent and they kinda cornered us and "asked" if their partner could live with us (not paying any rent btw) and we had rly no choice but to say yes

on top of that, their partner has been fatphobic and shitty and disrespectful to us on a near daily basis. nobody in my friends life likes this partner, not their parents or any of their friends, and especially us. i tried talking to my friend about this and they acted like they took it seriously but clearly didn't...

shit kept building after they were making us feel uncomfortable and intrusive in our own apartment for 4 months, and initially i said we could renew the lease since $875 rent per person sounded tempting + i found this unit + i like this unit + i hate moving, but it just really wasnt a good idea

the final straw was my friends partner being extremely rude and disrespectful to my high school friend during pride (my hs friend is a trans woman) and when we talked to them about it, they denied everything and deflected so fucking hard, we were completely fed up with it and realized that 4 months of this has been hell and i can't do another 12 months of this

last tuesday, we told them that we would not be renewing our lease, which ends july 30. we apologized about the late notice, and explained our side and tried to be as sympathetic and helpful as possible abt them renewing the lease with other roommates, but they were upset and i get being upset, so i was giving them some space etc

we made our conversation as mature and non aggressive as possible, ive been trying to stay as collected and polite as physically possible, especially since we are the only two men in this unit

they started being extremely passive aggressive and rude and awful to us throughout the past week, and even when i was helping them figure shit out with our landlord etc, they were still so rude to us... i mean slamming doors and stomping their feet and rolling their eyes when we walk past and deadbolting the door when we leave the apartment etc

after so much hostility etc in this unit, we stayed with mutual friends for the weekend and we told them abt everything and they were all extremely supportive and said we were not at all in the wrong for this, and that we have been extremely patient with them for so long. even a friend i didnt expect to side with us was 100% on our side and wants to talk to them one on one

we're in the process of applying for a new unit and fingers crossed we can move out asap. we started properly packing today, and during that, our friend asked to talk to us

they asked what we left out of our convo and what personal issues we had, i said i'm not comfortable talking about that until we're in our separate apartments and things have cooled down more. they were really mad that i was firm on that, they accused us of creating the tension and hostility in the apartment, despite the fact that we have actively been avoiding causing shit because our stress levels are through the roof and they're already demonizing us to others bc we put down a boundary, i can't be petty etc and give them an actual reason to demonize us.

as we kept talking, they were like. shaking with rage with a smile on their face and saying passive aggressive shit to us and saying we need to move out sooner than our planned move out date...

important context: my dad is the guarantor, i found this unit, and 99% of the furniture etc we have here is ours.

(disclaimer before i say this, i know various people with BPD. people that will take accountability for their actions and take steps to work on their coping mechanisms and behavior etc.) but this "friend" has BPD that they use as an excuse for every single one of their shitty actions and does not take any responsibility for their behavior. their partner, as far as i know, is not diagnosed with anything and while i'm no psychiatrist, i've had 3 diff people (including my actual psychiatrist) say this is telltale NPD. again not to say that makes you a terrible person, but when you don't take any steps to work on yourself etc and harm others around you, thats what i take issue with. its the definition of a volatile BPD + NPD relationship...

ive also been there for this friend more times than i can count. i've wiped so much snot and tears from their face, i've put aside my own shit to help them and i've done so much for them. thats rarely been reciprocated... they do not give a shit about us and it completely showed today when they talked to us and it became clear they were trying to financially trap us here and they're furious that we put a boundary down. they treat us like their parents, their therapists, and their savings account, and if we EVER did something like that to them, the fallout would be nuclear.

i'm literally shaking typing this and hearing them come out of their room slamming doors and shit. i don't know what they're capable of, and i don't know if they're planning on doing anything, but im afraid because i don't know. i've been having nonstop panic attacks recently and the living situation here is adding immense stress on top of the apt hunting process and moving process. i feel fucking sick genuinely

As a kid, before I knew who I was, I used to hear others talk about Gay Rights. And it confused me why gays had to have rights, when we don’t go around talking about heterosexual rights. And each time I would be no closer to a conclusion and would shelf that thought away again until the next time it popped up uninvited.

I was just who I was. A kid. A regular kid. A regular kid who enjoyed sports and being in shirts and pants because then no one would keep hounding me to sit with my legs “closed.” I hated the long hair my mother wanted me to keep. It made me warm in humid Singapore, was always messy, and was a chore to dry after each shower. From every practical standpoint, skirts and long hair made no sense to me. My mother was a girly-girl, who wanted her girls to learn the piano, dress in skirts and have long ponytails. Sadly, other than the piano, I was a huge disappointment to her.

I had always been an old soul in a young body. Everything had to make practical sense or I would have a hard time accepting it. Growing up, school was hard for an old soul like me. Kids everywhere seemed childish, and my best friends were books, which could help me escape reality, even if just for a while.

When I got older, I was happy to join the workforce, where I thought I’d be around mature adults, and my world would start to make more sense to me. Boy, was I in for a shocker. I had not realized that common sense was not common, basic courtesy was not basic, and ownership and accountability were not owned by many. I also learned that ethics and integrity counted for nothing when you were in sales and in the Insurance industry dominated by ruthless managers. After 6 years watching those honest fall, and those merciless soar, I dragged my sorry ass back to school, hoping and praying grad school would be different.

That’s where I met her. I remember that first day of introductions, when she sat at my 2 o’clock. I remember her introducing herself from country ABC and having hobbies in culinary and photography. I remember our class having to walk to the library for a school tour after, and me sidling up to her side as the lights turned red where we waiting to cross the road. I oh-so-casually looked at the birds on the tree above, the old guy taking a smoke just a distance away, and then finally, just nonchalantly turned to her and said, “Hi, so you’re into photography too? What’s your favorite camera?”

And that was the start of our last 4 sweet years together. During school breaks that 1st year, we took trips to Bangkok and Australia, and school took us to more trips in U.S., Switzerland, and Italy. We were young, and everything was rosy. We took budget planes for just 2 to 3 days out of Singapore on a whim, and did budget road trips for weeks, just booking the following nights’ accommodation as we went along. We visited her family in country ABC and took them on their first road trips to different states, and those improved her parents’ estranged relationship as well. At that time, we made do, living out of her tiny common room rental for 850 a month, in a small condo unit shared by (officially) 5 other housemates. 2 guys were in the master bedroom, a girl in a similar common room, a guy in the bomb shelter and a girl in the kitchen storeroom (where the last two had no windows and therefore, kept their doors open every night). I was her regular “secret” guest, and the neighboring room always had her boyfriend over.

That place was a nightmare. The room was tiny, fitted with a queen bed, a 0.4m x 1m wide study desk, a simple foldable IKEA chair, and a narrow (1.5m high) two panel wardrobe. With all the furniture against the 4 walls of the room, there was only a 0.5m walkway between the door and bed, and bed and wardrobe + study desk. (Think how you couldn’t even pull the chair all the way out to sit at the desk!) Luckily, she only brought one suitcase with her, and that had nowhere else to go except to be balanced precariously on top of the flimsy wardrobe held up by duct tape. There were tiny bugs constantly on the headboard of the bed, the walls, and the sides of the wardrobe, and squishing them only left small dots of red on the wood and paint.

After school ended, we both found basic jobs in the financial sector, earning basic salaries (3k each) that were barely enough to cover rent and the 50 grand of study debts. We lived simple lives on her culinary skills and moved out to a slightly bigger place (with no bugs!) as soon as the previous rental contract ended. Deciding on a small studio in the far areas of Western Singapore was hard when we only had a budget of about $1500 for rental. Fortunately for us, heaven smiled down on us during our search. I will never forget the moment we signed on the line to rent that new place, and the pure elation on her face mirrored my emotions the first day we wheeled her luggage through the door. We were both so overwhelmed that we just stood in the middle of the completely unfurnished unit, just turning around and around to look at the “huge” space we now had. The landlord was kind enough to provide us the keys 7 days before New Year’s Day, and we enjoyed our first homecooked Christmas dinner there. Just 400 square feet of luxurious blessing (including our very own bathroom).

2018 to 2019, we were happy. As happy as can be. If Singapore allowed, I would have married that girl, and made her my wife. I knew that I wanted her around, through thick and thin, bugs and all, for as long as I could. But because we couldn’t, we tried to apply for PR for her. Twice. And failed twice. Despite everything, we were happy. She enjoyed her work and colleagues, and I had a job I enjoyed, in a decent company, with great colleagues and a great leader. Everyday, time seemed to fly by as I get so engrossed in picking up new experiences and knowledge at work. And at the end of each day, I was happiest, running to catch the bus that would take me the few short stops to her office, and we would head home together.

2020, the world went crazy. When Covid-19 started, nobody took it seriously. When they finally did, it was too late. Singapore being small, seemed to put its economy before citizens’ health, and pretty soon, we saw new policies introduced so fast and furious, it was hard to keep up. Racism escalated real fast as fear grew. Everyone’s primal survival instinct kicked in, took over, and overwhelmed. We saw hoarding like never before, where previous proud displays of extravagance in the form of luxury goods, were replaced by flaunting of overstocked pantries of unnecessarily excessive daily necessities. Households storing shelves of toilet paper and rice, splashed out on social media, instigated herd mentality, and created dangerous vicious cycles. It was at this time that our rental contract was due for renewal, and because of travel restrictions, we saw a larger than usual demand for rental property. We saw increased negative correlation between our salaries and expenses but still, we were thankful for just having each other.

Unfortunately, fate reared its cruel head, giving us first-hand experience of Murphy’s law. Her father was diagnosed with cancer towards the end of the year, and that was the start of the end of the improving relationship between her parents. Both our companies also underwent major restructuring that year. Coincidently, both companies started offshoring parts of operation to neighboring country XYZ. And it seemed ridiculous then, because the number of Covid-19 cases in that country was heading north at breakneck speed. Every single day, more than half of both of our offshore teams were on medical, hospital or compassionate leave. Work was not getting completed, and to make things worse, both offshore teams seemed to have the same zero accountability and pride in their work. Every day was a mental torture to engage them in their finger-pointing, others-blaming games, even when evidence of their negligence was staring at them point-blank in the face.

Having a slightly better command of English than her, I took it in my stride facing these “Taichi experts.” But when my boss (that I had a huge respect for) lost his job due to the restructuring (and workplace politics), I started looking out. I was fortunate enough to be able to land another opportunity and left.

Her job was harder hit. Her team now had to rely on the offshore team to finish the daily BAU wok before Singapore team could check and sign off. I remember when she first joined, she was trained for a month before she caught up with the daily deadlines and managed to complete the day’s checks by 5pm daily. Somehow, their XYZ offshore team were still exceeding all deadlines by a wide margin (with massive amounts of repeated errors, which they would then trigger new blame games), causing the Singapore Team to finish their checks (and “fights”) and call it an end mostly after 10pm.

While barely keeping her sanity at work, watching her constantly forcing a smile to comfort her mother, who was struggling with a self-centered patient exploiting his illness, I saw the bags under her eyes gain prominence over the months. We tried desperately to find a new suitable job for her, as her initial Singapore team of almost 30 (mostly seniors with more than 10 years’ experience) dwindled to the last 5 of them. During this time, her mouth struggled to maintain its curve upwards, and it was heart-wrenching to witness the glimmer of hope fade from her eyes. I knew she missed her mother, as Covid-19 prevented us from traveling back to see her. I knew she was not enjoying her “new” role at work, working with the XYZ team. But my hands were tied. I begged everyone and anyone I knew to look out for any suitable job willing to consider a foreigner. It was a losing battle.

After 8 months, she started applying outside of Singapore as well, thinking to leave it to fate. Shortly, a call from ABC country offered her an interview. Things went fast, and in a few short weeks, they were extending an offer, with one condition, that being she was to board the first available plane back after completing her notice period.

I was crushed. I knew I couldn’t make her choose me (and continuing working with XYZ team), but suddenly I felt like I had been told I have just one more month to live. My life, as I knew it, was ending in just 4 very short weeks. We both knew her current job in its current form, was destroying her mental health, and I couldn’t bear to keep her here like that.

After the initial roller coaster of emotions calmed down, we strategized, trying to accommodate all the local places we had always talked about visiting, with the packing and shipping of her stuff.

Today marks the 33rd day she is not by my side, and all this time, I have been trying not to be cynical when considering the factors that contributed to our current situation. Days and nights blur into one, as I try tirelessly to find myself a job in country ABC, hoping against hope that we may soon reunite.

See, it's an interesting thing. I suppose psychologically. You live your life as an independent, self-employed touring musician/songwriter and over the years you realize it's possible. You can do it. You don't ever have to ask your government for any whatsoever support. That's because you know there won't be any. Anyway. But you don't mind because things do work out. Not necessarily very brilliantly, but they do. You can pay your rent, you can pay your expenses. All this. No problem. No bigger problem at least usually. But there might be a situation you're not really prepared for. Say, you've got a shit-load of gigs lined up, you're on tour, everything looks as bright as it ever could possibly look like. Things are literally taking off in a good way. And Bang. Here comes a pandemic. A good one. Not one of these baby pandemics. One of the really, really serious bad-ass pandemics. Not good, but OK, it's here. Not much to do about it. So what's happening next? All your shows will be inadvertently cancelled. That makes sense. It's really sensible. Because nobody with a tiny piece of brains left would like to have you travelling all the way to play in front of people, possibly infecting you or YOU possibly infecting THEM with some weird, lethal virus. Next thing happening will be: you're dead serious now you're screwed big time. Oh, and it's not exaggerating, because you indeed are. And now we're going for the interesting, dirty little bits to come up. A recipe for how to feel like a piece of crap. There's not too many ingredients you need to get that tasty dish ready to be served. Let's try to get into the mind of that particular touring musician/songwriter/freelance artist. He doesn't fell particularly well or secure about how his soon to come living conditions are going to look like. Especially how he's going to pay the rent for his flat, his rehearsal room, his energy bills, all this. But. Thank god. There is a government. And authorities. Both of whom he never ever asked for money or funding or whatsoever support. Now they're entering the scene. They're gorgeous. They've got surprisingly interesting new ideas. They discovered their love for all kind of artistic activities. This is the state of Bavaria, Germany, superior to the rest of the country, always been, let's get this straight. We're a culture loving state in Germany. We won't let that slip. We will support our artists. The poor bastards are suffering. They won't survive without help. We'll spend — no joke, mate — a couple of millions of Euros to keep them going. Really, man, we love them. They're so important. There are only two other nationwide industries generating a bigger gross turnover than the entertainment branch. And to be honest it doesn't really hurt to pay them some pocket money as it's anyway taxes paid by themselves. Next thing to happen is: all those important artists get into a most cheerful mood. But, erm, there is still no sign for any money rolling in. Let alone a way to apply for it. It's more a “you can very, very soon apply online for some much needed and deserved funding”. After a time span of eight weeks the artists are getting a bit nervous. I mean most of them don't have any savings. They relied on playing shows to pay their rent. But there are no shows. There won't be shows for a very, very long time as it looks like. Unfortunately the landlords want their money. Tricky, slightly unfortunate situation it is. There are cool landlords who'd skip the rent until there is a chance to earn some cash. But there are as many, if not more, not so very cool landlords. But hey — we're important. They want to have us. They are willing to pay money for us to survive. But still — the money is just not there. And all of a sudden. Here it is. The day the online application form is online. An easy one. Just fill in what you need, up to EUR 5000, or less if you think you'll need less and that's it. Shoot it over and things will go their way. But what's that? A week later there are new details in that very application. Sure you can have that money, BUT you may only use it for your business expenses. That is: office rent, rates on company cars bought, expenses for your facilities... Oooops. Our artist is getting a bit confused. That wasn't the deal, was it? Few days later it says: oh we forgot to tell you this all has to be paid back and you have to prove what you've spent it on. Which is: office rent, rates on company cars.... well, we call it business expenses. Now there is a little issue. Our artist is an independent touring musician. He didn't recently rent that floor in the local business tower for his headquarters office rooms, neither did he buy a brand-new tour van he still has to pay off. But good news: this is now turning into an avalanche of funding monies. There is top-up of another 4000 on offer in national funding from the German government. Wow! So while he's still mulling over this, a few weeks later he all of a sudden receives money. From the government. The arts-loving Bavarians. Not enough to get through a pandemia but something. At least. Plus an email with a detailed catalogue of questions about his monthly expenses in rent, business insurances, health insurance, the whole thing. Including a friendly reminder if he can't properly and honestly answer all these questions he's not only not entitled to get the funding but also puts himself at risk for being prosecuted. This is thin ice now. They'll kick your arse for dodging grants here. Phew! Now this is getting a bit complicated, isn't it? So let's call the hotline. There is a hotline, thank god. And it's a good hotline, a quality hotline as you can expect from a proper arts-loving government. “Good morning sir, I need some help.” “What can I do for you?” “I got money from you guys and at the same time I'm told I'm not entitled to keep it if I can't answer a lot of questions completely new to me. What does that all mean?” “Ah, don't worry. It's OK. The first wave of applications has been just waved through as they're meant as INSTANT CORONA SUPPORT. All those questions are just if you want some extra out of that national pot of subsidies. If you don't need any of that let me know, and we'll cancel this second application you haven't made yet.” “Oh. OK. Let's do that.” Trouble sorted. For now. But. There's always a but, innit? There's a new wave of support rolling in. It's a big new thing. It's particularly for ARTISTS. EUR 3000 in total for three months. Money just handed out to live off. Not refundable. These are good people. They understand what it's all about. Still you need to match some requirements. You have to be a self-employed, independent artist insured in the German KSK. That's the artist health insurance. For those not familiar with it: you have to prove by receipts, reviews and newspaper clips and all that you're really earning your main income as a performing artist. So there's no easy way to sneak in. Once you're in they can be sure you're serious about your intentions to lead your life as an artist. Got that? Yeah, sure. Means the money now ready to be spent on those losers is meant really just for them. No dodging possible. End of the day we're still in the world capital of bureaucracy. Our artist starts getting really aroused. To say the least. Particularly as this new funding thingy is actually not repayable. It's really for staying alive. Buying food, drinks, affording the odd lightbulb if necessary. Know what I mean? All the things he kept on hold. As this whole situation about receiving subsidies turned out to be a very complicated, very confusing thing and the online form is a bit confusing too, our artists decides not to take chances. Rather call the friendly bloke in the hotline again. He has been helpful before, so he'll sure know what to do here. And, thank god, he does. “As these are two totally different schemes you just fill in all the required information, tick the box you haven't applied for money yet — remember, it's a different thing? — and off we go.” Good. Done. Another three weeks passing by with daily checks of the mailbox. And finally — here it is! An official pdf document of the government of Bavaria. You're among the chosen ones. You're a real artist. We will pay you those 3000 so you can survive and keep on doing your little, quirky, important artisty things. Congrats. All good now? Not really. So why's that you may ask? Well, there is nothing happening. At least not on our artist's bank account. Instead, an email arrives two weeks later. Straight from the desk of the lady a few steps further up the ladder from our friendly hotline staff guy. And yes, she's really sorry. It's bad news she's bringing. Unfortunately we have to inform you, you're not entitled to apply for the artist aid scheme. And what about that bit of information these are two different things? Well, you already received money which includes everything we can give you. Ah, got it. So does that mean 3000 out of the received subsidies are non-refundable? No, because these are two different things. Thanks. This, dear reader, is when you realize you better stop wasting time on asking your government for a favour. This is when you finally understand how important you are as an artist in the state of Bavaria, Germany. Should have known better.

The Elizabethan Townhouse

I was recently sent an email asking what was on the site of the Elizabethan Town House at the north of Marygate.  This goes around the houses a bit but it’s a fascinating story taking in so many unrelated subplots! The Elizabethan Town House, formerly the Avenue Hotel was built in 1899 by Joseph Weatherston (1836–1910). However, to answer the question of what was there before the Avenue, we have to delve further back in time. 

The Elizabethan Town House

It is now hard to believe, but the Scotsgate was once the same size as the Cowport. A single-carriageway wooden bridge (later replaced by a stone causeway) spanned the 200 feet of the ditch in front of the walls. (This is why the road widens out to the north of the car park entrance: that is the point at which “land” was reached again.)

Dr John Fuller, in his 1799 History of Berwick complains bitterly about the Scotsgate and its narrow bridge, and the dangers it posed. And with good reason: remember—pedestrians were vying for space with traffic in both directions, and those on foot were coming off worse. It was probably as a result of Fuller’s remonstrations that in 1806, the Council gained permission from the Board of Ordnance “for taking down and widening the Scots Gate and the Draw Bridge leading thereto, so as to render the northern entrance into the town more accessible”. In the end, probably due to cost, just the east pedestrian archway was added. Note, there was a gate inside: the town was being locked down every night until about 1815!

If you look at the pedestrian archway on the east side and the archway over the Cockle Steps” leading to Greenside Avenue, we can gain some insight as to what happened. Originally, where the pedestrian archway is, there was a flight of stairs leading to the rampart. We also know that there was a guard house at this side of the Scotsgate. One can see the stonework of the Cockle Steps arch has been roughly dismantled and there has been no attempt to “finish” it in any neat way. This is lucky for the building detective, as it shows the arch must have projected over what is now pavement, under the rampart steps, forming a barrel vaulted roof to the guard house.

The rampart steps were taken down in order to create the new pedestrian archway. We can see in the Cockle Steps arch how only just enough has been removed to allow this. What happened to the guard house is unknown. It may have been downsized, rebuilt (unlikely) or abandoned. Whatever its fate, we know that 80 years later, Joseph Weatherston unblocked what was there to create Greenside Avenue.

In 1857 the thorny question of the Scotsgate raised its head once more. The problem was now that since the arrival of the railway in 1844, the majority of people walking up and down Castlegate favoured the west side, closest to the station. A square building, known then simply as “Miss Gardiner’s house” had occupied the site since the late 17th century at least (see 1792 plan above). It projected awkwardly beyond the natural street frontage. This meant that anyone walking up the west pavement on Marygate had to either use the original vehicular road, or cross to use the east footpath, neither deemed desirable. Alderman Bogue believed the best solution was to demolish the projecting wing of the house and build a second vehicular carriageway and in its place. Later that month, however, it was resolved to leave the house alone, widen the existing vehicular arch and add a west pedestrian archway. In February 1858 the Berwick Journal took the Board of Health (who were in charge of the project) to task declaring the alterations to be a “Waste of Money!”, and that “[the public] do expect to see some benefit commensurate to the outlay [of public money]; this, however, we regret to say, they are rarely privileged to see, and in the case of the improvements at the Scotchgate they never will.”  In May the Board decided on a plan of action; to widen the existing gate to the east by 6 feet to 18 feet 3 inches, raising the arch by 1 foot, and to add a west pedestrian footpath at an estimated cost of £40–£45. Work commenced demolishing the arch in September that year. The Berwick Journal, like many a modern day tabloid, without any sense of contrition, pronounced its U-turned opinion once more: “Now that it is down, and everybody can see what a great advantage its absence is, in every respect, we trust that they will by every means in their power endeavour to be released from the obligation of building it up again, in any form whatever.”  The paper went on to suggest all that was needed was a ramp from the east side of the opening up to the ramparts. Thankfully, the Board of Ordnance stuck by its insistence that the rampart was rebuilt! But what of Miss Gardiner’s house?  The Journal had a point when it demanded that the house should be purchased, “at any price and pulled down”, so that people could actually see the new west pedestrian archway ahead, instead of missing it and using the road. While they were at it, “the Corporation might buy that old, rickety, squinting thatched house […] which disfigures the East side of the entrance to the town.”  (Situated near the B&M supermarket entrance by the Castlegate car park, it seems to have been used as a toll house.) The paper went on to suggest it being replaced by a new building “in the Edinburgh fashion”, the money being recouped by selling or letting the flats and offices therein.

“Miss Gardiner’s house” had been occupied by a now elderly Guy Gardiner (1768–1855). He had been the Master at the first Grammar School between 1806 and 1848; only the third since 1691! The house had come as part pay with a salary of £80 a year. The original grammar school was nearby and now may form part of His two spinster daughters, Mary JS Gardiner (1804–?) a retired teacher, and her younger sister, Jane S Gardiner (1808–?) another teacher, were obviously looking after their father. The 1861 census shows that, following the death of their father, they were joined by a “cousin” the 14-year-old Jane JS Gardiner who had been born in Malta. Twenty years later, we find that young Jane was married to Thomas Fair Robertson Carr, an agricultural merchant. It is not clear whether the house sale was by mutual consent or by compulsory purchase, but by October 1881, it was to be offered to the Urban Sanitary Authority for £1625 and the projecting wing finally demolished.

But what was happening across the road at the site of the Elizabethan Townhouse? Examination of the OS 1852 map shows a very similar building layout with an archway leading through to Sidey Court, then a stonemason’s yard. Inside the arch is a blocked doorway that no doubt led into a pub called the White Hart. (Prior to this it was called the Sir Francis Burdett after the very popular reformist MP (1777–1844) elected to Middlesex, and Westminster.)

The date at the eaves states 1899 which is probably the date the Avenue was built as the first mention of it I can find is 1901 when the landlord was a Mr Elliott. Before Eliot or, indeed, Weatherston, the property belonged to George Back (1801–1879).  Living in Church Street (1851 census) he and his sons George (c.1827–1874) and James (1835–?) were the stonemasons to whom the yard and buildings belonged. George Jnr must have had an excellent education as by 1855 he was advertising himself as an “Architect, Land and Engineering Surveyor”.

In 1856 he fortuitously bought the lease of the Tweedmouth quarry. Fortuitous as in 1858, the King’s Quarry became the location of Tweedmouth Cemetery. Newspaper adverts from March 1857 now describe him as an “Architect and Sculptor” supplying gravestones at “The Studio, Scotchgate”, the salesroom of the family business.

By the time the 1861 census was taken, it would appear that George Snr and James had left Berwick.  What had happened? We will probably never know but in July 1860 George and James had applied for passports. A mere two months later, gone is any mention of his being an architect and sculptor; gone are the cemetery monuments. Instead, George is reduced to selling flagstones and other building materials. This would explain why his occupation in the 1861 census is listed merely as “merchant”. The change of business must have been due to the departure of George Snr and James; with nobody to make the gravestones, there were none to sell. It suggests that business had taken a downturn, possibly because, or as a result of George Snr and James’s departure to Ottawa, Canada. By now George would have been about 60: he died at James’s house there in 1878. 

Back in Berwick, in 1871, George Back Jnr was facing bankruptcy. Three years earlier, he had attempted to diversify selling ironmongery but to no avail. After three years of pitiful adverts attempting to offload a quantity of roof ridge tiles, George died in 1874.

It may have been then that Joseph Wheatherston acquired the property. He was a slater and plasterer from a family who had been in that trade for some years, starting (at least) with his grandfather Thomas Weatherston. Thomas had two sons, Joseph and William, who entered the family business. William (1799–before 1861) appears to have been working with his father from Chapel Street (1837) and then Woolmarket (1855). William was also the landlord of The Globe on Chapel Street. His brother Joseph was working in West Street. Joseph became a Councillor is 1859 and died in 1870. That year, Joseph Weatherston—son of William—took over the running of his uncle’s operation. He now lived at 1 College Place. In 1876 he was elected to Berwick Council and by 1885 become an Alderman. He later represented Berwick on Northumberland County Council.

Weatherston continued as a slater/plasterer for some time. Among the buildings he worked on were the Masonic Hall in 1862 (built on the site of a storage yard he owned) and the Literary and Scientific Institute (Library and Museum, now Costa Coffee) in 1871. In 1885, he had the remains of the old guard house by Scotsgate demolished and created Greenside Avenue and later, the Avenue Hotel.

within two days of only a sign in the yard she thought she struck gold she found a doctor from out of the area and a nurse local to the area that she lived in and thought this is perfect I got a doctor and a nurse that want to rent my place what could be better than this they came in their scrubs they were incredibly nice and they gave her credit reports that gave sherry here you go you’re our credit reports eight hundred plus were awesome and gave sherry cash right away and said we’d like to give you the security deposit right now so we can make sure we can have the first dibs at this property while we go through the application process and whatever and so nobody else can see it this is pretty standard so to Sherry a first time property manager this sounded like gold here’s a tenant that kind of already knows what they’re doing and she doesn’t really know what she’s doing so perfect this made her feel like her advertising work was magic and being a property manager was next to the easiest thing that there could possibly be she knew running credit was important but they already brought their Credit Karma credit reports they looked legit after all they had all the logos they looked like the actual credit karma credit reports and everything was set sherry also knew that it was kind of a hassle to get set up with credit bureaus and she’s heard stories about how people had to get their offices inspected to be able to run credit for people so she thought yeah this is good enough well nine months later sherry had her house back accept eight of those nine months she went without collecting a single payment on a property that was renting for $3,000 per month and she spent those eight months evicting the tenants who ended up leaving over eighty thousand dollars in damage because their socials were fake she couldn’t even sue them it turns out the only thing these medical professionals were able to dr. were their credit reports so here’s exactly how to run somebody’s credit the correct way oh and heads up for this method you do not need to have your office inspected you do not need a locking filing cabinet you do not need to go through a lengthy approval process with one of the credit bureaus or some kind of other third party company that is going to set you up to be able to run people’s credit we’re gonna make it a whole lot easier and you’re gonna get it all right now number one the most important thing to do is make sure you get a signed credit application I’ve got a sample here on screen and I also put a link to this sample application down below in the description you’ll find that link right below the link to my real estate investing course which is guaranteed to make you more money than the cost of the course which is pretty inexpensive or your money back you can personally email me when you accept the application from the tenant I highly recommend you take a nap on your phone like scanner pro or whatever and take a picture of the app right away so you can scan it and file it email it to yourself or whatever you need to do because the odds are if you don’t do that and you’re anything like me you’ll end up putting the papers on a pile and you’ll scan them six months from now but you may have already lost half of them very important when you take this signed credit application check their driver’s license in fact go ahead and scan their driver’s license as well I like to scan front and back and then compare the signature on the driver’s license to that on the application this sounds extreme and that might make you feel uncomfortable but think about it this way when you’re renting out your property the tenants are trying to court you they’re trying to get you to rent the property to them so this is very normal you’re in control at this point when the tenants have the keys that’s when they’re in control that’s why they say possession is nine-tenths of the law number two collect cash for the credit screening fee do not take a check because if they bounced the check you’re stuck paying bounced check fees I’ve been there also make sure to check your local and state laws regarding the maximum credit screening fees they’re different for every state now go to my smart move comm this is an officially sanctioned website by TransUnion once you register start a new report enter the tenants email address say yes that you have a signed application this is very important do not skip the cyant a poor credit screening there are too many privacy laws out there check with an attorney the application is complete you’ll get a report back with background criminal eviction history income insights address history and most importantly their credit report I personally disregard the credit score I go into detail in the credit report going into detail in the credit report is actually something that I’m going to delve in-depth in my real estate investing course because there have been cases where I will approve tenants based on what I see inside of the report whereas maybe otherwise they wouldn’t have gotten approved and vice versa sometimes people have high scores and there’s no way in heck I would approve them because of what’s actually inside the report so looking at the score itself I don’t recommend now this step is extremely important it’s very important that after you get the report you call trans unions customer service number and reference the report ID now take your application and ask the customer service rep I’d like to verify the social security number that was used to fill out the online portal application they’ll say okay go ahead give me the social you’ll give them the social that’s written on the paper and they’ll either confirm or deny that this social is accurate I personally recommend writing down the name of the person you’ve spoke with at the customer service center and the date and time you spoke with them and write down a little note verify check whatever now one of my last steps is one of my last challenges for the tenant when everything looks good I ask the tenant to bring their social security card to the lease signing or when I meet them to pick up their security deposit I always pick up security deposits in cash because I’m taking the rental off the market and I want cash or a cashier’s check I do not want a personal check if I’m taking a property off the market when I meet with them they need to bring their actual social security card not a copy nothing then I’m going to compare the name and number that they gave me on a social security card to their application at this point they’ve answered the challenging questions their picture ID matched them sometimes I even asked tenants to bring their passport have a second form of picture ID they actually have the social security card they were able to answer their questions correctly and I approved of what I found in the credit report usually I feel pretty comfortable at this point but sometimes when I’m questioning a tenants authenticity I will take it a step further and this is the bonus tip for an extra ten dollars I will do the same process with Experian just Google Experian landlord tenant credit check it’s only $10 at Experian because it doesn’t give you all of the additional insights but I like running their credit at Experian as well Authorities said they stalked streets in Chicago and the west and northwest suburbs in a reddish-orange van in search of lone women to abduct. Update: Murderer from notorious Ripper Crew released, heads to Wheaton to begin life as a free man » At 58, Thomas Kokoraleis is likely the only member of the group who will get a chance to rejoin society. He originally received a life sentence for his role in the murder of a 21-year-old Elmhurst woman who was abducted outside the suburban office where she worked in May 1982, but a series of legal maneuvers and now-defunct sentencing rules allowed for him to go free after serving just half his prison term. His younger brother Andrew was executed by lethal injection 20 years ago this month at age 35, before Illinois abolished the death penalty. The other two defendants have exhausted their appeals and probably will die in prison, though one will be eligible for parole if he lives to be 89. It’s unclear where Thomas Kokoraleis plans to live. The former DuPage County resident did not respond to written Tribune requests to interview him at the Illinois River Correctional Center, a medium-security facility in Fulton County. Though still upset, some relatives say they accept the news. “We’ve exhausted everything,” said Mark Borowski, who was 14 when his sister Lorry Ann was abducted after walking a few short blocks in broad daylight from her Elmhurst apartment to work. “There’s nothing else we can do. We fought as hard as we could. I cannot even imagine someone like this could get out.” Those who know Kokoraleis — including psychiatrists and psychologists who in recent years evaluated him as part of a last-ditch effort to block his freedom — say he is not sexually violent. They portray him as a hapless follower with a low IQ who unwittingly inserted himself into the police investigation while trying to help his brother. But police and prosecutors involved in the infamous case say they have no doubt about his involvement. Kokoraleis admitted in detailed, tape-recorded police interviews in November 1982 to being present during three attacks, including the slaying of Lorry Ann Borowski. At trial later, he denied being present and said police fed him details of the crimes. Authorities argued he wasn’t smart enough to memorize such descriptions even if they had. Authorities described the others as “genetic nobodies” whom Gecht easily manipulated while giving them work as laborers. Lorry Ann Borowski’s mother, Lorraine, now 83, said she never imagined she’d see the day Kokoraleis would be a free man. She recalled that during the nearly five months the family searched for her daughter, she would carry a sheet, hoping to use it to cover Lorry Ann’s body and give her child dignity in death. “I thought he was going to be in prison until I died,” Lorraine Borowski told the Tribune. Local authorities in Canton, Ill., where Kokoraleis has been incarcerated, said he is not expected to remain in the area. Before his arrest, he lived in Villa Park, where the family still has elderly relatives. His parents are deceased. Thomas Kokoraleis in an undated photo. One of them, Greg, told the Tribune his landlord has made it clear that the convicted murderer cannot stay with them. He insists his brother is not dangerous. “My brother would never hurt no one,” he said this week. “He’s not that kind of a person that would turn violent. He got mixed up with the wrong people. … I’m just praying for him so he can find a place to live and doesn’t end up sleeping on the street.” Other siblings live out of state. Kokoraleis was due to be paroled in late September 2017, but his release was delayed because he had not found an approved place to live, which is considered a parole violation. State corrections officials declined to say where Kokoraleis plans to live or even if he has secured housing. But even if he hasn’t, officials said, they cannot hold him any longer. The state will provide him few resources beyond transportation from the prison, according to state officials and advocacy groups who have argued that such treatment of longtime inmates is inhumane. Members of the Borowski family and friends along with attorney Gloria Allred hold a news conference to oppose the relase of Thomas Kokoraleis from prison. Kokoraleis, part of the Ripper Crew, was convicted of the 1982 murder of Lorry Ann Borowski. (Stacey Wescott/Chicago Tribune) State officials said Kokoraleis’ address will be a matter of public record on Illinois’ sex offender registry. Though he is not a convicted sex offender, officials said that because he is a murderer whose offense was sexually motivated, state law requires him to register for the rest of his life while living in Illinois. He will not be subject to other rules applying to sex offenders, such as boundary restrictions near parks, schools and day care facilities. Elmhurst police Chief Michael Ruth said he shares community members’ concerns that Kokoraleis may return to the area. “Human beings are creatures of habit,” he said. “If you were incarcerated for 35 years, where would you go? You go back to your old neighborhood, to what you’re familiar with.” At the time of his arrest, Thomas Kokoraleis was a 22-year-old painter and high school dropout who admitted using cocaine and marijuana. He did not have a criminal record. A forensic psychiatrist described the former special education student as having a “borderline range of intellect,” just above being mentally impaired with an IQ of 75, according to court records. His former trial attorney, Thomas Swiss, is now retired and said he has not spoken to Kokoraleis in years. He has described his former client as a follower and people pleaser, and a danger only to himself. A DuPage County jury convicted Thomas Kokoraleis in 1984 of Borowski’s rape and murder, and a judge later sentenced him to life in prison after rejecting the prosecution’s request for the death penalty. He did not testify during his trial, but during his sentencing hearing he took the stand and denied involvement. In late 1986, a state appeals court reversed his guilty conviction, citing legal errors, and ordered a new trial. One year later, Kokoraleis pleaded guilty to the Elmhurst murder in exchange for a 70-year prison term. The plea deal allowed for Friday’s release, as standard sentencing guidelines back then included day-for-day credit for good behavior. The passage of truth-in-sentencing laws later excluded convicted murderers from such perks. As part of the plea deal, prosecutors also dropped charges against Kokoraleis involving another woman who is thought to be the men’s first victim. Linda Sutton, 26, was found mutilated outside a Villa Park motel after the men abducted her about a week earlier near Wrigley Field in May 1981. Her children, Antone and Shavonna, were 9 and 1 at the time of their mother’s violent death. Her son still recalls the sight of police detectives arriving at their home with her earrings to try to identify the woman’s remains. “He served his time. We have to accept it,” said Antone Sutton, now a father himself. He said he has thought about what he would say if he ever met his mother’s killers. “I guess I just want to look in his eyes and speak to him. I can take it, whatever he says, to know the truth and, I guess, maybe release some inner demons in my mind.” In 2017, authorities explored whether Thomas Kokoraleis could be involuntarily civilly committed as a sexually violent person. But various mental health experts found he did not meet the legal criteria. The law required proof beyond a reasonable doubt that a person suffers from a mental disorder and that the disorder makes it “substantially probable” he or she will commit further acts of sexual violence. Besides crimes involving Borowski and Sutton, Kokoraleis admitted in his 1982 tape-recorded police statements to being present during the abduction of 30-year-old Shui Mak of Lombard. She vanished two weeks after Borowski’s kidnapping after getting out of a car following an argument with her brother as they drove in the Hanover Park area. Her body was discovered months later in a South Barrington field. The details of the group’s repeated attacks on women were shocking. The men would cut off their victims’ breasts, often using piano wire or a knife while the women were alive, as part of sexual rituals — sometimes involving cannibalism — later performed at a makeshift altar in the ringleader’s Chicago home, authorities said. Exactly how many people they killed likely will never be known, as police were unable to locate all the victims’ bodies. Police said the defendants were high on drugs and alcohol during the attacks, and later confused details or couldn’t recall where they dumped their victims. Spreitzer, 58, is ineligible for parole. Convicted of five murders, he was sentenced to death in 1986, but in 2003 then-Gov. George Ryan cleared out death row, commuting to life terms the sentences of all the state’s condemned inmates. It was one of Ryan’s final acts in office. Illinois abolished the death penalty some eight years later. The group’s leader, Gecht, 65, is eligible for parole in late 2042. If he lives that long, he will be 89. Without a confession or other physical evidence, authorities were unable to obtain a murder conviction against him. Gecht was sentenced to 120 years in prison for the rape and mutilation of an 18-year-old woman working as a prostitute who survived her attack and provided police with crucial details, such as a description of the reddish-orange utility van. Warren Wilkosz, a former DuPage County sheriff detective whose work helped end the crew’s cruel run, described passing out flyers to prostitutes along Cicero Avenue with a description of the van. Chicago police eventually located it, with Spreitzer behind the wheel, which led authorities to the rest of the men. The teenage prostitute identified Gecht as her assailant in a police lineup held in the hospital where she was recovering. Years later, Wilkosz witnessed Andrew Kokoraleis’ execution. Long retired, Wilkosz said he doesn’t have strong feelings about Thomas Kokoraleis’ release. Gecht, though, would be “a whole different thing,” he said. “He made Manson look like a Boy Scout.”

Gentrification in Durham: A renter’s story | The Herald Sun

Rosemary Abram came home to a letter on her front door, telling her she needed to move out by the end of the month.

It wasn’t an eviction notice. Not yet. That came later.

Abram, 62, has lived in a quadplex at the corner of Morehead Avenue and Shoppers Street for the past eight years with her husband, John, and mother-in-law, Peggy.

Their building is on the edge of two neighborhoods: West End and Lakewood. Both have recently seen new development, with renovated homes and new restaurants. In the Lakewood shopping center, the former hot dog stand Citi Dogs is shuttered. Nearby is the new food truck destination and bar called County Fare. Cocoa Cinnamon, the downtown coffeeshop, has a location by Lakewood, too.

The Abram family

Rosemary and John Abram, who married in 2011, wanted a place of their own and so were happy to find their rental for $450 a month. They’re both on disability, with a combined monthly income of $1,100.

“It was peace and quiet and inexpensive,” Rosemary Abram said. “When we moved here, we didn’t have a car, and it was right on the bus line.”

When they got a letter in 2017 that their building had been sold, they were told their rent was going up $50 a month. And instead of a yearly lease, it became monthly. They could manage $500 a month, Rosemary Abram said.

But then the letter from 3 Points Property came on April 1, telling them to move out by April 30.

It also said they could apply for a renovated unit on their street, which start at $825 for a two-bedroom like they live in now. That’s beyond what the couple can afford.

“It’s wrong what they’re doing,” said John Abram, 65. “They don’t care. We’ve been staying here eight years, never been late with rent, or owed them a brown penny.”

“It’s all about the dollar bill,” said Rosemary Abram.

John Abram called the number on the sign of an already renovated building across the street. The rent in that building is $995 a month.

‘It’s a dog eat dog world’

Gentrification is the displacement of people in a neighborhood by those with more money.

In the Abrams’ neighborhood, those who move into their old apartment will be paying nearly twice as much rent. One of the Abrams’ neighbors in their building, a bus driver, also got the letter. She has since moved out. So have two more neighbors.

In the building on the other side of them, Arlessia Cobb, 47, received a letter two weeks after the Abrams did. She has lived in an apartment in a quadplex just like the Abrams’ since 2011.

“I’m boxing up,” Cobb said. She asked their former property manager if he knows of any other available apartments. She needs until July to save up and move, she said. Thirty days isn’t enough.

“They need to give us time to prepare for this,” she said.

Cobb grew up "in the Cornwallis projects," then lived in East Durham. Her son, Ladarius Rogers, 21, has special needs and lives with her.

Cobb doesn’t think the changes to downtown Durham, less than a mile and a half away, are a good thing.

“They are moving out a lot of people to move in people of a higher income,” she said. “It’s not right. We’ve been here all our lives. I just think it’s wrong.”

“It’s a dog eat dog world, I can tell you. But I don’t think it should be like that … Durham has changed, and it’s changed drastically. I don’t think it’s fair to low-income people. We’re not middle class,” Cobb said. “We need a place to live.”

“I don’t think a person should stay in the projects, but when you’re trying to improve yourself, give us the chance,” Cobb said.

The Abrams could not find a new place to live and move out within a month. But they started packing anyway. On May 1, a day after their landlord wanted them gone, the living room of their two-bedroom unit was filled with boxes. In one of the bedrooms, Peggy Abram, 84, watched television.

Both Rosemary and John Abrams grew up in Hayti, Durham’s historically African-American area.

Rosemary’s father worked for the WL Robinson Tobacco Company and walked to work.

They had to move from Bacon Street, she said, when urban renewal came in the 1960s and the Durham Freeway, then called the East-West Expressway, was built through Hayti. Her family moved to a new house.

For John Abram, it was a move into public housing.

You either went to Fayetteville Street, McDougald Terrace or Cornwallis Road projects, he said. His family went to McDougald.

As a kid, he remembers his parents talking about the move.

“I knew we were being forced to do something we didn’t want to do,” John Abram said.

“Hayti was all right. It was like our own city. [Urban renewal] bulldozers just tore up everything. They wanted to get these black people out of the community.”

The property

For the past decade, Durham leaders have worked to revitalize downtown, bringing development and residents.

It worked, with 10,000 people now moving here every year. City Manager Tom Bonfield this week said the city is growing so fast that it is bringing in more property and sales tax money than predicted. City taxes won’t go up next year.

But the other side of that falls on the people who already live here and can’t afford to keep up with the changes.

According to Durham County property records, the land and building where the Abrams live was appraised at $314,000 in 2016.

Another apartment for rent from 3 Points Properties on Morehead Avenue touts the “incredible location” in a “really cute neighborhood,” and calls it “modern and timeless luxury living.”

“It’s frustrating," Rosemary Abram said. "You’ve been put out of your apartment, and where are you going to put your furniture? On the curb?”

As she reread the letter from the landlord, she read aloud: “‘We value you as a resident.’”

"That’s the biggest lie I ever heard,” she said.

“This gentrification in the city of Durham, this is ruining people’s lives. It’s taking people’s homes away from them,” she said. “Nobody’s fighting it because they don’t think they have any ammunition.”

A few days later, Abram got the eviction notice. As visitors knocked on her door, a maintenance truck with ladders on top circled the block twice, stopping in front of her building.

The eviction notice didn’t call for rent. It called for possession of the apartment.

John’s mother, Peggy, died May 5 in her sleep.

Why this is happening

Satana Deberry, executive director of the N.C. Housing Coalition and who just won the Democratic primary for Durham County district attorney, said “gentrification” is a loaded term.

“Once you say it, your conversation is over. Like art, you think you know it when you see it,” Deberry said.

But housing is a complicated issue of finance, equity and policy, she continued. “Nobody has solved it," she said. "But it is happening everywhere.”

“When investment comes to a neighborhood, the people who reap the benefit are those who own,” said Samuel Gunter, director of policy for the coalition.

“[Renters] don’t have control over where they’re living,” Deberry said.

Karen Lado, assistant director of the city’s Department of Community Development, said society is biased in favor of homeowners. She spoke at a recent UNC School of Government student presentation on housing issues, noting that half of Durham residents are renters.

“Can we change how we value renters in our neighborhood?” she said.

A WomenNC project by UNC-Chapel Hill fellows studied gendered impacts of gentrification in Durham. It found women of color, like Abram, are the most vulnerable to rent increases from gentrification in Durham.

The building where the Abrams live was built in 1961. The letter telling them they need to move was because of planned renovations.

Renovations — replacing a roof or HVAC unit, for example — come with rental property, said Jacob Rogers, chief operating officer of the Triangle Community Coalition, which advocates for property owners.

"If we look at when the majority of multifamily [units were] built, there have been these spurts," he said. "We’re in a multifamily growth spurt because just the demand is high for multi-family and rental units in general."

"In the life cycle of these properties, it’s time to do these upfittings, and so that’s what we’re seeing now," he continued. "And also with market rent, the supply and demand issue."

Rogers said it’s unfortunate when residents are displaced but it’s a property rights issue as well.

"The owners own the property," he said. "I don’t think you can fault people for selling these properties because they’re lifetime investments … If somebody buys it and wants to do something different with it, I don’t think its a valid argument [to say] that they can’t do it."

Rogers said that renters on leases only have the right to the space for the length of their lease. Renters can walk away, he said.

Going to court

The Abrams’ eviction case was heard in small claims court on May 21 at the Durham County Courthouse. The 3 Points Properties property manager, Debora Sandoval, gave the magistrate the paperwork showing a monthly lease.

Rosemary Abram said that 30 days wasn’t enough time to save up to move and find a new place. They are senior citizens on a fixed income, she told the magistrate. Plus, her mother-in-law had just died. They tried to pay rent in May but were refused because the property owners want their apartment, not their money.

Abram told Magistrate Aminah Thompson that what’s happening to them is gentrification.

"First of all, I’m sorry to hear about your mother," Thompson told John Abram, seated next to his wife. "Unfortunately, what I have in front of me is a month-to-month lease, which requires 30 days notice to move out."

Rosemary Abram said they needed more time.

"Unfortunately I cannot give you that much time," Thompson said. "I can give you 10 days. Unfortunately when you have a month-to-month lease, they can give you a reason or no reason at all [not to renew]."

Thompson told the Abrams they could appeal her decision to district court. They have until May 31 to leave their home or file the appeal.

After the case, Sandoval declined to comment, citing corporate policy.

Thompson said in an interview that there are a variety of situations that bring people to court because of an eviction filing.

"We see these situations daily. But this is the situation in Durham and across the country," Thompson said.

There are 900 eviction filings in Durham every month. The Durham Eviction Diversion Program started last fall as a pilot program by the Duke Law School Civil Justice Clinic and Legal Aid of North Carolina. Program leaders have asked for city and county funding for the coming fiscal year. Both the City Council and county commissioners are ironing out the details in the next few weeks as they finalize their budgets.

Duke law professor Charles Holton said they are seeing 40 to 50 eviction diversion referrals a month. "Compared with 900 new cases, there’s a big gap there," he said. The program tries to work with both landlords and tenants to avoid going to court in the first place.

Peter Gilbert of Legal Aid told council members and commissioners this month that evictions and the number of new people moving to Durham every day are not unrelated.

"It’s clear that keeping people in place is the most cost effective way of fighting gentrification," Gilbert said. Durham’s rate of eviction filings is the highest in North Carolina’s 10 largest counties, according to the diversion program.

Thompson, the magistrate, said a lot of people don’t show up for court, and those who do don’t articulate their situation like the Abrams did.

The couple left the courthouse without filing the appeal. But Rosemary Abram wants to file.

"I’m not filing for myself. I’m doing it for the people gentrified before me," she said. "I’m doing it for my neighbors."

The Life I Live.

As of today December 11th, 2017 will start the writing about my life and my struggles. This would just be a small window into my life so like every good book I will give you a backstory and what lead up to where I am now.

It was December of 2014, I was 18 and was living with my parents and two younger siblings in the NorthEast side of El Paso,TX still living as if i was still 15yo cause first thing i did when i woke up was turn on my Xbox 360 before walking into the kitchen and grab myself cup of coffee and spend hours of my day playing xbox as a way to make some friends who enjoy playing the same games as i do and i always found some way to make new friends and loved the different views and opinions of  C.O.D Public Lobbies once i filtered through the hatred that took up a large majoraty of the game i met a few Great Friends that i am still close friends with to this day some of which i met when i was 16yo. One day i was talking to my Aunt and cousins whom i was talking to frequently over the phone and some how the idea of me spending the summer there was brought up. i cant remember who it was that brought it up. One afternoon I was offered to spend the summer with my cousins in Artesia,NM. It was the first week of January when i heard that my Cousin whom i was the same age me being a few months younger got his own place and was living with his Girlfriend. Early in the morning before sunrise my mom, brother, Sister and I began the long Three-hour drive through the Guadalupe mountains and small towns that were scattered along the way. We finally arrived in Artesia that morning and i met my Cousins girlfriend and it was a little awkward since i hadn't seen my cousin in person since i was a very young child but that feeling dissapeared within the week. I lived with them for the first month of January and i had a really good time they eventually left that house and we moved in with my aunt and my younger cousin where i would stay for another two years. That Febuary i got a call from my mom telling me that the landlord in el paso had evicted them and had nowhere to go as he was illegally giving them only 3 weeks to leave. My mom and Aunt started talking and found a way to let them stay with her. I started working at walmart in the last week of febuaray starting out as a Unloader spending 3 months unloading trucks sorting and pulling pallets out to the sales floor. I quit after the 3 months due to a visiting Assistant manager giving me a ridiculously hard time and gave out Coachings (the equivalent of being sent to principal's office in school) like candy on Halloween and not wanting to take it anymore as I felt it was taking an emotional toll on me. A few weeks after quitting I got a call back from another ASM who offer me a position in the Sporting Goods department as a sales associate. I worked in that position until February of 2016, when I left because of ongoing family drama between my mom and my aunt and I was hearing it both at home and at work since everyone worked at Walmart at one point in time. I eventually grew tired of it and wound up quitting my job thinking I could find a job somewhere else with a drama-free workplace, we lived together but there were conflict and rumors spread of cheating that eventually took a toll on my mom’s marriage and caused them to divorce with my stepdad leaving to Texas. With me being unable to find a job and walmart not wanting to hire me i was not much help financialy so i tried to help the best i could being there to listen to problems and attempted to lighten the mood as much as I could but not being able to give the kind of financial help we needed we eventually went to live with my mom’s boyfriend only to be kicked out and with nobody else to fall back on we called my aunt and she helped use get our things from his front yard and back into her place at 3am without hesitation cause what family is for if not forgetting grudges even for a few days to help you out. We lived back at my aunts with the same drama and arguments to bubble back to the surface and caused everybody lives to become uncomfortable and avoided each other being afraid to say something that would start more conflict. Jump Foward to June 2017, My oldest cousin, her boyfriend and I moved into a small 3 bedroom rental house in Loco Hills, NM Where I really tried to push myself to get a job desperately applying to places that would hire someone who only has 1yr of retail experience and no drivers license or vehicle and has to rely on others for transportation. Me not having a job i basically stayed home playing Maid where i feed the 7 dogs that were here and tried to keep the house clean when they got home from work, cleaning the dishes, sweeping, mopping and switching the dogs since my cousin owned a pit bull who was SO sweet and loving as long as you were not another dog that wasn’t her boyfriends Blue heeler. So every day I would wake up early in the morning to put the five dogs that spent the night inside outside and the two that were outside they would go inside for the day and I would switch them again the same night to make sure everyone got relatively the same amount of time outside. I found it very hard to ask for things as I wasnt doing much in to help pay for bills and each passing week I felt more and more down about myself and where I was in my life as a 20-year-old who is back in the same place in life he was when he was 14, jobless, and being an financial leech to who ever is around him cause he cant get a job and because of this it is a part of the reason my cousin and her Boyfriend coudn’t afford to keep their car and pay the rent and bills of the house and were forced to move back in with my aunts in order to keep their car. Me, however, I am still in loco hills currently By myslef untill later this week where my mom and her BF are moving from hagerman,NM to loco hills to live in a place where they can have their dogs since I was hesitant to move back in with my aunt with all the people who live there it would be crowded (8 people in a 4 bedroom house) so to avoid any more uncessary drama I stayed here and asked my mom if she would like to rent this place to avoid possibly losing our dogs.So here i am laying in bed drinking coffee with my dog sleeping on my shoulder hoping my life will move on as I am applying to places every day but it is emotionally draining filling out applications and calling places only to be given an endless list of excuses or just flat out denied the position for not having a drivers license or a personal vehicle. Short Circuit: A roundup of recent federal court decisions

Politically powerful car dealerships have given Tesla a rough run of late, winning battles in courthouses and state legislatures to prevent Tesla from selling its cars directly to the public. IJ Communications Associate Nick Sibilla has the story in the New York Times.

Allegation: Five men are killed in Yemen by Hellfire missiles fired by an American drone; three of the men were the targets, two were collateral damage. Can the families of the latter obtain a ruling that the killings were unlawful? D.C. Circuit: This is a political question we cannot resolve. Concurrence: “Our democracy is broken.”

Homeland Security employee hands out security clearances, then transfers to Department of Defense. DHS finds some clearances were granted in error and tells DOD, which fires the employee. D.C. Circuit: No, DHS did not violate the employee’s privacy rights. It would be strange if an employee could avoid the consequences of a mistake by hightailing it to another agency.

Allegation: Passenger in stolen car makes a break for it on foot, is struck by a Bridgeport, Conn., police cruiser. He continues to flee but is Tased by three officers and winds up paralyzed. Second Circuit: No qualified immunity for two officers.

Scott Township, Pa., ordinance requires all cemeteries to be open to the public during the day and authorizes officials to enter any property sans warrant to determine if it contains a cemetery. A property owner objects, says the ordinance authorizes unconstitutional searches and unconstitutionally takes property. Third Circuit: While we encourage the Township to give up its inspection provision, the property owner doesn’t have standing to get a ruling on any of her claims.

Public defender is fired after he tells judges, lawyers, and politicians he was demoted — reassigned from the trial team to the juvenile court unit — because he refused to railroad clients into plea agreements. Third Circuit: The lawyer’s rumor-mongering impugned the integrity of the public defender’s unit and threatened to undercut staff morale, so his firing did not violate the First Amendment.

Bucks County, Pa., officials put database online identifying people detained or incarcerated in county jail as far back as 1938. Plaintiff: And my decades-old, expunged arrest record is publicly available (including on websites that post mugshots and charge a fee to take them down), bringing shame upon my family. Third Circuit: He may pursue a class action against county officials.

Ours is a tolerant legal system, says the Third Circuit. But three Orthodox Jewish rabbis who planned to kidnap and torture a (fictitious) Orthodox husband until he granted a divorce to his wife (an undercover agent) cannot have their convictions overturned on religious-freedom grounds.

A recent North Carolina law allows magistrates who oppose same-sex marriage to not perform them. If, as in one county, every magistrate recuses, the state pays to bring in a willing out-of-county magistrate. Plaintiffs: Which is an unconstitutional expenditure of public funds in aid of religion. Fourth Circuit: No one has been prevented from getting married. Plaintiffs don’t have standing to sue.

Hale County, Tex., jail officer sexually abuses detainee, resigns. Six months later, another officer rapes another detainee. Can she sue jail officials for failing to train and supervise their employees? Fifth Circuit: No. After the first rape, they put up a poster and told officers not to assault detainees, which was sufficient to get them qualified immunity.

Ohio men convicted of unspeakably horrible crimes, sentenced to execution. Ohio’s Execution Protocol calls for a three-drug cocktail with the infamous midazolam as the anesthetic. En banc Sixth Circuit (over a dissent): Which does not violate the Eighth Amendment’s ban on cruel and unusual punishment.

In Indiana, beer wholesalers can get a license to sell wine, and wine wholesalers can get a license to sell liquor, but nobody can get a license to sell both beer and liquor. The history is clear that this system was designed to promote political patronage. Unconstitutional? The history is irrelevant, says the Seventh Circuit, because it is imaginable that the system raises prices and therefore lowers consumption of alcohol.

Allegation: Displeased with the way a septic tank installer installed a septic tank (at the installer’s mother’s property), Brown County, Ind., health officer revokes the installer’s license — apparently for violations of the county’s secret septic-tank ordinance. Seventh Circuit: Could be the installer’s procedural due process rights were violated.

Minneapolis landlords: Inspectors ordered us to fix up our properties, which we rent to low-income families. But the alleged code violations are trumped-up; the remediation orders are vague; and officials won’t clarify them or let us appeal. Meanwhile, far worse violations persist in the city’s public-housing units. Eighth Circuit: All of which does not amount to a violation of the Fair Housing Act.

The NCAA bans anyone with a felony conviction from coaching at NCAA-certified youth athletic tournaments, a policy that disproportionately affects African Americans. Illegal racial discrimination under the Civil Rights Act? Ninth Circuit: Coach needed to show that an equally effective, less discriminatory alternative exists, which he failed to do.

In which the Ninth Circuit provides a brief illustration of why, if you’ve successfully invoked your right to an attorney, you should really, really stop talking.

Ninth Circuit: Though they appeal to public safety concerns, U.S. truckers who oppose Mexican truckers operating in the U.S. are in fact much more concerned about new competition. Separately, their suit against the feds over the issue can’t go.

In 1715, 11 Spanish galleons carrying a cargo of gold, silver, and precious jewels sank off the Florida coast in a hurricane. In 1979, a Florida company retrieved a cannon from the wreckage, kicking off litigation that continues to this day. The Eleventh Circuit has the latest installment.

Sarasota, Fla., detective applies for state court permission to track cellphones. ACLU: We’d like to see those applications, which are public records under Florida law. Feds: Ah, but the detective is also a deputized U.S. marshal, and state law cannot compel a federal officer to produce anything. Magistrate judge: That’s so, though he did sign one of the applications “Detective Smith, Sarasota PD.” Eleventh Circuit: The ACLU is entitled to some jurisdictional discovery.

Food trucks in Louisville, Ky., are prohibited from operating within 150 feet of a restaurant that sells similar food without the restaurant owner’s written permission, which is revocable at any time without notice. Unsurprisingly, large swaths of the city are no-go zones for food trucks, as getting permission from every brick-and-mortar food establishment is virtually impossible. Restaurants have even been known to add items to their menu specifically to force food trucks to move. Last month, a pair of food truck owners sued the city, arguing the 150-foot rule is an unconstitutional restriction on their right to earn an honest living. Read more here.
