What this is: Disappointing, infuriating, and a direct result of President Trump’s decision to withdraw President Obama’s previously issued guidance on transgender youth.  
What this isn’t: The end of the road. The past few months have seen a historic growth in support for transgender protections at the highest level. Thousands of individuals and organizations have signed on to the amicus briefs—major medical associations, unions representing millions of teachers, national religious leaders, elected officials at the local, state, and federal level, and ordinary citizens concerned about the rights and dignity of their fellow human beings.
This decision does not void any existing Title IX legal protections for transgender students, and similar cases regarding the fundamental rights of transgender students in schools are pending throughout the circuit courts.
The momentum on this issue is clear, and it isn’t going to be readily reversed—at least not if we all continue to work for what’s right. We remain committed to standing with Gavin, to supporting the ACLU, and ultimately toward the passage of explicit, comprehensive nondiscrimination protections for all LGBTQ Americans. It’s more important now than ever before.
Here’s how you can keep up the fight:
Show your support for equal access to public spaces by joining the #EveryoneWelcome campaign.
Support and share resources like The Trevor Project, which offer crisis intervention for trans people.
Stay informed and help educate others. An excellent place for news and educational resources is the National Center for Transgender Equality.

My blackness, transness and womanhood are political, social and historic realities. But my spirit, my soul, my humanity transcend these identity categories. As an artist I have always yearned for transcendence. Today I continue to do the spiritual work towards that transcendence. But the political, social and historic realities of the multiple identities I inhabit, continue to affect how I and people like me move through the world and access space and resources. In this context it becomes necessary, vital to celebrate ourselves and these socially constructed yet personally, politically and historically relevant identities we inhabit. Trans people are under attack perhaps now more than ever as we enjoy more visibility than we have ever known. So on this #transdayofvisibility #tdov2017 we celebrate trans folks, those who are visible, by circumstance and by choice. We celebrate and are visible for those who can not be. As we celebrate visibility we also acknowledge the limits of visibility. We acknowledge that trans folks experience violence disproportionately, that the past 3 years there have been more murders of trans folks than since we have been tracking trans homicides. We acknowledge that trans students are under attack in the United States. We #StandwithGavin Grimm and trans students like him across this nation fighting for dignity and equal access. We acknowledge that bills like HB2 and the bill masquerading as a repeal of that bill but is only more discrimination, are about erasing trans people from public life. We acknowledge that when we are excluded from being counted in census data this is another attempt to erase us. We acknowledge that when trans folks are misgendered and disavowed this is yet another attempt to stigmatize and erase us. We acknowledge that folks at the intersections of multiple identities being targeted must be lifted up. On this Trans Day of Visibility we reassert that we will not and cannot be erased. You might’ve watched the Grammys this past weekend, where Laverne Cox told you to google “Gavin Grimm.”
Many obeyed, the hashtag #StandWithGavin rising to the top of the trending lists as his story began to circulate among popular consciousness.
Gavin is a transgender high school student in the state of Virginia who has had to attend board meetings filled with adults discussing his ability to utilize the school bathroom, many of whom reportedly cheered after hearing vulgar statements made about the teenager.
When the school board voted that he would not be able to use the boys bathroom, Gavin decided to sue.
He says: “I am fighting this fight because no kid should have to think so hard about performing a basic and private function of being alive. No kid struggling to be accepted, and struggling to accept themselves, should have to simultaneously battle for the right to use the correct bathroom. That is why I have come to this point. I hope that I will be one of the last kids that has to go through something like this, and I am going to do what I can to ensure that.”
Represented by the ACLU, Gavin will be headed to the Supreme Court, where the verdict will impact transgender individuals more broadly than bathroom rights -- but to protections on the basis of sex interpreted to included gender identity. It will be the first time the Supreme Court will consider the question of whether transgender people are protected from discrimination.
Gavin’s case will extend beyond his final year of high school, but will determine if his name will be studied by students of history in the years to come, as a champion and defender of the trans community.
