Do Not Call: Efforts To Eliminate Robocalls

In a statement that exhibited his own frustration with robocalls, Federal Communications Commission (FCC) Chairman Ajit Pai said, “American consumers are sick and tired of unwanted robocalls, this consumer among them.”[1]Robocalls are an everyday occurrence for many Americans with a YouMail study showing that an estimated 47.8 billion robocalls were made within the United States during 2018, marking a 56.8% increase from 2017.[2]While some Americans ignore the calls, unsuspecting victims are at risk of giving away money or personal information, which in turn could be used in fraudulent activity. In order to deceive people into answering the calls, callers have turned to spoofing, or “deliberately [falsifying] the information transmitted to your caller ID display to disguise their identity.”[3]About 40% of scammers use the “neighbor spoofing technique” by changing the information that appears on a victim’s caller ID to match the area code of the victim thus making it seem as if the call is coming from a local, possibly known source.[4] With callers using such spoofing tactics and the number of calls made annually continuing to drastically increase, policymakers, such as Chairman Ajit Pai and the attorneys general of all 50 states and the District of Columbia, and the executives of major phone service providers have united to eliminate the robocalls that plague the phones of Americans.
On August 22, 2019, the attorneys general of all 50 states and DC and twelve telecommunications companies, including Verizon, Sprint, AT&T, and Comcast announced their voluntary agreement to eliminate robocalls.[5]The eight principles of the agreement outline the promises of the companies to grant customers free access to call-blocking and labeling tools and to work to identify the sources of illegal robocalls, so law enforcement can prosecute accordingly.[6]The second principle states that a specific step toward the ultimate elimination of robocalls is the implementation of SHAKEN/STIR technology, which is an acronym for Signature-based Handling of Asserted Information Using toKENs (SHAKEN) and the Secure Telephone Identity Revisited (STIR) standards.[7]The FCC explains this technology by stating that “calls traveling through interconnected phone networks would have their caller ID ‘signed’ as legitimate by originating carriers and validated by other carriers before reaching consumers.”[8] Such technology aims to reduce and potentially eliminate the number of illegal robocalls that are received by customers. Although there is no deadline for companies to begin complying with the agreement, Attorney General Josh Stein of North Carolina stated that “consumer statutes against unfair and deceptive practices” could be used to hold companies accountable to each of the principles.[9]
The combined efforts of state attorneys general and company executives as exemplified in this agreement represent the growing attention that the issue of robocalls is demanding. In a 97-1 decision in May, the Senate passed a bill with the intention of eliminating robocalls.[10] This was shortly followed by the House’s July approval of anti-robocall legislation by a vote of 432 to 3.[11] Although both the House and the Senate appear to be united in their dedication to reduce robocalls, the House’s legislation calls for stricter measures to be taken in order to do so. Among them include an expansion of the types of calls that can be opted out of and a requirement for telecommunication providers to make authentication technology accessible to customers at no additional charge.[12] In a letter to lawmakers, however, the Chamber of Commerce stated that the House bill would “harm businesses and consumers by impeding legitimate calls that consumers actually need or want,” further specifying them as “reminders to renew prescriptions or schedule a visit to the doctor, notifications of power outages,” etc.[13] The letter establishes a distinction between robocalls that are harmful and those that are necessary and warns of the consequences of the House’s exacting legislation.
As Congress continues to grapple with the differences in the severity of legislation between the House and the Senate, the agreement between the state attorneys general and twelve major telecommunications companies establishes new means by which Americans could find liberation from the unwanted calls.
