Meaning of Civil Law
The word "Roman law," also known as Romano-Germanic law, comes from the ancient Roman phrase "jus civile," which meant "citizens' law" and was used to refer to the laws that were formally passed in Rome.
Individuals' private or civil rights are addressed by a system of laws or regulations known as civil law, not the interests of the general public. It is usually structured and focuses largely on the interpersonal relationships between two or more citizens.
Concepts from the Corpus Juris Civilis then spread throughout Europe. Though its influence has waned, it nonetheless serves as the foundation for modern civil law systems worldwide.
Features of Civil Law
The following are the main characteristics of civil law:
Concerning citizens’ private rights
Civil Law is solely concerned with citizens’ rights. It applies to any legal relationship or obligation dispute between two or more individuals or legal entities. It is enjoyed by people who live in a state that uses legal procedures to enforce obedience. Civil law aims to accomplish two goals:
Keep citizens’ rights from being violated, and
In the event of an infringement, restore citizens’ rights.
Codification
Civil laws in India are almost usually codified legislation. Codified civil law is a body of laws consisting of numerous articles that are sufficiently flexible to be used in certain situations.
The benefits of civil law codification are as follows:
It increases the certainty of law in a legal system,
It is clear and specified, as opposed to hazy customary laws, which increases citizens’ trust in the judiciary,
It facilitates law study by allowing specific provisions to be easily and systematically remembered and applied; and
It is easily adaptable to the changing needs of the state
Civil liability
Civil liability is the legal obligation for a person to compensate another person or their property. In civil disputes, it is mandatory for a person to make reparations when they damage another citizen.
Under civil law, there is a one-to-one duty of compensation. In contrast, under criminal law, a criminal who commits a crime that affects society may be subject to a fee or penalty.
Subjective application
The extent to which civil laws are applied may vary subjectively depending on the territory, citizens, etc.
Civil law branches in India
A wide range of legal issues pertaining to the rights and obligations of citizens are covered by the enormous body of civil law. Several prominent branches of civil law exist, some of which are listed here:
Contract Law
Contract law is a branch of civil law that governs, enforces, and interprets agreements involving the exchange of goods, services, property, or money. It confers rights and obligations on the contracting parties as well as remedies on the damaged party. Furthermore, the contract law describes how to pursue legal remedies.
Section 2(h) of the Indian Contracts Act, 1872, defines a contract as "an agreement enforceable by law" and governs contract law in India. The Indian Contract Act of 1872 created numerous contract kinds, such as agency, indemnity, and bailment. It also indicates if a contract is valid, voidable, or voidable.
Property law
Property law is the branch of civil law that deals with citizens' property, controlling their rights to use or transfer it as well as their restrictions when utilising other people's property.
Personal property comprises items such as vehicles, furniture, stocks, and other transportable and tangible (or intangible) objects, whereas real property refers to immovables such as land, buildings, and other immovables.
The Transfer of Property Act of 1882, the Indian Contract Act of 1872, the Indian Easement Act of 1882, and other acts control property law in India.
Family law
The interactions and ties among members of a particular family are governed by family law. It lays down the responsibilities and rights of family members in relation to things like maintenance, adoption, marriage, and divorce.
Family law in India is governed by a number of statutes, including the Hindu Marriage Act of 1955, the Indian Christian Marriage Act of 1872, the Dissolution of Muslim Marriages Act of 1939, the Muslim Women (Protection of Rights on Divorce) Act of 2019, and others.
Tort law
A tort is a civil wrong committed by someone or something against another that causes physical harm or property damage. Civil tort law is usually uncodified and permits the victim to sue the offending party for damages. Defamation, negligence, and trespassing are a few examples of torts.
Cases handled under Civil Law
In general, there are four types of civil law cases:
Tort claims
A tort is a civil wrong committed by one person or entity against another that causes him bodily harm or property damage. Tort claims are classified as follows:
Negligence: Negligently causing harm or damage;
Intentional: Intentionally causing harm or damage.
Strict liability: Causing injury or damage due to failure to keep something the wrongdoer possesses safe (or preventing it from escaping).
Tort claims include the following:
Professional negligence,
Trespass,
Animal attacks (e.g. dog bites),
Defamation, etc.
Contractual claims
Contractual claims arise when one or more parties fail to fulfil their contractual obligations. Examples of contractual breaches include:
Disputes over the sale of property,
Sale of a defective product,
Non-payment of money,
Violation of contractual conditions, etc.
Equitable claims
Injunction suits are another name for equitable claims. The goal of these cases is to prevent someone (a person or a company) from doing anything, not to get rewarded. If there are equitable claims, the court has the authority to direct the wrongdoer to:
Stop the action,
Change the course of action, etc.
Class action claims
A class action claim is, as its name suggests, a lawsuit brought by a number of harmed parties. Usually, companies are the target of these kinds of lawsuits. A class action lawsuit could be filed, for instance, if:
A company sells hazardous products
Someone defrauds a group of people.
How do I know if I need a civil lawyer?
Get legal advice from civil litigation lawyers prior to filing a lawsuit. They are aware of which cases have the best probability of success and are educated about the procedures and supporting documentation. You can get counsel from a litigation advocate regarding whether, in some cases, alternative dispute resolution is a preferable option.
If you've been fighting a losing battle to settle a dispute, a civil lawyer could be able to help. A civil lawyer works to help you get justice while putting pressure on the other side to admit guilt.
Why hire a civil lawyer?
Not all civil law firms or solicitors concentrate only on redressing wrongs throughout the nation. They also work to atone for wrongs done to specific people. A civil attorney typically represents parties in cases relating:
Divorce
Trusts
Wills
Contracts
Mortgages
Titles
Wills
Personal injury
Workers Compensation
They also handle corporate, personal injury, and civil rights cases. In several other instances, solicitors are on hand to provide guidance to those handling intricate processes.
How can a lawyer help?
Civil lawyers are necessary in civil cases. Their primary responsibility is to gather the evidence needed to present your side of the story to the other side and, if needed, the judge. Because of their experience dealing with these issues, they find evidence that you might not even look at.
In addition to proving what occurred, they also want to know why it occurred in order to prevent it from happening in the future.
While gathering evidence, a civil lawyer hears your side of the story and considers how you would like to come across to the opposition. In this regard, district or criminal advocates are less interested with serving your interests and more focused on punishing misconduct than are civil lawyers.
Finally, a civil lawsuit seeks justice for you rather than punishment for the other party.
Services our professional team of civil lawyers provide
Appearance before various competent authorities in all commercial and civil proceedings,
Drafting and submitting multiple documentation, such as deeds, plaints, and applications
Property-related documentation, such as sale deeds and memorandums of understanding.

Was sold fake Bawa, Souza, 9 more paintings for ₹17.9 cr, alleges exec
The India head of the US-based private equity firm TPG Capital filed a complaint with Tardeo police late on Monday night alleging that he was sold paintings by leading Indian artists worth ₹17.9 crore that turned out to be fakes. In his complaint, Bhatia named solicitor Vishwang Desai and art dealer Rajesh Rajpal, the owner of Art India International at Churchgate, as the men who duped him.
Puneet Bhatia, who recently started building his personal art collection, told police that 11 of the paintings he bought from Rajpal, including a Manjit Bawa and an FN Souza, turned out to be forgeries. In his complaint, he told police that he was introduced to Desai, managing partner in the law firm Desai and Diwanji, at a friend’s party in January of 2022. Bhatia told police that he was impressed by Desai’s knowledge about Indian art and he bought his claims of long experience in buying and selling art at face value. As their friendship cemented, Desai allegedly told Bhatia to invest in art and offered to help him source the “right” artworks. According to Bhatia’s police statement, Desai talked up Rajesh Rajpal’s credentials as an art dealer and spoke about his office at Churchgate and his art gallery at Cuffe Parade to establish Rajpal’s bona fides.
It was in the course of their many conversations about art and investment that Desai first told him about a Manjit Bawa painting titled Krishna with Cows which was up for sale for ₹ 6.75 crore. “I was told that the current owner of the painting was a retired IAS officer called Subrata Banerjee who lived in Bhopal,” said Bhatia in his police complaint. Desai also told him about a painting by FN Souza which was available for ₹1.75 crore, and which was allegedly owned by the head of an erstwhile princely state in Madhya Pradesh.
In early February, Bhatia was told that Banerjee was about to leave for London and the deal needed to be made before that. “I was told that Rajpal was in Bhopal to bring both the Bawa and the Souza to Mumbai.” Bhatia, who was then based in Gurugram, asked Rajpal to courier the two paintings to his bungalow instead.
Within days of him receiving the art consignment, Desai provided him with the requisite certificates of authenticity, self-attested and notarised certificates of provenance from the previous owners, and the invoices from Art India International.
Happy with his purchase, Bhatia bought nine more paintings from Rajpal, paying a total of ₹17.9 crore, according to his complaint. The paintings, he said, were showcased on the walls of his home when some friends raised suspicions about their authenticity. It was only then that Bhatia began making independent enquiries into the provenance and authenticity of the artworks. “I also reached out to the said bureaucrat Mr Banerjee through my own sources but he denied ever owning the Manjeet Bawa painting or having sold any other painting by the artist,” Bhatia told police.
He next approached a Mumbaibased company, Structured Systems, which specialises in forensic examination of handwriting and authenticating of artworks. They assessed the signatures of the artists appearing at the bottom of the paintings and informed Bhatia that they were forged. Based on this report from Structured Systems, Bhatia confronted the Desai and Rajpal, and demanded they return his money. He told police that while Desai first sought time, he later began evading his calls.
Solicitor denies role
When contacted, Desai denied his role in the dubious sale and told HT that he merely introduced Bhatia to the art dealer, and that they made the deal with the respective owner of the Bawa and the Souza. “I am not the person who sold the paintings to Bhatia,” he said, before going on to add that as an art connoisseur he himself had bought several artworks from Rajpal, and had in fact bought some paintings from the same lot as Bhatia.
As far as he knew, he said, the owners of the paintings had given Bhatia sworn affidavits and Rajpal too had provided him with certificates of authenticity. He also said, defending Rajpal, who is not a well-known name in Mumbai’s art circuit, that on Bhatia’s request, the art dealer had taken four of the painting sold to Bhatia and sold them to other buyers. The remaining seven artworks however could not be sold because the investment banker has refused to issue consent notes.
A representative from Structured Systems told HT they get frequent requests for authentication of artworks, and that most requests come to them through lawyers and independent agencies. Refusing to comment on Bhatia’s specific complaint, a representative, speaking on condition of anonymity, said: “We can only say that this kind cheating with art works happens far more often than most people realise.”
An officer with Tardeo police said the two accused had been booked under sections 120-B (criminal conspiracy), 406 (criminal breach of trust), 420 (cheating and dishonesty), 467 (forgery of a valuable security, will or authority to transfer any valuable security), 468 (using forged documents for the purpose of cheating) and 471 (using forged documents as genuine) of the Indian Penal Code based on Bhatia’s complaint.
Both Rajpal and Bhatia remained unavailable for comment despite several efforts to reach out to them.
PUNEET BHATIA TOLD POLICE THAT 11 OF THE PAINTINGS HE BOUGHT, WHICH INCLUDED A MANJIT BAWA AND AN F.N. SOUZA, WERE FORGERIES

Scandal Unfolds: Rohan Jaitley, DDCA President, Faces Serious Allegations Amidst Factional Strife
In a shocking turn of events, Rohan Jaitley, the president of the Delhi and District Cricket Association (DDCA) and son of the late Union Minister Arun Jaitley, finds himself ensnared in a web of serious allegations, including charges of sexual abuse and financial impropriety. The scandal, rocking the DDCA, has further exposed the deep divisions within the association.
Tumblr media
The controversy erupted on February 22 when a woman, known to Jaitley, filed a complaint with top officials of the Board of Control for Cricket in India (BCCI). In her detailed complaint, she accused the DDCA chief of exploiting his official position to solicit both sexual and financial favors. A second complaint has now surfaced, with a Mumbai-based model leveling grave allegations of sexual abuse against Jaitley. The latter complaint, submitted to the BCCI's POSH Committee (Protection of Women from Sexual Harassment) on July 19, adds another layer of complexity to the already turbulent situation.
Notably, neither of the complainants has taken the matter to the police thus far. Despite the gravity of the accusations, sources close to Jaitley dismiss them as falsehoods orchestrated by DDCA members who faced defeat in recent cricket body elections. According to these sources, the absence of legal action indicates the baselessness of the charges.
However, the allegations don't end there. Former Additional Solicitor General Vikas Singh has sent a scathing email to Jaitley, accusing him of attempting to manipulate competition and favor a specific architectural firm for major contractual jobs within the DDCA, particularly those related to the World Cup matches scheduled to be held in Delhi this year.
The DDCA, already a bitterly divided entity, is witnessing a power struggle with celebrity cricketers and prominent politicians vying for control. As Delhi braces itself for the upcoming ICC Cricket World Cup in October-November, the drama within the DDCA is expected to intensify.
In another political arena, the Pawar family and the Nationalist Congress Party (NCP) are grappling with internal strife. The splinter group, led by Ajit Pawar and Praful Patel, is in talks with BJP leadership about potential collaboration. Despite the discussions, Ajit and Praful are reportedly attempting to convince Sharad Pawar to switch allegiance from Maharashtra Vikas Aghadi to the National Democratic Alliance (NDA).
Meetings between the breakaway leaders and Sharad Pawar have taken place, where they conveyed the BJP's offer, which includes induction into the Union Cabinet with a significant portfolio and a respectable share of seats in upcoming elections. However, post-split surveys indicate that the NCP's voter base remains largely loyal to the senior Pawar. Prime Minister Narendra Modi is said to have conceded to the demands of the NCP breakaway group but is yet to make a final offer to Sharad Pawar. The political game in Maharashtra continues as the state navigates the intricate dynamics leading up to the 2024 Lok Sabha elections.
