🙄 Jussie Smollett gets more time to file appeal, but court says 'no further extension will be granted'
By Matthew Hendrickson, Sun-Times Media Wire Tuesday, January 31, 2023
CHICAGO -- A state appeals court on Monday granted a request by Jussie Smollett's defense lawyers for a fifth (5th) extension to file their initial argument, but warned it would be the last time.
"A fifth motion for more time to file an opening brief, particularly by the defendant in a criminal matter, is rare," the three-judge panel of the First District Appellate Court wrote in its order. "Nevertheless, the court grants the motion to serve and file appellant's brief on or before March 1, 2023. After that date, no further extension will be granted."
In their motion last week for yet another extension, Smollett's attorneys said their brief was completed and, at the time, they were still waiting for a ruling on a request to file an oversized brief in the case.
The actor and singer is appealing his conviction for staging a hate crime against himself in Chicago and lying about it. His lawyers have said they needed to file 80 pages instead of the standard maximum of 50. They cited the complexity of the case and previous cases that were brought against the actor after the 2019 hoax first came to light.
Smollett was indicted that year but in a much-criticized reversal, State's Attorney Kim Foxx's office dropped all charges against Smollett in consideration of community service and his agreement to turn over the $10,000 he had posted for bond to the city of Chicago.
That led to Special Prosecutor Dan Webb being appointed to review the decision, and he announced new charges against the actor the following year.
Attorneys for the special prosecutor's office opposed the filing of an oversized brief, noting Smollett's appeal dealt only with the case that led to his 2021 conviction, not earlier cases.
In the ruling Tuesday, the judges allowed Smollett to file an oversized brief but not as large as they had requested. "Instead, Defendant-Appellant may file a brief not to exceed 20,000 words, a 33% increase in the number of words," the court ruled.
A jury convicted Smollett in December 2021 on five counts of felony disorderly conduct and he was sentenced by Judge James Linn to five months in jail. The sentencing hearing ended with the actor yelling that he was not suicidal before being led from the courtroom by sheriff's deputies.
Smollett only served six days in the Cook County Jail before he was released on his own recognizance pending appeal. He will be required to go back and serve the rest of his time if his conviction is not overturned.
His attorneys allege the charges bought by Webb amount to double jeopardy. They have also criticized rulings Linn made before and during the actor's trial.

Jussie Smollett back to work, making directorial debut after convicted for faking Chicago hate crime.
Jussie Smollett makes his directorial debut in the movie "B-Boy Blues," which airs in a few weeks on BET+.

Take Wyatt Earp as a biopic and it is a superb and fair film. Compare it to Tombstone which was more of a Western and it’s lacking the flair. However, it ends abruptly, and it is miscast. Cosner (and i am a fan) doesn’t really make a good Earp. Dennis Quaid who I am also a fan of, doesn’t make a good Doc. This was 1994, in the 80s I might have a dif...

Jensen Ackles, Katheryn Winnick, Kylie Bunbury and Reba McEntire entire for ET Online
"When [creator] Elwood [Reid] was telling me his idea of me being a part of the show, I was like, 'Oh my gosh, I've never done anything like that. I've never been a villain,'" McEntire said from the Albuquerque, New Mexico, set, alongside co-stars Kylie Bunbury, Katheryn Winnick and new series regular Jensen Ackles. "So I was like, 'Yeah I'm in it, I wanna be a part of it,' and the experience has been absolutely 100 percent marvelous."
In season 3, private detective Cassie Dewell (Bunbury), undersheriff Jenny Hoyt (Winnick) and newly appointed sheriff Beau Arlen (Ackles, who was introduced in the season 2 finale) maintain order in Helena, Montana, with their unparalleled investigative skills. But the trio faces their most formidable mystery yet, with McEntire's Sunny at the center of it, in which no camper can be trusted and where danger lurks around every jagged rock and gnarled tree
"The way it was presented to me, I am the type that will go, 'Would you like to learn how to...? Would you like to...?' and then I'll cut your carotid artery," McEntire quipped. "She's bad to the bone but and, you know, sweet."
Winnick expressed enthusiasm over having McEntire join the Big Sky family.
"We are so lucky to have her," she praised. "We really are. It just feels to me like it's a whole new season this year. It feels to me that it's a different vibe on set. Obviously the scripts are, we've changed the format this year, which we're very excited. We're doing an open-close per week for the cases but also Reba's storyline [is] an overarching [one]. There's a huge arch with another storyline as well and we just got some great guest stars that are joining and supporting Reba... and a lot of surprises."
And she isn't the only significant addition to the ensemble. Ackles, who spent 15 years fighting demons on Supernatural, teams up with Bunbury and Winnick in a more regular capacity this year as the town's sheriff.
"They just told me Reba was gonna be here," he joked when asked how it feels to be lording over the town as sheriff. "I said yes, 'What do I have to do? Who do I have to kill?' And then they said, 'Don't worry about that, Reba's got that handled.'"
While he wouldn't divulge too much, Ackles says Beau is part of "the good guys." But with a show like Big Sky, "anything can happen."
"It is a true mystery show and that's one of the appealing factors to it is you don't know who's on what side of the team and you don't know what's going to happen. You don't know where it's going to go. The storylines can cross, they can stay separate, there's a lot that can happen," Ackles teased, leaving the door open for possible romance with Beau and one of the show's leading ladies. "Elwood and his crack team of writers have really set a great stage for what's about to happen."
McEntire's real-life boyfriend, Rex Linn, also joins the show this season as Sunny's husband, Buck.
"It's been a lot of fun. We've been working together since May. We shot a movie together and now we're on Big Sky together. We're having a blast play husband and wife with Cormac [played by Luke Mitchell] as our son," she shared. "We're having a blast together. We love working together and it's been a great experience."
Ackles admitted to fanboying over Linn, which he says was his most memorable day on set.
"Honestly, everybody, it was 'Reba's here! Reba's here!' and I was like, 'Reba's here,' then I was like, 'Wait, is that Rex Linn?'" he recalled. "And I bee-lined to him and just went full fanboy on him. So that was was embarrassing and memorable all at the same time."
"They definitely bring a warm, welcoming, energized, very full of life energy and I think that's necessary when you're working together with people every single day," Bunbury said of McEntire and Linn's working relationship. "So they've really set the tone for us and it's really beautiful."
"Rex has a great attitude. He wants everybody to have fun," McEntire said. "That's what he says right before they say, 'Action.' He says, 'Have fun.'"
As for the season as a whole, Winnick said "it's a whole new level" of chaos.
"Epic. Definitely the stunts, the action, the drama, the character-driven material, the chemistry between the actors every week it's a completely new surprise in a lot of ways because of the open and close in each episode," she previewed. "But also it's really interesting, it's like peeling off an onion when you discover the B plot or the second storyline, which you dive more into the characters and figure out how twisted they really are."
Big Sky premieres Wednesday, Sept. 21 at 10 p.m. ET/PT on ABC.

Roger Dale Beck, and John Arthur Ackroyd, have been convicted of aggravated murder in 1993, for raping, stabbing and shooting Kay Jean Turner, of Eugene. She was attacked on Christmas Eve 1978 while jogging in the Camp Sherman area.
Ackroyd had reported seeing Turner on the day she disappeared. He led police to her remains eight months later, saying he had stumbled across some of her clothing while he was walking his dog.
“He was trying to go for the reward money,” said District Attorney Bill Hanlon of Jefferson County. ”If he could have kept his mouth shut, this case would have gone nowhere.”
However, authorities didn’t have enough evidence to proceed, and the case remained unsolved.
Hanlon credited the Linn County sheriff’s office with helping breaking the case in 1990, when they began investigating Ackroyd again. This time he was questioned in the disappearance of his stepdaughter, Rachanda Pickle, 13, in the Santiam Canyon.
Pickle never was found. Further help in cracking the Turner case came in 1992, when new forensic tests on her remains showed that she had been shot and stabbed.
Turner’s husband, Noel Turner, said that he was grateful to the jury for convicting Beck. He credited testimony from Pam Ramirez, who was married to Beck at the time of the slaying. - Statesman Journal

Top Terrifying-But-True Horror Stories Reported in the News
Sure, a scary movie, book, or program can get your heart racing in the moment, but you can rest comfortable afterwards knowing that what you witnessed was a work of fiction. What's scarier is when the actual world becomes creepier than anything Stephen King could conjure up.
Real fear occurs all around us every day, even if it doesn't always make it into your newsfeed. Murders, disappearances, demonic possession, and devil worship aren't simply fiction from a writer's imagination; they're news headlines.
We've compiled a list of some of the most horrific and inexplicable real-world stories below.
The Axe Murder House
The Villisca Axe Murder House in Villisca, Iowa is a popular tourist destination for both ghost seekers and horror fans. The location of a brutal unsolved 1912 murder in which six children and two adults had their skulls totally smashed by an unknown perpetrator's axe was acquired in 1994, restored to its 1912 form, and made into a tourist attraction. Staying at the ancient haunted house costs $428 per night, and tourists frequently claim unusual paranormal encounters, such as images of a guy with an axe wandering the hallways or faint screams of children.
The haunting, however, took a worse turn in November of 2014. Robert Steven Laursen Jr., 37, of Rhinelander, Wisconsin, was on a routine recreational paranormal visit with friends when he experienced genuine terror. According to VICE:
His companions found him stabbed in the chest—an apparently self-inflicted wound—called 9-1-1, and Laursen was brought to a nearby hospital before being helicoptered to Creighton University Medical Center in Omaha.
According to the Montgomery County Sheriff's Office, Laursen received the self-inflicted injury about 12:45 a.m., around the time the 1912 axe murders in the home began.
Laursen was able to recuperate from his injuries, but he has never talked publicly about what happened that day. The event was unpleasant for the home's owner, Martha Linn. "It's publicity, but it's not the type of publicity you're looking for." I don't want people to assume that if they come to the Villisca Axe Murder House, something will happen that would force them to do anything like that.” Today, the home is accessible for tourist visits and overnight stays.
The Haunted Doll
When you think of haunted dolls, you often think of the eerie old Victorian-looking porcelain variety. None of which you're likely to have lying around. However, don't get too comfy with any children's toys too soon: a Disney's Frozen Elsa doll that was given as a present for Christmas 2013 in the Houston region made news earlier this year when it appeared to be haunted.
The doll recited phrases from the movie Frozen and sang “Let It Go” when a button on its necklace was pressed.
“For two years it did that in English,” mother Emily Madonia said. “In 2015, it started doing it alternating between Spanish and English. There wasn’t a button that changed these, it was just random."
The family has owned the doll for more than six years and never changed its batteries. The mother says the doll would randomly begin to speak and sing even with its switch turned off.
In December of 2019, the family decided to get rid of the scary doll. They discovered it inside a bench in their living room weeks later. “The kids said they didn't put anything there, and I believed them because they wouldn't have searched through the rubbish outside,” Madonia explained to KPRC2 Houston News.
Elsa stopped singing the English version of "Let It Go" at that moment, speaking only Spanish when pressed. The strange doll was then double-bagged and placed at the bottom of the family's rubbish, which was carried out on garbage day. They went on a trip soon after, but when they returned, Elsa had also returned and was waiting for them in their garden.
Elsa was shipped to a family friend in Minnesota, who fastened the haunting doll to the front bumper of his truck this time. According to Madonia's most recent February Facebook update on the scary doll, it does not appear to have found its way back to Houston.
A Dangerous Exorcism
Kennedy Ife, 26, of North London, began acting strangely and aggressively in August 2016 after experiencing throat pain. Before his family confined him to a bed using wire ties and severe force, he allegedly bit his father, threatened to chop off his own penis, and spoke of a python or snake inside of him.
According to the BBC:
“The family then set about attempting to ‘cure’ Kennedy through restraint and prayer over the next three days, the court was told.”
His brother, Colin Ife, told police:
“It’s clear that thing was in him, what we believed was a demon because it was not natural. It was clearly trying to kill him,” he said.
“We had to restrain him for himself. It was clear if we didn’t restrain him, he could have tried to harm people in our family.”
Kennedy Ife had been chained to his bed for three days without medical treatment when his brother contacted 911, saying that he was suffering from dehydration. He looked to be having respiratory problems and was pronounced deceased at 10:17 a.m.
According to The Independent:
While police were at the house Colin Ife allegedly carried out an “attempted resurrection” by chanting and praying for Mr. Ife.
Kennedy Ife had been chained to his bed for three days without medical treatment when his brother contacted 911, saying that he was suffering from dehydration. He looked to be having respiratory problems and was pronounced deceased at 10:17 a.m.
According to The Independent:
Kenneth Ife told jurors he ordered his sons to take shifts and use "overwhelming force" but denied that an "association with cults, occults and secret societies" played any part in the death.
After a four day jury deliberation, all seven family members were cleared of charges on March 14, 2019.
