The Supreme Court of Texas narrowly decided Friday that sovereign immunity, which largely shields government agencies from civil lawsuits, also protects the operator of the Texas electric grid.
The 5-4 opinion will likely free the nonprofit corporation from lawsuits filed by thousands of Texans for deaths, injuries and damages following the deadly 2021 winter storm, unless lawyers find another way forward.
The Electric Reliability Council of Texas, which manages the power supply for most of Texas, qualifies for immunity because it “provides an essential governmental service,” Chief Justice Nathan Hecht wrote in the majority opinion. State law intended for ERCOT to have the power of an “arm of the State government,” Hecht wrote. If anyone is going to hold ERCOT accountable for its actions, Hecht wrote, it should be state regulators or the Legislature, not the courts.
Freezing temperatures gripped the state during the 2021 winter storm, straining the power supply so much that ERCOT called for cutting power to millions of homes and businesses to prevent the grid’s collapse. More than 200 people died. Experts estimated afterward that financial losses totaled between $80 billion and $130 billion, including physical damage and missed economic opportunity.
Thousands of residents accused ERCOT, power companies and distribution companies of failing to prepare for the freezing weather.
Lawyers expect the high court’s decision will allow ERCOT to be dismissed from the litigation, although it does not shield other defendants.
Attorney Mia Lorick, who represents some of those plaintiffs, said she sees only a slim possibility that lawyers could keep claims against ERCOT alive by arguing that their cases have differences that somehow skirt the sovereign immunity finding.
Majed Nachawati, whose firm is representing other plaintiffs in the related cases said, “The Texas Supreme Court’s decision is disappointing to say the least. People lost their lives and the only recourse to the citizens of Texas is to be able to go through the judicial process, and the judicial system, to try to remedy or right the wrong that occurred in this case. And if you can’t count on our judiciary to protect its citizens, I think we’re in a lot of trouble.”
Justices Jeff Boyd and John Devine, along with two others, disagreed that ERCOT has sovereign immunity. Purely private entities are clearly not sovereign, and making them so undermines the public trust, they wrote. The justices argued that “no statute designates ERCOT as a part of the government” and that courts should not be barred from hearing claims against it.
The ruling sprang from two cases filed against ERCOT. San Antonio’s municipally owned utility, CPS Energy, alleged that ERCOT mishandled the soaring price of power during the 2021 winter storm. And private equity investors at Panda Power Funds alleged that 10 years earlier ERCOT issued reports that misled them about how much power the grid needed.
ERCOT spokespersons issued a statement saying that the organization was pleased with the decision. CPS Energy said in a statement that it was disappointed but thankful that four justices agreed with the utility as it sought relief for customers. The utility said the litigation still led to “critical discussions at the highest levels that are necessary to improve our power grid and energy market.”

TALLAHASSEE, FL — Authorities in two states are threatening Florida Gov. Ron DeSantis with criminal charges after dozens of migrants were flown from Texas to California this week and to Massachusetts in September 2022.
In California, authorities were investigating whether DeSantis was behind a flight that picked up asylum-seekers on the Texas border and flew them — apparently without their knowledge — to California's capital of Sacramento.
The development coincided with confirmation from the Bexar County Sheriff's Office in Texas that criminal charges were recommended against DeSantis in connection to an incident where 49 asylum seekers were flown from Texas to Martha's Vineyard as part of DeSantis' migrant relocation program.
In California, about 20 people aged 21 to 30 were flown by private jet to Sacramento on Monday, state Attorney General Rob Bonta said. It was the second such flight in four days.
Sacramento Mayor Darrell Steinberg and faith-based groups who have been assisting the migrants scheduled a news conference for Tuesday morning.
Meanwhile, California Gov. Gavin Newsom lashed out at DeSantis on Twitter, calling him a "small, pathetic man" and suggesting his state could pursue kidnapping charges.
"@RonDeSantis, you small, pathetic man," Newsom tweeted. "This isn't Martha's Vineyard. Kidnapping charges?"
With the tweet, Newsom included a section of the California penal code on kidnapping charges that reads, "(d) Every person who, being out of this state, abducts or takes by force or fraud any person contrary to the law of the place where that act is committed and brings, sends, or conveys that person within the limits of this state, and is afterwards found within the limits thereof, is guilty of kidnapping."
DeSantis, who is seeking the Republican nomination to run for president, has been a fierce critic of federal immigration policy under President Joe Biden and has heavily publicized Florida's role in past instances in which migrants were transported to Democratic-led states.
DeSantis and other Florida officials have remained mum, as they initially were last year when they flew 49 Venezuelan migrants to the upscale Massachusetts island of Martha's Vineyard, luring them onto private jets from a shelter in San Antonio.
In a statement to the Miami Herald this week, the Bexar County Sheriff's Office in Texas confirmed that criminal charges were recommended in connection with the Martha's Vineyard case.
The case was then passed to the Bexar County District Attorney, the Herald reported.
"The case filed includes both felony and misdemeanor charges of Unlawful Restraint," according to the statement. "At this time, the case is being reviewed by the DA's office. Once an update is available, it will be provided to the public."
The case by Texas authorities isn't the first piece of litigation levied at DeSantis regarding the flights to Martha's Vineyard.
Lawyers for Civil Rights filed the suit on behalf of about 50 Venezuelans involved in the flights, and Alianza Americas, a network of migrant-led organizations supporting immigrants in the U.S. in September 2022.
The lawsuit names DeSantis and Secretary of Florida Department of Transportation Secretary Jared Perdue, and called the flights "inhumane and morally repugnant."
The suit says the Florida officials arranged a "fraudulent and discriminatory scheme to transport nearly 50 vulnerable immigrants, including women and children, from San Antonio, Texas to Martha's Vineyard without shelter or resources in place."
According to the lawsuit, DeSantis used about $615,000 in taxpayer dollars to charter the flights to Martha's Vineyard and told the migrants they would arrive in either Washington, D.C., or Boston. The suit also says the migrants were lured into planes with the promise of benefits, including $10 McDonald's gift cards.

The Curse of Griffith Park
Until 1896, when Griffith Jenkins Griffith bequeathed 3,000 acres of what is now Hollywood Hills to the city of Los Angles for us as a public park, the area was a trail of blood and bad luck for anyone who owned it. 
In 1863, most of the land was owned by a wealthy rancher named Don Antonio Feliz. Feliz’s spread covered almost 8,000 acres. Don Antonio never married and lived on his huge tracts of land with his niece Dona Petranilla and a maid named Soledad. When Feliz lay delirious with smallpox that year, Dona Petranilla was sent away so that she wouldn’t contract the fatal disease. 
Don Feliz was soon visited by a neighbor, Don Antonio Colonel, and his lawyer, Don Innocante, to discuss Don Feliz’s will. (No, they weren’t all named Don; it was a title people used when they wanted other people to think they were important, or in rare cases, if they actually were.) Don Feliz was said to agree to the final draft of the will, but another version of events claimed he was nodding in agreement because someone had fastened a stick to the back of the delirious or unconscious head. To no one’s surprise, Don Colonel got the ranch, Soledad made out with a few sticks of furniture, and Dona Petranilla got squat. The fact that she was also blind probably made her a trifle bitter. 
The seventeen-year-old Dona Petranilla reportedly swore out a curse on Don Colonel; it was melodramatic and lengthy, as translated by nineteenth-century California historian Horace Bell: “Your falsity shall be your ruin! The substance of the Feliz family shall be your curse! The lawyer that assisted you in your infamy, and the judge shell fall beneath the same curse! The one shall die an untimely death, the other in blood and violence!” She rants on for a while longer, then says, “Blight shall fall upon the face of this terrestrial paradise; the cattle shall no longer fatten but sicken on its pastures, the fields shall not longer respond to the toil of the tiller, the grand oaks shall wither and die! The wrath of heaven and the vengeance of hell shall fall upon this place!” 
Dona Petranilla might have been blind, but she saw the future pretty well. Don Colonel outlasted many in his family, watching while they died of disease or misfortune. When he died, his widow remarried, only to have her new husband try to divorce her and take her property. The litigation lawyers took almost all that was left. 
The next owner, Leon “Lucky” Baldwin, tried to run a dairy on the star-crossed land, but the business failed, and he was swallowed up by mortgage companies after there occurred a series of natural disasters that were eerily close to Dona Petranilla’s curse. Not-so-Lucky Baldwin sold the land to Griffith J. Griffith, a Welshman who made a killing in gold mine speculation. He donated the park to Los Angles. A few years later Griffith was convicted trying to kill his wife and spent a few years in San Quentin. 
The legend of the curse has long given rise to ghost stories in the park that bears Griffith’s name. Ranch hands working the property in the late nineteenth century said that they had seen Don Colonel howling down the valley toward what are now the municipal golf course and the L.A. zoo. The figure is reported to make appearances at Bee Rock, a granite towering over the east side of the park. 
The curse seemed to abate once the city of Los Angles took possession of the land, and perhaps the only dangers that remain for the weekend hikers are things like bodies dumped onto the fire road, mountain lions, and six-foot rattlesnakes. The park is closed at night, so if the ghosts who stalk the old trails of Griffith Park put in appearances only after sunset, they should walk in relative peace until the land inevitably changes hands again.

Abbott visits Fort Worth to swear in slate of new Texas business court judges

With hands raised and in black robes, Gov. Greg Abbott swore in 10 judges to the newly created statewide business courts at a ceremony at Texas A&M University School of Law in downtown Fort Worth.
The new courts, which were made possible by the passage of House Bill 19 during the 2023 legislative session, will handle certain high-value business disputes of at least $5 million in some cases and more than $10 million in others.

“It’s about time,” Abbott said, speaking to a law school lecture hall filled with judges, attorneys and lawmakers. “We are speeding up the process — the decision-making process — in business cases. (We’re) doing that by reducing the caseload in the preexisting courts (that) will also help them decide their cases a whole lot faster.”
On Sept. 1, five court divisions opened in Fort Worth, Dallas, Austin, San Antonio and Houston, according to the state court’s website.
Abbott this summer appointed two judges to each division for two-year terms.
The new courts give the governor the opportunity to appoint judges in the state for the first time.
The fee to file a case is $2,500.
As of Sept. 19, there were eight cases filed in the state’s business courts, according to a Bloomberg Law search.
The 8th business court division in Fort Worth is based inside the Texas A&M School of Law building in downtown, where the courtrooms and judges’ chambers will reside.
“This provides just one more reason for out-of-state companies to move to the state of Texas, but (the business courts are) also going to provide a way for (A&M Law) students to interact with these courts, and with the fact that you’re connected with the business community,” said Texas A&M University System Chancellor John Sharp.

Advocates for the formation of business courts said the new courts will reduce backlog and allow judges who are familiar with complex legal matters to oversee cases.
Andrew Zeve, a partner at White & Case, a global law firm that specializes in corporate transactions and litigation with offices in Houston, co-wrote an explainer article on the Texas business courts.
He says that a lot of state court judges were already very capable of handling legal matters before, but the new business courts could help.
“It certainly doesn’t hurt knowing that you’re going to go to a judge that has a background in the specific type of case you’re working on,” said Zeve, a trial lawyer who specializes in complex commercial disputes and intellectual property litigation. “I do perceive that these judges will help alleviate some congestion on the dockets in the busier cities.”
Zeve also expects that judges in these courts will more often issue written opinions — currently a rare occasion in state district courts.
“That’ll help clarify Texas law on issues and complex litigation, because having more jurisprudence out there can only help,” said Zeve.

Abbott appointed two business attorneys with decades of litigation experience to the Fort Worth division:
Jerry Bullard of Colleyville
and Brian Stagner of Fort Worth.
Bullard, who has three decades of experience in state and federal litigation in both trial and appellate law, is a shareholder and attorney with Adams, Lynch and Loftin, P.C. in Grapevine.
He is a gubernatorial appointee on the Texas Juvenile Justice Department Board and a member of the Texas Supreme Court Advisory Committee. He received his law degree from the University of Texas at Austin School of Law.
Bullard has donated $750 to Abbott since 2014, according to the political donation tracker OpenSecrets.
Stagner, a former partner at Kelly, Hart and Hallman and an adjunct professor in business law at Texas Christian University, has over two decades of experience in state and federal complex business litigation.
He has experience with consumer class action, corporate governance, unfair business practices and other areas.
He has represented major business clients in manufacturing and technology, obtaining multi-million dollar verdicts and serving as co-counsel on a trademark case that won around $56 million.
He received his law degree from Texas Tech University School of Law.
“This partnership of the Texas business court and Texas A&M is just the start across multiple industry sectors from hypersonics and urban agriculture to gaming and the treatment of rare diseases,” said Robert Ahdieh, dean of the Texas A&M University School of Law and chief operating officer of Texas A&M Fort Worth.

He says that bringing the business courts to the city is just one aspect of the collaborations that Texas A&M Fort Worth will bring. Once complete, the expanded downtown campus will have a “tremendous impact” in Fort Worth, North Texas and beyond, Ahdieh said.
