Ask Blog Intro

Hey, everyone! This is Fern/Lynn Canigula. I am the author of the RTC fic "Are We Ever Going Back?" I mentioned the possibility of an ask blog, and a lot of people liked it. My schedule is finally allowing me to work on that. This blog is just a fun way to get to know my depictions of the choir a little better, interact with them, and learn about my headcanons that I'm applying which may not make it into final drafts. A few things first just to clarify: 1. Anything said on the ask blog will be true to the story. 2. In the story itself, the choir does not have this blog. It's kind of a parallel AU if that makes sense. 3. I cannot draw, so answers will be written. Maybe I'll use Gacha Club idk yet. 4. You can also ask me things as the author. Please do. I love love love to yap. 5. No NSFW asks. These characters are teenagers. However, I am comfortable with having them make suggestive or inappropriate jokes because, well, they're teenagers. 6. I will tag any answers with "awegb (name)" or "awegb (name) answers" because I don't want to flood the regular tags if nobody knows what the characters are talking about. 7. Hate and harassment will not be tolerated. (But so far all of you are GEMS, so I probably don't have to worry.) 8. The start of this blog will take place starting after they all get out of the hospital and a lot of court stuff, so like mid January 2010. 9. Please note that this fic is mainly based around recovery from all sorts of trauma. Proceed with caution, because a lot of sensitive topics are covered here. Take care of yourselves loves <3 10. Penny Lamb is very based off of her depiction in Legoland, with some changes to fit the plot of Ride the Cyclone. Basically her backstory is the same, but she became a recluse instead of the entire JK-47 incident. 11. You can ask the choir, but also side characters, be they canon or OC. 12. i love how this implies that they’ve never been in the subway before. well, since most of them almost never left uranium, this checks.

ocean — she always advocated for public transportation (and for some reason believed it wasn’t widely used, probably because she assumed everyone could use a car and subway was for noble people who cared for the environment), but if she ever went to a big city, she never stayed there for long, and usually walked by foot. when she actually used the subway for the first time, she decided to hand out flyers that said something like “thank you for choosing public transit! here are some other ways you can help the planet (…)”. ended up absolutely overwhelmed and in a taxi, wiping tears with the flyers no-one seemed to like. wonder why.

noel — romanticized the shit out of paris metropolitan, said he researched all about it and prided himself on being more knowledgeable of it than a local. when he got to go to france (probs a family/school trip when he was a teen) he bought an overpriced graphic t-shirt with the metropolitan map and confidently entered the underground. immediately got disappointed it wasn’t all gothic catacombs, and accidentally sat on a wrong train. had to take off his t-shirt and figure out where he was, and after two hours of being chest naked in the french underground and hopping from one wrong train to another even wronger train a kind passer-by pointed out that the print on his tee was of marseille, not paris. he spent an extra hour figuring out the correct map and asking for directions in broken french (the locals despised him). he entirely missed the drag show he waited for, and ever since then grew to hate the french underground.

mischa — is in on a ukrainian inside joke about metro in odesa. successfuly convinced all choir that there’s metro in odesa. there is no metro in odesa.

there’s also a ukrainian book called toreadors from vasyukivka, where two boys want to build a metro in their village, so they dig a big hole in their yard and a cow accidentally falls into it. safe to say their idea doesn’t stick. at some point these boys get to kyiv and immediately get lost in metro there. that’s 100% mischa. he did this i was the cow.

also he always finds ways not to pay for his ride: jumps over the tourniquet’s, crawls under them, squeezes in with a person in front of him etc. sometimes gets extremely bored and hides in a train wagon when it reaches the final stop, and stays in it when it goes to depo.

ricky — his parents drove him everywhere by car, and told the tales about toronto subway being inaccessible, dangerous and full of freaks. he never believed them. at some point (maybe in a trip with the choir) he got to travel by subway himslef. it was, in fact, a bit of an unpleasant experience, but he found out that it sucks on his own terms and was lowkey proud.

also he was listening to some cringefail furry music (i do not know if furry music is a thing but it will be now) and realised his earphones disconnected and he was blasting it to everyone only after he got home.

penny — had a secret hiding spot in toronto subway where she could keep her things and return to see them intact. she and ezra hid there often and spied on people, sometimes picking up what fell out of their purses — like pieces of candy or pennies (get it? penny? pennies? penis?). they never stayed there for long tho cause it was too overwhelmingly loud.

one time she went to that place and realised some construction workers occupied it. she was emotionally devastated.

constance — always saves the seat for the elderly, disabled and other people who might need it, and people always thank her plenty when she does so. actually never ever sat on a train seat unless the wagon was mostly empty. however, one time she had a horribly tiring + devastating + bad day and decided to sit down for once. got called 10 slurs by an old guy who didn’t see there was another free seat and ocean then told her she should have thought about others first. when she got home she wrote an angry vent in her musical diary (yk, the ones that open with a password and then play a one direction song or smth) with a fluffy pen.

+ talia — she is a subway rat. has a love/hate relationship with obolon station. has beef with pochayna station. she herself is from solomyanka region of kyiv where there is no subway. considers it her curse.

hello, sirenc0re! i come here to ask if you have any RTC character headcanons that you wouldn't mind divulging?

ohhh i have a few! these are somewhat disorganized, i dont think ive really shared these outside of a single reddit comment. anyways:

penny loves boybands ofc (backstreet boys, nsync, obviously 'seven up' before it split) but further than that i think she likes 60s-70s pop too- fleetwood mac, kate bush, the beatles, etc

ezra is the one that's genuinely really into gangsta rap. NWA, tupac, snoop, dr dre... and of course eminem (though he isnt really a gangsta rapper. it's adjacent) i think rap in general is something he likes. though he's like, a smartass. so i think that at least early on he would "like" it the same way he likes penny's boybands (something to mock as the pinnacle of empty and vapid commercialism) before he actually starts appreciating it as art (JK-47 notwithstanding) and not something he has to prove against. so im saying he would genuinely like tribe called quest. it's in my mind. i am manifesting it. as a side note, i jokingly wanted to be like AND HE LISTENS TO MACKLEMOREEEE but im a hard ass and in the timeline that exists in my head it's 2009. and in 2009 mackle had the penis song as the first track of his debut album. make of that what you will

ocean's whole straight-lace schtick is her twisted version of a teenage rebellion against her hippy parents. she also makes herself seem better off than she actually is. im of the firm belief that pretty much everyone in uranium (except perhaps constance's parents and misha's adoptives) is broke. and i think that with her parents lifestyle, ocean would be on the lower end of that spectrum and it's a big insecurity of hers that she tries very hard to project against to varying degrees of success

noel says he was saving up to go to france, but if you looked at his bank account there would be maybe 200~ saved there. most of his wages went to supporting himself and his single mother

post-cyclone au, i think ocean would shift away from politics and become a personal injury attorney

post-cyclone au, ricky becomes a sci-fi erotica author… i like to think he's extremely successful in that particular niche

post-cyclone au, ocean and noel's relationship becomes wayyy less hostile. they still 'fight' but all the venom has been sucked out of their words. one time he tripped her in the hallway inbetween class periods, which prompted her to halfheartedly kick his ankles, which leads to a 'fight' that gets her in trouble in school for the first time in an actual decade (she's pissed)

post-cyclone au, constance's epiphany about life being beautiful makes her a lot more bold. which is to say she now has the confidence to go on a million little sidequests for no other reason than to experience the bounties of existence. penny wants to go to a concert 3 hours away but she's still banned from the bus? constance knows how to drive and the unlimited trust of her parents, hop in

very much inspired by ray winter's take on misha when he was answering asks about it so i've absorbed it because it makes sense: misha was a class clown back home and pretty well-liked. he's such a solid and passionate dude, and way more kind than he's allowed to be because everything in canada seems to hate him. i believe that his 'attitude' problem mostly stems from loneliness, (which is kinda exerted on him but also enforced by him after a certain point since i think he retracts himself into his phone with talia rather than be in the real world where he is miserable) and that he would have done so much better if he had one genuine friend he could talk to. in a post-cyclone au, he gets a bunch of those, and no longer feels like all of those emotions are being stiffled or bottled up

I wanna talk about my boy Romeo

Tw: Small suicide mention.

Okay so if you remember my post about my Ricky's Space Age Bachelor Man outfit you remember that I said I had an oc that would interprete the song for him, and this is Romeo, he's a kid that moved to Uranium city when he was 14 years old. He immediately became friends with Ricky Potts because since Romeo is deaf they were the only two kids that knew sign lenguage. Both of his parents are deaf too. Romeo has an hearing aid but he didn't get it until he was 12, so basically he had barely heard himself until he was a teen, so he's bad at pronouncing words but at 17 yo (time of the cyclone accident) he can speak properly. If someone makes fun of the way he speaks he's going to rip all of their limbs off (joking, he will actually flip you off and then go to his house and cry). He often has to help people communicate with Ricky since they don't know sign lenguage, and usually he's okay with it and likes interpreting for Ricky but if you ask him "Oh, what did Ricky say?" And then it's a single sign he has said the meaning of a hundred times he will get frustrated, he has diabetes and had to get his left arm amputated when he was 9 years old, so he has a robotic arm prosthetic. Romeo is a trans man, but when he moved to Canada he already had started testosterone and used a binder, so almost no one knows. He truly appreciates Ricky since he feels like he's the only person he's able to relate to, Ricky makes him so happy... He likes dancing Tango, Flamenco/Sevillana and Ballet. He used to live in Spain before since his mother is half Spanish. He's not a fan of the other choir kids and prefers not talking to them if it's not to tell them what Ricky is trying to say because he's always thinking that people want to make fun of him and doesn't want them to... If he's your friend the moment your parents look away for a second he's going to be trying to convince you to get your hair dyed (If the rollercoaster accident hadn't happen he would have dyed Ricky's hair the next day). He really appreciates spending time with Ricky and they always have sleepovers together since they meet, Romeo also loves Ricky's kittens a lot and considers himself the cats second father (apart from Ricky who is their dad of course). When they were 15 Ricky told Romeo about Zolar and he was like 😦, but he actually supports him with his religion. If in the Afterlife Ricky actually started talking like in the RTC productions Romeo would probably feel too stunned and scream really loud. Fun fact, he's called Romeo because if I had been born with a penis my mother would have called me that. He hates the "And where's your Juliet?" joke, it annoys him a lot. Everytime he hears his dead name he feels like puking. If they didn't die Romeo would probably stay with Ricky for the rest of his days. He's bisexual. He can speak English, French, Spanish, Portuguese and Italian, but his French level isn't as good as the others since he had to drop out of that class back in Spain because the teacher made him feel uncomfortable. He knows American sign language and Spanish sign language. If Romeo hadn't gotten to transition he would already have tried to unalive himself already. Romeo also likes reading and drawing. His favorite books are Heartstopper and "Un Beso Bajo La Lluvia". And that's him, I hope you liked ma boy, he's my favorite oc so that's why I put bro in my RTC au.

People v. HHH [(26 August 2020)], G.R. No. 248245. August 26, 2020 

HHH, the father, accused of sexually assaulting his three daughters identified as AAA, BBB, and CCC, with crimes committed at various dates within their home in Angeles City. Prosecuted under six separate criminal cases, these involve two counts of Rape by Sexual Assault, three counts of Statutory Rape, and an additional count of Rape by Sexual Assault occurring across different dates from 2012 to 2014. The daughters provided testimonies detailing the assaults, leading to HHH’s arrest and subsequent trials. The Regional Trial Court (RTC) found HHH guilty, a decision later affirmed with modifications by the Court of Appeals (CA), increasing the amounts for damages.

Issues: 

1. Were the Informations for Criminal Case Nos. 14-12400, 14-12401, and 14-12402 defective due to the vagueness of the dates alleged? 

2. Did the prosecution establish HHH’s guilt beyond reasonable doubt for two counts of Rape by Sexual Assault and one count of Statutory Rape? 

3. Did the prosecution establish HHH’s guilt beyond reasonable doubt for two counts of Statutory Rape? 

4. Were the penalties and monetary awards imposed by the CA correct?

Court’s Decision: 

1. The Informations were not defective despite vague dates, except for Case No. 14-12402, where the prosecution failed to establish the timing of the event as alleged. 

2. The Court found HHH guilty beyond reasonable doubt for two counts of sexual assault and one count of statutory rape, with modifications in the nomenclature of offenses in accordance with applicable laws. 

3. Guilt beyond reasonable doubt for two counts of Statutory Rape was established against HHH, with credible testimonies from the victims supported by medical findings. 

4. The Court set aside the CA decision partly, affirming HHH’s guilt for sexual assault and statutory rape under modified terms and recalculating penalties and damages according to relevant laws.

Doctrine: – Precision in the alleged commission date in Informations is not required when it is not a material ingredient of the offense. The Court places significant weight on the credibility of G.R. No. 248245. August 26, 2020. Two minor victims’ testimonies in sexual assault cases, recognizing the traumatic impact and the victims’ reluctance to immediately report the crimes. – The qualifying circumstance of the offender’s relationship to the victims cannot elevate the charges unless explicitly stated in the Informations.

Statutory Rape: Committed when (a) the victim is under 12 years old, (b) the offender has carnal knowledge of them, regardless of consent or the victim’s will. 

– Rape by Sexual Assault: Committed when the offender commits an act of sexual assault through forcible insertion of an object or body part other than the penis into another person’s bodily orifices. 

– Principle of Specificity in Informations: The need for specific dates in criminal charges is flexible, particularly in sexual offenses where exact times may not be materially relevant. 

– Credibility of Minor Victims: The testimony of minor victims is given significant weight, especially in the absence of evidence showing any ill motive on their part to falsely testify against the accused. 

– Doctrine of Relationship as a Qualifying Circumstance: Relationship between the offender and the victim must be explicitly alleged in the Information to qualify the offense and impose a higher penalty.
