Hi! I just want to say that I really like your blog, and I’ve learned a lot about the Franklin Expedition and related things reading it. I have a bit of a weird Fitzjames ask, but since you’ve read the Battersby bio and other books about this time period I hoped you had some thoughts. Is there a reason the Coninghams never formerly adopted Fitzjames? Was it something that just wasn’t done then? Or do you think his birth father had smth to do with it?
Hello! Thanks so much for the lovely message – I’m so glad you’ve enjoyed the Franklin expedition content! I literally cannot stop talking about James Fitzjames, so it’s always a delight to get asks about this wonderful, absurd man, and I don’t think that’s a weird question at all.
I do want to preface by saying that I’m not trained as a modern (post-medieval) historian, so there are some gaps in my knowledge that others would definitely be able to fill – notably, I’m unfamiliar with common practices for how illegitimate children of this period were typically raised. My impression is that it wasn’t uncommon for “informal adoptions” like the arrangement between the Coninghams and James to occur, but I don’t have a lot of sources for that impression. (If anyone has knowledge on this topic, please do add on!) 
So, I can only really speak to Fitzjames’ specific situation.
That being said, I do have some ideas! 
So, why Robert & Louisa Coningham didn’t formally adopt James Fitzjames: two (1&2) non-factors, and one actual possible reason (3).
First, (1) it certainly wasn’t a lack of love. No matter how you measure it – verbal expressions of care, educational and financial support, time investment, inclusion in family social networks, career assistance – the Coninghams provided all the love they could, to the best of their ability. They took James in, probably when he was an infant or toddler, and committed themselves to him, even after having just lost their infant firstborn son, John. During James’ childhood and teenage years, the Coninghams hired tutors to teach James alongside their surviving son, Will. When James wanted a naval career, Robert Coningham worked tirelessly to help him find a good post, even though the Coninghams had no naval connections. James called Robert’s mother “grandmama” and wrote to her excitedly about Congreve rockets. Following Robert’s death, both Will and Louisa wrote to James to reaffirm their love for him and to communicate in no uncertain terms that he was a part of their family no matter what. Will opened a bank account on James’ behalf and poured into money into it – an annual stipend equivalent to more than twice what I make yearly. After Louisa had also passed away, Will still begged James to come live with him whenever James was on English soil, asking James, “Why don’t you come home all your friends will be glad to see you and with us you will find a home and the most affectionate welcome that hearts can give you?” (quoted in Battersby 2010, pg. 151.)
Basically, the Coninghams loved James.
This stopped being relevant to your question; I just wanted to put that out there.
The Coninghams loved James. James was loved.
Okay, back to less emotionally fraught territory.
Second, (2) I don’t think that Sir James Gambier, James’ birth father, had much to do with whether or not James was formally adopted. It’s possible, but it doesn’t seem like Gambier was much engaged in Fitzjames’ life at all. If he was a part of the reason, it probably wasn’t purposeful.
Finally, (3) I think the real reason comes down to the practicals: a formal adoption from the Coninghams would have compromised James’ ability to hide his origins. Because the arrangement was informal, James could fairly easily change his “life story” at a moment’s notice – and the details he gave about himself did change several times. The year of his birth, the place of his birth, even when exactly he came to live with the Coninghams – by keeping all this data uncertain, James (or rather, the Coninghams, on James’ behalf) made it harder to track down the details needed to piece together the fact of James’ illegitimacy. A formal adoption might have raised questions and drawn attention to the secrets that James, sadly, would need to spend the rest of his life hiding.
So, tl;dr – even if a formal adoption was ever on the table, James Fitzjames probably had to keep the terms of his relationship with his foster-family purposefully vague so that he could better maintain the fiction of having once had legitimate married parents who had died and left their child to be raised by others. That being said, formality wasn’t necessary; the Coninghams were clearly able to love and support James without ever having their connection made legal on paper.  
I hope this answers your question! There’s a lot to explore here, and I’m actively doing research on the relationship between James and his mom-in-all-but-name Louisa, so if I find out anything else, I’ll let you know.

The amount of love Robert conveys to Fitzjames in his letters makes me emotional every time. Fitzjames was so fortunate to have a father who loved and supported him like this. I think about how it's for the best that Robert wasn't alive anymore when Fitzjames went missing in the Arctic... it would have killed him.
