BMI (Broadcast Music Inc) and ASCAP ( American Society of Composers, Authors and Publishers) are two of the top three United States performing rights organizations (the other being Society of European Stage Authors and Composers). The role of a performing right organization is to collect license fees on behalf of the songwriters, composers and music publishers. And then the organization distributes them to the songwriters, composers and music publishers as royalties. They have simple mission statement that basically say that they are there to build a bridge between songwriters and the businesses and organizations that want to play their music publicly.
Why should performers sign up with BMI and ASCAP?
Tip#1: BMI and ASCAP allows songwriters, composers and music publishers to focus strictly on their craft and not have to worry about their performance rights. They are both equipped to handle any category or any genre, including, concert music, country, film and TV, Jazz, Latin, Musical Theatre, Pop/Rock and Rhythm/Soul.
Tip#2: BMI is not new in this industry and are very professional. They can add value to your business in the music industry. BMI has been around since the 1940’s and currently powers over 750,000 licensed business that use music and represent over 12 million musical works. ASCAP was the first PRO (performing right organization) in the Unites States. It was founded in 1914. As the music industry has evolved, they have learned to evolve right along with it. Throughout the evolution of their business they have always remained committed to protecting songwriters, composers and music publishers. ASCAP is home to more than 600,000 creating members and have over 10 million licenses.
Tip#3: Both ASCAP and BMI values music. They are advocates on behalf of the music creators and they love all genres and respect creators at any stage in their career. However, ASCAP is proud to say that they get 80% of Oscar music nominations. Tip#4: BMI and ASCAP are very diligent at paying music royalties to creators when their songs are performed. Some of the most popular places to play music that receive royalties are TV shows, Radio and Movies. BMI gives one half of the royalties to the songwriter(s) and the other half is designated for the publisher(s) or copyright holder(s). ASCAP calculates royalties by use weight (an amount attached to each performance) X licensee weight (license fee paid by the station) X “Follow the Dollar Factor” (License fees that ASCAP receives) X Time of Date (the time of date the performance occurs; prime time, midnight?) + Premium Credits = Credits. ASCAP certainly has a more complicating royalty equation, but it provides the most amount of money for their consumers.
Tip#5: BMI has a well diverse executive team that consists of experts in fields such as music career development, technology, finance, licensing, new media, corporate strategy and even copyright law. At ASCAP the employees are all proud to be part of the community of music creators and supports. They are collectively experts in music and media businesses, technology, licensing and copyright. ASCAP is also the only United State performing rights organization with a Board of Directors. The Board is elected by their membership.
In the end, either BMI or ASCAP would be suitable companies for your needs. Both are relatively equal in quality and ability. It is very necessary to make sure that if you are a songwriter, composer or publisher that you are singing up for a performance right organization to ensure that your hard work is protected. Both of these companies want to make sure that you are fairly compensated for the music that is performed in public. These two companies charge businesses who play your music and then send you the money as royalties. Both companies use cutting edge technology to track, match, process and pay over a trillion performances each year.
