In 2014, Jeremy Meeks was arrested and convicted of five weapons charges and one gang charge.[1] This arrest and this crime changed his life forever, although probably not in the way that you’d think.

Meek’s mugshot, showing his bright blue eyes went viral after an eagle-eyed observer spotted the handsome photo on the Stockton Police Department’s Facebook page. [2]From there, the photo went viral, with countless admirers commenting and sharing all about how beautiful they thought Meeks was, all from his mugshot. Branded as the “hot felon” Meeks was walking runways as soon as he was released from prison. He made his runway debut during Fashion Week, walking for menswear designer Philipp Plein. From there, Meeks' life changed drastically. He launched a 15-million dollar deal with Fashion Concept GmbH for a collaboration collection[3], started dating and had a child with a billionaire heiress[4], and started speaking out about a greater need for Black designers in fashion.[5]

By nearly all accounts, Meeks’s life is almost unrecognizable, all because of the publication and later public obsession with his mugshot. Meeks’s story is an interesting one, but is just one thread in the larger complex ethical fabric of the mugshot publishing industry.

When one thinks of Paris, France, they often don���t think of mugshots. Our images of the city of light typically center around cheese, not criminals. But it was in this unlikely place that the first mugshots were taken, during the 1830s. These first mugshots were very useful, and the practice soon spread across police departments around the world. [6]

Today, the practice of taking and making mugshots public is strongly in practice in almost every police department across the country. There remains a lot of debate centered across the publications of mugshots, and there are many questions about privacy that can come from this.[7] More than that, there has even been a rise of an entire industry surrounding the distribution and the public disclosure of mugshots, sometimes called the “mugshot publishing industry.”

The idea behind a company like this is simple. They are typically a website or a social media page. The owners publish photographs of people arrested (which are available as public record) and compile them,  typically with their full name and crime. These websites operate like databases, and one can search any name they wish, and see a photograph of the person’s mugshot, along with a summary of any of the crimes they may have committed. [8] These sites have only become more popular and more prevalent as the Internet grows larger. In 2012, the Miami Herald went as far as to call them a “hot new Internet business.”[9]

The argument for these sites is that they can provide for public safety. By having these crimes and people readily listed, one could search these records before they hire a babysitter, plumber, or even go on a blind date. Often the owner of these sites cite their services as a work of “public safety.”[10] However, many of these sites have a service where they will remove your mugshot and arrest details, for a fee.

The “mugshot publishing industry” as it is sometimes called, is often criticized as profiting off of shame. However, many defenders often cite the fact that these mugshots, for better or for worse, are public information, and they are simply broadcasting attention toward something that was already out in the open, but probably ignored.[11]

Ironically, much of this question came to a head with the arrests and leaked mugshots of two of the owners of what was, at the time one of the largest online collector’s of mugshots: mugshots.com. The founder’s were arrested for suspicion of criminal extortion, identity theft, and money laundering.[12] The California Attorney General’s office described Mugshots.com as a business “permeated with fraud.” The publication of their mugshots was a great public irony, but it raised much larger public questions about the ethics and legality of their actions.

There are also questions of larger, racial issues. What race typically are the people shown in these mugshots? How might showcasing these photos impact bias? A story on NPR highlighted that some local police departments are taking a backseat from showing mugshots as quickly and as publicly in their local newspapers because of reasons cited like this. “And I think that newsrooms need to weigh like, does this have news value? And what harm might we cause by putting this out there?”[13]

These are all questions that mugshot publishing companies, journalists, and citizens must wrestle with, considering this growing industry.
