"The majority of high-tech patent lawsuits are brought by patent trolls—companies that exist not to provide products or services, but primarily have a business using patents to threaten others’ work. Some politicians are proposing to make that bad situation worse. ...

The Patent Eligibility Restoration Act, S. 2140, (PERA), sponsored by Senators Thom Tillis (R-NC) and Chris Coons (D-DE) would be a huge gift to patent trolls, a few tech firms that aggressively license patents, and patent lawyers. For everyone else, it will be a huge loss. That’s why we’re opposing it, and asking our supporters to speak out as well. 

Patent trolling is still a huge, multi-billion dollar problem that’s especially painful for small businesses and everyday internet users. But, in the last decade, we’ve made modest progress placing limits on patent trolling. The Supreme Court’s 2014 decision in Alice v. CLS Bank barred patents that were nothing more than abstract ideas with computer jargon added in. Using the Alice test, federal courts have kicked out a rogue’s gallery of hundreds of the worst patents. 

Under Alice’s clear rules, courts threw out ridiculous patents on “matchmaking”, online picture menus, scavenger hunts, and online photo contests. The nation’s top patent court, the Federal Circuit, actually approved a patent on watching an ad online twice before the Alice rules finally made it clear that patents like that cannot be allowed. The patents on “bingo on a computer?” Gone under Alice. Patents on loyalty programs (on a computer)? Gone. Patents on upselling (with a computer)? All gone. ...

PERA’s attempt to roll back progress goes beyond computer technology. For almost 30 years, some biotech and pharmaceutical companies actually applied for, and were granted, patents on naturally occuring human genes. As a consequence, companies were able to monopolize diagnostic tests that relied on naturally occurring genes in order to help predict diseases such as breast cancer, making such testing far more expensive. The ACLU teamed up with doctors to confront this horrific practice, and sued. That lawsuit led to a historic victory in 2013 when the Supreme Court disallowed patents on human genes found in nature. 

If PERA passes, it will explicitly overturn that ruling, allowing human genes to be patented once again. ...

“To See Your Own Blood, Your Own Genes”

From the 1980s until the 2013 Myriad decision, the U.S. Patent and Trademark Office granted patents on human genomic sequences. If researchers “isolated” the gene—a necessary part of analysis—they would then get a patent that described isolating, or purified, as a human process, and insist they weren’t getting a patent on the natural world itself.

But this concept of patenting an “isolated” gene was simply a word game, and a distinction without a difference. With the genetic patent in hand, the patent-holder could demand royalty payments from any kind of test or treatment involving that gene. And that’s exactly what Myriad Genetic did when they patented the BRCA1 and BRCA2 gene sequences, which are important indicators for the prevalence of breast or ovarian cancer. 

Myriad’s patents significantly increased the cost of those tests to U.S. patients. The company even sent some doctors cease and desist letters, saying the doctors could not perform simple tests on their own patients—even looking at the gene sequences without Myriad’s permission would constitute patent infringement. 

This behavior caused pathologists, scientists, and patients to band together with ACLU lawyers and challenge Myriad’s patents. They litigated all the way to the Supreme Court, and won. “A naturally occurring DNA segment is a product of nature and not patent eligible merely because it has been isolated,” the Supreme Court stated in Association for Molecular Pathology v. Myriad Genetics. 

A practice like granting and enforcing patents on human genes should truly be left in the dustbin of history. It’s shocking that pro-patent lobbyists have convinced these Senators to introduce legislation seeking to reinstate such patents. Last month, the President of the College of American Pathologists published an op-ed reminding lawmakers and the public about the danger of patenting the human genome, calling gene patents “dangerous to the public welfare.”  

As Lisbeth Ceriani, a breast cancer survivor and a plaintiff in the Myriad case said, “It’s a basic human right to see your own blood, your own genes.” "

First ever ship: MSR for sure! As a kid I used to watch the x files with my mom and even baby me was like wow these idiots love each other. If we're talking about fanfic, my first ship was my ninja demon princess Naruto oc and Itachi 😅

Last song: Nazo Nazo by Kikagaku Moyo. They're one of my favorite bands and I'm still kicking myself for not being able to see them on their very last tour last year even though they were playing like 20 minutes away from me 🥲

Last movie: I just finished my spooky month rewatch of The VVitch. It's one of my favorite movies of all time

Currently reading: The Palestine Laboratory: How Israel Exports the Technology of Occupation Around the World (ebook currently free on verso books if anyone's interested) I also recently finished my re-read Cormac McCarthy's Border Trilogy and I'm pleased to report he's still one of the best to ever do it

Currently watching: Interview with the Vampire and I'm so mad I slept on it because it's so good. Also watching Joe Pera's new comedy special and that's been really good too (I often fall asleep to his adult swim show. It soothes the soul in a very special way on top of being very funny)

Currently consuming: My partner and I just roasted up some brussel sprouts to have with some leftover lobster bisque. Washing it down with a beer

Currently craving: I'm pretty full right now but give it an hour or two and I'll want some ice cream or something. Other than that I really would like to make some pierogies soon but I don't think I can be bothered to actually make them 🤷🏼‍♀️

Plus too many Little Croquettes jam sessions to count. I went to many of these with @lessjokes and a few with @lizzylizzylizzy. NOFX with @vicwomg was the most memorable since we got to be on stage with the band the whole time. Taylor was the best though, followed by Annabelle Chairlegs and Ruth Radelet and Agar Agar (all of which were part of the Psyched Radio festival, can't wait for next year), and also all the Curling shows were a blast, especially the one with Plash. (Check all of them out if you haven't already!)

and so the good friend who always sets me up on a date got me out of the rut and surprisingly went with me to church. afterwards, we walked across the street to this coffee shop/tattoo place/barber/merch store in Kamagong. 

friend: you see the tattoo artist? he is cute right? and he looks a little dirty and mysterious. hindi ba yan ang mga gusto mo?

me: okay. lol. 

friend: and he is staring at you now

me: he stares because we are staring at him!

tattoo artist: Hi (introduces himself) did you like the coffee?

me: yeah medyo mahal nga lang

friend: ............

tattoo artists: next time me discount. papa tatto ka ba sir?

me: hindi. coffee lang

tattoo artists: want to check our shirts? i designed some. 

friend: HE WILL BUY. 

me: wala ako dalang pera lol 

friend: HE HAS GCASH 

me: anong number mo (me hands him my phone) 

tattoo artists: magugustuhan mo yung shirt, sir.

me: (deep inside) sana single pa tol. ang lakas ng appeal. 

tattoo hands me the shirt and lo and behold the left ring finger has a wedding band.

Sa kalagayan ngayon ng presyo ng mga bilihin sa bansa, mas lalo lang dapat pagtuunan ng pansin ang pagtugon sa mga pangangailangan ng mga mamamayan. Nararapat lamang na isaalang-alang ng pamahalaan ang kanilang pamamaraan ng pagsukat at pagtukoy ng kahirapan sa bansa.

Ang presyo ng bigas ay umaaabot mula 38-50 piso (Department of Agriculture, 2022), ngunit ang pagkonsumo lamang ng kanin ay hindi nagbibigay ng sapat na sustansiya para sa isang tao. Ayon sa Food and Nutrition Research Institute ng Department of Science and Technology (DOST-FNRI), ang inirerekomendang food intake ng isang karaniwang tao bawat araw ay dapat: (1) 8 basong tubig, (2) 5-8 servings ng complex carbohydrates gaya ng kanin, mais, tinapay, atbp., (3) 3 servings ng gulay, (4) 3 servings ng prutas, (5) 1 basong gatas, (6) 3-4 servings ng protina gaya ng karne, isda, lamang dagat, beans, atbp., at (7) opsyonal na sweets at fats. Mula rito, agad nang magiging kwestyonable ang batayan ng pamahalaan sa konsepto ng "food poor" sapagkat ito, at maging ang “basic food needs”, ay tila mga arbitraryong konsepto. Hindi ba dapat tawagin na nating “food poor” ang mga hindi nakakakamit ang mga pangangailangan na ito?

Makikita sa talahanayang ito ang mga pinakamurang mga bilihin sa bawat food group ayon sa Bantay Presyo ng Department of Agriculture (DA) nitong ika-8 ng Nobyembre 2022, at ikumpara natin ito sa 2021 food threshold na inilabas ng PSA.

Kung susumahin, aabot sa 36.65 pesos ang kailangang ilaan para sa bawat meal ng isang Pilipino upang makamit ang basic nutritional needs. Malayong-malayo na ito sa 2021 threshold na inilabas ng PSA. Hindi na ito nakapagtataka sapagkat sa mga nakalipas na buwan ay labis na tumataas ang inflation rate ng bansa. Matatandaan na 4.4% ang inflation rate noong Agosto ng nakaraang taon, habang 6.3% naman ang inflation rate nitong Agosto 2022. Sa patuloy na pagtaas ng inflation rates, kakailanganin ng karaniwang mamamayan na maglaan ng mas maraming pera para sa pagkain.

Ayon sa PSA, ang food threshold ay ang minimum na ginagastos ng pamilya upang makamit ang “basic food needs which satisfies the nutritional requirements for economically necessary and socially desirable physical activities”. Subalit, ang batayan lamang nila ay ang halaga na inilalaan ng isang pamilya sa pagkain. Tila hindi ito tugma sa batayan ng DOST-FNRI na nakapokus naman sa nutritional value. Bunga nito, maaaring malito ang sinomang mag-iinterpreta ng alinman sa dalawang pamantayan. Maaaring akalain na sapat na ang 18.62 pesos para sa isang masustansyang meal, kahit ito lamang ang average na ginagastos ng isang pamilya sa pagkain. Hindi sinusukat ng PSA kung natutugunan ba talaga ang nutritional needs ng isang tao, taliwas sa kanilang depinisyon.

Hindi sapat ang bare minimum lamang pagdating sa nutrisyon at kalusugan, lalo na’t tayo ay ika-63 sa 121 na bansa pagdating sa kagutuman at sapat na nutrisyon (Global Hunger Index, 2022). Ang isyu ng kagutuman ay hindi dapat minamaliit sapagkat bahagi ito ng pangmalawakang usapin ng kalusugan. Upang matugunan ang mga isyung ito, hindi lamang pagkain kundi kailangang maging holistic ng gagawing solusyon na tutugon sa pinag-uugatan ng problema – mapa-pisikal, mental, sosyal, spiritwal, o emosyonal man ito. Samakatuwid, hindi dapat mga band-aid solution lamang ang ipinapatupad ng pamahalaan. Bagkus, kailangan nilang magkaroon ng komprehensibong plano ukol sa gutom at kalusugan ng taumbayan.

Kailangan ng pamahalaan na muling suriin at isaayos ang mga pamamaraan nito ukol sa pag-aaral at pag-unawa sa kalagayan ng madla. Isang malaking hakbang ang pagpapanatili ng komunikasyon sa masa upang hindi na magdulot pa ng kalituhan. Totoo na ang mga istatistika ay repleksyon ng kalagayan ng ating kapaligiran, ngunit hindi lamang ito dapat tinitignan bilang mga numero, kundi kailangan din nating siyasatin ang totoong buhay ng taumbayan dahil sa gitna ng pabago-bagong lagay ng ekonomiya. Ngayon, higit kailanman, kailangan ng bansa ng mga lider ng mangunguna sa epektibong pagharap sa kaliwa't kanang krisis na dinaranas ng bansa. //ni Apollo Tumaliuan

Filipino Demigod Children in PJO Headcanons (Highschool Edition)

Please note that most of this is just for fun and should be taken with a grain of salt and as a joke. With that being said, enjoy this shitpost.

No, I am not over my PJO phase and with its resurgence in popularity, here's a list of what I think Filipino kids would be like in Camp Half Blood according to their godly parent (we start with the big twelve): Zeus: Fuckboys. Just. Fuckboys and them basketball cuties. Palagi silang nakavarsity jacket o kaya nakashorts/sports apparel. Pag may date sila, nakadefault outfit ng white shirt, khaki-color pants, white vans o sports shoes tapos may dala-dalang fanny pack na wala namang laman kasi yung pera nila, nasa bulsa. The Zeus kids are some real eye-candy (because Zeus) and have loud, thunderous voices na dinig sa likod pa ng classroom at sa buong court kapag naglalaro ng basketball. Isang linggo lang sila nagkakajowa bago sila makikipagbreak... tas babago nanaman.

Marami kasi silang daddy issues kaya di nila alam kung pano tratuhin ang mga babae pero mahal na mahal nila mga mama nila kasi mama's boys na spoiled brats rin. #ballers i guess.

Their defining trait as Zeus's kid is that they have really loud voices and you'll always be drawn to their presence; because aside from being kind of charismatic, they're just bubbly, party people over all. ...still fuckboys though.

Demeter: Either mga artsy kids o yung mga magagaling sa Biology. Their color aesthetic for clothing is either muted browns to light beiges and greens or bright, pastel. No in between. Sila yung tipong firm at leader type yung personality, either class pres o vice pres tapos paminsan pa-epal pero they mean well naman. Nagagalit sila tuwing may nag-s-skip ng cleaning duties o sinisira yung mga halaman na dinala nila para sa class deco.

Sa friend group nila, sila yung "mom friend" na no-nonsense at tipong nagbibigay parati ng advice para hindi na masaktan yung marupok nilang kaibigan (na palaging nafa-fall para sa Zeus kid) pero hindi rin lang sila pinapakinggan.

Alam mong anak sila ni Demeter kasi ang gagaling nila mang-alaga ng halaman at pati na rin ng tao. Punctual sila at organized to the point na nakakatakot na pagminsan. Hindi sila inaasar ng mga classmate kasi tuwing nagagalit ang mga Demeter kids, either sisigaw sila hanggang may darating na teacher o iiyak nalang sa harap hanggang lahat damay sa guidance.

Athena: Syempre mga topnotchers at kumon babies o kaya mga honor students na ginagawang personality nila yung pagiging honor student. Tahimik silang mga tao pero super dependable sa research kasi alam nila kung ano ginagawa nila (unlike your dumb ass na gumawa ng estetik na background sa Canva para sa Background of the Study jusko). Fashion sense nila ay puro collared na polo na may kasamang knitted sweater o knitted vest tsaka baggy, brown pants o schoolgirl na skirt. Sa tuwing recitation, sila nangaaway sa mga Demeter kids kung ano ba yung tamang sagot (plot twist: mali silang dalawa paminsan). Athena kids hate the Zeus kids, the Aphrodite kids, and most especially the Ares kids kasi sila parating pabigat sa group works.

Their defining trait as children of Athena is that they're very academically gifted/inclined pero pagdating sa street smarts o pagiging madiskarte, doon sila nahihirapan. Magaling sila sa recitation at sa mga individual tasks pero pagdating sa groupworks, masgusto nila maging leader kasi ayaw nilang bumagsak. "Failure is not an option" yung mindset nila and they often base their worth on productivity until their friends have to step in para gumala at kumain kasi ilang araw na silang umiinom ng kape at di natutulog para lang tapusin yung research. Athena kids like to sacrifice sleep for studying kaya pagminsan, natutulog nalang sila sa classroom.

Apollo: Do I even need to elaborate? SYEMPRE, sila yung mga choir kids, theater kids, band kids, AT mga sadboi. For the choir kids, tahimik lang naman sila. Chill lang. For the theater kids na anak ni Apollo, medyo high strung at super energetic sila. Magaling magrole-play at umarte para sa mga video assignments tsaka may paborito silang mga mainstream na plays kagaya ng Hamilton o kaya Heathers. Sa Band kids ni Apollo naman, chill rin sila but they never, ever shut up about how band practice went. And then we have the sadbois. Paborito nilang song artist o band is either December Avenue o Ben&Ben... o kaya both at the same time. Outside of the Theater and Choir kids ni Apollo, Band kids and Sadbois always carry around an instrument. The difference is that the Band kids use their instruments for, well, band. Pero yung mga sadboi, nakikita mo silang palaging may dalang gitara. Kahit hindi nila nilalaro, meron at meron silang hawak na gitara ta's pakanta-kanta ng either: a. Sa Huling Sandali by Ben&Ben

b. Pagtingin by Ben&Ben

c. Sana by I Belong in the Zoo

Their defining traits as children of Apollo are their godly-parent-given talent in singing and the art of making every girl/guy who they like not like them back--especially for the sadbois/girls. Their default form of courtship is through singing or "Harana" and it usually works out for them EXCEPT the sadbois/girls who seem to be in a state of perpetual rejection by their crushes. It's not that 'di sila pogi o maganda, they're just somehow almost always attracted to the people who don't like them back and it becomes a subject of many, many, MANY uncalled for jamming sessions.

Fishbone and Son Rompe Pera at BRIC Celebrate Brooklyn! at Lena Horne Bandshell

On Saturday, June 29, 2024, Fishbone (of Los Angeles) and Son Rompe Pera (of Mexico City) performed sets at BRIC Celebrate Brooklyn! at Lena Horne Bandshell in Prospect Park. This was the first time in the season’s 46-year-history that punk bands were booked to play the bandshell.

Arab trip-hop and electro-pop music by Egyptian singer and songwriter Maryam Saleh & Lebanese music producer Zeid Hamdan in Paradiso (Upstairs Hall) on Thursday, May 9th, 2024. The duo delivers folkloric songs and compositions, often tinged with sarcasm, defying convention. They prompt listeners to unravel their hidden meanings with poignant political and social content, drawing from musical traditional elements to offer surprising modern twists and interpretations. Their rendition is inspired by Sheikh Imam and Ahmed Fouad Negm work and serves as a poignant reminder of a bygone era of revolutionary folk music.

Maryam Saleh habitually pushes the boundaries of Arabic music. A luminary of Egypt’s alternative music scene, she delivers a savvy mix of old and new, infusing shaabi and folk styles with innovative techniques and fearless personality. Saleh is a singer, composer, actress, and poet. As the teenage frontwoman of the band Gawaz Safar in the early 2000s, she revived the decades-old protest songs of folk legend Sheikh Imam for a younger audience. She broke new creative ground with the dizzying electro beats and sarcastic poetry of 2015’s Halawella, a critically-acclaimed album she recorded with Soap Kills’ Zeid Hamdan.

Zeid Hamdan is a Lebanese music producer and composer, born in Beirut in 1976, standing for the last few decades as the creative force behind several captivating indie bands originating from the SWANA region, such as Soapkills, Bedouin Burger, the Beit Project, Hiba Mansouri, Zeid and the Wings, The New Government, Maryam Saleh, Maii and Zeid, Kandia Kora (Guinean Pop) La Guinee Kazamada (Arabic electro pop) and more. Successfully blending his Middle Eastern roots with a spectrum of influences including punk, electro, and folk. On top of producing his own records , Zeid Hamdan has also been scoring for Films.
