And if he is still with us on October 1st, Carter will be the first President or Vice President in American history to celebrate their 99th birthday.

VRP x TFL Italy New Exhaust Line Released for European Cars

VR Performance (“also known as VRP”) has partnered with TFL Italy to release a series of high quality performance exhaust systems for popular European vehicles such as Porsche, BMW, Ferrari, Lamborghini, and Audi. Each VRP system from TFL is hand built to order in their factory near the heart of Italian horsepower in Modena. Instead of just another company building exhausts off factory jigs, TFL Italy creates each system from the ground up. Having the car in their R&D facility, each vehicle gets 3D scanned to design the system for the best flow and function. Once completed a prototype is built to test the most important aspect for any exhaust buyer which is the sound. The exhaust systems feature high quality TIG welds, thick CNC machined flanges, and a laser engraved VR badge. Some exhausts are available in 304 Stainless Steel or highly sought after Iconel. The VRP x TFL exhaust systems are made to work with the factory valve functions and sensors that are on the vehicle. In addition to the exhaust systems that are generally catback or mufflers, competition race pipes and headers are also available for certain models.

Por su parte, Acindar concreta sus agravios en lo atinente a la nulidad de las patentes 126.345 y 135.234. Con relación a la primera afirma que se trata de una combinación patentable y que, en todo caso, solo está comprendida en las “realizaciones ocultas” de la patente 122.598. Y con respecto a la segunda, cuestiona la valorización efectuada por el perito tercero, entendiendo que la patente 120.348 no la anticipa.

3° Orden del tratamiento de las cuestiones y criterio para su desarrollo: Sobre la base del buen método utilizado por la sentencia apelada y teniendo en cuenta los temas que los agravios traen a decisión de la alzada, consideró adecuado tratar las cuestiones controvertidas en el siguiente orden:

a) Novedad de la patente 122.598; b) usurpación de las patentes de la actora; c) daños y perjuicios; d) legitimación para obrar del ingeniero Serg; e) novedad de la patente 126.345; f) nulidad de la patente 135.234; g) pautas para la regulación de los honorarios.

Aclaró además que en los puntos a) y e) precedentes he aludido a la novedad de las referidas patentes y no a su nulidad porque esta cuestión ha devenido insustancial ya que el plazo de ambas ha expirado: el 26 de julio de 1975 para la núm. 122.598 y el 3 de julio de 1976 la núm. 126.345. Corresponde de todos modos analizar lo sustancial de la materia controvertida porque en la medida en que se determine si las patentes han sido bien otorgadas o no, ello puede incidir, en el primer caso, en la procedencia de la demanda por los daños y perjuicios que se habrían causado en caso de infracción durante la época de vigencia del privilegio (CNFed., sala civil y com., entonces única, noviembre 13-967, causa 5017, “Vitale, C. c. Jauregui Ales e Hijos, S. R. L.”) Y, en el otro, en el acierto de lo decidido respecto de las costas (CNFed., sala civil y com., mayo 22-967, JA, 1968-I-146; idem, sala 2ª, junio 28-974, en Rev. Boletín Nacional de la Propiedad Industrial, N° 421, p.

415).

Por análogas razones, y al solo efecto de establecer la procedencia del reclamo indemnizatorio de la actora. corresponde decidir en qué medida la fabricación del acero “Acindar 60” ha importado una infracción de las demás patentes de la actora. 

Prometo también que en la consideración de los agravios he de apreciar de modo integral los planteos de las partes dada la complejidad que presenta esta causa, aunque atendiendo, claro está, a lo sustancial de cada una de sus argumentaciones. Pero con el entendimiento de que no me encuentro obligado a tratar todas y cada una de éstas, sino sólo aquellas que se estimen pertinente para la solución del caso (Corte Suprema, Fallos, 258-304; 262-222; 265-301; 272-225; 278-271; 251-390, entre muchos otros). 

4° La novedad de la patente 122.598: A) Antes de considerar este tema y de apreciar las pruebas incorporadas al proceso, creo que es menester referirse previamente al criterio o pautas interpretativas que deben regir esta materia. 

Es bueno recordar entonces que el art. 3о de la ley 111 dice: “Son descubrimientos e invenciones nuevas: los nuevos productos industriales, los nuevos medios y la nueva aplicación de medios conocidos para la obtención de un resultado o de un producto industrial”

Desde ya que, a efectos de establecer si se cumple o no el requisito de la novedad, debe partirse de la base de que la originalidad absoluta no existe, pues “todo se construye sobre lo anterior, y en nada humano es posible encontrar la pureza” (Sábato, Ernesto “La Cultura en la Encrucijada Nacional”.Buenos Aires, 1973, ed. Crisis, p. 24).

No obstante ello, es necesario tener en cuenta que desde el punto de vista de la protección legal “la invención debe procurar una ventaja, utilitaria o técnica, para la industria; y esta ventaja será inesperada, es decir, que ella superará la que la técnica industrial corriente puede realizar” “en efecto, hay cantidad de modificaciones o innovaciones que la técnica ordinaria de la industria hace surgir, que pueden entrañar indudables progresos industriales, sin que haya propiamente actividad inventiva. Constantemente los industriales procuran perfeccionar y mejorar sus medios; ellos llegan así a una fabricación más perfecta y menos costosa, pero todos estos cambios no participan necesariamente de la naturaleza de la invención; ellos son simplemente el resultado de la experiencia o el fruto de una gran habilidad profesional” (así lo sostiene Paul Roubier, “Le droit de la propriété industrielle”, Paris, 1954, Recueli Sirey, t. II, núm. 141, ps. 64 y 66, en virtud de 10 dispuesto por el art. 2° de la ley francesa de 1811, del cual ha sido copiado el recordado art. 39 de la ley 111. A properly designed exhaust system is critical to engine performance. Skunk2’s 76mm MegaPower RR Exhaust system for the 2012-2015 Civic Si coupe was developed with this in mind and is based off of more than 15 years’ worth of racing experience. Dyno-proven for maximum horsepower, MegaPower RR systems are constructed of T-304 stainless steel, are robotically TIG welded, and feature CNC mandrel bends for a precise fit. The MegaPower RR for the 2012-2015 Civic Si in conjunction with the Skunk2 Alpha Header for the 2012-2015 Civic Si has seen hp gains above 30hp.

Designed for heavily modified naturally aspirated engines as well as for turbocharged applications that require more exhaust flow than Skunk2’s 70mm MegaPower R Exhausts provide, MegaPower RR Exhausts allow engines to breathe more efficiently and produce more power thanks to larger diameter piping. MegaPower RR Exhaust systems were designed for maximum flow and power, featuring oversized tubing and mufflers, which result in a significantly louder tone when compared to other MegaPower systems.

Featuring Japanese-spec, Super N1 styling, MegaPower RR Exhaust systems generate more horsepower by optimizing engine airflow and volume through carefully selected, application-specific tubing lengths and diameters and increased wave scavenging effects for more horsepower. CNC mandrel bending allows for a constant tubing diameter throughout the bend, which results in precise fitment as well as improved exhaust gas flow. Each system is fitted with a resonator, includes stainless steel flanges, and is finished off with a straight-through, low-restriction racing muffler for uninterrupted flow.
