A federal judge on Monday threw out a lawsuit by Elon Musk’s X that had targeted a watchdog group for its critical reports about hate speech on the social media platform. In a blistering 52-page order, the judge blasted X’s case as plainly punitive rather than about protecting the platform’s security and legal rights. “Sometimes it is unclear what is driving a litigation,” wrote District Judge Charles Breyer, of the US District Court for the Northern District of California, in the order’s opening lines. “Other times, a complaint is so unabashedly and vociferously about one thing that there can be no mistaking that purpose.” “This case represents the latter circumstance,” Breyer continued. “This case is about punishing the Defendants for their speech.” X’s lawsuit had accused the Center for Countering Digital Hate (CCDH) of violating the company’s terms of service when it studied, and then wrote about, hate speech on the platform following Musk’s takeover of Twitter in October 2022. X has blamed CCDH’s reports, which showcase the prevalence of hate speech on the platform, for amplifying brand safety concerns and driving advertisers away from the site. In the suit, X claimed that it had suffered tens of millions of dollars in damages from CCDH’s publications. CCDH is an international non-profit with offices in the UK and US. Because of its potential to destroy the watchdog group, the case has been widely viewed as a bellwether for research and accountability on X as Musk has welcomed back prominent white supremacists and others to the platform who had previously been suspended when the platform was still a publicly-traded company called Twitter.

This old folklore text I'm reading uses the term Scottish-Irish consistentently and it took me a minute to work out that it means Gaels (i.e. speakers of "Erse"/"Irish" in Scotland, in other words speakers of Gaelic, Highlanders) and not any of the three groups relatively commonly referred to by that term.

Mood board for my latest project. Little bit of it below the cut.
You eat the lunch you packed and pull off your sweater, the noon sun warming you up enough to not need it, at least for the moment. You putt along to a new spot and try fishing again, this time catching three good sized fish. Surprising, considering the time of day, but sometimes you get lucky. You're thinking about heading back home when you spot a flash of white under the water.
You grab your camera, determined to be ready. And then a grey shape launches out of the water and into your boat, nearly capsizing it. The white orca sluices through the water next to your boat a moment later, regarding you disdainfully with one bloodshot eye. He flicks his tail as he dives again, soaking you and your passenger.
Your seal friend makes himself comfortable at the prow of the boat, entirely too pleased with himself.
"You're on thin ice, mister!" You tell him, turning back the way you'd come. Thanks to him you missed your photo and nearly went for a swim in deep water. You're pretty sure he couldn't help you out of that situation even if he wanted to, especially with a hunter swimming just below. You certainly don't want four inch teeth biting you in half.
Of course, you don't want to see your friend get eaten in front of you either. You know its the way of the ocean, but he's your little buddy.
The white orca cuts across your path again. You stop your engine, heart hammering, and grab your camera. He disappears into the depths for a moment, and then jumps a little ways away. If you didn’t know better, you’d say he was showing off. You get several quick snaps that you know will be gorgeous— Water droplets catching the sun, his ghostly white body stark against the backdrop of the dark ocean. You grin at the seal, and yelp when something thumps the bottom of your boat, rocking it harshly.
Then the white orca (he needs a name, so you land on Ghost) surfaces next to you, terrifyingly close, and spits water at the seal.
“Holy shit,” you breathe, adjusting your lens for the close contact, camera shutter clicking away as you shoot pictures. Ghost eyes you, and then spits water a second time. The seal looks deeply offended, but not concerned, even with his hunter bobbing in the water a few feet away. “Aren’t you a pretty boy.”
He is pretty. A juvenile, maybe, now that you see him up close— He’s a bit small for an orca, but he’s all alone out here, no pod to speak of, and a juvenile wouldn’t survive on it’s own. As if he can hear your compliment, he creaks at you.
The seal barks back. He seems offended by Ghost’s presence. Understandable, since Ghost was trying to eat him earlier. You get a few funny snaps of the two of them regarding each other over the rim of the boat, having a conversation that you have no way of understanding. You feel a bit insane. A bit like you’re going to wake up laying in the bottom of your boat any minute, and this will all be a funny dream.

People have not been good to them#But in Western North Atlantic populations there's been more and more sightings since the 90s in the Maritimes#And lots of calves!! There's less pollution from farming run off in the northern areas so the population isn't experiencing the same-#fertility problems that some other groups of orcas do#and they seem to be more diverse in their breeding practices too which is good#there's a pod in the Southern hemisphere that's like Hapsburg levels of inbreeding#Although there are still some breeding problems all over just from being apex predators#lots of pollutants collect high up in the chain#That's why the resident pods on the West Coast of north america seem to do a bit better - They're primarily fish eaters#versus transient whales that tend to eat more mammals and other whales#People need to get their shit together about the ocean#Sorry what was I saying#I'm working on a novel version of this because there's a bigger story to tell but I still want to finish this fic version and post it#Sitting around 9k now but I'll probably finish it before posting just to avoid another WIP people want me to update chapters on lmao#anyway I should go do some chores or something

this is so entirely random but one thing i thing i wonder abt every once in a while is if there are any indigenous american emigrants like ones that have left the americas entirely. like indigenous americans in the uk or whatever. i dont even know of any hispanic mestizo british people…. i mean statistically im sure there has to be at least some of them right. however small the number. but ive like never seen or heard from them if they do exist… so i always wonder what that must be like. like how comparible is that to cultural diaspora in america. how much of your cultural identity do you keep with a community that small? and like the way that the majority of countries have at least some amount of black & east+south+west asian immigrants for the people to have exposure to even if not everywhere is as culturally diverse as america. but if youre british have you met all of those but just never met an indigenous american. or like any latin american. thats crazy to me
#i do know there are latinos in east asia japan esp but i feel like ive never seen them in europe#well besides like rich latina american influencer girls that move to italy and only speak english. thats not what i mean#i mean like actual communities and families earnestly emigrating and establishing themselves or whatever..#like i know theres some indigenous groups from other continents in the us. mostly from northern africa se asia and the pacific islands#but i guess in fairness i cant say i know of any aboriginal australians in america…#idk this mostly means nothing i have no point its just a shower thought i have sometimes#also i know theres a lot of black carribean immigrants in the uk but those are mostly from former british colonies right?

History of the Jingle Dress Dance
The Jingle Dress Dance began with the Mille Lacs Band of the Ojibwe Tribe in the early 1900s and became prevalent in the 1920s in Wisconsin and Minnesota (Great Lakes region) in the US and in Ontario, Canada.
The story is that the dress was first seen in a dream. A medicine man’s granddaughter grew sick, and as the man slept his Indian spirit guides came to him and told him to make a Jingle Dress for the little girl. They said if the child danced in it, the dress would heal her. The Jingle Dress was made, and the tribe came together to watch the child dance. At first, the child was too sick to dance alone so her tribe carried her, but after some time, the little girl was able to dance alone, cured of her sickness.
The dance has since been not only a ritual of healing but also one of pride.
What Do Jingle Dresses Look Like?
Jingle Dresses, also known as Prayer Dresses, are believed to bring healing to those who are sick. As mentioned above, the dance gets its name from the rows of ziibaaska’iganan (metal cones) sewed to the dress. These cones are traditionally made from rolled snuff can lids and hung from the dress with ribbon close to one another, so they make a melodic sound as the girls and women dance. Traditionally, the dress is adorned with 365 visible jingles, or cones. Nowadays, these cones are often machine-made.
The dresses come in every color imaginable, from yellow to bright blue, to deep red, and accented with sparkles and even neon-colored fabrics. They are often made with shiny and sparkly materials and decorated with fringes, embroidery, beading, and more.
They usually have three-quarter length to full-length sleeves and come down to mid-calf or the ankle. They are secured at the waist with a thick belt, often made of brown leather. On their feet, the dancer wears decorative moccasins embellished with the same kind of detail found on their dresses.
What are the steps for the Jingle Dance?
As the ziibaaska’iganan hit one another it sounds like rain falling, so it’s important for the dancer to be light on their feet, to move in time with the drum and stop when the beat stops. They keep their foot movements low to the ground while dancing, kicking their heels and bouncing on their toes to the music. Typically, this dance is done in a zigzag pattern, said to represent one’s journey through life—or so the story goes. Often, they keep their hands on their hips, and if they are dancing with a feathered fan (full of neutral colors, like eagle feathers) as the more modern Jingle Dress Dancers do, they will raise it into the air as they dance to receive healing.
The traditional Indian dance involves low, soft-footed steps, as could be performed by those who were sick, while the modern competitive dancers push the boundaries some as they try to out-dance their competitors. The manner in which the dance has evolved has built firmly on its origin story.
What are the songs and music for Jingle Dance?
The music for this style of dancing has a foundation of a solid drumbeat, and of course, the metal cones make a loud jingling (hence the name) as the women move, which contributes to the music you’ll hear at a Jingle Dress Dance. Jingle Dancers will usually dance to Northern drum groups. Special songs for Jingle Dance include a Side Step or Crow Hop
