Em 2019, foram cultivados 511,442 acres de cânhamo nos EUA, sendo o Colorado o maior produtor do país, mas estados como Montana, Oregon, Kentucky, Vermont, e Washington estão expandindo. O Colorado começou em 2016 com 9770 acres sob uma licença  acadêmica, mas mesmo com a passagem da lei federal Farm Bill de 2018, a confusão na lei e nas regras seguem causando ansiedade para produtores e agricultores de canhamo nos EUA e no resto do mundo.  

O DEA lançou regras essa semana ou a chamada “Interim Final Ruling (IFR)” que ameaçam a eminente indústria do cânhamo.  A regra criminalizaria “Work-in-Progress Hemp Extract (WiPHE)” (traduzindo: extrato em processo de extração) e o novo e badalado Delta8THC. Isso contradiz a lei Farm Bill de 2018 que removeu os canabinóides derivados do cânhamo da Lista de Substâncias Controladas, distinguindo estes (CBD, CBDA) da maconha com maior teor de THC que 0.3%. 

O Farm Bill antecipou a ambiguidade que envolve o WiPHE: Quando o cânhamo é processado, as concentrações de canabinóides aumentam e excedem 0,3% de delta-9 THC. A remoção das sementes e caules das flores ricas em canabinoides e da biomassa causa esse pico. Sementes, talos e caules são pesados, portanto, removê-los causa uma medição de 'peso úmido'. O conteúdo de THC não aumentou - está apenas mais concentrado. Este processo é inevitável. Também é lícito, porque as lavouras e o produtos devem ter 0,3% delta-9 THC ou menos. 

A IFR também afirma que todos os canabinóides sintéticos e derivados são ilegais (THC8).Mas a Farm Bill removeu todos os derivados do cânhamo da lista de drogas perigosas! Assim, ao dizer que todos os canabinóides sintéticos e derivados são ilegais (incluindo THC), a DEA contradiz a Farm Bill. Se esta regra for aprovada, terá efeitos graves no setor. Também demonstra como o governo ainda se recusa a fazer reformas ao THC, algo que lembra a fracassada Guerra às Drogas. ⠀

E o impacto em outros lugares como o Brasil, como fica? E o 1% maximo proposto no Brasi para produção de oleo? Como fica? Seriam todos ilegais sendo que os governantes e academicos que os aconselham nao consideraram essa nuance tecnica? Como que isso foi pro texto do PL sem essa vital peculariedade? Ahhh lembrei! A comissão foi a Canada, Colombia e Uruguay aprender como faz. 

A solução, seja nos EUA ou no Brasil, ou na Colombia fica a mesma: tirar a cannabis sativa da lista de drogas pesadas. Mas a confusão na lei favorece o lucro na transição e a vontade politica e da elite seguem mais fracas que a humanidade exige, e merece, por lei.

#Repost @nocohempexpo ・・・ "The U.S. Food and Drug Administration has begun to look into whether hemp-derived CBD is safe in food or supplements. #Repost @letstalkhemp ・・・ "Google will for the first time allow ads for some CBD products on its advertising platform, the company announced.⁠ ⁠ Google said in late December that it would update its ad policies on Jan. 20 to permit the limited promotion of pharmaceuticals containing CBD that have been approved by the FDA, as well as the promotion of non-ingested items such as candles and beauty products containing CBD, or cannabidiol.
