"Taylor-made deals: how artists are following Swift’s rights example"
- The Guardian 9/1/24 [excerpt]
Prince and George Michael are bleak warnings from history, but the moves by Swift, Rodrigo and others can stand as roadmaps for the future. It also means the music industry has had to adapt away from contracts based on ownership. There are two kinds of rights at stake here: the rights to the master recordings of an artist’s work, and songwriting rights, known as publishing. One senior music publishing executive says their part of the business was ahead of the curve, explaining that publishing deals tend to work on exclusive licensing terms or retention periods. “Publishers pivoted from a rights-ownership business to the servicing of rights,” they say. Those retention periods are getting shorter, they add, down from about 25 years three decades ago to between 12 and 15 years today.
David Martin, CEO of the Featured Artists Coalition, says there is “a propensity towards owning rights” for artists, but some acts are still prepared to sign away ownership for what they think might be their only shot at the big time. “We have members who are still signing major label deals,” he says. “Some of the terms in some of those deals are terms that we’d expect artists to be thinking very carefully about.”
Message [,Brian - a partner at Courtyard Management] says he steers acts away from ownership-based contracts. “We have a default position that we won’t advise our artists to do life-of-copyright deals,” he says. “It’s not that we wouldn’t do them, but our strong advice would always be to come up with a licence arrangement of some description.”
This is the ideological underpinning of BMG and AWAL (Artists Without a Label), which is now under the ownership of Sony Music Entertainment. “The philosophy is flipping the relationship,” says Alistair Norbury, president of repertoire and marketing at BMG UK. “There had to be a fairer and more transparent way to work with the creative community.”
Acts on BMG’s roster – notably Kylie Minogue, Suede, Sigur Rós and Louis Tomlinson – are on licensing or assignment deals, so ownership of the recordings eventually reverts to them. “They want to be with a record label where they have creative control and ownership coming back to them at some point,” says Norbury.
[..]
Norbury believes that, with more choices for acts, music companies have to repeatedly prove their worth and think about mutual gains rather than offering one-sided deals that are land grabs for all the rights. He says, “You want something successful in a longterm partnership rather than owning something that failed.”

Happy Birthday Long Gone John!
This week contained a load of election gloom. One way to beat it is by spinning one of the records that came out on the great Sympathy for the Record Industry label, headed by Birthday boy, Long Gone John Mermis! (November 13, to be exact.)
Long Gone was one of the first indie imprint moguls that offered New Bomb Turks a hoot, and he ended up releasing three 7" singles and included us on everyone's favorite trashy Xmas compilation, Happy Birthday, Baby Jesus (1993).
Tumblr media
It was an honor to be on a label that has released a mountain of wild, weird, wacky, and wonderful trash-rock since 1988, and sorta kinda still does sometimes...
I did a lengthy interview with Long Gone in my book, We Never Learn, as his import to the 1990s underground R'n'R milieu cannot be overstated. But I recently stumbled on this quickie article I did about him for the April, 2007 issue of CMJ New Music Monthly, when John was on the precipice of finally moving out of his beloved L.A., back in 2007.
I was Associate Editor at CMJ (College Music Journal) at the time, and this was for the monthly mag we were still producing. Since the whole company went kaput in 2017 and the website disappeared, you'll have to scroll down to page 9 here to see the story. But it's also kinda interesting to see what was going on in the indie world around then while scrolling through the whole issue. (My 2006 Best Of list is in there somewhere…).
Happy Birthday, Long Gone, and thanks!!

i’m confused about the relation between columbia, azoffs and harry? and sony?
Sony is a parent record label, they own Columbia, who Harry is signed to. The Azoffs are a powerful music industry family, who have business connections in a lot of things. Jeff Azoff owns a talent management company, who Harry is signed to for management. Jeff is his manager. Jeff's dad, Irving Azoff has been a music manager for decades, owns/owned a management company, has served and still serves on the board of many music industry companies like Ticketmaster/Live Nation, MSG and more. He's also started a record label before, which he sold, and now he started a new one.

In response, TikTok claims it has reached “'artist-first' agreements with every other label and publisher” and that “Universal's self-serving actions are not in the best interests of artists, songwriters and fans”
31st January 2024 By Surej Singh
Last night (January 30), Universal Music Group (UMG) published an open letter announcing its intention to withdraw music from artists signed to the publisher and label from short-form video platform TikTok, which has since responded in a statement of its own.
A short list of UMG artists whose music is expected to vanish from the platform is Taylor Swift, Bad Bunny, The Weeknd, Drake, Billie Eilish, Justin Bieber, Adele, Coldplay, J Balvin, Post Malone and Sophie Ellis-Bextor – whose 2001 track ‘Murder On The Dancefloor’ has gone particularly viral through TikTok following the release of Saltburn.
In its statement, UMG announced that its licensing agreement with TikTok expires today (January 31, 2024) and that negotiations to renew the contract have fallen short. According to Reuters, TikTok and UMG first reached an agreement in February 2021.

Hello, im wehaveagathering from my main blog, im kind of obsessed with your hockey poetry edits and I think your blog is great! I guess I kind of have a dumb question, where do you find the images you use for your edits? Did you say Getty in your tags?? I’ve gotten into making icons recently (and i have ideas for poetry edits hrrrghhh) but it’s hard to find high res images. Thanks for your time and I hope you have a nice day :)
first of all thank you so much 🥹 and second that’s absolutely not a dumb question!! i do pull a lot of images from getty and i’ll also download pictures from sports articles (i got a lot of the hugheses pictures from online access articles, for example), or sometimes from instagram/facebook/twitter if an account is public. freely admitting that i am not technologically advanced? inclined? in the slightest here, but the image editing software that you use and how you import/export photos with it makes a difference in the quality of them as well!
if you haven’t seen them yet, i would also recommend checking out @simmyfrobby @national-hockey-lesbian @hauntedppgpaints @tapedsleeves @starscelly and @captainbradmarchand’s blogs just off the top of my head!!! they might know more places to get high res images and also i love their work 💕🫶
#sorry can’t type hands all butterfly hearts i’m just out here like 🥰🥰🥰🥹🥹🥹😭😭😭💕💕💕#@ everyone i tagged ty i love you i hope you don’t mind the tag 😘 also i KNOW i am unintentionally forgetting people so tag them at will#forgive me i am eepy. we are running on <4 hours of sleep and over 18 hours awake 🫡#liv in the replies#join the club!!! join the club!!!!! we love the hockey poetry edits!!!!!! i’m so excited to see what you create!!!!! :)))))#the process of me finding images is very much like. either i have a vision in my head and i troll getty looking for it or my screenshots#if i know i have one l m a o but either way i am always 68 pages deep in a hyper specific search labeling my photos like ‘ohHHH buddy’#‘menace 1 abd 2’ ‘but he’s not a cup winner’ ‘ohhhh the nolpat media scrums are rich earth’#‘because WILLY WONT CUT HIS HAIR’ ‘deJA FUCKIN MILK BAYBE’ ‘is it truly sn edit if u don’t find a devastating baby pic’ ‘yes MF last line’#and so forth. like. glad it’s comprehensible to ME but if anyone else ever tried to use these photos based on file name alone i am so sorry#also i forget that y’all can’t see all of the metadata notes on photos to know where they’re from :/ i gotta be better abt making it clear#also on the note about image quality i just need to state for the record i am so photoshop whatever illiterate.#i learn one (1) new trick on GIMP a year maybe two if i am lucky & no i have never figured out consistent sizing 🫡 but the one hack for res#i HAVE figured out is that when i do edits i usually make a whole doc w/the poem lined up on it (helps me keep somewhat consistent sizing)#and then i export that document as a pdf and edit the pdf in the software instead of trying to screencap or jpeg or anything. PDF quality >#that is probably so convoluted lol if anyone has tips please lmk i am always learning#ANYWAY. rambling u did not ask for but is inherent to Me.#have a great day too!!!!! you literally made mine so 💕😭#wehaveagathering#indecisor
