Firen Lhain: Chapter 806: Clear the Air:  Part II / III
"The third item on the agenda," Aurora stated, "is that I have made a short list of Atlasian architectural companies who specialize in renovating and modernizing castles."
"I'd say go with the one who's most discrete." Jaune stated.
"Of course." Aurora said, matter of factly, as if that closed the discussion. Jaune then looked between everyone else.
"For national security?" Weiss asked.
"What?" Jaune asked, "Uh, maybe? One, we're living a non-traditional lifestyle, and two, I'm not fond of scrutiny."
"Undue scrutiny?" Weiss asked.
"Or any, really."
"What about teachers?" Ruby asked.
"Well, yeah, well, teachers, teaching, kind of have important things to say, but other than that, it's not their business."
"What is?" Nora asked.
"Is not." Ren interjected.
"Is not?" Nora asked.
"What do you have?" Jaune asked.
"Not much, it's like all yours, really."
"Other than certain things." Blake stated, looking at her ring.
"I believe he means," Weiss interjected, "he wishes to avoid ANY scrutiny."
"Maybe it has to do with having seven sisters who are always in mine, and everyone else's business." Jaune stated, "Or from having a father who... liked to keep The Man at an arm's length."
"Weren't you like, a knight?" Yang asked, and Weiss turned to her.
"That might very well be the reason why. Knights were known for their... independent personalities."
"To quote my father," Jaune stated, "what business is it of yours?"
"Friend-Nora?" Penthesilea asked, "You do not own any possessions?"
"Well, there's my clothes, and Magnhild, and the gun that General Ironwood gave me." Nora replied, "And my swimsuit. Wait, no, Weiss bought my swimsuit, so I don't think it's mine."
"Pardon?" Weiss asked.
"Well, if it's my swimsuit, why can't I wear it?" Nora asked.
"Oh, well." Jaune stated, "We've had a busy what, week? Has it been two weeks since I was kidnapped?"
"A fourtnight less two days." Aurora said.
"How many is that?" Yang asked, and then her eyes rolled up as she started to do the math.
"A dozen." Blake stated.
"Why didn't she just say that?" Ruby asked.
"It's an.. older..." Jaune voiced, "measure of time."
"Back from when travel took a good deal longer." Aurora added.
"Anyways?" Jaune asked, "I mean, I was kidnapped, we ended up with a castle, I was made an Earl, we have prisoners in our dungeon."
"A dungeon you ripped the bars off." Yang said giddily.
"Anyways-anyways." Jaune stated, "I figured once we had a castle we could just, like, suntan in the garden, and whatever, and... I'm in bed because I healed the woman who killed Pyrrha." The joy seemed to evaporate from him and he slipped backwards. Ruby and Blake laid their heads on his chest. Jaune's breathing became harsh, as if he were gasping for breath.
"Should we reconvene?" Aurora asked.
"No." Jaune wheezed. "Family... first..."
"If?.." Aurora asked, and then breathed in deeply, "if we first bought sheep, we could use the income to support further renovation efforts."
"But?" Jaune asked, "Minions?"
Weiss spoke to the group, "He wishes to prioritize the benefits of his... er... minions."
"Don't we kind of need money coming in to do stuff like that?" Yang asked, causing Jaune to let out a harsh, bellowing sigh.
"He does have a point." Blake stated, now sitting up to look over the blanket.
"Ugh." Jaune sighed, "Ffiinnee. Vote."
"Do we get a vote?" Nora asked.
"Of course you do." Jaune grumbled.
"I don't mean to impose," Ren stated, "but, we are minions after all."
Jaune grumbled as he slowly forced himself to sit up, Ruby and Blake deferentially moving to the sides.
"Ren," he said, with a tint of hurt of sorrow, "we've - we've been together since Beacon. We wouldn't be here without each other, how could you?"
Ren held up his hand and Jaune trailed off, "If you could?" he asked, and Jaune simply looked at him, "As we established, we are to be minions, servants, vassals, retainers, whatever term you would prefer to use."
"Nora seems to like minions." Yang stated, causing Ren to let out a subtle smile.
"Yes, she does." he stated.
"I believe he means, Sir," Aurora said to Jaune, "that he believes such matters should be decided by the family."
"Huh?" Jaune asked, "Uh?" he said, as he laid back down. "I hate that he makes a point. Fine, sheep first."
"And?" Nora asked.
"And the llama." Jaune stated, "And whatever facilities we need to raise sheep."
"And a shepherd, obviously." Weiss stated.
"And a shepherd, obviously." Jaune repeated.
"Last on the agenda," Aurora stated, "we should consider adding another hangar or landing pad."
"Assuming we'll be building an extra wall?" Weiss asked.
"Yes, Mistress." Aurora said, causing Weiss to develope a shocked look. "Sir has requested we add a number facilities that would require extensive additions."
"Oh, uh, yes, of course." Weiss stated.
"Considering." Jaune voiced. "If that's the last business, uh... family dismissed."

"So, tell me?" Winter asked from the pilot seat, "Why has General Ironwood chosen you for this assignment?"
"I was already assigned to aid and support her previous frame." Ciel replied.
"And why were you chosen for that assignment?" Winter asked.
"I'm afraid I do not know, Specialist."
"I'm sure General Ironwood saw something in you." Winter stated.
"I do not know what, Specialist." Ciel replied.
"Maybe you need more faith in his judgement of you?" Winter stated.

The jury-rigged proximity alarm sounded and Ruby Petal Burst out of bed. Jaune made to sit up but found Blake gently pushing him back to bed. She kissed him on the cheek. "Just leave it to us." she soothingly said to him. He grumbled but laid back down.

Weiss jumped out the window, followed quickly by Yang. She used a series of Glyphs to catapult Yang up the side of the tower, before catapulting herself as well. The two shot over the side as Winter's airship landed. "Sister!" Weiss gleefully exclaimed as she landed. The airship landed and the rear gangway opened up Weiss catapulted herself over to hug Winter, but had to deflect as Ciel stepped down the gangway. She stood at attention and saluted. Weiss rebalanced herself and walked out. "Hello?" she asked.
Ruby Petal Burst onto the roof in her underwear before Petal Bursting back inside, passed Blake, also in her underwear who was flattened against the outer wall of the guardhouse. "Ciel?!" Ruby asked from inside the guardhouse.
"Cadet Ciel Soleil!" Ciel replied.
"What's a cadet?" Yang asked.
Weiss then turned to her, "Those at Atlas Academy wishing to joining the ASOC unit."
"They are given additional military training." Winter stated as she reached the bottom of the gangway.
"Okay?!" Ruby shouted from inside the guardhouse, "But, we're not like, military here."
"Not in the slightest." Winter said with a slight light blue flush.
"Your visit was... unexpected?" Weiss asked, "How are you doing, Sister?"
"General Ironwood has classified all information about this location as Top Secret." Winter replied, "All flight logs and communication reports, along with providing encrypted communications protocols, allowing you to hide your location."
"Yes, well," Weiss replied, "after what happened, that seems sensible."
"And I am doing well, sister." Winter said with a slight smile.
"And, uh, Sunshine?" Yang asked.
"Cadet Soleil." Ciel stated, still at attention.
"Yes, well," Weiss said to her, "Yang is fond of nicknames." She then offered Ciel her hand. "Weiss Schnee."
"It is an honour to meet you, Huntress." Ciel said, as she reached forward to shake Weiss' hand.
"Now, just so you know, we are not military here, and Jaune-dear is not fond of ceremony."
"Is he in charge?" Ciel asked, causing Yang to snicker, along with Ruby from inside the guardhouse.
"Pater familias." Winter stated, "And older practice that makes sense in this context."
"And this context is?" Ciel asked, "If you don't mind my asking."
"Five-way." Yang said.
"Five-way what?" Ciel asked.
"They..." Winter said and paused.
"We have an alternate lifestyle." Weiss stated, and then turned to Winter, "Is she your understudy?"
"She's Penny's friend!" Ruby shouted from inside the guardhouse.
"I was on her team, until her demise." Ciel stated, "General Ironwood has asked me to assist her however I am able." Ciel stated.
"Sorry!" Ruby shouted, "She's Penny's Weiss."
This caused Yang to start snickering.
"I do not believe she meant it that way." Weiss added. "And our relationship has improved dramatically." This cause Yang to keel over with laughter. "Yes, well, Ciel?" she asked.
"Cadet Soleil." Ciel stated.
"Ciel?" Penthesilea asked, as she landed on the tower roof.
"Ms. Polendina." Ciel said to her.
"I am afraid my friends are not so fond of formality." Penthesilea stated.
Ciel then saluted her. "General Ironwood has asked that I assist you."
"Yeah?" Yang asked, "General Ironbutt doesn't get to order us around, here."
"He explicitly stated it was a request, and if I refused it would not affect my graduation at Atlas Academy."
"Uh... huh?" Yang asked.
"And his name is General Ironwood." Ciel neutrally stated.
"My mistake." Yang said, trying to hide her smile.

The development of Law’s relationship with Zoro - Part 5: Zou, The Kindred Spirits (Searching for Nakama)

Crossing the open gate, Zoro and Law kept exchanging their observation. Trafalgar noticed the gate was snapped off the hinges.

to which Zoro replied “good point” and added another detail, the destruction of the road ahead.

Once it became clear something was definitely off about the place and the group may meet unfriendly forces ahead, Zoro with his killer smile advised to be careful. Despite his own words, Zoro, Law and Robin didn’t show any worry, in contrast to Franky and Usopp getting their weapon ready to strike at any moment.

Once again, Zoro and Law talked freely, exchanging observations and explanations while staying close to each other. Both led the group and noticed the upcoming danger before anyone else. They grabbed their swords, ready to fight:

Zoro said he will deal with the enemy and Law did not protest nor try to interfere (even when soon after that Zoro was kinda electrocuted). What seems to be a sign of respect and trust for Roronoa’s fighting skills.

The skirmish with Carrot was stopped by Wanda. The female Mink didn’t have time to explain what is going on, but told them where to find the rest of Straw Hats (chapter 805):
“We don’t have time to take youteia there!! Just follow my instructions!! On the right is Rghttrump Forest! Head there and turn left at the deep dark swamp! From there, you’ll find yourteia crew’s corpse is ahead in Rightflank Forest!”
The mention of the corpse led the group to be shocked and worried (though Law’s expression was again omitted). Here is time to talk a bit about “suffering” of Usopp who were unlucky to stuck in group with three “dark” characters:
Robin with the macabre imagination and talking non stop about potential cannibalism as a fate that could happen to their friends
Law with his deadpan commenting how navy admirals were now after Usopp’s head knowing full well the younger pirate will be scared as hell
Zoro - similar to Robin - has a tendency to like dangerous and terrifying stuff and to smile at the mere idea of fighting deadly opponents but also scares time after time Usopp with his comments or logic (seen especially in Enies Lobby).
Law, Zoro and Robin have this nice but dark similarity which may explain why in their little group, Usopp stood out from the rest. The majority of the team was in fact the stoic, cool-headed and dangerous beings.
Zoro in the end shut down the rising panic by reminding his friends that Sanji was with the missing Straw Hats and he would not allow anything bad to happen. Reassured by that, Robin asked Law about his own nakama, who were supposed to wait on Zou for him.

Law admitted he didn’t think he would ever see his crew again (what should be worrying on itself, but thankfully, Dressrosa was behind them already).

Bebo’s vivre card was untouched, thus Law’s navigator was fine and safe. He explained who Bepo was and that the polar bear left Zou as a kid, so didn’t remember much about this place. Law voted for Bepo as someone he knew for 10 years and that Mink could be trusted. This was one of rare moments in which Law shared information from his past.

Law proposed to head straight to Bepo, to learn what was going on there. Usopp was concerned they would have to pass through a potentially dangerous town but Zoro decided to trust Law’s word about Bepo. After all, it was better than trusting some strange animals.
Law voted for Bepo and Zoro did not question the polar bear’s trustworthiness, even though so far the interaction with the Mink Tribe left a bad impression - an attack out of nowhere and then Wanda talking about the corpse of their nakama.
The poor state of town again raised a question about what happened on Zou. The group examined the deserted buildings and saw devices of tortures. Law pointed out to giant footsteps suggesting either the Mink Country was invaded by monsters or huge animals or some infighting happened not so ago.

↪ Once again, Law and Zoro kept close to each other even though a moment ago everyone was examining the place in a more individual way. The previous group shot had Law standing far away from the rest.

The group came to the conclusion that whatever happened brought the country to swift, dramatic collapse just a week or two ago.

Usopp was overwhelmed by all the revelation. The rest of the group didn’t show any clear sign of worry, even though their friends could be in danger. Not only Straw Hats, but Law’s own crew too. Law and Zoro still were in close range of each other.
Then out of nowhere, a giant wave of (sea) water enough to cause a flood fell from the sky (chapter 806). Robin advised everyone to head for higher ground...

but the next panel showed their current place to be literally flooded. That and the additional bubble speech suggests the group did not manage to run away before water fell on them all.
Manga did not provide an explanation how exactly the group got on higher, safe ground. It was shown only they survived and were more or less okay.

At the same time, everyone was wet - what could be seen very well in anime (episode 755) while in manga especially on Law and Robin. Those two panels imply that the group was not without contact with sea water. As the devil fruit users, Law and Robin were the most vulnerable in such a situation (would Room even work then?, I wonder...).
Because of four pages of break between the first frame and the next (thus the perception of time disturbed), it is impossible to tell for sure if these two needed to be saved from drowning or not. Yet, knowing the caring nature of Straw Hats, it is highly possible others would secure their vulnerable companions even if the situation did not call for such measures. Also, Franky has this protective instinct about Robin’s well being, so he most likely would be saving her in first place - what means Law had either Zoro or Usopp to depend on. Considering A) Zoro’s protective nature toward drowning devil fruit users [Luffy and Chopper especially] and B) how close lately he and Law were, I think Roronoa would be the one dragging Trafalgar to safety.
From the high tower, Usopp spotted Straw Hat… who seemed to be bitten by Carrot.

A nice detail - Zoro (black backpack) and Law (the long sword) again were shown closer to each other than to anyone else.
Trafalgar used his powers to switch places, so the group could meet with Luffy. Looking how ungraciously the Straw Hats were falling, he either did not warn them in advance or the shambles technique had that effect on people, especially used on them for the first time.

In all fairness, I’m not sure if Zoro managed to land well in the manga - anime made him and Robin be the only ones from their crew to avoid the fall. Whatever the case, Zoro did not verbally attack or complain for the way Law transported them all. In a way, Law’s idea of fast transport was as bad as Luffy’s.
Once the group reunited with Luffy, Law was sidetracked into more background character. It was visible especially when Usopp started using Zoro (while pretending to speak as him) to scare off the Minks.

Law’s reaction “disappeared” behind bubble speech, so it is impossible to say what he thought about Usopp’s antics or that Pirate Hunter allowed Usopp to act this way. Still, looking at frame composition - with Zoro as central figure in the foreground - the Straw Hats were on his left side while Law, alone, on right.
Finally Straw Hats met their missing crewmembers and for the first time saw all the Minks, alive and happy to see them. The view of hideout and Minks reaction shocked/surprised all newcomers. When Zoro was asking Wanda about Minks supposed hatred toward humans,  Law again A) was hidden by bubble speech and B) stayed close to Zoro’s right side while keeping distance from other characters.

While Straw Hats celebrated the reunion with Mink Tribe (and slowly learning what happened to Sanji and the Minks) Law went to see his crew (chapter 807).:

The genuine smile contrasts a lot with the constant frown seen on his face for almost all the time, even with befriended Straw Hats.
At the same time, Zoro got angry at Minks invading his personal space to fawn. This contrast to the drinking scene after Dressrosa, when he didn’t mind throwing his arm around Law’s neck, thus having little to none space between them.

With the next chapters, the focus of the story switched to events happening during the Straw Hats separation (Kaido’s men attacking Zou in search for another samurai, using chemical weapon against Minks and torturing them for days and how Sanji’s group saved the devastated Tribe and what happened to Black Leg). Along the way, Luffy and his crew met two local rulers: King of the Night, cat Nekomamushi and King of the Day, dog Inuarashi.

Suits, Season 8, Episode 6 - "Cats, Ballet, Harvey Specter" - Review/Recap/Spoilers
#Suits - Season 8, Episode 6 “Cats, Ballet, Harvey Specter,” Review/Recap/Spoilers

Last week’s theme was ‘family,’ this week it was ‘friendship.’  I’ll say it…this was NOT one of my favorite episodes!  There were some good scenes, but the show seemed to drag.  I usually say it’s the fastest hour on TV but not this episode.  #SorryNotSorry 
The majority of the show Harvey seemed pissed off at Louis, Donna and Samantha were at each other’s throats, Louis having baby-on-the-brain, and Katrina and Brian getting a lot more chummy.  I was really looking forward to this episode because, well, Louis and Harvey going to “couples counseling” – who wouldn’t want to see that?  I mean the two actors were great last week with their bantering, but when they go to see Dr. Lipschitz all they end up doing is yelling at each other and Louis storming out of Lipschitz’s office.
Harvey, who we saw on the phone with his brother is informed that Marcus and Katie were getting a divorce despite Harvey’s work last week.  Then Louis walked into his office telling him that Harvey’s oldest client, McKernan Motors was leaving the firm because Dominic, the owner, wanted to sell.  Meanwhile, Donna walks in to tell Louis that one of his oldest clients, Joan Walsh had an emergency and is waiting to talk to him.  Louis pawns off Joan’s emergency to Harvey because he had to go have sex with Sheila.
As for Louis pawning off a client to Harvey and a case to Katrina just to make time to have an “afternoon delight” (as Harvey put it) with Sheila is seriously unprofessional.  And I’m so done with his storyline.  In my opinion, when you add a baby it’ll kill the show.  It’s happened before.  But to each their own.
Harvey goes to see Lipschitz without Louis and it turns out that Harvey is upset because Louis now has something that Harvey doesn’t; and that is a woman in his life (Sheila) and they are trying for a baby.  Once that happens, Harvey basically won’t be the center of Louis’ world.  Harvey tells Lipschitz “they all leave”.  He tells Lipchitz, “Because they all leave.  Everyone leaves, Mike, Rachel, Jessica, my sister-in-law…everyone.”  My heart hurt for Harvey!  I love vulnerable Harvey and the strong Harvey.  Oh but how I want Harvey to continue to see a therapist to get the help he so needs (and not end up sleeping with the therapist!)  I’ll also admit that the scene between Harvey and Louis in the bullpen was cute; where Harvey tells him, he was afraid of losing him.  Louis accuses him of pulling a Litt and that they are “brothers from another mother.” That made me laugh, and Louis was ok in my book again.  Thanks Harvey!
I would have rather seen more of the case of the social media star Harvey goes against for Joan!  The case is about a 16-year-old social media darling named Daisy Jones who has 50 million followers.  In this social media-crazed day and age, this case would be fascinating to watch.  The case is basically that Joan’s company produced a concealer which caused an allergic reaction to Daisy’s face.  Daisy was played wonderfully by Ava Allan; she went toe-to-toe with Harvey stating because of her 50 million followers she can be very influential and potentially cause his client to lose more than the $10 million she wants.  I hope the writers continue this storyline because it would be interesting to see this play out since it is relevant these days with all the Kardashian-like social media fame.
Katrina picked up Louis’ case because Louis told her it would improve her chances to be the next named partner.  Because, according to Louis all the partners needed to vote on it and there has been one partner holding out, the infamous Paul Porter.  Katrina recruits Brian to help her, and of course, he does whatever she needs.  They are cute and funny together and seem very comfortable together; sometimes a bit too comfortable.  Donna walks into the library where Katrina and Brian are having a working dinner.  She doesn’t interrupt them when she sees an innocent gesture of Brian wiping sauce off the side of Katrina’s face.  Donna immediately thinks there is something more than just friendship.  She talks to Katrina the next day indicating the ‘heart doesn’t always listen to the brain,’ Katrina gets paranoid thinking that her actions with Brian are being perceived as something more than friendly because maybe she does like Brian more than she was ready to admit.  I hope they don’t couple these two for anything more, except as colleagues and platonic friends, especially since Brian is a husband and a new father, but I guess we’ll have to wait and see.
And saving the best for last…Donna and Samantha.  This storyline and the social media case were two of my favorites tonight!  I will say I’m beginning to like Katherine Heigl’s character!  My husband still doesn’t trust her.  [Yes, we have discussions about Suits, and debates about Samantha Wheeler.  He is such a Donna fan!]  Donna was skeptical of Samantha from the beginning.  Who wasn’t?  However, in “Cats, Ballet, Harvey Specter” the two ended up working together to take down the head of a charity.  Donna had a pro-bono case for a close friend of hers’ charity for underprivledged girls, she wanted Alex Williams to handle, but he declined because he was too busy.  He talks to Samantha about it, and Samantha agrees, she even gets one of her clients to donate $5 million to the charity.  That impresses Donna enough to assign the case to her, but she still doesn’t trust Samantha.  Samantha goes over the charity’s files and realizes that something isn’t right.  The charity seems to be spending more than what is usually spent on galas and such.  She tells Donna who said she was sure it was just an accounting error, and she would ask her friend Peggy.  Samantha insisted there was something more than a simple explanation, but promised not to do anything until Donna spoke to her friend. 
However, Donna and Samantha are similar because neither would be able to sit on the sidelines when they know something bad is happening or when someone is being taken advantage of, especially when that someone is someone they know and care about.  In this case Donna’s friend and for Samantha a charity whose cause she cares about.  So I knew the moment that Donna told Samantha not to do anything until after she spoke to her friend that Samantha was going to do something.  I was shocked that Peggy got fired!  But in the end, Donna and Samantha worked together and had the head of the charity to step down and name Peggy as his replacement.  I would love to know more about Samantha’s background; we’ve seen a little last week when she mentioned to Alex’s daughter that she didn’t have anyone to influence her in her life when she was young, and in 806 she and Donna were going to go for a drink where Samantha said she was going to start trusting.  I would love to see that scene!  Hopefully, there will be more Samantha/Donna scenes to come this season.

episode two mirae  confessional 806 words
mirae still wasn’t so used to the confessional format. she liked talking about things, but guided talking was really strange. and she especially wasn’t looking forward to it this week, what with her outburst at chanmi. she knew they’d ask about that.
she entered the room, sat down where she was supposed to, and let a stylist fiddle with her hair and makeup until the producers were happy. and then she was prompted, as per usually-- first, about the format of the second episode.
“this week was insane,” mirae admitted, shaking her head and sighing deeply. “when i watched last season, and they had to learn five songs only for one to be randomly picked, i thought that would be so hard, but we had to learn eight. and it wasn’t just a performance, it was a competition too. it’s like every season, they make the second episode harder and harder. like they start out with a pretty easy thing, like hey how about you perform for us something that you’ve probably practiced a billion times in your studio have fun, and than bam-- all of the sudden they’re like okay so learn eight songs and make sure you’re coordinated with five other people and if one of them messes up, they mess you up too. like....how are we supposed to process that. i’m pretty confident in my skills and i was losing my mind-- did the producers even think about how hard this would be for someone like taeha? ......though she did really good. much better than i expected. she didn’t break anything, and that’s super great.”
as she was asked about her team, her eyebrow twitched a little and she sighed again. “um.....for the most part, my team was pretty great. hana and i get along really well, and she’s really talented. yena is great too, and she helped me a lot when it came time to learn choreography and make sure everyone in our group knew it too. taeha is super sweet; she may not be the most talented trainee here, but she tries harder than anyone, and she’s always so positive. she could get run over by a train, and she’d bounce right up and talk about how she just needs to shake it off and keep going and she’ll improve. it’s amazing.” she ended it there, hoping the producers would just drop it, but she knew that hope was in vain. 
when asked about chanmi and their disagreement, mirae slumped a little in her chair. “okay, listen......” she finally said, tucking a stray lock of hair behind her ear. “now isn’t the time to get all cushy and sweet, so i’m not going to try to spare anyone’s feelings-- she really isn’t so good. like, she has base talent and potential, but she thinks she’s like........sara or peach or something, and she’s so not. not even on the same level as them. some of the parts in our songs required some real complex vocals for the main vocalist positions, and like....sorry to be rude, but she couldn’t do it. no matter how good she thinks she is, hana is ten times better. when we’re preparing for a challenge where it’s sink or swim and if someone messes up, we all go down? we can’t be delicate about feelings. we have to give the advanced parts to the people who can handle them. taeha understood it fine, and so did the other girl-- chanmi pouting and pitching fits and being a big baby about everything was unprofessional, incredibly hard to work with, and just stupid. and after two days of that dumb stuff, i got tired of it. i wasn’t going to put up with it for the rest of the week, so i drew a line in the sand. i mean......to everyone who thinks i did the wrong thing-- this is a competition. some of us are friends, but we didn’t come here to be friends. we came here to make it to the final group. that means doing everything we can to nail challenges, and if nailing challenges means you have to tell someone they aren’t as good as they think they are? it needs to be done.”
when she was done ranting about chanmi, the producer then prompted her on the performances. “i don’t know what to say. i think i did really well. i was better on the second day than the first. not knowing the points yet sucks, but anything for ratings, right? no one in the audience there saw my fight with chanmi, so i think i’ll come out of things pretty okay. i just hope all the people voting from home can see my side of the story and don’t judge me to harshly on what happened in the studio.”

Official acts, officious acts and bloody shoe tracks
(Here is the latest edition of the Institute for Justice’s weekly Short Circuit newsletter, written by John Ross.)

New trial for former New York state senate majority leader and his son, says the 2nd Circuit. Could be they were corrupt, but the jury that convicted them in 2015 was given an overbroad definition of what “official acts” might fall afoul of the law. (In 2016, the Supreme Court vacated the conviction of former Virginia governor Bob McDonnell over said overbroad definition, a result that controls this case.)
After the housing market collapse, the feds brought 16 enforcement actions (in the Southern District of New York) against financial institutions that sold certain mortgage-backed securities to Freddie Mac and Fannie Mae and allegedly overstated their quality; 15 defendants settle, paying a total of $20 billion. Second Circuit: The 16th failed to disclose pertinent info to Fannie and Freddie, so the remaining defendant’s sale of mortgage-backed securities is reversed, and the $806 million purchase price must be paid back.
Federal law: States are allowed to remove convicted felons from their voting rolls. Plaintiff: That means states have to remove them. Third Circuit: Your argument “mangles the statute beyond recognition.”
University student accuses another student of sexual assault, which he denies. All evidence is hearsay. University: He’s suspended for a year. Sixth Circuit: He can go back to school while the case proceeds. He should have been able to cross-examine the accuser (by submitting questions to the disciplinary panel, which would ask them of the accuser if deemed relevant).
Illinois’s “full-slate requirement” bars the Libertarian Party from running candidate for county auditor without also fielding candidates for other positions on the ballot, including coroner and school superintendent. Seventh Circuit: The rule excessively burdens ballot access for “minor” political parties (“incentivizing [them] to manufacture frivolous candidacies as a means to an end”) and violates the First Amendment.
Campbell, Wis., police chief persuades town officials to ban private signs on overpass lest they distract drivers below. Annoyed with protesters continuing to protest there and for posting videos online of police removing them, the chief posts protester’s name and email to porn, gay dating websites. They order him to drop the gun; an officer shoots him dead as he turns toward them. Turns out it was a toy gun. Ninth Circuit (over a dissent): No qualified immunity at this point; a trial is necessary.
Man believes he is having sex with 14-year-old in Cambodia, brings video of it to the United States. He’s caught. Man: Turns out I was mistaken about her age; she was an adult when the video was recorded. Ninth Circuit: Even if that’s so, you still attempted to bring child porn into the states. Conviction affirmed.
Judge has a moment of “revelation” and grants summary judgment on grounds not raised by the parties (without telling the parties the plan). The 10th Circuit reveals that he’s not allowed to do that.
“This is a tax case. Fear not, keep reading,” says the 11th Circuit, concluding that the Internal Revenue Service did not violate the Constitution by denying deduction claimed by gay man for in vitro fertilization as a medical expense.
Man kidnaps child from Bay Minette, Ala., day care after robbery attempt, is given two life sentences. (The child is unharmed.) Man: As the state concedes, my crime had nothing to do with sex. I shouldn’t be classified as a sex offender and forced into therapy. Eleventh Circuit: State law says kidnapping a minor is a sex offense, so tough.
And in en banc news, the D.C. Circuit will not reconsider its ruling that D.C.’s near-ban on guns, whereby carrying in public is prohibited unless the police chief perceives an individual has a good reason for it, violates the Second Amendment.
When Jack Roundtree pulled his food truck into Green Cove Springs, Fla., after Hurricane Irma, he intended to serve lunch to hungry residents with few other options and even give away his BBQ for free to utility workers. Sadly, officials shut him down because he had not first obtained a permit from city hall, which was shuttered. Ridiculous! But it’s also sadly common for cities to force mobile food vendors to jump through crazy hoops. In Baltimore, for instance, food trucks can lose their license if they park within 300 feet of a restaurant that sells the same type of food once too often. What counts as the same? It’s frustratingly open to interpretation. Fortunately, Baltimore food-truck owners are fighting back, and last week at trial they argued that the only reason for the rule is to protect restaurants from honest competition.
