"Cases Are Heard by Napanee Magistrate," Kingston Whig-Standard. May 7, 1934. Page 2. ---- William Mowers Given Fifteen Months' Sentence - Other Cases --- Addressing William Mowers of Selby. who appeared in police court on Saturday morning on two charges, on a breach of the Liquor Control Act and the other a breach of the Excise Act, Magistrate Graham said in part:
"On September 27th last you came home from the Ontario Reformatory where you served several months and you told me at the time that you were through with crime. However, it was not long before I received several complaints as well as letters stating that you were again peddling moonshine or illicit liquor and there was no care taken as to whom it was sold. These acts of yours have prov- ed a lot of inconvenience to people and the officers of the law have had considerable trouble.
"This peddling of moonshine is a dangerous procedure, as the contents are not in any way tested. Our laws are such that one does not have to do what you did."
In conclusion the Magistrate said: "Mowers, you are a menace to the public and it will be my duty to take you from society for a considerable period, and under no circumstances you should receive no consideration.
"On the breach of the Liquor Control Act you will be fined $100.00 and costs and in default of payment, three months in jail, and on the breach of the Excise Act you will be fined $400 and costs and three months in jail and if the fine is not paid an additional nine months, or a total incarceration on the two charges of fifteen months in jail. The sentences are to date from April 21st, when the accused was taken into custody.
Mr. Bolstead of the R.N.W.P. was present for the case.
Mowers was taken into custody on April 21st, and before sentence was pronounced, previous convictions against him were read. There were three as follows:
A breach of the Excise Act in Deseronto in 1925, the accused receiving 30 days in jail, a charge of assault, the accused receiving five years suspended sentence and a combined charge of assault and a breach of the Excise Act, Mowers being given two years less a day in the Ontario Reformatory.
A resident of Strathcona, McRorry, who was taken into custody by Provincial Officer F. W. Barrett a few days ago on an alleged serious charge in which his eleven-year-old adopted daughter is concerned, appeared and was remanded for one week as the Crown was not prepared to proceed with the case.
Traffic Case The magistrate also heard a highway traffic case preferred by Traffic Officer L. O. Rawlins. On Saturday evening, April 22nd. Mr. Austin Kimmerly, who resides about four miles west of Napanee stated that he was crowded to the soft shoulder by a transport as the result of which his car went into the ditch. The alleged driver of the transport was Ernest LeGender and he was charged with driving a motor vehicle in a manner dangerous to the public.
Mr. Kimmerly stated that had his car stayed on the highway the trailer, which was attached to the transport, would have struck it. Mr. Kimmerly said that he did not know who owned the transport. There were several witnesses and one Bruce Wagar, said that although he saw nothing happen, the name of the transport was Motorways.
Nichola Dioheo, who was driving east at the time saw the truck cut in front of Kimmerly's car and his evidence was corroborated by his wife. Traffic Officer Byles was expected to give evidence but did not put in an appearance so the Magistrate adjourned the case for one week.
Assault Case Alfred Sutton, an employee of the Strathcona Mill Paper Mills, was convicted of unlawfully assaulting another employee, Herbert Fox on April 30th, and was given a suspended. sentence of six months and to pay the costs, which amounted to $11.25.
The magistrate remarked that the case was a petty one, but at the same time fully explained the interpretation of the Code with respect to assault. "A threatening manner constitutes assault," said the magistrate.
The whole trouble arose over the fact that Sutton accused Fox of pulling the steam down and words led to tapping on the shoulders, after which Fox said that Sutton had struck him, which Sutton denied.
Clarence Baldwin said that Sutton had roared at Fox and he saw Sutton strike Fox. Fred Baker also heard loud talking and saw the men tapping each other.
Three witnesses were called by Sutton, namely George McGarvey, Russell Clodd and Arthur Patrick and none saw any blows struck, but all saw the shoulder tapping.
The magistrate advised the men that when any trouble again developed at the mill, it would be better to inform the mill owners, as people could not take the law in their own hands.

i like to think that prester likes getting scratched behind the ears (something something dragon instincts) but is very embarrassed because (1) the inherent "wanting to be pet like an animal" and (2) most people are much shorter than him.
and at some point, cosmo and him were having a convo along the lines of "you know i could just do that for you if you were shorter" which led to prester lying down on cosmo's desk, very embarrassed but also very happy
anyway i love gay men
