Even though Hermione had known it would've been better not to come along with Martin to his parents, she had done so. And so far she was not regretting it. She had always liked his family and they had been kind so far to her. Unfortunately, it meant that they would have to share a room once more and that was the exact reason why Hermione was currently leaning against the doorframe that gave access to the shower. The one that she had been wanting to use but where Martin was already standing right now. "You know... If you are trying to get in my pants, it is wise to next time not start with the fact that I snored. Which I don't by the way, you keep hearing yourself. So no, I am not going to remind you of our late mornings." She had gotten into some meetings with high end people of the ministry quite late sometimes when she was still together with Martin. And even though they were not together right now, it did not stop her from watching the naked man under the shower right now. Yes, they broke up, but that did not mean that she was immune to the man she had called her own for quite a few years. Both their jobs had been a reason of them breaking up in the end, a decision they had made together. "I'm happy the house is sound proof, otherwise your parents wouldve woken up from the snoring as well." Hermione pushed herself away from the doorframe so she could walk into the bathroom so she could get in front of the mirror so she could start her morning ritual of brushing her teeth. "Will you hurry up with that shower, I want to use it as well. Without you in it."

Martin had just stepped into the shower, waking up in his parents guest room in Atlantic City. She'd surprisingly enough agreed to coming along, even though they had ended things on not the best terms a few weeks earlier. "I forgot that you snored like an old man," Martin teased, running his hands through his hair in the shower. He looked over at her through the glass door framing the shower, "Will you also remind me why I always seemed to be late for work whenever we started our days together?" He teased, challenging her to join him in the shower. Nothing had happened that night, he'd promised to keep his hands away from her, but why not spice things up a bit, now that they were already here? "And don't worry - this house is as sound proof as it can get," he pointed out, in case she was worried his family would hear any noise from their room.

Marriage of Expedience

Summary: Regardless of what anyone says, Hermione Granger wouldn't get married just to obtain a proxy vote in the Wizengamot. After all, she's a war heroine and an honest and hard-working Ministry worker. People and papers shouldn't be allowed to go around insinuating that she'd exploit the sanctity of wizarding matrimony and the entire legal system simply for the sake of passing a few revolutionary pieces of legislation.

Obviously, she eloped with former Death Eater Draco Malfoy because of her... hidden domestic side.

JKR really could’ve done with throwing at least one successful wizarding/muggle couple in there…

as much as i hate to say it, i actually quite like that wizard/muggle mixed marriages canonically don't really work, whether or not it was an intentional decision from jkr to present it this way.

the wizarding state is really quite authoritarian, and the sole motivation for its repression is to prevent muggles from learning about magic's existence. it also seems to have social mores - especially around gender - which are much more old-fashioned than those in 90s britain, which is only to be expected from a small, insular community.

the only plausible theory we can draw from canon is that - while this might change post-war [hence ron taking a driving test] - living in the magical world means separating yourself entirely from the institutions of muggle society. unless you actively insist upon it [which is my theory about ron learning to drive - i think hermione makes him as a point of pride in her muggle heritage], you don't have a passport, or a bank account, or a national insurance number [so you can't work in the muggle world], you don't use the nhs, you don't have any muggle-recognised qualifications, and so on...

everything you might do which would generate a record with the muggle state - getting married, buying a house, having a baby, etc. - has its own parallel system in the wizarding world.

[to the extent that - surely - a witch who marries a muggle man in a muggle ceremony isn't legally married in the eyes of the wizarding state? tom riddle might be a legitimate heir in the muggle world and a bastard in the magical one...]

and while we know there are wizarding agents embedded in muggle institutions [from snape saying in deathly hallows that petunia's letter to dumbledore must have been intercepted by undercover wizards working for the post office], their purpose isn't to facilitate cross-community interaction... it's to contain breaches of the statute of secrecy and stop muggles finding out about magic.

as a result, i think it's really likely that muggles married to witches or wizards have literally no rights in the magical world. and i think that opens up two ways of thinking about mixed marriages which are worth exploring:

firstly, that the number of abusive magic/muggle relationships must be enormous - and not just because of the violence the power imbalance caused by magic has the possibility of inflicting, but because the muggle partner has absolutely no hope of having their abuser face justice.

[after all, i guarantee that the only thing which would happen if a wizard was arrested by the muggle police for assault is the state's obliviators swanning in to wipe the memories of everyone involved... there's not a ministry worker we meet in the books who seems likely to think that muggle women's rights were more important than upholding the statute of secrecy...]

and secondly, that there must be plenty of non-abusive magical/muggle relationships which end up being impossible for the people involved to sustain because it's just too difficult to deal with the restrictions placed upon the couple by the wizarding state.

the complete legal separation between the two worlds - and the implied difficulty this causes in making it possible to form cross-community relationships - is one of the really subtle, insidious ways that the ministry maintains blood- and magic-supremacy, which canon hints at but never really delves too deeply into. and so i think it's worthwhile for us to take that and run with it...

They’ve done it a few times on shared projects, holing up in her office or his, and quickly fall into an easy rhythm. Every time she sneaks a glance, he’s conveniently looking elsewhere.

At the final table, he shakes one close to his ear. “So what’s inside? They’re light.”

She hurries over to him. There’s few enough people around that the surprise won't be ruined if she gives him a peek, and the prototypes were perfect.

“We’ll have to be quick.”

A sly smile pulls at his lips, and he holds one end towards her. “On three?”

Post-War Revelations

The atmosphere in the Burrow's kitchen was a mix of relief and exhaustion. The war was finally over, and the Weasley family, along with Harry and Hermione, gathered around the worn-out kitchen table. Mrs. Weasley had just served a hearty meal, and as everyone settled into their seats, Ron couldn't help but break the silence.

"So, what has everyone been up to lately?" Ron mumbled as he stuck his fork into a roasted potato.

Percy, who hadn't spoken a word since he came home with the rest of the family after the battle, cleared his throat. "Actually, I've got quite a bit to catch you all up on." He adjusted his glasses and took a deep breath.

"When I realized what was actually happening at the Ministry, I was first embarrassed, and then I realized if I didn't want to align myself with fascists, then I better make myself useful." Percy began. ",I started leaking information and documents through Aberforth."

Everyone exchanged surprised glances. Ron's eyes widened, "You what?"

"Yeah, turns out I have a bit of a rebellious streak, not so different from the family after all," Percy admitted. "But that's not all. I eloped with my co-worker and co-conspirator."

The room fell into shocked silence before George broke it with a loud, "What?"

"I know, I know. Shocking," Percy deadpanned. "We even have a baby now."

Hermione couldn't contain her excitement, "A baby? What's her name?"

Percy grinned proudly, "Her name is Molly."

The revelation sent shockwaves through the room. Mrs. Weasley's eyes welled up with tears, and she reached over to pull Percy into a tight hug. "A granddaughter named after me! Oh, Percy!"

Ron looked between Percy and the rest of the family, "Wait, so you mean to tell me that while we were out there fighting, you were off eloping and having babies?"

Percy shrugged, "Well, I had to do something productive with my time."

Comparison of Ron and Hermione's contributions in Harry Potter and the Deathly Hallows

I will willingly admit this post was written out of pure spite, tired that I was of seeing people claim Ron had barely contributed to anything in Harry Potter and the Deathly Hallows, or at least way less so than Hermione.

So you know me, what do I do in this sort of case ? I decided to analyse closely what exactly Ron and Hermione did in the book, on different levels and in different ways to completely understand what went on.

Edit: I changed some scores slightly by adding or removing points, and had to recalculate everything, though it didn't change anything to my conclusions; changes are highlighted in bold

List of Ron and Hermione's accomplishments/contributions in Harry Potter and the Deathly Hallows

So of course, to begin my analysis, I needed to list all of their concrete contributions and accomplishments. To be absolutely fair to either of them, I did not take into account feats of bravery that did not ultimately directly help or save anyone (so I did not count Ron begging Bellatrix to torture him instead of Hermione), but I did count elements in which one or the other protected, helped, or saved someone else.

I also listed any Duelling Feat or any fight Ron and Hermione had with Snatchers/Death Eaters/others that had to do with fighting against dark forces or people (I therefore did not include the fact that Ron punched Draco Malfoy during the Battle of Hogwarts).

Anything that helped Harry in the Horcrux Hunt or in getting Voldemort down was taken into account, however small, even if it was just knowledge regarding the Trace (this bit of knowledge allowed the trio to dispel the theory that Death Eaters had found them because Harry still had the Trace) or the location of the Lovegoods, or conjuring up a flask to get Snape's tears. I however omitted intelligent remarks that didn't move the plot forward directly (so for example, I did not include Ron's shrewd comment after he read Mundungus Fletcher's mind).

As Ron and Hermione's feats had to be concrete, I also omitted moments during which Ron was the buffer between Harry and Hermione, or during which one or the other recomforted/or tried to recomfort Harry/the other. I however judged that Ron leading the Horcrux Hunt for months was worthy of being listed, because he took on a major responsibility that helped the trio as they tried to move forward with the Hunt.

To make you understand how I proceeded, each point listed is a thematic element; so several actions from the same event can be listed as separate elements. The chapter in which the element listed happened/was referred to is mentioned after each element.

Ron

1. pretended to be Harry with the help of Polyjuice when he was part of the “Seven Potters” operation (“The Seven Potters”)

2. stunned a Death Eater right in the head from a flying broom (“Fallen Warrior”)

3. saved Hermione in the Tottenham Court Road Café when she didn’t notice that Rowle and Dolohov were going to attack the trio by lunging across the table and pushing her sideways (“A place to hide”)

4. cleared up the café on Tottenham Court Road with Harry after the fight, at Harry’s command (“A place to hide”)

5. gave information to Harry and Hermione regarding the Trace (“A place to hide”)

6. rugby-tackled Mundungus Fletcher when he tried to dive for the stairs (“The bribe”)

7. spied on Ministry workers with the Invisibility Cloak and heard that only the most senior Ministry members could connect their homes to the Floo network (“Magic is Might”)

8. convinced Harry and Hermione that Stunning three Ministry officials was not a good idea because a pile of unconscious bodies would be suspicious, and therefore suggested to use Fred and George’s products (“Magic is Might”)

9. snatched Red Cattermole’s bag without the latter noticing it before Reg Cattermole went back home (“Magic is Might”)

10. pretended to be Reg Cattermole with the help of Polyjuice Potion and convinced Albert Runcorn to take Nosebleed Norgat to ultimately take hair from his head (“Magic is Might”)

11. warned Harry and Hermione that Ministry officials knew there were intruders in the Ministry and that the trio had five minutes at most to leave the place (“The Muggle-Born Registration Commission”)

12. made the most of an uproar cause by the colleagues of some balding wizard to size Mrs. Cattermole and get her out of the Ministry through the fireplace, saving her and getting her away from the real Reg Cattermole – trying to deter other Ministry officials from scrutinizing the situation (“The Muggle-Born Registration Commission”)

13. prevented Harry and Hermione from saying the Taboo (Voldemort’s name) many times, after noticing that it felt like a jinx (“The thief”, “The Goblin’s Revenge”)

14. escaped from a gang of five Snatchers after being captured by them by hitting the one holding him in the stomach and grabbing his wand before Disarming the one who has his wand and Disapparating (“The Silver Doe”)

15. managed to steal a wand from Snatchers and brought the spare wand with him when he came back, which ended up replacing the one broken by Hermione (“The Silver Doe”)

16. saved Harry’s life by jumping into icy water to retrieve Harry who was drowning and by cutting the Horcrux to stop it from strangling Harry; also retrieved the sword of Gryffindor from the icy pond (“The Silver Doe”)

17. faced mental torture at the hands of Voldemort but won against Voldemort’s taunts, resisted possession and destroyed the locket (“The Silver Doe”)

18. learned about the existence of the Taboo during his time away and alerted Harry and Hermione that there was one (“Xenophilius Lovegood”)

19. knew approximatively where the Lovegoods lived (“Xenophilius Lovegood”)

20. led the Horcrux hunt for months while Harry obsessed over the Hallows, not only to search for the Horcruxes but also to gather the team’s spirit (“The Deathly Hallows”)

21. subdued Wormtail with the help of Harry, and took his wand (“Malfoy Manor”)

22. imitated Wormtail to reassure Lucius Malfoy that nothing particular was happening (“Malfoy Manor”)

23. Disarmed Bellatrix Lestrange with Wormtail’s wand (“Malfoy Manor”)

24. saved Hermione by pulling her from under the wreckage caused by the collapse of the chandelier detached from the ceiling by Dobby, and Disapparating after catching a wand thrown at him by Harry (“Malfoy Manor”)

25. was the one who suggested the trio should double-cross Griphook by swapping the real sword of Gryffindor with the fake and give the fake to Griphook to buy enough time for the trio to escape (“Shell Cottage”)

26. pretended to be Dragomir Despard during the trio’s break-out at Gringotts (“Gringotts”)

27. stunned a wizard who was lunging for Hermione’s throat (believing her to be Bellatrix) (“Gringotts”)

28. Stunned Goblins with Harry and Hermione (“Gringotts”)

29. helped Harry cast gouging spells to blast the ceiling apart and facilitate the trio’s escape from Gringotts, after they observed Hermione do it (“Gringotts”)

30. was the one who suggested that the students who were in the Room of Requirement could help them find the other Horcruxes (“The lost diadem”)

31. designed a plan to destroy the cup of Hufflepuff, by remembering the Chamber of Secrets had Basilisk fangs; told Hermione that she should destroy the cup of Hufflepuff (“The Battle of Hogwarts”)

24. saved Harry’s life after Hermione cast a spell on Nagini to force the snake to get away from Harry; dived aside to avoid it from striking her and one of her spells smashed the windows; cast a Blasting Curse charm that “flew around the room, exploding the wardrobe mirror and ricocheting back at them, bouncing from floor to ceiling”, though it also broke Harry’s wand (“Bathilda’s secret”, (“The Life and Lies of Albus Dumbledore”)

25. took care of Harry by getting the locket, stuck to Harry’s chest, away with a Severing Charm; she also cleaned the wound caused by Nagini and put some dittany on it (“The Life and Lies of Albus Dumbledore”)

27. designed a plan so that the Death Eaters who were at Xenophilius Lovegood’s house could see he was not lying about Harry’s presence: she got Ron to put on the Invisibility Cloak so that his presence wouldn’t be known, waited for Xenophilius to appear at the top of the stairs before Obliviating him and destroying the floor so that the Death Eaters could see the trio right before Hermione Apparated them away (“The Tale of the Three Brothers”)

28. cursed Harry’s face to make it unrecognizable so that the Snatchers wouldn’t see it was Harry (“Malfoy Manor”)

29. lied under torture done at the hands of Bellatrix Lestrange that the sword of Gryffindor was fake (“Malfoy Manor”)

35. used “Levicorpus” to help Harry get the cup of Hufflepuff (“Gringotts”)

Conclusions

From this you can see that in terms of sheer numbers, Ron and Hermione's contributions are roughly equal (40 for Ron, 44 for Hermione). Considering that depending on the way I managed the two lists I could have added some elements for Ron (e.g., telling Dobby to bring Dean, Luna and Mr. Ollivander at Shell Cottage in "Malfoy Manor") or removed items for Hermione (e.g., casting the "Diffindo" spell on Ron at the Tottenham Court Road café), I consider a 4-point difference to be negligible. For reference, I would consider a point difference above 8 (1/5 of Ron's contributions) significant.

Weighting-analysis of Ron and Hermione's contributions

Of course simply listing their feats and contributions was not enough, since all of them are not as impressive, were not as important, had unwanted consequences, or were the result of negligence, a mistake, or something else. So I also had to weigh on each of the items listed. To be fair to Hermione, I also added two "mistakes" for Ron that were not part of his contributions.

My point system is of course very subjective, but I think most will consider it fair. I calculated Ron and Hermione's points separately and only did the total in the end to try to be as unbiased as possible (though I did check that the number of points I would grant to one was equal to the number of points I would grant to the other for a contribution of similar nature).

Point system

+ 0.25 = small contribution

+ 0.5 = medium contribution; small duelling feat; small or medium element pertaining to the protection of others and/or reaction time in a dangerous situation and/or evaluation of a dangerous situation and/or defence or escape against unwanted forces

+ 1 or + 2 = important contribution; duelling feat; important element pertaining to the protection of others and/or reaction time in a dangerous situation and/or evaluation of a dangerous situation and/or defence or escape against unwanted forces

Conclusion

While factoring other elements such as the importance of the contribution in helping taking down Voldemort or fighting against dark forces in general, the level of dangerousness in which the contribution happened and the levels of bravery and/or sacrifices required to accomplish the feat, the level of intelligence or creativity involved, quick-thinking, quick reaction time, the level of skill involved to accomplish the feat, mistakes... You can see that Ron and Hermione's contributions are still roughly equal (according to my point system, Ron has 182.5 points and Hermione has 171.75... This is probably due to the fact that Ron not only destroyed a Horcrux but was directly responsible for designing the plan that allowed Hermione to destroy another -granting him + 10 points directly-, and to the fact that Hermione made more mistakes with rather terrible consequences - so Hermione has more malus points), and the point difference between them may seem important, but as I said I consider a point difference to be significant when it hits the bar of 1/5 of the lowest score (here 1/5 of 171.75 = 34.35, yet the point difference between the two scores is 12.75).

Nature of the Contributions

Ron and Hermione are different, and contributed differently to the Horcrux Hunt. I decided upon 8 categories: Strategy/Tactical Thinking; Research, Planning, Knowledge; Deductions; Duelling Feats and Fights; Quick Thinking in dangerous scenarios (which does not correspond to situations requiring a quick reaction time, those are counted in different categories depending on what it ended up doing, but is more akin to "presence of mind"); Resistance against Evil; Protection of others; Leadership. I thought that to really understand Ron and Hermione's profiles, I would put each item listed above in one or more of the categories but also count the points I attributed to each item in my weighting-analysis. There are in the end certain items that did not fit any of the category and that I thought best not to include.

Ron

Strategy/Tactical Thinking: 8 (4.75 points), 25 (5 points), 30 - knowing how to use people to one's advantage - (2 points), 31 (10 points), 37 - spatial reasoning - (4 points) = 25,75 points

Research, Planning, Knowledge: 5 (0.25 points), 7, (2 points), 11 (3 points) 15 (2 points), 18 (2 points), 9 (0.25 points) = 9.5 points

Deductions: 13 (6 points) = 6 points [reminder: this is not a representation of Ron's capacity for deduction, since there are many intelligent remarks I did not include in my analysis; this category only shows deductions that moved the plot forward)

Leadership: 0 point (I did not count what happened at the Lovegoods as "Leadership" because trusting one person at one given moment to carry out a plan does not show, to me, that they are "the leader"; otherwise I would also count other plans made by Ron as examples of him being a Leader).

Conclusion

This to me so clearly shows what Ron and Hermione's strengths are. In terms of "Resistance against evil", both have roughly the same amount of points, while the point difference in "Quick Thinking in dangerous scenarios" is not significant according to my arbitrary cut-point (above 1/5 of the lowest score), showing that both Ron and Hermione are strong-willed and are quick-thinking in dangerous situations.

Hermione is in the lead in the categories "Research, Planning, Knowledge" (with a 19 point difference, the 1/5 of the lowest score being 1.9) and "Deductions" (with a 13 point difference, the 1/5 of the lowest score being 1.2). For the first case, the reason is obvious: out of the three members of the trio, Hermione is the one who thinks about what kind of knowledge, what tools, what objects they will need. She's also generally better at casting spells/ doing magic. The second case offers a bit less insight, because Ron's observations that did not directly make the Horcrux Hunt progress/had no real impact were not included even though many of them were brilliant. However, I think it does show that between Ron and Hermione, Hermione is the one who makes deductions that help move the plot forward.

Ron is in the lead in the categories "Strategy/Tactical Thinking" (with a 14.75 point difference, the 1/5 of the lowest score being 2.2) and "Duelling Feats and Fights" (with a point difference of 19 points, the 1/5 of the lowest score being 4.9). Again, not surprising. Despite people's inexplicable tendency to think Ron only showed his Strategic skills in Book 1, Ron is a very good tactician and strategist (Hermione is a good strategist when it comes to politics, but not war). Ron, unlike Hermione, is a fighter/soldier, with quicker reaction time and more impressive duelling feats. It shows in the sequence at Malfoy Manor when Ron and Harry are fighting together; the two are completely synchronised.

Ron being ahead in "Leadership" is only a reflection of the fact that Ron is Harry's second-in-command.

The category that I was most interested in was "Protection of Others" since Ron ended up being slightly ahead, too (with a 13 point difference, the 1/5 of the lowest score being 8.9). I think it mostly reflects the fact that Hermione has knowledge that helps protect people and or save them while Ron goes above and beyond to protect people in the heat of the moment (which means Ron got more bonus points).

Overall conclusion (for now...)

The hypothesis presented that Hermione contributed much more to the Hunt than Ron is quite absurd indeed.

I will also jump on the Harry defense train here. Everyone's already talked about Tom and Harry's similar upbringing, their need for friends/followers that helped make them who they are, and their opposites-attract sort of personalities. But Tom chose to target Harry because of his "halfblood" status, because he knew not to underestimate him where his other followers would have. He's Harry POTTER. His parents "thrice defied" Voldemort, joined a war effort against him with his uncles- one of which was the heir to the Black House. One of which was a halfblood werewolf- son of a renowned Department of Magical creatures Ministry worker, and the third of which became- essentially, a traitor- the Dark Lord's close and personal servant when the rest of his followers had abandoned or disregarded him outside of Barty. Harry is also the descendent of one of the fabled Peverells, just as Voldemort is. Both the rightful inheritors of the ancient Deathly Hallows.

Without the Horcrux and without the prophecy, Harry would have still been heavily involved in Voldemort's life and/or the war because of his family status and his personality. He's not "just a Horcrux" he's not "Just some random boy" and he's not "Just Harry". He was always gonna be someone important who would get involved with Voldemort at some point in time regardless of any Horcrux, scar, or fame.

Hermione is the "random girl" here, but that's totally fine. That's still a great dynamic. A talented nobody x a talented somebody. The stories and dynamics are different but can be similar in their own right, it's just a matter of people respecting a fandom shipping space.

yes yes - Harry is a very special boy, and hermione is a special girl, for very different reasons! Love them both (and they both deserve better than friggin Voldemort lol we are all the actual monsters here)

Hermione took a deep breath and let it out slowly. She could do this. It was going to be fine.

"Ah."

She started pacing again, shaking her arms out. Stretching her fingers like they were overworked and cramped.

You can do this, she told herself. It's simple.

Just a few words. No harm, no foul. Best to get it over with.

She paused, looking at the door in front of her as she frowned. No, it was too hard. She'd never done this before. Ever.

Fuck. This was so hard. And he wasn't even back yet.

She returned to pacing and started mumbling under her breath the words she was trying to psyche herself up to share.

Quick and easy like a bandaid. Rip it off. Endure the pain of the stinging, sticky adhesive. Yeah, just like that.

She stopped and took a deep breath again.

"It's fine," she said to nobody in particular. "It's fine."

It was late and the ministry workers in this department had already gone home. Coming to his office now made Hermione grateful that he was almost as much of a workaholic as she was.

There would be nobody around to witness her absolute horror.

But no, it would be fine. There was nothing to it. She was brave. Brave and reckless. Okay, she was too logical to be completely off the rails like many of her former Gryffindors. But Hermione knew how to  be impetuous when the situation called for it.

Like right now. As in right now, as she heard the Floo in his office go off. Which meant he was back. Finally. Fuck! Her nerves were already shot.

Couldn't get any worse, right?

Okay Hermione, she told herself. Deep breath.

She inhaled, closing her eyes for a moment, and then let it out softly. Good. She had stopped trembling.

Hermione lifted her chin defiantly and knocked on Auror Malfoy's door.

"Come in!"

She strode in confidently, smiling widely as she always did when she saw her boyfriend and felt her body warm at the attention he suddenly gave her.

Sitting behind his desk already, he'd looked up and smirked, now interlocking his fingers together in anticipation.

It was just three words.

She'd never uttered them before to any man. He was waiting.

"Yes, Granger?"

That smooth drawl almost made her trip over herself. Damn him and his ability to make her stutter like a first year with a crush.

"Draco." She took another deep breath and cleared her throat. It was easy. People had been saying this to each other for thousands of years.

Hi saintsenara, I’d like to know your thoughts on the Trace etc because you always seem to have a a really lucid and informed perspective of, well, everything

I never liked how the Ministry and Hogwarts are able to automatically and infallibly detect muggleborns. I feel like the ramifications of that aren’t properly dealt with but I also think that it’d be more interesting and plausible if muggleborns had to be looked for.

I also feel like the Trace is dealt with very strangely. When is that integrated? Is it just automatic for muggleborn students or would the school’s representative (ie. Dumbledore for Tom and McGonagall for Hermione ) place it? If they can place these restrictions on children remotely then why couldn’t they for, say, Death Eaters or Sirius Black? It doesn’t make sense to me that there is anything about the Trace that would make it only applicable to underage wizards and witches. If they need to do something to the children to place the Trace then why can’t they do that with all Azkaban inmates as a preventative measure? Is it simply too outrageous to do that to adult wizards? Is the Trace too easily broken? If the Trace is easily breakable then the Order would’ve broken it for Harry in Deathly Hallows, wouldn’t they?

The lack of thought enrages me!

the thing which has to be borne in mind with the trace is that its narrative purpose is primarily as a coming-of-age experience - it's the threshold which wizarding teenagers need to cross to become legal adults.

and not only this, it's primarily an allusion to the real life coming-of-age experience which defines [or, certainly, which defined in the 2000s, gen z are famously more abstemious] british and irish teenage life...

becoming old enough to legally drink.

when i was a teenager, eighteenth birthdays were a big deal precisely because of the opportunities they afforded to get legally boozed. i was in the supermarket at 10am on mine, passport in hand, buying a disgusting bottle of own brand vodka [which i don't think i or any of my friends ever touched] just because i could.

but the word "legally" is important in this context. because, while the legal drinking age in the uk and ireland is eighteen... that doesn't mean that most teenagers wait until then for their first sip. and nobody - adults in positions of authority such as police, teachers, social workers, doctors etc. included - thinks they do.

and that's because the law is actually more ambiguous than it seems. in the uk, it's legal for children as young as five to drink alcohol in a private residence [!]. in england, scotland, and wales [but not northern ireland], sixteen year olds can legally drink some types of alcohol in licensed premises as long as they're eating a meal.

as a result, the legal penalties for underage drinking are basically non-existent [for the drinker, that is; they can be reasonably hefty for anyone caught selling to under 18s]... if there's nothing else in play which might attract the state's attention.

or: i went to a house party at a friend's when i was fifteen, drank a bottle of rose, broke up with my boyfriend, and ended up sobbing in her garden at the top of my lungs about how men are dogs at 2am, and was then sick.

this friend and i were both white, grammar-school-educated, generally-perceived-as-sensible teenage girls, whose families were well-known and well-liked. the neighbours, seeing me having an absolute flop of a night, could say "ah, the folly of youth, we were all young once, the lasses are in high spirits etc. etc."

but without the protection afforded by social acceptability, maybe they'd have interpreted the situation very differently, and called the police or contacted social services about my friend's mam letting us drink there, or so on.

the trace functions in the same way. the actual law on underage magic - that it's totally illegal - is obviously nonsense. we know in canon that children in wizarding households can use magic before they're seventeen, because - as dumbledore says - the ministry is happy to trust their parents to regulate them doing so.

that is, in families which have the standing afforded by conformity to social convention [especially in living separately from muggles], underage magic can be seen as all a bit of a laugh.

but muggleborns are viewed in the eyes of the state as risks, until they reach adulthood and - in all the cases we meet in canon - remove themselves from the world of their birth entirely. the ministry's main aim - the thing it's preoccupied with - is preventing muggles from learning that magic exists. therefore, anyone magical who lives in a muggle household is subject to much more surveillance than those who don't.

[if the weasley twins do magic in the burrow's garden, who cares? if harry does it in the middle of little whinging, countless muggles might see!]

when it comes to how muggleborns are detected, i actually quite like the extra-canonical information jkr has given about the quill of acceptance and the book of admittance [which is on pottermore]. where i don't agree with it is that i don't think all muggleborns are admitted to hogwarts.

i've said a few times - and, for my askbox girlies, i will write the longer meta on this, i promise - that i think hogwarts applies some form of selection process, which explains why the class-status of the intake [including the muggleborn students we meet in canon] is near-uniform.

as a result, i think that muggleborn students are looked for - they're observed and vetted to make sure they'll fit in at hogwarts - and the interview they have with the deputy head is the final stage in that process.

when they're accepted to hogwarts [or when they actually start at the school, to give hermione the summer of trying spells she mentions in philosopher's stone] i think it's fair to imagine that the trace comes into effect, but that it's only ever going to cause alarm at the ministry if it's broken when students - of any background - are in muggle areas.

which means very little for wizard-raised students - who can do magic at home whenever they want - but restricts the freedom of muggleborn ones.

when it comes to restricting adult magic... we know - because sirius mentions it in prisoner of azkaban - that inmates are deprived of their wands. jkr has retconned how possible magic is without a wand in her post-series writing, but the evidence of canon is that all but the most basic, unsophisticated magic is impossible without one.

losing access to a wand - and, therefore, losing access to magic - is how the state restricts adults' use of magic [which is what happens to hagrid when he acquires his criminal record for manslaughter]. and this is actually a more strictly enforceable and much harsher punishment - it's basically the permanent deprivation of the wizarding world's fundamental marker of liberty - than the trace, which, while it is enshrined in law, basically amounts to nothing more than a fairly loosely-enforced social barrier between childhood and adulthood for 90% of the population.
