Heads up folks, NicoNicoDouga is currently down due to a large scale cyberattack

The attack happened on the 8th and the site is still down in terms of video streaming. Apparently there were reports of Ransomware being used during the attack.

The site is still “down” but the blog part is back up but from the report, videos and content posted are ok so do not fret. The site is still down as of this post (save for the blog) and it seems they are working their hardest to fix it and do damage control.

Here is a rough translation of their most recent post:

Report and apology regarding cyberattack on our services

As announced in Niconico Info dated June 8th, 2024, Dwango Co., Ltd. (Headquarters: Chuo-ku, Tokyo; President and CEO: Takeshi Natsuno) has been unable to use the entire Niconico service operated by our company since the early morning of June 8th. It has been confirmed that this outage was caused by a large-scale cyberattack, including ransomware, and we are currently temporarily suspending use of the service and conducting an investigation and response to fully grasp the extent of the damage and restore it.

After confirming the cyberattack, we immediately took emergency measures such as shutting down the relevant servers, and have set up a task force to fully clarify the damage, determine the cause, and restore the system. We would like to report the findings of the investigation to date and future responses as follows.

We sincerely apologize to our users and related parties for the great inconvenience and concern caused.

Around 3:30 a.m. on June 8, a malfunction occurred that prevented all of our web services, including our "Nico Nico" and "N Preparatory School" services, from working properly. After an investigation, it was confirmed that the malfunction was caused by a cyber attack, including ransomware, at around 8 a.m. on the same day. A task force was set up on the same day, and in order to prevent the damage from spreading, we immediately cut off communication between servers in the data center provided by our group companies and shut down the servers, temporarily suspending the provision of our web services. In addition, since it was discovered that the attack had also extended to our internal network, we suspended the use of some of our internal business systems and prohibited access to the internal network.

As of June 14, we are currently investigating the extent of the damage and formulating recovery procedures, aiming for a gradual recovery.

This cyber attack by a third party was repeated even after it was discovered, and even after a server in the private cloud was shut down remotely, the third party was observed to be remotely starting the server and spreading the infection. Therefore, the power cables and communication cables of the servers were physically disconnected and blocked. As a result, all servers installed in the data centers provided by the group companies became unusable. In addition, to prevent further spread of infection, our employees are prohibited from coming to the Kabukiza office in principle, and our internal network and internal business systems have also been shut down.

In addition to public cloud services, Niconico uses private cloud services built in data centers provided by KADOKAWA Group companies, to which our company belongs. One of these, a data center of a group company, was hit by a cyber attack, including ransomware, and a significant number of virtual machines were encrypted and became unavailable. As a result, the systems of all of our web services, including Niconico, were shut down.

The Niconico Video system, posted video data, and video distribution system were operated on the public cloud, so they were not affected. Niconico Live Broadcasting did not suffer any damage as the system itself was run on a public cloud, but the system that controls Niconico Live Broadcasting's video distribution is run on a private cloud of a group company, so it is possible that past time-shifted footage, etc. may not be available. We are also gradually checking the status of systems other than Niconico Douga and Niconico Live Broadcasting.

Publishers' Binding Thursday

This week's choice from the stacks is a 1928 edition of French novelist Gustave Flaubert's (1821-1880) Madame Bovary, published in London by John Lane The Bodley Head, Ltd. and in New York by Dodd, Mead and Company. Flaubert's work strives for a sense of realism and of perfection, always seeking "le mot juste"—"the right word." He famously said that "an author in his book must be like God in the universe, present everywhere and visible nowhere."

Madame Bovary was originally serialized in the Revue de Paris in 1856 and as a book in two volumes in 1857. There was an obscenity trial about the contents of the novel, which gained the novel notoriety. This edition features an English translation by British critic and translator J. Lewis May and illustrations by British illustrator John Austen (1886-1948). I believe that Austen did all of the illustrations for the book, including the charming wood-engraved tulip endpapers and the head and tailpieces at the beginning and end of each chapter. It is also likely that he designed the figure on the cover, which also appears on the dust jacket of the book (not pictured).

A Modern Journey to the West Sequel

Joel Bigman has written The Second Journey (2024), a modern sequel to Journey to the West (Xiyouji, 西遊記, 1592), which is being touted as “The World’s First Chinese-Jewish Historical Fantasy.” The story is framed as the contents of a lost 7th-century CE scroll discovered inside a buried jar while city planners investigate a watermain leak in modern Xi’an, Shaanxi province, China. A subsequent translation of the Aramaic text reveals a second, unknown journey undertaken by Xuanzang, Sun Wukong, and Zhu Bajie (but not Sha Wujing or the Dragon Horse) five years after their original return. This new quest is initiated by the Bodhisattva Guanyin, who requests that the Tang Monk seek knowledge outside of China for the benefit of the Kaifeng Jews, who have assimilated so much into Chinese culture that they’ve forgotten how to read their Hebrew scriptures. The trio travels past India and into Central Asia, where they procure the services of “Bear” (a.k.a. the “Second Samson“), a supernaturally strong Jew with knowledge of the various routes and personages of Historic Palestine. Together with a mysterious donkey, they travel from town to town looking for a holy man willing to return to China and become the Kaifeng Jewish community’s new teacher, thereby reigniting their religious life. Bear arranges for the pilgrims to meet and stay with several such holy men—allowing them to learn Hebrew and Jewish culture and religious history along the way—but the search for the right candidate is quite difficult.

I give The Second Journey four and a half out of five stars. The book is well-written, with smooth and oftentimes thought-provoking dialogue. The worldbuilding is very creative and yet still respectful to both Jewish beliefs and Chinese mythos. It’s definitely a great way to introduce someone to Jewish culture and religious history via Journey to the West. I highly recommend it!

It is the artist's minimum right to request an accurate and transparent basis for settlement of accounts that have been unclear, and SM is also an obligation to comply with the exclusive contract and the Pop Culture and Arts Industry Development Act. <1> Artists' position on activities so far and SM's refusal to provide settlement data

1. Artists have previously signed a long-term exclusive contract with SM for more than 12 to 13 years and have been working diligently as members of EXO.

2. During the long-term exclusive contract period as above, artists have only trusted SM's explanation of the settlement amount that is settled every time, and have received the settlement amount by looking at the data unilaterally prepared by SM without specific and objective evidence. In response, artists have recently formally requested copies of settlement data and settlement grounds several times through their agents, but SM replied that they cannot provide copies of the data.

3. SM is obligated to provide artists with settlement data and settlement grounds, including total income details, expenses subject to deduction, and amount subject to deduction, under the existing exclusive contract, under the Pop Culture and Arts Industry Development Act. In addition, the settlement cycle under the above exclusive contract arrives twice a year, so the above settlement data and settlement basis must also be provided twice a year. SM's failure to provide these settlement data and settlement grounds is a strong proof that SM did not pay the artists properly, and the artists will take all civil and criminal legal actions against SM, including filing a settlement claim.

<2 > Artist's position on unreasonably long-term contracts and further extension attempts

1. Previously, artists have signed exclusive contracts with SM for more than 12 to 13 years. This is too different from the standard contract for pop culture artists (singer-centered) announced by the Fair Trade Commission based on the seven-year contract period, and it is unilaterally disadvantageous to artists beyond the minimum reasonable extent.

2. SM already has 13 years of contract, including an extended period in the provisional disposition of the TVXQ case, and the reasonable violation of the Seoul Central Law is that SM uses its superior position to exercise unfair control and excessively violate its economic freedom and basic rights. In the case, the court again pointed out that it is very difficult for idol stars, such as applicants (TVX members), to continue their popularity in their 30s and beyond.

As such, the existing exclusive contract seriously restricts personal rights for an excessively long period of time and constitutes "an act of unfairly using the position of the transaction" in Article 45 (1) 6 of the Monopoly Regulation and Fair Trade Act. 4. Furthermore, SM made artists sign an exclusive contract to extend their debut date by 7 years and an additional 3 years if they are overseas. However, in the case of K-pop artists in Korea, it takes at least months and years to make their debut, and overseas activities are a natural premise. Furthermore, even though Xiumin and Chen were members who planned to work in China from the beginning, the exclusive contract, which adds three years if they work abroad, forced them to sign a long-term contract of more than 10 years based on the date of the exclusive contract from the beginning.

5. On the other hand, SM is trying to claim a minimum contract period of 17 years or 18 years by having artists sign a follow-up exclusive contract again, not even enough to sign an exclusive contract for 12 to 13 years as above. This is SM's repeatedly committing extremely unjust tyranny against artists.

6. In the process of sealing a subsequent exclusive contract, the artists were unable to negotiate properly under the existing exclusive contract, and it was difficult to set the terms of the contract or reflect their wishes on an equal footing. In the case of a provisional disposition in the TVXQ case, the court should have been able to stop the existing negotiations and negotiate with other entertainment agencies other than SM if the applicants (TV TVXQ members) only passively signed the exclusive contract form presented by SM, Even if an extension agreement was reached after the applicants (TVXI members) established their position as entertainers, applicants who were already bound by the existing exclusive contract could not strengthen their bargaining power. 9. Baekhyun, Xiumin, and Chen are seriously considering filing a lawsuit against the Fair Trade Commission for the long-term signing of existing exclusive contracts and subsequent exclusive contracts.

<3> A message to the fans
