at Bearden 3 Hardin Valley Academy 1
Thursday, May 18, 2023 7pm
Lucas Nordin scored two goals Thursday to lead Bearden in a 3-1 victory over Hardin Valley and win the Region 2-AAA Championship. The win gives the Bulldogs home field for Saturday’s State Sectional round with a berth in next week’s State Tournament on the line. 
After the Hawks took a quick lead just four minutes into the game, Nordin’s first goal came with 10:23 left in the first half when he alertly headed in a Hayden Tate volley-shot blast off the crossbar following a precise Nic Prins cross, and the teams went to intermission knotted at 1-1. “Hayden’s my wing man,” the All-American striker said after the game, “I was lucky to be in the area—I'll give this one to him!”
Early in the second half, Jack Raulston served up a perfect corner kick for sophomore defender Cole Stopka to bury a thunderous header into the net for a 2-1 Bearden lead. Nordin provided the cushion with seven minutes remaining off a nice Ethan Ford header assist across midfield initiated by a timely kick from GK Logan Nelson for the final 3-1 margin.  
Outside defender Prins and defensive mid Eric Freudenberg held their own against Hardin Valley All-State forward Ish Pelacios, twice picking his pocket on attacks. Chandler Donohoe, Jack Tirgrath, Lucas Ford, and Shawn Spencer skillfully controlled and possessed the ball late to ice the win.
Goals: HVA-Marques Powers (4’); LUCAS NORDIN (30’ assist-Hayden Tate, Nic Prins); COLE STOPKA (44’ Jack Raulston); LUCAS NORDIN (74’ Ethan Ford, Logan Nelson).

Outside the box...Hardin Valley now must travel to Kingsport Dobyns-Bennett for Saturday’s Sectional round...the north bank was full of students from both schools, with three Hardin Valley fans painting their chest to display ‘H-V-A’...following the game, Ethan Ford confirmed that his and Lucas Nordin’s colorful mohawks are actually ‘fuchsia’, and not red or maroon as previously reported…Woof!

Crumbling Competition

The first cookies, invented in 7th century Persia, were made so that bakers could test an oven’s temperature. Eventually, through war and exploration, cookies were introduced to Europe. By the 14th century, recipes to bake cookies were well-known in European cities and households.[1] Sprinkles, now found on some types of cookies, also have historical roots. Sprinkles were invented by French bakers in the 18th century and originally given the name nonpareils, which means “without equal” in English.[2] Moreover, the Industrial Revolution created technological improvements that resulted in cookies and sprinkles being produced commercially in the 20th and 21st centuries.
Thus, Crumbl Cookies (founded in 2017) did not successfully run a business by selling a novel product that had never been invented. Instead, after opening its first store in Logan, Utah, the company built its business by marketing on social media and offering a rotating weekly menu of cookie flavors for takeout or delivery. Since opening its doors in 2017, Crumbl now has over 300 bakeries in 36 states nationwide, making it the fastest-growing cookie company in the country.[3]
Today, Crumbl is suing two of its competitors – Dirty Dough and Crave Cookies – for trademark infringement. Lawsuits filed in the U.S. District Court on May 10, 2022, illustrate that Crumbl is seeking triple damages from these two companies in an amount deemed fair by the court. An amended lawsuit against Crave Cookies was filed June 29, 2022. These lawsuits allege that both companies copied Crumbl's weekly rotating menu model as well as its products and packaging.
In the lawsuits, Crumbl includes header sections with close-up pictures of cookies, a cookie logo with a bite taken out of it, long boxes that perfectly fit cookies side by side, and similar cookie recipes and presentation (such as sugar cookies with fruity cereal for decoration) as examples of copying.
In addition, the suits filed against Crave Cookies claim that Crave co-founder Trent English toured a Crumbl location and applied to be a franchise owner just before starting his own business in 2019. "The fact that Crave was founded by a former Crumbl applicant with knowledge of Crumbl's business and brand identity shows that Crave was clearly aware of Crumbl and the Crumbl trade dress," the lawsuit states.[4]
But are Crave Cookies and Dirty Dough in violation of trademark infringement, or are these companies just competitors offering similar products?
Competitors or Copycats?
Crave Cookies currently has four stores in operation in Utah. Its website states, “After experimenting with hundreds of different recipes to find the perfect chocolate chip cookie, we created what we believe to be the best cookies you will ever taste”.[5]
Dirty Dough currently has three stores up and running in Utah, and it plans to open dozens of stores around the country. According to its website, “Dirty Dough cookies are engineered from the inside out, with every cookie featuring some combination of layers, mix-ins, or filling within the dough. The unique flavor profiles and trademark gooey goodness of our cookies set us apart from other cookie-cutter brands (see what we did there?)”.[5]
Like Crumbl Cookies, both Crave Cookies and Dirty Dough sell decorated cookies with a rotating menu. However, the owners of both companies deny directly copying Crumbl. For instance, Dirty Dough owner Bennett Maxwell recently placed 12 digital advertising billboards in response to the lawsuit. One states, “Our cookies don't crumble with competition" and another said, "We don't just file lawsuits- we just have better cookies." In response to Crumbl using pictures to illustrate the similarities between its cookies and Dirty Dough’s and Crave Cookies’ cookies, Maxwell stated, "They're showing our picture of cookies and sprinkles next to theirs like they had the first cookie with sprinkles”. Similarly, Crave Cookies co-founder Trent English has stated, “Our reaction is kind of confusion because we don't see any similarities.  This is their way to stifle competition”.[7]
Even without legal interference, the imitation of a competitor rarely results in a positive outcome. In her book, Understanding Michael Porter: the Essential Guide to Competition and Strategy, Joan Magretta states, “In what classical economic theory calls ‘competition,’ evenly matched rivals selling equivalent products go head to head, driving prices (and profits) down… But Porter offers a more nuanced and complex view of what actually happens when companies compete to be the best. Customers may benefit from lower prices as rivals imitate and match each other’s offerings, but they may also be forced to sacrifice choice. When an industry converges around a standard offering, the ‘average’ customer many fare well… The needs of other customers may be undeserved. Think about the last flight you took. It probably met the basic need of getting you where you needed to be. But was it a pleasant experience? Are you eager to fly again? When choice is limited, value is often destroyed”.[8] According to Porter, companies should not compete to be the “best’ in an undifferentiated industry, but instead compete to be “unique”. In addition, if customers only have access to undifferentiated products, then they are also detrimentally affected.[8]
Thus, through a lawsuit, Crumbl Cookies is trying to prevent competition based on price in an undifferentiated cookie industry. If Crave Cookies and Dirty Dough are not differentiated from Crumbl, competition based off of which store offers the lowest priced cookie will occur. This will result in lower profits for all competitors. Even without the threat of a lawsuit, Crave Cookies and Dirty Dough should try to further differentiate their business models to attract new types of customers that are not part of Crumbl’s market. By offering unique products, services, or marketing, Crave Cookies and Dirty Dough can avoid crumbling under the influence of its more established competitor.

Among the young cowboys participating in the 2017 Junior National Finals Rodeo, Dec. 6-12, will be Wyatt Freeman, 11. The sixth grader from Beutler Middle School will be the only representative of the State of Idaho at the event, said his mother, Kelly Maughan. The young man has been riding miniature horses, steers, and bulls since he told his parents that he was big enough to “fall off and eat dirt,” said Kelly. The family was watching That Famous Preston Night Rodeo when Wyatt was three years old. The following year, she and her husband, Chris, let him ride. Freeman is going into the competition with a third place world standing for the junior division, which is for youth ages nine-12.His rodeo competence has his parents taking him from Montana to Texas and also to Kansas to participate in major rodeos, such as Cowboys Days in Evanston, Wyo., and the Grand National Rodeo in San Francisco. Last summer he participated in Utah’s Days of ’47 Rodeo, brining home a second placing in mini bronc riding. In his spare time, Wyatt breaks mini-horses for other people, as well as mini donkeys for the grandkids in his family. When he’s old enough to participate in That Famous Preston Night Rodeo he’ll be an old hand at the trade.  In fact, he does well enough that he pays his own entry fees at all the events. “We (his parents) pay for housing and travel,” said his mother. A young but growing company recently participated in the 39th Great Lakes ProRodeo Circuit Finals. Held in Louisville, Kentucky during the North American International Livestock Exposition, the largest all breed show in the country, they were able to showcase 16 of their animals in the Championship Competition.
To produce rodeos, they have over 65 bucking horses and 70 bulls to choose from to transport to the rodeos. As a growing company they are looking to the future as they are breeding and raising horses and bulls to add to the competition stock. Currently, they have 300 cows, 120 yearling bulls, 27 weanlings and 15 three-year-old horses. In 2017 the ranch welcomed 12 new foals from this breeding program. As the young bull herd ages to 2, 3, and 4 years old they are taken to approximately 15 competitions in many locations across the country. Besides our rodeo, the crew hauls to 6 other PRCA rodeos. In 2018 they will be adding another Extreme Bull riding over the Fourth of July. At the Great Lakes ProRodeo Circuit Finals it was the Cowboys vs the Animals, and the animals were certainly ahead showing the talent they were bred for. A few cowboys used their match to put a little cash in the bank. Tanner Aus from Granite Falls, MN tied for 3rd place on the second night riding Jelly Roll, helping to propel him to finish 1st overall for the rodeo in the Bareback Bronc event. (Jelly Roll also helped cowboys out in Ashland, MO for a 1st and 2nd in Granite Fall, MN.) The final night, Jimy Marten of Donahue, IA made it to the 8 second buzzer on Chrome Hatchet to win the performance, the rodeo and the Year End Title Of 2017 Bull Riding Champion. With the 2017 Wrangler National Finals Rodeo (WNFR) in Las Vegas this December, 2 Championship ProRodeo Bulls have been chosen to make the trip  – B-9 Juicy Fruit and 1137 Cowbanger (pictured above) will make his 2nd WNFR appearance. Both of these cowboys have won more than $106,000 so far this season. “When you win the gold buckle, that’s the best you could do in the lifestyle I chose to live,” Bingham said. “To get the very top dog award that I could possibly ever achieve would be amazing. It’s something I’m going to continue to try to do.”
Joining Bingham and Bennett in their quest for a gold buckle are Baylor Roche, 28, of Tremonton, a steer wrestler in sixth place with $99,000 in winnings and J.C. Malone, 32, a tie-down roper from Plain City with $86,000 won.Competitors from elsewhere in Utah include three members of the Wright family of Milford, all competing in the saddle bronc riding contest. They are Ryder Wright, 19, in 8th place with $99,000, Jake Wright, 28, in 10th place with just less than $92,000 and Jesse Wright, 28, in 14th place with just less than $77,000. All three have bested Cody Wright, 40, Ryder’s father, who was the 2008 and 2010 world champion in this event, who finished 17th this season with just less than $70,000. The Wrangler National Finals Rodeo is the season-ending championship event for the Professional Rodeo Cowboys Association and is widely acknowledged to be the world’s premier rodeo, according to prorodeo.com. Held annually since 1959 – and since 1985 in Las Vegas – the Wrangler NFR is ProRodeo’s richest and most prestigious rodeo, and it showcases the very best cowboys, barrel racers and livestock in the world, says the website. The rodeo is telecast to more than 55 million households on CBS Sports Network, says the website. Each performance of the Wrangler NFR is broadcast live from 7:45-10 p.m. on CBS Sports Network — DISH channel 158 or DirecTV channel 121, according to news releases from the rodeo. The Top 15 contestants in the standard rodeo events — bareback riding, steer wrestling, team roping headers and heelers, saddle bronc riding, tie-down roping, Women’s Professional Rodeo Association barrel racing and bull riding — qualify to compete at the Wrangler NFR based on money won during the regular season. At the conclusion of the Wrangler NFR, world champions are determined based on total season earnings, including the Wrangler NFR, says the website. The Wrangler NFR consists of 10 rounds – one round on each of 10 consecutive days. Each contestant competes once each day. Cowboys and barrel racers earn money by placing first through sixth in any round and pick up more money by placing first through eighth in the average with their cumulative times or points earned during the 10 rounds.
