Pakistan confirms 'processing' visa applications of Jadhav's wife, mother

Pakistan's Foreign Office (FO) has confirmed that the visa applications of former Indian Naval officer Kulbhushan Jadhav's mother and wife were being processed.

"Visa applications of mother and wife of Commander Jadhav received for their visit on humanitarian grounds. Being processed," Foreign Office Spokesperson Dr Mohammad Faisal tweeted on Saturday.

Pakistan Today has reported that the FO, on Thursday, issued directives to the Pakistan High Commission in New Delhi to issue visas to Jadhav's wife and mother.

The Indian High Commissioner in Pakistan will also be allowed to accompany Jadhav's family during the meeting.

The Pakistan Government had decided to allow Jadhav to meet his wife and mother on December 25, Geo News reported citing Pakistan's Foreign Office spokesman Dr Mohammad Faisal, as saying.

Jadhav was arrested in Pakistan's Balochistan Province over charges of alleged involvement in espionage and subversive activities for India's intelligence agency - the Research and Analysis Wing (RAW).

India, however, maintains that Jadhav was kidnapped from Iran, where he had business interests after retiring from the Indian Navy.

Jadhav was sentenced to death by a Field General Court Martial (FGCM) in Pakistan this year in April.

However, the ICJ on May 18, 2017, stayed the hanging after India approached it against the death sentence.

India has appealed to the court to impose emergency measures for Jadhav's execution to be suspended until the legal battle in Hague concludes, while also accusing Pakistan of violating the Vienna Convention by failing to provide him with consular access and for being in breach of international human rights law.

To this end, India's and Pakistan's written responses have been submitted to registrar Philippe Couvreur of the ICJ.

India may have to move the International Court of Justice (ICJ) to gain access to ex-naval officer Kulbhushan Jadhav as Pakistan failed to comply with the July 2019 order in the case, senior advocate Harish Salve said.

Salve was India’s counsel during the hearing of the Kulbhushan Jadhav case in The Hague, Netherlands last year, in which the ICJ had asked Pakistan to undertake an effective review of the conviction and sentence of Kulbhushan Jadhav and asked it to grant consular access to him without further delay.

In an online lecture held on Saturday, Salve said that India was trying to secure access to Jadhav and had sent as many as 23 requests to Pakistan, but had received no response, according to a Times of India report. "We have been trying to persuade Pakistan to let him go. If they want to say they are releasing him on humanitarian grounds, they can do so. We want him back," he Salve said, adding that the case involving the former naval officer has become an “ego problem in Pakistan”.

Salve also said that India hopes in an effort to release Jadhav, India also hopes that they will be able to persuade Pakistan through the “back-channel”. “We have come this far, they cannot now put him (Jadhav) to death. Our consular officers have to be given access,” he said.

India has been doing its best to keep the spotlight on this case, Salve said in response to a question on how it will be ensured that Jadhav does not meet the fate of Sarabjit Singh. "We have kept the glare on this case in the hope that Pakistan will not act worse than it generally does," he said.

Recounting the proceedings of the July 2019 hearing at The Hague, Salve said, “Pakistan tried theatrics through power point presentations of his confession. They even claimed that he was given their passport by the government of India. In their FIR, they named the entire Indian security apparatus, including the home minister and intelligence agency heads. But we relied on the Vienna convention where they should have granted us consular access before his confession. We also raised the issue of human rights violation by Pakistan.”

Salve also said that India has written to Pakistan asking them for evidence against Jadhav other than a video of his confession, adding that neither the chargesheet, FIR nor the military court judgment has been shared with India. “Their domestic courts may find that sufficient. They know if it comes to a fair consideration and a fair trial, they will have no choice but to release him. Someday, we shall have him back in India,” he added.

Jadhav was arrested on 3 March, 2016 from the Balochistan province and India was informed about it on 25 March, 2016, when the Pakistan Foreign Secretary raised the matter with the Indian High Commissioner in Islamabad. Meanwhile, India insisted that he was illegally detained from Iran, where he was on a business visit.

Jadhav was sentenced to death on charges of espionage and terrorism in April 2017 and a month later, India approached the ICJ against the Pakistan military court’s “farcical trial”. In January 2018, National Security Advisor Ajit Doval had “gently nudged” then Pakistan counterpart Nasser Khan Janjua to release Jadhav, Indian Express reported.

India exchanges list of prisoners with Pakistan, says it awaits consular access to Kulbhushan Jadhav

India awaits consular access to Kulbhushan Jadhav and other Indian nationals in Pakistan's custody, the external affairs ministry said on Monday, as it exchanged with Islamabad the list of civilian prisoners and fishermen lodged in each other's jails.

"Lists of 250 civilian prisoners and 94 fishermen were handed over to Pakistan," it said.

A list of 54 Pakistani civilian prisoners and 4 fishermen, who have completed their sentence and whose nationality confirmation is awaited from Pakistan, was also handed over and Pakistan was asked to expedite the confirmation, the ministry said.

Asserting that it remains committed to addressing humanitarian matters, including those pertaining to prisoners and fishermen in each other's country, the ministry said the government has repeatedly emphasised the need for early release and repatriation of civilian prisoners, missing Indian defence personnel and fishermen along with their boats.

"We also await consular access to those Indian nationals in Pakistan's custody for whom it has so far not been provided, including Kulbhushan Jadhav and Hamid Nehal Ansari," the ministry asserted.

Pakistan has also shared a list of 58 civilian prisoners and 399 fishermen in its custody, who are Indians or believed to be Indians, it said.

The ministry said the list was exchanged between the two countries through diplomatic channels simultaneously at New Delhi and Islamabad. It was done as part of the 2008 Agreement on Consular Access between India and Pakistan.

The ministry also informed that a juvenile named Hasnain, whose nationality was verified by Pakistan, was repatriated today through the Attari/Wagah border. He had inadvertently crossed the border in May last year. He was handed over to Pakistani authorities in the presence of Pakistan High Commission officials.

The Pakistan Foreign Office also issued a press release regarding the exchange of lists and said that Pakistan will release 146 fishermen on January 8.

The exchange of the lists of prisoners comes days after Indian death-row prisoner Jadhav met his family on December 25 in Islamabad.

The Jadhav-family meeting became the latest flashpoint in the already strained Indo-Pak relations with Pakistan terming its decision to allow Jadhav's family to travel to Pakistan to meet him a humanitarian gesture and India accusing it of violating mutual understanding.

There was no consular access granted during Jadhav's meeting with his wife and mother and instead Deputy High Commissioner JP Singh, who accompanied the two women, was initially separated from them.

They were taken to the meeting without informing Singh, and the meeting was started without him, the ministry had said in a statement earlier.

Singh could join only after pressing the matter with officials, but was still kept behind an additional partition that did not allow him access to the meeting as agreed.
