I have no idea whatsoever what happened that evening in the streets of Stockholm in late June that led to the detention of three U.S. citizens — including the rapper A$AP Rocky — and to them facing assault charges.
But once upon a time, I was prime minister of Sweden, so I have to confess to having a certain knowledge of both the powers and the limitations of that office.
I certainly hope that what really happened will be sorted out by the courts without undue delay. Everyone is equal before the law, and everyone should have an interest in a speedy resolution of the case.
But the case has acquired a certain prominence since President Trump jumped to the defense of the most famous suspect. True to form, Trump has launched a number of tweets to demand “FREEDOM” and in general terms expressed his dissatisfaction with both Sweden and its prime minister for not immediately doing what he wants.
Trump isn’t particularly known for taking up individual cases of this sort. If he is known for anything, it’s being ready to turn a blind eye — even to murder. But in this case, one can see that he had very specific political reasons for demanding that these three people are immediately sent back home.
So let’s just say he didn’t have the inner workings of Sweden’s legal system in mind. Here’s an unsolicited briefing.
As prime minister, you can have your government propose laws and try to get parliament to decide on them, but once that’s done, your role in how they are implemented is absolutely zero. There certainly are countries around the world where the judiciary is little more than an instrument of the arbitrary powers of the ruling strongman, and where the political leadership can send people in and out of prison at their discretion. Sweden is most certainly not one of those countries.
A Swedish prime minister who tries to order a court to release a suspect or dismiss a case is first going to fail and then, with high probability, will be kicked out of office.
I wouldn’t say that our judiciary necessarily handles every single case in a way that is beyond any reproach, but its independence is far preferable to a system of arbitrary justice influenced by the whims of politics, be they domestic or foreign. The independence of the judiciary is rightly seen as a hallmark of a truly free society. In this we are no different from the United States.
In addition to being a free country, we are also a small country. Based on historical experience, we tend to be somewhat allergic to larger powers, be they in our immediate vicinity or not, trying to influence who is brought to justice in our country. If you cave in to one, you could be certain that others might try to do the same. The United States is a country friendly to us — others might not necessarily fit that description.
The three U.S. suspects will get a fair trial. No one doubts that. The outcome will be decided by the court — without any interference by any higher political authority within or outside of the country.
That’s the way it should be in a free society.
Our school lunch problem is a microcosm for what’s wrong with American life

Pennsylvania’s Wyoming Valley West School District can’t seem to stay out of trouble. First, it got flagged for threatening families that owed money for their children’s school lunches with the foster-care system. It then turned down a number of offers from do-gooders and philanthropists to pay off all the debt, only backing down this week after yet another round of bad publicity.
The story was extreme, but the actual problem was not. It can seem as though barely a week goes by without news of some school district or other attempting to get tough on children whose parents or guardians can’t or won’t pay their lunch bill, a problem so prevalent that it now has a name: lunch shaming. There was Warwick, R.I., where students whose parents were in arrears were told they would receive only a sunflower butter and jelly sandwich, and Canaan, N.H., where a school cafeteria worker was fired after giving a student an $8 lunch when he didn’t have money in his account, and reports that school district workers in states including Alabama, Kentucky, Texas, Michigan and Utah tossed the lunches of students in the garbage when they realize that the students couldn’t pay for their tray of food.
The ongoing issues with school lunches are part and parcel of our better-but-not-great economy, the one where even as people feel increasingly confident about their personal finances, serious signs of trouble remain, including a growing number of people paying credit card bills after their due date, a record amount of outstanding student loan debt and almost 40 percent feeling so financially beleaguered that they say they would struggle to handle a $400 expense in an emergency.
But these school lunch scandals are also representative of increasing punishing callousness, harshness and brutality of American life. It starts at the top, where our billionaire president, one who inherited both his vast fortune and his connections, feels no shame at taking away food and housing subsidies for people in poverty, meanwhile making a sustained effort to do away with the Affordable Care Act, which would result in millions of people losing access to health care. Desperate migrants are corralled in concentration-camp-like holding facilities at the border, where children continue to be separated from their parents for spurious reasons. Unlike every other nation in the developed world, the United States does not mandate paid maternity leave. (A Republican proposal to offer that option to new mothers would offer them a portion of their wages — at the cost of potentially reducing their Social Security payments at retirement.) Life expectancy is falling.
Yet, remarkably, despite the meanness embedded in our society, Americans view themselves as a generous people. That’s likely because we give more to charity than almost every other first-world country. Whenever a local school district finds itself in the crosshairs of a school lunch scandal, numerous people often step up to offer to pay the outstanding bills. But, in truth, our giving nature is often exaggerated. Food banks routinely report they are in danger of running out of food. A large minority says the government has no responsibility for ensuring that everyone can access health care, and most crowdfunding campaigns to help people pay medical bills do not meet their goals. People who can’t make ends meet are immediately assumed to be wasting their limited funds on lattes and avocado toast, while food-stamp recipients are viewed with suspicion, with many convinced they are somehow guilty of living a lazy, louche life on the backs of more responsible taxpayers.
As for Wyoming Valley West School District, it won’t need to take money from millionaires and billionaires to pay children’s dining bills going forward. The district plans to begin offering all its students a free breakfast and lunch regardless of need or ability to do so, something it can do because of a federal program that pays for it if many students in the district live in poverty. Here’s hoping it can continue to do so. President Trump’s proposed federal budget, released in March, would have made significant cuts in the program. The administration is also considering redefining poverty in such a way that more than an estimated 100,000 children over the next decade would no longer qualify for a free or reduced-price meal at school. That’s hardly a happy ending.

The Supreme Court’s Decision And How It Impacts Hundreds Of Thousands Of Dreamers

On Thursday, June 18th, the Supreme Court ruled the Trump Administration’s cancellation of the Deferred Action for Childhood Arrivals (DACA) in September 2017 as unconstitutional. Established by the Obama Administration in 2012, DACA protects over 700,000 young immigrants who were brought into the United States as children and did not have citizenship or legal residency status, from being deported. These individuals, also known as Dreamers, had to have arrived in the US before the age of 16and been in the country since at least June 15, 2007. They also had to have been enrolled in school or graduated, with zero convictions of certain offenses and posed no threats to national security or public safety.[1]
Among many other key guidelines, DACA recipients have been able to renew their statuses every two years for a fee of $495.[2]While the program does not offer a pathway to citizenship, DACA recipients are able to receive work permits as well as health insurance from employers who offer it. In some states they may obtain drivers licenses and pursue higher education through in-state tuition and state-funded educational grants and loans. [3]Among DACA recipients are doctors, nurses, business owners, grocery store workers, first responders, and childcare providers. 200,000 Dreamers are essential workers who have been on the front lines in the fight against the COVID-19 pandemic. Many of them only speak English and have no recollection of the country they were born in. [2]
The Trump Administration has long been a huge critic of the DACA policy and has made multiple attempts to dismantle the act. On September 5th, 2017, they announced their decision to phase out DACA over a six-month period. If approved, the rescission would have stripped DACA recipients of their statuses and left them subject to removal by March 5, 2018.[4] The Trump Administration claimed the program had been introduced “without proper authority” and had “legal and constitutional defects”. In their effort to wind down the program, they also claimed it increased the risk of undermining public confidence in the rule of law[1].
This decision, however, was met by several lawsuits, beginning with the Regents of the Univ. of California v. Dept. of Homeland Security. The federal court in the northern district of California ruled in favor of the Plaintiffs after they provided evidence that the decision to rescind DACA lacked legal basis and violated the Administrative Procedural Act and the Due Process Clause of the Fifth Amendment. The court ruled the university would suffer irreversible damage by losing DACA recipients and their contributions as students and employees.[4] Numerous other organizations also challenged the rescission.

Furthermore, on May 1, 2018, 10 states sued the administration, challenging the initial creation of DACA. Led by Texas, these states urged Federal District Courts to halt the program until the legal issues in the case were decided upon. Judges continuously made the decision that an injunction was not in the public interest. Then-Attorney General Jeff Sessions of Texas and the Trump Administration simply declared DACA illegal and unconstitutional, without providing detailed justifications for cancelling the program.[5]The repeated failure of this argument in federal courts in 2017 and 2018 set the stage for the Supreme Court DACA ruling.
On June 18th, 2020, Supreme Court Justices ruled, 5-4, that the Trump Administration’s move was unlawful. The majority opinion, written by Chief Justice John Roberts, who joined with the court’s four more liberal justices, stated, “We do not decide whether DACA or its recession are sound policies… The wisdom of those decisions is none of our concern.” The ruling was instead based on how the Administration went about cancelling DACA and whether they could have done so. The Administrative Procedure Act forbids the government from making sweeping, consequential policy decisions that are “arbitrary and capricious”. [6]

The then head of the Department of Homeland Security, Elaine Duke, simply stated in her memo the belief that the program was unlawful and unlikely to stand up in court. The new head of the department, Kirstjen Nielsen, attempted to revise the Administration’s reasoning in a short memo after the previous argument failed. In her memo, she attempted to provide more of a complete explanation. The Supreme Court, however, ruled that the D.H.S. could not “rely on reasons offered nine months after the rescission and after three different courts had identified flaws in the original explanation.”Roberts indicated that the memo was too late and that an agency must defend its action based on the reasons it gave at the time it acted, instead of when the case is already in court.[5]
Justice Roberts also noted that Duke’s memo did not address the extent to which young people relied on this program. They have attained degrees, begun careers, bought homes, and started families in the U.S. In addition, 200,000 U.S. citizens are the children of DACA recipients along with the fact that these recipients pay around $60 billion in taxes each year.  
The Supreme Court however did make it clear that an administration can rescind a program like DACA, and immigration experts do not disagree with that statement.The way Trump went about canceling DACA was illegal, but if done properly in the future, all the justices seemed to agree that the president does have the authority to cancel the program. This means that the White House is free to try again.[5]
Among the public, DACA is a very popular program. Recent polls show up to 85% of Democrats and independent voters are for the policy and huge majorities among Republican voters are in support as well.[5]
143 business associations and companies filed briefs in support of DACA, explaining that rescinding the program will harm the economy. The libertarian Cato Institute estimates that companies will face $6.3 billion in costs to replace Dreamers "if they can even find new employees to fill the empty positions". CEO of Apple, Tim Cook, noted that his company employs 443 Dreamers who come from 25 different countries and four continents.Cook argued, "We did not hire them out of kindness or charity… we did it because Dreamers embody Apple's innovative strategy. They come from diverse backgrounds and display a wide range of skills and experiences that equip them to tackle problems from different perspectives.” [1]
The ruling was a significant setback for President Trump, who had promised in his election campaign that he would “immediately terminate” the program. He provided expected harsh criticism of the ruling, stating the it didn’t seem to be "based on the law" and that it "tells you only one thing, we need NEW JUSTICES of the Supreme Court."[1]
Leaders from the Democratic Party, however, applauded the court’s decision and have encouraged more permanent protection for Dreamers. Senate Minority Leader Chuck Schumer stated, "We've always believed in immigration in America. We've had some dark forces oppose it in recent years, but we believe in it. It's part of our soul.”Many lawmakers also pointed to the Dream and Promise Act, a bill that prohibits removal proceedings against certain immigrants and provides them with a path to permanent resident status. This is the next step in the fight for DACA and the bill is currently working its way through the Senate. [1]
Although the issue is far from settled, the recent decision gives DACA recipients a lifeline."Today's decision allows Dreamers to breathe a temporary sigh of relief," said Professor Stephen Yale-Loehr of Cornell Law School. "The administration may try to terminate the DACA program with a better justification, but that will take months or years. In the meantime, Congress should enact permanent relief for Dreamers to end this drama once and for all."[1]

The President is expected to sign H.R. 299, the "Blue Water Navy Vietnam Veterans Act." This legislation includes language which will eliminate the cap on the VA home loan guarantee. Veterans, under this legislation, will be able to purchase any home they qualify for using the VA home loan (with zero down payment).
As introduced, the legislation would slightly increase some of the guarantee fees for all veterans using the VA loan program, in order to pay for the healthcare component. NAR opposed this language, and in conjunction with other groups, was able to mitigate the impact of these increases. NAR will continue to work with the VA on implementing the loan limit provision and assuring all veterans have access to the home loan benefit.

(Foreign Policy) On Tuesday, Russian President Vladimir Putin said he would approve newly-proposed changes to the Russian constitution that would allow him to remain in power until 2036. Under the current constitution, Putin would be required to step down when his term ends in 2024, and speculation was rife about what Putin would do next. Putin was not definitive as to whether he would continue as president, telling Russia’s parliament, “I’m sure that together, we will do many more great things, at least until 2024. Then, we will see.”
Is China Returning to Business as Usual? (Foreign Policy) Life in China appears to be beginning to return to normal after weeks of lockdown due to the coronavirus. Although the streets of major cities aren’t anywhere near as crowded as before, people are coming out again and offices and factories are starting to spring back to life. The makeshift hospitals erected in Wuhan amid the outbreak have been closed, and the epidemic seems to have been broken there. On Tuesday, President Xi Jinping arrived in Wuhan for a carefully planned visit. There, local leaders have demanded that the people show their gratitude to the party, which received some pushback. Don’t confuse this with actual normality. Life in China is still happening under the shadow of the virus, with temperature checks, app monitoring, and other biosecurity measures. That includes a just-announced 14-day quarantine period for all international arrivals at Beijing’s airports, which could extend across the country soon. Movement within the country is still restricted, including for migrant workers.

The Minnesota Gophers Look to Make a Statement. (Jesse Johnson/USA Today Sports.)
     War Eagle, everybody! SEC bowl season is here, and begins tonight in Houston, Texas. This is my favorite time of year, when I can sit back and watch lots of good teams from around the country, and see matchups of the sort I normally don’t get to see during the regular season. And mostly, I love to see how the SEC stacks up against the rest of the country. Lately, that answer has not been good. The SEC hasn’t had a winning bowl record since 2015. Last year’s SEC teams went 6-6, after fielding losing records in 2016 and 2017.
     Auburn faces a historic matchup at noon on New Year’s Day, against the Minnesota Golden Gophers. The two teams have never played each other in football. Minnesota has some pretty good scalps on its belt from this past season, including knocking off Penn State when the Nittany Lions were 4th in the country. A perfect season was derailed at Iowa, then the Gophers were thumped by 21 points at home against Wisconsin.
     There is no question that Minnesota can pile up the points and the yards, with a tandem of 1000-yard receivers, a great quarterback in Tanner Morgan, and a 1000-yard rusher in Rodney Smith. The Gophers are averaging 34.3 points per game. I think Auburn will be stronger up front on defense, so we will likely see Minnesota utilize quick-passing strategies like most Auburn opponents have, this season. Auburn likes to use mostly man coverage. Opponents have tried to isolate size on cornerback Javaris Davis, and speed on nickelback Christian Tutt. Auburn will allow short completions, but until the Iron Bowl, few of those passes went for very many yards as the Auburn secondary is fundamentally very sound on tackling.
     Auburn’s key to winning this game is to get some production out of the ground game. With a healthy Auburn backfield and offensive line, this should be possible. In their last game, Minnesota was blown out by Wisconsin 38-17. The Badgers did it by rushing for almost 5 yards per carry, and eating the clock.
     The Outback Bowl will kick off at Noon Central Time on Wednesday, New Years Day, and will be televised on ESPN. We’ll have our usual trackemtigers.com open thread up and running for this one.
     There is quite the slate of post-Christmas bowl action this season. I had a great time last night watching the mighty Miami Hurricanes get shut out 14-0 in the Independence Bowl against Louisiana Tech. That team has fallen fast in recent years.
Upcoming Bowl Games, after the jump!
     In just a few minutes, the Military Bowl kicks off in Annapolis, Maryland. North Carolina will take on Temple in that one. I’ve been impressed by the job Mack Brown has done at UNC. There have been some stumbles, but the Tar Heels did win their last couple of games to get bowl-elegible, including a 41-10 thrashing of North Carolina State. Temple has lost 3 of their last 6, including blowout losses to SMU and Central Florida. I’ll take the Tarheels, in this contest.
     This afternoon, Michigan State takes on Wake Forest in the Pinstripe Bowl from Yankee Stadium in New York. Wake was looking like a challenger in the ACC before a late-season fade. Meanwhile the Spartans barely made a bowl this year. This is the sort of game the Spartans seem to find a way to win, and they should have a crowd advantage as well.
     SEC action kicks off at 5:45 PM in Houston, in the Texas Bowl. The Texas A&M Aggies take on the Oklahoma State Cowboys. Both teams underachieved this season, and I’ll be curious to see if the Aggies can get up off the mat after they were absolutely destroyed in the season finale against LSU.
     This evening the Holiday Bowl features Southern Cal and Iowa. This should be a virtual home game for the Trojans. This will be a good opportunity to see what decent Big-Ten and PAC-Twelve teams do in a showdown.
     Late evening action has Washington State meeting Air Force in the Cheez-it bowl in Phoenix. The Air-Raid meets the triple option, in this one. I like Air Force, in this game.
     Saturday features 4 games, 3 of them are New Years Six games, and 2 are playoff games. A pair of 11:00 AM games precede the playoffs. First, Penn State takes on Memphis in the Cotton Bowl, in Arlington Texas. Memphis won the AAC title, while Penn State missed out on the Big Ten championship game. Memphis will be playing for pride, but it is worth noting that they lost head coach Mike Norvell to Florida State in recent weeks.
     Also at 11:00 AM is the Camping World Bowl in Orlando, Florida. Notre Dame takes on Iowa State. Iowa State is a potentially explosive team, but lost some close games this season. I suspect the winner in this game is the team that is more excited to be there. Notre Dame fans were expecting to be back in the Playoff, this season.
     At 3:00 PM on Saturday, we have the Chick-fil-a Peach Bowl, in the first game of the college football playoff. LSU hosts Oklahoma in this one. I think LSU’s defense really came on in the second half of the season, and should be able to slow Oklahoma down. No team except Auburn really slowed LSU down, all season. LSU may be without the services of banged-up running back Clyde Edwards-Helaire, but the Tigers still should have plenty of firepower ready to go in this one.
     The other playoff game is Saturday evening, in the Fiesta Bowl in Glendale, Arizona. Ohio State hosts Clemson. This is a matchup featuring the best of the ACC and the Big Ten. I think overall the ACC was the weaker conference, but Clemson played awfully well down the stretch, even so. Also, Clemson has been in the playoff every year since 2014, and knows what it takes to win it all. I would also point out that Clemson defensive coordinator has had a month to scheme up something for the Ohio State offense. In the past 4 Clemson playoff openers, the Tigers held Oklahoma to 17, Ohio State to zero, gave up 24 to Alabama in 2017, then held Notre Dame to 3 last season. I’m not looking for the Buckeyes to do any better.
     Monday December 30th, we have a quartet of bowls. At 11:00 AM, we have the Servpro Bowl in Dallas, where Western Kentucky takes on Western Michigan. I’ll be honest. I know little about either of these teams.
     At 3:00 PM, we have the Music City Bowl in Nashville. Mississippi State takes on Louisville in that one. Mississippi State did not have their strongest season, but did make it to a bowl game. Louisville was blown out 52-27 by Miami, and 45-13 at Kentucky in recent weeks. Here’s hoping the Bullies can win one for the SEC.
     Also at 3:00 PM, there is the Redbox Bowl in Santa Clara, California. California takes on Illinois in that game. Again, I watched neither team play this season.
     Monday Night features the Orange Bowl in Miami. Florida will take on the Virginia Cavaliers. The Cavs won their last 4 regular season games to take their division, then got blasted 62-17 by Clemson in the title game. Considering that Florida had close losses to LSU and Georgia, I think the Gators are much more talented, and should bring a lot of in-state fans to this game. If Florida is motivated for this game, I think we’ll see a big Gator win.
     New Years Eve is a busy bowl day, this year. The action kicks off with the Belk Bowl in Charlotte at 11:00 AM. Kentucky will take on Virginia Tech. I keep on saying that Kentucky is unlikely to win with a wide receiver taking snaps at quarterback, and yet the Wildcats keep winning. The Hokies can put up some points, though. I don’t see Tech rolling over like Louisville did against Kentucky.
     At 1:00 PM, we have the “Tony the Tiger” Sun Bowl, from El Paso, Texas. Florida State takes on Arizona State in that one. Both teams are trying to build for next season, after forgettable 2019 campaigns.
     At 2:45 PM, the Liberty Bowl kicks off in Memphis. Navy will take on Kansas State in that game. Normally I’d rank the Big 12 ahead of the Mountain West, but I suspect Navy may be the more motivated team.
     At 3:30 PM, there is the Nova Home Loans Arizona Bowl, from Tucson. Wyoming will take on Georgia State in that one. I can remember opening weekend, when Wyoming knocked off Missouri and Georgia State beat Tennesee. I would think Wyoming would bring more fans to this one, but I can’t really guess who might win this one.
     At 6:30 PM on New Years Eve, the Alamo bowl kicks off from San Antonio. This one features Utah vs. Texas. Utah is fresh off an embarrassing loss to Oregon in the PAC-12 title game, while Texas has been embarrassing for a good bit of this season. I suspect that the Longhorns will fall once again, in their home state.
     Wednesday, New Years Day is strangely quiet this bowl season, with only 4 games. Auburn will play in the Outback Bowl at noon in Tampa against Minnesota. Also at noon, the Citrus Bowl will be played in Orlando, with Alabama taking on Michigan. I would have really rather seen Alabama and Auburn play at different times. I think the Tide will play angry in this game, and send Michigan fans home grumbling.
     The Rose Bowl game kicks off at 4:00 PM, in Pasadena, California. Oregon will take on Wisconsin. I like Oregon’s versatility on offense in this game.
     The New Years nightcap is the Sugar Bowl, in New Orleans. Georgia will take on Baylor. This will be a tough game for the Bulldogs. Baylor is not an easy out. The Georgia skill position players have had a lot of injuries lately, and it has been a sub-par passing year for the Bulldogs. I’m thinking we’ll see a 5th straight Georgia post-season loss.
     A couple of bowls were pushed to Thursday, January 2nd. The Birmingham Bowl kicks off at 2:00 PM, with Cincinnati and Boston College doing battle. I think the Bearcats will win this one easily. I wonder how well attended this game will be?
     The Taxslayer Gator Bowl will be played Thursday night, with Tennessee taking on Indiana. Tennessee started the season off looking like the worst team in the SEC, then won 6 of their last 7 games. I think Vol fans and players are excited to be back in a bowl game after a 2 year absence.
     Friday afternoon at 2:00 PM, we’ll have the Famous Idaho Potato Bowl from Boise, Idaho. The Ohio Bobcats will take on the Nevada Wolfpack. The extended forecast for this one looks to be rainy with temps around 40 degrees. Brrrrr.
     Saturday, December 4th will have the earliest of the bowl kickoffs, with the Armed Forces Bowl kicking off at 10:30 AM in Ft. Worth Texas. Southern Mississippi will take on Tulane. I’ll be pulling for the Green Wave, who Auburn defeated 24-6 this past season.
     The bowl season continues on Monday evening, January 6th, with the Lending Tree Bowl in Mobile, Alabama. Louisiana takes on Miami of Ohio in that one. I expect that the Ragin’ Cajuns will carry that one.
     Finally, on Monday evening, January 13th we’ll have the College Football National Championship Game, from New Orleans. It is an interesting situation this season, as we have over a 2 week delay between the playoff games and the final. My prediction is that we will see LSU and Clemson do battle in this one.
