The U.S. Supreme Court’s ruling Friday that overturned the landmark “Chevron doctrine” may give Wyoming an advantage when mounting court challenges for and against federal regulations and actions on issues ranging from wildlife and land management to energy development and industrial emissions.
Gov. Mark Gordon and Wyoming’s congressional delegation have hailed the ruling as a clear legal advantage in fighting federal agency actions they don’t like. But the ruling doesn’t necessarily hand Wyoming — or anybody else who sues federal agencies — a clear path to victory in court, according to several Wyoming and out-of-state observers.
Wyoming has much at stake. 48% of the land and 68% of the mineral estate are managed by the federal government and the Equality State has many active grievances against federal agencies now active in the courts. Since 2019, Gordon’s administration has initiated or participated in at least 57 lawsuits either challenging federal natural resources policies, or defending federal positions from litigation brought by public health and conservation groups, according to a list of lawsuits his office provided to WyoFile.
THE CHEVRON DOCTRINE
The Chevron doctrine, established by a 1984 Supreme Court ruling, instructed lower courts to defer to the expertise within agencies like the Bureau of Land Management, Environmental Protection Agency and U.S. Fish and Wildlife Service in their interpretation of carrying out laws passed by Congress. Those laws — like the Endangered Species Act and Clean Air Act — frequently do not reach into the weeds on scientific matters such as what qualifies as critical habitat or measuring ambient air quality, for example.
Under Chevron, deference to federal agencies’ interpretation wasn’t automatic, but applied when an agency attempted to reasonably interpret an ambiguous statute.
Now that the doctrine is overturned, courts may make their own interpretation of congressional intent. But that still won’t erase decades of case law, or statutory precedent, much of which is based on those agencies’ past interpretations and court actions, observers say.
“I think [courts are] going to struggle with it because they don’t have subject-matter expertise in these very intricate, technical aspects of the everyday life of an agency,” Sheridan-based landowner advocacy group Powder River Basin Resource Council Attorney Shannon Anderson said.
POLITICAL REACTION
Gordon, however, hailed what he described as a “victory for common-sense regulatory reform.”
“For years, unelected bureaucrats running federal agencies in Washington D.C. have used [Chevron] ‘deference’ as an excuse to target certain industries based on politics,” Gordon said in a prepared statement Friday. “Wyoming has experienced that firsthand. Limiting their power to overreach is cause for celebration, and this ruling begins that process.”
While not a party to the suit, Wyoming filed an amicus brief in the Supreme Court case Loper Bright Enterprises v. Raimondo, which was the basis for overturning the Chevron doctrine. Sen. Cynthia Lummis (R-Wyoming) and Rep. Harriet Hageman (R-Wyoming) also signed on to another amicus brief in the case.
“I applaud the Supreme Court’s decision to restore decision-making power back to democratically-elected members of Congress just as our Founding Fathers intended rather than allowing D.C. bureaucrats to rule with an iron fist,” Lummis said in a prepared statement.
“Today’s Supreme Court ruling is a major victory for getting Washington out of Wyoming,” Sen. John Barrasso (R-Wyoming) said in a prepared statement. “For too long unelected, unaccountable Washington bureaucrats have gone unchecked.”
Other parties who’ve tracked efforts to overturn the Supreme Court’s 40-year-old precedent aren’t so sure that it’s a clear-cut victory for industry-aligned conservative western states like Wyoming that often rail against federal regulation.
A SMALLER VICTORY?
“I don’t think there’s been a lot of really deep thinking on their side about what [the loss of Chevron] actually means,” said Brett Hartl, an attorney who heads government relations for the Center for Biological Diversity. “They almost were captured by their own ideological premise more than factual reality.”
It’s possible, he said, that the court’s decision will ultimately have the effect of strengthening some environmental laws, though it could be “many years” before the true consequences are made clear.
“Some laws — like the Endangered Species Act — are actually very clear and very strong and have a very obvious meaning,” Hartl said. “Myself … and other organizations would actually argue that, if anything, the Fish and Wildlife Service has interpreted the [Endangered Species Act] weaker than what the law actually requires.”
As courts, instead of federal agencies, take more of a role interpreting environmental statutes, the strengths of the laws themselves may become more important, he said. To illustrate the point, Hartl compared the National Forest Management Act with the Federal Land Policy and Management Act. The former, which is considered a stronger law, governs U.S. Forest Service lands while the latter, perceived as weaker, has bearing on Bureau of Land Management property.
“So the loss of Chevron may make it easier to have protections for Forest Service lands than BLM lands,” Hartl said.
NO IMMEDIATE EFFECTS
Dessa Reimer, a Jackson-based attorney with Holland and Hart, does not foresee “immediate” on-the-ground changes in Wyoming stemming from the high court’s decision. The Chevron standard of review, she pointed out, does not necessarily implicate most federal agency permitting and decision making.
“For example, the Converse County Oil and Gas Project or Chokecherry Wind or the BLM’s Rock Springs RMP: Those aren’t notice-and-comment rulemaking, so when someone challenges those types of agency decisions, Chevron deference was not applied,” she said.
The immediate effect, Reimer believes, relates to how courts review agency rulemaking. “And there has been a slew of agency rulemaking under the Biden Administration coming out this year that’s already been challenged,” she said.
The BLM’s Public Lands Rule is one example. The measure, which puts land conservation on even footing with other land uses, has been targeted by Wyoming and Utah in a legal challenge.
Typically, federal agency rules and actions swing wildly between Democratic and Republican administrations: The EPA’s stance on regional haze and the BLM’s direction on federal coal leasing in the Powder River Basin are prime examples. But within the Supreme Court’s new ruling overturning the Chevron doctrine is the notion that courts might equalize those wild administrative swings in policy direction, according to University of Wyoming College of Law Professor Sam Kalen.
“What SCOTUS did say is, where there has been what’s called statutory precedent that had a court already affirming an interpretation, under a deference standard or not, the court said, ‘We’ll still likely give that stare decisis precedent,'” Kalen told WyoFile. “So it doesn’t automatically mean that all those old cases justify revisiting.”
A lot of litigants will try, however.
“I guarantee you that litigants are going to try to revisit a lot of cases now,” Kalen said. “The way I look at it is as a threat to the administrative state.”

FSU Dominates LSU in Season Opener

What an exhilarating start to the college football season! Picture this: a pulsating atmosphere at Orlando's Camping World Stadium as over 65,000 avid fans packed the house to witness an epic showdown between the Florida State Seminoles and the LSU Tigers. It was a game that had everyone talking—a tale of two halves that had the crowd holding their collective breath.
Early on, both teams displayed unwavering determination, trading blows in nail-biting fashion. But the Seminoles seized the moment when the second half rolled around and never looked back.
One player who showed up and showed out was Keon Coleman, a highly-touted transfer for the 'Noles. Coleman proved his worth with jaw-dropping plays precisely when the 'Noles needed them. He lit up the night with 122 receiving yards and three touchdowns.
The game began with Florida State winning the coin toss and choosing to defer to LSU for the second half. The stadium came alive as the ball soared through the air, setting the stage for a game that would go down in history. LSU's quarterback, Jayden Daniels, wasted no time, launching a 55-yard strike to running back Tre Bradford. Yet, Florida State's defense stepped up to the plate, sacking Daniels thanks to the efforts of linebacker DJ Lundy.
Then came the Seminoles' offensive magic. Tight end Jaheim Bell made a crucial catch, while wide receiver Johnny Wilson ignited the crowd with two key 12-yard receptions, including a pivotal conversion on third and long. And before you could blink, Michigan State transfer Keon Coleman electrified the field with a breathtaking 40-yard reception for his first touchdown in garnet and gold.
LSU, however, was not to be outdone. They orchestrated a nine-play, 75-yard drive, capped off by Bradford's gutsy one-yard touchdown run.
When it seemed like the game could sway in any direction, FSU went three and out, resulting in a punt back to LSU. The Tigers capitalized on two costly penalties, advancing deep into the red zone. But at the 20-yard line, FSU's linebacker Tatum Bethune and defensive tackle Malcolm Ray made a stand, setting the tone for what was to come. The first quarter concluded with two incomplete passes by Daniels, and the Tigers were met with a crucial fourth and short, which was shut down by a heroic sack from defensive back Shyheim Brown.
The game continued to be a rollercoaster, with both teams exchanging turnovers. First, LSU's Aaron Anderson muffed a punt, allowing FSU's Azareye'h Thomas to recover. However, Travis threw an ill-fated pass on the ensuing play, resulting in an interception by Duce Chestnut. LSU couldn't capitalize, pinning FSU deep on their one-yard line.
Then came brilliance as Daniels broke away on a 40-yard scamper, putting LSU within striking distance. Their second touchdown followed swiftly with a one-yard rush by Noah Cane, putting the Tigers ahead 14-7.
But the Seminoles weren't ready to concede defeat. Wilson showcased his prowess with a 22-yard reception, while wide receiver Winston Wright, Jr., followed suit with an 18-yard catch, marking his debut as a Seminole. And when the pressure was on, Coleman rose to the occasion, securing a 21-yard touchdown reception, tying the game at 14-14.
With halftime looming, the Tigers made one last push to snatch the lead. But FSU's linebacker Kalen DeLoach and defensive back Fentrell Cypress stood tall, denying the Tigers a touchdown and forcing them to settle for a 36-yard field goal. The halftime score read LSU 17, FSU 14.
As the second half kicked off, the 'Noles found their rhythm with an unstoppable ground game. A wild trick play by wide receiver Duece Spann to Wilson ignited the crowd and propelled FSU into the red zone. Although they couldn't find the end zone, kicker Ryan Fitzgerald calmly nailed a 33-yard field goal, leveling the score at 17-17.
But Florida State's defense truly shone in the third quarter. Cornerbacks Jarrion Jones and Fentrell Cypress stepped up, shutting down the Tiger attack. And in the fourth quarter, it was the turn of defensive back Renardo Green to give the offense a golden opportunity.
In a pivotal moment, FSU faced a fourth-and-two situation, and they turned to running back Lawrance Toafili, who delivered on a 41-yard pass play. Quarterback Jordan Travis then took matters into his own hands, rushing in for a touchdown, propelling FSU ahead 24-17. Travis's stellar performance included 342 passing yards, three touchdowns through the air, and an additional rushing touchdown.
The show wasn't over yet. Coleman once again proved his worth, snagging a seven-yard touchdown reception from Travis, extending Florida State's lead. The defense was unrelenting, with consecutive tackles for loss by Joshua Farmer and DJ Lundy forcing the Tigers to punt and granting the 'Noles excellent field position. The scoreboard now showed FSU 31 and LSU 17.
The final, decisive blow came from tight end Jaheim Bell, who made a stunning 44-yard touchdown reception thrown by Travis, pushing FSU ahead 38-17. Bell added to the spectacle with another touchdown, making it 45-17, while a late score by the Tigers added some final points.
Ultimately, the scoreboard read FSU 45, LSU 24, and the college football world is now on notice of the Seminoles. This victory marked FSU's first top-10 win since 2016, and it left fans and analysts alike wondering if this could be the year when the Seminoles emerge as the nation's top team.
With an electrifying start to the season, the 'Noles return to Tallahassee, riding high on their impressive victory as they prepare for their next challenge against Southern Miss. The buzz surrounding this team is undeniable; anything is possible for Florida State in 2023.

What Have You Been Working To Promote Lately?
Silence Like Sirens EP - a tour through chapters of my life from breakups on Metropolitan to becoming a mother in Maine in the pandemic.
Please tell us about your favorite song written, recorded, or produced by another woman and why it’s meaningful to you.
Just gonna go with a couple recent tracks I’ve dug by newer artists who I think are being authentic in their voice and production while presenting work (and themselves) in an artful way: Due West by Kelsey Lu and Child Actor by Glume.
What does it mean to you to be a woman making music/in the music business today and do you feel a responsibility to other women to create messages and themes in your music?
I just feel a responsibility to be authentic to who I am - in any given moment in time. I think that's the boldest most beautiful thing one can do...
What is the most personal thing you have shared in your music or in your artist brand as it relates to being female?
The expansive love and deep vulnerabilities of becoming a mother.
Who was the first female artist that made want to create music / be in the business? Who's Your Favorite Female Icon (dead or alive) and why?
Grace Jones & Patti Smith because they are each unapologetically who they are, they are deeply curious, and they are compelled to create.
What was the most challenging thing you have had to face as a female artist?
Having male producers in my younger years want me to be their version of who they wanted me to be.

2022 G5 Coaching Power Rankings
As we near the end of the Power Ranking series we once again cast an eye to the best of the best in the G5. Only the top 10 coaches make the list, let’s see who’s the best out there in the mid-majors.

10. Blake Anderson
Record at Utah State: 11-3 Overall Record: 62-40 Division Titles: 1 (2021) Conference Titles: 1 (2021)
Movement: N/A
Blake Anderson returns to the G5 top ten in triumph after leading Utah State to their first ever Mountain West Championship. That’s how you do it. The Aggies are attempting to challenge Boise State as the lead program in the Mountain Division. Anderson so far seems up to the task.

9. Jeff Tedford
Record at Fresno State: 26-14 Overall Record: 108-71 Division Titles: 2 (2017, 2018) Conference Titles: 1 (2018)
Movement: N/A
It turned out to be a short retirement for Jeff Tedford, who jumped back into the hot seat after his successor Kalen DeBoer left Fresno for Washington. Tedford returns to the Bulldogs to ensure that things are running up to his high expectations.

8.  Chuck Martin
Record at Miami OH: 39-52 Overall Record: 113-59 Division Championships: 2 (2016, 2019) Conference Championships: 1 (2019)
Movement: Down 4 spots
This is more of a correction for placing Chuck Martin too high last year. He’s doing an admirable job at a place that’s very hard to win. The Redhawks made their third bowl in seven years under Martin.

7. Jeff Monken
Record at Army: 58-43 Overall Record: 96-59
Movement: Same
Jeff Monken continues to work miracles at West Point. Army won 9 games for the second consecutive year, an unthinkable feat before Monken came on the scene. The Black Knights are well positioned to keep things rolling with somebody who knows the program so well in charge.

6. Ken Niumatalolo
Record at Navy: 105-75 Division Championships: 3 (2015, 2016, 2019)
Movement: Down 3 spots
It hasn’t been a good few years for Ken Niumatalolo. Navy continues to struggle with losing, the Midshipmen have only bowled once in the past four years. Their consecutive losing seasons in 2020-21 are also a first under Niumatalolo. Can the man who’s led Navy so capably in the past arrest this downward trend?

5. Kalani Sitake
Record at BYU: 48-29 
Movement: Up 5 spots
Kalani Sitake has BYU looking good. The Cougars are playing themselves all the way into the Big 12 in a few years and lot of the credit is due to Sitake, who has done a great job maintaining the program. Brigham Young is building back into one of the West’s powerhouses just in time for a call up to the Big 12.

4. Troy Calhoun
Record at Air Force: 111-75 Division Championships: 2 (2015, 2021)
Movement: Up 2 spots
The most consistent winner of all the Service Academy coaches, Troy Calhoun turned in another strong campaign in Colorado Springs. Air Force tied Utah State for the Mountain Division title with a 10-3 record in 2021. The Falcons weren’t able to wrest away the Commander-in-Chief’s Trophy from Army, but Air Force is well positioned to compete for some time coming.

3. Bill Clark
Record at UAB: 49-26 Overall Record: 60-30 Division Championships: 3 (2018, 2019, 2020) Conference Championships: 2 (2018, 2020)
Movement: Down 1 spots
Bill Clark continues to work miracles down in Birmingham. The Blazers went from a dead program to a promising call-up heading to the American Athletic Conference as C-USA implodes. It was the first year UAB didn’t win the West Division since 2017, not a bad streak. We’ll see just how much Clark can build from here.

2. Curt Cignetti
Record at James Madison: 33-5 Record Overall: 100-31 Conference Championships: 3 (2018, 2019, 2020)
Movement: N/A
Many of you haven’t heard of Curt Cignetti, some of you probably didn’t even know James Madison is joining the FBS next year. The Dukes are coming into the Sun Belt with a head of steam. JMU has remained one of the top programs in the FCS in Cignetti’s three years at the helm. James Madison has finished in the top 3 in the FCS rankings every year of his tenure. We’ll see just how well the Dukes will translate into one of the G5′s best leagues.

Through the medium of film and photography, this major exhibition considers how masculinity has been coded, performed, and socially constructed from the 1960s to the present day. Examining depictions of masculinity from behind the lens, the exhibition brings together the work of over 50 international artists, photographers and filmmakers including Laurie Anderson, Sunil Gupta, Rotimi Fani-Kayode, Isaac Julien and Catherine Opie. In the wake of #MeToo, the image of masculinity has come into sharper focus, with ideas of toxic and fragile masculinity permeating today’s society. This exhibition charts the often complex and sometimes contradictory representations of masculinities, and how they have developed and evolved over time. Touching on themes including power, patriarchy, queer identity, racial politics, female perceptions of men, hypermasculine stereotypes, tenderness and the family, the exhibition examines the critical role photography and film have played in the way masculinities are imagined and understood in contemporary culture. Masculinities: Liberation through Photography is a major group exhibition that explores how masculinity is experienced, performed, coded and socially constructed as expressed and documented through photography and film from the 1960s to the present day.
The exhibition brings together over 300 works by over 50 pioneering international artists, photographers and filmmakers such as Richard Avedon, Peter Hujar, Isaac Julien, Rotimi Fani-Kayode, Robert Mapplethorpe, Annette Messager and Catherine Opie to show how photography and film have been central to the way masculinities are imagined and understood in contemporary culture. The show also highlights lesser-known and younger artists - some of whom have never exhibited in the UK - including Cassils, Sam Contis, George Dureau, Elle Pérez, Paul Mpagi Sepuya, Hank Willis Thomas, Karlheinz Weinberger and Marianne Wex amongst many others. Masculinities: Liberation through Photography is part of the Barbican’s 2020 season, Inside Out, which explores the relationship between our inner lives and creativity.
Jane Alison, Head of Visual Arts, Barbican, said: ‘Masculinities: Liberation through Photography continues our commitment to presenting leading twentieth century figures in the field of photography while also supporting younger contemporary artists working in the medium today. In the wake of the #MeToo movement and the resurgence of feminist and men’s rights activism, traditional notions of masculinity has become a subject of fierce debate. This exhibition could not be more relevant and will certainly spark conversations surrounding our understanding of masculinity.’
With ideas around masculinity undergoing a global crisis and terms such as ‘toxic’ and ‘fragile’ masculinity filling endless column inches, the exhibition surveys the representation of masculinity in all its myriad forms, rife with contradiction and complexity. Presented across six sections by over 50 international artists to explore the expansive nature of the subject, the exhibition touches on themes of queer identity, the black body, power and patriarchy, female perceptions of men, heteronormative hypermasculine stereotypes, fatherhood and family. The works in the show present masculinity as an unfixed performative identity shaped by cultural and social forces.
Seeking to disrupt and destabilise the myths surrounding modern masculinity, highlights include the work of artists who have consistently challenged stereotypical representations of hegemonic masculinity, including Collier Schorr, Adi Nes, Akram Zaatari and Sam Contis, whose series Deep Springs, 2018 draws on the mythology of the American West and the rugged cowboy. Contis spent four years immersed in an all-male liberal arts college north of Death Valley meditating on the intimacy and violence that coexists in male-only spaces. Complicating the conventional image of the fighter, Thomas Dworzak’s acclaimed series Taliban consists of portraits found in photographic studios in Kandahar following the US invasion of Afghanistan in 2001, these vibrant portraits depict Taliban fighters posing hand in hand in front of painted backdrops, using guns and flowers as props with kohl carefully applied to their eyes. Trans masculine artist Cassils’ series Time Lapse, 2011, documents the radical transformation of their body through the use of steroids and a rigorous training programme reflecting on ideas of masculinity without men. Elsewhere, artists Jeremy Deller, Robert Mapplethorpe and Rineke Dijkstra dismantle preconceptions of subjects such as the wrestler, the bodybuilder and the athlete and offer an alternative view of these hyper-masculinised stereotypes.
The exhibition examines patriarchy and the unequal power relations between gender, class and race. Karen Knorr’s series Gentlemen, 1981-83, comprised of 26 black and white photographs taken inside men-only private members’ clubs in central London and accompanied by texts drawn from snatched conversations, parliamentary records and contemporary news reports, invites viewers to reflect on notions of class, race and the exclusion of women from spaces of power during Margaret Thatcher’s premiership. Toxic masculinity is further explored in Andrew Moisey’s 2018 photobook The American Fraternity: An Illustrated Ritual Manual which weaves together archival photographs of former US Presidents and Supreme Court Justices who all belonged to the fraternity system, alongside images depicting the initiation ceremonies and parties that characterise these male-only organisations.
With the rise of the Gay Liberation Movement through the 1960s followed by the AIDS epidemic in the early 1980s, the exhibition showcases artists such as Peter Hujar and David Wojnarowiz, who increasingly began to disrupt traditional representations of gender and sexuality. Hal Fischer’s critical photo-text series Gay Semiotics, 1977, classified styles and types of gay men in San Francisco and Sunil Gupta’s street photographs captured the performance of gay public life as played out on New York’s Christopher Street, the site of the 1969 Stonewall Uprising. Other artists exploring the performative aspects of queer identity include Catherine Opie’s seminal series Being and Having, 1993, showing her close friends in the West Coast’s LGBTQ+ community sporting false moustaches, tattoos and other stereotypical masculine accessories. Elle Pérez’s luminous and tender photographs explore the representation of gender non-conformity and vulnerability, whilst Paul Mpagi Sepuya’sfragmented portraits explore the studio as a site of homoerotic desire.
During the 1970s women artists from the second wave feminist movement objectified male sexuality in a bid to subvert and expose the invasive and uncomfortable nature of the male gaze. In the exhibition,  Laurie Anderson’s seminal work Fully Automated Nikon (Object/Objection/Objectivity), 1973, documents the men who cat-called her as she walked through New York’s Lower East Side while Annette Messager’s series The Approaches, 1972, covertly captures men’s trousered crotches with a long-lens camera. German artist Marianne Wex’s encyclopaedic project Let’s Take Back Our Space: ‘Female’ and ‘Male’ Body Language as a Result of Patriarchal Structures, 1977, presents a detailed analysis of male and female body language and Australian indigenous artist Tracey Moffatt’s awkwardly humorous film Heaven, 1997, portrays male surfers changing in and out of their wet suits.
Further highlights include New York based artist Hank Willis Thomas, whose photographic practice examines the complexities of the black male experience; celebrated Japanese photographer Masahisa Fukase’s The Family, 1971-1989, chronicles the life and death of his family with a particular emphasis on his father; and Kenneth Anger’s technicolour experimental underground film Kustom Kar Kommandos, 1965, explores the fetishist role of hot rod cars amongst young American men.
