long meditation on jade and dave's relationship - part 1

here's a three-part heavy homestuck meta. took me about 3 days to scrobble together and format and everything

part 2 part 3 cooking

i apologize in advance for the disorganization of my thoughts. after writing it i realized this is probably one of the clearest glances into how my mind thinks associatively so everything relates in some way to something else in here. the foundations for my thoughts might be invisible to others because they can’t see the connections ive built upon but you can probably see them here, and that strong foundation is also why i care so much about them and why i chose to lay it all out. sometimes i feel like i have Got to get this tangled associative web out of my head and into some form of writing so other people can be like, “oh so This is why you have so much to say” and can just. see into my head and where it all comes from for me. people have expressed interest and the general opinion tends to be that people like hearing my thoughts a lot so yeah. pov you are in my brainwebs. seatbelts everyone get on the magic school bus in that bitch

some time ago i saw this post i saw as i was going through florals jade tag again. my homestuck hyperfixation flared up again and ive been hyperfocused on dave and jade and particular just absolutely entering these monotropic black holes over them and turning them around at different angles and looking at discussions and what people thought both now and in the past and now that im older i can appreciate them even more. ive always been a fan of dave and jade both, but i cant even lie dave has my whole heart so maybe im biased as well. but i like to believe that regardless of my liking for dave and interest in not even x-ray scanning him just straight up 3D mri scanning him and rotating him in my head that my argument is still very reasonable. i just understand his psychology a lot

i want to preface this by saying i absolutely love floral and im so glad she’s on the hsbc team because i know she can do jade harley justice. one of the best jadesters fr. we all come into media analysis with different personal experiences and perspectives, and i understand this was from her perspective as someone who had run ins with dumb boys and relates a lot to jade which is why she can put so much love into her <3 i just found myself disagreeing with some of the arguments that she presented in that post just as a peer who also read the comic from my own perspective. keep in mind i also love jade to bits and want the best for her

so yea this isn’t a targeted post at all. it just got the juices flowing and inspired me to actually write my pre-existing thoughts down and i used it as a springboard for them

i think it ended up being pretty insightful overall especially because i was stoned as fuck writing it and ive come to realize being stoned amplifies and improves the output of my deeply inwardly associative thought processes tenfold. or maybe weed just changes how significant it feels. maybe a little of both

part 1: on using davesprite as a basis for interpreting jade's relationship with all daves

i love what hussie does with alternate versions of characters and. it’s one of the coolest things about homestuck’s characterization. like floral quoted:

… we see that Jack is a simple man, no matter what name he goes by. He is, if not much else (and he’s not), impatient and violent. We only got the briefest glimpse into these qualities when we were first introduced to him on Derse. But now we get to spend much more time with him, albeit in the form of a completely different character. This is another bit of sneaky utility provided by this intermission tangent. It serves as an arc to help indirectly characterize the villain of the early acts. Having multiple copies of a character operating in totally different circumstances turns out to be a great stealth characterization tactic, and it gets used much more aggressively later in the story. In fact, it proves to be inseparable from one of the story’s most essential themes. (Hussie’s Intermission commentary)

so i agree in principle and think the alt self thing is fucking brilliant

however, i disagree with the argument it’s supporting.

So, not the same character, but if switched, I would go out on a limb and say that Dave would experience all the same issues as Davesprite did, but without the “bird” part acting as an easy explanation. That doesn’t make Dave responsible but it does speak volumes to how their personalities respond to each other, insinuates that a relationship involving any Dave would end badly for Jade and that “Real” Dave indeed has Some Issues To Deal With.

i don't agree that dave and davesprite should be compared in this context. yes they are splinters of the same character and floral is right on the money in that canon deflecting the relationship failing on "bird issues" doesn't really explain anything meaningful, but i do not think its the case that all of jade’s relationships with dave are doomed to fail because of what we saw with jade and davesprite.

yes, if switched, dave strider would be practically identical to davesprite since they were the same exact person until a branch in the timeline

however, it's the unique things davesprite has been through that made him like this. davesprite has baggage that dave doesn't. a timeline where john was tricked into fighting his denizen early and died and jade couldn't get in on time and was presumably wiped out dinosaur style on earth. with alt future dave's year-worth of knowledge, gear, loot, and experience, he rescinded his player status and "realness" as a human person to be a game guide for his naive past self right before the timeline split in order for himself and his friends to continue existing.

that would mess anyone up mentally. it's no wonder he's jaded, no pun intended. he's depressed as shit and bitter and probably has trauma issues unrelated to his bro, though they do compound on it. yes they both experienced bro's abuse but i'm talking about the differences between alpha timeline dave and davesprite; right now im not going to talk about things that are the same about them prior to the timeline split because it applies to them both so it's redundant.

essentially what's setting them apart is their experiences playing sburb, their chronological age (alt future dave/davesprite had been making timeloops over a span of four months and he says that in total the time from his chronological perspective is close to a YEAR in sburb grinding shit out before he goes back), their relationship to their friends and how their friends see them and how they see themselves, their ontological natures as beings, what their purposes are.

davesprite had his ontological status as a person and purpose changed. he assumed he'd be the one playing and doing important main shit in the alpha timeline with all his friends but then it turns out that wasn't the case due to the events that went down in his timeline. and becoming a sprite solidly changed his degree of existence. davesprite's best friend john asking if he can talk to "the real dave" is when i think he realized just how fucked up his existence as a person has become despite him doing pretty much everything for everyone for nearly a YEAR before the alpha timeline was even able to get properly started. if davesprite didn’t exist, nobody would have (john needed to live to do ectobiology). davesprite knew this and weaponized it against john who john treated as a secondary, lesser dave. so of course he’s kind of an asshole. it’s like his efforts and sacrifices meant squat to the people he considered his best friends because they didn’t experience it. to john he just suddenly appeared from the future and became a sprite.

this is heavy shit for davesprite that alpha timeline dave does NOT have to go through and it did change him in ways that cannot be said about alpha timeline dave. this is not a universal dave experience. so while it’s true that dave has the capacity of act like davesprite under those exact circumstances, alpha timeline dave didn’t undergo those that led to davesprite’s more miserable traits. therefore i don’t think it’s fair to conflate jade’s failed relationship with davesprite in particular as informing of how most of jade and dave’s relationships would unfold, because davesprite has been in exceptionally tragic circumstances, coming to terms with the state of his own existence. the last thing davesprite needs is romance. alpha timeline dave does not carry this burden.

Everyone believed that what was creating the dissonance wasn’t a central part to Dave’s character but an aftereffect of Bird Syndrome. Which you can’t blame them for because there’s nothing that would lead them to think differently. Every character besides Dirk is completely in the dark about Bro’s abuse and Dave stated he’d probably never tell any of the Betas. Which is fine, no one’s owed to know somebody’s baggage. But when you don’t give people a means to understand what you’re going through, especially when it leads you to hurt them, its only inevitable everyone’s going to be confused and going to come to conclusions using what they do know.

rebuttal to this: as i said earlier i don’t buy the whole bird issues thing and i get the handwaviness about being fused with a bird being john’s explanation for davesprite’s bullshittery. however i think it’s important to mention that john and jade both question if becoming a sprite might have had something to do with his change.

being fused with a bird never bothered him, as jade says. it was all the other baggage that came with the prototyping.

this includes playing the game for way longer than anyone else and mindlessly grinding from the ground up for about a year, then turning himself into a game construct and having his ontological level of existence as the platonic ideal form of dave strider lowered in the eyes of his friends.

JOHN: like what? JADE: its hard to explain JADE: just some slight differences in personality i guess JOHN: he still raps sometimes. JADE: yes... JADE: so? JOHN: i just thought i would mention that. JADE: ok i will admit i cant really tell if his rapping style has changed JOHN: trust me, it hasn't. JADE: i dont know if the differences are because he is a sprite JADE: or because he lived for a while in a different timeline... (p.4733)

JOHN: why is he such a basket case? he's like regular dave, but like, aloof enigma edition. JOHN: maybe it's because he's part bird? i think becoming a bird and a sprite did something weird to him. JADE: i dont think being a bird ever bothered him JADE: like i said... its all more complicated than that JOHN: normal dave was so much more level headed. JOHN: i have to admit, i spend a lot of time wondering what he and rose are up to. JADE: me too JOHN: ehh... JOHN: maybe it's for the best he broke up with you. JADE: why? JOHN: well, what kind of future do you think you would have with him? JOHN: he's a sprite. like really, what even is a sprite? how long do they live? will he still be around if we win the new game we are allegedly trying to get to? JADE: i dont know (p.5294)

as for the bro abuse thing, i can’t tell if floral’s position here is that davesprite is fucked up and had a failed relationship with jade because of bro’s abuse, and that dave would also necessarily have failed relationships with jade because he had the same experiences and also doesn’t tell anybody? the wording there is kind of vague and can be interpreted in different ways but that’s how i interpreted it.

they are right that bro’s abuse is something dave keeps to himself. but remember that dave has also deluded himself about it to cope. he doesn’t know what to think of it himself. both alpha timeline dave and davesprite have this baggage, but we explore it more with alpha timeline dave.

i know dave said in the post-retcon timeline when having a conversation with dirk that he could never tell karkat all of this or any of the betas about his abuse. but i still find this pesterlog interesting and i want to put a spotlight on it. even while dave was still chugging that copium, jade was the person he was closest to opening up about the nature of his relationship to his bro at this point. remember this is quite early on in the comic and he didn’t have 3 years on the meteor to contemplate it yet when he said this to her, his bro had just died at this point

GG: anyway dave im really sorry about your bro/dad GG: you were pretty close with him right? TG: meh it was a pretty bizarre relationship by any standard TG: fightin off wave after wave of face pumicing puppet ass every day TG: always being on guard for stealth attacks in the middle of the night while getting up to go to the fucking bathroom GG: heheh TG: but i guess it all sorta amounted to some vague unspoken semblance of kinship TG: if thats a thing TG: like if honor among thieves is something then lets call it camaraderie among ironic rapping roof ninjas TG: but thanks GG: sure TG: i thought about taking his sword TG: when i was there TG: but i couldnt TG: couldnt really bring myself to try to pull it out it was too weird GG: dave we have to stop him!!!!! even if he’s in denial about it, deciding to point out the positivity he can rationalize about it to avoid spending too much time thinking deeply about it (it makes him uncomfortable), he’s getting closer to acknowledging the truth here that shit wasn’t normal, about it being “bizarre” and you can tell hes being genuine here when he thanks jade for her concern about his loss

dave then continues talking about his thoughts/feelings on the situation after jade says “sure”, as if he took her concern as an invite to open up about his thoughts even when it’s something vulnerable for him that he tried putting on false bravado in front of terezi about. jade then abruptly changes topic to what’s to be practically done about these tragedies—dave was still on the topic of his bro and she changed the topic to jack noir without clarifying, hence he goes “what”

this is interesting because terezi tried to get something out of him about this and was met by riddly puzzlecock and false bravado but he’s pretty straight up about his current feelings with jade. basically it really depends on the person dave is talking to.

in this specific argument, floral approaches grimbark jade solely from the position of her being uninhibited which is true in many ways, but grimbark jade is also quite nefarious and not in her right mind. i think that even if jade were unihibited and spoke her mind, she wouldn’t have it in her push the mayor into lava to get dave to fight her. thats the evil. floral does acknowledge this in a separate post though, but it’s not really touched on in her argument im discussing. i also want to reiterate that even though it might seem like im violently ripping this post limb from limb its really just something to bounce my pre-existing thoughts off of. this is all written with civility towards and respect for floral

even roxy says something about this—that the schtick doesnt suit her. like it doesnt feel like something she’d have the natural capacity to really be without some external influence

so i don’t think everything jade says here should be taken to heart about her real feelings or how she would express them if she was being genuine as her normal self. we know jade can get mad but i think we’re giving her evil possession a little too much credit

that’s why i was personally disappointed in grimbark jade when homestuck was ongoing, is it felt like it didnt really give us anything? it was like empty calories while just waiting for the regular jade to come back which she never did. it is interesting to look at in retrospect to see if there’s anything there but…grimbark jade isn't exactly a reliable narrator. i guess none of them are but like, especially not grimbark jade. if i can’t separate what’s genuinely jade under this mess from what isn’t then what’s the point?

like for example this was left out of floral’s argument when showing this part, but in the comic grimbark jade tells dave that he’s “more messed up inside than davesprite” …. right after dave wouldnt comply with her demands to fight her and doesnt want to fight lord english. that’s…not really telling about anything at all for either of them. jade is evil and if things dont go the way she’s programmed to get them to go she’s gonna flip her lid. this is what i mean about her not being in her right mind

okay, so starting off, we wanted a villain tommy arc, but now we have a sad tommy arc.. i mean, he was even considering taking his last canon death by jumping into lava. the entire time he has been exiled all he’s been thinking about is tubbo and his friends and wanting to be back home in l’manberg. after tubbo exiling him he realized that no one actually wanted him around. he’s even trying to be more independent and is refusing people’s help just because he feels like all of his friends dont want him around. even when ranboo and fundy came to visit him he made them leave early because he “didnt want to waste their time.”

obviously tommys glad that ghostbur is with him in logsted, but the fact that ghostbur keeps going back to l’manberg and wants tommy to come back with him, upsets tommy even more. also, even though tubbo promised to help tommy find the discs, in the end tubbo said that the discs dont matter and that tommy is too obssessed with them.

i think that techno said it really well. (i dont know where the actual quote is, so im going to paraphrase.) “imagine giving your life to a country just to be exiled, haha look at this loser.” this is a great quote to represent what’s happening to tommy, because not only is tommy a loser, he also gave his all to a country that he was kicked out of. he fought for it, he was with it since the very beginning, and even when he was exiled the other times, he fought to get his country back and he worked so fucking hard just to be betrayed by his friend.

i personally think that tommy was mostly, (key word mostly), in the right. dream makes his own rules, he does what he wants, says he’s on the side of chaos but when someone calls him out for it he immediately flips sides and says that he’s doing everything for peace in the smp. so when tommy fought back and burned georges house, dream shouldn’t have gone that crazy. but then, at the first sight of a small threat, tubbo kicked tommy out. but, literally right before, dream had dethroned george, giving the throne to eret. obviously, since there was no reason to do that, george was mad and joined the side of, then, mexican l’manberg. so, what is dream even fighting for? chaos, as he said himself.

and with the tubbo is turning into schlatt theory, i would have to agree and disagree. obviously he thinks he doing the right thing, but in reality he is acting just like schlatt. schlatt would lie and exile someone who was his “friend” and not even tell any of his associates. schlatt would encourage the hit list and killing dream, even after dream held up his part of the deal. schlatt would pretend to be on dream’s good side just to go behind his back and plot to kill him.

but, to condradict tubbo turning into schlatt, i think that tubbo just wants to be seen as his own person. hes always been the sidekick, yunno, “tommy’s friend.” he just wanted to be important, in other words, to have power all by himself. tubbo just wanted to be a good president, a good ruler, but instead he ended up losing his best friend. now he kind of has nothing.

Now, I would like to compare tubbo to wilbur, because i miss wilbur, normal wilbur, that is. when wilbur was confronted with death, he stood up for himself. when wilbur’s entire nation was rigged with tnt by dream he still stayed strong to eventually get l’manberg, and freedom in the process. dream says, “give in or die.” now, tubbo faced with this situation would give in, as shown by how he exiled tommy just because dream threatened him. but, wilbur responded with, “independence, or death. if we get no revolution, then we want nothing. we would rather die, than give into you and join your smp.” wlibur got blown up and lost one of his canon lives.

tommys lost everything. he lost wilbur, techno, lmanberg, the discs, his friends. to him, he has nothing left. he really feels that he has nothing to live for.

i guess in the end wilbur was right. “tubbo? he’s lying to you man! he would drop you in a second!”

hmm i think that like. even without a mentor's guidance yao will probably become less unruly and wild as he ages, as a process of growing up and becoming less focused on causing Chaos (he's directing that feralness to like. making an actual plan to take over the world probably), because society's tolerance for buckwild bullshit decreases as you get older and older, and the likelihood that he'll miss out on awards and other accolades if he continues this sort of behaviour, which his ambition won't allow for. BUT what i think won't change is the fact that he's an arrogant asshole and he becomes more and more so as he grows up with a lifetime of academic and extracurricular excellence. so im just saying imagine said sub in high school absolutely tearing apart one of his assignments. like just covering the whole thing in red-inked ruthless rebuttals and giving him a c. yao has never gotten a c in his life and is both humiliated and impressed because the sub is RIGHT, and they managed to outlogic him (which up till now only his friends + nyo china could probably yao doesn't associate with dumb people). and then he progresses amazingly in that class during the sub's remaining time with them and gets nyo china to let the sub teach him when they land a job. like i feel as though he would greatly benefit from an older mentor who won't tolerate his bullshit and would challenge him to reach new heights and this might be person!! (this thought is kinda unrefined and doesn't fully explain the Vibes but i need a nap now + it's not really Baby au anymore it's Slightly Less Baby au fhwinfkwg good afternoon to you and good night for me!)

And to your last paragraph, HELL YES IT’S CANON NOW. “Yao doesn't associate with dumb people” I’m crying omg. Yao takes all honors/gifted classes and doesn’t speak to anyone who doesn’t 😭 The big red C glaring at him from the top of his (once beautiful) essay stabs him viscerally in the chest and he needs to take a few days before looking at it again in order to recover his strength ego. He reads through all the comments and each one shreds his ego even more lmao; they’re not even mean comments but he just knows the sub is Completely Correct and sinks into a low like he’s never had. But they slowly warm up to each other especially as Yao gets ~reformed~ ever so slightly, and then it turns into friendly bickering and Long Debates on various intriguing topics (Yao always plays devils advocate in those :|). But yeah I definitely think she’d be a good candidate ig, since she doesn’t take bs even from the star pupil who is also an ass. And she’s a sub at first, so it gives her a little bit more room to throw hands whenever she wants instead of having to control herself lol

watching xikan on the 娱乐新鲜派, 一起爬墙吧 , and sina 娛情实验室 interviews just made me appreciate him even more. his snarky, playful side contrasts well with his caring, protective side. and i feel like we saw more of the former during ip and we’re seeing more of the latter during snzm. both are nice to see, but i miss his silly fun side and im grateful he still has it in him to act cocky in a non-snobby, but rather joking way but also speak like a true friend about how he feels about his friends who have found success post ip.

Here we are again my lovely muns! Another Christmas has drifted around, and it’s now almost been four years since I started writing Leo. That’s a crazy amount of time for me in the world of roleplay. Through each of those years, you guys have brought a smile to my face every day through your writing, muses and just being who you are. They’ve been some of the hardest years of my life but I’ve been lucky to have you all by my side. Truthfully, I’m not sure what’s going to happen next year. I start a new job in January and it’s going to suck up my time mercilessly. I don’t know how much I’ll be able to be around. But I will never leave. As long as I have a place to escape to here, I know I can get through things. I want to support everyone else just as much as you have supported me. I don’t know if I’ll ever find a way to accurately portray how much you all mean to me. Around Christmas, you’re supposed to spend time with the people you love. Even though that includes you guys for me, there are countless oceans and countries that get in the way. I’m not Santa sadly, so there’s no travelling by reindeer to see you all like I’d wish to. But at the very least, I want to reach across to you and give you all a hug with words. Which is dumb really, considering I tell you nearly every day and holy crap, you must be so sick of it by now. But nothing changes, no matter how many times it’s said. It doesn’t lose its impact. It’s always true. Want to know I really random fact? The first time I went on to your blog, the post I saw first was one of strawberry and cream cake. Not only did that just make me adore you at first sight (I love strawberry and cream cake it’s my favourite cake ever) but it also made me associate you with it a little ^^ Perhaps it’s cuz you’re so sweet, or that now I always imagine Sooyeon and Leo baking together and feeding each other strawberries. Or maybe it’s just the fact that you’re the strawberries to my cream hehe~ One wouldn’t be here without the other. I’m so thankful to know you and to have our SooLeo.

☆ @numberxix I told you this a while ago but it’s still something I think about around this time of year. The day we first started talking was new years day, about two years ago now. What I didn’t tell you that much of was that I had had a really bad start to that year. I’d had a bit of a panic attack on the way home from seeing family. It was pretty much the worst first day of the year you could get. But then we started talking. You were one of my first reasons to smile that day. And it’s been like that for this entire year since. We have so many ships between our muses, romantic or friendship and I love every single one of them. Kyungri and Jaehwan will of course always be the first in my heart. But I can’t wait to see how they all develop. There are so many ideas we have, so many little scenarios and I wouldn’t want to share them with anyone else.

Hiiii, Love!!!! I’m so sorry it took me so long to answer! but yesterday I was busy, and when I came home my head hurt like a b*tch, 😖😖. Liam’s eyes very pretty, aren’t they? And then one night we just starting watching a video of AuronPlay reading a fic, and he was happy for the first time in months. Tbh I never payed attention to that, :/ (heteronormative mind and all that). If I had, maybe I had known about a lot of my high school friends’ sexuality. Looking back, we were just a group of friends, boys a girls, nobody cared about boyfriends/girlfriends (we were friends from 12-16). Then we went our separate ways, and we lost touch. And now I see in Facebook that they are gays and lesbians, and I’m like… :/ we didn’t know much about those things back then. And I hope I didn’t make any comments who could offend/affect them. But it makes me so happy to see them being themselves and living with they’re boyfriends and girlfriends… 😊 I just wish I could have been a better friend back then 🤷🏻‍♀️. But now I pay attention to that. And I always try to show support in a non invasive way. And try to educate people about who they’re been homophobic, or make not appropriate comments… like there’s this boy (around 16) that likes to paint his nails. And I love everything to do with nails. And, at the shop, I comment on people’s nails (if I know them enough, lol). And I always try to say something nice to this guy. To normalize the fact that he has his nails painted (and no make a statement that I approve of it, if someone else is listening, so they don’t make rude comments around me). And then my friend’s sister is Lesbian. But their mother is so ancient-minded… like, my friend has a dit of fat, and she’s always making comment about how she should be skinnier bc she won’t ever find a husband 😒. And her sister is very thin. And once, she was working as cleaner in a /cuartel de la guardia civil(?)/. And their mother was always: hmmm, I hope she finds a good guy there, bc she’s never had a boyfriend. And I always thought: I wonder why, lol. Well, she finally came out to her parents, and while they don’t treat her different (which I don’t know if it’s good or no), they’re like “waiting” she changes her mind. And hoping she finds a boyfriend. Anyway, her mother is friends with my mom, and she comes to visit at the shop sometimes, and she always has a comment to make about what people do or don’t do. And I get so angry 😡. I’m always correcting her. But she doesn’t listen. And I feel sorry for my friend and her sister. So whenever I have the chance I saw her my support, and always talk about these things, lol. (I talk so much about lgbt+ things, that my family associates me with it, to the point that every time they see a rainbow or whatever they tell me: look look! And I just satisfied with it. Well, she isn’t a nasty anti, jajajja, but she doesn’t think they’re together. Not for nothing special, just that she thinks they would say it if they were together. Episode #1- “I AM ONE OF THE TWO OLD LADIES OF THIS SEASON AND I’M ONLY 29!!”- Gwen

Here is what I wanna say before the game even starts: I want to be the villain of this season. I wanna piss people off, stab people in the back, and do whatever I can to ruin other people's games. In all honesty, I don't really care about winning or not, as long as I have fun while doing it. The goal is to be like Russel Hantz or Tyson. I picked Tommy as my icon for the irony, because everyone else will associate me with his kindness before I stab them in the back.

I'm looking forward to this game! So glad it's with a bunch of newbies, I was worried it'd end up being a half and half deal and that's the format I've been completely fucked over by in the past, so fingers crossed without jinxing myself I can thrive here! I'll do a proper cast assessment of my tribe in the morning when I've spoken to more people and gotten a better feel for them, but I already love Gwen and she's definitely somebody I can see myself working with. I need to rewatch the introductions as well since there's so many videos.. obviously missed the memo about that myself oops!

feeling really good on day one so far. the tribe seem great and im already keeping my eye out for a few i wanna work with . we wil just see what happens after the immunity challenge .

Sweet fishsticks on ice, what a night! I talked to everyone on the tribe and they are awesome! My goal is to use today to try and get to know everyone more and make them comfortable. I'd say ai definitely do vibe with a few people, namely Gwen, AnnMarie, Rizo, and Liam but I like to keep my options like the oceans- open

Something funny took place! I talked to Gwen who said she wanted to work with essentially me, Rizo, AnnMarie, Sara, and Liam. No more than 2-3 minutes after, Rizo messages me with more sorta the same proposal. Dont get me wrong I am for this, but I will say it was pretty telling to me of the ones I may have to keep my eyes on!

Marooning Night: Everything’s looking solid so far. Tribe seems to be shaping up nicely and I’m making some good connections with people. Hopefully we can be competitive in challenges. I’ve connected with AnnMarie through band, Sara through zwooper, Rizo through sports, and Tim right off the bat through not mowing what we were doing :) I haven’t gotten the chance to talk to Kyle yet, but from his video I gleaned that we are both big husker fans and that we were both at the Nebraska Iowa game, so there should be a good connection there. There is one thing that makes me a little nervous though. I looked through the cast reveal and I am the youngest person on the cast. I know that’s doomed the game of some survivor players, and I’m not sure how much that will affect this game. I guess we’ll have to wait and see.

Well I love everyone. So friendly! I have a lot in common with everyone and it's so exciting. I enjoyed meeting everyone, but the game part of the game came quickly behind. It seems that a group is developing with me, rizo, liam, chris, and gwen. I'm glad that Ive already been pulled into a group, it makes me feel comfortable. But I have to be careful. It is only the first round. I'm worried about my inactivity and that affecting challenges. I gotta wakeup at 5 am for school, so going to bed at midnight may not be the best. Hopefully no one notices.

Morning Day 1: What the hell. You’ve got to be kidding me. This sucks. Why does this have to be the twist in my first season. We have to get THREE players voted out of the game before we can get an idol, and then if we keep playing them right we can get up to three straight. We got our target list, and of course, I got AnnMarie, Tim and Sara. Three of the people I’ve connected with the most and wanted to work with. And now, in order to have a chance at the first idol(s), all three of them have to be voted out. I don’t think I’m going to try for that idol very hard, at least not until we get new target lists, cause I want to work with those people.

Right now I could see three possibilities for first boot. Cheatham and Zach haven't been that active, and then Will just makes me feel so uncomfortable that I sort of want to vote him out right now. But not in a "hey lets throw the challenge to vote him out" way bc he won't be playing so it might be unfair based solely on that. Austin is cool but a little inactive so far, he seems decidedly average. Tawny hasn't spoken to me yet :( but still she spoke a lot in our call so if I were to target her based off that it could only end poorly. Noah is cool, I get the feeling he is going to overplay tremendously, so maybe I'd like to have him as my number one. Amy and Dylan are great as well, and I would also love to work with them if I can. Ideal alliance so far would be me, Amy, Austin, Dylan, Noah so far. But only if I'm not the guy who organizes it singlehandedly

What’s on my right now is that I am very comfortable with where I am in the game, I have already made connections with a few people and I am very confident I will be staying in this game for a while. What’s on my mind is that The Cock Destroyer alliance will hopefully run the tribe, my main objective is to not get the weak people gone first since I wanna drag them alone like a sack of meet so one of my main targets for now is Dylan because I’m gonna be honest I don’t trust the guy and he gotta go, PERIOD!

Holy guacamole, I went from feeling like we were Hopeless in Seattle to being D2 the Mighty Ducks. Being able to find the right door first is a huge relief but I have to gio my hat off to my entire tribe because we make a great team and Gwen rocked this!

So it's been less than 24 hours and I've spoken to everyone. Right now, I just want to get everyone to like me because that will make them want to work with me. My targets are Will, Dylan and Cheatham. Right now, I just want to isolate them, or form a majority alliance without them, because that will make my game much easier.

Uh oh. Since I have high school I wasn't able to be active all day for this (kinda confusing) challenge. I'm really hoping that this isn't going to put too big of a target on my back. My target right now is Dylan. He's one of my targets, and I'm pretty sure I'm one of his, judging by the fact that he never responded to me when I said I wanted to work with him.

Alliance time! I just made an alliance with everyone except the 3 on my target list. This is exactly how I planned. I think I redeemed myself after not really doing much in the challenge, and I'm already playing harder than the others. The fact that I created the alliance will make the people in it feel good too because now they will think I really trust them. Anyway, if all goes to plan we can eliminate one of my three targets (Cheatham, Will, Dylan) and slowly get each of them out until I get my idol.

So the alliance is me, Will, Vincent, Amy, Austin and Tawni. I got Amy to give one of the other three as a name so I didn't have to seem too vocal, and she said Cheatham which makes me home that he is gone first. But unless plans change, I'll have 1/3 targets gone, leaving Will and Dylan as my next 2 to go. I'm sorry, but this is just lining up way too easily for me.

I am so happy we won! Man talk about comeback! I think this is going to help push stuff in the right directions for sure! Rizo and I may have a pair going on but we're talking about creating a 4some (me, him, Gwen, and Sara) and maybe that can lead to a majority chat with the others. I do know I want to keep my options open without forgetting the opportunities that will soon be closed

I’m a little pissed off, so my plan was to get rid of Dylan but my so called alliance memebers are like DONT VOTEEEE DYLANNNWNWNWN, because Zach decided to think he was being clever by trying to make an alliance which excluded me but little does his tiny brain know that his ass is grass and he’s going to be waddling out of tribal. ok so we lost despite my best efforts >:( (i like writing cfs bc skype won't turn my emojis ugly here, the fact that I can read them more easily post-season is merely a bonus) The consensus is to vote out Zach, because he is easily the least active. He was the last person to really show up, still barely talked to anyone (aside from me apparently), and didn't contribute to the challenge at all. Now, I firmly believe that out of everyone in the game, Zach trusts me the most. So in a way, it would be beneficial to keep him. However, doing that would unfortunately sever my ties with other potential allies who are more likely to be useful to me, such as Noah or Austin. I did briefly try to campaign for Will leaving, and I am very sure that I could pull off a 5-4 blindside with Zach, Dylan, Noah, and maybe Amy, but that would be quite messy. Austin and Cheatham are set on the Zach train, and I have 0 relationship with Tawni, so going for those votes is unrealistic. And to be honest, the whole thing doesn't necessarily paint me in the best light, and it puts me in the spotlight I want to avoid right now. Amy - she's a good ally so far and i like talking to her, and it doesn't even seem like she's that active which doesn't make her as dangerous as some of the other players on this tribe. definitely someone worth raising hell to save. Austin - he's cool, we're together, he's active, but he's impossible to read. i cant tell if hes going to be a major flop or a major threat, this guy is going to be fun to play with, and i am 95% sure that if i'm voted out, he'll have had something to do with it. Cheatham - he's certainly an interesting character. he is quite active, which will serve him well, but i'm not feeling as if he's going to be a top contender. Dylan - he's one of my favourite people to talk to, but i've heard several people mentioning him as someone they like, so I'll need to make sure that I don't under-estimate him. Noah - I said a few hours in (in my thread) that Noah would be an amazing ally, and so far it's looking like he's my number one. I haven't lied to him at all (even by omission), and I hope we can keep this up right until I take him out at the final 5 >:) (lmao i'm not merging why should i be planning my endgame) Tawni - declaring right now she is the most dangerous player on my tribe. would be a great vote if will/zach weren't on my tribe and if she wasn't so well-connected otherwise. Who knew these ORGs could be so fun? Probably everyone reading this. But seriously, I am having a blast so far. Ok, so a few things before I get to my thoughts on my tribemates: 1. Before reading on, be aware that anything I say should be taken with a grain of salt. I apologize for my dry sense of humor and my ego in advance. 2. I AM ONE OF THE TWO OLD LADIES OF THIS SEASON AND I’M ONLY 29!! 3. You should know that I am very competitive. And I like to be in control. It is going to be really hard for me to take my foot off the gas pedal sometimes! I cannot tell you how difficult it was to leave my tribe for an hour and a half this morning for a meeting for work and have them continue the immunity challenge without me. I put together a spreadsheet and updated it as we took our turns. I was also the one to dictate our moves most of the time. The hosts were very particular about the format of our moves, down to the spaces and punctuation. I did not want anyone to send an incorrect response without me checking it first. But when I had to go into a work meeting, I had to let it go. They were successful without me (after my extensive and thorough coaching of course). They appear to be capable human beings (insert laughing emoji here). 4. One thing that I am not telling the rest of the castaways is the exact nature of my job. Luckily, my official job title is “Case Manager,” so I can get away with seeming way less awesome than I actually am. They know that I work with kids with autism. But what I am leaving out is that I supervise ABA (Applied Behavior Analysis) programs. I am planning to sit for my board certification exam next year. (Fingers crossed!!) I develop and monitor behavior intervention programs, as well as train staff and caregivers in how to implement the principles of ABA. Yes, my job involves analyzing and modifying the behavior of kids with autism, but behavior is behavior regardless of about whom you are talking. The basic principles of behavior still apply…defining, predicting, and ultimately modifying the behavior of others through manipulation of environmental variables that either reinforce or punish specific behaviors. I could go into more, but I won’t now. Maybe in some future confessional I will give some specific examples. Look at me applying my work to my “personal life” 5. I am in one “official” alliance, meaning we have a separate group chat – it is called the Sunt Pack. It consists of Rizo, Sara, and me. We are all Sam Hunt fans, hence the “Sunt Pack.” The following points are about my fellow tribemates. I’m glad I waited until today to share my opinions, because they have definitely changed since we competed in the immunity challenge! 6. AnnMarie – Very sweet high school girl. I am in an unofficial alliance with her and Sara that Sara doesn’t know about yet called “CP” – Clarinet Pride. (EDIT – she knows about it now because I just made a group chat) AnnMarie currently plays clarinet in her school band and Sara and I played clarinet when we were in school. My only concern about AnnMarie is that she can’t have her phone on her during the school day. We were able to work around it in the challenge today, but I don’t know how this will affect future challenges; however, it might be beneficial later on when the game is individual. For now, I am trying to be a “mother” type figure to her…giving her advice about after graduating high school. I feel that we have bonded over this. 7. Chris – Awesome guy! He is in the unofficial majority alliance (that I hope is the only majority alliance haha) with AnnMarie, Liam, Sara, and Rizo. We’ve had some cool chats. I think we would get along well in real life. 8. Liam – The Dom to my Colin. Very cool chap. Wicked conversation – had a very riveting discussion about how accounting and philosophy majors are so similar. Clearly. But seriously. In the unofficial majority alliance. 9. Sara – my fellow OLD LADY. We have a lot in common because we are about the same age, and we graduated high school the same year. We also both like country music. Seemed kind of quiet when we did a group audio/video chat. SARA IS ON MY LIST OF PEOPLE TO GET OUT. As much as I love a fellow Grandma, I will figure out how to get her out of the game, if not by my hands directly. In the unofficial majority alliance. 10. Kyle – He was the last person that I talked to. I definitely had the wrong impression of him before our audio/video chat during the challenge. Seems like a pretty chill dude. Plus he has lots of adorable pets. But, HE IS ALSO ON MY LIST OF PEOPLE TO GET OUT! He seems pretty savy, so might not be the worst move near the end of the pre-merge. 11. Steven – Not much to say – haven’t talked to him very much in individual chat. Seems nice enough. I need to get to know him better, but HE IS ALSO ON MY LIST. So, whatevs. (In all seriousness though, I’m sure he is lovely and I would love to get to know him!!!!) 12. Rizo – My brother from another mother! Puns puns puns across the board! Dad jokes FTW. Need I say more? I need to make this gentleman my ride or die. And then slay him in the finals. Then be BFFs after. In the unofficial majority alliance. 13. Tim – He was another one that I think I was wrong about. I make one incorrect Harry Potter reference, trying to be all smart…BUT I think we bonded over the challenge. In the audio/video chat, we nerded out over our Survivor fandom and strategy for the challenge. So I may have been wrong about him. 14. Okay, this is long. Is that normal? I have no idea. I’m new to this. I am SO THANKFUL to now be a part of this community. I cannot tell you how refreshing it is to be able to make a reference to a past season and have other people actually know what I am talking about. That’s all for now!

Coming into this game I honestly expected to know a few people..or have at least seen them around but I didn't (with the exception of Tawni but I don't know her well). I love that. When you start fresh, nobody can judge you based off previous experience. Observing and picking up things about strangers is literally one of the most fun aspects of games to me. I got the best vibes at the very beginning from Rizo/Gwen/Liam and also Tim...but could tell right from the get go that Gwen is a THREAT! Women's intuition. The comp just confirmed it further. I pray to the Survivor gods that others aren't blinded and realize this! I could tell before any alliance was even made that she was close with Chris too and probably closer with Rizo then I am. Being in 3 different alliances with her is inch resting. She's playing hard and to win! But anywayyyyys..had we lost, I figured Steven might be an easy first boot because he was just rather quiet and kept to himself...but then he SHOWED UP at the end of that comp and finally started initiating Convo with me and not the other way around. So when we lose..whos an easy vote? Idk. Pretty sure the answer is nobody! And then there's Kyle.... I didn't really give him a second thought until we went on group call and then played in the comp. He's just so chill and laid back and those are the people I like working with. I don't like pushy players and I don't like sheep and he's neither of those so I'm hoping that we can stick together for a long while. He's also fun to hassle so. Yeah um...this confessional is getting really long so I'll stop ranting for a while...though I have plenty to say. *Giggle*

We are about to head in to tribal and honestly, there hasn't been much gameplay going on. I am voting for Cheatham because he is one of my three targets, and he hasn't spoken a single word to me about working with me. Of course there is a chance that I am just oblivious to everyone else and that I am going home, but I really hope that's not the case.

May a college expel a student for ‘unprofessional speech’ in Facebook posts?

Say a student is in a professional education program at a college — law school, medical school, nursing school, business school, school of education or the like. May the college expel him from the program, on the grounds that certain speech of his is “unprofessional” and therefore casts doubt on his professional temperament and likely future behavior?

We’re not talking here about speech within a curricular assignment — a thesis, a term paper, a practicum client counseling session or even a seminar discussion in which participation is graded. Colleges have to evaluate the content of such curricular speech, though even there they may be constrained. (If I grade class participation at UCLA, for instance, I can only count it as part of the final grade, and I’m supposed to grade it in a way that’s as ideologically neutral as possible.) Rather, we’re talking about speech outside such graded discussions, often outside class and sometimes even outside school.

In Keefe v. Adams, a split 2-1 8th Circuit panel upheld such an expulsion; the Supreme Court will on Friday consider the petition for certiorari, filed by Robert Corn-Revere, Ronald London and Lisa Zycherman of Davis Wright Tremaine. And just today, I filed an amicus brief (written by my students Jenna Mersereau, Jennifer Milazzo and Joshua Ostrer, and me) supporting the petition, on behalf of the Cato Institute, the Electronic Frontier Foundation, the National Coalition Against Censorship and the Student Press Law Center. We’re hoping that the court will call for a response from the state defendants (the next step in the process, if the court is to grant review), and then ultimately agree to hear the case.

Summary of Argument

The opinion below authorizes college administrators to expel students for their speech, whenever that speech — including speech entirely outside any curricular project — supposedly fails to comply with professional norms.

This principle could easily apply to, for instance, speech about educational policies, proper rules governing sexual relationships, and “social justice.” Indeed, it has already been applied to such speech in a precedent on which the opinion below relied.

And this principle could easily apply to law schools, business schools, medical schools, and other programs. Armed with this opinion and other circuit court opinions that it endorses, colleges can revive and broaden campus speech codes under the pretext of applying professional standards.

The opinion below is inconsistent with past circuit and district court cases that have uniformly struck down such speech codes. (The petition helpfully canvasses the split between this case and other circuit precedents.) It is also inconsistent with this Court’s precedents. See Papish v. Bd. of Curators of Univ. of Missouri, 410 U.S. 667, 671 (1973) (per curiam); Healy v. James, 408 U.S. 169, 180 (1972). And it is profoundly damaging to free speech at colleges and universities, on which free speech throughout American society depends.

Argument

First Amendment protection is critical at universities, “one of the vital centers for the Nation’s intellectual life.” Rosenberger v. Rector & Visitors of Univ. of Va., 515 U.S. 819, 835-36 (1995). If uncorrected, the opinion below, and other recent circuit decisions like it, will set a dangerous precedent: Colleges will be able to punish students for expressing their views, based simply on administrators’ judgments that certain speech is inconsistent with their subjective understanding of professionalism.

I. The Logic of the Decision Below Would Let Colleges Punish Views That Administrators See as Contrary to Professional Norms

A. The Code of Ethics for Nurses Embodies Ideological Commitments

Central Lakes College expelled Craig Keefe from its nursing program under the program’s student code of conduct, which permits such expulsion for “behavior unbecoming of the Nursing Profession” or a “transgression of professional boundaries.” The court below upheld that decision, on the theory that the First Amendment does not protect “unprofessional speech” such as speech that violates the Nursing Code of Ethics.

But this rationale would cover a vast range of speech. The same “professionalism” policy in the Nursing Program handbook also says, for example, “Integral to the profession of nursing is a concern … for social justice” — right before stating that “students who fail to meet the moral, ethical, or professional behavioral standards of the nursing program are not eligible to progress in the nursing program.” If a student can be expelled for speech “unbecoming of the Nursing Profession,” he can thus be expelled for lack of “concern … for social justice” as well.

Indeed, the Code of Ethics for Nurses expressly endorses many controversial ideological positions. It takes the view that “health is a universal human right.” It states, “Nurses must address … social determinants of health such as poverty, … human rights violations, education, … and healthcare disparities.”

It states, “All nurses … must firmly anchor in nursing’s professional responsibility to address unjust systems and structures.” It states, “Nurses collaborate with others to change unjust structures and processes,” and “should collaborate to create a moral milieu that is sensitive to diverse cultural values and practices” ([section] titled “Obligation to Advance Health and Human Rights and Reduce Disparities”). Likewise, it states, “Nursing must … advocate for policies, programs, and practices within the healthcare environment that maintain, sustain, and repair the natural world” ([section] titled “Social Justice in Nursing and Health Policy”).

Presumably students whose political views are inconsistent with these beliefs would be subject to expulsion for “fail[ing] to meet the moral, ethical, or professional behavioral standards of the nursing program.” After all, administrators can equally say in such cases that they are merely treating “a graduate student’s unprofessional speech” as “lead[ing] to academic disadvantage,” because the speech constitutes “non-compliance” with “professional ethical standards.”

B. The Opinion Below Cannot Be Defended as Authorizing Only Viewpoint-Neutral Restrictions

The opinion below defends its reasoning by saying that “teaching and enforcing viewpoint-neutral professional codes of ethics are a legitimate part of a professional school’s curriculum that do not, at least on their face, run afoul of the First Amendment.” (emphasis added). But one of the main precedents that the opinion heavily relied on — and cited seven times — involved expulsion precisely for the expression of certain views.

In that case, Oyama v. University of Hawaii, 813 F.3d 850 (9th Cir. 2015), a student training to be a teacher was expelled for expressing his ideological views regarding the age of consent and education of students with disabilities. Though Oyama itself was explicitly restricted to speech inside a classroom, the opinion below expands Oyama’s reach to any student speech, not just curricular speech.

The opinion below also heavily relies on Keeton v. Anderson-Wiley, 664 F.3d 865 (11th Cir. 2011), which it cites six times. Keeton likewise involved a student being disciplined for ideological speech — statements disapproving of homosexuality.

Keeton, if it is sound, must be limited to speech that expresses an intent to violate specific rules of conduct within a college-operated practicum: The Eleventh Circuit held in Keeton that a university could discipline a counseling student because “she expressed an intent to impose her personal religious views on her clients” in her upcoming practicum. But the opinion below in this case relies on Keeton far outside any such expressions of intent. And the opinion’s reliance on Keeton shows that the logic of the opinion extends to ideological positions (as in Keeton) and not just to personal gripes.

The speech restriction in this case also cannot be justified as merely embodying a private professional organization’s code of conduct. A private association can adopt whatever views of professionalism it chooses; but the First Amendment prevents a public university from embodying such private associations’ views into officially enforced speech restrictions.

Nor can the speech restriction upheld by the opinion below be justified on the theory that licensing boards could later reject the student for the views he expressed: Licensing boards cannot exclude applicants based on the applicants’ views, either. “The First Amendment’s protection of association prohibits a State from excluding a person from a profession or punishing him solely … because he holds certain beliefs.” Baird v. State Bar of Ariz., 401 U.S. 1, 4-6, 8 (1971) (plurality opinion); see also id. at 10 (Stewart, J., concurring in the judgment) (likewise concluding that a licensing body may not “recommend denial of admission solely because of an applicant’s beliefs that [it] found objectionable”).

C. The Opinion Below Cannot Be Defended as Simply Restricting Speech “at the Wrong Place and Time”

The decision below authorizes colleges to regulate their students’ speech any time, any place, and on any subject, so long as the college can later justify that regulation by referring to a vague professional conduct code. Keefe’s expulsion was not simply an “adverse consequence on the student for exercising his right to speak at the wrong place and time, like the student who receives a failing grade for submitting a paper on the wrong subject.” Keefe posted his Facebook comments at home, on his own time, and not as part of any school assignment. If he was speaking at the wrong place and time when he was at home after school, there will never be a proper place and time for him to speak.

Indeed, the opinion below in this respect directly conflicts with this Court’s opinion in Papish v. Board of Curators of University of Missouri, 410 U.S. 667 (1973) (per curiam), which rejected the notion that such content-based discipline could be justified as mere “time, place, or manner” restrictions. The graduate student in Papish distributed a newspaper containing a political cartoon of policemen raping the Statue of Liberty and the Goddess of Justice, with the caption “With Liberty and Justice for All.” The school attempted to expel the student for violating a student conduct code bylaw which prohibited “indecent conduct or speech.” and the lower courts agreed.

Yet this Court expressly disapproved of the “language in the opinions below which suggests that the University’s action … could be viewed as … enforc[ing] reasonable regulations as to the time, place, and manner of speech.” Instead, this Court held, punishing a student because of “the disapproved content” of his speech — there, allegedly indecent content — could not be justified as a restriction on the mere “time, place, or manner of [the] distribution” of speech. The same is true in this case: The language in the opinion below which suggests that the University’s action could be viewed as enforcing reasonable regulations as to the time and place of speech is inconsistent with Papish.

D. University Student Speech Is Protected Against Content-Based Restrictions Even If They Are Viewpoint-Neutral

Papish also makes clear that college student speech is protected even against viewpoint-neutral but content-based speech restrictions, and not just against viewpoint-based ones.

In Papish, university officials claimed that the student’s speech was punishable because of its lack of “decency,” not because it expressed an anti-police viewpoint. Nonetheless, this Court made clear that even restrictions on vulgar and crude expression are unconstitutional. “[T]he mere dissemination of ideas — no matter how offensive to good taste — on a state university campus may not be shut off in the name alone of ‘conventions of decency.’” The assertion in the opinion below that student speech restrictions are permissible so long as they are viewpoint-neutral cannot be reconciled with Papish. And the holding of Papish must equally apply when speech is being shut off in the name of professionalism rather than of decency.

Letting colleges expel students for their speech based on administrators’ subjective interpretation of “professionalism” is especially inappropriate because standards of “professionalism” are often so subjective. This Court has recognized that matters of “taste and style” are not for the government to determine. Cohen v. California, 403 U.S. 15, 25 (1971). The same is true of distasteful speech such as Keefe’s.

If administrators can show that a student’s speech fits within a narrow exception to First Amendment protection, such as for “true threats,” they can indeed punish the students on those grounds. But they should not be free to create a new exception for “unprofessional speech” (at least when the speech is outside the curriculum and outside any interactions with specific patients).

II. The Decision Below Jeopardizes Speech in Law Schools, Business Schools, and Many Other University Programs

What the College’s nursing program is doing, other colleges can do as well. That is clear for other nursing schools, which similarly rely on the Code of Ethics for Nurses to forbid “[b]ehaviors unbecoming of the Nursing Profession,” “[i]nappropriate” or “[u]nprofessional behaviors,” or behaviors that show “lack of professional compatibility.”

But the decision below will also authorize punishing speech in law schools, business schools, and other schools that recognize similarly vague national standards of professional conduct. A medical school administrator might conclude that a student who supports mercy killing (indeed, considers it a moral imperative) is violating professional norms. See, e.g., Hippocratic Oath, Yale Book of Quotations 360 (Fred R. Shapiro ed. 2006) (“Neither will I administer a poison to anybody when asked to do so, nor will I suggest such a course.”). Or a business school administrator might conclude that a student who condemns the free-market system is likely to betray the interests of stockholders, or to misunderstand economics.

A law school administrator might conclude that a student who argues that the attorney-client privilege is immoral might violate professional norms. After all, the administrator might argue, “The First Amendment did not bar [me] from making the determination” — based on the student’s speech — “that [the student] was unable to meet the professional demands of being a [lawyer].”

An education school administrator might worry that a student who makes a policy argument against age-of-consent laws might in the future molest students. Indeed, that is precisely the reasoning that the Ninth Circuit approved in Oyama. All such student speech could thus lead to discipline and even expulsion. Yet public colleges should not be freed to silence the expression of dissenting views, regardless of what various organizations’ standards advocate.

Many courts have struck down campus speech codes in recent decades. In Dambrot v. Central Michigan University, for instance, the Sixth Circuit held that a speech code restricting written literature or slogans that “infer[red] negative connotations about … individual[s’] racial or ethnic affiliation” was unconstitutional. 55 F.3d 1177, 1184-85 (6th Cir. 1995). In DeJohn v. Temple University, the Third Circuit struck down as unconstitutional a ban on “gender-motivated” speech that was likely to cause disruption. 537 F.3d 301, 316-17, 320 (3d Cir. 2008).

Likewise, in McCauley v. University of the Virgin Islands, the Third Circuit held that a student code of conduct prohibiting speech that “tends to injure or actually injures, frightens, demeans, degrades or disgraces any person” was unconstitutionally overbroad. 618 F.3d 232, 237-38, 250 (3d Cir. 2010). For more decisions striking down campus speech restrictions, see Iota Xi Chapter of Sigma Chi Fraternity v. George Mason Univ., 993 F.3d 386, 388-89, 391, 393 (4th Cir. 1993); College Republicans v. Reed, 523 F. Supp. 2d 1005, 1010-11, 1021 (N.D. Cal. 2007); Roberts v. Haragan, 346 F. Supp. 2d 853, 870-72 (N.D. Tex. 2004); Bair v. Shippensburg Univ., 280 F. Supp. 2d 357, 373 (M.D. Pa. 2003); Booher v. Bd. of Regents of N. Ky. Univ., 1998 U.S. Dist. LEXIS 11404, *28-*31 (E.D. Ky. 1998); UWM Post, Inc. v. Regents, 774 F. Supp. 1163, 1165-66, 1173, 1177 (E.D. Wis. 1991); Doe v. Univ. of Mich., 721 F. Supp. 852, 856, 864-66 (E.D. Mich. 1989). Yet the opinion below gives administrators a roadmap for speech codes that are even vaguer and broader than the ones struck down in these decisions.

There is ample appetite for such restrictions, as recent events have shown. University administrators often feel pressure from activists, legislators, faculty, or students to impose speech codes; and of course they may support such codes themselves. Thus, to give just a few examples:

A University of Idaho student was charged under a university speech code with “discrimination” and “harassment” for (a) saying “illegal immigration destroyed my home state of California” in between songs at a musical concert on Cesar Chavez Day, and (b) shouting “liberalism is destroying America” at a “Take Back the Night” march.

A University of Wisconsin-La Crosse student newspaper published a satirical article titled “Cheney Kills Five Crips in Inner-City Hunting Accident.” As a result, the newspaper was charged with “racist, sexist, homophobic, ablest [sic], anti-Semitists [sic] speech” that would “threaten the recruitment and retention of students from underrepresented groups,” and was ordered to cut its distribution by 97%.

A Muslim student at William Paterson University received an unsolicited email from a professor discussing a film described as “a lesbian relationship story.” He replied with an email asking that he not be sent “any mail about ‘Connie and Sally’ and ‘Adam and Steve.’ These are perversions. The absence of God in higher education brings on confusion.” The student was charged with sexual harassment for his use of the word “perversion” to refer to homosexuality.

The speakers in these cases were eventually absolved because of First Amendment concerns. But the decision below, and the Ninth Circuit Oyama decision on which the decision below relies, takes the view that such constitutional concerns are misplaced — so long as the speech can be labeled “unprofessional speech,” it can be punished. Under the reasoning of these decisions (and especially the decision below to extend Oyama even outside the classroom), all such speech would be subject to suppression.

Indeed, the rationale of the court below could easily apply not just to satire or slogans, but to normal, reasoned, and substantive discussion of contested policy issues, as was the case in Oyama. Faced with this danger, even careful and thoughtful students will tend not to express themselves on certain topics, for fear that they will be expelled from their academic programs.

The way “to avoid these ends” is “by avoiding these beginnings.” West Va. Bd. of Ed. v. Barnette, 319 U.S. 624, 641 (1943). This Court should step in and make clear, to the Eighth Circuit, the Ninth Circuit, and other courts — as well as to college administrators — that college students cannot be expelled simply because an administrator concludes that they engaged in “unprofessional speech.”

Conclusion

The logic of the decision below would let colleges punish a vast range of student views that administrators view as “unprofessional speech.” It would apply not just to nursing students, but to students at law schools, business schools, and other academic institutions.

The decision cannot be defended on the grounds that such restrictions are “viewpoint-neutral,” or cover only speech “at the wrong place and time.” Indeed, it relies on and endorses cases that have upheld viewpoint-based restrictions — and, in any event, even viewpoint-neutral but content-based restrictions on university speech are unconstitutional.

The decision is thus inconsistent with the decisions of this Court, and the decisions of other federal courts. This Court should therefore grant certiorari, and reverse the judgment of the Court of Appeals.
