The Defense won this case against Ms. Chastity Jones by arguing, “CMS’s race–neutral grooming policy was not discriminatory as hairstyles, while culturally associated with race, are not “immutable physical characteristics.” “In essence, traits in a person’s appearance that are tied to their culture but are otherwise changeable are not protected and can be used to deny job offers.” To translate further, the Defense claimed they could uphold their racist ass grooming policy because ‘hairstyles are easily changeable’ so it shouldn’t be a big deal to anyone, nor is it racist to force an employee to make this change. You know they don't believe that shit for a split second and that it's just a goddamn excuse. What I would give to have been the one in the room making the counter-argument against that bullshit claim. "Okay, Your Honor, if the Defense honestly and sincerely believes that all hairstyles are easily changeable, why not go the opposite route and instead make a rule that only curly hair-based hair styles are acceptable in the work place? Why not in stead force straight-haired applicants to perm their hair and use cornrows, twists, or dreads? All hairstyles are easily changeable, right?" I'd love to fucking watch them flounder as they shout out "WE CAN'T DO THAT!" and struggle to not sound as racist as they are when they try hard not to say exactly "THAT'S TOO HARD AND REQUIRES TOO MUCH CHANGE OF A PERSON’S NATURAL HAIR!" because that is exactly what the fucking plaintiff was fucking saying. And it’s not as if they can argue “MORE PEOPLE HAVE STRAIGHT HAIR, SO THE MINORITY SHOULD ACQUIESCE-” I’m pretty sure more people have naturally curly hair, which makes your argument null, void, and frankly racist and racist-apologist in nature.
