Colin Kaepernick’s collusion lawsuit against the NFL can continue after overcoming a significant obstacle Thursday.
The arbitrator hearing Colin Kaepernick’s collusion case against the NFL ruled against the league today after the NFL requested dismissal of the case on the grounds that Kaepernick and his legal team had not presented sufficient evidence to proceed.

Under Article 17, Section 7 of the current collective bargaining agreement, the appointed arbitrator in an anti-collusion matter may “determine whether or not the complainant’s evidence is sufficient to raise a genuine issue of material fact” and dismiss the case if the evidence is insufficient.
This is what’s known as a motion for summary judgment, a common legal tactic used by attorneys to prevent cases from proceeding further into discovery (where potentially damaging documents or depositions could hurt you) or into trial (where you might lose). In essence, moving for summary judgment means asking a judge or arbitrator to look at the facts as they exist at that time and determine that, even if those facts are interpreted in the other party’s favor, there is no legal issue and therefore nothing to determine at trial.
What does this mean for Kaepernick?
For starters, it means he and his team get to keep pursuing the collusion grievance. That’s obviously bad for the NFL, which would like this dispute to go away without owners, general managers, coaches, or Roger Goodell’s wife having to testify in an arbitration hearing. Section 7 states that summary judgment is determined, “at any time following the conclusion of the permitted discovery.” This suggests Kaepernick’s case is likely to proceed to a hearing with the arbitrator, though the CBA doesn’t explicitly preclude multiple motions for summary judgment.
Does it mean Kaeprnick’s more likely to win?
Not necessarily. Remember, the arbitrator’s sole job on this motion is to determine whether there are any material questions of fact. At the hearing, Kaepernick, as the complaining party, has the burden of proving by “a clear preponderance of the evidence” two things: 1) that the league or its franchises engaged in collusive behavior, and 2) that in doing so Kaepernick suffered economic damage. (Preponderance of the evidence is often thought of as having more than 50% of the total evidence favoring your case, and it’s a much lower standard than “beyond a reasonable doubt,” the burden of proof the prosecution has in a criminal case.)
At the federal trial level, a 2007 study by the Federal Judicial Center found that about 17 percent of the civil cases they examined had at least one summary judgment motion filed, and only 5 percent of those resulted in the case being terminated entirely. So while this ruling wasn’t good for the NFL, it also shouldn’t have been especially surprising.
Summary judgment exists to prevent the unnecessary time and expense of taking cases that have no merit to the finish line. Today’s ruling doesn’t mean that Colin Kaepernick’s going to win his case — but it means he’s going to have a viable shot.
That or the NFL just decides to settle and pay Kaepernick some sum of money to avoid any potential embarrassment.

Stunner on a Friday afternoon!
Colin Kaepernick and Eric Reid, who had filed a collusion lawsuit against the NFL, reached a settlement out of court.

That’s from Kaepernick’s lawyer. The NFL shared the same statement on the official league website.
Couple of things to consider here:
settling makes Eric Reid look like a hypocrite, considering that he called Malcolm Jenkins a “sellout” for accepting league money a while back, causing a divide in the Players Coalition
Kaepernick also looks like a sellout for not riding this thing out to the end (assuming he just took a huge amount of hush money here).
Reid just signed a 22 million dollar deal with the Panthers, so his case is weakened.
If the NFL was willing to settle out of court, then there was probably enough evidence to hurt their chances in court
Kaepernick said repeatedly that his protest wasn’t an affront to the military or United States veterans. He began taking a knee SPECIFICALLY out of respect to veterans. He was originally sitting on the bench during the anthem.

I’m sure the settlement terms will be leaked at some point. I also think many social justice folks and Kap supporters will be disappointed with how this thing ended.

According to USAToday, the ousted NFL quarterback and the religiously “randomly” drug tested strong safety have reached a settlement in their joint collusion lawsuit against the NFL. The details of the settlement were kept confidential, but you can only imagine the number that the league had to come up with to satisfy both men. They know good-and-damn-well that team owners were almost assuredly banding together to keep Kaep from getting a job.
Attorney Mark Geragos broke the news on Twitter this afternoon.
“For the past several months, counsel for Mr. Kaepernick and Mr. Reid have engaged in an ongoing dialogue with representatives of the NFL,” Geragos and the NFL said in the statement. “As a result of those discussions, the parties have decided to resolve the pending grievances. The resolution of this matter is subject to a confidentiality agreement so there will be no further comment by any party.”

The NFL Players Association has long been in support of Kaep and Reid but were not made aware of the details in the settlement either.
“We continuously supported Colin and Eric from the start of their protests, participated with their lawyers throughout their legal proceedings and were prepared to participate in the upcoming trial in pursuit of both truth and justice for what believe the NFL and its clubs did to them,” the union said in the statement. “We are glad that Eric has earned a job and a new contract and we continue to hope that Colin gets his opportunity as well.”

Colin Kaepernick has settled his collusion case with the NFL.
Kaepernick’s attorney Mark Geragos announced on Friday in a statement that the two sides resolved the matter.

The league issued a similar statement.
“For the past several months, counsel for Mr. Kaepernick and Mr. Reid have engaged in an ongoing dialogue with representatives of the NFL. As a result of those discussions, the parties have decided to resolve the pending grievances. The resolution of this matter is subject to a confidentiality agreement so there will be no further comment by any party.”
Mr. Reid is a reference to Eric Reid, the safety for the Carolina Panthers who also joined the collusion suit against the league.
Yahoo’s Charles Robinson notes that there was talk from a source previously that Kaepernick would only withdraw his suit if there was a lucrative settlement.

It’s hard to view this as anything other than disappointing from Kaepernick’s party. His whole stance of standing up for social injustice and racial inequality seemed to be at the cost of his earnings. Why would he agree to a confidential settlement now rather than let the truth come out? It seems that would better serve society, and now those who wanted to know the truth won’t get those answers.

Colin Kaepernick has a new deal with Nike, even without having a job in the NFL.
Kaepernick’s attorney, Mark Geragos, made the announcement on Twitter, calling the former San Francisco 49ers quarterback an “All American Icon” and crediting attorney Ben Meiselas for getting the deal done.

Kaepernick already had a deal with Nike that was set to expire, but it was renegotiated into a multi-year deal to make him one of the faces of Nike’s 30th anniversary “Just Do It” campaign, according to a person familiar with the contract. The person spoke to The Associated Press on condition of anonymity because Nike hasn’t officially announced the contract.
The source says Nike will feature Kaepernick on several platforms, including billboards, television commercials and online ads. Nike also will create an apparel line for Kaepernick and contribute to his Know Your Rights charity. The deal puts Kaepernick in the top bracket of NFL players with Nike.
The NFL and Nike extended their partnership in March to run through 2028. Nike provides all NFL teams with game-day uniforms and sideline apparel that bears the swoosh logo.
Last week, Kaepernick scored a legal victory in his grievance against the NFL and its 32 teams when an arbitrator denied the league’s request to throw out the quarterback’s claims that owners conspired to keep him out of the league because of his protests of social injustice.
Kaepernick contends the owners violated their collective bargaining agreement with players by conspiring to keep him off teams. His case hinges on whether owners worked together rather than decided individually to not sign Kaepernick.
A similar grievance is still pending by former 49ers teammate Eric Reid, a Pro Bowl safety who joined in the protests.
On Friday night, Kaepernick and Reid, also now out of the league, were each given huge ovations when they were introduced and shown on the big screen during a match between Serena and Venus Williams at the U.S. Open.
Kaepernick began a wave of protests by NFL players two seasons ago, kneeling during the national anthem to protest police brutality and racial inequality. The protests have grown into one of the most polarizing issues in sports, with President Donald Trump loudly urging the league to suspend or fire players who demonstrate during the anthem.

Meanwhile, the league and players union still haven’t resolved whether players will be punished this season if they choose to kneel or demonstrate during the national anthem. Owners approved a policy requiring players to stand if they are on the sideline during The Star-Spangled Banner, allowing them to stay off the field if they wish.
But the league and union put that on hold after the Miami Dolphins faced backlash for classifying the protests as conduct potentially detrimental to the team — putting players at risk of fines or suspensions.
