EB-5 Remains the Fastest Path to US Permanent Residency for Chinese and Indian Nationals Following the October 2024 Visa Bulletin
The release of the October Visa Bulletin marks the beginning of the government’s fiscal year. Immigration practitioners anxiously await its publication as it sets the stage for the new year and what may be expected. The October 2024 Visa Bulletin was just recently released and has reaffirmed that the EB-5 Immigrant Investor Program remains the fastest route to U.S. permanent residency for investors born in countries with significant visa backlogs, such as China and India.  
Visa Backlogs for China and India: A Continuing Challenge
For years, Chinese and Indian nationals have faced long wait times to obtain U.S. green cards due to high demand and the per-country visa caps. The employment-based visa categories, particularly the EB-2 and EB-3 categories, have been significantly backlogged for these countries.
The October 2024 Visa Bulletin continues to reflect these severe backlogs:
The final action cutoff date for EB-1 China will advance by one week, to November 8, 2022, and India will remain at February 1, 2022.
The final action cutoff date for EB-2 China will advance by three weeks, to March 22, 2020, and India will remain at July 15, 2012.
The final action cutoff date for EB-3 China will retrogress by five months, to April 1, 2020, and India will advance by one week, to November 1, 2012.  
The retrogression for China in the EB-3 category is quite unexpected as the new fiscal year is just beginning.  This signals a very challenging year ahead and individuals impacted by the retrogression may want to consider alternative, faster green card options, such as the EB-5 program.
The Strategic Advantages of EB-5 Regional Center Program
When Congress reauthorized the EB-5 Regional Center Program in March 2022, a portion of EB-5 visas was set aside specifically for investments in Targeted Employment Areas (TEAs), which include rural areas, high-unemployment areas, and infrastructure projects. Despite increasing demand, these set-aside categories will remain current under October 2024 Visa Bulletin.
For Chinese and Indian nationals, the EB-5 Regional Center Program presents clear strategic advantages:
No Employer Sponsorship Required: For individuals without a job offer or those waiting for their employer-sponsored EB-2 or EB-3 priority date to become current, the EB-5 program offers an independent pathway to a green card.
Fast Processing Times and No Backlogs: Even compared to other self-sponsored options, such as EB-1A or EB-2 NIW, the EB-5 program stands out as the fastest and most straightforward choice for Chinese and Indian nationals without backlog delays.
Concurrent Filing Option: Chinese and Indian nationals in the U.S. on a valid non-immigrant visa, such as F-1, H-1B, or L-1, can simultaneously file their EB-5 and adjustment of status applications. Currently, the EB-5 regional center program in the set-aside categories is the only employment-based visa category that allows concurrent filing for Chinese and Indian nationals. This allows investors to obtain a five-year work authorization card (EAD) and international travel permit (Advance Parole) while their green card application is pending. This option is particularly beneficial for foreign students, enabling them to bypass the H-1B lottery for work authorization. It also provides added security for individuals on employer-sponsored visas, such as H-1B or L-1, by ensuring continued work authorization, which adds considerable peace-of-mind in the event of job loss or to simplify changing employer.

Global AI Talent Wars: How Immigration Policies Tip the Scales
The competitiveness of America’s tech sector depends on the technical skills of its workers. American companies rely largely on overseas STEM talent to fill essential roles in increasingly competitive and strategic fields like AI. Pathways to legal immigration and work status have provided the boost American businesses need to maintain an innovative edge and an answer for talented foreign nationals who want to build their careers and lives here.
The war for skilled AI talent will only get hotter. While the U.S. still holds its title as the top country for global AI talent, China is quickly catching up. Today, an outsized proportion of AI experts and top researchers come from China, many of whom opt to work domestically. According to a recent report from the think tank MarcoPolo, China produced nearly half (47% ) of the world’s top AI researchers in 2022, 28% of whom remain in China – a striking increase from 2019 when just 19% of the world’s top AI researchers came from China and only 11% worked there. The same trend can be seen with AI talent from other countries; by 2022, one-fifth of Indian AI researchers chose to work in their home country.
Foreigners still find America very attractive for studying AI and working in the field, but that appeal is beginning to wane. Even though 77% of non-American AI talent remained in America after receiving a PhD in the U.S. in 2022 (down from 86% just two years earlier), restrictive immigration policies, tech layoffs, and growing opportunities in other Western countries mean staying in the U.S. is getting harder and less appealing.
Last month’s landmark Supreme Court decision to overturn Chevron v. NRDC clouds the picture even more. The ruling will have an outsized impact on immigration cases for many years, complicating the legal landscape and creating processing delays and backlogs.
With global competition for AI talent heating up, what will it take to keep the American AI sector competitive in the long run, and what are the most viable pathways for highly skilled foreign workers and companies looking for the best AI talent?
U.S. Immigration Policy in Flux Puts Business and Lives in Flux
At first blush, the Biden Administration’s October 2023 Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence showed promise in helping immigrants and visa holders with AI backgrounds. The order recognizes the importance of foreign talent for American AI businesses and instructs the Department of State, the Department of Homeland Security, and the U.S. Citizenship and Immigration Service (USCIS) to streamline the visa process for noncitizens to study, conduct research, and work on AI initiatives. It also calls for clarified and modernized pathways for noncitizen AI experts for O-1A temporary work visas and EB-1 green cards for individuals who possess extraordinary ability in their field, for EB-2 national interest waiver green cards, and for foreign-born founders of AI startups using the International Entrepreneur Rule.
Unfortunately, few of these changes have been implemented, and in March 2024, the government increased fees and changed the rules to curb abuse in the H-1B visa lottery program, which grants 65,000 visas annually, plus an additional 20,000 for individuals with master’s degrees or higher from U.S. universities. This move has made it more difficult and expensive for employers to hire talented noncitizen AI experts who want to work in the U.S. Because of the number of applicants from India and China, these changes have a more significant impact on applicants from those countries – where an increasing number of AI experts are trained.
Further, the Supreme Court’s overturning Chevron vs. NRDC will have a major impact on immigration cases. The ruling states that courts are no longer required to defer to Federal agencies like the Department of Homeland Security (DHS) or the Board of Immigration Appeals (BIA) for interpretations of ambiguous regulations, a shift that will lead to more inconsistent interpretations and enforcement of immigration laws across jurisdictions, added complexity, and a growing backlog of cases. This uncertainty is, of course, exacerbated by the political atmosphere during this year’s contentious election.
Tech Layoffs Pose Risks to AI Companies and Put Noncitizen AI Workers in Peril
Corporate downsizing also has a direct, personal impact on foreign-born AI workers – and direct implications for AI businesses’ ability to recruit and retain AI experts in the future. Layoffs in the technology sector have been in the headlines for 18 months. According to Crunchbase, more than 190,000 workers in U.S.-based tech companies lost their jobs in 2023, and 56,600 have been laid off in the first six months of 2024. Big Tech AI innovators have not been immune; Meta reduced its headcount by over 20%, and Microsoft, Amazon, and Google have all cut staff.
Many tech companies have stopped or dramatically curtailed their permanent labor certification program (PERM) applications. PERM certifications are issued by the U.S. Department of Labor (DOL) and allow employers to hire foreign workers to work permanently in the U.S. The goal is to assess whether there are not enough qualified, able, and willing U.S. workers to accept the role and whether employing foreign workers will adversely affect the wages and conditions of equally capable American workers. In most cases, a U.S. employer must obtain the PERM certification before submitting an immigration petition to USCIS.
For companies, the PERM process is an expensive undertaking. Costs can be as high as $15k – $20k per case, which adds up quickly for companies hiring thousands of employees. When Google laid off 12,000 in January 2023, it stopped PERM applications that same month, and early this year, the company notified employees that it wouldn’t restart the PERM process until at least the first quarter of 2025. Similarly, Amazon recently informed employees that it was pausing new PERM filings through the end of the year after having suspended them in 2023.
The implications of tech layoffs and the slowdown in PERM applications are far-reaching. Employers that have laid off over 100 employees must suspend their PERM green card process for six months. These businesses are then subject to the labor market test if they rehire for the same role, which means prioritizing American candidates in a tight labor market. Employers must advertise for a role in six places, and if just one qualified person applies for the position, then the PERM process is over for that role.
Being laid off is difficult for anyone, but for individuals who depend on corporate sponsorship to stay in the U.S., loss of employment can have a dramatic impact on their personal and professional lives. Individuals who have worked and lived in America legally for years suddenly find themselves struggling to secure their future immigration status.  Employees who were in the process of obtaining a visa via corporate sponsorship at the time they were laid off must start the process over — and the clock keeps ticking. They must find corporate sponsorship within two months (60 days) or explore another avenue to secure their immigration status. If they are qualified, they could file for an O-1A non-immigrant visa petition or self-sponsored EB-1A and EB-2 national interest waiver (NIW) immigrant petitions (green card). The bar is very high for EB-1A extraordinary ability and national interest waivers, and the process takes six months and often up to two years.
AI Employment’s Path Forward
Fortunately, the picture is likely not so bleak for highly qualified AI tech talent because the requirements for those roles are so specialized and in high demand.  However, for businesses that need to recruit top foreign-born AI talent, forethought and pre-planning are important before starting the hiring process. This is especially true for smaller businesses on tighter budgets:
Look for technically qualified candidates at universities: If specialized technical expertise rather than years of employment experience will suit the job requirements, universities with graduate programs are a good starting point. Individuals in these programs can grow into the job, and if they fit the EB-1A or EB-2 NIW criteria, they can self-sponsor. If the foreign national is unable to secure the H-1B visa, the O-1A nonimmigrant petition could be a viable alternative.
Know candidates well before hiring: Understand their technical qualifications, expertise, and whether they match the requirements now and in the future. This knowledge will help guarantee that a candidate is the right long-term fit for the role. Plus, seeking highly qualified individuals in a master’s or PhD program where their work is likely published will make the application process easier.
Highly skilled AI experts seeking to work in the United States can pursue several avenues if corporate sponsorship is not valid option:
O-1A temporary work visas: The O-1A visa is granted to highly qualified individuals to work in the U.S. for up to three years, with the potential for extensions. Applicants must demonstrate expertise in their field, which typically means holding an advanced degree (master’s or PhD), time in leadership positions, industry awards, speaking at conferences, and published work in their field. O-1 visas require a sponsor and a rigorous application process.
Self-sponsored EB-1A Extraordinary Ability and EB-2 National Interest Waivers: Candidates for EB-1A or EB-2 NIW petitions, which provide a green card, must document a demonstrated extraordinary ability in their field – typically with national or international acclaim. Advanced degrees, awards, publications, and media coverage are typically required. Successful EB-1A and EB-2 NIW applicants also receive a green card, enabling them to live and work in the U.S. permanently.
Contributions from immigrants to this country have played a central role in the innovation and technical advances that have made American enterprises global leaders in so many different sectors. Moving forward, competition for the top AI talent will be a major factor in determining the winners. Changes in work status policies, a tight labor market, and election year uncertainty make current times challenging for both talented noncitizen AI workers and American businesses – especially smaller ones which often serve as incubators of innovation.  With the right strategies and proper planning, American AI businesses can retain their innovative, creative edge with the best AI talent and expertise.

How to get a green card by investment and make your American dream a reality.
Always wanted to live in the US?
Unfortunately, the country’s Permanent Resident Card, or green card, is notoriously difficult to get.
Unless you have a family member in the US, a job offer or a lucky streak on the diversity visa lottery, you might need to put your American dream aside.
Except if you’re extremely wealthy, that is. The USA is among a handful of countries that still offer ‘golden visas’, or citizenship by investment.
The Immigrant Investor Program, or EB-5 visa, is America’s version of this scheme.
Here’s how it works and who’s eligible.
How do you get a US golden visa?
The EB-5 visa requires a minimum $800,000 (€730,000) investment in an approved commercial enterprise in the US. Additionally, the business must create or preserve at least 10 jobs.
For projects outside of targeted employment areas, the minimum investment rises to $1,050,000 (€960,000).
The investor must plan to be involved in the business as a manager.
If your application is approved after filing evidence of your investment, you can begin applying for a green card.

If successful, you will gain the right to live, work, study or retire in the US. Your dependent family members - spouse and unmarried children under 21 years old - will also be eligible for a conditional green card.
How many golden visas does the US hand out?
The US issues just 10,000 EB-5 visas per year, including those given to family members of investors.
As of last year, when the programme was renewed for another five years, 20 per cent of these visas are set aside for projects in rural locations. These target areas with fewer than 20,000 residents or with high unemployment rates.
Each country is allocated a maximum of 7 per cent of all EB-5 visas each year.
Which nationalities apply for the most US golden visas? The EB-5 visa is by far the most popular with people from China. In 2022, over 6,000 US golden visas were issued to Chinese nationals, with those carried over from the COVID-era partially accounting for the high number.
Due to the popularity of the scheme and the restrictive quota, Chinese investors currently face a decade-long wait for their green cards.
However, the waitlist is far shorter with the new rural scheme because it is considered a new category. This has led to fresh interest in the scheme.
India came next with 1,381 EB-5 visas in 2022, followed by Vietnam (815), South Korea and Brazil (336 each).
Which other countries offer golden visas?
Golden visas are becoming increasingly controversial in Europe. Many countries are eliminating or toughening up their schemes to avoid potential security risks, with Portugal the latest country to pull the plug.
The European Commission has warned that these schemes could be used for money laundering, tax evasion and organised crime.
Nevertheless, Austria, Italy, Greece, Malta, Spain, Switzerland and Turkey still have golden visa schemes in place.
Elsewhere, Singapore, the UAE and various Caribbean islands also offer golden visas. Although Canada does not have a countrywide golden visa scheme, some provinces do offer them.

HAPPY TAMAVERSARY! Smart Anniversary Party Set
It's November 23, so you know what that means...new Anniversary Tamagotchi to celebrate the market release date of the original Tamagotchi 26 years ago! Once again we have a Smart set, though it's a bit more lavish and readily available than last years.
To recap, last year the white Tamagotchi Smart was available via lottery on Bandai's exclusive shopping site Premium Bandai and shipped at the very end of August 2022 (close to 3 months before the general release of the coral pink, mint green, and NiziU versions). It includes the 1997 Friends TamaSma Card that lets you raise 4 classic characters (Mametchi, Kuchipatchi, Nyorotchi, Oyajitchi) in their 1996 monochrome pixel stylings along with playing the good old "Left or Right" game. Come to think of it, I wrote a post about the unboxing!
Anyway, this year's theme is Anniversary Party, plus it's available at general retail so more fans will be able to get their hands on it. Let's see how it looks next to last year's package.

IT'S BIG! The added length and depth comes entirely from the character book added as a bonus. (For those who've never opened a Smart, it's a VERY tight fit in there!)

On one side of the package you've got your special artwork...last year's mimicked the original P1 Japanese packaging, while this year's features a big old party with cake, balloons, plus all the Smart adults and the 10 included on the TamaSma Card, including Ginjirotchi who was picked by fans in a poll a few months back! This year's is much more in line with the modern Tamagotchi branding...I personally remain a fan of the classics.
Time to look inside!

Character Special Book? Check. Anniversary Party TamaSma Card? Check. Smart unit and wristband? Check. Instruction booklet and charging cable? Check and check. (Between my Vital Bracelets and my Smarts I'm swimming in these tiny cables!)
Now let's get a look at the actual unit.

Oh that is SPARKLY! A gorgeous glittery gradient makes up the "faceplate", with the new Tamagotchi logo screened in white on the clear cover. Matched with the purple of the unit it's a true visual treat.

Taking a look at the unit without the wristband, it's an opaque cool purple shell. I'd call it closer to periwinkle than lilac if we're going by Crayola crayon colors. The printed buttons around the Home button aren't a perfect color match, having a bit more red to them. It bothers me a bit but honestly I'm so busy staring at the sparkles I doubt I'll care much once this review is gone.
The wristband itself has a jelly-like opacity to it and feels a little firmer than the standard strap. The clasp is a slightly darker purple that matches the unit's Home button, and features no printing.
As for the Special Character Book...?

It's a bit smaller than the books that have been released so far. I thought it would be similar to the character introduction section of January's "Special Book", but it's actually BETTER!

While the Special Book used the blue-outline "modern" art for classic characters up until the Connection series, this book uses the original artwork from "back in the day". Pixels and personality galore! Plus they have full rosters for Angel, Garden, Ocean, Devil, and Yasashii, which were only covered briefly in the special book.

PLUS it's got character descriptions for EVERYONE, even the funky dudes who were exclusive to Data CardDass cards and random town residents who I'm not sure have ever been featured like this before!
All non-collab (NiziU, Sanrio, Molcar, One Piece, Pixar) SmaCard characters are included up to September's Magical Change as well. (The Anniversary Party characters are introduced pretty early on, plus they were all in past versions anyway.)
The inner covers also feature past series art including the original package, 20th anniversary art, and more!
I wasn't expecting so much love and care to go into a such a small volume, but I've gotten a real sense that whoever is in charge of Tamagotchi cares greatly about the history of the brand. Professor Banzo and Mika-Chu even give a send-off on the back cover, thanking us for 25 years and hoping we'll continue to stick with them going forward.

Overall, a great set sure to please even the most nitpicky of fans. Here's to another 25 years!

Give it to me! Btw, Wakana’s favourite is actually #5. Wakana is a bit surprised and embarrassed that so many fans want her face on a shirt. Right now they are thinking about using one of the designs for the front and one for the back so we have more options. Seems like the front will be a drawing (#1) and the back will be the shark song (#2) [No big fat Wakana face on my t-shirt *forever sad*]. They want Wakana to draw the picture right there in front of us, she is doing a dinosaur (which could possibly become a new character). Wakana will do a proper drawing later, this one turned out a little funky. Now it’s time to decide on a colour. Most people want blue or (mint) green which would be fitting I guess. It’s gonna be mint green (good choice!). Wakana also decides that her dinosaur character will be a velociraptor (Rap-chan) so everyone, please look forward to it ^_^
LOTTERY CORNER: She throws a dice to decide how many people get a present. First she throws a 4 but she feels like that’s not enough. She throws again and gets a 5 so she decides that a total of 9 people will get a present. 5 people will get one of her goods with a signature. 4 people will get a polaroid from today’s event. Unfortunately I didn’t win anything. Used up all my luck with the Keiko hat XD
No new announcements of a release or future event T_T Guess we will have to be patient.

I think when Americans talk about "legal" vs "illegal" immigration, they often don't realize how restrictive the American immigration process is. Just because the US has the highest population of immigrants, people seem to assume that there's an easy process for foreign nationals to move to the US. But that thing that Americans often do, where you just "move abroad" and look for a job and enjoy life as an "expat" — that thing doesn't really work for people wanting to come to the US. The last people who were able to do that came through Ellis Island a century ago.
First of all, when people say "illegal immigration" they're often talking about political asylum. Political asylum is a well-defined legal process. To qualify for asylum you have to prove that you're being persecuted in your home country or prove that you have reason to believe that you WOULD be persecuted upon your return. ASYLUM CAN ONLY BE REQUESTED IN THE USA OR AT A PORT OF ENTRY. There is no visa application process, no paperwork to fill out at your local embassy. Your PHYSICAL PRESENCE in the USA is a LEGAL REQUIREMENT to start the asylum processs.
Political asylum aside, pretty much every other kind of immigrant visa with the goal of permanent resident status (green card) requires you to find a sponsor. That's either a spouse or an immediate relative, or it can even be an employer (this obviously only works for extremely high-skilled jobs). A green card is the ONLY pathway to naturalization (US citizenship).
Visas (student/work/tourist) are always TEMPORARY, heavily regulated, and, by definition, meant for visits and not for immigration.
The so-called Green Card Lottery (DV/diversity visa) technically belongs to process no. 2 and is the ONLY way to immigrate to the US without a sponsor and without eligibility for political asylum. "Diversity" refers to diversity in the immigration process since it favors applicants from countries with low numbers of immigrants to the US in the previous 5 years. Countries with high numbers are excluded. (For the 2022 lottery these are: Bangladesh, Brazil, Canada, China, Colombia, Dominican Republic, El Salvador, Guatemala, Haiti, Honduras, Hong Kong, India, Jamaica, Mexico, Nigeria, Pakistan, Philippines, South Korea, Vietnam, the United Kingdom (except Northern Ireland) and its dependent territories.) The lottery grants 55,000 visas per year. The DV application is free but it requires you to prove that you have an "available means of support." That can be a job (for those already living in the US) or money in a bank account, real estate, etc. These assets have to be "convertible to cash" within one year and should be enough to guarantee that you will not request public assistance/welfare for the next three years. So how much is that exactly? Well, you're expected to support yourself at the level of "125% of the current Poverty Guidelines or above", which is currently defined as an annual income of $21,775. If there's any doubt about your financial independence you can be declared ineligible. So... you see how even this "open to everyone" lottery isn't really open to everyone.
Now I don't expect American citizens to know every detail about American immigration policy but everybody should be aware that all this is in pretty stark contrast (1.) to how it works in the rest of the world, since most other popular immigration countries have one or even multiple pathways to permanent residency (and eventually citizenship) and (2.) to the American image of an open society and the quintessential immigrant country.
TL;DR: despite its popularity, the US is one of the most difficult countries to immigrate to and I wish more Americans knew this.

Must have at least 5 years professional experience after graduation OR 10 years professional experience as an entrepreneur
You must earn a higher salary or profit than the national average for the region you work in.
For example, the EB-2 NIW visa benefits qualified individuals who can contribute to the United States in a wide variety of fields, including science, arts, and entrepreneurship.
To summarize, in addition to obtaining a green card right with DV lottery 2022, a person who meets the above-mentioned conditions in different areas can be entitled to immigration to the USA.
