The Supreme Court declined on Tuesday to revisit the landmark First Amendment decision in New York Times v. Sullivan, rebuffing a request to take another look at decades-old precedent that created a higher bar for public figures to claim libel in civil suits.

The media world has for years relied on the unanimous decision in the 1964 case to fend off costly defamation lawsuits brought by public figures. The ruling established the requirement that public figures show “actual malice” before they can succeed in a libel dispute.

Despite being a mainstay in US media law, the Sullivan decision has increasingly come under fire by conservatives both inside and outside the court, including Justice Clarence Thomas, who said on Tuesday that he still wanted to revisit Sullivan at some point.

“In an appropriate case, however, we should reconsider New York Times and our other decisions displacing state defamation law,” Thomas wrote in a brief concurrence to the court’s decision not to take up the case. He said that the case, Don Blankenship v. NBC Universal, LLC, was a poor vehicle to reconsider Sullivan.

Just a few months ago, the conservative justice attacked the ruling in Sullivan in a fiery dissent in which he called it “flawed.” Thomas issued other public critiques of Sullivan in recent years, including in 2019, when he wrote that the ruling and “the Court’s decisions extending it were policy-driven decisions masquerading as constitutional law.”

The case at hand concerns Don Blankenship, a former coal baron who was convicted of a federal conspiracy offense related to a deadly 2010 explosion at a mine he ran, in what was one of the worst US mine disasters in decades. His sentence of a year in prison was one day less than a felony sentence.

“Blankenship himself admits this was a highly unusual sentence for a misdemeanor offense; he notes that he was the only inmate at his prison who was not serving a sentence for a felony conviction,” according to a lower-court opinion in the case.

During his unsuccessful 2018 US Senate campaign in West Virginia, a number of media organizations erroneously reported that he was a convicted felon, even though his conspiracy offense was classified as a misdemeanor.

Blankenship sued a slew of news outlets for the error, alleging defamation and false light invasion of privacy. Lower courts ruled against him, finding that the outlets did not make the statements with actual malice, the standard required by Sullivan.

Attorneys for Blankenship told the justices in court papers that the “damage was irreparable” since no felon has ever been elected to the Senate, and urged them to overturn the Sullivan decision.

“The actual malice standard poses a clear and present danger to our democracy,” they wrote. “New York Times Co. v. Sullivan and its progeny grant the press a license to publish defamatory falsehoods that misinform voters, manipulate elections, intensify polarization, and incite unrest.”

Attorneys for the media outlets urged the justices not to take up the case, arguing that it’s “as poor a vehicle as one could imagine to consider” questions related to Sullivan’s holding because, they said, the reporting mistakes were honest ones.

“There is good reason why the actual malice standard of New York Times has been embraced for so long and so often,” the media organizations told the justices. “At its essence, the standard protects ‘erroneous statements honestly made.’ While it permits recovery for falsehoods uttered with knowledge of falsity or with reckless disregard for the truth, it provides the ‘breathing space’ required for ‘free debate.’ A free people engaged in self-government deserves no less.”

Just last year the court declined to revisit Sullivan in a case brought by a not-for-profit Christian ministry against the Southern Poverty Law Center.

At the time, Thomas dissented from the court’s refusal to take up the case.

“I would grant certiorari in this case to revisit the ‘actual malice’ standard,” he wrote. “This case is one of many showing how New York Times and its progeny have allowed media organizations and interest groups ‘to cast false aspersions on public figures with near impunity.’”

In 2021, conservative Justice Neil Gorsuch also questioned the decision in Sullivan, writing in a dissent when the court decided not to take up a defamation case that the 1964 ruling should be revisited in part because it “has come to leave far more people without redress than anyone could have predicted.”

College of Idaho: 2022-23 NAIA Men's Basketball Champions

KANSAS CITY, Mo. – It took 27 years and a thrilling final 20 minutes of basketball for College of Idaho to earn its second national title. The Yotes held Indiana Tech off just long enough to complete its task and earn a 73-71 victory to hoist the coveted red banner.

College of Idaho did what it has done all season and started off the game red hot. The Yotes took control early and broke-off a 19-4 run to get things started. While the offense was impressive, the defense was just as. One of the top five in average defensive scoring margin in the 2023 NAIA National Championship field, the team from Caldwell, Idaho held the Warriors to six points in the first eight minutes, which set the tone.

The Yotes led by as much as 21 points in the first half as Tyler Robinett led the way. The sophomore was three-for-three from three-point range and led all scorers with nine points. Charles Elzie finished the opening frame with seven as Indiana Tech was able to cut the deficit to 19 before the break. Indiana Tech was held to just over 35 percent from the floor and went 1-7 from the free throw line.

Just 24 hours earlier, Indiana Tech erased a 16-point deficit, 11 at the half on their way to a win over Georgetown. On Saturday night, the Warriors looked to do the same and within minutes, began to cut into the lead.

Down by as many as 23 with just over 16 minutes to play, the Warriors put together a 10-2 run to begin climbing back. By the 12:01 mark, Rog Stein knocked-down a three-ball to put Indiana Tech within 13. Three and a half minutes later, the lead was down to 10 as College of Idaho called a timeout to try to end the momentum.

Indiana Tech climbed all the way back as the time continued to wind down. While College of Idaho was able to keep the Warriors at bay for the most part, they finally began to break through in the closing minutes.

The team from Fort Wayne brought it all the way back to within four, thanks in large part to the 18 points provided by Rog Stein, but came just short of repeating the magic of one night ago in the closing seconds.

Jake O’Neil led the Yotes with 15 points and 12 rebounds. Samaje Morgan added 13 points and Tyler Robinett chipped-in 11. In the end, however, it was Charles Elzie that was named the Chuck Taylor Tournament MVP for his outstanding performance throughout. The junior finished final site play with 67 points.

For Indiana Tech, bot Blake Davidson and Max Perez finished with 12 points while Josh Cline recorded 11 to round out the scorers in double digits, along with Stein’s 18.

College of Idaho finished the season on a 36-game win streak after suffering just one loss in the first game of the season to Arizona Christian.

I knew the EFF had been around longer than I've been alive, and that they've done so much for the internet that I take for granted. I like learning about how it came into being and what they've actually done. And I love learning that it actually worked, at least some of the time, that the people didn't just get conveniently disappeared, that the EFF sued and actually won and I live in a world with a better internet because they did that.

The affidavit on which SJ Games were raided was unbelievably flimsy . . . Loyd Blankenship was suspect because he ran a technologically literate and politically irreverent BBS, because he wrote about hacking, and because he received and re-posted a copy of the /Phrack newsletter. The company was raided simply because Loyd worked there and used its (entirely different) BBS!

... and also I find it amusing that in their illegal raid they didn't bring their own lockpicks or whatever. They tried to use the office letter openers.

In their diligent search for evidence, the agents also cut off locks, forced open footlockers, tore up dozens of boxes in the warehouse, and bent two of the office letter openers attempting to pick the lock on a file cabinet.

The World Must Always Have A Green Arrow

   On the eve of the conclusion to the epic crossover “Crisis On Infinite Earth’s”. The CW has released promo pics of the penultimate episode of Arrow to ease the nervous tension boiling from every fan. Desperately waiting for the arrowverse to return from winter hiatus, and give an explanation to that massive cliffhanger ending. One thing for certain is that whatever happens the arrowverse will never be the same. 

    Sadly one of the architects of the shared continuity has officially passed the quiver. Oliver Queen finally fulfilled his blood oath of saving his city. The mission his father entrusted him from its inception on Lian Yu. When Oliver returned from his eternity of torture spanning five years. He discovered the malice that plagued Star City in the primordial season 1. Now 8 years later Oliver is passing his mission to someone else. Due to the proclamation that he has become something else. Albeit with a hood so he feels right at home. 

   The one who will now take on the mantle of the Green Arrow is none other than Mia Queen (Kat McNamara). Mia is the biological daughter of Oliver and Felicity. She grew up in 2040 Star City. A future full of crime, and no government stability. Star City has fallen into its old habits because there is no emerald archer watching the city, and being the silent protector it truly needs. Oliver Queen is gone because he sacrifices his life fighting for the multiverse due to the impending crisis that threatens everything, and all that there is. Queen not knowing the ramifications of his actions sets up a lot of turmoil for his family post mortem. 

   When Oliver departed from the arrowverse. He left his wife a widow and left his daughter to grow up in a world without her father. The one parent she truly emulates. Hence why she resents him so much.  However due to the flash changing the timeline, and Crisis being brought much earlier than anticipated. Mia would get the closure she was longing, and seeking for an instance of time with her father. 

   Ollie knew when he saw her he had to pass on his legacy and during the crossover. He did exactly that. Not only by granting Mia the title of Green Arrow, but also giving her a suit, and passing on the quiver. One thing Mia needs to realize is that the world needs a green arrow. So by accepting the role; she also takes on Oliver’s mission. The pedigree of the queen’s bloodline is now pumping through her veins. The safety of Star City in her hands. 

  Now understanding the big shoes Mia will have to fill. The stories of the Green Arrow are only beginning. The CW knowing that fans are heartbroken over the cancelation of Arrow. A show that was a pioneer in starting a shared continuity spanning multiple properties. It had an awesome run of eight seasons. Something that doesn’t occur often in this day and age of media. 

  In addition to the success of Arrow. The network snuck in a backdoor pilot for the adventures of Mia Queen as season 8 episode 9. If the ratings prevail then more exposure of Star City will start to remain prevalent in the arrowverse. The synopsis of the back door pilot reads.

  Seeing the promo pics makes me ponder on why they are dropping an entirely new property. The feeling emanating from the project was that it was just Arrow season 9 or a soft reboot of the show. However only time will tell to change my decision. 

  One thing for certain though. I will miss Oliver Queen and going on the tour of Star City with him, and the team. Eight seasons almost in the books, and now everything must come to end. It’s the circle of life, but the cycle starts again and the world will know that the presence of the Green Arrow can still be felt.  

 In closing, Arrow will live on in the hearts of the fans, and the citizens of the Arrowverse alike. Remember the quiver has been passed, and the next chapter is ready to be written. (Credit The CW)

Top 15 Craziest Episodes of Arrow

„Crazy“ is an ever changing measure, especially in the Arrowverse. When Time Travel and Parallel Universes were introduced it was a heavy leap from the norm. A couple of seasons later it was pretty much normal. So this list reflects changes in the norm, episodes that pushed the crazy and unusual. What is crazy for on show is not crazy for another one.

 „Arrow“ was for it’s first seven seasons the straight man of ist own universe. However that does not mean, that crazy did not happen, and then there is Season 8 of course….

 So let’s get into it.

 15.  Purgatory (Episode 8.7/167, Written by: Rebecca Bellotto und Rebecca Rosenberg, Directed by: James Bamford)

Zombies on Lian Yu. While this is quite a sombre episode, it has undead Fyers, Yao Fe and Billy Wintergreen in it, which especially for „Arrow“ is quite let’s say unusal.

 14. Green Arrow and the Canaries (Episode 8.9/169, Written by: Beth Schwartz, Marx Guggenheim, Jill Blankenship, Oscar Balderrama, Directed by: Tara Miele)

 This one is the backdoor pilot (still not picked up, but neither axed yet), and the only episode of the show where Oliver Queen only appears in archive footage, which is unusal enough. It also has time travelling Canaries, different set of memories and a new post-crisis timeline, in which JJ is dating Mia (how wrong is that?!) who is basically a female version of Oliver at the beginning of his journey. A very wild trip.

13.  The Brave and the Bold (Episode 3.8/54, Written by: Greg Berlanti, Andrew Kreisberg, Marc Guggenheim, Grainne Godfree, Directed by: Jesse Warn)

Crossovers were the moments „Arrow“ had a chance to let ist hair down and just be a little bit different for a while. This one has Barry, Caitlin, and Cisco visiting Starling City and the Flash and the Arrow teaming up against Captain Boomerang. It’s still Arrow, but with a  splash of „The Flash“ in it, which makes it funnier and nerdier then „Arrow“ usually is.

12.  Legends of Yesterday (Episode 4.8/77, Written by: Greg Berlanti, Marx Guggenheim, Brian Ford Sullivan, Directed by: Thor Freudenthal)

This crossover involves Team Arrow and Team Flash as well as time travel, egyptian reincarating immortals and the always overacting Vandal Savage. We get a new timeline and a lot of shenigans. And a lot of heroes all crammed together.

11.  Suicide Squad (Episode 2.16/39, Written by: Keto Shimizu, Bryan Q Miller, Directed by: Larry Teng)

 Most people who did not read DC Comics only knew what this Suicide Squad was supposed to be because of this episodes and follow ups in later seasons. Long before the big movie did it all wrong, “Arrow” did it was better with this one, where John Diggle interacts with the squad while Oliver is off angsting around about Slade.

10. Draw Back your Bow (Episode 3.7/53, Written by: Wendy Mericle, Beth Schwartz, Directed by: Rob Hardy)

 Hate her or love her. This episode introduced Currie Cutter alias Cupid an insane former police woman turned obsessive stalker, who is here on a mission to irredacte love alltogether. And the story kind of goes very different then you would normally expect from „Arrow“.

9.      Crisis on Earth-X Part 2 (Episode 6.8/123, Written by: Wendy Mericle, Ben Sokoloswki, Marc Guggenheim, Andrew Kreisberg, Directed by: James Bamford)

Kara und Oliver as a loving couple of supervillains? Yes, it’s „Crisis on Earth-X“. After the West-Allen-Wedding was rudley interrupted last episode, in this one all the heroes of two different earths band together to find out what is going on, and Oliver meets Tommys evil doppelganger, while Kara is grossed out by the thought of her and Oliver as a married couple, and well a lot of crazy stuff is going on.

8.      Three Ghosts (Episode: 2.9/32, Written by: Greg Berlanti, Andrew Kreisberg, Geoff Johns, Ben Sokolowski, Directed by: John Behring)

 In this „Arrow“-Version of a „Christmas Carol“ Oliver gets visited by three ghosts and Barry gets hit by lightning. Among other things. All very good stuff in an rather unusal episode.

7. Haunted ( Episode 4.5/74, Written by: Brian Ford Sullivan, Oscar Balderrama, Directed by: John Badham)

 John Constantine crosses over in the Arroverse in this episode which reveals Olivers dealings with him in the past and shows him restoring Saras soul. With this episodes the show started to embrace it supernatural arc, which many fans weren’t too fond of in latter part of this season, but this episodes remains a favorite because here „Arrow“ got mystically weird.

6.      Invasion! (2) (5.8/100, Written by: Greg Berlanti, Marc Guggenheim, Wendy Mericle, Directed by: James Bamford)

In the middle of the big „Invasion“ Crossover „Arrow“ celebrated its 100the episode by looking at a world where the Gambit never sank. While the writers cleary had fun with Barry and Kara in this one, the heart lies in the dream reality, where things are better but sadly not real.

5.      Elseworlds Part 2 (Episode 7.9/147, Written by: Marc Guggenheim und Caroline Dries, Directed by: James Bamford)

 In the prolog Grant gives his best hilarious Oliver Queen-Impression, and yes, Oliver und Barry are still body swapped in this episode, which makes the introduction of Batwoman kind of strange and „Arrow“ kind of less serious then normally.

4.      Crisis on Infinite Earths Part 4 (Episode 8.8/168, Written by: Marv Wolfman, Marc Guggenheim; Directed by: Glen Winter)

A rather big protion of this episode takes place in the Speed Force and we revisit many important moments of our heroes history in this rather unusal episode, which is the heart and highlight of TVs biggest crossover of all time. And Oliver Queens last stand. Which is sad of course, but this is, after all, „Arrow“. Sad is this shows new normal.

3.      Reset (Episode 8.6/166, Written by: Onalee Hunter Hughes und Maya Houston, Directed by: David Ramsey)

Yes it’s a time loop episode in „Arrow“! Yes, it’s still „Arrow“, it will still break your heart. But it’s probably the moment the show embraced it’s funny pages origin the most wholehearted.

2.      Starling City (Episode 8.1/ 161, Written by: Beth Schwartz und Marx Guggenheim, Directed by: James Bamford)

We are essentially reliving the pilot with a few signifcant changes. Turns out we are actually on Earth-2 and Oliver pretends to be his doppelganger in order to do a thing for The Monitor. Until the shocking ending, this on is like everyone favorites „Arrow“ fanfic come to live. Even the flashforwards are not bothering us in this.

„Cops“ meets „Arrow“. This is a documentary about Team Arrow, or rather the making of the documentary about Team Arrow or rather a very special very unsusal episodes with an avid fan as the villain, a camera team all around, old interviews that did not age well and new interviews which are a tad revealing. It‘s a prudent celebration oft he 150the episode of the series.

The best available players after Round 1 of the 2020 NFL Draft

Houston offensive tackle Josh Jones highlights the best players for the second round on Friday.

In the end, after several twists, turns and false rumors, the beginning of the 2020 NFL Draft went as usual. And that goes beyond Joe Burrow going first and Chase Young going second. The Lions took cornerback Jeff Okudah at No. 3. The Giants took an offensive tackle. Tua Tagovailoa went to the Dolphins like most expected until people started assuming they would take Justin Herbert. The Chargers wisely took the best quarterback that fell to them in Herbert.

But not everything went according to plan. The wide receivers came off the board in an order few expected. Same for the offensive tackles. The first round was also filled with some stunners, like the Green Bay Packers moving up for quarterback Jordan Love or the Seattle Seahawks holding at No. 27 and taking linebacker Jordyn Brooks.

Those unexpected picks meant some big names fell out of the first round. Here are the best players available at the start of the second round of the 2020 NFL Draft, based on SB Nation’s top 100 players and then some:

 Jackson, Tenn (June 21, 2017) – The Office of Admissions and Records at Jackson State Community College released the honor roll for the Spring 2017 semester. On the honor roll, there were 307 full-time students who achieved a quality point average over 3.00. There were 381 students who made the dean’s list by achieving a quality point average of 3.50 or better.

 Honor Roll is reserved for students who are enrolled for twelve (12) or more hours of college-level work (Learning Support excluded) and who complete a semester’s work with a quality point average between 3.00 and 3.49.
