Indian Crypto Regulation Ready by September: Official
The Indian government is expected to issue detailed cryptocurrency guidelines by September, a senior official from the country’s Ministry of Finance reportedly said. Consultations with all stakeholders including the central bank have already begun. This announcement is independent of the supreme court’s hearing of petitions relating to crypto regulation in India.

Regulation Expected by September
The Indian government has reportedly finished drafting the regulatory framework for cryptocurrencies. The New Indian Express wrote on Saturday that the government is “likely to issue guidelines on cryptocurrency by September.”

This news follows the statement last month by the country’s Economic Affairs Secretary, Subhash Garg, confirming that the draft law would be ready by mid-July.
Citing that stakeholders include the Securities and Exchange Board of India (SEBI), the Reserve Bank of India (RBI), and the Internet and Mobile Association of India (IAMAI), an unnamed senior official from the Ministry of Finance told the news outlet:
The draft is ready and consultation is on with all the stakeholders…before coming up with the final paper. We expect it to be ready by September.
“The ministry has constituted an interdisciplinary committee under the chairmanship of Special Secretary (Economic Affairs) to examine the regulatory framework regarding virtual currency,” the publication detailed. “SEBI and RBI have expressed some reservations regarding clauses in the initial draft.”
How Should Crypto be Regulated?
The unnamed senior official was quoted by the New Indian Express, “Cryptocurrency is a new phenomenon and naturally, governments across the globe are struggling with it.” He further detailed, “Most of the officials have serious reservations against it, which all of us agree with … we want to arrive at a common conclusion. There must be an appropriate mechanism to regulate the same.”
While the regulators have not confirmed how cryptocurrency will be regulated, Quartz reported that a senior government official familiar with the matter indicated it could be regulated as a commodity. “I don’t think anyone is really thinking of banning it (cryptocurrencies) altogether. The issue here is about regulating the trade and we need to know where the money is coming from. Allowing it as (a) commodity may let us better regulate trade and so that is being looked at,” the publication quoted him saying on July 11.
He explained that cryptocurrency “trade is not a criminal offence,” describing:
What has to be in place is a mechanism to be sure that the money used is not illegal money, and to track its source is the most important thing.
Supreme Court Hearing Also in September
The Supreme Court of India on July 20 set the final hearing date for all petitions relating to cryptocurrency regulations to September 11. The hearing is in response to the circular issued by RBI on April 6 banning banks and all financial institutions under its control from providing services to crypto companies.
Many industry participants have petitioned against the ban. The IAMAI successfully convinced the supreme court to hear its petition on July 3. However, the court did not grant a stay and the ban went into effect on July 5. Banks subsequently closed the accounts of most crypto exchanges.
Judgement Day
The supreme court was supposed to hear all of the petitions relating to crypto on July 20. However, since some government bodies such as SEBI have not provided a response, the news outlet noted:
A three-judge bench headed by Chief Justice Dipak Misra acceded to the request made by the petitioners and the matter has been listed for final disposal on September 11.
At the hearing on Friday, the IAMAI was represented by Advocate Gopal Subramanium while Advocate Shyam Divan appeared for RBI. Divan “informed the court that allowing dealings in cryptocurrencies will encourage illegal transactions,” the publication conveyed, adding that he clarified the central bank’s policy is of “extreme caution.”

Tòa án tối cao của Ấn Độ đã duy trì lệnh cấm ngân hàng trung ương cung cấp dịch vụ cho thị trường tiền mã hóa trong nước sau phiên điều trần hôm qua (20/07/2018).
Tòa án tối cao Ấn Độ đã tổ chức phiên điều trần mới nhất về vụ kiện chống lại thông tư của Ngân hàng Dự trữ Ấn Độ (RBI) cấm tất cả các tổ chức tài chính, bao gồm cả các ngân hàng, cung cấp dịch vụ cho doanh nghiệp trong lĩnh vực tiền mã hóa. Được giới thiệu vào tháng 4, chính sách này cũng cấm các ngân hàng cho phép khách hàng mua tiền mã hóa thông qua tài khoản ngân hàng. Lệnh cấm có hiệu lực vào ngày 05.07, sau một nỗ lực không thành công nhằm thuyết phục Tòa án tối cao trì hoãn lệnh cấm hồi đầu tháng này.
Phiên điều trần được chủ trì bởi thẩm phán trưởng Dipak Misra và các thẩm phán khác như AM Khanwilkar và DY Chandrachud cùng với sự hiện diện của luật sư Ấn Độ – KK Venugopal.

Người ủng hộ đại diện cho ngành công nghiệp tiền mã hóa cho rằng thị trường Ấn Độ đang mất dần đi thị phần trên thị trường thế giới là do kết quả đến từ những lệnh cấm của RBI.
Trong khi ngày 11.09 được xác định là ngày phán quyết cho thị trường tiền mã hóa trong nước, thì chính phủ Ấn Độ cũng đang thiết lập dự thảo để công nhận và hợp pháp hóa khu vực này một cách hiệu quả trong tương lai.
Theo báo cáo của CCN, vào tuần trước, ủy ban liên chính phủ liên ngành đã được giao nhiệm vụ thành lập khuôn khổ pháp lý cho lĩnh vực tiền mã hóa, và dường như họ không có bất kỳ động thái nào về việc cấm hoàn toàn các giao dịch trong thị trường. Thay vào đó, các nhà chức trách có thể thực thi các tiêu chuẩn, quy định mới có khả năng phân loại tiền mã hóa như một loại hàng hóa.

India’s Supreme Court has upheld the central bank’s directive of prohibiting banks from offering services to the domestic cryptocurrency sector following a hearing today.
On Friday, India’s Supreme Court held its latest hearing of the case against the Reserve Bank of India’s (RBI) circular forbidding all regulated financial institutions, including banks, to provide services to business in the cryptocurrency sector. Introduced in April, the policy also forbade banks from allowing their own retail customers from purchasing cryptocurrencies through bank accounts. The ban came into effect on July 5, after an unsuccessful final-hour attempt to convince the Supreme Court to delay the ban earlier this month.
The petition was put forth to chief justice Dipak Misra and justices AM Khanwilkar and DY Chandrachud with India’s attorney general KK Venugopal also present, underlining the significance of the matter.
The hearing saw ‘limited arguments’ brought forward by lawyers on behalf of the Internet and Mobile Association of India (IAMAI), which counts domestic cryptocurrency exchanges as its members, and the Reserve Bank of India. The lack of opinions from other prominent authorities in response to the regulation-seeking petition by the cryptocurrency sector has seen the Supreme Court defer the date of hearing again, with final arguments to be heard on September 11.

Limited arguments were advanced on behalf of IAMAI and RBI today. Since SEBI and few others have not filed their response to the Petition seeking regulation, so the Court directed for completion of pleadings. Final arguments on 11th September.

Representing the IAMAI and the cryptocurrency sector, senior advocate Gopal Subramaniam underlined the severity of the matter surrounding the RBI circular and called for the hearing to be heard without any further delays.
Appearing for the central bank, senior advocate Shyam Divan also called for a final hearing while claiming cryptocurrency could encourage illegal transactions, according to Indian legal news blog Bar&Bench.
He reportedly stated:
“The policy of RBI is of extreme caution.”
The advocate representing the cryptocurrency industry argued Indian adopters and the wider Indian market stand to lose among global counterparts as a result of the RBI-led banking curbs.
Mr. Gopal Subramaniam, Sr. Advocate representing IAMAI submitted that in the world of digitalisation, such a Circular from RBI would be a loss.

While September 11 is shaping up to be judgment day for the domestic cryptocurrency sector, an unlikely ally could see India’s government could bring respite to adopters and the wider ecosystem by establishing regulations, currently in draft, to effectively recognize and legalize the sector in the near future.

Modeled on an 18th century picaresque novel, Bruce Norris’s “The Low Road” on stage at the Public Theater presents the improbable adventures of a scoundrel, one Jim Trewitt, to whom an adversary rightfully attributes “a rather comprehensive wickedness.”
It is a wild ride through the first two decades of Jim’s life in Colonial America, which lead up to the American Revolution, peopled by some 50 vivid characters – whores and highwaymen and Hessians; celibates and slaves and British soldiers; Mohegan scouts , rich liberal benefactors and giant alien bees — portrayed by a superb cast of 17, including Chris Perfetti as the delightfully sniveling anti-hero, and the priceless Harriet Harris as the naïve Madame who raises him.
There is what some theatergoers might see as a catch, although others would view it as an enhancement. Norris intends “The Low Road” as a lesson in economics – or, more precisely, as a cautionary tale about the evils of Republican-style capitalism.
It is impossible to avoid this theme. Adam Smith, the 18th century philosopher and economist, narrates the play, the character (portrayed by Daniel Davis) a near-constant presence. Jim, the son of a thief and a whore left as an infant on the doorstep of a house or prostitution, stumbles upon a passage of Smith’s writing that explains the economist’s belief in the free market – that society functions best when every individual is left to pursue his own self-interest without regard to the community at large. These individual self-interests collectively create an Invisible Hand that guides society. Jim is seven years old when he reads about the Invisible Hand, and it guides the rest of his life of avarice, betrayal and outright thievery.
“How convincingly those words resonate within the ears of a child,” Adam Smith tells us. “For if the fruits of a man’s labour may be enjoyed without regard to consequence, if every penny therein derived is to be his alone, to do with as he pleases, he will apply himself to that labour, and once his prosperity is thus achieved, the rest of the damnable world can stick it up their fucking arsehole.”
“The Low Road” is not above such low blows. Norris is not making what you might call a subtle argument, although he is frequently amusing. The playwright scores points against free market thinking throughout the play, working them into scene after scene. When Jim, after being robbed, is rescued by a religious community, he sanctimoniously quotes the dogma of free market economists as if the sayings are from the Bible – “The rising tide doth lift all vessels in the harbor”; “the Lord helps them what helps themselves”; “Give a man a fish and you feed him for a day. Teach him to fish and you feed him for a lifetime.” No, the congregants tell him, none of these sayings are in Scripture. What IS in the Bible: “The poor have always been with us.” The leader of the community adds: “What He tells us is that our obligation is perpetual and everlasting.”
In another episode, when Jim seeks to buy a slave, the slave merchant speaks of his merchandise like a modern-day salesman (“If you’re not a hundred percent satisfied, within thirty days’ time we’ll gladly exchange ya for another of equal or lesser value, minus wear and tear to the first.”)
As if to make sure the audience gets the point, “The Low Road” even leaves the 18th century for one satirical scene in the 21st, a panel discussion at a world economic forum with pro-business eggheads and self-satisfied businessmen – including, slyly, “Richard Trewitt of Trewitt Bank Global, LLC,” an apparent descendant of Jim Trewitt. Only one panelist, a retired banker and eminence grise named Ed, cautions against the “mad rush for profitability” and the push for deregulation that could, as it did in the Great Recession ten years ago, destroy lives. “I do start to wonder – the question occurs whether the past decade has taught us anything at all.”
Norris, best-known for his Pulitzer and Tony winning play “Clybourne Park,” a take-off and sequel of sorts to Lorraine Hansberry’s “A Raisin in the Sun,” uses “The Low Road” to express an impressive number of opinions. He weighs in against climate change, the hypocrisy of rich liberals and dynamic airline pricing, and argues for universal free education and collective bargaining, mostly through the playwright’s main mouthpiece, Jim’s slave John Blanc (Chukwudi Iwuji), who has his own improbable and mesmerizing story.
There is no way to escape the playwright’s built-in commentary, but under Michael Greif’s direction, “The Low Road” is the very definition of rollicking. And if the long running time (150+minutes including intermission) includes some scenes that don’t work as well as others, and some that are too way out there even to assimilate – be prepared for an awkward visit by giant bee-like aliens with pessimistic prophecies on the future of the human race – there is enough low comedy and high jinks along the way to make “The Low Road” worth traveling.
