All You Need To About Form 15CA and Form 15CB

Introduction

In the course of business, it happens that many payments are made outside India. When payments are made outside India, there are certain compliances that need to be followed and tax deduction is required for any amount that is taxable under the Income Tax Act. The purpose of this compliance is to collect information regarding payments that are chargeable to tax in the hands of recipient NRIs. An NRI is required to file Form 15CA and Form 15CB for any payment made outside India. Form 15CB along with Form 15CA needs to be filed online on the official website of the Income Tax Department.

What is Form 15CA?

Form 15CA is a declaration made by the remitter stating that he has deducted tax from any payment made to a non-resident. Form 15 CA needs to be filed by the remitter — the person making the payment to the NRI or foreign company. It is also used as a tool to collect information regarding payments that are chargeable to tax.

Through Form 15 CA, the Income Tax Department keeps track of all foreign remittances/payments and also their taxability. As per Income Tax Rule 37BB, it is the responsibility and duty of authorized banks or dealers to ensure that they receive such forms from the remitter. Income Tax Form 15 must be filed online in CA Income Tax Department. Also, along with Form 15 CA, 15 CB needs to be filed with the Income Tax Department. However, Form 15CB must be accompanied by an accountant’s certificate in Form 15CB.

What is Form 15 CB?

While Form 15 CA is a declaration, Form 15 CB is a certificate issued by a chartered accountant. A Chartered Accountant has to ensure that all the provisions of the Income Tax Act and Double Taxation Avoidance Agreement are complied with in respect of tax deduction while making payments.

What is the applicability of Form 15CA and Form 15CB?

If the remittance amount is not chargeable to tax, no form is required.

If the remittance is covered under the specified exemption list, only Part D of Form 15CA has to be submitted.

Redesigned Form 15 CA and Form 15 CB submission process

The IT Department has launched a new redesigned submission process for Form 15 CA and Form 15 CB. This decision has been taken based on various responses from corporates and professionals across India. It is believed that these changes will simplify the entire Form 15 CA and Form 15 CB filing cycle from form preparation to submission to verification process. Let’s look at the significant changes in the process.

For multiple filing of Form 15CA/CB, it is no longer mandatory or necessary to assign the same CA in a particular financial year.

Hence, appointment of Chartered Accountant for Form 15 CB is a one-time activity for a particular financial year.

A CA can now proceed with Form 15 CB for both the remitee and the remitter without the need for the taxpayer to fill up Part C of Form 15 CA and submit it to a Chartered Accountant, after a single assignment is made in a year. Hence, here the earlier process of multiple acceptance and rejection for each form is eliminated and the entire process is simplified.

Chartered Accountants can now access Form 15CB directly from IT Forms functionality for filing instead of work list for action.

The offline/bulk mode of submission process has been enabled from 4th October. Taxpayer can generate XML files using Java-based offline utility. The offline utilities are available on the portal in the “Download” section under the “Income-Tax Forms” page and upload it to the portal for further filing. A new online process will start soon on the portal.

How Big Are Red/Blue Glitch Pokemon?

A Typical Glitch Pokemon’s Height/Weight

If you’ve ever bothered to look at the Pokedex entries for glitch pokemon in Red/Blue, you might start noticing a pattern. Almost every single glitch pokemon reports the same set of numbers: 23 feet tall and 880.6 pounds. In fact, besides the Missingno, only around twelve glitch pokemon are also an exception to this rule. The rest are all the same:

I’m sure there’s some reason for this. I imagine it’s related to how the game is reading data that it shouldn’t be and interpreting it as height and weight information. But I’m not here to explain exactly what it’s doing, because frankly, I don’t know. 

What I am here to do is give you a feel for how big most glitch pokemon are! 23 feet tall can be hard to imagine, after all. At least, *I* have a hard time visualizing it. So I googled “23 feet  tall.” And this amazing thing is what I found:

So, most glitch pokemon are about as tall as this straw Godzilla here. 

This is actually not an outrageous size for creatures in the pokemon universe. For example, Onix is listed as ~28 feet tall. So Onix would tower over this, even. Still, that said, glitch pokemon aren’t exactly housecat-sized friends. They are Big Boys.

Oddly, though, the weight of glitch pokemon seems surprisingly low for their size. Animals that weigh around 800-900 pounds in real life include American bison/buffalo, Grizzly and Polar bears, moose, yaks, and large tigers. Some very chonky animals, absolutely-- but admittedly none of these animals are the size of this Godzilla here. We’d normally expect a real, living Godzilla of this size to be, well, heavier then a single buffalo. 

The Pokedex may not be the best at listing realistic estimates, though. For example, Onix is listed as being around 460 pounds. A 28-foot tall creature made of solid rock is only 460 pounds? Honestly, that seems pretty low.

In any case, the final answer is that most glitch pokemon weigh about a Single Buffalo. For reference, one of these:

Now that we know your garden-variety, average glitchmon is around these scales, what about the exceptions?

Glitch Pokemon Height Ranges

To help give a proper idea of sizes, I’ve created a height chart of glitch pokemon in red/blue:

As you can see, most glitches are in that 23-foot range, which is the height of a Rayquaza. But there are some who are significantly larger!

-F3 (the Riachu hybrid) is 40 ft tall, which comes rather close to Wailord (47 ft). 

-DE (a Magnemite hybrid) is ~60 ft tall which nearly reaches the massive Eternatus from Sword/Shield (65 ft). 

-But three glitch pokemon, C3, CB and DC (a Gengar hybrid and the two Pidgeotto hybrids) can reach an entire 80 feet (DC can vary in height/weight), towering over even Eternatus. This is taller than the tallest dinosaurs. 

-However, there’s an even a bigger behemoth. The glitch pokemon EE (a Bug/Glitch type) can also come in a range of sizes, ranging from the average 23 feet all the way to around 87 feet tall. This is not quite reaching kaiju sizes (or Gigantimax sizes), but I can assure you an 87-foot tall bug would be pretty intimidating. 

-On the other hand, a few of the size exceptions are more reasonable. D4 and EC are about the same size as the 23-foot average. 

-Meanwhile, C2 (A Pokemaniac type) and CA (one of the powerful Normal/Ground types) are around 16 feet tall, which is around Primal Groudon or original Zygarde size. Still hefty pokemon, to be sure, but  a bit easier to handle.

-Missingno’s regular form is 10 feet tall, the height of a standard basketball hoop. Arceus and Serperior are this size. Still large, since they still can’t quite fit into an average house without ducking for the ceiling, but we’re getting there.

-The only small glitch pokemon are F7 (the Pidgeot hybrid) and DF (one of the Normal/Normal types), at 2 feet tall. This is the size of Charmander, which should come up to just above your knees. Quite a cute size!

Glitch Pokemon Weight Ranges

Now, if you look at the list, you’ll find that most glitch pokemon seem rather beefy:

-For the heaviest glitch pokemon, C3 (a Gengar hybrid) and the two Pidgeotto hybrids (CB, DC) can weigh 6099 lbs, a little over 3 tons. This is in the range of what heavy Elephants weigh. 

-Not far off from those, the Raichu hybird (F3) and DE (a Magnemite hybrid) weigh 5751.9 and 5400.7 lbs, respectively. 

-Regular Missingno are 3507.2 lbs, around the weight of Rhinos.

-DF (a Normal/Normal type) and F7 (the Pidgeot hybrid) are 2622 lbs.

-For reference, the heaviest natural pokemon, such as Primal Groudon, are 2204 lbs

-C2 (a Pokemaniac type) and CA (a Normal/Ground type) weigh 2150.1 lbs., in the range of what Hippos weigh.

-EE (a Bug/Glitch type)’s weight ranges widely from 2056 to 106 lbs.

-The weight for most glitch pokemon is 880 lbs., in the range of a Buffulo

So, yeah, most of these seem to be an impressive weight! On the other hand, most of these seem surprisingly light for their size. Take C3, for example. This pokemon is 80 feet tall, taller than the biggest dinosaurs, and yet it only weighs around the weight of one large elephant. EE can have an even more extreme contrast. It can be ~84 feet tall but only weigh around 100 pounds. 

However, the most extreme example is probably the pair of pokemon with the lightest weights for glitch pokemon:

-D4 (a Gengar hybrid) and EC are only 0.6 pounds, which is about the weight of a can of beans. Yet these pokemon are 22 feet tall (the height of Giratina). That is incredible! I can’t imagine what they are made of.

If we look at regular Missingno, we find a height/weight contrast that’s not quite so nuts. Missingno is 10 feet tall and weighs ~3500 lbs. That’s actually pretty heavy for its height! (A Buffalo is ~800-900 lbs and ~5 feet tall, so you’d expect a freakish monster 10-foot-tall Buffalo to weigh ~1800 lbs). However, while Missingno is surprisingly dense, it’s not insanely unrealistic?

That said, the reward for the most reasonable height/weight ratio must go to C2 & CA. C2 & CA are ~16 feet tall and weigh ~2150 pounds. This is actually very close to Primal Groudon, which is ~16 feet tall and weighs 2204 pounds. And in our Buffalo example, we’d exepect a freakish Buffalo that’s 15 feet tall to weigh around 2700 lbs. So, yeah, not too far off the mark!

Summary

Most glitch pokemon are a bit shorter than an Onix and weigh about the same as Steelix (or one real-life buffalo). However, some glitch pokemon can reach up to ~87 feet tall, much taller than any natural pokemon. Additionally, some glitch pokemon can weigh up to 6099 pounds, well beyond the weight of any natural pokemon. Glitch pokemon probably don’t beat out Gigantimax pokemon in height and weight, but they do for natural pokemon.

Also, most glitch pokemon are surprisingly light for their size. This can be very extreme. However, Missingno is actually pretty dense for its size, and a few glitch pokemon have a very reasonable hight/weight ratio.

Step 1: CA and CB are friends/don't know each other/are aquanteses;

Step 2: CA notices smth about CB all of a sudden;

Step 3: COnfUISiON;

Step 4: DENIAL;

Step 5: Okay, but maybe this could be nice? But what if they don't like me?? If I confess, then would I lose my feelings in time or would I get rejected before they could form???;

Step 6: CA does smth cute unintentionally; CB notices;

Step 7: BLUSH;

Step 8: hWAT Is hAPPenNING?!

Step 9: Do I like them??

Step 10: No way;

Step 11: Okay, but maybe this could work?;

Step 12: Plot happens;

Step 12.1: Someone gets a confession from Character M; Jealousy is what i mean; (<<more denial)

And there you have it!

The point I'm trying to make here is don't use 'I love you' as a confession.

It's too soon and it's too shallow; there is no basis for the emotion.

Let me explain like this: everything has a basis; a plot, a character, a feeling, a relationship ect.

In order for a relationship to have chemistry, there has to be a basis for said chemistry.

And that basis is time.

A character cannot say 'I love you' immediately after confessing because their feelings are highly unlikely and are probably based off of appearance (at least it's how its portrayed to the reader). You, as a writer, may know what and who the characters are, but said characters, in your story, don't.

They need time in order to get to know each other and subconsciously start crushing on each other. And even after they have confessed, it is still too early to say the three special words because now CA is learning a whole new side to CB and vice versa.

The stages of a relationship:

1. Friends; frenemies; aquantences;

2. A character does smth that makes the other notice them;

3. Confusion;

4. Denial;

5. Probably worth a try;

6. Confesion: 'I like you';

7. I'm getting to know you;

8. I like you even more now;

9. My feelings are growing stronger;

10. Realization;

11. Should I tell? Would it scare them off?- Doubt;

12. They support me and I do them, if it doesn't work out then it wasn't meant to be;

13. Second confession: 'I love you';

14. I am happy;

Then comes marriage and children and so on and so on.

Not to say that these stages are accurate or anything, but it is roughly of how a character falls for someone.

Even if they have fallen for them since before the plot in the story takes place, the reader needs time to adjust to the facts that CA likes CB.

Slow burns also need to chill out a little, not just series that progress way too quickly.

I'm sorry about the huge rant, this was honestly supposed to be a funny prompt. ^^;

But I hope it helped some in some way!

And don't get me wrong, I have been a victim of this sort of problem too when I started out so don't be shy and feel embarrassed or anything cause everyone's a beginner! Learn from your mistakes!

When an NRI vend a property located in India, it's the buyer’s responsibility to abate the withholding duty/ TDS (Tax subtracted at Source) from the trade consideration while making a payment to him. Presently this TDS rate is further than 20 edu cess cargo. This is applicable when an NRI dealer hold this property for further than 2 times and 30 if property is vended within 2 times of purchase.

This chance is applicable on trade consideration rather than capital gain. This makes TDS rate applicable onanon-resident dealer is relatively high in comparison to applicable on resident merchandisers. This TDS subtracted shall be deposit by the buyer to the income duty department within the specified time limit and the same TDS challan shall be encouraged to the dealer for his records. Also TDS return shall be filed by a buyer before the due date and TDS instrument shall also be encouraged to the dealer. Once it’s done the NRI dealer can check the same TDS details in his 26AS also.

Once the TDS is subtracted, an NRI can file his duty return on the base of his capital gain duty liability and can claim refund of redundant TDS subtracted. This can be done after the end of fiscal time in which property is vended. The NRI can reduce his capital gain duty by investing his capital gain quantum in any other domestic property or by investing in government notified bonds within the specified time limit and as per the applicable vittles.

Refund that can be claimed = TDS subtracted by buyer – Capital gain Duty Capital gain duty = Capital gain *20.8 ( add cargo, if applicable) .Capital gain = Trade proceeds – Listed * Purchase price and cost of Enhancement-– Transfer expenditure * Listed means inflating the value of property by applying government notified cost affectation rate.

Alternate option is, Rather of getting TDS subtracted at a advanced rate, an NRI dealer can apply for lower/ O TDS deduction instrument to his assessing officer/ income duty officer depending on his capital gain duty. Also the buyer shall abate TDS at the same rate mentioned in the instrument.

In case, an NRI wants to repudiate the trade proceeds or refund quantum entered from income duty department also his bank will ask him to submit 15ca and 15cb instrument along with other documents.15 cb instrument is a instrument from Chartered Accountant (CA) while Form 15ca is the information given by the remitter.

Important point

1. Please make sure to file a duty return in India if you have vended a property in India. This becomes ineluctable especially when you're planning to repudiate the trade proceeds. Else there are huge chances that you'll get a notice from Income duty department asking reason of non – form or about the source of plutocrat which is remitted outside India.

2. If you're buying a property from an NRI dealer also you shall have TAN no. If you do n’t have also you can apply for it online. 3. Filing Lower/ NIL TDS instrument is an online process now. Time to get a instrument depends on the time taken by assessing officer to respond. Normal time to get a Lower/ NIL TDS instrument is one to two months after applying for it.
