Europe VAT laws not changing any time soon, recent. If understand FAQ well, mean shipping to Europe impossible for several years minimum?
That's correct, I won't be shipping to the EU for the foreseeable future due to some import packaging regulations that either have already been implemented or are planning to be implemented in the future.
Note that this is for EU countries only—I can ship to all other non-EU countries like Switzerland, except for the UK due to the UK's own convoluted VAT system.
The only workaround I can offer for EU folks is that you can have a friend or family that lives in a non-EU country place an order to deliver to their address, and then they are able to ship that order to you marked as a gift. Not an option for everyone, I know.

As it stands now, each EU country has its own system and fees that I can't keep up with (for example, France would cost me 80 euros per year), I'd need to individually register and report to each country, some require reporting and tracking of what sources of packaging I use, I believe? It's all very complicated, and it makes my head spin just trying to figure out what the requirements actually are, so that's why I stopped shipping to the EU entirely out of an abundance of caution. I also just don't get enough sales to the EU to justify the headache, I'd probably actually lose money paying all the fees. Actually, while I was looking up details while writing this post, apparently there's a new PPWR that's going to replace the old EU Packaging Directive? This is why I can't handle this (ಥ﹏ಥ)
As for why this doesn't seem to be affecting all companies—corporations can obviously afford their own professionals whose entire job is to handle this stuff, and the requirements are also different for large vs small volumes. Meanwhile, a lot of other small or 1-person businesses straight up don't know about these requirements, because it's not like there's a memo passed around about updates to international shipping law. It's also even more confusing because some packages are slipping by without any issue, probably in part due to how the regulations are still new and still being implemented, so I assume it's kind of a mess.
I know of a few people who are willingly taking the risk and shipping to the EU anyway and have had no consequences (for now at least), but I'm not risking the fines ¯\_(ツ)_/¯
Now for the UK, their VAT system doesn't have anything to do with packaging, but what it does require is similar registration with the government, and I'm required to collect and pay the VAT myself. No thanks!

Sam Heughan’s Sassenach whisky brand loses the final legal fight in a trademark dispute in the European Union 🇪🇺
Sam Heughan launched his whisky brand "The Sassenach" in 2020, nickname his character uses for his on-screen love interest in the time travel drama "Outlander". Since 2021, Heughan has been embroiled in a legal battle with "Sasse" a German distillery over the name of his whisky brand, arguing that the Sassenach whisky would confuse customers who might think he is linked to them.
The European Union Intellectual Property Office (EUIPO), which resolves trademark disputes, ruled in favour of the German company and issued a decision upholding the opposition saying The Sassenach could not use the name as a whisky brand. After losing the initial decision at the Fifth Board of Appeals in 2021, Heughan's legal team appealed in 2022 to overturn the decision.
His legal team said there was no risk of confusion as Outlander was popular in Germany. Lawyers for the Sasse distillery, however, said: "The television series may be as popular as the other side claims, which we deny, nonetheless it is not sufficient to assume that the average consumer knows the meaning of that term. Both parties in litigation were given time to present evidence and arguments in their defence and after the Examination period, the Opposition Division’s decision was taken this year 2023.
Great Glen Company or its representative never commented on the EU decisions until last October, in New York when Sam Heughan was asked about Sassenach whisky situation in the European Union in a chat with Mark Gillespie at the Whisky Cast podcast and Heughan's response was very limited, deflecting the question talking about the name in dispute but not the EUIPO's decision, regarding Sassenach whisky that was supposedly aware of the official communication from the European Union Intellectual Property Office - Opposition Division- sent to Great Glen Company in July 2023, which considered that the disputed trademark 'The Sassenach' must be rejected for all the contested goods.
It's a bit curious that after the EUIPO decision, Sam Heughan appeared on a surprise visit to New Orleans, which included podcasts, and events with @sgwinespirits on Tales of the cocktail with an unscheduled tasting of his drinks at the Ritz-Carlton in Nola. Later on, he began his Sassenach sales tour around the United States last summer. If these people had known what had happened with his Sassenach brand in the EU would be different?
In addition, Great Glen Company (GGC) applied to register a new trademark with the World Intellectual Property Organisation (WIPO) and the EU, following the EUIPO decision, following its earlier idea to build on all the Outlander ideas, the new trademark is called "LALLYBROCH SPIRITS" (Lallybroch means "lazy tower" in Gaelic). It will not use Midhope/Lallybroch as a distillery. This new trademark has nothing to do with or relate to the grounds of Midhope Castle, the site of a new whisky distillery with a different brand and ownership. Its new application is already registered in the United States.
It's pending resolution in the EU, Canada and the United Kingdom where Heughan requested its registration.

THE SASSENACH UNIQUE SPIRITS
The Great Glen Company, Sam Heughan’s firm, applied to register the brand name Scotch whisky THE SASSENACH UNIQUE SPIRITS as a future trademark to sell the whisky across Europe, but Theo Sasse e.K brand distillery in Schöppingen-Germany, objected claiming the name was too close to its trademarked name, which it uses to sell whiskies and brandies spirits.
On 20th July 2023 the Opposition Division takes the following:
DECISION
1. Opposition is upheld for all the contested goods.
2. International registration is entirely refused protection in respect of the European Union.
REASONS
On 24th November 2021 the opponent Theo Sasse e.K filed an opposition against all the goods (Class 33) of international registration designating the European Union. The opposition is based on, inter alia, German trademark registration ‘Sasse’ (word mark). Also, the opponent invoked Article 8(1)(b) EUTMR and Article 8(4) EUTMR.
LIKELIHOOD OF CONFUSION — ARTICLE 8(1)(b) EUTMR
A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings.
The opposition is based on more than one earlier trade mark. The Opposition Division finds it appropriate to first examine the opposition in relation to the opponent’s German trade mark registration.
a) The goods
The goods on which the opposition is based are, inter alia, the following:
Class 33: Alcoholic beverages, excluding beers. Alcoholic beverages, except beer are identically contained in both lists of goods (including synonyms).
b) Relevant public — degree of attention
The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question. In the present case, the goods found to be identical are directed at the public at large.
c) The signs
The relevant territory is Germany.
Contested sign The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components. The earlier mark is the word mark ‘Sasse’. The protection of a word mark concerns the word as such and not the specific graphic or stylistic elements accompanying that mark.
The verbal element ‘SASSENACH’ of the contested mark has, contrary to the allegations of the holder, no meaning for the relevant public and is, therefore, distinctive. Likewise, the unicorn device of the contested sign has no particular meaning in relation to the goods and is distinctive.
THE SASSENACH’ in the contested sign are the dominant elements as they are the most eye-catching.
Visually, the signs coincide in ‘SASSE’, which represents the entire earlier mark. The signs differ in the representation of a unicorn and the additional letters ‘-NACH’ (after SASSE) and the non-distinctive elements ‘The’ as well as ‘UNIQUE SPIRITS’ in the contested mark. Thus, the single word element of the earlier mark is fully contained in the most distinctive verbal element of the contested mark. That fact alone is a clear indication of a visual similarity. Therefore, the signs are similar to a below-average degree.
Aurally, the signs coincide in the syllables ‘Sas-se’, which is the sole and distinctive element of the earlier mark and the beginning of the most important verbal element of the contested sign, ‘Sas-se-nach’. The signs differ in the last letters of this word (one syllable), ‘nach’, and in the first verbal element of the contested sign, ‘The’. The fact remains that the earlier mark is entirely included at the beginning of the most important verbal element of the contested sign.
Conceptually, the signs will always be dissimilar as the contested mark will be understood with at least one meaning, namely the unicorn in the contested mark. As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.
d) Distinctiveness of the earlier mark The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion. In the present case, the earlier trade mark as a whole has no meaning for any of the goods in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.
e) Global assessment, other arguments and conclusion The goods at issue are identical. They target the general public, who possesses an average degree of attention. The earlier mark has a normal degree of distinctiveness. The signs are visually similar to a below average degree and aurally similar to an average degree since the sole and distinctive element of the earlier mark, ‘Sasse’, is entirely reproduced at the beginning of the contested sign’s only fully distinctive verbal element, ‘Sassenach’. Evaluating the likelihood of confusion implies some interdependence between the relevant factors and, in particular, a similarity between the marks and between the goods or services.
Considering all the above, especially taking into account that the earlier mark is entirely reproduced in the contested sign and used for goods that are identical, the Opposition Division finds that there is a likelihood of confusion on the part of the public. Therefore, the opposition is well founded on the basis of the opponent’s German trade mark registration It follows that the contested trade mark must be rejected for all the contested goods. As the earlier right German trade mark registration leads to the success of the opposition and to the rejection of the contested trade mark The Sassenach for all the goods against which the opposition was directed.
The trademark status was "totally refused", meaning that THE SASSENACH UNIQUE SPIRITS trademark cannot be registered in the EU. If SH's trade mark application is refused, he can file an appeal. He must file his notice of appeal within 2 months from the date of the refusal decision (August-September) and the grounds of appeal must be filed within 4 months from the same date of notification (October-November). But, He did not appeal and last November the EUIPO confirmed by letter the provisional refusal of his trademark and refused its protection in the European Union. The final decision was published on 14 December 2023.
Conclusion
The EUIPO’s decision of the Board of Appeals, regarding its whisky has a “displacement” because Sassenach whisky cannot be registered as a trademark in the EU, the Sassenach trademark was refused. SH must be aware the significance of the total refusal decision regarding its whisky brand. If he was planning to recover from a legal dispute by putting his gin on an impromptu Sassenach tour around US last summer, proving that his recent EU legal battle was a mere bump in the road, he should have thought twice. He lost a legal battle to register his Sassenach whisky brand as a European Community trademark ® in 27 states. It is a big difference. It seems that if Heughan wants to continue selling its whisky, it will have to change the name.

USAF: Boeing's KC-46A and T-7A face more delays

The Air Force's head of acquisitions, Andrew Hunter, noted possible future problems for the KC-46A and said that production of the T-7A could start “a little later” than previously predicted, but he remained confident about the future of the two aircraft.
For years, the fixed price agreements that Boeing has signed for programs such as the air refueling plane KC-46A Pegasus and the coach T-7A Red Hawk have been headaches for the aerospace giant amid billions in losses due to delays, supply chain restrictions and development problems. And now, according to the U.S. Air Force acquisition leader, more delays for both efforts may be coming.
Testifying before the Chamber's Armed Services Maritime Power and Projection Forces Subcommittee on Tuesday, Andrew Hunter said that an update to the long-problematic vision system of the KC-46A would probably arrive in 2026, surpassing a projected field date already 19 months late, from October 2025. After the hearing, he told reporters separately that the service would "probably" approve the production of coach T-7A later than previously expected.
“There is some scheduling pressure,” Hunter told lawmakers about the implementation of a new vision system for the KC-46A, called RVS 2.0. "And depending on the completion of the airworthiness certification process of the Federal Aviation Administration (FAA), I cannot guarantee that we would be in a position to enter the field in 25. It could be '26. And that's really likely - I think it will probably take the field in 26."
After the hearing, Hunter explained to reporters that a possible Pegasus delay is linked to the FAA certification process, arguing that when RVS 2.0 is integrated, “you need to make sure that this will not affect anything else on the plane. Therefore, this makes the airworthiness process more complex than it may seem, because it is essentially more than just the cameras you are dealing with."
Hunter added that he is "confident" that USAF and Boeing "have the right project" and that the team "will go through the entire process of airworthiness in the near future".
So far, Boeing has reported losses of more than $7 billion in the Pegasus program due to its fixed price structure, although it is not clear whether more losses could be associated with an additional delay for RVS 2.0. Boeing has defured the questions to the U.S. Air Force, but the company had already praised the capabilities of the new vision system as providing marked improvements over the basic version.
Despite the problems in the vision system, the aircraft has been released for combat deployment and can refuel most of the U.S. fleet, except the A-10, due to a separate problem with an actuator on the tanker's boom, which should be resolved by fiscal year 26. Hunter suggested last year that the service was inclined to buy more tankers as part of a new strategy to continue the retirement of the service's former KC-135 refuelers, although a service official later said that a procurement strategy had not yet been decided.
Europe's Airbus positioned itself as an alternative if the U.S. Air Force decided to participate in a competition, after its partner Lockheed Martin announced that it was giving up.
In his testimony this week, Hunter said that autonomous capabilities could be incorporated into the future of air refueling, but told journalists that this would not be a requirement for the next installment of the acquisition of tankers.
"I think this would be something that we would consider as an independent effort and potentially put into practice in the future," he said about autonomous replenishment.
In a written statement on Tuesday [PDF], Hunter additionally said that the service would slightly expand its current contract with Boeing, adding four KC-46As for a total registration program of 183.
T-7A 'A little later than we expected'
Meanwhile, budget documents confirmed the decision of the U.S. Air Force to halve the 2025 fiscal acquisition of the T-7A Red Hawk training aircraft, intended to replace the former T-38 Talon, from 14 to seven, and indicate that delays in the program are also near.
This program was reformulated last year to reflect a delay of more than two years. A subsequent surveillance report found that problems with the flight control software and the jet's escape system continued to pose risks to the already delayed schedule, especially when the jet moved to enter flight tests, where the U.S. Air Force could discover new flight control deficiencies.
Now, it seems that the coach's schedule may be a little longer. According to the Fiscal Year 2025 budget documents released by the service on Monday night, a decision of the Marco C - or the point at which the service officially approves a program to go into production - is projected for May 2025. Previously, authorities planned the C-Mark for February 2025, although the program allocated a full year of schedule margin for the decision.
To help mitigate delays, Boeing began buying long-term parts to start making an eventual production decision. This approach required a special agreement between the U.S. Air Force, Boeing and the Defense Contracts Management Agency to oversee initial production, which the service said last year had been achieved.
In addition, as Aviation Week previously noted, budget documents also suggest that the initial operational capacity of the jet may be postponed for one year, from the second quarter of Fiscal Year 2027 to the second quarter of Fiscal Year 2028. So far, Boeing has reported losses of about $1.3 billion in the Red Hawk program, and it is not clear whether further delays could result in more charges. As with the KC-46, the company transferred questions about the T-7A to USAF, which did not immediately respond to a request for comment.
Speaking to reporters after Tuesday's hearing, Hunter explained that the decision to halve the purchase of T-7A in Fiscal Year 25 was mainly the result of high-level fiscal pressures. Still, he said that the size of the seven Red Hawks batch "is a good starting point" for the service.
He said that delays in the start of the flight test program may mean that the coach will be approved for production later than expected. The first USAF T-7A landed at Edwards Air Base in November.
“We entered the flight test program a little later than we expected, so we will probably start production a little later than we expected,” Hunter said. “At the moment, the flight test program is doing relatively well. If we don't discover something unexpected, I believe we will go into production in fiscal year 2025."
Asked if the date of the Marco C of February 2025 is at risk, he replied: "To define when we will comply with the Marco C. It's event-driven. We will have to see how the testing program behaves."

Ann Neal is Mark Webber’s wife/manager/questionable person. Almost everything I’m going to talk about next is from Mark’s book Aussie Grit which everyone should read
She is 17 years older than Mark (as per the public info on their company’s registration), which maybe wouldn’t be a problem if they started dating at their current ages but they first met and got together when Mark was 17. She was also his manager during the early part of his career. more below the cut now!!
In his book Mark talks about how their relationship went from professional to personal during the FIRST trip to Europe. Please keep in mind this was his FIRST attempt to grow his career, his first time away from home, and he knew nobody but her, his manager, who is like 17 years older than him and should know better.
Like this woman was in a position of power, had his career in his hands, and was on a separate continent where literally the only person he knows is her.
Mark said in his book that even his mum wasn’t happy about it, and also that Ann’s kid views Mark as a big brother…like ok
In Aussie Grit Mark literally wrote Ann’s first impression of him. Please keep in mind he was SEVENTEEN (17) and she was 34.
“I liked how bold and cheeky he was, and how mature he seemed. When I asked someone how old he was, I was shocked when they said 17 - he was confident beyond his years.”
LIKE?? The fact she went from thinking and saying this about a 17 year old to becoming his manager and then very quickly starting to hook up with him to having a relationship is CRAZY. She also apparently remembers what he was wearing that day - like girl why were you looking so hard?!?!
They moved to England then and didn’t know anyone else and became codependent and Mark has said she was the only one, other than himself, who believed that his F1 dream could happen. It’s very cute in that it obviously ended up happening, but please keep in mind that this is still his manager and a woman almost two decades older than him.
Mark said his parents’ weren’t happy with the relationship, and at one point he went back to Australia for a break (from racing and a temporary break up with Ann because it got too serious too fast) and got a new management company and started dating someone else. Ann wasn’t happy, and Mark said she “wasn’t prepared to hang around and watch young love undermine all we’d worked so hard for”
Like. This is now not just his former manager, but also his EX GIRLFRIEND. He’s got a new girlfriend now and a new management and Mark then decided his personal life was now affecting his driving, so he broke up with the two newbies and went back to Ann because Ann wasn’t happy.
So six months after the break up and Mark groveling, saying “I want to come home,” Mark left Australia and moved back in with Ann and her son in England. Like at this point he was what? 20? And he’s basically settled down for life with a much older woman and her kid (sound familiar).
Obviously I do not know Ann or Mark but the way this reads to me and probably anyone who’s read the book is that she was looking out for herself and herself only. She had an opportunity and she took it while manipulating an 18/19 year old man who did not know any better and whose career she held in her hands!!! LIKE.

63rd Infantry Division
August 3, 1926 – July 21, 2023
Tony Bennett was an American singer. Bennett amassed many accolades throughout his career, including 20 Grammy Awards, a Lifetime Achievement Award, and two Primetime Emmy Awards. He was named an NEA Jazz Master and a Kennedy Center Honoree, and was the founder of the Frank Sinatra School of the Arts in Astoria, Queens, New York. Bennett sold more than 50 million records worldwide.
Tony Bennett had come a long way since growing up poor in Queens, New York, during the Great Depression. Born Anthony Dominick Benedetto in 1926 to Italian immigrants, Bennett's father was a grocer who died when Tony was 10 years old. It wasn't long before he started helping out the family by singing while waiting tables.
Like many people and many families, the Benedettos' lives were forever changed by World War II.
Bennett turned 18 in 1944 and was drafted into the U.S. Army.
By March 1945, the young soldier was deploying to Europe with the 63rd Infantry Division, replacing casualties lost in the Battle of the Bulge. In his 1998 autobiography "The Good Life," he called the war a "front row seat in hell."
As the German Army was pushed back, Benedetto and his company saw bitter fighting in cold winter conditions, often hunkering down in foxholes as German 88 mm guns fired on them.
At the end of March, they crossed the Rhine and entered Germany, engaging in dangerous house-to-house, town-after-town fighting to clean out German soldiers; during the first week of April, they crossed the Kocher River, and by the end of the month rea ched the Danube.
During his time in combat, Benedetto narrowly escaped death several times. The experience made him a pacifist he would later write, "Anybody who thinks that war is romantic obviously hasn't gone through one,"and later say, "It was a nightmare that's permanent. I just said, 'This is not life. This is not life.'"
At the war's conclusion he was involved in the liberation of the Kaufering concentration camp, a subcamp of Dachau, near Landsberg, where some American prisoners of war from the 63rd Division had also been held. He later wrote in his autobiography that "I saw things no human being should ever have to see."
Benedetto stayed in Germany as part of the occupying force but was assigned to an informal Special Services band unit that would entertain nearby American forces. His dining with a black friend from high school—at a time when the Army was still racially segregated—led to his being demoted and reassigned to Graves Registration Service duties.
Subsequently, he sang with the 314th Army Special Services Band under the stage name Joe Bari (a name he had started using before the war, chosen after the city and province in Italy and as a partial anagram of his family origins in Calabria). He played with many musicians who would have post-war careers.
Upon his discharge from the Army and return to the States in 1946, Benedetto studied at the American Theatre Wing on the GI Bill. He was taught the bel canto singing discipline, which would keep his voice in good shape for his entire career. He continued to perform wherever he could, including while waiting tables. Based upon a suggestion from a teacher at American Theatre Wing, he developed an unusual approach that involved imitating, as he sang, the style and phrasing of other musicians—such as that of Stan Getz's saxophone and Art Tatum's piano—helping him to improvise as he interpreted a song.He made a few recordings as Bari in 1949 for small Leslie Records, but they failed to sell.

#3 Volvo EX30 — The China-made (but with a Swedish passport) crossover is starting to live up to the hype, jumping to the 3rd spot on the table in only its 3rd full month on the market. The model had 7,642 registrations in March. Note that its slightly bigger, but much older, sibling, the XC40 (recently renamed EX40), does not seem affected by this, with the Belgian-made SUV scoring its best result in 10 months (5,595 registrations in March). Expect the EX30’s sales to continue strong in the coming months, maybe even crossing the five-digit barrier (fingers crossed). Currently Volvo’s cheapest model(!), starting out at 39,000 euros vs. the 40,000 euros of the gasoline XC40, the EX30 is Volvo’s smallest model — the size of a VW ID.3. While it cannot be considered cheap (for that it would have to cost less than 35,000 euros), it can nevertheless be considered well priced, especially considering the premium standing it holds. Regarding the EX30’s March results, the distribution of deliveries show a push in three markets, with the UK (1,510 units), France (1,388 units), and the Netherlands (1,173 units) being the only ones above 1,000 deliveries, followed from afar by Sweden (652 units)(..)
P.S. The Volvo EX30 example well illustrates the mechanism of how American ICE vehicle manufacturers and the other companies that do not produce affordable electric cars will be kicked out of the European car market...! Tesla is too expensive and fails to offer a viable alternative to replace mass market ICE vehicles, but the Volvo EX30 is a completely different story: reasonable size perfect for Europe, acceptable range, good speed and quite reasonable price...! So, actually Tesla had lost affordable EV competition...
