It is with great concern that we, the members of the Netzwerk Autorenrechte which represents authors and translators in the book sector from 15 organisations in the D-A-CH region, observe Germany's, Frances and Italy's new position on the AI Act proposal. This new position runs counter to the consensus previously reached by EU Member States on the legal regulation of AI, in particular with regard to transparency and liability obligations for developers of generative technology.
According to reports from Euractiv on 19 November 2023, Germany – under the lead of the Digital Ministry and the Federal Ministry for Economic Affairs and Climate Action, and together with France and Italy – wants to push for "obligatory self-regulation" instead of legally binding regulation. There are no sanctions for saftey incidents such as copyright, authors’ rights and data protection violations, insufficient labeling, or circumventing ethical standards in the position of these three countries.

Dear Chancellor, dear Vice Chancellor, dear Federal Minister,
dear Mr President of France, dear Prime Minister of Italy:
We urge you to change your position, which currently favors supposed economic advantages to the detriment of sustainable legal rules. Your position sends a fatal signal to everyone in the cultural sectors and to all people in Europe: namely, that you're willing to protect the same tech companies that illegitimately make use of cultural works and citizens data for their own profits – rather than protecting the people whose work and private data have made these foundation models and generative applications possible in the first place.
The consequences of your position would be devastating. Generative technology is already threatening numerous jobs. We can already observe several harmful “business models” based on AI products and an increase in disinformation. It's been proven that generative AI uses unlawfully obtained works without the knowledge or consent of the works' authors. Without legal regulation, generative technologies will accelerate the theft of artistic work and data. They'll increase discrimination and the falsification of information, including damage to reputations. And they'll significantly contribute to climate change. The more legally deregulated generative products reach the market, the more irreparable the loss of trust in texts, images, and information will become for society as a whole.
We urge you to return to the values of trust, democracy, and justice. We're standing on the threshold of an evolution, of one of the most decisive moments in history. Will we regulate the machines that are using humans in order to replace them? Or will we choose the short-sighted ideology of money?
We trust you have the political resolve to do the right thing.

The US Copyright Office is currently asking for input on generative AI systems ...
... to help assess whether legislative or regulatory steps in this area are warranted. Here is what I wrote to them, and what I want as a creative professional: AI systems undermine the value of human creative thinking and work, and harbor a danger for us creative people that should not be underestimated. There is a risk of a transfer of economic advantage to a few AI companies, to the detriment of hundreds of thousands of creatives. It is the creative people with their works who create the data and marketing basis for the AI companies, from which the AI systems feed. AI systems cannot produce text, images or music without suitable training material, and the quality of that training material has a direct influence on the quality of the results. In order to supply the systems with the necessary data, the developers of those AI systems are currently using the works of creative people - without consent or even asking, and without remuneration. In addition, creative professionals are denied a financial participation in the exploitation of the AI results created on the basis of the material. My demand as a creative professional is this: The works and achievements of creative professionals must also be protected in digital space. The technical possibility of being able to read works via text and data mining must not legitimize any unlicensed use! The remuneration for the use of works is the economic basis on which creative people work. AI companies are clearly pursuing economic interests with their operation. The associated use of the work for commercial purposes must be properly licensed, and compensated appropriately. We need transparent training data as an access requirement for AI providers! In order to obtain market approval, AI providers must be able to transparently present this permission from the authors. The burden of proof and documentation of the data used - in the sense of applicable copyright law - lies with the user and not with the author. AI systems may only be trained from comprehensible, copyright-compliant sources.

so far: unlike human made work, AI generated artwork or designs are not copyrighted (in germany) AND if the AI piece is based on an existing human made work and it's still visible in the AI piece you need to get the copyright from the original owner / creator (includes designs, logos, images, text and music)
Copyright owner can opt-out and sue if it's still gets used for AI training / generation (american laws aren't finished yet but also will go into that direction)

They test different AI software to give out a little comic scenario. And oh boy as a graphic designer with knowledge about typography the text is triggering me so hard. It's so bad. SEE alone typography is an area that can't be made by a machine because even tho it is based on design laws it's still an intuitive human-eye based way of design. There is a difference between mathematical-centered and optical-centered.

Man they are all so horny for AI and reduction of jobs and costs.... But no matter how good an AI could generate an image or video... it will never give you the raw files where you can do individual changes afterwards.
Besides that I still think humanity isn't ready yet for the power and options AI is giving us. (at least one of the very high quality AI builders isn't selling it atm because they are afraid that it will get misused for fake news and stuff, so they try to find a way to prevent that before they bring it on the market)
So many creative jobs and professions that will die out just for us to get 100% digital made "creative" content and advertisements :/ (so far even the most high quality AI still has some small uncanny vibe). Like even actors will be replaced in the future... all they need to do is allow companies to use their face / body.... there is literally a Black Mirror episode about that.
Reminds me of that one AI kpop idol project I have seen last year on tiktok.... absolutely creepy and wrong. I know some of us are simping over anime, game or vocaloid characters but... man idk, do yall want to simp over uncanny digital kpop idols who don't even exist nor actually work for their skills and talent? 💀 Being into an idol is not just about the visuals and songs, it's about their personality and individuality.... for me at least.... (but of course the kpop industry is one of the first trying this). I do like Taemin for example beacuse he's breaking out of the industry norms. AI dude could never be on his level.

AMG SL, the new edition of an icon, returns to its roots with a classic soft top and sporty character. At the same time, the luxurious roadster as a 2+2 seater is particularly suitable for everyday use and puts its power down on the road with all-wheel drive for the first time.
High-tech components such as the AMG ACTIVE RIDE CONTROL suspension with active anti-roll stabilisation, rear-axle steering, the optionally available AMG ceramic high-performance composite brake system and the standard-fit DIGITAL LIGHT with projection function sharpen the sporty profile.

At market launch, the new SL starts with two output levels of the AMG 4.0-litre V8 biturbo engine. The engines are assembled purely by hand at the company’s site in Affalterbach according to the „One Man, One Engine“ principle. In the top model SL 63 4MATIC+ (combined fuel consumption 12.7-11.8 l/100 km, combined CO2 emissions 288-268 g/km)[1].
The engine develops 430 kW (585 hp) and provides a maximum torque of 800 Nm over a wide rev range from 2500 to 4500 rpm. Accelerating from 0 to 100 km/h takes only 3.6s, the top speed is 315km/h.
In the SL 55 4MATIC+ (combined fuel consumption 12.7-11.8 l/100 km, combined CO2 emissions 288-268 g/km), the V8 unit develops an output of 350 kW (476 hp) and a peak torque of 700 Nm. The sprint from standstill to 100 km/h takes 3.9s, the top speed is 295km/h.

BMG, FOLLOWING ‘MORE EFFICIENT AND MORE EFFECTIVE’ STRATEGY UNDER NEW CEO THOMAS COESFELD, REORGANIZES STRUCTURE; AROUND 40 STAFF CUT

Thomas Coesfeld, CEO of BMG since July, has made another major move at the Bertelsmann-owned company.
MBW revealed in September that, under Coesfeld, BMG was taking the digital distribution of its music in-house – bringing its longstanding distribution deal with Warner Music Group/ADA to an end. (BMG has since confirmed that, while keeping digital distribution in-house, it’s inked a deal with Universal Music Group to handle its physical distribution business.)
Now, Coesfeld is enacting another set of significant changes at BMG, which posted an operating EBITDA of €90 million ($97m), up 22.6% YoY, in the first six months of 2023.
Berlin-based Coesfeld this week confirmed to staff that BMG is reorganizing its global structure in pursuit of his strategic goal for the company to become “more efficient and more effective”.
The biggest change under that plan will see BMG discontinue its centralized international marketing department for recordings, which to date has been led by the company’s EVP Global Repertoire, Fred Casimir.
In an internal note, issued to staff on Thursday (October 26) and obtained by MBW, Coesfeld said: “The international marketing team was set up five years ago in response to the needs of the company at the time.
“Our talented team have done a great job, driving international campaigns for artists including Lenny Kravitz, Kylie Minogue, and Louis Tomlinson, but unfortunately on a business level, expectations from this novel structure were not met and it created duplication of functions with local teams.
“The clear business decision is to instead give artists a single contact point with their local repertoire teams.”
In addition, Coesfeld has green-lit four other significant alterations to BMG’s structure: (i) The discontinuation of BMG’s Modern Recordings label based in Berlin; (ii) The closure of the firm’s New York-based theatrical productions initiative; (iii) No more active commissioning of new films to take place at BMG; and (iv) The consolidation of BMG’s New York and Canada-based recorded music operations into its Los Angeles office.
In total, MBW has confirmed, these changes – including the international marketing function closure – will affect 3% of BMG’s global staff, equating to around 40 employees. Fred Casimir will be leaving the company later this year as part of the move.
“These are tough but necessary decisions,” said Coesfeld in the Thursday internal note to BMG staff. “I would like to extend my thanks to the team members involved on behalf of everyone at BMG. They have done us proud. They were given the news only today, and I understand it has been a shock. We are in close contact with them and in Germany with our Workers Council to ensure everything is handled in a respectful way.”
Elsewhere in the internal memo, BMG confirmed that it is “on target” to begin distributing its own recorded music to streaming services such as Spotify from Wednesday next week (November 1).
In addition to becoming a “more efficient and more effective” business, Coesfeld’s comments in the memo outlined three other core strategies that form part of his “four-point plan” for the company this year.
The other points in this plan include “better engaging with our clients and partners”, “renewing BMG’s culture”, and “investing money wisely”.
Referencing the latter point, the internal BMG memo said that the company recently introduced “a new deal-modelling tool and new deal-approval routines to create more rigor in the system”.
As a result of the closure of BMG’s international marketing function, the company’s artists will no longer have two marketing contact points (domestic and international).
Their sole contact point for marketing going forward will be the repertoire team to which they are signed.
“Much like our distribution alliance with Warner Music/ADA struck in 2016, our previous international set-up – established around the same time – was the right decision back then,” said Coesfeld in Thursday’s memo.
“It allowed us to grow and was the ideal structure for the time. Our recordings business is now three times the size it was then and it’s overwhelmingly streaming-based. It is no surprise that the way we manage our business also has to change.
“While the logic of this move is clear, however, we should not underestimate the impact on our colleagues. Our best wishes are with them and BMG will do what we can as a company to help them at this time.”
When contacted by MBW, a BMG spokesperson said today (October 28): “Just as we have insourced our digital distribution because we had outgrown the old set-up, so we are changing the way we do international to reflect the scale we have now achieved.
“A centralised international department made sense when our local repertoire teams were not as strong as we are now. We’ve addressed that and a centralised function is no longer needed. As the only global player outside the three majors, international continues to lie at the heart of what we do. We’ll just do it differently.
“It’s far better to make changes like these from a position of strength when you’re performing well, rather than leaving it too late”
“Obviously these are tough decisions to make, but there’s better ways to invest this money to improve our service to clients and you can expect further announcements on improvements to our service offering imminently.
“97% of the BMG team are unaffected by these changes.”

India approves development of the 5ª generation 'AMCA' fighter

In a significant move, the Indian Cabinet Security Committee approved the fifth-generation Advanced Medium Combat Aircraft (AMCA) poaching project to be executed by the Defense Research and Development Organization (DRDO).
With an estimated cost of approximately US$ 2 billion, the project will be carried out by the Aeronautical Development Agency of the Defense Research and Development Organization. The goal is to develop poaching and its associated technologies in collaboration with several public and private sector entities. The plan includes the construction of approximately five prototypes within a period of about five years.
According to sources, the project will involve the production of the prototype by industry players, including the public sector company Hindustan Aeronautics Limited.

The government has actively sought the development of national technologies in the defense sector.
The Ministry of Defense predicts that the fifth-generation aircraft project will create numerous employment opportunities and may result in substantial commercial contracts worth millions of dollars for Indian companies. This initiative is expected to generate large-scale employment opportunities.
Under the leadership of Prime Minister Narendra Modi, the Indian Air Force has significantly strengthened its support for Indian fighter aircraft projects. This is evidenced by the government's acquisition of more than 200 light combat aircraft and the approval of engines for the LCA Mark-2 project.
The introduction of the AMCA into operational functions is expected to begin after 2030. The two initial squads are planned to be equipped with GE-414 engines, while discussions are underway for the co-development of more powerful engines for the subsequent squads.
India is expected to introduce more than 200 of these advanced fifth-generation fighters, which will also contribute to the country's ability to develop future generations of jet fighters in the domestic market.

Surging Forward
When it comes to the Four Ps of Marketing, there is one that affects us the most. It raises eyebrows. It may cause mental anguish. And it hits where it hurts the most, the pocketbook. I can only be talking about one thing: Price.
As I was telling my undergrads yesterday, they have now lived through—and survived—a period of inflation. This hasn’t happened for 40 years, which I remember all too well from my university days. It’s the kind of thing you tend to remember forever.
While inflation is now more or less within a reasonable range (about 3.1% last month), our grocery bills are up about 25% in the last four years. You can thank the compounding effect for that. Some manufacturers have responded by reducing the size of the package, so they can try to maintain price points. Labeled as “shrinkflation” by President Biden and others, it gives the illusion that prices haven’t gone up, even though the unit price definitely has.
Given that we have all now become hyper-sensitized to price since COVID, it should come as no surprise that Wendy’s plans to test surge pricing for its hamburgers is drawing the ire of many. It’s bad enough that the price of fast food has skyrocketed, but now they want to charge even more during hours of peak demand, as well as at locations that are typically busier than others.
Surge pricing, which also goes by the moniker dynamic pricing, has been in use for decades. It’s what explains the matinee price at movie theatres, a time of day in which far fewer people are likely to see a movie. Airlines have done it for years, with peak demand times seeing fares much higher than off-peak. Add hotels to the mix, too. Business hotels are often weekend bargains for families, because all the people with expense accounts have gone home. And we all know how expensive food and beverages are at airports and stadiums, while not far away they are much lower.
Uber is another company leaning on this model, with the price of a ride reflecting the demand. If a stadium is emptying out, the price just went up. Many other retailers, from Amazon to Target, Kroger, Best Buy, and others have done it. The advent of digital price tags makes it all too easy to reset prices within a store, or even systemwide. Heck, I even saw it in Germany some years ago, with gas stations raising prices at peak commuting times, and lowering them during others. Shame on you for not refueling at a better time!
One of the more interesting aspects of dynamic, or surge, pricing is that used on Dallas-area toll roads and express lanes. Essentially, the price is set based on traffic volume. As congestion increases, the price for diverting to the express lane goes up. The thinking is that it might just be worth your added dollars to be able to zoom by the unlucky proletariat stuck in traffic. Be sure to wave as you go by. These lanes are the sky boxes of the highway system. At peak times, a person driving solo can pay up to $0.90 per mile for the privilege.
The weeks ahead will be interesting to see how the market reacts to Wendy’s move, and whether they stick to their guns or back down. If customers swallow surge pricing, it opens the flood gates for all fast food restaurants to do the same. It could then spill over into all restaurants, and everywhere else. Consumers will be left at wit’s end trying to keep up with what amounts to a wide array of possible prices for the things they buy. I suspect that apps and websites will arrive that allow for crowdsourced updates on all of it.
It’s the price we pay for being alive today. Inflation is one thing, but having to endure exorbitant temporary price hikes is quite another. Even staying home and being a hermit does not make you immune, because you still have to buy things. As for me, I’m staying in the slow lane just as a matter of principle, and because I’m still waiting for my salary to go up commensurately to account for the last four years.

ESSEN, Germany (AP) — For most of this century, Germany racked up one economic success after another, dominating global markets for high-end products like luxury cars and industrial machinery, selling so much to the rest of the world that half the economy ran on exports.
Jobs were plentiful, the government's financial coffers grew as other European countries drowned in debt, and books were written about what other countries could learn from Germany.
No longer. Now, Germany is the world’s worst-performing major developed economy, with both the International Monetary Fund and European Union expecting it to shrink this year.
It follows Russia's invasion of Ukraine and the loss of Moscow's cheap natural gas — an unprecedented shock to Germany’s energy-intensive industries, long the manufacturing powerhouse of Europe.
The sudden underperformance by Europe's largest economy has set off a wave of criticism, handwringing and debate about the way forward.
Germany risks “deindustrialization” as high energy costs and government inaction on other chronic problems threaten to send new factories and high-paying jobs elsewhere, said Christian Kullmann, CEO of major German chemical company Evonik Industries AG.
From his 21st-floor office in the west German town of Essen, Kullmann points out the symbols of earlier success across the historic Ruhr Valley industrial region: smokestacks from metal plants, giant heaps of waste from now-shuttered coal mines, a massive BP oil refinery and Evonik's sprawling chemical production facility.
These days, the former mining region, where coal dust once blackened hanging laundry, is a symbol of the energy transition, dotted with wind turbines and green space.
The loss of cheap Russian natural gas needed to power factories “painfully damaged the business model of the German economy,” Kullmann told The Associated Press. “We’re in a situation where we’re being strongly affected — damaged — by external factors.”
After Russia cut off most of its gas to the European Union, spurring an energy crisis in the 27-nation bloc that had sourced 40% of the fuel from Moscow, the German government asked Evonik to keep its 1960s coal-fired power plant running a few months longer.
The company is shifting away from the plant — whose 40-story smokestack fuels production of plastics and other goods — to two gas-fired generators that can later run on hydrogen amid plans to become carbon neutral by 2030.
One hotly debated solution: a government-funded cap on industrial electricity prices to get the economy through the renewable energy transition.
The proposal from Vice Chancellor Robert Habeck of the Greens Party has faced resistance from Chancellor Olaf Scholz, a Social Democrat, and pro-business coalition partner the Free Democrats. Environmentalists say it would only prolong reliance on fossil fuels.
Kullmann is for it: “It was mistaken political decisions that primarily developed and influenced these high energy costs. And it can’t now be that German industry, German workers should be stuck with the bill.”
The price of gas is roughly double what it was in 2021, hurting companies that need it to keep glass or metal red-hot and molten 24 hours a day to make glass, paper and metal coatings used in buildings and cars.
A second blow came as key trade partner China experiences a slowdown after several decades of strong economic growth.
These outside shocks have exposed cracks in Germany's foundation that were ignored during years of success, including lagging use of digital technology in government and business and a lengthy process to get badly needed renewable energy projects approved.
Other dawning realizations: The money that the government readily had on hand came in part because of delays in investing in roads, the rail network and high-speed internet in rural areas. A 2011 decision to shut down Germany's remaining nuclear power plants has been questioned amid worries about electricity prices and shortages. Companies face a severe shortage of skilled labor, with job openings hitting a record of just under 2 million.
And relying on Russia to reliably supply gas through the Nord Stream pipelines under the Baltic Sea — built under former Chancellor Angela Merkel and since shut off and damaged amid the war — was belatedly conceded by the government to have been a mistake.
Now, clean energy projects are slowed by extensive bureaucracy and not-in-my-backyard resistance. Spacing limits from homes keep annual construction of wind turbines in single digits in the southern Bavarian region.
A 10 billion-euro ($10.68 billion) electrical line bringing wind power from the breezier north to industry in the south has faced costly delays from political resistance to unsightly above-ground towers. Burying the line means completion in 2028 instead of 2022.
Massive clean energy subsidies that the Biden administration is offering to companies investing in the U.S. have evoked envy and alarm that Germany is being left behind.
“We’re seeing a worldwide competition by national governments for the most attractive future technologies — attractive meaning the most profitable, the ones that strengthen growth,” Kullmann said.
He cited Evonik’s decision to build a $220 million production facility for lipids — key ingredients in COVID-19 vaccines — in Lafayette, Indiana. Rapid approvals and up to $150 million in U.S. subsidies made a difference after German officials evinced little interest, he said.
“I'd like to see a little more of that pragmatism ... in Brussels and Berlin,” Kullmann said.
In the meantime, energy-intensive companies are looking to cope with the price shock.
Drewsen Spezialpapiere, which makes passport and stamp paper as well as paper straws that don't de-fizz soft drinks, bought three wind turbines near its mill in northern Germany to cover about a quarter of its external electricity demand as it moves away from natural gas.
Specialty glass company Schott AG, which makes products ranging from stovetops to vaccine bottles to the 39-meter (128-foot) mirror for the Extremely Large Telescope astronomical observatory in Chile, has experimented with substituting emissions-free hydrogen for gas at the plant where it produces glass in tanks as hot as 1,700 degrees Celsius.
It worked — but only on a small scale, with hydrogen supplied by truck. Mass quantities of hydrogen produced with renewable electricity and delivered by pipeline would be needed and don't exist yet.
Scholz has called for the energy transition to take on the “Germany tempo,” the same urgency used to set up four floating natural gas terminals in months to replace lost Russian gas. The liquefied natural gas that comes to the terminals by ship from the U.S., Qatar and elsewhere is much more expensive than Russian pipeline supplies, but the effort showed what Germany can do when it has to.
However, squabbling among the coalition government over the energy price cap and a law barring new gas furnaces has exasperated business leaders.
Evonik's Kullmann dismissed a recent package of government proposals, including tax breaks for investment and a law aimed at reducing bureaucracy, as “a Band-Aid.”
Germany grew complacent during a “golden decade” of economic growth in 2010-2020 based on reforms under Chancellor Gerhard Schroeder in 2003-2005 that lowered labor costs and increased competitiveness, says Holger Schmieding, chief economist at Berenberg bank.
“The perception of Germany's underlying strength may also have contributed to the misguided decisions to exit nuclear energy, ban fracking for natural gas and bet on ample natural gas supplies from Russia,” he said. “Germany is paying the price for its energy policies.”
Schmieding, who once dubbed Germany “the sick man of Europe” in an influential 1998 analysis, thinks that label would be overdone today, considering its low unemployment and strong government finances. That gives Germany room to act — but also lowers the pressure to make changes.
The most important immediate step, Schmieding said, would be to end uncertainty over energy prices, through a price cap to help not just large companies, but smaller ones as well.
Whatever policies are chosen, “it would already be a great help if the government could agree on them fast so that companies know what they are up to and can plan accordingly instead of delaying investment decisions," he said.
