Dear J'Luc K. Star,
With fools, you cannot predict them.
Tumblr media
I believe Ms. Miney was likely threatened by her former boss to sue her. I've been involved in enough cases to know his type. He would threaten the family of his dead employees if it meant saving his precious reputation.
Tumblr media
Had Ms. Miney contacted a lawyer early on instead of pulling this nonsense, she could have put in a counterclaim of his abusive treatment toward her sister and won flawlessly.

Lawyer Explains Defamation, Libel, and Slander
I'm sure you've heard about defamation; it's a commonly used term in popular vernacular, even amongst those outside of the legal world. What exactly is defamation, though? What are the legal requisites for the allegation to hold any weight in a court of law? Let's break it down.
By definition, defamation constitutes a false statement of fact made about somebody that harms their reputation. It's essentially a weightier legal definition for "spreading rumors" and is not protected by the First Amendment right to free speech; anybody who should defame another may find themselves civilly or criminally liable for the illegal act of defamation.
In order to prove defamation, one had to prove the publication of false statements, that said statement was damaging to the plaintiff, that the statement was made with "actual malice," and the damages that ensued as a result.
Legally speaking, "Actual malice" doesn't necessarily mean the statement published was done with literal malicious or mean intent; instead, it means the plaintiff has a conscious and intentional understanding that what they are saying is false, or act with reckless disregard to the truth within said statement.
Now, that's defamation, but what are libel and slander? Libel is essentially just written defamation, meaning a statement requires publication to be admissible as libel.
Slander is verbal defamation spoken by the defendant
This is just one of many educational posts I'll be sharing, but I felt this one to be more urgent; not only because I hear the term get thrown around so often, but also because it'll make it easier to cover defamation lawsuits with you guys once you understand the term and it's associated implications. I hope you learned something!

“PATIENT LOSES SUIT TUBE LEFT IN BODY,” Toronto Star. January 31, 1933. Page 1.  ---- Woman's Husband Breaks Down When Judgment Given --- Special to The Star Hamilton, Jan. 31.- Bereft of home and business through prolonged litigation, James Thomson broke down at the conclusion to-day of the supreme court trial of the action brought by him and his wife, Nellie, against the city of Hamilton and the General hospital for $10,000 damages, claimed for alleged negligent treatment of Mrs. Thomson. Mr. Justice Logie dismissed the action without costs.
Plaintiffs claimed a rubber drainage tube left 13 months in her breast after an operation performed in September, 1929, while she was a patient of Dr. R. Y. Parry, caused prolonged ill health. They were given judgment in their first suit against the physician but it was reversed when an appeal court found he was not liable. Their action against the hospital and corporation followed.

If you’re making the character a lawyer/legal assistant, here is another list of potential paperwork specific to that:
Pleadings (Complaints, Cross- or Counter-Complaints, Answers)
Court orders (sometimes called Minute Orders)
Discovery documents (medical records, written questionnaires, invoices, deposition transcripts, requests for information)
Client reports
Privilege logs (ie having to go through documents and write out what you’re withholding as “privileged”)
Motions, Motion Notices, and Separate Statements supporting motions.
Case Management Statements (ie summaries of the case submitted to the court)
Settlement Agreements
Private Investigator Reports
Judicial review requests (ie you ask the judge to look at specific statutory law in preparation for a case; generally stuff like city ordinances or specific regulations that the judge might not be familiar with)
Subpoenas
We don’t talk enough about how fanfiction writers love to give character large amounts of non-specific paperwork they hate doing
