THANK FUCKING GOD
"The Supreme Court on Thursday [June 13, 2024] unanimously preserved access to a medication that was used in nearly two-thirds of all abortions in the U.S. last year, in the court’s first abortion decision since conservative justices overturned Roe v. Wade two years ago.
The nine justices ruled that abortion opponents lacked the legal right to sue over the federal Food and Drug Administration’s approval of the medication, mifepristone, and the FDA’s subsequent actions to ease access to it. The case had threatened to restrict access to mifepristone across the country, including in states where abortion remains legal.
Abortion is banned at all stages of pregnancy in 14 states, and after about six weeks of pregnancy in three others, often before women realize they’re pregnant.
Justice Brett Kavanaugh, who was part of the majority to overturn Roe, wrote for the court on Thursday that “federal courts are the wrong forum for addressing the plaintiffs’ concerns about FDA’s actions.”
The opinion underscored the stakes of the 2024 election and the possibility that an FDA commissioner appointed by Republican Donald Trump, if he wins the White House, could consider tightening access to mifepristone, including prohibiting sending it through the mail...
Kavanaugh’s opinion managed to unite a court deeply divided over abortion and many other divisive social issues by employing a minimalist approach that focused solely on the technical legal issue of standing and reached no judgment about the FDA’s actions...
While praising the decision, President Joe Biden signaled Democrats will continue to campaign heavily on abortion ahead of the November elections. “It does not change the fact that the right for a woman to get the treatment she needs is imperiled if not impossible in many states,” Biden said in a statement...
About two-thirds of U.S. adults oppose banning the use of mifepristone, or medication abortion, nationwide, according to a KFF poll conducted in February. About one-third would support a nationwide ban...
More than 6 million people [in the U.S.] have used mifepristone since 2000. Mifepristone blocks the hormone progesterone and primes the uterus to respond to the contraction-causing effect of a second drug, misoprostol. The two-drug regimen has been used to end a pregnancy through 10 weeks gestation...
Biden’s administration and drug manufacturers had warned that siding with abortion opponents in this case could [have] undermined the FDA’s drug approval process beyond the abortion context by inviting judges to second-guess the agency’s scientific judgments. The Democratic administration and New York-based Danco Laboratories, which makes mifepristone, argued that the drug is among the safest the FDA has ever approved."

--
Note: A massive relief and a genuine victory - this will preserve access to the medication used in 2/3rds of abortions last year, for at least another 2 years. (Probably minimum time it will take Republicans to get their next attempt before the Supreme Court.)
Still, with this, a sword that has been hanging over our heads for the last two years is gone. There will be a new one soon, but we just bought ourselves probably at least 2 years. The fight isn't over, but this is absolutely worth celebrating.
#edited like two hours after posting to add clarification that this decision isn't permanent#thanks to @queerrights for pointing out that wasn't clear#but it DOES buy us a couple years#and importantly it gives us two to three more years to fix this situation#because if democrats win the presidency and both houses of congress#(without fucking joe manchin there to singlehandedly stop them he's a fucking bastard)#then democrats WILL make abortion legal nationwide once again#abortion#abortion rights#bodily autonomy#reproductive rights#abortion is healthcare#united states#us politics#supreme court#us news#us supreme court#republicans#democrats#healthcare#public health#medicine#abortion pill#abortion access#abortion bans#current events#usa#pro choice#scotus#mifepristone

if you are in the US and are at risk of unwanted pregnancy, you should buy mifepristone immediately while it's still legal to mail so you can have it on hand just in case (it should keep for about 2 years). the future of this method of medication abortion is seriously at risk. it is very important that you are prepared for a worst case scenario
if this applies to you or a loved one go here and follow the instructions. it's $150 so if you are not at risk of unwanted pregnancy and are able, please consider helping others with the cost, or buying some to have on hand in case someone you know needs it in the future
edit: just wanted to add that I personally have already bought and received a provisional dose in case I know someone who needs one from this site so I can confirm that it is legit
#not trying to be super alarmist but this is especially important if you live in a state that is very hostile towards reproductive rights#please follow this court case as well. it is probable that the supreme court will make the situation even worse than the district courts#tell your friends and family#formerly ori/ons/belts#also i think if u just like. google the name of the site u will see other places reference that specific one#also this is currently legal in all 50 states BUT IT WILL NOT BE FOR LONG.#which is why i posted this lmfao

Jill Filipovic at Slate:
Should the very state of being pregnant place women in a subclass of citizen, vulnerable to criminal prosecution or civil penalties for behavior that would be perfectly legal from a nonpregnant person? Judging by their proposed legislation and various legal antics, the anti-abortion movement says: Yes. Pregnant women simply should not have the same rights as any other U.S. citizen. Take, for example, efforts to criminalize the crossing of state lines for abortion. There is a very, very long tradition in the U.S. of allowing people to travel out of state to access medical care, and it’s so deeply ingrained we barely think about it. Consider, for example, the businesswoman who lives in New Jersey but works in New York City and so goes to the dentist in midtown Manhattan, or the dad who lives on the Kansas side of Kansas City but takes his sick kid to a specialist at a hospital on the Missouri side. A great many Americans don’t think twice about crossing state lines for health care. Abortion opponents are trying to change that for one group of people: pregnant women.
Conservative legal groups are already drafting model legislation to prevent pregnant women from traveling for abortions by legally penalizing anyone who helps them, a strategy used by the state of Texas in one of its abortion bans, which allows anyone in the U.S. to sue those who assist women with abortions—and be rewarded with a bounty paid by the state. The architect of that Texas abortion bounty law was Jonathan Mitchell, an anti-abortion activist (and Donald Trump lawyer) who is currently representing a Texas man in his quest to probe into his ex-girlfriend’s abortion, which she allegedly sought outside of their home state. Mitchell filed a petition to learn the details of this woman’s abortion for, he says, a potential future lawsuit. But to be clear, the woman in question did absolutely nothing illegal: Traveling out of state for health care, including abortion, is not against the law in Texas or anywhere else. It’s just that Mitchell and other abortion opponents would like to change that—and are apparently happy to represent controlling (and, in another case Mitchell took on, allegedly abusive) men to do it.
They’re also happy to reclassify pregnant women as a kind of sub-citizen who, by simple virtue of their pregnancy status, are not entitled to the same legal freedoms and protections as anyone else. A Texas woman who goes to a Colorado abortion clinic is being treated differently from any nonpregnant person who travels for a medical procedure—and you can bet that this categorization of pregnant people as suspect, should they travel out of state, will lead to all sorts of investigations and abuses.
Take this hypothetical: Say the anti-abortion movement succeeds and makes it a crime to travel out of state for an abortion. Say a woman in Idaho (where abortion laws are so extreme, they have no exceptions for saving a woman’s health) travels to Washington state, where abortion is legal, and gets her hands on abortion-inducing drugs. Say she’s not pregnant. Say she takes the drugs anyway. Has she committed a crime? Or, to use a more likely legal model, say Texas makes it a crime to help a woman travel for an abortion, and a Texas woman goes to Colorado, gets abortion-inducing drugs, and takes them, despite not being pregnant. Is the friend who helped buy her plane ticket still liable? Presumably not: No pregnancy means no abortion, which means no violation of an abortion ban. But if the two women in these scenarios had been pregnant, the legal calculus would be entirely different.
Or to use a perhaps more realistic scenario: Mifepristone, an abortion-inducing drug, is also commonly used to treat Cushing’s syndrome, and researchers say it has tremendous potential to treat other illnesses, too, from various cancers to PTSD. Under an anti-abortion legal scheme, if a Texas woman with Cushing’s syndrome travels out of state, gets mifepristone, and takes it, she (or those who help her) would face potential legal consequences only if she’s pregnant. It’s her status as a pregnant woman—not the act of traveling or even taking an abortion-inducing drug—that is the problem. And generally, the law frowns on making a person’s status—rather than their actions—the basis of a crime or a lawsuit. That’s part of treating all people equally under the law, and offering all people the equal protection of it.
Preventing pregnant women from crossing into a state for a legal medical procedure isn’t the only way in which the anti-abortion movement is attempting to curtail basic rights and protections for anyone carrying a pregnancy. Earlier this year, abortion opponents argued before the Supreme Court that pregnant patients should be treated differently than nonpregnant ones in cases of serious medical emergencies—that doctors and other health workers should be permitted to give pregnant women a substandard level of care, and to essentially refuse to appropriately stabilize them. If a woman comes in and is very ill, she’s entitled to one standard of care; if she comes in and is very ill and pregnant, that standard of care is lower in states that criminalize abortion.
At issue in the Supreme Court case, a ruling in which is expected early this summer, is the Emergency Medical Treatment and Labor Act (EMTALA), a law initially written to prevent hospitals from dumping seriously ill patients who couldn’t pay. Pregnant women in particular were often coming into hospitals in labor, only to be refused care; there were stories of women birthing in hallways and cars. EMTALA says that any hospital receiving federal Medicaid dollars (which is most hospitals, both public and private) must provide lifesaving care to anyone who walks through their doors, regardless of their ability to pay. That means that hospitals have an obligation to stabilize ill patients. (If they don’t have the ability to appropriately stabilize a patient, they must move the patient to a facility that does.)
Jill Filipovic wrote in Slate the insidious trend of anti-abortion hardliners making pregnant people 2nd class citizens by enacting laws criminalizing access to out-of-state abortion services (this is also applicable to gender-affirming care).

I just came up with a brilliant analogy to teach my dad men the difference between Plan B and the abortion pill!
Plan B
Plan B prevents ovulation. The egg is never fertilized.
James Bond is pregnant. He's sitting in a Walmart parking lot in is Aston Martin, putting his recipt into his purse when he notices a baby waddling up to his car with a Glock.
As it goes to open the door, he hits the lock button and peels out of the parking lot. The baby shoots after him, putting a hole through the back window, but misses James Bond.
The Abortion Pill
The abortion pill is actually two pills. The first is Mifepristone, which causes the baby to stop growing. The second is Misoprostol, which sheds the lining of the uterus. This is rather painful and medically considered an abortion.
James Bond is pregnant. He's sitting in the Walmart parking lot in his Aston Martin, putting a recipt in his pocketbook. All of the sudden, his passenger door opens; a baby gets in, pointing a Glock at him; slams the door; and buckles its seatbelt.
"Drive," the baby says.
James Bond pretends to reach for the gear shift, but at the last second, he slams his hand on the eject button. The baby and the baby's seat go flying backward out of the car.
James Bond peels out of the parking lot. The baby scrambles to undo his seatbelt and sit up, and it shoots after the Aston Martin, hitting James Bond in the shoulder.
Miraculously, of course, the bullet misses the arteries and bones in the shoulder through the power of movie magic. James Bond goes home and heats a knife on the gas stove while he puts the groceries away one-handed. Then he cauterizes the wound.
Later, a friend messages him on Facebook, upset with him for ejecting the baby onto the pavement.
"The baby shot me," James Bond says.
"Well, that's what you get for ejecting a poor innocent baby," says his friend.
James Bond explains he ejected the baby because it was trying to jack his car and was pointing a gun at him.
His friend replies that if he didn't want his car to get stolen, he shouldn't have bought a car.
(James Bond knows for a fact his friend has lots of cars.)
Facebook gives the messages to the government, and they put James Bond on death row for ejecting the baby. After all, its his fault for buying a car in the first place.
Through the power of movie magic, James Bond turns his last meal, a peanut butter and jelly sandwich, into C4 and blows up the wall of his cell, miraculously escaping death.

If you search for the phrase “abortion pills” on the messaging service Telegram, an array of public channels and groups pop up. Some have names like “Buy Abortion Pills” or “Abortion pills Mifepristone Misoprostol” while others offer advice on symptoms and best practices “after the pregnancy comes out.” On May 3, a post on “ABORTION PILLS MARKET” included a photo of a blister pack labeled as abortion pills, alongside the caption, “We are legit.”
There are currently more than 200 public groups and channels on Telegram that explicitly mention selling abortion pills in their name or description, a WIRED investigation found. At the end of May, the last month for which we have complete data, 57 of the 211 groups we uncovered were active, with at least one message sent in that month.
Activity found on the platform related to selling abortion pills traces back to at least 2016, and many of the channels and groups cater to customers around the world. In the year since the US Supreme Court overturned Roe v. Wade in June 2022, though, there’s a new focus on marketing to people in the United States, according to WIRED’s review of roughly 47,000 public messages scraped from these channels. And in general, public activity on Telegram related to abortion pills has been exploding since last summer.
“Since its creation, Telegram has actively moderated harmful content including the sale of medications,” says Telegram spokesperson Remi Vaughn. “Telegram's moderators use a combination of proactive monitoring of public chats in addition to accepting user reports in order to remove content that breaches our terms of service.”
Shady drug sellers and scams are nothing new on digital platforms. A nearly universal experience of the early consumer internet, after all, was receiving spam emails claiming to offer penis enlargement pills. And in the decades since, dark web markets have fueled illegal distribution of drugs globally. Like other prescription drugs, though, abortifacients are legal in some countries but not others. Furthermore, in some places they can be prescribed for certain purposes but not others, leaving patients to potentially seek ways to fill in the gaps for their own care. In the US, access to reproductive care, including abortifacients, varies widely from state to state.
Despite the clear uptick in activity on Telegram related to abortion pills, researchers say that they don’t see evidence of a massive new movement to illegally sell abortifacients to Americans. Kat Green, an abortion access researcher and founder of the online data analysis platform Endora, says that illegal sales of abortifacients, and corresponding questions about legitimacy and safety, aren’t currently central topics in US abortion access work. In part, this is likely because it’s still legal in many US states for patients to get abortion pills by mail. And prescribed use of these pills, also known as medication abortion, is markedly on the rise in the US. But as new and pending legal challenges threaten to further curtail access, illicit sales could eventually expand.
Analysis of frequently used phrases in the Telegram message trove WIRED collected shows that a large number of these groups and channels don’t just claim to sell abortion pills. Phrases like “weight loss,” “muscle mass,” and “erection pill” were among the 10 most popular two-word phrases that appeared in the data set. And thousands of additional messages mentioned “benzos,” “painkillers,” “Xanax,” “weed,” “coke,” and “guns.” In all, at least a quarter of the channels appear to be hawking more than just abortifacients.
Hundreds of messages from the data that contained pricing information indicate that the average cost of purchasing a purported pack of abortion pills on Telegram is currently $135.
WIRED’s investigation also indicates that the abortion pill ecosystem on Telegram is likely a small world. Analysis of the members and administrators who send messages in the groups and channels shows that many of the accounts are likely controlled by the same individuals. For example, a user going by the name Dr. Pooja Gupta has sent 1,500 messages across nine channels or groups advertising the sale of abortion pills. Dr. Pooja uses a WhatsApp number that is referenced by administrators in 14 additional channels. And some of them use similar names like Doctor Jain and Doctor Reenu. Many of these messages also referenced the same website.
After joining several of Dr. Pooja Gupta’s channels, WIRED reporters received a private Telegram message from a user known as Manisha Gupta offering medication abortion for $90. When WIRED reporters expressed interest in making a purchase, a person prepared the order and sent an image showing a blister pack of pills, and an envelope with that day's date as well as the address WIRED provided for shipment. The return address written on the envelope was a location in Mumbai, India.
Still messaging on Telegram, a person then sent account information for Punjab National Bank and directed WIRED to submit payment through a service called Remitly. WIRED reporters did not complete the transaction. When asked whether they have had more US-based customers in recent months, the person said, “since new laws I am send to America much more.”
Some groups on Telegram have US-specific names or descriptions, like “Abortion Pills in Republican States,” but most have more generic names and claim to deliver to dozens of countries. For instance, one of the largest and most active channels in the data set dates from August 2021 and is apparently specifically geared toward delivering abortion pills to Dubai, Kuwait, Qatar, and the Philippines—all countries where legal access to abortion is restricted.
Last June, researchers from the security firm DarkOwl noticed a sharp increase in discussions on the dark web about connecting abortion-seekers in the US with abortifacients and other resources. Some vendors that already sold illegal drugs said they would begin selling medication abortion as well. At the time, though, the researchers said that they didn’t actually see abortion pills widely available for sale on most dark web markets, but that “they are available for purchase via threads in discussion forums, as well as classified-style advertisements on transient paste services.”
Ian Gray, director of analysis and research at the security firm Flashpoint, says that turning points like the Covid-19 pandemic or the fall of Roe for the US can spark trends in digital scams and illicit online sales. But a survey Gray conducted for WIRED of dark web advertising targeted at the US over the last year did not reveal a dramatic spike in content related to abortifacients.
“At a high level, it's difficult to identify a significant increase in chatter related to abortion pills due to Roe v Wade being overturned last year,” Gray says. He notes, though, that “there are a limited number of posts within the past year in marketplaces, which may indicate demand. Most posts, at least on Twitter and some within Telegram, are in Brazilian Portuguese, likely due to a ban on abortion pills.”
As with many medical procedures, the stakes are extremely high in medication abortion. But the patchwork of laws and access in the US could make the landscape particularly fraught for patients in need who may eventually turn to illicit markets out of desperation.
