Hate speeches, personal remarks by leaders not good for healthy democracy: Rajnath Singh

PATNA/NEW DELHI: Concerned over the deteriorating political discourse in the country, senior BJP leader and union minister Rajnath Singh has said elections shouldn’t be fought and won by spreading hatred among people and there should be no place for “bitterness and acidic remarks” in a healthy democracy. He also expressed confidence that the NDA will win the Bihar elections and asserted that the exit of the Chirag Paswan-led LJP won’t impact the poll prospects of the ruling alliance. Singh also rejected allegations of any hidden understanding with Paswan’s party, saying the BJP believes in fair politics and doesn’t play with the trust of the people. “Chirag and his party would have their own reasons for leaving the alliance. But I don’t think LJP would have any impact on the ruling BJP-JD(U) alliance in Bihar assembly polls. Our alliance will win the elections and form the next government in the state,” he said. When pointed out that Paswan in his election campaign was only attacking Chief Minister Nitish Kumar and not the BJP, Singh said,”Personal animosity is not good for healthy politics. It should be avoided and I myself also don’t practice such politics.” The former BJP president also termed as baseless the allegations of a hidden understanding between the BJP and the LJP. “BJP believes in fair politics and doesn’t play with the trust of the people,” he said. Expressing concern over hate speeches and personal remarks being made against each other by leaders of all political parties, Singh said there is no place for hatred in healthy politics and elections should not be contested and won by spreading hatred among people. “I myself never resorted to such tactics,” he said. “Bitterness, acidic remarks and personal attacks against each other in speeches should be avoided. It is not good for a healthy democracy. Rather, there should be discussion, debates and even arguments on issues of public interest,” he said. Singh, who has addressed more than a dozen political rallies in Bihar and is scheduled to address many rallies in the coming days, said the response he witnessed in his public meetings is highly indicative that the BJP-JD(U) alliance will win the elections in the state. “The alliance, in the Bihar assembly polls, will reap the benefits of effective implementation of the Central government’s welfare schemes. At the same time the state government under Nitish Kumar has also performed well and the people will vote for it,” he said. Singh, the seniormost minister in the central government, said the Modi dispensation “ended the crisis of credibility” in politics. “Modi government delivered on its promises and its track record establishes that. On the other hand the opposition, whether in Bihar or at the national level, lacks credibility as it always failed to fulfil its commitments,” he said. On Tejaswi Yadav’s rallies attracting huge crowds, Singh said the rallies of BJP leaders are also being attended by people in large numbers. “You yourself saw attendance in my rallies and you must have seen the massive crowds in Prime Minister Modi’s rallies. Public meetings organised by BJP are attracting huge crowds. It will be unfair to exaggerate about public meetings of one party and its leaders,” he said. Asked if the NDA was shrinking as some of its oldest constituents have left the ruling alliance, Singh said the alliance is still a “big united family”. Without naming any party, Singh said, “Those who left NDA moved out of the alliance for their respective reasons. In politics you never know when anyone can become your ally”. On whether the NDA’s doors were still open for its erstwhile allies, he said, “The NDA’s doors are always open for those who want to contribute in the development of India. But we cannot compromise on our development agenda and the core issues of our ideology”. Singh has twice been the BJP president and the party contested two Lok Sabha elections “in 2009 and in 2014” when he was at the helm. Currently the Union Defence Minister, Singh was Home Minister in the previous NDA government.

My Rant...
I rarely come on here anymore but I just wanted to say my piece on this infuriating election and the way Britain is run.
I’m not sorry and I have a lot to say so bear with me.
This all started because of the referendum. A referendum which showed up just how discordant and split the country truly is. I do not agree with the result and am very upset we are leaving the EU.
All I have heard though since the results came out, have been politicians calling it the “will of the people”. Ok. A small majority voted us out. But that’s right. A SMALL majority.
And that was only of the people who actually voted.
There a many of those who couldn’t vote (because of age restrictions) or wouldn’t vote for whatever reasons they told themselves, and those who did vote for remain, who did not want to leave the EU. In my books that far out numbers the people who voted leave.
It is not the “will of the people” if the majority of the country didn’t vote for it. That is a small sector, just like a lot of the politics in this country has been about lining the pockets of the wealthy, the 5% of our population who do anything they can to better their own lives and damn the consequences it has on others.
I wish people were more generous and thoughtful. More considerate of the people they share their lives with. Believe it or not your life doesn’t just affect your own. You come into contact with countless people every time you go to work, or school, or even just go for a walk. How do you know that the smile you gave that one random person didn’t make their day? Because it could have. People’s actions have an impact in the smallest ways and the biggest. Some are just more noticeable.
Especially by those who hold power in parliament. The term “holding power” is distasteful and it’s so controlling. But that’s unfortunately the society we live in. Where there will always be those who think just because they are well off or own a company think they have more rights to things like education or healthcare than the rest of us.
The whole, “private versus state” thing is ridiculous divide and actually gets in the way of education. Parents who say “I’m paying for a better education for my child.” are actually saying “I’m paying for white boards or more resources to be pumped into the school.” That’s not an education. That just fancy toys. An education is when you learn something. When you actually come away from that day of sitting in classrooms inspired by something a teacher said or what you read or something that proved to you, yes you can do that thing you were struggling with. That won’t happen by throwing more money at it and shoving all kids into the same way of teaching and testing. The best teachers I had were ones who had a dialogue with the students. Where we were able to question the text books and engage with it ourselves. OK I was a shy student who didn’t feel confident enough to share my views and this post is hard for me to make but here I am.
Now onto the election and the person who calls herself the leader of Britain.
She stands there talking about working together and providing stability, when the only thing her government has done, has separated this country and made so many u-turns I’m surprised parliament hasn’t fallen down into the Thames. She hasn’t wanted to engage or debate or trust the public with the truth.
She keeps hiding behind statements and the party line, just like so many politicians have before. Now I don’t agree with some things Corbyn says either. Like his views on Brexit but we aren’t voting for one person we are voting for the party.
May is a poor example of a leader and much of what she says does not stack up. Alot of wwhat the party stands for is truly shocking and is saddening to see how it is still in today’s politics. Serving the interests of the better off in a hope that it will magically get the population more money is not a stable or even workable frame of economics. It doesn’t happen like that. Hasn’t happened. The rich get richer and hell to the rest.
The media is just as guilty for misleading people. And I have never been more ashamed of the BBC. The national broadcaster and they keep hushed up on what the conservatives are doing but any other party and they line them up in the firing line.
Teresa May says she is doing what she is doing for the people.
To which I say to her, really?
Look around.
Are the children who’s parents can’t afford to get them new school uniform or lunches because you keep cutting their benefits and rising taxes being looked after?
Are the elderly in dire need of care and attention getting the support they need?
Are those ill and ailing people in hospitals who in recent years have had to wait the longest time for care which should be readily available feeling like they are being cared for at all?
Are the people who provide these services getting the resources they need?
Not from what I have seen, read or heard.
How can she stand there and say her plans are stable and providing a future to protect us when she herself has voted on issues to block progression, to block support getting to those who need it.
The facts are out there that she doesn’t support the lgbtq community, that she doesn’t support our elderly, that she doesn’t support our children. So how can she stand in front of the country and promise to look after ‘the people’ when she refuses to acknowledge a majority of the population.
And when she does in her speeches, it’s to use as a point against labour. She brings up hashed old arguments from Camerons government, from Blairs government.
OK labour hasn’t always been great and there are still issues within the party that need to be addressed. But I have never felt a more relieving breath of fresh air than when I first heard Corbyn speak. For once there wasn’t a politician who said, the Tories do this, the tories do that. He spoke about what the issues were and how they would be addressed.
Like I said before there are some things I do not agree with him on but when will you ever agree with some one on every single thing.
I just want May to take a step back and really think in what way is she representative of anyone who has any loving, generosity in their hearts, who would put others before themselves . Leaving the EU is not progressive. Taking money away is not progressive. Excluding members of our society is not progressive.
All these stupid political borders and separations we have on this planet.
A show I watch, that I implore you all to watch, Sense8 is one of the most beautiful and uplifting pieces of drama I have ever seen on screen. It has representation and diversity. And in its second season has a really powerful speech about who some one is.
It says “labels are the opposite of understanding. [….]
Who am I? Do you mean where I’m from? What I one day might become? What I do? What I’ve done? What I dream? Do you mean … what you see or what I’ve seen? What I fear or what I dream? Do you mean who I love? Do you mean who I’ve lost? Who am I?
I guess who I am is exactly the same as who you are. Not better than, not less than. Because there is no one who has been or will ever be exactly the same as either you or me.”
We are one planet, one species which has to live together. If our governments truly wanted the best for us there would be no restrictions placed on minorities or the freedom of movement.
If you look at someone and think they don’t belong because they are different, than you are one of the worst types of people.
Difference is what makes humans so amazingly beautiful. And our capacity to love and embrace that difference is breathtaking.
A human being is a human being whether they are black, asian, white, gay, bi, straight, trans, female, male and all other variations.
If you let hatred in, you’ve already lost. If you let disrespect in, why should someone respect you?
Everyone should be free to be who they are, wherever they are.
Our governments need to change. They need to change to reflect the people who live now.
So when Teresa May stands up and opens her mouth, how can she possibly stand there and say she is working for the people when nothing she has done reflects that.
I don’t have any impact on many people’s lives and I doubt this will reach anyone beyond this space, but to anyone who will read this, there needs to be a way we can make a difference. Differences make us who we are and fuel a progressive society.
The whole Brexit disaster shouldn’t have happened. After campaigning for Scotland to stay, united, stronger together it was ridiculous that the next thing to happen was to shut the EU out. I’m not surprised Scotland wants to leave England again.
The whole point of the EU was to bring peace between our countries after the horrific world wars. Look at our world today. We are breaking apart at the seams. Yes the wars in Iraq and Syria predate Brexit but we don’t have to look far to know who to blame for that. If anything this is a time to work closer together not apart. So again how can Teresa May say she will be the one to bring stability to the country when it was her party that tore it apart.
So go and vote. Use that vote that so many have fought for in our past. Use the privilege of the vote this country has to make a stand against those who want to silence us.
We are better together. We only have to prove it.

A Rose by Any Other Name – or – It’s not Wrong it’s just Different

The bench was an active inquisitor in the Thryv v. Click-to-Call oral arguments held Dec. 9, 2020 before the U.S. Supreme Court.  This is the third post-AIA Supreme Court case focusing on the no-appeal provision of 35 U.8.C. § 314(d) (“determination by the Director whether to institute an inter partes review under this section shall be final and nonappealable”).   [TRANSCRIPT]
Oral arguments focused on two major issues: (1) the extent that SAS limited Cuozzo; and (2) the importance of the time-bar since there are alternative fora for judging patentability and the patent is invalid anyway.
The first point — SAS limiting Cuozzo: In SAS (2018), Justice Gorsuch explained the holding in Cuozzo (2018) as follows:
Cuozzo concluded that § 314(d) precludes judicial review only of the Director’s “initial determination” under § 314(a) that “there is a ‘reasonable likelihood’ that the claims are unpatentable on the grounds asserted.
SAS. To be clear, if the no-appeal statute’s sole function is to block appeal of the reasonable-likelihood decision, then the decision is foreclosed in favor of the patentee (allowing appeal of the time-bar question).  However, as I suggested in a prior essay, I believe that Justice Gorsuch SAS opinion overstated Cuozzo’s holding. I suspect this was an intentional shading of Cuozzo made possible because of 5-4 split.  A smaller majority allows for a more extreme opinion.
This issue was ripe for discussion in the oral arguments with Thryv’s counsel Adam Charnes attempting to explain that Gorsuch’s SAS statement isn’t “wrong” per se, it just isn’t complete.  Charnes would obviously rather not require overturning of the Supreme Court’s most recent case on the subject in order to win.
JUSTICE GINSBURG: What do you do with the sentence in this Court’s SAS decision that says 314(d) precludes judicial review only of the Board’s initial determination under 314(a) that there is a reasonable likelihood that the claims are unpatentable?
MR. CHARNES: We think that that’s not a complete description of Cuozzo . . . .
JUSTICE GINSBURG: So you think that that was just a wrong sentence?
MR. CHARNES: I wouldn’t say it was wrong. . . . What I’d say is that the Court had no need to describe Cuozzo more broadly … because that was not the factual circumstance of SAS. …
JUSTICE KAVANAUGH: I think you are saying “it’s wrong,” to pick up on Justice Ginsburg’s question, at least the use of the word “only.”
MR. CHARNES: I think it’s not a complete description. I think that’s not the only basis that this Court explained in Cuozzo. I think that’s — that’s a fair point.
Justice Kavanaugh is the only new member of the court since SAS and his vote is likely critical to the outcome in this case. However, the most likely swing vote is Chief Justice Roberts.
The Gov’t attorney, supporting Thryv in its no-appeal argument and agreed that the SAS statement is wrong.
MR. ELLIS: (Representing the U.S. Gov’t and supporting the no-appeal argument)I do think that sentence is wrong, and I think it’s incomplete. . . . Cuozzo concluded more than that. And I think, if you look at the decision, you’ll see that.
The wrongness of Justice Gorsuch’s statement is potentially twofold: (1) it is clearly an unduly narrow statement of the holding in Cuozzo; and (2) it might also be an incorrect interpretation of the statute.  For me, this raises the interesting esoteric question about precedent and primary sources.  What is the precedential and stare decisis role of the Supreme Court’s (mis)description of its prior precedent.  Is the (mis)description now the leading precedent, or is it merely a secondary source helpful in interpreting the original decision.
Mr. Geyser has the easier case on these points — arguing that the patentee clearly wins under SAS, and should also win under Cuozzo.
MR. GEYSER: (Arguing for the patentee) We’re simply reading 314(d) to say exactly what this Court in SAS said it meant, which is it is limited to only the initial patentability threshold in 314(a).
My friend from the government now concedes that they think that [SAS] was wrong. I don’t believe they’ve asked this Court to overturn SAS. We don’t think that the Court was wrong.
JUSTICE KAGAN: Well, it’s not a question of overturning. It’s just — I think what they were saying is that SAS dealt with one issue in which it was unnecessary to recite Cuozzo’s full test, but Cuozzo has a broader test than SAS quoted.
MR. GEYSER: Well, to be very clear, I think that we win under Cuozzo as well, but I don’t think that the reasoning in that statement, which is a very plain statement in SAS, can be limited in that way.
[The “only” language in SAS] is an absolute part of the core holding of the case in rejecting what the government eventually framed as their primary submission in SAS.
The substantive issue on appeal in Thryv was the PTO’s interpretation of the time bar in § 315(b).  Although a lawsuit had been filed and served, the PTAB found that the time-bar was not triggered because that lawsuit had been dismissed without prejudice.  On appeal, the Federal Circuit found that the PTAB had misinterpreted the statute — holding that dismissal does not annul the time-bar.
The Patent Challenger and Government both argue that the a time-bar decision by the PTAB is not appealable. Justice Gorsuch pushed that question in an extreme example, and Charnes held his ground on no appeal:
JUSTICE GORSUCH: Let’s just hypothesize that someone has tried to undo this patent four times or maybe even more in a court of law, failed for various reasons every single time, and then comes to the director of patents, who has a political mission, perhaps, to kill patents, let’s just say. And it is clearly time-barred under the statute. Let’s just hypothesize that. And yet, the director goes ahead and does it anyway. Under your submission to the Court, I believe you’re saying that is a shenanigan this Court cannot review.
MR. CHARNES: It is correct that our submission is that’s not reviewable. The time bar is not reviewable.
JUSTICE GORSUCH: All right. The hypothesis, there’s no good faith, okay? The director of patent has a political desire for whatever reason to destroy this patent and many others. . . . In your circumstance, you’re telling the Court there’s no review of that decision, I believe, or maybe it’s not a shenanigan even in your — your view perhaps.
MR. CHARNES: Well, I think there is — there is no review under — under 314(d). It may be that it’s an appropriate case for mandamus relief if the circumstances are as egregious as you suggest in your hypothetical. . . .
JUSTICE GORSUCH: So we’re going to just channel all these cases to mandamus? Is that — is that the upshot of your position?
MR. CHARNES: No, because mandamus is a rare relief. I mean, it would only be reserved for really egregious circumstances like your hypothetical.
JUSTICE GORSUCH: If the institution decision is not reviewable at all, how would it be mandamus-able? . . .
Mr. Ellis from the SG’s office added his two-cents with an argument along the lines of “you shouldn’t care about privacy if you have nothing to hide.”  In this case, his argument was that we shouldn’t worry since “you’re going to get review, judicial review of the patentability” question.
MR. ELLIS: What was open for review was that patentability analysis. Now Respondent opted not to challenge that patentability analysis. But, if it had merit, that would be judicially reviewable and then the patent wouldn’t be canceled.
This discussion takes us to the second general topic for discussion — is the time-bar a big deal.  In Cuozzo and in oral arguments here, the justices appeared reluctant to bar appeals of important issues such as due process violations and statutes of limitations.
CHIEF JUSTICE ROBERTS: Well, but, I mean, I don’t think it’s what we were fighting over at Yorktown. I mean, it���s just a question of whether — (Laughter.)
CHIEF JUSTICE ROBERTS: — as you said, the ultimate question, the ultimate issue that affects the property rights in a patent, it’s going to be reached. It’s just a question of whether you use one procedure or another. . . .
CHIEF JUSTICE ROBERTS: As I understand [Mr. Charnes] answer, at least part of it is more or less that this is small potatoes. It’s just about timing for — for the institution of the matter and that the basic issue of the patent validity is something you’re going to get to. You have a number of avenues to get to it.
The basic idea here is that even if the petition is time-barred, patentability could be raised in an ex parte reexamination or in a district court declaratory judgment challenge, or by a separate petitioner who was not time-barred:
CHIEF JUSTICE ROBERTS: [speaking about ex parte reexam] Well, it’s different, I’ll give you that, but, I mean, it’s focused on the same ultimate question. . . .
JUSTICE KAGAN: But if it’s not with this Petitioner, it can be another Petitioner. . . And, indeed, even when a petitioner drops out under this statute, the Board can keep the proceeding going without the petitioner. So the fact that it is this Petitioner seems utterly unimportant under this statute.
Justice Ginsburg appeared to recognize that the time-bar is important:
JUSTICE GINSBURG: In Cuozzo, it was a particularity requirement, and that was described as a minor statutory technicality. But, here, we’re not dealing with a minor statutory technicality; we’re dealing with a time bar.
Justice Gorsuch provided a softball for the patentee’s counsel to answer:
JUSTICE GORSUCH: Well, I guess the question, though, that we’re struggling with is so what’s the big deal? If you’re stuck going to ex parte review anyway, why should we care? What’s your answer to that?
MR. GEYSER: … because inter partes review is a very different process than ex parte reexamination.
JUSTICE GORSUCH: Spell that out. Spell that out. Why?
MR. GEYSER: It’s because instead of having an opportunity for a single response, truncated discovery, you’re in an adversarial proceeding. You’re before a panel of three PTAB judges who might give you an hour oral hearing.
You get a long, iterative process with a talented patent examiner who can say this is what I think is wrong, and then you have lots of opportunities to show them exactly why that concern is unfounded.
And, again, the PTAB is reversed a fourth of the time. It’s not like this process … is perfect or without error. . . .
JUSTICE KAGAN: It just doesn’t seem as though this petitioner makes all that much difference.
MR. GEYSER: Well, Congress felt otherwise in this heavily negotiated process that produced 315(b) as a fundamental safeguard for patents.
JUSTICE GORSUCH:  Why does it matter whether it’s one petitioner or another petitioner?
MR. GEYSER: To make sure that you don’t have someone gaming the system . . .
MR. GEYSER: And [Congress] understood that this [time-bar] is a significant protection for patent owners. And it’s a significant way to divide the authority between the courts on the one hand and the agency on the other.
There is a more detailed statutory interpretation question here — The no-appeal provision is directed to institution determinations “under this section” — i.e., Section 314, and the time-bar is found under Section 315 of the Code.  Under this “chapter”
JUSTICE KAVANAUGH: But “under this chapter” is used in the same provision [314(b)]. If we had “under this chapter” here [in 314(d)], that would solve your problem.
The petitioners here do a nice job of overcoming that argument and so I don’t see it as the basis for the decision, although the court may throw it in as an ancillary matter.
In the end, the case comes down to a strong presumption that agency decisions are subject to appeal in Federal Court. And, the question is whether congress did enough in the statute to overcome that presumption in this case.  Patentee’s counsel (who is aware of many cases) ended his arguments with an appeal to precedent and history:
MR. GEYSER:I would submit that I’m not aware of any case that this Court has ever decided that would find Article III review cut off entirely based on language as indirect as this.
We can look for a decision in this case in the Spring of 2020.  I am expecting a split opinion with the majority affirming — holding that the no-appeal provision has no force in this particular case.

The new structure which is part of a whole new complex will open in 2019. I can’t wait!!!

Every time that Scary Clown 45 does his daily dose of fucking everything up, call Fox news.  Calling your congressmen and protesting will have to continue, of course but it seems he mostly listens to Fox. ***** A personal note: I heard a comedian the other day talking about jerks in all parts of our lives. Whether it be church, work, school, concerts, an AA meeting or whatever there is always an asshole in the mix to ruin stuff. This really resonated with me because I have seen a situation lately that perfectly illustrates this. A local store has a department with 3 managers. Manager #1 keeps hiring in his friends that mostly create their own schedules and do not often break a sweat. Manager #2 has been there a while and things run pretty smooth and fair when they run the day. Manager #3 is new to the position and often seems like they do not know what the fuck is going on and it was recently learned that this one has been backstabbing #2 so much that # 2 was fired. Now, we can’t know, of course, the reason for the firing but it just shows that a perfectly nice place to work and shop with a company one can believe in can go all wrong because of one or two bad apples. Manager #2 who is also battling illness (so does not often have the strength to fight back) has lost a career and many employees who respect them are now stuck working with people they know will run the place into the ground or having to find another job. I have seen a few similar situations thru the years and of course, asshole in chief in D.C. is like the all time perfect example of this but why can’t we weed out the jerks?

Farah Fath (Mimi Lockhart) is back. Sheila, Shawn and Belle will show up soon.  Kyle Lowder who used to play Brady will return as another character. There is a rumor that Allison Sweeney (Sami) will swing in for a bit and will she be pregnant with Rafe’s baby? I am betting so since Hope just mentioned something about Raif not having any kids.

The supporter held up a Trump 2020 sign. My son chuckled, “At least he bought a ticket.”

I can’t help but think of our ‘well meaning’ Christian folk trying to convert the Native Americans back in the day. As well as leverage for scary clown’s wall, are they trying to fill these children’s heads with their own propaganda while they are in foster care or residing in the white man’s warehouse? **When will the loyalists realize that a wall cannot be built? I think many of us feel helpless as that sinking feeling we all had on election night has come to the point we all feared.** The Red Cross has not even been allowed in to these FOR PROFIT facilities. Protesters are staying on the case of Krisjen Nielsen. The administration and their defenders have been so flippant about the whole thing especially Corey (womp, womp) Lewandowski.** It costs the government over twice as much to house the kids without their parents.** Melania visited the kids and wore a jacket which read ‘I really don’t care, Do you?’ This started a whole new mess. I thought of those Turpin monster parents. Why on earth does anyone want to put kids in cages?  Does it make someone powerful to torture children?
***** June ended with about 700 protests for the kids in cages. Family’s Belong Together marches were overflowing in the heat with inspiring messages and a lot of heart. I was so proud to be there.

Many do agree with this one for they feel there is not equal punishment for nations when it comes to human rights.** A lawsuit was filed on April 23 alleging kids were held down and injected to render them helpless and keep them calm.**It seems that we should leave the immigrants alone and enforce swift, harsh penalties for those who hire undocumented workers.
