I want you to understand the cause and effect of what has led to what is going on in texas at least re: abortion laws.
First off let me clarify: Roe v Wade was not law...yet. When you see a ___ v ___, that is an opinion. Not in the sense you may think. It's an opinion decided through litigation which means it's a powerful opinion that has been hammered out through the judicial process of a lawsuit being drawn up, and worked out in court. It could be a local, state, or federal court. Typically the ones that are most significant are federal, or ones that have come before the US Supreme Court - either because it is the federal government that is being challenged, the defendant petitions to move it to federal, or that the case has been elevated through appeals.
There are particular circumstances that determine if a case can go federal level:
"Federal court jurisdiction, by contrast, is limited to the types of cases listed in the Constitution and specifically provided for by Congress. For the most part, federal courts only hear:
Cases in which the United States is a party;
Cases involving violations of the U.S. Constitution or federal laws (under federal-question jurisdiction);
Cases between citizens of different states if the amount in controversy exceeds $75,000 (under diversity jurisdiction); and
Bankruptcy, copyright, patent, and maritime law cases.
In some cases, both federal and state courts have jurisdiction. This allows parties to choose whether to go to state court or to federal court."
Federal courts may hear cases concerning state laws if the issue is whether the state law violates the federal Constitution.
In the case of Roe v Wade, the attorney's filed to the Supreme Court since the argument was that the state law was a violation of a federal law - specifically the 14th amendment assertion of right to privacy. That is what determines the jurisdiction in this case.
RvW was decided in 1973 with a 7-2 ruling in favor of Roe's right to privacy and ultimately right to choose how to treated her pregnancy. Why hasn't it been turned into law? Obvious reasons over the years include what party is in power in executive, congressional, or even judicial circles. Right now though we have a D in the executive and congress, but something many are overlooking is the critically important and understates judicial branch - which holds significant changes Trump installed.
Also regarding congressional, though there is a stronger hold on the house (even with 3 vacancies), the senate is just barely D majority with 50 R, 48 D and 2 independent as shown in the charts below. The two Independent Senators, Bernie Sanders of Vermont and Angus King of Maine, caucus with the Democrats which brings it 50/50 and the US VP - Harris (D) in this case - is the President of the senate and ultimately serves as a tie breaker for votes as well as situations like this even divide of party members. Were the VP a republican than republicans would still have a senate majority.
I will dive more into what's going on with the senate and why even with a D majority it isn't where it needs to be as it's a bit less straight forward.
So how the hell are abortion rights being challenged? Why aren't the all powerful democrats doing anything?!
Well, they are and have been doing a lot - and I urge you in moments when you are frustrated by feeling as though "dems aren't doing anything" to dig deeper to understand how our government operates. It's very clear there is a poor comprehension of our civics system by the general population which is why I'm using this as an opportunity to not only inform but also to learn more myself. I was educated primarily in Texas public education system. I was privileged enough to have decent teachers, but there is still much to learn. I'm doing research as I write this. I've already learned a lot. Come learn with me!

So with dem control of executive and congressional branch, all that is left is judicial.

Trump also had a major influence on the nation’s highest court. The three Supreme Court justices he appointed – Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – are the most by any president since Ronald Reagan (who appointed four) and the most by any one-term president since Herbert Hoover
Donald Trump has appointed and the Senate has confirmed 220 Article III federal judges through November 1, 2020, his fourth year in office.
The average number of federal judges appointed by a president through November 1 of their fourth year in office is 200.
Judges are supposed to be neutral impartial parties who use only what is presented in court and through the judicial process (which involves looking at current standing laws) to determine their decisions in court instead of using their personal opinion or political sway to inform them. However, as we saw all too often, trump was not interested in impartiality. He was interested in control, asserting his own personal opinion, even on occasion insisting he himself as president had more control than the constitution actually allows. So with that conflict and the fact he installed so many judges really makes huge impact on the judicial branch of our government. Since every branch is supposed to be fair and equal this causes a lot of road block when one branch is neither fair nor equal. You can't simply use the other two the gain up on the third - though in this case that would be convenient for dems, it would be much less convenient when the parties were reversed. It's also important to acknowledge the reality that D are not always impartial either - which again we will get to after judicial chat - nor are all R unfair. This can be a hard pill to swallow, even for me. Reality is not always easy to accept.
So of course appointments made by trump, of which there were many, can not be trusted to actually be acting in good faith, but in favor of personal or political interests (which also often come down to personal interest of a financial persuasion). When judges are not impartial, they may make decisions that ultimately contradict what was presented in court or what the law of the land says. Typically if a hearing with the Senate Judiciary Committee (you can see an example here of the first day of Amy Comey Barrett's hearing day 1/3) determines that there is a conflict of interest or that they are illgitimate, then ideally a judge will be blocked from appointment. This clearly also depends on the makeup and impartiality of the Senate and thus the Committee. The Committee will debate and vote on whether or not to confirm every nomination made by a President. (it used to require 3/5 of the senate or 60 votes but since 2017 only requires a "simple majority" or 51 votes for confirmation)
I want to take a quick aside here and go a little philosophical in understanding judicial impartiality, because I hope it will help you have some perspective on how it's an inherently difficult matter. Ultimately the court's impartiality comes down to checks/balances and faith. Not religious faith, but faith in humanity and honesty. Trusting that there is no hidden motive or lies or manipulation at play. We tend to have to rely heavily on the checks and balances part since faith in humanity can be easily manipulated with lobbying and politicians eagerness to look bipartisan for popularity in elections (appealing as more bipartisan is considered a way of winning over more votes like centrists and those just left and right of it). Checks and balances allows oversight of the 3 branches over one another and attempting to keep the scales balanced in order to prevent any one branch being too powerful and ultimately to avoid the US being something more like a monarchy - which was a primary goal at the time of forming the constitution and government since it is what we had fought to escape in the first place.
"So judges aren't allowed their 1st amendment rights?!"
Humans are merely humans no matter what title they have or role they play and humans are inherently flawed and partial. Nobody is perfect and some make mistakes as well as bad faith decisions for ulterior motives (could be a matter of loyalty to well funded lobbyists or even general unchecked and ultimately supported ignorance or a power grab). After and throughout checks and balances, that is where the faith part comes in that we hope we can trust judges to put their personal opinion aside and go with what the evidence presented in court and the law and super precedents tell them. We trust the Committee to do their due diligence in researching nominees and asking them tough questions. Realistically everyone can and likely will have some kind of opinion on any major issue, so it is not that anyone expects a justice to not have a personal opinion, only that they not use it to determine their decision in court. So, say i was a judge looking at a defendant accused of a civil rights infringement and i personally felt that they were guilty but there was no or not enough "valid" evidence to prove it, I couldn't assert they are guilty just based off my own opinion. I would have to depend on the evidence shown in court proving that it has infringed on precedents or existing law.

"BLAHBLAHBLAH WHAT ABOUT THE SUPREME COURT"
It would be too tumultuous for me to dig into each of the 3 Supreme Court judge appointments by trump in regards to current issues around Roe v Wade, so I'm going to focus on one that is likely most relevant in particular: Amy Coney Barrett. Barrett was an appointment made when Ruth Bader Ginsburg's passing caused a vacancy in the court. (Why didn't she retire under Obama? The Senate was GOP controlled which made the odds of a pro-choice appointment being confirmed low). RGB was well known for being a strong advocate for the right to choose and for a long time was a stronghold in the court to ensure Roe v Wade was upheld. Since trump wouldn't want to lose too many votes from women and allies to women, he made the clear choice to appoint a woman which is what i would call performative in the case that though Barrett is a woman she does not particularly stand on the side of women's rights.
In day two of Barrett's confirmation hearing, Senator Klobuchar honed in on Barrett's opinions regarding Roe v Wade - especially as to whether it is considered what is called a "super precedent", an important matter when talking about codification. Klobuchar makes it clear that Barrett has said she finds Brown v BoE to be a super precedent despite the Supreme Court never impressing that opinion, but refuses to consider Roe v Wade a super precedent despite that being a Supreme Court opinion. Barrett's argument is that "scholarly literature" she has read has asserted it is not a super precedent because calls for its overrule has never ceased, where as cases such as Brown v Board "nobody questions anymore". Klobuchar digs in again asking if US v Virginia Military is a "super precedent" and Barrett refuses to answer - or as she phrases it "grade" - because it wasn't one of the cases Barrett spoke about in an article she had written.
After Klobuchar asked Barrett if Roe v Wade is a super precedent, Barrett asked Klobuchar how the Senator defines a super precedent. Reasonably so, Klobuchar - who is a senator and not a judge - scoffs and puts that responsibility back on Barrett who was nominated to be a Supreme Court judge. Barrett obliges and asserts a definition that she uses is of (supposedly not conservative) ONE scholarly opinion which depends on a case being "so well settle that no political actors and no people seriously push to overrule"
In a scholarly opinion in 2006 by Michael J Gerhardt at University of North Carolina School of Law defined a super precedent in many ways one being "decisions whose correctness is no longer a viable issue for courts to decide; it is no longer a matter on which courts will expend their limited resources."
However:
in the Roberts hearings, Charles Fried, a prominent conservative legal scholar at Harvard, agreed explicitly that Roe was a superprecedent. As solicitor general under President Ronald Reagan, Mr. Fried had asked the court to overturn Roe. But testifying on behalf of Judge Roberts, he said that Roe had become a super-duper precedent that would not and should not be overturned, because it was reaffirmed in 1992 and extended in subsequent decisions protecting gay rights and the right to die.
Here is a good example of what happens in academia and why i take "scholarly research" with a heap of salt since I have experience in doing scholarly research. When you are doing research, your audience is trusting that you have run through all the hard work of researching both sides of a specific matter - not just looking up opinions based on whether they are from a conservative or a liberal as that is not supposed to be what determines their opinion on any particular matter.
You are supposed to be actually looking into all the differing opinions on the specific subject matter. While it does help to have a context of the profile of the one giving the opinion, it is the evidence they present in their argument that is what should be prioritized in research. The audience is also trusting that the sources the researcher uses are valid, researched, and impartial and that any studies they use are peer reviewed and use proper methodology and are also impartial without any sway from funders. Since many academic resources that would elaborate on these details are often gatekept through paywalls or language or other accessibility barriers, it can be difficult for the general population to do their own research - the majority of which do not have access for one reason or another - they are left with nothing but to choose to have faith the researcher they are reading did their job earnestly.
Barrett focusing on opinions from scholars (actually it seems she is more dependent on one particular scholar's opinion - Gerhardt as seen in notes 128-132) based on whether or not they are typically conservative scholars is basing it on an irrelevant matter when she should have been taking on all opinions about super precedents and digging into comparing and contrasting them based on whether or not they hold water. It seems more like she sought a defense for her pre-determined opinion and insulated it from challenge by excluding any other assertions despite their significance. She ultimately failed at her responsibility as a researcher.
On Wednesday 9/2/21, the Supreme Court voted 5-4 to not block Texas SB8, a decision that weakens Roe v Wade.
Now this has been a very long form way of spelling out just SOME of the impact that trump has had on the judicial branch. I want to now go back to 2016 when he was elected, and try to extrapolate why what happened in that election was a serious failure in regards to those responsible for casting their votes: The People.
"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."
"We the people" is every single resident and/or citizen of the nation at any time. The constitution is essentially a contract drawn up between every single one of us including those born and raised here, those who move here, those who's communities were here before the formation of the nation, and those who may be a citizen but living elsewhere. The diversity of The People in every faucet of human life makes this document necessarily complicated and amendable. In consequence the way in which our government is also complicated but also amendable. One matter that has been a point of contention since the dawning of the nation is the right to vote.
Who could vote & When (.):
1776: white men over 21 who owned land
1870 Racial barriers eliminated tho 15th is not enforced by states
1920: white women can vote
1924: Native american's given voting rights
1964: Civil Rights Act - all above 21y/o may vote regardless of identifiers such as race - ensures Black people's right to vote
1971: Voting age lowered to 18
1984: Accessibility extended to disabled americans by setting accessibility standards
In between all of these are other matters that challenged the accessibility to voting for one population or another such as literacy tests, naturalization, and polling taxes. Many of the challenges were directly challenging to People of Color particularly Black Women. To this day there are still many who must fight to assert their right - a right that should never be denied, never be thought of as less than inherent. Access is less a concern for the wealthy and well to do as their needs are never on the line the way it is for people who are poor, Black, disabled, immigrant, or even just have a primary language other than English.
For those of us who have never had to fight to utilize our right to vote in our life have too often shown that we do not respect the power in this right. Or rather know exactly how powerful it is and choose to use that power in a destructive way because we aren't getting our faves. For the first many many years I was eligible to vote, I refused to at all because I do not like how our government and politicians conducts themselves. As soon as I learned about the filibuster I was so pissed I didn't want to partake at all. Have I be impacted by this personally? To an effect, but not in a way that impacts my life significant enough for me to really notice. But in congruence with other privileged decisions not to vote, it has certainly impacted many lives. In a nation where communities are still fighting to have the law meant to protect them properly enforced, it is entirely a privilege abused to choose not to vote.
Though I was 18 in 2007, 2016 I cast my first vote.
Why? Because it was finally looking as though I may face personal consequences if I didn't. Prior to 2016 i wasn't worried bc there was obama, i wasn't old enough to vote when bush was up for relection and seeing him win again embittered me further. by the time I was 18, I saw how unreliable 3rd party was despite my parents being all in that gambit, and otherwise it all felt like nobody was paying attention to the issues only on popularity contests. All i thought of though was my perspective on the matter. It was all me-centric, my choice to withhold from voting in any election. When trump started to look less like a joke and actually got traction, I saw my neighbors trump signs and i looked at where i was in life. I had also began to actually do the work and stop letting apathy guide my decisions, but to rather listen to my humanity and my responsibility as my neighbor's neighbor.
Quite literally. At the time my neighbor was a Black woman. I only spoke to her once and it was when she came by to selflessly make sure I was going to be ok when our landlord was kicking us out to sell the place out from under our feet - something I hadn't even considered doing yet seemed like second nature for her to do (to be fair i was struggling to find a place but i've no idea about her life). I wish i had gotten her name and stayed in touch, it's kind-hearted people like that that are hard to come by. I'm still working on being as selfless.
I was and am proud to have not only voted in 2016, but for my first vote to have been for a woman. I was scared and for someone other than myself for once in 2016. I had high hopes for Clinton based on name recognition and basic common sense.
Humans are not perfect. Nor are they inherently humble.
Trump encouraged arrogance among the most ignorant leaning right. Sanders encouraged arrogance in the most ignorant leaning left. Clinton seemed to always get the most dramatic fire though from both sides, which signaled to me some kind of mess was going on. My own parents tried to sell me on Sanders, but by this point I had a better concept of how to properly research and untangle the mythologies that were parroted by my own parents about Clinton. Even when I proved their parroted lies wrong they were unwilling to concede, only to move the goal post or deflect.
Now, I get to my point.
Which is to really smack upside the head of anyone who chose not to vote in 2016, everyone who is left or liberal but voted for trump, everyone who wrote in someone else. If trump hadnt made it in as POTUS, paired with the republican majority senate, the landscape of the judicial branch would not have faced such a conservative shift, it wouldn't have given mcconnell so much influence, it wouldn't have resulted in the pandemic being so much worse than it needed to be. Many lives would have been spared. You can only blame the government for so long until you realize we are the government, we install the government, and we hold power we must use wisely. We the People.
Many who voted for clinton have been critical of her. As we always should be critical of those we choose in any level of government. We the people hold responsibilities that build this nation from the ground up, and without adherence to those responsibilities it puts other's rights in danger. When we decide that something doesn't matter that much to us or weighing it against the consequences we may personally face - you're failing in your responsibility to your neighbor who is likely doing far more justice to you than you are extending to them.
Yes my white people i look at you.
Yes my white men I look at you.
Yes my white queers I look at you.
Yes my white degree holders I look at you.
Yes white youth I look at you where I once was. When I was younger and arrogant and naive and apathetic and bitter and I let all that guide my choices instead of my concern for the neighbor who was looking out for me.
I still matter in the formation and function of tomorrow's government and I'm going to make sure I let my impact be constructive for all my neighbors who have extended such courtesy to me by not shirking my main duty to make an informed vote in every election i may partake in from local to national.
The differences among us in this nation may seemingly tend to fall along party lines, what the real metric is:
Do you give a fuck outside your own home?
Or is it just about what you want, what you think, what you feel? Nothing in this nation is just involving you or your bestie or your family, we're in this together whether we like it or not. Trust me as someone who struggles daily to find the humanity in others, I know how toxic that can be to your perspective when you give into it. Believe in benefit of the doubt, believe in change, believe in your power to do good for others. Believe and invest in your humanity.
While i can be mad at conservative votes for trump that was to be expected. I'm far more disappointed in the right AND DUTY to vote being given up by so many on the left simply because their fave didn't make it to the finals. That is not how establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, or secure the Blessings of Liberty to ourselves and our Posterity. AOC and Pressley and Porter did not make it where they are by their supportive constituents abdicating their right to vote.
I accept my faults in never having voted before 2016 even in local elections. It was stupid and selfish and 2016 woke me up to that reality. You don't go from 0 to trump overnight. Do you accept your fault in not voting in 2016 when one of the most detrimental candidates was running and won?

I was doing some research for a fanfiction, and remembered this line from Reality Trip, which got my criminal justice self all excited because of the implications. So have some analysis from a rambling autistic with a criminal justice degree.
“Daniel Fenton, in accordance with the Federal Anti-Ecto Control Act, Article 1, Section 1, Sub-section A, you're under arrest.”
Y'all, this is kinda wack? It means, on some level, there has been a federal judgment within the world of Danny Phantom that not only acknowledges that ghosts exist, but has an entire fucking act describing specifically the course of action in a sense. Lots of acts will kind of be this vague overarching thing with various random acts thrown into it, but the name along with the article one, section one subsection a dealio implies that this entire act focuses on ghosts. I say act and not law btw, because those terms are not necessarily synonyms.
Not only does this confirm that there are acts (at least one anyway) in Danny Phantom that specifically talk about ghosts, but kind of really and truly cements that the Guys in White are actually a federal government agency, rather than them simply acting as one but really being a private company of sorts or being some local state government program.
And with laws about ghosts, it means that legally, the government had to define what exactly a ghost is as well as their rights and lack of rights, and that they legally acknowledge, as a nation, that ghosts exists. While, of course, we don’t really ever get to see this act, and as far as I know, it’s literally Never talked about again, this scene means that this act applies to Danny. For a quick refresher, this happens after Danny is exposed, and so this act still applies to Danny despite him being outted as a half ghost. A scary sidenote is before this scene and line of dialogue, the agents told Danny that he was coming in for questioning and experiments.
So what might it possibly say? If there are any acts that we can potentially base what this act possibly would say, I would probably guess it’d be similar to the acts used for minorities within the United States. And I say these kinds of acts because they’re specifically acts that discriminate towards a group, and that have used various reasons to justify how they are not human, citizens or have any legal rights. If the agents’ lines were correct, these acts probably gave them justification for doing inhumanly cruel things to Danny.
Of course, Danny could be arrest for something totally different and not for some anti-ghost reasons. At this point in time, he’s still kind of half-loved, half-hated publicly as people are shown to still believe that he stole during the events of Control Freaks and the mayor incident of Public Enemies, but if he was under arrest for any of those crimes, the agents would have said that. And I refuse to believe this is an oversight of the writers, because they would have found any nitpicky thing and made it a funny situation where the agents went on and on and on about this endless list of crimes that the ghost boy has committed until Danny roundhouse kicked somebody. And no, it’s likely not because the Guys in White are only interested in Ghost Crimes. As federal officials, which they are confirmed to be, they would have arrested him for everything and have to basically fistfight the other government agencies investigating his Non Ghost Crimes.
So what exactly is he under arrest for? No clue obviously, and it’s hard to really even guess. Article 1, Section 1, Sub-section A for most acts are basically describing what the act’s going to be before it moves on to detail that. I think this is an oversight of the DP writers, lord knows we get enough of them, but it could also potentially highlight the Dumb factor of the Guys in White that we would see them sometimes exhibit, where instead of properly referencing the piece of legislation he’s under arrest for, they just blurt out the first section of that law.
And who wrote this act? It could be anybody, of course. Anybody within politics. It also begs the question as to exactly when this act was written and when it was put into effect. I’d wager it heavily depends on when the Guys in White came into effect, as they are clearly acting under these laws. Which begs the question: how many pieces of anti-ghost legislation are there? Who’s writing them? There’s potential that there are literally lawyers who are literally experts in ghost law. Keep in mind that in the beginning of the series, there was a lot of skepticism that ghosts even exist.
This honestly leads me to propose a new headcanon: The Guys in White are a very new government organization that spawned after the events of Public Enemies. To preface this and clarify, in order, the Guys in White appear in only five episodes: Million Dollar Ghost, Double Cross My Heart, Reality Trip, Eye for an Eye, and Livin’ Large.
Evidence to support this theory:
They only show up four episodes later in their first appearance in Million Dollar Ghost. Public Enemies seems to also be the first episode in the series that shows a massive onslaught of ghost attacks. I would guess that this is the ghostly event that probably spawned the act in question, which may have called for the organization of the Guys in White. Prior to this, ghosts were basically shown that they’re unconfirmed to exist on a public level. Even Jack, our lovable and excitable ghost hunter who’s been doing this since his college years admits in Mystery Meat that he’s never seen a ghost until that point. Jazz mentions that Harriet Chin in Bitter Reunions lost her job for writing an article about ghosts because she was laughed for writing about something that was more for “the national enquirer”, a conspiracy theory newspaper that nobody really takes seriously.
Why are they there during the events of Million Dollar Ghost anyway? If they’re a new organization, they may need that money or are cashing in on the publicity of the event to spread their name, or they’re just starting out and have no real clue where else to go. Only two of them even showed up anyway. The only other groups there are very small ghost hunting groups: literally two young adults on scooters, another set of young adults with a tiger fueled by anxiety and a van, and FentonWorks. And while they, out of all of them, clearly have the most advanced technology, they’re about on the same skill level as the other ghost hunters (getting captured and tricked and such just as easily). Danny even was just as “haha” about them as he was the other hunters who had showed up.
Their technology in Million Dollar ghost is nothing in comparison to the literal jetpacks and planes and four wheelers and armor they get several episodes later. Their funding increased when they proved ghosts exist and more ghostly events happened, and they likely proved their competence in some way. Especially when we see that they have been catching other ghosts (like Skulker in Double Cross My Heart and Lydia in Reality Trip) and gathering important information on ghostly artifacts (Reality Trip).
It would explain why they don’t really show up that often in the series, especially during major ghost events where they really should be there, such as the ghost king invasion of Reign Storm. They may have not secured the funding or manpower to really do anything just yet. Note that Reign Storm happened in between Million Dollar Ghost and Double Cross My Heart, which is almost a 20 episode gap. Their skills, knowledge, ability, technology and apparent funding jumped massively between these episodes, and it kind of stays about the same consistency for the rest of the show.
They really only seem to have one department, and they have really low employee numbers for a government agency. There’s no talk or implications or having multiple departments or anything, such as research or technology. Even during the SWAT invasion during Reality Trip, there’s only like twenty or so agents there. In Livin’ Large, there’s only about seven there, and two are the Agent K and O that we know. They play a lot of roles, from researching, questioning, gathering information, tracking down criminals, getting information from the Fenton’s lab, technology things in FentonWorks, etc. Of course, this is a staple for many law enforcement jobs where you have many tasks, but they seem to be playing the role of detective, computer analysis, and police officer at minimum given the wide variety of things we see them do. As somebody who’s worked in three situations where the company/program was very new, it’s incredibly common for a new company that’s still finding it’s groundings to have a very blurred job line. Or they’re heavily underfunded, but look at the goddamn jetpacks they get, look me in the eye and tell me they’re underfunded.
The lack of basic ghost information. In Livin’ Large, they want to destroy the Ghost Zone. It’s apparently very obvious that you Can’t Do That, but the Guys in White seem oblivious. While you can argue that they’re just fucking dumb, it may be more reasonable to assume that they simply just don’t know.
There’s no dialogue (that I can find) prior to Million Dollar Ghost to suggest they exist. There’s also no dialogue from Vlad, who would have known and been wary of such an organization had it been around for years, to suggest that they’ve been around a while. Jack, who also is open about how much he admires them, would have likely said something to. But I am willing to chalk this entire part up to simply poor writing.
“But Danny knew who the Guys in White were when they showed up in Million Dollar Ghost!” Yeah. He also knew who the other people were, and I heavily doubt that they’d be as big of a deal or name as the Official government branch. It’s very likely that they all introduced themselves when they showed up.

I was talking to Sarah yesterday and I had a revelation I think is worth sharing.
Let’s begin at the beginning. About a month ago, Instapundit posted this.
Now, I’ve been thinking of the rise and fall of civilizations lately. I can’t think why it’s been on my mind. It’s a tale as old as time—a civilization emerges, establishes a new worthwhile order, the good things brought forth by said order soften up the people maintaining it, the softening turns to decadence, and the decadence gives way to the barbarians, who clean the slate. Where would you say things are lately?

In short—the federal government of the United States of America has become impotent at almost all good things.
Expanded out—There is no start to its talents. It cannot maintain its borders. Since the “election” it doesn’t even try. No surprise there. It cannot maintain friendly relationships with allies—as our recent screwing of Britain on our way out of Afghanistan shows. The “leader” of the “free world” could not be bothered to pick up the phone for our closest ally. Speaking of Afghanistan, it can’t win a war. It can’t even lose gracefully. In fact it fucked up leaving so badly some people are entertaining that it intended to fuck it up, because how the fuck does somebody above the age of six not notice that pulling the military out first and the civilians out second is not even a remotely workable strategy? Resulting in leaving millions of dollars of equipment—and—excuse me, what? Millions of dollars of dollars in the desert? Fantastic.
It makes self sabotaging and idiotic choices to stymie its own domestic oil industry, while accepting a pipeline not from Canada, but one that’s a joint Russian-German venture instead. Which means the problem, contrary to any environmentalist whining, isn’t the pipeline—it’s the pipeline with a friendly country. Big surprise— its only true interest in the environment lies in international agreements that hamstring us while doing nothing to China, the world’s largest polluter. It either can’t be trusted on energy production and the environment, or is trying to get it wrong.
It can’t manage its economy. What could have been a “V” shaped recovery has been turned into an “L” shaped one. What could be contributing? Paying people to do nothing? Rampant inflation? Meanwhile all the dumbasses running the country can think of is spending several billion more dollars that don’t exist. The country has infrastructure problems for a fact, but they’ll only acknowledge that to the extent of cynically plastering the word on an “infrastructure” bill which is in fact just a far Left wishlist that largely ignores actual infrastructure, in the hopes people will be dumb enough to support it because it has the right label.
And on.
And on.
And on.
What aptitudes does it have besides taking money, trampling civil liberties, and ignoring constitutional laws at gunpoint? News flash, dummies: We don’t need peaceful protestors incarcerated without a trial. We don’t need the weight of the federal government turned to the problem of violating states rights because Texas passed a law Biden doesn’t like. We need military egresses that look like they weren’t planned by Bozo the clown and an economic plan better than something China would design for us as an attempt to permanently sink the country. Is there anyone at all in DC who can provide that? If not, is there anything useful they can do? I’ll wait.

This is what decadence looks like. When the government stops even attempting competence because nothing and nobody that currently exists can replace or displace them so who cares about results? When comfort and plenty have become so common, been taken for granted for so long, that the question of utility or even basic sanity isn’t even distantly considered. When it’s assumed that self-harming policies that will obviously damage the country won’t really matter because nobody has ever known a world without America and fundamentally has no idea how the present day came to be. When the country’s most educated start chasing bizarre and unimaginably stupid ideas on economics that boil down to “inflation won’t happen if you double the monetary supply by printing money, if only you just believe hard enough”. In fact, when education stops being a means to greater insight, more useful abilities, and a better life, and becomes a cult devoted to the kind of idiocy that can survive only with strenuous censorship, the tenets of the cult being treated by the indoctrinated as a collection of sacred mysteries and deeply-thought paradoxes— while to those not similarly trained it is self-obviously a collection of contradictory and self-serving lies.
Verily, decadence is here. We can infer that what comes next is the barbarians. And we have options. Mexican illegals? A heady mixture of poverty-stricken Marxists who have never known a system that wasn’t corrupt, functionally lawless, and devoted to the tenets of voting oneself rich; and outright criminals with lives like “a demon’s resumé”? Perhaps radical Muslims? By sheer numbers worldwide they’re the most likely option. The Taliban just got a huge infusion of cash and a big boost in morale. In a few short days we’ll know whether they’ve arranged a thank you gift for Zho Bi-Xen and his kleptocrat marching band to commemorate his intended pull-out date. But even if, and God I hope, they have not, we can expect an uptick in terrorism and quite shortly. Or perhaps China? The Middle Kingdom would laugh at being called barbarians, but I call genocidal communists like I see them. Mao was morally three steps below a pig and Xi has enough power to aspire to greater depths. As is I wouldn’t dream of feeding a pig Mu Shu Xi due to the great risk of poisoning the pig.
But there is a barbarian group not considered. Us.
Hang on. Before you balk, listen. Look again at what these idiots are selling as the fruits of civilization. Defenses of pedophilia and urinals as art. And more, too—sterilization and disfigurement of teenagers in the form of sex changes. Black supremacy as a panacea to made up threats of white supremacy. Books nobody reads, movies nobody watches, paintings that exist only to launder money—even the ones not made by Hunter Biden.
What good person would not be proud to be considered a barbarian by these miserable, over-decorated Faberge people? I’d be mortified if they agreed with me! So they think I’m a sexist or a racist or whatever. Fine. They do not use these words to mean the same things I mean, so it’s a pointless argument, and they are now officially beneath my explaining myself to them. When the people who are calling me names are so morally opaque that the Taliban can make devastating critiques of them just by referencing the foundational works of their own gender studies programs, I’m done caring about the names. Yes, this is a moment of peril, but also opportunity. See in your country what every hostile group listed above sees in it—the makings of great civilization, along other, less stupid lines. All of it guarded by weak, fat, stupid people with no will and no self-belief. Take that mindset and go forth.
Get involved in your local systems. There is an old prayer for God to make ones enemies ridiculous. Congratulations to whomever was still praying it. Your prayers have been answered. Will you tell me that you cannot defeat these people? People who lose casual debates to terrorists not on principle but on basic facts?

You can’t reason with them so don’t bother. Recent events have made it clear you may as well try to talk sense into a three-day-old mackerel. Just confront them with their own stupidity so that people who see the inevitable video understand what this is about, and don’t feel that you are too good to shout them out of the room. You’re the barbarian, remember? Not like the nice civilized people with their gender-queer Tik-Tokers pushing vaccine propaganda. That means you’re excused from conversations with morons. Don’t bother trying to find common ground. Look at where they’re standing! Do you want to try to find the midpoint between that and reality? Silly. Pointless. Send them back to their walled online gardens to whine to their equally stupid friends about the barbarians.
Can we take it back from the ground up? I don’t know. But hey, it’s got to be worth a shot. Join the fun! Find some friends and locate a low-hanging political event to raid. When was the last time you went to a town hall for your town? Isn’t just a part of you curious to know whether your local county commissioner starts by declaring her pronouns? Wouldn’t it be wonderful to see someone like that made very uncomfortable? You can make that happen. You can probably do it within the next month. Bring a few friends! Or a few dozen. Some of the people reading this probably were afraid to do that kind of thing for fear of losing their job. The Biden economy might have freed up some of your time. What have you got to lose now? More importantly, the way things are going, are you going to lose it anyway if things continue as they are? Think on it.

NEWS UPDATE USA !!! A Missouri couple says they dragged their feet on getting the Covid-19 vaccine. Then they got sick
Louie Michael and his wife, Pattie Bunch, were both hospitalized last month with Covid-19 in Springfield, Missouri.
An ambulance first had rushed her, with respiratory failure, to an emergency room one day; he was admitted the next night. "You may not make it through the night," she recalls a physician telling her. Michael remembers the doctor asking him about possible intubation: "Do you want us to fight for you? Do you want us to do anything we can to save your life?" Bunch, now recovery at home, says she felt helpless. "You have no control." Coronavirus cases, hospitalizations and deaths are rising again in Missouri, with the federal government deploying a Covid-19 surge team to provide public health support. The state's health department estimates that more than 70% of the virus in the state is the more infectious -- possibly more dangerous -- Delta variant. That variant, first identified in India, accounted for 51.7% of all new Covid-19 infections in the country over the two weeks that ended Saturday, the US Centers for Disease Control and Prevention has estimated. State health officials push vaccination efforts Robert Knodell, acting director of the Missouri Department of Health and Senior Services, on Friday acknowledged significant outbreaks of the Delta variant in north-central Missouri and a similar surge in southwest Missouri. Vaccination, Knodell told reporters, "is now, and remains the number one most effective mitigation step that every Missourian age 12 and over can take to protect themselves, to protect their families, and their neighbors." Dr. George Turabelidze, a state epidemiologist, said Missouri had "vulnerable hot spots" where not enough people were vaccinated and warned the state is "heading towards widespread infection with Delta."
Over the past week, Missouri's Covid-19 caseload was second highest in the country, with 15.5 new cases per 100,000 people daily, or 108 cases per 100,000 people over seven days, according to Johns Hopkins University data. Arkansas had the highest rate at 15.7 new cases per 100,000 people each day, the data showed. At Springfield's Mercy Hospital, the rapid spike in hospitalizations left administrators scrambling to borrow ventilators from other hospitals. At the city's CoxHealth hospital system, 90% of coronavirus patients had the Delta variant. "We are seeing a tremendous increase in the number of Covid patients in our emergency department over the past several weeks," said Dr. Howard Jarvis, medical director of the emergency department at CoxHealth. He added, "We are going to get worse over the next couple weeks. Certainly people are out doing a lot more things. I think there's a lot of people that have less concern about the virus. Now we don't have a very high percentage in this area of people who are vaccinated." Breeding grounds for more deadly Covid-19 variants Missouri is not alone. More than 9 million people live in 173 US counties with Covid-19 case rates at or more than 100 cases per 100,000 people in the last seven days and with vaccination rates lower than 40%, Dr. Rochelle Walensky, director of the CDC, said at a White House briefing on Thursday. More than 90% of those counties also have a vaccination coverage of less than 40%, according to Walensky.
"Many of these counties are also the same locations where the Delta variant represents the large majority of circulating virus," Walensky said. "Low vaccination rates in these counties, coupled with high case rates -- and lax mitigation policies that do not protect those who are unvaccinated from disease -- will certainly, and sadly, lead to more unnecessary suffering, hospitalizations and potentially deaths." In fact, a new data analysis has identified clusters of unvaccinated people, most of them in the southern United States, who are vulnerable to surges in Covid-19 cases and could become breeding grounds for even more deadly variants. The analysis by Georgetown University researchers identified 30 clusters of counties with low vaccination rates and significant population sizes. The five most significant clusters cover large swaths of the southeastern US and a smaller portion in the Midwest. The clusters are largely in parts of eight states -- from Georgia to Texas and southern Missouri. About one-third of Americans have not received a Covid-19 shot. About 39% of Greene County residents fully vaccinated Katie Towns, acting director of the Springfield-Greene County Health Department, said the county -- population about 300,000 -- had 240 Covid-19 cases just on Wednesday and 17 deaths in the last two weeks. About 39% of its residents are fully vaccinated, according to health department website. "We're not a huge community," she said of the 240 cases. "That's a really large number and we haven't seen these numbers since we had a surge back in December and January." About 56% of adults in Missouri have received at least one Covid-19 vaccine dose and 39.4% of residents are fully vaccinated, according to CDC data. In Taney County, where the southwestern Ozark city of Branson is a huge tourist draw, about 25% of its roughly 56,000 residents are vaccinated. "It runs the gamut," Lisa Marshall, director of the Taney County Health Department, said of the hesitancy to the vaccine. "Maybe they just want to wait and see or ... it's not quite ready yet. Maybe they're just not someone that vaccinates. We've also heard a little bit of concern over how quickly the vaccine was developed." Overall, data shows that Covid-19 is expected to swell in less vaccinated communities, especially as the Delta variant continue to spread in those areas. In Missouri, a federal surge team deployed there is to include an epidemiologist, research assistants, a health communication specialist, contact tracers and others who will help with vaccination and outreach, according to the health department. The teams include members of CDC, the Department of Health and Human Services, and the Federal Emergency Management Agency "We have a CDC representative helping us with ... investigating the (Delta) variant and its presence here in our community," Towns said. "But we just have ... one representative right now. We'll gladly accept the additional resources."
At the 500-bed CoxHealth hospital system, Jarvis said nearly all of the new Covid-19 admissions have been unvaccinated younger patients. "This is going to keep happening," he said of the latest surge in cases. "It may peak here and then it's going to spread to other places. If we don't get enough vaccinated there's going to be another variant that's probably worse. It's just that's the way viruses work." Couple, sick with Covid-19, holds hands in the ICU In Rogersville, Louie Michael said he and wife Pattie Bunch, a nurse, had been "dragging our feet" since the spring about getting a Covid-19 vaccine. In mid-June, Bunch got sick. "It felt like a bomb dropped on me," said Bunch, who is still recovering less than a month later. "I just wasn't feeling good at all. And I thought, 'Oh, no.'" An ambulance rushed her to the hospital with respiratory failure on June 17. The next night, Michael, an entertainer, had to be rushed to the same emergency room in Springfield. A nurse eventually put them in the same ICU room, where Michael took a snapshot of them holding hands. "We didn't know how it was going to turn out," said Michael, who along with Bunch urges people to get vaccinated. "We didn't know if we'd get to go back home." "Or see our kids again, or our family or grandson," she said. "It could have just ended that night," said Michael, who has been with Bunch for 30 years. "It made me mad. I didn't want it to end that way. It's not supposed to end that way ... and unfortunately, it's ending for a lot of people that way."

Is Legalizing Marijuana Destructive to Society? We will examine both sides of the controversial topic of whether to legalize Marijuana.
The million-dollar question seems to be is legalizing marijuana destructive to society or can we function and live normally in a society where marijuana is legal? The topic has been debated for years but even more now because of how popular and open people are with it in today’s society. Back then, people were not as open with using marijuana. There were not medical uses for marijuana or stores that could legally sell marijuana for recreational uses. In our society today, people are more expressive about their opinion when it comes to legalizing marijuana and fighting for the right to legally obtain marijuana without being considered a criminal. Then there are people who believe that marijuana is not good for our society. Others believe that marijuana should be kept as an illegal drug and those who obtain it should be criminally charged. They believe marijuana will negatively affect our society rather then add value to it. Today we will explore both sides of the great debate to further understand the viewpoints of many who have an opinion on the legalization of marijuana.
THE GREAT DEBABTE
The main issue on concerning the debate is whether marijuana should be legalized or not. More recently millennials significantly supported the legalization of marijuana. As of 2015, data shows “Millennials (currently 18-34) have been in the forefront of this change: 68% favor legalizing marijuana use, by far the highest percentage of any age cohort. But across all generations –except for the Silent Generation (ages 70-87) – support for legalization has risen sharply over the past decade.” Since 2015, states have proposed bills that would add laws on medical marijuana use and the recreational use of marijuana. States that have proposed legal the usage of medical marijuana is Alabama, Florida, Hawaii, Idaho, Kansas, Kentucky, Maryland, Mississippi, Nebraska, South Carolina, South Dakota, and Virginia. States that have proposed legal the usage of recreational marijuana is Connecticut, Florida, Hawaii, Maryland, Minnesota, Nebraska, New Jersey, New Mexico, New York, North Dakota, Oklahoma, and Virginia. Because of COVID-19 states had to pause the voting process and up until 2021 states have resumed voting on the proposed bills. As of March 25, 2021 lawmakers in New York came to a consensus with Governor Andrew Cumo on legalizing marijuana. “Following several failed attempts, lawmakers in Albany struck an agreement with Gov. Andrew M. Cuomo to legalize cannabis for adults 21 and older, a move that officials hope will help end years of racially disproportionate policing that saw Black and Hispanic people arrested on low-level marijuana charges far more frequently than white people.” Those who are IN favor of legalizing marijuana believe that the government think they know what is best for people so instead of knowing forcing the collective to follow a particular rule, they should give them the option to legally engage with marijuana. As history repeatedly shows us is that race plays a huge part in who gets in trouble with the law or not. “According to the U.S. Department of Health and Human Services, Black and White people use marijuana at roughly the same rates.1 And yet, Black people are nearly four times more likely to be arrested for a drug-related crime.2". If we look to philosophers like Douglas Husak who believe that the prohibition of drugs is counterproductive, he gives several reasons on why this is true. Husak is in agreeance with many others and what the United States’ history has shown us that “In the first place prohibition has always been aimed or selectively enforced against minorities. Contemporary statistics are shocking. Although whites and Blacks are roughly comparable in their rates of illicit drug use, Blacks are arrested, prosecuted, and punished for drug offenses far more frequently and harshly than whites. About 10 million whites and 2 million blacks are current users of illicit drugs. Five times more whites than Blacks use marijuana, and about four times more whites than Blacks use cocaine”. Another reason Husak introduces is how expensive prohibiting drugs are in 2005 “state and federal governments now spend close to $40 billion each year combating illegal drugs. Most of this money has been wasted.” Specifically concerning marijuana “in 2005, Milton Friedman and a group of over 500 other economists advocated for marijuana legalization on the basis that prohibition directly costs more than $7.7 billion per year.” Research shows that there is a considerable amount of tax paying dollars being spent on the prohibition of marijuana and other illicit drugs. So, considering what the data has provided us, another argument in connection with the expensive argument is “A 2010 Fraser Institute study found that legalizing and taxing marijuana could produce considerable revenue for British Columbia. Economist Stephen T. Easton estimated the annual amount at $2 billion.”
The debate of whether or not to legalize marijuana would not be a debate or a controversial topic if there was not an opposing viewpoint to legalizing the drug. Those who are NOT in favor of legalizing marijuana say that “Marijuana use harms more than just the person using the drug. [129] Societal costs of marijuana use include paying for increased emergency room visits, medical care, and addiction treatment for the uninsured; more victims of drugged driving accidents; increased crime; and a negative impact on health from secondhand smoke.” Those opposed believe that it will cause harm to society by adding to medical accident and an increase in hospital visits. Another reason is teen usage, “Marijuana is especially dangerous for young people, because human brains are not fully developed until around age 25 (four years past the legal age in states that allow recreational marijuana). [79][80] The American Academy of Pediatrics said that adverse effects of teen marijuana use include “impaired short-term memory and decreased concentration, attention span, and problem solving, which clearly interfere with learning. Alterations in motor control, coordination, judgment, reaction time, and tracking ability have also been documented; these may contribute to unintentional deaths and injuries.” [156] Studies show that students who use cannabis perform worse in school. There is also the fear of addiction, “Dr. Drew Pinsky, a board-certified internist and addiction medicine specialist, said, “I’ve been treating cannabis addiction for 20 years. When people are addicted to cannabis, cocaine and alcohol the drug they have the most difficult time giving up is the cannabis.” [93].”.
My thoughts
After researching the topic whether marijuana should be legalized or not, I have concluded that if we were in a time like 10 plus years ago then the coins of legalizing marijuana would outweigh the pros. But now that we are living in a time where people are educated about marijuana, where it comes from, how it is used, and what it could be used for the pros outweigh the cons. With the data that I have researched marijuana does in fact destroy our society if anything it adds value to our society. This is because we live in a nation where there is an increasingly amount of people who use marijuana responsibly and love it. Also, there are people who don't use it but are educated enough to know that it does not hurt people or others around them. There are states that have legalized it and there are states that are currently creating bill's bad what allow for the legalization of marijuana. This shows how progressive our nation is becoming towards something that has been controversial four years. As a young African American woman, I can say that the research definitely explains to us how racial profiling and mass incarceration could slow down because of allowing people to use marijuana. There are so many people in our society that use marijuana and out of those people who use it African Americans are incarcerated and punished more for using marijuana. African Americans are looked at as criminals because now they have a criminal record because of something as small as using marijuana. The research provided shows that the cons tend to repeat their cells there is not much of a difference and each argument provided. What this tells me is that those who oppose legalizing marijuana cannot come up with a legitimate reason why it would be destructive to our society. So, what I think the research tells us is that we still have quite a way to go in figuring out whether or not to legalize marijuana, but we are definitely close as a nation to accepting that marijuana is not harmful to our society and that it can be legally used responsibly whether it is for medicinal usage or recreational usage. The question of whether legalizing marijuana is destructive to our society is still out on the jury to be answered but research is showing that the favor leans more towards those who are in support of legalizing marijuana.

For months now, President Trump has carefully planted the seed that he might not leave the office of the presidency willingly if he loses.
Whether it’s tweeting that the election should be delayed as it “will be the most inaccurate and fraudulent election in history” or that there will be widespread voter fraud because of the expected uptick in mail ballots due to the coronavirus, Trump seems intent on undermining the electoral process.
This, in turn, raises a rather thorny and unprecedented question: What happens if Trump won’t go? The answer is bleak. Experts tell me that the president actually has a lot of power at his discretion to contest the election, and some of the scenarios that could bring us to the edge of a crisis are actually very plausible.
Consider this one: It’s late on Election Day, and hundreds of thousands of votes in key battleground states still have to be counted due to the increased use of mail and absentee voting because of the pandemic. As a result, media outlets have largely avoided calling the race, but based on the votes that have been counted, Trump leads in enough states to reach at least 270 electoral votes, which would be enough to win the election if his election-night lead holds. Trump claims victory, but because Democrats were much more likely to vote by mail than Republicans, Joe Biden eventually pulls ahead because of the Democratic lean of the remaining votes — a phenomenon known as the “blue shift.”
That’s just one of the many scenarios the Transition Integrity Project, a bipartisan collection of over 100 experts, explored this summer while researching how a possible election crisis could unfold.
Rosa Brooks, a professor at Georgetown University Law School who co-founded the Transition Integrity Project, told me she and her colleagues weren’t interested in predicting the likelihood of any one scenario they looked at, but more so in understanding the range of possibilities. Ultimately, they don’t know to what extent this year’s election result will be contested — would Trump deploy federal agents from the Department of Justice to secure vote counting sites or would he just take to Twitter to bemoan the results? — but Brooks told me they do think the election will be contested at least on some level. So the question they’re asking is: How much?
One big takeaway from the Transition Integrity Project’s simulations was just how much power Trump has at his disposal should he choose to contest the election. “You have just a tremendous differential between the president of the United States of America, who has just awesome coercive powers at his disposal, and a challenger who really has no power whatsoever in our system,” said Brooks. “Joe Biden can call a press conference; Donald Trump could call on the 82nd Airborne.”
This, of course, would be a doomsday scenario, and one reason why so much of this is hard to fathom. A cornerstone of American elections has been the peaceful transition of power, but as research from the Transition Integrity Project and others underscores, there are multiple ways to contest an election. And it’s not limited to just Trump either. It’s very possible were Trump to win in the Electoral College, where he has an advantage, but lose the popular vote to Biden, that Democrats would dismiss the election as unfair.
We, of course, do not have to look too far back in our electoral history to know that Americans have survived a disputed election before — see the 2000 presidential race. But experts I talked to were worried, given Trump’s inflammatory rhetoric around the election and his own track record of openly flouting democratic norms, that the country wouldn’t be able to handle another full-throttle election dispute. Take how low the public’s trust in the election already is. Last week, an NBC News/SurveyMonkey poll found that 59 percent of Americans were not too confident or not confident at all that the election would be conducted in a free and equal way, in line with its polling since early August on this question.
It might be hard to remember now, but in the 2000 presidential election, Florida’s GOP-controlled state legislature was on the verge of appointing a new slate of electors to vote for George W. Bush had a court-ordered manual recount imposed by the Florida Supreme Court dragged on. Of course, it ultimately didn’t come to that because the U.S. Supreme Court stepped in and halted Florida’s recount, famously deciding in a 5-4 decision that the state Supreme Court had overstepped its bounds and that a recount could not be held in time to meet the federal deadline for the selection of presidential electors.
Edward Foley of Ohio State University’s Moritz College of Law thinks something similar could happen this year if the president and his backers contest the results in the Electoral College.
In Foley’s scenario, Trump leads in the tipping-point state of Pennsylvania on election night, but because of Democratic gains in ballots counted in the following days, Biden pulls ahead by a few thousand votes. What happens next quickly devolves into a partisan dispute. Democratic Gov. Tom Wolf signs Pennsylvania’s certificate of ascertainment, confirming Biden’s victory by listing the Democratic electors as the state’s official slate for the Electoral College, while the Republican-controlled Pennsylvania legislature appoints a different set of electors at Trump’s behest as he has claimed there was widespread election fraud.
This, were it to happen, would likely be met immediately with legal challenges in state and federal court, perhaps followed by another intervention by the U.S. Supreme Court. But the significance is that even if a court ruled against the validity of one set of electors, Congress still has the power to consider both sets of electors as long as they have in hand the certificate naming them.
The Electoral Count Act of 1887, which governs the electoral vote counting process, was designed to help Congress decide how to handle such a situation. But it is especially ambiguous on what would happen if the Senate and House disagree on which set of electors should count, which could happen if the GOP retains control of the Senate and Democrats keep the House.
In Foley’s scenario, Vice President Mike Pence — as president of the Senate, he would oversee the count in Congress — follows one interpretation of the law, arguing that neither set of electors should count because they conflict. That removes Pennsylvania’s votes from the total number of electors and gives Trump a majority based on the remaining 518 electoral votes.1 Democrats, however, counter, claiming the certificate bearing the governor’s seal, which supports Biden, is given preference by the law.
Ultimately, though, neither side finds a compromise and we find ourselves in the midst of a full-blown constitutional crisis. In this scenario, the Supreme Court could become involved if, for instance, Democrats seek an injunction to stop Pence from not counting Pennsylvania’s votes. But it’s also possible the court would try to avoid making a ruling on the counting dispute, in keeping with a dissent from Bush v. Gore that argued neither the Constitution nor the Electoral Count Act provided a role for the judiciary in this process.
Under the 20th Amendment, we know someone must take office on Jan. 20 as president, yet the amendment is curiously silent on how to deal with a dispute over whether someone has actually qualified to take office. “The thing that we know for sure is the current term ends,” said Foley, but he added that doesn’t mean it would be straightforward to figure out who should take office next if there’s a disagreement.
In fact, it’s possible that House Speaker Nancy Pelosi could claim that under the Presidential Succession Act, she is next in line to become president and that she would be willing to resign her House seat to serve as president until Biden is ruled the election winner. But if Republicans claimed Trump had won reelection, they very well might object to Pelosi being sworn in. Given a crisis on this scale, it’s hard to unpack what exactly might happen, but it’s very likely things would spiral out of control, and the resulting uncertainty could spark unrest and protests that could very well lead to violence.
Gaming out these different scenarios demonstrates that, should Trump dispute the result, a key factor will be the extent to which leading Republican officials at the federal and state level cooperate with him. Brooks pointed out that while Trump has significant power to contest the results as president, he can ultimately only go so far if supporters don’t follow his lead.
For instance, in one of its simulations, the Transition Integrity Project found that GOP leaders might support some of Trump’s claims of fraud or maneuvers to manipulate the vote count, but that didn’t mean they’d go along with every move he tried. For instance, it found many Republicans might oppose an attempt to federalize and deploy the National Guard. And in Foley’s scenario, much hinged on what Senate Majority Leader Mitch McConnell and other Republicans — including Pence — chose to do when it came to deciding which Pennsylvania electors should count.
The relative closeness of the election is a factor here, too. In a different simulation the Transition Integrity Project looked at that put Biden in a stronger position on election night, Trump attracted less support from Republican leaders and Biden’s campaign was able to get some degree of bipartisan cooperation so that the country didn’t slide into a full-blown electoral crisis. Still, throughout its different scenarios, the project found it likely that the Trump campaign would try to raise enough doubts about the vote so as to undermine what might even seem like a clear result. Considering Trump claimed millions of people illegally voted when he won in 2016, it doesn’t take much to imagine he’d do the same this year if he thought it would improve his chances of winning a contested election. That’s one reason researchers at the Transition Integrity Project rank Trump’s allegations of voter fraud among the most dangerous threats currently facing the election.
Of course, considering how high the existential stakes seem to be in this election, it’s not out of the question that Biden might be the one who disputes the result. Tellingly, in another simulation the Transition Integrity Project played out, a crisis unfolded after Trump won in the Electoral College but lost the national popular vote by 5 points. Trump claimed it was fraud that explained Biden’s popular vote edge, but Biden retracted an election night concession and pushed Democratic governors in Michigan and Wisconsin to send appointed slates of electors to Congress, in conflict with the elected ones backing Trump. In his work, Foley also explored an alternate scenario in which Arizona was the tipping-point state and Republican Gov. Doug Ducey refused to certify the results to give Biden the state’s electors. During Congress’s counting, congressional Democrats argued that Arizona’s electors should be disqualified to give Biden the victory — the same argument Pence made in the Pennsylvania scenario to claim Trump had won.
The scenarios laid out by the Transition Integrity Project and Foley shouldn’t be taken as definite outcomes, but they do make clear that the rickety apparatus governing our electoral process could collapse if key actors decide to push against it.
Worryingly, the public may be especially vulnerable to attempts to delegitimize the election, too. Faith in the Electoral College is already shaky because of the possibility of a popular vote-electoral vote split like in 2000 and 2016, and worse yet, support for the Electoral College is increasingly polarized by party. A conflict over which electors should count would only exacerbate those concerns. And because many Americans still expect to know who won on election night, this could create a situation where much of the public isn’t ready for — or is ready to reject — sizable shifts in the vote after Election Day, which could make it easier to cast doubt on the outcome.
But even if the worst scenarios don’t come to pass, the fact that we lack a neutral electoral arbiter is surely a ticking time bomb for our democracy. Such an institution may sound difficult to create, but many individual states have used judicial panels to successfully sort through close elections, and other democratic nations have far better laws to adjudicate contested elections. For now, though, in the absence of such measures, the peaceful transfer of power hinges on the expectation that that is how American elections work, but that may be increasingly hanging in the balance, as anyone living in this incredibly polarized era of U.S. politics will tell you.

Oct. 14: Why I still think Trump has a ~75% chance of winning
Epistemic status: Who even am I? You shouldn’t listen to me. But see the final section for details.
By ‘winning,’ I mean still being president on 1/22/21, and there being no serious actionable plan to get him out.
2500 words of paranoia and bad math after the cut.
Polling factors:
Today, 538 gives Trump a 13% chance of an EC victory, so let’s use that as a starting point. As Nate Silver will tell you every chance he gets, 2016 presidential polls were only off by a few percentage points, and that’s probably still true. But a similar (or even smaller) systematic polling error would be enough to flip some battlegrounds, bumping Trump up to something like 25-30%. Have pollsters managed to correct for the systemic errors of 2016? There’s true meaningful debate around this, but the balance of evidence seems to be that the pollsters never figured out what caused the errors, and so were not able to fix them.
Note that Trump’s decline in the polls is driven by voters who approved of the president until very recently. Consider the sort of person who still had a favorable of opinion of Trump right up until fall 2020. Generally, dips in Trump’s favorability ratings seem to have been due to conservative infighting. Often, when a person stops supporting Trump, it’s because he is being insufficiently racist. These constituents’ loyalty may be wavering, but they are not likely to switch sides.
As a complete asspull hypothesis, I’d guess that some people who tell pollsters they no longer support Trump are trying to pressure him into adopting more hardline policy and will never vote for a Democrat.
I would posit that the 13% number is the absolute hard minimum chance of Trump winning an EC victory, fair and square. Error bars push that number higher. Taking average polling data over time also pushes that number higher, since it’s almost never been this low.
Dysfunction factors:
So, those are the odds for a free and fair election. What are the odds of the election being free and fair? I’m glad you asked! Zero.
Election integrity has taken major hits recently. Citizens United turned elections into ad campaigns. Shelby County v. Holder made laws against discriminatory election practices unenforceable. The Hatch Act is also not being enforced. The numerous alleged campaign finance law violations brought against the 2016 Trump campaign all amounted to nothing (except jail time, and subsequent pardons, for some functionaries).
Fine, let’s say elections can never be perfectly fair, but even if we grade on a curve and request that elections be as fair as possible, we’re still not doing great, and it’s been getting worse since 2010.
Hey, remember all those jokes from like 2004 onwards about how unreliable and insecure electronic voting machines are? That shit never got fixed. Remember the story from this week about some 90,000 New Yorkers getting the wrong mail-in ballots?
Remember when the Russians got into the Illinois voter database in 2016? The institutions that were supposed to defend against that kind of thing have since been gutted or captured by republicans.
Hey, remember when the Iowa primary was so dysfunctional that they ended the vote count without ever producing a final tally or figuring out what the problems were?
Election integrity groups have been sounding the alarm continuously on this one. Electoral commissions and underfunded, understaffed, and undertrained in use of modern systems. This is a huge problem all by itself, and it gets worse when applied to the next issue.
Malfeasance factors:
In my American public school civics education, I learned that Richard Nixon was a crook who paid some burglars to spy on the democrats, because of how crooked he was. I did not learn that ratfucking is bog-standard procedure, in every election, all over the world. I had to learn that on my own, later. Generally speaking, the election integrity talking heads take the opinion that most countries routinely interfere in the elections of most countries, and the Ds and the Rs have never not been spying on each other. The extraordinary thing about Watergate was that Republican congressmen were weirdly amenable to allowing an investigation into one of their own, a mistake they have never since repeated.
Some amount of ratfucking is to be expected. The nation has weathered this factor before. But, like electoral competence, this may be getting worse over time. State governments have very wide purview when it comes to voting procedure, and Republican states are wasting no time in finding creative new ways to toss out ballots. The most common reason for a mail-in ballot to be rejected is that the signature on the envelope doesn’t match the voter’s signature on file. There is no official criteria or standard practice for how close a signature has to be to count as a match. Signatures are not useful security for anything, anyway.
Georgia’s 2018 election was arguably illegitimate. Irregularities included voting sites closed at the last minute for unclear reasons and fraudulent ballot collectors stealing ballots. Calls for recounts all failed. Other southern states are on thin ice. All the big Texan cities are getting one ballot drop box each, in case you thought Texas would be allowed to turn blue.
Red states already have various laws permitting them to throw out ballots that arrive after the election. Sabotaging the post office or throwing out all uncounted ballots soon after the election, as most sitting Republicans in congress and governors have already gone on record to suggest may be necessary, is a violation of the letter but not the spirit of existing restrictive voting laws.
The big thing, of course, is that the right wing media landscape has been fully saturated with the idea that Democrats will engage in conspiracies to steal the election, and action will need to be taken to thwart these plots. To that end, Republicans at all levels of government, including at the DOJ, have repeatedly signaled willingness to take unprecedented measures to stamp out fraud. These include numerous voter purge plans, new criteria for dismissing ballots, and sending the DHS or other law enforcement agencies to take custody of ballots.
In addition, the MAGAs are organizing ‘poll watcher’ groups to secure urban voting sites. Even if these groups fully obey the law and do not engage in anything that could legally be termed intimidation or harassment, that’s still a lot of leeway. Of course, over the last couple years, we’ve all learned that right wing protesters can sometimes bend or break the law and get away with it, and sometimes receive cooperation from the police. This goes triple for blue cities in red states, which is exactly what we’re worried about.
Malfeasance in general is made easier by the unprecedented levels of geographically-sorted voting blocs. It is trivially easy to tell whether a district will go hard for Trump or hard for Biden. So, whether interference is coming from law enforcement officers, protesters, or semi-sanctioned militias, they will know which lines to intimidate and which boxes to steal.
Russiagate set a clear precedent: It doesn’t matter if it’s blatant, outrageous, or corrupt. Republicans do not want to defect, and right wing media will keep the base in line. Democrats will be outraged, and then fold. There are no remaining nonpartisan referees to appeal to.
Pundits like to imagine that sitting Republicans in congress will not blatantly steal an election for fear that it will lead to them getting voted out of office, to which I would suggest that the obvious answer is the correct one: Voted out how?
Democrats shooting themselves in the goddamn foot factors:
Trump likes to say that the election will be illegitimate if he loses. Mainstream news outlets like to push back against this. The NYT, for instance, has been loudly insistent that the election is totally secure all year.
It’s not, and they’re morons. No experts agree with them on this. Trump fabricating a bunch of fictional threats does not invalidate the numerous actual threats.
Biden, Pelosi, and Schumer would not be anyone’s first pick for the task of contesting an election, but that’s who we got.
Possible October surprises:
Hey, what do you guys think this year’s James Comey is going to be? The only real prediction I have is that something very destabilizing happens in the week before the election, but the particulars could be anything. Some fun possibilities:
DNC hacked again
Federally sanctioned repeat of the 1985 MOVE bombing
Hunter Biden cocaine sex tape
Anything that startles people, destabilizes institutions, and distracts from other issues is a viable possibility.
Scenarios after a contested election:
There are plenty of bluechecks and think tanks who have already gamed this out in detail. You don’t have to take my word for any of this part. The choices are:
There are rival sets of state electors, and Congress decides which ones count. Result: McConnell and Barr play Calvinball until they get the outcome they like, Trump remains in office.
The supreme court decides. Result: Trump remains in office.
The militias decide. Result: Trump remains in office, plus the Handmaid’s Tale happens.
There’s an orange revolution. After months of protracted struggle, Trump is ousted from office. However, in the meantime, ~8 states have seceded and Russia has annexed Alaska. In the ensuing chaos, John McAfee claims the presidency.
Probability estimates:
Trump’s odds of a ‘legitimate’ EC victory are only at 13% as of this moment, but the running average is higher, with occasional spikes above 30%. Polling errors add a little extra. Let’s say 25%.
Trump’s odds of losing the EC vote, but clawing it back through malfeasance until enough Republicans agree that he’s won, are very low in the case of a Biden landslide. But a landslide is unlikely, and as the results are closer, the probability of Republicans declaring themselves winners approach one. Note that, at least from mainstream news coverage, this won’t look like the power grab that many democrats fear. It will look like a lot of confusion and disarray, with an unclear EC count, followed by a cascade of authorities and sources declaring Trump the winner and securing the acceptance from government bodies one at a time. For the most likely election outcomes in which Trump doesn’t win straight up, I’d say a 30% chance Trump remains in office.
The election being a total dysfunctional disaster, with multiple states unable to certify results, is at least 5%. At least! In such a case, I’d give Trump an 80% chance of remaining in office.
In general, I believe that the only way that Biden gets to be president is if everything basically holds together and works like it’s supposed to, and also Trump legitimately loses the EC. There is one way for everything to go right. There are many ways it can go wrong.
The NYT has fixated on the possibility that Trump clearly loses, but refuses to leave office anyway. I’d give this no more than a 1% chance of happening. But I think there’s a major blind spot around the possibility that we have no idea who won, because the whole thing is obfuscated by multiple layers of confusion and malfeasance. What tools to democrats have for investigating malfeasance? What tools do they have for persuading people that they won when the results are in question? What tools to they have for enforcing election laws that they didn’t have in 2017?
I think they have approximately one asset, and it’s a populace that’s willing to rise up in defense of their rights. But the DNC spent the last five-ish years antagonizing and alienating anyone left of Dianne Feinstein, so, the efficacy of a potential national mobilization has been severely compromised.
Any protracted contested election scenario either favors Trump remaining in power, or the eventual balkanization of the US. One reason there are no good scenarios for a contested election is that mainstream media has been so adamant that the election is secure. When the Democrats are trying to contest results, they will be struggling against their own narrative.
Then, I add a 10% chance that a last minute October surprise tips the race to Trump. It happened last time, and Comey wasn’t even trying; now that every government office is staffed with Trump appointees who are trying, they have a decent shot at this.
Summing up these odds, I arrive at Trump having around a 70% chance.
Then, I add another 5%, because I bet there’s things I haven’t thought of, and every year there’s some small chance that the far right will go all in on a race war, and this would be a good opportunity for them.
I will take actual bets on these odds.
My biases:
Numerous.
I grew up in a red community in a red state and was bullied a lot by kids who grew up to be far-right; I have a chip on my shoulder about this that precludes dispassionate analysis.
I believe the RNC has looked at US demographic trends and likely consequences of climate change, and has accepted a certain amount of fascistic will to power as a necessary evil. This is mere supposition on my part.
Despite the fact that I am more or less an asshole stoner burnout weeb, I remain convinced that the editorial staff at the NYT and several other major American journalistic institutions are somehow even dumber than I am. Although this may sound unlikely, this assumption has been invaluable for making predictions about the world.
I am a paranoid person.
My motivations for writing this:
Believe it or not, I’m only doing this to assuage anxiety. I’ve been convinced that Trump’s odds for remaining in office have been significantly higher than polls would suggest since 2018, and it’s maddening to see so few other people agree even though my core assumptions keep not going away.
If anyone read this far: I’m sorry, and I hope this motivates you to vote, if you weren’t going to already. If Trump remains in office, protests against him will benefit from having the mandate of a clear popular vote win, even if not an EC win, so I do believe that even people outside battleground states should vote.
I don’t know about Tumblr, but on Twitter, ‘no-hopers’ are characterized (fairly or not) as being defeatist Bernie bros who think that Trump should win the election to teach the DNC a lesson. I disavow this idea in the strongest possible terms. I think Biden can win and urgently should win. But every time I see someone talking about the Biden presidency as if it were a sure thing, it takes another year off my lifespan.
No matter what happens, we will be fighting racism and corruption for the rest of our lives, because that’s what ethical behavior entails in this world. But a Biden term vs. a second Trump term are in no way equivalent, and things can still get worse.

The New York Times is literally a propaganda outlet and Timothy Egan is a deceitful chode. His every word drips with the anxious desperation of the Democrats who know their goose is cooked.
Watching “Succession,” the HBO show about the most despicable plutocrats to seize the public imagination since the Trumps were forced on us, made me want to tax the ultrarich into a homeless shelter. And it almost made a Bernie Bro of me.
That’s the thing about class loathing: It feels good, a moral high with its own endorphins, but is ultimately self-defeating. A Bernie Sanders rally is a hit from the same pipe: Screw those greedy billionaire bastards!
Sanders has passion going for him. He has authenticity. He certainly has consistency: His bumper-sticker sloganeering hasn’t changed for half a century. He was, “even as a young man, an old man,” as Time magazine said.
But he cannot beat Donald Trump, for the same reason people do not translate their hatred of the odious rich into pitchfork brigades against walled estates.
Because powerful oligarchs that own their government murder them with impunity when they do.
>March 7 was a bitterly cold day in Detroit, and a crowd estimated at between 3,000 and 5,000 gathered near the Dearborn city limits, about a mile from the Ford plant. The Detroit Times called it "one of the coldest days of the winter, with a frigid gale whooping out of the northwest". Marchers carried banners reading "Give Us Work, "We Want Bread Not Crumbs", and "Tax the Rich and Feed the Poor". Albert Goetz gave a speech, asking that the marchers avoid violence. The march proceeded peacefully along the streets of Detroit until it reached the Dearborn city limits.

The unarmed crowd scattered into a field covered with stones, picked them up, and began throwing stones at the police. The angry marchers regrouped and advanced nearly a mile toward the plant. There, two fire engines began spraying cold water onto the marchers from an overpass. The police were joined by Ford security guards and began shooting into the crowd. Marchers Joe York, Coleman Leny and Joe DeBlasio were killed, and at least 22 others were wounded by gunfire.

Give Sanders credit for moving public opinion along on a living wage, higher taxes on the rich and the need for immediate action to stem the immolation of the planet. Most great ideas start on the fringe and move to the middle.
But some of his other ideas are stillborn, or never get beyond the fringe. Socialism, despite its flavor-of-the-month appeal to young people, is not popular with the general public. Just 39 percent of Americans view socialism positively, a bare uptick from 2010, compared with 87 percent who have a positive view of free enterprise, Gallup found last fall.

This is ignoring for the moment that due to Americans’ piss-poor education system they have no idea what “Socialism” means aside from “more government.” Looking at the breakdown of results, it seems as though they just asked people off the top of their head what they thought about X, no definition or elaboration given. In conversations on the sidelines of a DNC executive committee meeting and in telephone calls and texts in recent days, about a half-dozen members have discussed the possibility of a policy reversal to ensure that so-called superdelegates can vote on the first ballot at the party’s national convention. Such a move would increase the influence of DNC members, members of Congress and other top party officials, who now must wait until the second ballot to have their say if the convention is contested.
They deny it in the article, claim that changing the rules would be “bad sportsmanship,” but one would be a fool to believe them. If anything, their ambivalence towards relying on Superdelegates would make me even more nervous at this stage. Politico wants it to seem like the DNC is bent on playing fair, but more likely than not they have no intention of changing the convention rules because they believe there’s no need. With Warren’s flagging support and the luke-warm response to Biden, I doubt they’re overcome with optimism of beating Sanders in an honest primary. With all the shenanigans from last time’s primaries in mind, it’s likely that the machinery to rig the results their way is already in place—the primary could already be over before it even begins.

As More Diverted Floodwaters Head Their Way, Dolphins Keep Dying in Louisiana

As an unprecedented amount of floodwater makes its way down the Mississippi River, the U.S. Army Corps of Engineers today opened the Bonnet Carre Spillway for the second time this year. Done to prevent New Orleans from being flooded, the action marks the first time the spillway, which diverts the Mississippi’s nutrient- and pollutant-heavy freshwater into Lake Pontchatrain, has been opened twice in the same year.
The historic opening of the spillway is happening in the midst of an ongoing and mysterious dolphin die-off in the Gulf of Mexico and the same week that the United Nations released its most comprehensive report on the state of biodiversity.
The report warns that the rate species are going extinct is speeding up and can only be slowed by simultaneously combating climate change and directly protecting species and their habitats. But in Louisiana, despite more frequent and intense extreme weather and the current dolphin die-off, the local, state, and federal governments are showing little political appetite to deal with either.
Only yesterday the Corps announced it would open the spillway again this year, but quickly moved up the planned date of May 14 to May 10 after regional rainfall caused the Mississippi River to rise 6 inches in 24 hours, with more rain expected this weekend.
The diverted freshwater will make its way from Lake Pontchartrain to the Breton and Mississippi Sounds, where a dolphin die-off is underway. The Breton Sound, a fish- and oyster-rich estuary where salt and freshwater meet, is located about 35 miles southeast of New Orleans and leads into the Gulf of Mexico. Historically, freshwater from the Mississippi River fed the sounds, but devices like locks and dams have drastically reduced the water flow into them over the years, creating more brackish environments than normal. These water-control mechanisms, created to protect human developments along the Mississippi River, allow for controlled releases such as the one today.
A Meeting Postponed
This morning, May 10, inclement weather postponed a meeting scheduled for the National Oceanic and Atmospheric Administration (NOAA), the lead agency investigating the dolphin deaths to meet with the Louisiana Department of Wildlife and Fisheries (LDWF); the Army Corps of Engineers; the National Audubon Society; and local officials and fishermen in St. Bernard Parish to discuss how to respond to the dolphin die-off.
“Everything is weather-related in Louisiana,” said Randy Myers of LDWF when he alerted me of the postponed meeting. His comment comes off as particularly poignant in a state where climate science deniers continue to govern as if humankind's role in climate change were insignificant.
On May 1, Gov. John Bel Edwards tripled-down on climate denial at the Grow Louisiana Coalition “Oil and Natural Gas Industry Day” in Baton Rouge. Edwards acknowledges that the climate is changing but diverges from mainstream climate science by saying he is unsure what humanity's role is. His stance is echoed by his administration’s efforts to welcome new oil and gas industry projects in the state, including numerous petrochemical plants.
‘This is not normal’
George Ricks, a fishing charter boat captain, and founder of The Save Louisiana Coalition, was disappointed that the meeting with NOAA was canceled. He and other fishermen in St. Bernard Parish have taken to monitoring the recent dolphin die-off on their own. I accompanied him on a monitoring trip on May 7. We found three dead dolphins in three hours.
“This is not normal,” Ricks said, visibly upset when our boat approached each dolphin. In the 52 years he has been out on the water in this area, he had only come across two dead dolphins, and those were likely killed by boat strikes, he told me. This year he started spotting dead dolphins on April 10. Two were found within two miles of each other. Since then, he has documented 36 dead dolphins, including the three we found that day.
Ricks cringes when he hears people talk about how natural it is for freshwater from the river to come into the estuary. “If the Mississippi River was a babbling brook, we would be OK,” he says, “but we are talking about the second-most polluted river in the United States, loaded with benzene, mercury, phosphates, nitrates, all the fertilizer from farming practices — the same river causing the dead zone in the gulf every year, but that is what we have emptying into our estuaries, and this is the result of it. These animals just can’t take it.” For oystermen, the opening of the spillway is always a cause for concern because it leads to plummeting water salinity levels as the freshwater suddenly dilutes the estuary’s brackish waters, which can kill the oysters they harvest.
Watching for Impacts
Today, an LDWF press release said the agency is continuing to monitor the area’s fish and wildlife, an effort began with the first spillway’s opening on Febuary 25. It is monitoring Louisiana’s oyster, shrimp, and crab populations, as well as impacts to federally managed marine mammals and sea turtles.
“It is likely some oyster beds will see an impact, especially if salinities remain low and water temperatures rise,” said Patrick Banks, LDWF Assistant Secretary for Fisheries, “but we are confident that the areas will be able to rebound just as Mother Nature intended.”
St. Bernard Parish President Guy McInnis declared a state of emergency today due to the second spillway opening because it will impact hundreds of his parish’s residents who depend on the local seafood industry. The parish government wrote in a statement on its social media page that preliminary feedback from the LDWF suggesets the dolphins might be suffering from freshwater lesions due to the Bonnet Carre Spillway’s openings, but the science isn’t conclusive on the die-off’s cause. Ricks doesn't think enough is being done to uncover the cause of the dolphins’ demise. He wonders if politics are preventing an aggressive investigation into the die-off and believes that if the public became aware that the river’s water is implicated in killing dolphins, then public opinion might turn against the diversion projects, which are key to the state’s Coastal Master Plan to rebuild and protect Louisiana’s diminished coast.
These projects, the proposed Mid-Barataria and Mid-Breton sediment diversions, are part of the state's plan to reduce coastal land loss. While the projects have wide support, they required a waiver from the Marine Mammal Protection Act, to all construction without further study of whether they will harm marine mammals, including dolphins.
I asked the Louisiana Department of Wildlife and Fisheries when it last monitored the dolphin die-off situation. Myers told me the agency is activity monitoring but couldn't tell me the specifically the last time the agency checked in the Breton Sound. With more Mississippi River water headed that way, Ricks plans to keep a watchful eye on the area, with or without the help of government agencies.
A Glimpse of the Future?
Criticism of the two proposed diversion projects comes mostly from oystermen and charter boat operators but the projects’ supporters readily dismiss the criticism, saying the state has to do something to protect and rebuild the disappearing coast. Louisiana has been losing coastal land for decades due to damage done by the oil and gas industry, extreme weather events and sea level rise worsened by climate change and subsidence, among other causes.
Ricks insists he isn’t just opposing the sediment diversions because the projects will impact his business. He also points to the U.S. Army Corp of Engineers report, released in March, on managing the Lower Mississippi River Delta. According to this report, “the morphologic modeling results for the diversion scenario analyses show net land gain in the near vicinity of the diversion outlets and net land loss farther away from the outlets.” In other words, these types of projects would likely build the same amount of land in one area that they erode elsewhere.
Ricks sees the report as a vindication of his belief that the sediment diversion projects could end up destroying as much land as they create.
Warnings Coming True
In March, NOAA forecasters noted the high risk of “major flooding due to well-above-normal precipitation, snowmelt, saturated soils, and frozen ground” in areas feeding the Mississippi River this spring.
And this week, NOAA reported that 313 river gauges across the United States showed levels above flood stage. All but five of those gauges were in the U.S. heartland, mostly within the Mississippi River watershed.
Just last year federal scientists warned that impacts to the Gulf of Mexico region, such as worsening floods, heat waves, and sea level rise, will intensify as the globe continues warming. While a global chorus of scientists say there is still time to avoid the worst impacts of climate change, that time is quickly running out.

American Democracy Is in Crisis: Our democratic institutions and traditions are under siege. We need to do everything we can to fight back.
It’s been nearly two years since Donald Trump won enough Electoral College votes to become president of the United States. On the day after, in my concession speech, I said, “We owe him an open mind and the chance to lead.” I hoped that my fears for our future were overblown.
They were not.
In the roughly 21 months since he took the oath of office, Trump has sunk far below the already-low bar he set for himself in his ugly campaign. Exhibit A is the unspeakable cruelty that his administration has inflicted on undocumented families arriving at the border, including separating children, some as young as eight months, from their parents. According to The New York Times, the administration continues to detain 12,800 children right now, despite all the outcry and court orders. Then there’s the president’s monstrous neglect of Puerto Rico: After Hurricane Maria ravaged the island, his administration barely responded. Some 3,000 Americans died. Now Trump flatly denies those deaths were caused by the storm. And, of course, despite the recent indictments of several Russian military intelligence officers for hacking the Democratic National Committee in 2016, he continues to dismiss a serious attack on our country by a foreign power as a “hoax.”
Trump and his cronies do so many despicable things that it can be hard to keep track. I think that may be the point—to confound us, so it’s harder to keep our eye on the ball. The ball, of course, is protecting American democracy. As citizens, that’s our most important charge. And right now, our democracy is in crisis.
I don’t use the word crisis lightly. There are no tanks in the streets. The administration’s malevolence may be constrained on some fronts—for now—by its incompetence. But our democratic institutions and traditions are under siege. We need to do everything we can to fight back. There’s not a moment to lose.
As I see it, there are five main fronts of this assault on our democracy.
First, there is Donald Trump’s assault on the rule of law.
John Adams wrote that the definition of a republic is “a government of laws, and not of men.” That ideal is enshrined in two powerful principles: No one, not even the most powerful leader, is above the law, and all citizens are due equal protection under the law. Those are big ideas, radical when America was formed and still vital today. The Founders knew that a leader who refuses to be subject to the law or who politicizes or obstructs its enforcement is a tyrant, plain and simple.
That sounds a lot like Donald Trump. He told The New York Times, “I have an absolute right to do what I want to with the Justice Department.” Back in January, according to that paper, Trump’s lawyers sent Special Counsel Robert Mueller a letter making that same argument: If Trump interferes with an investigation, it’s not obstruction of justice, because he’s the president.
The Times also reported that Trump told White House aides that he had expected Attorney General Jeff Sessions to protect him, regardless of the law. According to Jim Comey, the president demanded that the FBI director pledge his loyalty not to the Constitution but to Trump himself. And he has urged the Justice Department to go after his political opponents, violating an American tradition reaching back to Thomas Jefferson. After the bitterly contentious election of 1800, Jefferson could have railed against “Crooked John Adams” and tried to jail his supporters. Instead, Jefferson used his inaugural address to declare: “We are all republicans, we are all federalists.”
Second, the legitimacy of our elections is in doubt.
There’s Russia’s ongoing interference and Trump’s complete unwillingness to stop it or protect us. There’s voter suppression, as Republicans put onerous—and I believe illegal—requirements in place to stop people from voting. There’s gerrymandering, with partisans—these days, principally Republicans—drawing the lines for voting districts to ensure that their party nearly always wins. All of this carries us further away from the sacred principle of “one person, one vote.”
Third, the president is waging war on truth and reason.
Earlier this month, Trump made 125 false or misleading statements in 120 minutes, according to The Washington Post—a personal record for him (at least since becoming president). To date, according to the paper’s fact-checkers, Trump has made 5,000 false or misleading claims while in office and recently has averaged 32 a day.
Trump is also going after journalists with even greater fervor and intent than before. No one likes to be torn apart in the press—I certainly don’t—but when you’re a public official, it comes with the job. You get criticized a lot. You learn to take it. You push back and make your case, but you don’t fight back by abusing your power or denigrating the entire enterprise of a free press. Trump doesn’t hide his intent one bit. Lesley Stahl, the 60 Minutes reporter, asked Trump during his campaign why he’s always attacking the press. He said, “I do it to discredit you all and demean you all, so when you write negative stories about me, no one will believe you.”
When we can’t trust what we hear from our leaders, experts, and news sources, we lose our ability to hold people to account, solve problems, comprehend threats, judge progress, and communicate effectively with one another���all of which are crucial to a functioning democracy.
Fourth, there’s Trump’s breathtaking corruption.
Considering that this administration promised to “drain the swamp,” it’s amazing how blithely the president and his Cabinet have piled up conflicts of interest, abuses of power, and blatant violations of ethics rules. Trump is the first president in 40 years to refuse to release his tax returns. He has refused to put his assets in a blind trust or divest himself of his properties and businesses, as previous presidents did. This has created unprecedented conflicts of interest, as industry lobbyists, foreign governments, and Republican organizations do business with Trump’s companies or hold lucrative events at his hotels, golf courses, and other properties. They are putting money directly into his pocket. He’s profiting off the business of the presidency.
Trump makes no pretense of prioritizing the public good above his own personal or political interests. He doesn’t seem to understand that public servants are supposed to serve the public, not the other way around. The Founders believed that for a republic to succeed, wise laws, robust institutions, and a brilliant Constitution would not be enough. Civic, republican virtue was the secret sauce that would make the whole system work. Donald Trump may well be the least lowercase-R republican president we’ve ever had.
Fifth, Trump undermines the national unity that makes democracy possible.
Democracies are rowdy by nature. We debate freely and disagree forcefully. It’s part of what distinguishes us from authoritarian societies, where dissent is forbidden. But we’re held together by deep “bonds of affection,” as Abraham Lincoln said, and by the shared belief that out of our fractious melting pot comes a unified whole that’s stronger than the sum of our parts.
At least, that’s how it’s supposed to work. Trump doesn’t even try to pretend he’s a president for all Americans. It’s hard to ignore the racial subtext of virtually everything Trump says. Often, it’s not even subtext. When he says that Haitian and African immigrants are from “shithole countries,” that’s impossible to misunderstand. Same when he says that an American judge can’t be trusted because of his Mexican heritage. None of this is a mark of authenticity or a refreshing break from political correctness. Hate speech isn’t “telling it like it is.” It’s just hate.
I don’t know whether Trump ignores the suffering of Puerto Ricans because he doesn’t know that they’re American citizens, because he assumes people with brown skin and Latino last names probably aren’t Trump fans, or because he just doesn’t have the capacity for empathy. And I don’t know whether he makes a similar judgment when he lashes out at NFL players protesting against systemic racism or when he fails to condemn hate crimes against Muslims. I do know he’s quick to defend or praise those whom he thinks are his people—like how he bent over backwards to defend the “very fine people” among the white nationalists in Charlottesville, Virginia. The message he sends by his lack of concern and respect for some Americans is unmistakable. He is saying that some of us don’t belong, that all people are not created equal, and that some are not endowed by their Creator with the same inalienable rights as others.
And it’s not just what he says. From day one, his administration has undermined civil rights that previous generations fought to secure and defend. There have been high-profile edicts like the Muslim travel ban and the barring of transgender Americans from serving in the military. Other actions have been quieter but just as insidious. The Department of Justice has largely abandoned oversight of police departments that have a history of civil-rights abuses and has switched sides in voting-rights cases. Nearly every federal agency has scaled back enforcement of civil-rights protections. All the while, Immigration and Customs Enforcement is running wild across the country. Federal agents are confronting citizens just for speaking Spanish, dragging parents away from children.
How did we get here?
Trump may be uniquely hostile to the rule of law, ethics in public service, and a free press. But the assault on our democracy didn’t start with his election. He is as much a symptom as a cause of what ails us. Think of our body politic like a human body, with our constitutional checks and balances, democratic norms and institutions, and well-informed citizenry all acting as an immune system protecting us from the disease of authoritarianism. Over many years, our defenses were worn down by a small group of right-wing billionaires—people like the Mercer family and Charles and David Koch—who spent a lot of time and money building an alternative reality where science is denied, lies masquerade as truth, and paranoia flourishes. By undermining the common factual framework that allows a free people to deliberate together and make the important decisions of self-governance, they opened the way for the infection of Russian propaganda and Trumpian lies to take hold. They've used their money and influence to capture our political system, impose a right-wing agenda, and disenfranchise millions of Americans.
I don’t agree with critics who say that capitalism is fundamentally incompatible with democracy—but unregulated, predatory capitalism certainly is. Massive economic inequality and corporate monopoly power are antidemocratic and corrode the American way of life.
Meanwhile, hyperpolarization now extends beyond politics into nearly every part of our culture. One recent study found that in 1960, just 5 percent of Republicans and 4 percent of Democrats said they’d be displeased if their son or daughter married a member of the other political party. In 2010, 49 percent of Republicans and 33 percent of Democrats said they’d be upset by that. The strength of partisan identity—and animosity—helps explain why so many Republicans continue to back a president so manifestly unfit for office and antithetical to many of the values and policies they once held dear. When you start seeing politics as a zero-sum game and view members of the other party as traitors, criminals, or otherwise illegitimate, then the normal give-and-take of politics turns into a blood sport.
There is a tendency, when talking about these things, to wring our hands about “both sides.” But the truth is that this is not a symmetrical problem. We should be clear about this: The increasing radicalism and irresponsibility of the Republican Party, including decades of demeaning government, demonizing Democrats, and debasing norms, is what gave us Donald Trump. Whether it was abusing the filibuster and stealing a Supreme Court seat, gerrymandering congressional districts to disenfranchise African Americans, or muzzling government climate scientists, Republicans were undermining American democracy long before Trump made it to the Oval Office.
Now we must do all we can to save our democracy and heal our body politic.
First, we’ve got to mobilize massive turnout in the 2018 midterms. There are fantastic candidates running all over the country, making their compelling cases every day about how they’ll raise wages, bring down health-care costs, and fight for justice. If they win, they’ll do great things for America. And we could finally see some congressional oversight of the White House.
When the dust settles, we have to do some serious housecleaning. After Watergate, Congress passed a whole slew of reforms in response to Richard Nixon’s abuses of power. After Trump, we’re going to need a similar process. For example, Trump’s corruption should teach us that all future candidates for president and presidents themselves should be required by law to release their tax returns. They also should not be exempt from ethics requirements and conflict-of-interest rules.
A main area of reform should be improving and protecting our elections. The Senate Intelligence Committee has made a series of bipartisan recommendations for how to better secure America’s voting systems, including paper ballot backups, vote audits, and better coordination among federal, state, and local authorities on cybersecurity. That’s a good start. Congress should also repair the damage the Supreme Court did to the Voting Rights Act by restoring the full protections that voters need and deserve, as well as the voting rights of Americans who have served time in prison and paid their debt to society. We need early voting and voting by mail in every state in America, and automatic, universal voter registration so every citizen who is eligible to vote is able to vote. We need to overturn Citizens United and get secret money out of our politics. And you won’t be surprised to hear that I passionately believe it’s time to abolish the Electoral College.
But even the best rules and regulations won’t protect us if we don’t find a way to restitch our fraying social fabric and rekindle our civic spirit. There are concrete steps that would help, like greatly expanding national-service programs and bringing back civics education in our schools. We also need systemic economic reforms that reduce inequality and the unchecked power of corporations and give a strong voice to working families. And ultimately, healing our country will come down to each of us, as citizens and individuals, doing the work—trying to reach across divides of race, class, and politics and see through the eyes of people very different from ourselves. When we think about politics and judge our leaders, we can’t just ask, “Am I better off than I was four years ago?” We have to ask, “Are we better off? Are we as a country better, stronger, and fairer?” Democracy works only when we accept that we’re all in this together.
In 1787, after the Constitutional Convention in Philadelphia, Benjamin Franklin was asked by a woman on the street outside Independence Hall, “Well, Doctor, what have we got, a republic or a monarchy?” Franklin answered, “A republic, if you can keep it.” That response has been on my mind a lot lately. The contingency of it. How fragile our experiment in self-government is. And, when viewed against the sweep of human history, how fleeting. Democracy may be our birthright as Americans, but it’s not something we can ever take for granted. Every generation has to fight for it, has to push us closer to that more perfect union. That time has come again.
Never Forget: this brilliant woman won 3 million more votes than her opponent.

I'm sure the "no need to panic" brigade would want us to point out that this affecting "only" hundreds or thousands of Latinx Americans living in a narrow region along the border.
But.
First of all, that's too many people.
Because...
Because here is the thing about due process.
Everybody gets it, or no one really has it.
And from the moment the Trump regime decided it just doesn't apply to "illegal" immigrants, we were always heading here.
Some (white) people replied to suspension of due process for non-citizens by saying "Well, I could prove my citizenship easily." But how do you do that when you're not entitled to any process to prove anything?
If we passed an amendment to the Constitution saying that Constitutional protections don't apply to waterbed repair technicians named Sleven Trusbucket, all the government would have to do is say that's you and you would be out of options for proving them wrong.
And to the sort of person who is sure that life operates on formal logic and strict proof, the sort of person who is sure if they can present the right argument just the right way they can convince anyone of the truth of anything, it feels like there must be some way around that.
But that's part of the horror of a situation like this, part of why Kafka's The Trial is so viscerally uncomfortable to read. The proof does not matter if no one is bound to accept the proof. It feels like it should. It always feels like truth should matter, proof should matter.
Now I said long ago, and again at the head of this thread, that we're past the point of "first they came for". For most of the people reading this, they're still not up to "they came for me", and probably won't be for a while. They're working to expand the ranks of "non-American"
They redefined huge swathes of undocumented immigrants -- including ones working with the system to fix their status -- as "criminals" and "gangmembers" and "animals". They slammed the door in the face of immigrants with papers, finding pretexts to call them "illegal".
They started revoking the citizenship of naturalized citizens for whatever excuse they could find, and the next step is to strip citizenship of natural born citizens who don't fit their profile of a Real American.
Right now their excuse for doing so is restricting them to people born in a border region but the excuse will widen and so will the scope of the action.
And they aren't just moving in one direction here. They've been revoking the passports of trans people while all this is happening.
Now, the flipside of revoking citizenship and "deporting" someone is: the United States cannot bestow citizenship for another country. Just because the man in the low castle thinks someone looks "Mexican" doesn't mean they default to that when they lose US citizenship.
There's been a lot of talk on Twitter about the dangers of statelessness, in regard to Canada and ending birthright citizenship (something the Trumpers would love to do if they can swing it.)
People who lose their citizenship are thrown into a legal limbo, effectively becoming unpersoned for many purposes.”

And while nationalists whip up fear of the foreign, they hate and despise the stateless even more. They're deliberately making the "immigration crisis" worse.
Nazi apologists will be happy to tell you that the great humanitarian Hitler tried so hard to get Jewish Germans settled happily and healthily elsewhere but that no one would take them in, thus leaving him with a problem in need of a final solution.
So what's going to happen when Trump has stripped citizenship from everyone who doesn't "look American", doesn't "look like they should be voting", but there's nowhere to deport all these people, no home country for them to return to?
And maybe you're thinking that we don't have the resources to actually disenfranchise and denaturalize *everybody* who doesn't "look American" buuuut the magic of not giving due process is they don't have to.
If you knew that people whose last names are in the same language as yours are getting rounded up, stripped of rights, and arrested when they go to apply for or renew a passport... how dire would it have to be, before you'd dare try?
And then what if it expands to, say, people showing up at polling places? DMVs? Hospitals?
What if it goes on to the point where "everyone knows" that people with certain names and/or skin tones aren't really citizens and don't have to be afforded any particular rights?
Before the SCOTUS struck down sodomy laws, in a lot of states being seen as gay could be used to justify just about any level of discrimination. Gay couple needs an apartment? "We can't make landlords rent to a criminal if they don't want to." Were the couple ever convicted? No.
But ~*everybody knew*~ what gay people got up into their bedrooms was illegal, doing illegal things made you a criminal, and being a criminal was grounds for termination, eviction, expulsion, exclusion.
Or if you want to see what the future of law enforcement looks like in a fascist state, look at the standards used to arrest and prosecute sex workers.
For years now, in the land of Innocent Until Proven Guilty, you could be arrested for "suspicion" of a victimless crime because of entirely legal materials in your purse and entirely legal conduct within a place you had every legal right to be.
The actual ideal is that the cops could know you're a sex worker, could know for a certain fact that you're engaged in sex work, but if they couldn't prove it then you are an innocent in the eyes of the law. That's how it's supposed to work and how it works for some crimes.
Everyone in town can know that J. Doe up on the hill beats his wife and kids but if the cops can't prove it they will tell you nothing can be done, and proof has to be more than the fear in their eyes or bruises on their arms. Or even him "allegedly" bragging about it.
Meanwhile they'll pick people up off the street for ~*suspicion*~ of sex work and "prove" it through entirely circumstantial means, none of which points to actual lawbreaking.
Now here's the crux of that: being able to claim that any woman carrying condoms (for instance) is a sex worker doesn't mean they detain everyone and make them turn out their pockets.
It just gives them a tool, a weapon, to use when they feel like it.
And that's the future of policing. Increasingly broad rules that could apply to increasingly wide swaths of the population, that can be deployed by the authorities when someone "looks" like they might be trouble, much less starts to actually make any.
They practice these techniques on populations they think they can get away with practicing them on, and when they do get away with it, they start looking to expand.
Cf. stop and frisk in New York City, where white kids were more likely to have marijuana but less likely to be stopped and ordered to turn out their pockets. It was a tool of control.
Obviously I'm talking about practices that go back years before when Trump came to power. He's part of a progression, not the source.
And if you want to know where the progression is heading, just look at how the law has treated people on the margins since the year seventeen seventy forever.
That's where we're heading.
And I don't think enough people are alarmed enough by this.
I saw somebody QTing the Washington Post story at the head of this thread with "And Democrats want to tell us to vote every two years like that's enough."
It's not enough. But we haven't been voting every two years, and that's part of how we got here. Just part. A crucial part.
I think we should add this (specifically: stripping people near the border of citizenship) to the things we call our representatives about, especially but not only if you're in Texas. And if we can vote in a Democratic majority we'll have more tractable reps to yell at about it.

A scary thing in all of this: the wave of revocation of trans passports I alluded to upthread doesn't appear to have *originated* anywhere. Select federal employees just decided it's time to start doing it.
I can't tell you from the outside which escalations of "enforcement" (to abuse the term) against immigrants and what I guess are "accused immigrants" among citizens were also spontaneous decisions made at the level at which they occur but I'm sure some of them were.
What I'm saying is, there have always been people within the federal enforcement apparatus and bureaucracy who were waiting for favorable winds to launch their warships.

With so much of this enforcement being subjective and self-directed, it is also decentralized. Which makes it harder to block or even attack.

I know people are waiting for a point where it feels real, where it really feels like Nazi Germany. That point is going to be too far along to have any practical chance of stopping it.
Instead it's going to keep happening piecmeal and every time it happens, those who sound the alarm will be met with "You're overreacting, this isn't like a law against Jewish business ownership, this is only affecting a specific group of people in specific circumstances."
Relax: The monster's not eating your whole body, it's just eating one bite at a time.
The piecemeal, self-directed, subjective nature of these actions makes them harder to fight. Bank of America, the State Department, and DHS are all saying the same thing when questioned on this: "This is the same policy we've always followed." It's just being applied differently.
"We've always exercised discretion..." but now it's being exercised in different directions, towards different ends.
Someone asked what to do, besides be scared:
Make a lot of noise. If we are silent, we are complicit. If the only voices heard are those who support what's happening, they can claim universal assent.
If you work in a workplace, try telling your coworkers, "You know, they're taking citizenship away from people who live near the borders. If they can do that to anyone, they could do that to us. I don't think it's right." You don't have to make it partisan or anti-Trump.
Yell at your elected representatives. Democratic politicians should be aware that the GOP is reshaping the electorate in their favor. It's cynical, but they have to care about that.
Tweet about it, share it on social media. These things are not sufficient but they are necessary.
Vote in November. Same.
I know it feels like making noise isn't doing anything except complaining and we're taught that talk is the opposite of action but I promise you: talk is an action. When there is enough of an outcry they back down. Not all the way always. But slowing and mitigating damage helps.

WASHINGTON — Roger Stone has always lived in a dog-eat-dog world.
So it was apt that he was charged with skulduggery in part for threatening to kidnap a therapy dog, a fluffy, sweet-faced Coton de Tuléar, belonging to Randy Credico, a New York radio host.
Robert Mueller believes that Credico, a pal of Julian Assange, served as an intermediary with WikiLeaks for Stone. Mueller’s indictment charges that Stone called Credico “a rat” and “a stoolie” because he believed that the radio host was not going to back up what the special counsel says is Stone’s false story about contacts with WikiLeaks, which disseminated Russia’s hacked emails from the D.N.C. and Hillary Clinton’s campaign chairman.
Stone emailed Credico that he would “take that dog away from you,” the indictment says, later adding: “I am so ready. Let’s get it on. Prepare to die (expletive).”
As the owner of two Yorkies, Stone clearly knows how scary it is when a beloved dog is in harm’s way. When he emerged from court on Friday, he immediately complained that F.B.I. agents had “terrorized” his dogs when they came to arrest him at dawn at his home in Fort Lauderdale.
The last thing Stone posted on Instagram before his arrest was a video of a terrier, with a high-pitched voice-over, protesting, “Roger Stone did nothing wrong.”
Always bespoke and natty, living by the mantra that it’s better to be infamous than never famous, Stone looked strangely unadorned as he came out of court to meet the press in a navy polo shirt and bluejeans.
As the master of darkness who had been captured in darkness stepped into the bright light of Fort Lauderdale, he was his usual flamboyant, unapologetically meretricious self. He proclaimed his innocence, flashed the Nixon victory sign and reiterated the old saw from his mentor, Roy Cohn, that any attention is good attention.
But it fell flat. Being Roger Stone had finally caught up with him.
He has always said Florida suited him because “it was a sunny place for shady people,” borrowing a Somerset Maugham line. But now the cat’s cradle of lies and dirty tricks had tripped up the putative dognapper. And it went down on the very same day that Paul Manafort — his former associate in a seamy lobbying firm with rancid dictators as clients, and then later his pal in the seamy campaign of Donald Trump — was also in federal court on charges related to the Mueller probe. Manafort’s hair is now almost completely white.
One of Stone’s rules — along with soaking his martini olives in vermouth and never wearing a double-breasted suit with a button-down collar — is “Deny, deny, deny.” But his arrest for lying, obstructing and witness tampering raised the inevitable question about his on-and-off friend in the White House, the man who is the last jigsaw-puzzle piece in the investigation of Trumpworld’s alleged coordination with Russia: Is being Donald Trump finally about to catch up with Donald Trump?
Stone, who famously has Nixon’s face tattooed on his back, is the agent provocateur who is the through line from Nixon, and his impeachment, to Trump, and his possible impeachment.
As Manafort said in the 2017 documentary “Get Me Roger Stone,” Trump and Stone “see the world in a very similar way.” And that way is theatrical and cynical. Do whatever you have to do to get what you want; playing by the rules is for suckers.
In 1999, when I went on a trip to Miami to watch Trump test the presidential waters, Stone orchestrated Trump’s Castro-bashing speech to Cuban-Americans. The bodybuilding, swinging strategist, christened “the state-of-the-art sleazeball” by The New Republic in the 80s, said he was “a jockey looking for a horse.”
Stone, who was mixed up in Watergate at the tender age of 19, “made the transition from the Stone Age of dirty tricks to today,” as David Axelrod puts it.
He watched Nixon rally the silent majority with a law-and-order message and racial dog whistling. He helped Ronald Reagan create Reagan Democrats.
For decades, believing “past is prologue,” Stone urged Trump to be the successor to those pols, revving up angry, white working-class voters who felt belittled or scared of “the other.” It would be so easy to divide and stoke resentment, as Stone and Trump proved when they inflamed the birther controversy against Barack Obama.
“Hate is a stronger motivator than love,” Stone told the documentarians. “Human nature has never changed.”
The tribal tensions in America made Stone’s favorite tricks easier than ever; he didn’t have to operate in the shadows. He wore a T-shirt with Bill Clinton and the word “Rape” at 2016 campaign rallies. As Stone boasted in the documentary, his “slash-and-burn” tactics “are now in vogue.”
Trump has had periods of estrangement with Stone. In 2008, in an interview with The New Yorker, he called the strategist “a stone-cold loser,” a state Trump himself has been relegated to this past week, courtesy of Nancy Pelosi.
Stone will not go gently. When he is asked about the tattoo of Nixon, he says he got it to remind himself, “A man is not finished when he is defeated; he is only finished when he quits.”
At the moment, though, dogged by Mueller, Stone and Manafort are the dog’s breakfast. The pair has given practicing the dark arts a bad name.

Trump signed an executive order to abolish what he did....
I don’t normally come in here to post long political pieces. However, after the disgusting comments that I’ve read on social media as Democrats held a press conference to speak about children being ripped apart from their parents at the border, is more than I can take. So, because I am pretty fucking annoyed with all the baseless accusations, and major misinformation I would like to dispel erroneous conclusions along with the comments I have been seeing on social media.
Immigrants are taking our jobs!
No Becky, they’re not. Immigrants are bringing in jobs and taking the low wage, often dangerous and non-union jobs that YOU don’t want to take. How about you go pick those strawberries in the blazing heat for as little as 6$ an hour, doesn’t sound very appealing right? So if it’s not good enough for you because you want a cushy job, what makes you think Immigrants want to do it too? They don’t, but they’re so desperate to make a living that they’re willing to do anything so long as they can provide a better future for their own families, something you can easily understand. As a matter of fact, while you enjoy your burrito know that none of it would be possible if it wasn’t for an immigrant who brought in their culture and food to enrich our country. Yeah, that big old Mexican franchised fast food joint? Would not have existed for your high school kids to work at, so while your sitting on your ass enjoying someone else’s culture, know that none of it

Noooo, Immigrant individuals cannot ever receive federal based help such as SSI. They can’t even get health insurance. Some states do hand out some help to aid immigrants but it would only be something as small as being able to use the WIC program which is very limited. (I’ve used it when I had just given birth). As a matter of fact, white citizens are amongst the highest percentage who receive federal assistance and immigrant people pay INTO our social security and taxes without hope of ever getting that money back. If you want to talk about needlessly spending your money on immigrants then you should definitely be against the barbaric procedures that are happening right the hell now. There are companies profiting from your taxpayer money in order to house children that didn’t need to be housed in the first place. It’s all a big scam and those 1 % who don’t really need the money are making millions that you’re paying into JUST because you want to be a paranoid idiot. It’s a pretty simple concept actually, it’s called security theater. Except this theater is of the Third Reich.

Oh Brandon, you xenophobic dick. First of all the Obama and Bush administration NEVER placed an order of removal between the parents and their children. What is true is that there is no law saying these current atrocities have to be carried out. Crossing the border illegally is a misdemeanor that can get you jailed for up to 20 days or so and then you’re automatically sent to your country of origin. The immigrant parents who are caught with their children are never separated from them and there are no real lasting repercussions. If I was to take your reasoning into account then that would mean people who have had a DUI, or those who have been arrested for public disturbance should have their children taken away as well? Secondly, when the Obama administration implemented certain facilities to house kids it was due to an immense influx of unaccompanied minors who were immigrating to the USA by their damn selves. Most, of these children, were from Central America and were not deemed a threat to the nation after very careful vetting. These kids ranged between the ages of 12-17 years old and they were TEMPORARILY housed or often placed in foster homes with other immigrant adults till the Government could get a hold of their parent. Of course, everything wasn’t always handled perfectly as there were a ton of problems because sometimes the foster parents would refuse to answer their phones to various federally appointed counselors or even gave the Government the wrong information. Some of the facilities in which the children were housed were not as top notch as we expected and there were abuses happening at the time. But by that point, the children were really alone. They didn’t come in with their parents to protect them and sadly things didn’t always go the right way. The few kids who were separated from the adult were either trafficked here or were in deep danger of those adults that surrounded them
They should come here legally if they want to enter the country!
Kathy, you sad simpleton. Looking for Asylum is not against the law. Actually, the ports of entry for refugees are being blocked by ICE agents to deter them from reaching the United States legally. Usually, when an immigrant came to the port of entry looking for asylum they would have to bring proof which then they would be taken to a holding facility where their case was carefully reviewed and then after about a month or so they would either be allowed to stay or leave depending on the severity of their situation. Now, Looking for a way to come to the united states legally especially in countries that are extremely corrupt is very difficult. I myself applied for a visa in order to come to the united states twice and both times it was denied even though I was a 4-year-old child who was about to die of a severe heart condition. If it hadn’t been for a charitable company that had put their name behind me and petitioned for me to travel I would never have even set a foot in the United States and I would never be able to write this because I’d be dead by now. That’s how difficult everything is. The immigration system is so broken and instead of looking for a solution you shining citizens can only proclaim your distaste for a president that hasn’t been in office for over 2 years. Obama, Bush, or Clinton are no longer running the country. Take responsibility for the mistakes YOUR amoral president is making.

Ms-13 is a Mexican terrorist group that has been used as a cop out to paint innocent people who are Latino and Hispanic in an unflattering light. Gang members don’t really want to come here, their profit is not here. They are already immensely powerful in Mexico, why leave if things are good for them? It makes no sense and if again I were to take your reasoning into consideration I would say that other countries should never allow an American entry because they could be from the KKK. What makes sense is to have a racist, xenophobic, sexist president using something like gang violence in order to disenfranchise a group of people who don’t match his ideas for the perfect immigrant. Case in point, he very clearly said he would like Europeans (meaning Caucasians) to immigrate here (They wouldn’t. Europe is not perfect but at least it has universal health care among other things.) Mexicans, meaning all Latino because that how you all like to categorize us not realizing that Latinos are very diverse but those of us who are brown in complexion are rapists, killers, we’re infesting the country, we’re bringing disease, we’re animals among other ludicrous things Trump has said about the Latino community and for the record, not all immigrants are Mexican. Most at this point are from Central America. It's the same as not all Asians are Chinese, not all black people are thugs and not all white men who wear penny loafers are entitled pricks who call on their daddies to fix their problems. You see how stereotypes work? Those of you who applaud him while desecrating the flag by wearing it as a shirt or bandana and eating off of flag emblazoned paper plates like to think you’re somehow better and patriotic because you won the lottery by being born here. It’s as simple as that and if you want the immigrants to fix their problems back home maybe tell your government not to meddle in their democratic systems. It’s a cop-out to make yourselves feel better about the atrocities that are happening.

Yes Brayden, because a wall is gonna stop a bunch of plane riding immigrants to come to the United States. Newsflash, most people who end up here illegally came here legally through a visa but overstayed their welcome. Most of the people who came here otherwise, seek asylum, which is not illegal. There are actually very few people who cross the border illegally and stay here. No one wants to leave their life, culture, and language behind unless it’s absolutely necessary. The wall will stop nothing. Separating kids and now babies from their parents have not deterred the parents from continuing their long arduous trips to the United States. The wall only serves as a trophy for the GOP to pat themselves on the back and say what good little legislators they are. It’s a sign of oppression and a sign of unwelcoming. It’s as if I had a picture of Jesus in my living room but a satanic altar in the next room. It’s counterproductive and we’re the ones who are gonna pay for it. Mexico will pay for nothing even if Trump is holding these children hostages. The procedures are very eerily being carried out in much the same way the Nazi's carried out their atrocities. First, they block all potential legal ways for the marginalized group to carry out their mission legally. Then, they used false rhetoric and fear monger civilians so that the marginalized group can be dehumanized and therefore easier for the government to carry out whatever it is they are planning without dissent. Then they sanitize the living conditions in which the immigrant group are living in. Finally, they discredit or all accounts that are cited by reputable resources in order to keep the masses confused and ignorant. It's exactly what happened when the Japanese were placed in internment camps.

Ok, how about you fork over $20,000 while working a minimum wage job that you can’t quit from no matter how bad it is because if you do there’s nowhere else for you to work at without breaking the Law. Immigration lawyers are some of the worst wolves in sheep’s clothing I have ever met. I spend about $10,000 just to get a green card while having nowhere else to live but at my Mother in law’s tiny ass house in the middle of the ghetto while pregnant. I slept on the floor with my husband because the place was so small we couldn’t even put a bed in there, much less afford one. When I was about to apply for citizenship my Lawyer up and left after I had paid her the money to file in the citizenship paperwork. She disappeared and I have no way of recuperating my paperwork from her. Thankfully no everything was lost but I am not an isolated incident, there are countless stories of people who have been duped by lawyers and there are more fast food joint in the USA than immigration courthouses. So you guys do the fucking math. It takes so much of you and so long for you to even reach the tip of what American citizens expect from you.

We break the law every single day Khayyley, it's not an exaggeration or even something that I'm making up. I live in Connecticut and lord do we have some ridiculous laws like, husbands who cannot kiss their wives on any Sunday. If a cyclist goes above 65 MPH they have be stopped by a police officer and we're not allowed to educate dogs. (lol, what?) Anyway, the point is we don't get citations, incarcerated or even have enforcement carried out for the most menial lawlessness so why should we punish these kids who have done nothing wrong? This used to be the country that was known for checks and balances, the country of separation of church and state. Somewhere along the way, we've lost ourselves and we've become the country of checks and cherry picking. The country that puts babies in cages and we don't allow the staff to offer any comfort. These are not "summer camps" and we shouldn't find a way to sanitize the word cage but we have gone so far off the deep end and our expectations for our leaders are so low that we may as well be licking the ground. These are kids who are screaming for their mothers and fathers who may never see them again just for committing the sin of being born brown, something that they obviously have no control over. It's a harrowing reality but their voices are falling on deaf ears as politicians use the bible to excuse their horrid laws as they smile because they're the ones all cozy with big fat paychecks provided by their citizens. We're duped into thinking that these current politicians have our best interest at heart when in actuality they don't. Just because an abusive parent says they care about you doesn't mean they actually do. The GOP is a cesspool of corrupt, self-serving, amoral group of people with Trump at the head.

Our healthcare system is a fucking joke and we sit idly by as Men in power oppress our women because they don't want to bring a child into a world full of problems that cannot be easily fixed. We cater to our very own terrorists who use the bible in order to justify themselves and call it "freedom of speech" yet we call people color sons of bitches for simply daring to protest peacefully for the flagrant disenfranchisement of his fellow people. We slap the, what about isms and point fingers to others without realizing we're the ones putting them in those positions while simultaneously squashing the education system in order to keep future voters ignorant. Republicans can't be voted in if we have intellectuals willing to question their agendas. It's much easier to have dumb, compliant, narrow-minded morons in order for them to make that money. Can't you see what it is they're doing? They are dehumanizing these people and saying that they're all criminals and or will become criminals in the future so that the white elitists can feel alleviated of all culpability in order for them to be able to sell their soul to the administration that is quietly pocketing civilian's money. Money, that they say will go to charities but never do. It doesn't matter if these kids have television, air conditioners, or even a meal because they have been so traumatized by being ripped apart from their parents that even if they were being housed at the Ritz Carlton the practices would still be inhumane.

Wow Tammy, first of all, he didn't need to. Separating children from their parents is not a law, never has been. The separation of children who were accompanied by an adult usually happened if the child was found to have been a product of human trafficking, which by the way, has a very low percentage. Instead, the manner in which these kids are being handled now is more cause for worry because they can fall prey to actual human traffickers. Case in point, the over 1,000 children that were mysteriously lost and haven't been found yet and no one has any clue where or how they might have disappeared. It's insane for you to think that just because these kids are in these prison camps they're somehow being treated correctly. These children only see the light of day for 2 hours and the rest they spend it inside and security measures have been implemented to keep the child from escaping as if they were high-security inmates. They're being treated like prisoners and now they're being forcefully injected with psychiatric drugs in order to keep them from crying. I don't think I need to tell you about the long-term repercussions these drugs can have but I will anyway. It can cause obesity, adult onset diabetes, dizziness, listlessness, and are left incapacitated. Easy prey for any trafficker. it's callously barbaric. These kids are set up for a plethora of mental health problem that will never go away. This new executive order was unnecessary and Trump just needed to feel like a dictator because that's what he truly wants. He doesn't believe in a democracy. He values people like Stalin and Kim Jung Un and insults our allies (sorry Canada!). The paper he signed keeps families together yes, but at the cost of their freedom because they are to be kept in what I would guess to be newly built facilities that will most definitely be paid by us for an indefinite period of time as opposed to deporting them back to their countries after about 20 days. It'll be a real concentration camp and I wouldn't be surprised if gas chambers and fire pits begin to appear all over the United States and all Latino immigrants are rounded up regardless of whether they are legally here or not.
We should worry about our own citizens instead of immigrants who are only a distraction to our own problems.
You're right up to a point. We should definitely worry about our citizens and maybe worry about our very own problems that plague our nation, yet we don't. We should be working towards implementing Gun control and worrying about human rights abuses towards people of color, but we don't. Instead, we blame those very people that are being needlessly maligned because we'd rather think it's their fault as opposed to us saying that we fucked up, that we cannot do enough to help our own people. Immigrants aren't looking to distract us from our own problems but the GOP sure is using that scapegoat in order to confuse us and turn us into megalomaniacs who claim to care for this country while rationalizing the heinous laws that this administration is implementing. Understand that just because I sympathize with the plight of immigration it doesn't negate my love or even my worries for the problems that are in my country. I love this country and I'm thankful to this country for all its wonderful opportunities. I believe we can be better and I don't think we're perfect but we're definitely capable of being great indeed. It was before and I'm sure we can be now and in the future.
Listen, all I’m trying to really say is that the things that are happening are beyond horrible and at such an alarming speed that I am scared for the future of my country. This president is giving a pathway for all the fascists to wave their flag and complain about how they suffer at the cost of people they refuse to understand or even get to know. It's giving way for racists to be open about their disgusting assumptions by calling it honesty, and "well I'm just telling it like it is, and everyone else was thinking it, anyway".
Just like President Snow from the Hunger Games, Trump is using children to shield himself and get what he wants. This is no longer a, “I wonder what a dystopian future would be like.” situation we are there already. This is the Handmaid’s Tale. This the Hunger Games. This is Nazi Germany, and the trail of tears coming to fruition all over again and we’re allowing it. So, come November if you do not vote blue and later regret not doing so then it will be entirely your fault that this once great country will crumble and burn to the ground with only the ashes to left as a reminder of what it once was. Our founding fathers would ashamed of us and we should too. Have a little humanity and compassion but if you're not capable of that, at least know that your stance will follow not just you but your entire lineage till the end of time just like the Nazi regime was because you are most definitely on the wrong side of history.
