The British Columbia Securities Commission (BCSC) concluded that David Smillie and his company, ezBtc, committed fraud, misappropriating approximately $13 million CAD ($9.5 million USD) in customer cryptocurrency assets between 2016 and 2019. Over 2,300 Bitcoin and 600 Ether, claimed to be securely stored, were diverted to online gambling and personal accounts.
EzBtc falsely assured clients of cold storage security, but the investigation exposed the misuse of assets. Smillie now faces potential sanctions, including fines and market bans, with a decision expected by September 24, 2024.
This case highlights the financial and emotional distress inflicted on investors, undermining trust in crypto platforms. Despite such setbacks, Canada's overall cryptocurrency adoption remains low, with only 3% of Canadians using digital currencies regularly. However, there’s positive news as 3iQ Digital Asset Management plans to launch North America’s first Solana exchange-traded product (ETP), signaling ongoing innovation in the sector.

B.C.'s securities regulator says a Vancouver company violated securities rules when it developed a cryptocurrency under false pretenses and took in $3.3 million from 500 investors in B.C. and beyond.
The B.C. Securities Commission alleges payment processor NetCents and its CEO, Clayton Moore, broke securities rules when they issued a NetCents Coin cryptocurrency in 2017, including by making "misrepresentations" about demand and how the cryptocurrency was to be managed.

Y’all, I am legal geeking out.
Canada DOES have defamatory libel in their CRIMINAL CODE. Most places do not have criminal defamation so I didn’t think to look it up for Canada.
The accusers CAN be charged criminally for defamation in Canada. 🤯
R.S., 1985, c. C-46, § 301(a)
Every person who publishes a defamatory libel is guilty of
an indictable offence and liable to imprisonment for a term of not more than two years
If we’re keeping score, Shitshow 1 et al might be facing criminal charges for defamation AND CSAM/Revenge Porn.
There is caselaw where defamatory Tweets can be tried in Canada:
Giustra v Twitter, Inc., 2021 BCSC 54 (CanLII) https://www.canlii.org/en/bc/bcsc/doc/2021/2021bcsc54/2021bcsc54.html (last visited 19 May 2023)
On top of that, PHW can sue the accusers civilly for the same. So, we’re talking like four different lawsuits. The criminal and civil suits will likely be consolidated respectively, but that’s boring judicial minutia no one cares about.
I still maintain that PHW shouldn’t throw his money away because litigation is expensive and he’s unlikely to recover even attorney fees, BUT he could at least file criminal charges and let the Crown deal with them.
I am manifesting that if PHW, Jane, and the Convention release statements, that they all include:
I am pressing criminal charges.

I reported it to the Bank of England through the FCA Prudential Regulation Authority. How much money would I have now if these riffraff had not cheated? That is my big question, what a shame on these countries that allow these people to continue working and cheating all good-hearted people, who work non-stop.

Pip weaves long lasting sonic landscapes. Justly intonated harmonies, airy noises and slow melodies construct an organic music where the listener can both surrender to the music and actively explore the multilayered sonic facets. The duo has existed since 2006 and since then they have developed a characteristic sound in a music encompassing improvisation and collective composition. Their 2019 release ‘Possible Worlds’ is a one hour long piece utilizing an extended instrumentarium of justly tuned guitars, trumpet and synthesizers, and it documents their pinnacle work as a duo so far.

An investment fraud investigation that began nearly a decade ago has led to fines totalling nearly $1 million against three B.C. residents.
The elaborate fraud — which promoted fake gold-mining operations in Africa and Brazil and promised hefty returns while claiming the investments were fully insured — was spearheaded by a Brazilian national living in Florida. It raised nearly $15 million from unwitting investors, including at least $1.5 million from 137 B.C. residents.
This week, the B.C. Securities Commission (BCSC) ordered Sabrina Ling Huei Wei to receive a $500,000 administrative penalty and another $90,000 to the BCSC, which is the amount she obtained from the scheme. Justin Colin Villarin must pay a $200,000 penalty and his $15,718 return from it; James Bernard Law is ordered to pay a $150,000 penalty.
Wei was banned for life from the B.C. investment market, while Villarin was banned for 25 years and Law for 20.
The BCSC got a tip about the B.C. residents promoting the U.S. “gold-mining” company, Massachusetts and Florida-based DFRF Enterprises, in 2015. It ruled against the accused fraudsters last October, noting Wei, Villarin and Law knew or should have known the companies’ claims were fraudulent. However, they continued to promote them to investors.
Back in 2015, BCSC investigators posed as investors and attended a presentation at a downtown Vancouver hotel promising “extraordinarily high, no-risk returns on supposedly lucrative gold mining operations in Mali and Brazil,” said a statement about the penalties released Thursday.
None of the money was used for gold mining and DFRF made no money from the supposed operation, only collecting any of its proceeds from duped investors.
The BCSC issued an alert about DFRF several days later warning investors about its claims and warning that its claims were “characteristic of investment fraud.”
The scheme initially landed on the radar of the U.S. Securities and Exchange Commission (SEC) and was orchestrated by Daniel Fernandes Rojo Filho and associates. The SEC characterized it as a Ponzi or pyramid scheme that pulled in US$15 million from a total of over 1,400 investors.
Filho used none of the funds for gold mining, and bank records show DFRF had no other legitimate business activities. Instead, the SEC found that Filho used more than US$6 million of investors’ money for personal expenses and luxury cars.
Filho and several others in the U.S. were hit with civil actions by the SEC for fraud and selling securities without being registered. Filho was ordered to pay US$11 million.
The Canadian trio is banned from a wide range of trading and promotional activities on the B.C. investment market. In addition, the BCSC also issued a lifetime ban to Filho and another U.S. investor using its authority to enforce orders from other jurisdictions.
