Dorothy Delgado's Divine Devices. The letters were printed in bold black writing over the shop door. From the street you'd think this pop-up shop was nothing much out of the ordinary, and in truth you'd be right.
Some fifteen years ago, when Dorothy was still a girl who believed in such things as the Tooth Fairy and the Baba-Da-Gan, she'd come across a small shed down by the brook behind her mother's house.
Her mother had told tales of imp-like creatures that lived in small sheds similar to this, tin can contraptions with leaky roofs and blacked-out windows, covered in rust and mould.
There were markings on the door of the shed, ritualistic symbols (Dorothy had etched these same symbols into the frame of her pop-up shop door, it was all about appearances you see). Despite her mother's warnings -- about sheds and imps and strangers by the brook -- Dorothy had been curious, too curious not to take a peak inside. It was ironic really, that same curiosity is what now sent customers flocking to her store.
"You're shorter than I expected," a boy half her height, wearing a bright yellow hat and sporting a beard the same colour that ran to his knees -- odd for a boy to sport a beard that long -- was sat on stool playing with his tail.
"You were expecting me?" Dorothy asked despite herself, forgetting yet more of her mother's wisdom.
There's trouble in asking questions.
The boy had smiled an awful sort of smile, all teeth and no lips. There was a flash of hunger in his eyes. They're like stones. Dorothy had thought to herself. Grey and hard, and I'll bet they don't bleed.
That was all it took, one question followed by another and the boy had managed to trap Dorothy in a sort of spiraling conversation that felt so much like a fever dream she'd have sworn it never happened. That was, had it not been for the curse.
"Little girls lie, don't they?" the boy had asked.
"Nuh-uh. Not this one." Dorothy had protested, just a little too much.
Of course little girls lie, but they get in trouble for lying, so Dorothy certainly wasn't going to admit to such a sin. Not to this stranger in a tin-can. What if her mother found out?
Back in the present day Dorothy sighed. That boy, that day, they held home in the very fore-front of her mind, a memory played forever on repeat, just like that Christmas special her mother had loved, the one about the boy who never did as he was told.
She gave a short laugh, unlocking the door to her store, the bell above her head ringing as she stepped inside. Her mother would have loved this, the veritable mountain of antiques displayed on table-tops, and on shelves, and hanging from the ceiling, some larger oddities standing of their own right on the wood panel flooring.
But her mother was no longer of this world. A tragic accident that could have been prevented if not for this Gods forsaken curse.
To tell the truth was to be spat at in the street, no matter how hard she tried, no matter how hard she pleaded, no one would either again believe the words of Dorothy Delgado. But to lie, to lie was to speak gospel that no ears could ever deny -- little girls don't lie, nuh-uh, not this one.
The only problem was the inevitable visit some days later when Dorothy's divine device failed to live up to expectations.
She could handle the authorities, all she had to do was lie and they'd bid her a good day, apologising for having wasted her time. But the customers, oh dear lord the customers. You could lie and send them packing, but word would spread, yet more words would be written, scathing reviews left online making Dorothy Delgado's Divine Device's the one place in town you gave a very wide birth.
Oh how she missed the days before the world and her wife carried computer's in their pockets.
So she'd move along, find another town, come up with some other clever name under which to sell her fabled goods. And ever on the cycle would repeat.
If she'd had the choice, she might just have gone back home, to her mother's that is, the little cottage by the brook. But the boy had taken that took, hadn't he.
Ring.
The door came open and with it entered Dorothy's first customer of the day.
"Interesting place you've got here," the man offered.
There it is. Dorothy gave a short but pleasant smile, just enough to invite the man in further, but not so friendly as to lose all sense of mystery. It was an art. One she'd mastered over the years, she'd have you know.
The man picked up a feather pen and pot of ink, squinting at the tag. There was no price, just words and a promise, "this is a joke, right? You don't really expect me to believe..."
"That this pen can make you a world famous novelist?" Dorothy put a hand on the man's shoulder, and whispered in his ear, "this pen was once owned by Dickens, by Orwell, by Virginia Woolf. It can make you world famous alright, but at a cost."
The man drank up every word, he swallowed and asked, "what cost?"
"Thirty-four ninety-nine," Dorothy grinned, "plus taxes."
You have been cursed so that nobody believes you when you tell the truth. But you find people will believe you when you lie. So until you can find a way to undo the curse you make do as a very successful merchant.

I decided to bring back my self care lists. I don't really have a structured plan yet, bc it was a decision I made without much thought, but to start I think I'll try to be mindful each day by doing at least three things that can count as self care, and then write them in my daily posts to hold myself accountable. No matter how small they are they count as long as I am doing something to make myself feel better. I am going through an emotional time and I need to be extra careful with myself, and since this is a low effort thing that worked in the past it seems like the right way to go.

wrote and posted a book review of the book I finished (I haven't posted one in ages it was nice to write one again!)
continued rewriting the second set of notes for my political institutions class
duolingo
worked a bit on my reading journal and set up my bujo for December
today's self care:
set my alarm a bit later than usual
finished studying earlier than usual both in the morning as well as in the afternoon because if brain isn't braining I don't see why I should torture myself and struggle when I clearly need rest
started relistening monstrous agonies and spent my entire lunch break listening to it (I need the sort of comfort that podcast gives me and it was truly needed)

Girls don't want boys; girls want to battle ancient gods to the death!
My friends, the time has finally come for me to review the entire Burning Kingdom's trilogy by Tasha Suri. I've mentioned it before in my rec list of queer historical novels, but that was before I completed The Lotus Empire, the last book in the series. And now I can say with conviction: Tasha Suri is the only writer out there who truly understands love and romance and WHAT SAPPHICS WANT. 🙌🏻
To back up, the Burning Kingdom's story takes place in the imaginary kingdom of Parijatvipa (a reimagining of South East Asia/India with a lot of magical realism flowing through its veins). One of our heroines, Malini, is a princess who has been told all her life by the clergy and her younger brother the Emperor that her destiny is sacrificial immolation. Our second heroine, Priya, is a priestess in the ancient and mystical temple of the Hirana, where for centuries Temple Elders and Temple Children have worshipped the Yaksa (ancient nature divinity spirits that were supposedly destroyed at the end of the Age of Flowers). Their love story begins when Malini is sent by her brother to repent at the Hirana for her unwillingness to be burned alive and Priya is assigned to be her servant/guard.
The trilogy follows the two women as they clash against each other like waves, or like two powerful tornadoes that destroy everything in their path. Their love might be easier if one of them was softer, but what makes Priya and Malini such a power couple, is that they're both incredible badasses with spines of steel and nerves of fire. The stakes cannot be higher and only keep rising. It starts out as one Princess vs The Patriarchy, and ends with Gods vs Nature, Humans vs. Gods, and Sapphic Love Conquering All. I feel it is very important to let everyone know that the trilogy has a very satisfying ending, despite the many devastating and heart-breaking twists and turns along the way.
While this trilogy is incredibly Girl Power and is full of countless badass lady characters, I must say that one of the reasons I enjoy Tara Suri as a writer is because she also understands how to write good male characters from the female gaze perspective. Sure, some of the men in this book are horrid villains, but then she gives us truly complex and good boys like Rao (I would die for Rao), Aditiya, Jeevan, Ganam, and Rukh along the way.
This series is really riveting and never stops delivering. We get really wonderful gay/lesbian solidarity. We get so much great ladies supporting ladies content (Bechdel test? LOL Tasha Suri straight blows right past it into a different dimension of female solidarity.) We get hot girl on girl under the waterfall action. We get gorgeous rumination on the nature of faith and sacrifice. But most importantly, we get two very deeply flawed women who love each other so powerfully and so beautifully that their love literally reshapes the world.
I am begging everyone to drop whatever they're doing and read this series. It's really up there for me as some of the Best Gay Shit Ever.

I'm gonna be a little quiet on here until after I start playing Dragon Age. I don't want to be spoiled and the urge to click on posts that have DA tags blacklisted is mounting. And just like with Inquisition, I want to go in totally blind.
#[static]#I can't wait to see what my friends and mutuals think. it's always so much fun to watch folks play new games together#I've seen a few reviews. but I ultimately want to decide for myself#I've already seen people bickering about really inane stuff just to have something to be negative about#and while there are incredibly valid criticisms of EA among other things ... the stuff I'm seeing -#- is typical fandom stuff that I don't want to touch with a 10 foot pole#it's kind of funny how much people can rattle on about a game that isn't out just because they want something new to complain about#and people are 100% allowed to have their opinions and feelings on if they thought a game was good or not but the stuff im talking about is#- like being mad at folks getting invested in characters or talking about how bad they know it's going to be even though they havent played#i think i just hate when people talk with such conviction about how other people should enjoy things that it pisses me off real bad#i saw a take on my for you page about how it's wrong of people to be writing fics about things that havent happened yet#because what if they're wrong and then theyve wasted their time and are gonna be ruinously upset. instant block lol#i thankfully dont see any of this on my dash ... usually just in the dragon age tags or on the for you page which I rarely frequent#just let people enjoy something without getting wound up about it not being the right way. it's just drama for drama's sake#but also feel free to hate it and hate it loudly! so long as you understand it's also ok for others to have a different opinion#it's just the super-online 'everyone is wrong but me' takes that leave me reeling

Zero Day Director commentary - With actor Andre Keuck
#movies#film#cinema#Damn I wish Cal was here#Andre and Ben are really interesting to listen to#This movie is one of those movies where it needs like 3 commentaries#It needs one with just Ben Coccio by himself#then one with Cal and Andre by themselves#then another with all 3 of them#Not all movies do that but I love when studios/filmmakers have multiple commentaries to create a sense of thorough intimacy#due to the nature of how commentaries are set up they can be quite restrictive/pressing/limited with no pauses or rewinds.#so I find cast/crew don't have enough time or able to present how they would like to if they could edit/rewind or pause for fluent presenta#So I love when they have director commentaries and actor commentaries or composer commentaries#Platoon's dvd extras are so dope they got multiple commentaries and one with military adviser Dale Dye who was a RL vietnam vet#Or Hostel's commentaries where one is just Eli Roth and another is Tarantino and Eli Roth with Scott Spiegal#idk if Zero Day ever got a blu-ray release but I think it should but the DV technology of the camera is kinda at it's limit of resolution#but an AI upscaling with 20 years later retrospective with Ben Cal and Andre would be sooo dope along with updated commentaries#Every few years I always rewatch Zero Day so that time has come that last few days lol#Ever since Columbine as a lil kid I have always been into spree-murders and active shooter incidents#I remember reading a peer-reviewed paper called Pseudo-Commandos#And Eric and Dylan and Andre and Cal would be dubbed Pseudo-Commandos where they dress up in a semi-military fashion#and have a delusion of superiority mixed with perceived sense of persecution whether it's true or not#it went into the Postal shooter from the 80s as well and what he went through along#plus I read another book called Going Postal which also went into postal shootings along with school shootings#I want to make a film about spree murders or an active shooter/s but I remember just getting so tired of the subject matter#because every 3 weeks there was some new shooter in the headlines and I found myself not wanting to be exploitative#When I write/direct my film I'd like it to address and study the character of such an individual but not try to be too political#or exploitative and focus on the ambiguities that are left behind when someone does this#as a society I noticed we stopped asking the questions on why and stopped having constructive conversations#it feels like as a coping mechanism we've started treating them like tornados or natural disasters

as a writer how do you stop thinking about like getting kudos/comments? I've just started writing fanfic, and when I start a writing something -- it goes well and then eventually I get to point where I'm like "ahh but what the readers don't like that? or what if I don't get as many kudos or comments" and it makes it difficult to continue because then it becomes stressful -- I guess how do you deal with "wanting to write stuff for yourself" and "wanting validation" thanks!
You're going to hate this answer, because I hated it too, but TIME. When you first start writing and you get kudos and comments and people love what you're doing, it's a huge validation of your effort and talent, and it's natural that you want MORE of it. When I first started putting up fics I already had been writing for 15+ years, knew I was good at it, and still for a good few years found myself really glued to the hit counter, and the kudos, and wondering how I'd be able to get people to comment the same way they did on things like Seven Suitors.
But the thing is that commenting comes and goes in waves, and unless a fandom has a big comment culture, or is large enough that you're guaranteed a good glut of them every time you post...you're going to hit a point where you write exactly what everyone wants and get crickets. And at that point you'll get ANNOYED, because LOOK, I MADE THIS, i made it for YOU GUYS, and now y'all don't have anything to say? It'll get to you. It'll make you doubt that you know what anyone wants at all. It'll happen and it'll suck the whole time.
Lots of advice will say "write for yourself," which is an excellent sentiment. You should always write what YOU want. Put into your fic what you want to see, write the nitpicky poetic metaphors and craft the most screwball twists your heart desires. Pour yourself into the most niche AUs and most tin-hat canon theories. At the end of the day, you want the IDEAS you put down to be for you, because comments and kudos are nice, but if they don't come...you have to be proud of what you put out, even when it feels like an echo chamber.
But also...we don't POST things for ourselves. We post things to share. Fic are a conversation with canon and it is perfectly natural to want to create something that creates conversation among other fans. So you're never going to fully get the need for validation out of your head, you're not. You can hide hit counts and ignore your inbox all you like, but the want to have someone interact with your work, to inspire someone to reach out to you will ALWAYS be there. You just have to create a healthier relationship with it.
Be confident in what you write. Think less about whether people will like it, and more about how you WANT them to react. The reader is the most important character in any novel, but it's the one most authors forget to manage. When you come to a point where you go "oh man, I hope this is good for them!" stop and go, "what do I *want* them to be feeling here?" Focus on where you're putting their attention and whether you WANT it there. There's so much you can do when you visualize your relationship with the reader as PART of the work, and it takes off a lot of the pressure of "is this good? is it disappointing? will this get me validation?" and brings it back into the realm of storytelling. You are taking your reader on a journey, and when you do it well people will think less about "did I like that?" and more about "what comes next?"
#asks#writing advice#writing#please understand nonnie that what you are feeling is completely natural and part of the process#and shades of that will stick with you no matter how good you get#but the thing you want to keep in the center of your mind when it comes to that#is that you can only get kudos once on a fic and you are lucky to get a 1:100 comment vs hits ratio#so the instant validation WILL dry up and you'll have to have something about your story#that makes you push through. because people will come back and comment!#people will blow through 50+ chapter and leave you the most emotionally hungover review promising you their first borns#but sometimes you will have written a good third of them with NO feedback whatsoever#and you just have to trust in yourself that it's good. it's FINE#i used to obsessively check hits and be really put out to see how many people were coming and not commenting#especially when i wrote really emotionally driven stuff and really tore myself up to get those feelings through#but i also would have been miserable only writing fluffy 1 or 2 shots with no plot just to get the flush of comments those fics get#you just gotta do what you gotta do and let your audience find you. recontextualizing the relationship helps a LOT#i already was big on focusing on the meta plot of my works because as i said. 15+ years. had a lot of time to experiment and get good#but i still had to like. give myself the same pep talk 2 years in about how to view that relationship#everyone goes through it and if they say they don't they're a liar and i mean that seriously 🤣

if there's one thing i hate more than slackers in group projects its goddamn hypocrites
#this guy did jack shit for two full weeks when we're building the damn prototype#but STILL brought up the fact that most of our team blew off a report till the last minute in the beginning of march#*prototypes don't work* “sEe tHis iS wHy wE nEedEd tO hAvE a cOnvErsaTioN aBouT MS3”#like hon you lost the rights to the “y'all need to contribute more” argument the moment you left me hanging for 2-3 FUCKING WEEKS#like excuuuuuse me you been prioritizing extra curriculars all week get off your high horse stop lecturing everyone else about contribution#he made maybe 3 contributions? maybe?#first he 3D modeled an adapter and sent it to someone else to print (couldn't even do THAT himself smh)#then he sent the gc a sketch of an idea i roughly proposed literally the NIGHT BEFORE as his own contribution (that I ENDED UP BUILDING#then he...screwed on a few pipe fittings and called it a project :)#would be a LOT less pissed if he didn't show up to One Thing outside weekly team meetings/class#then apologize for slacking off BUT then launch into a FUCKING SPEECH ABOUT HOW HIM BEING HERE PROVES HIS COMMITTMENT#all because he DOESN'T LIKE GETTING UP EARLY. like sir. sir i am rIGHT FUCKING HERE. i was up till 4-5am working on this stfu#we've been building for three weeks and he's come into work on stuff wo me there ONCE for an HOUR#for context id spent about fifteen hours in the shop alone working on the fucking thing that WEEK#like im trying to be understanding ik tech week is hell#but i took “stepping back” as “i only have a few hours here and there to be in the shop and will do the writeups”#NOT “won't show up outside meetings AND we're splitting slides and writeups 80/20”#like id been in the lab all fuckin day and notice we have an assignment due (missed a SINGLE meeting due to exam)#and i ask him if theres anything i can do (and im thinking like look it over maybe add a spec or two)#and this fucker has the AUDACITY to ask me to write the full four paragraph summary cause he#*checks notes* copy-pasted some specs from milestone 3 so of COURSE its only fair that despite the fact I've been in the lab ALL DAY#that i write the four fuckin paragraphs too#course we're troubleshooting and he's like “did you clean the pump? did you disassemble it and rinse it?” like yes???#i did EVERYTHING i could think of before i even bothered texting you cause i know you're fucking useless#and then he raises fifteen different concerns which while valid would have been NICE TO HEAR WHEN I SENT YOU MY INITIAL DESIGNS#y'know BEFORE i spent over fifteen hours of my free time building this damn thing#with slackers i just pick up the work and move on with my life this idiot is trying to gaslight me into thinking that he contributed fairly#when i heard “i need to step back due to play stuff” i thought we'd be splitting it like 65:35 NOT FUCKING 95:5#and now hes probably going to give ME a poor peer review because I've been passive aggressive with him in the few meetings he showed up to#like i got shit going on too? how the fuck does he expect me to respond to being abandoned to do this shit myself

I used to work for a trade book reviewer where I got paid to review people's books, and one of the rules of that review company is one that I think is just super useful to media analysis as a whole, and that is, we were told never to critique media for what it didn't do but only for what it did.
So, for instance, I couldn't say "this book didn't give its characters strong agency or goals". I instead had to say, "the characters in this book acted in ways that often felt misaligned with their characterization as if they were being pulled by the plot."
I think this is really important because a lot of "critiques" people give, if subverted to address what the book does instead of what it doesn't do, actually read pretty nonsensical. For instance, "none of the characters were unique" becomes "all of the characters read like other characters that exist in other media", which like... okay? That's not really a critique. It's just how fiction works. Or "none of the characters were likeable" becomes "all of the characters, at some point or another, did things that I found disagreeable or annoying" which is literally how every book works?
It also keeps you from holding a book to a standard it never sought to meet. "The world building in this book simply wasn't complex enough" becomes "The world building in this book was very simple", which, yes, good, that can actually be a good thing. Many books aspire to this. It's not actually a negative critique. Or "The stakes weren't very high and the climax didn't really offer any major plot twists or turns" becomes "The stakes were low and and the ending was quite predictable", which, if this is a cute romcom is exactly what I'm looking for.
Not to mention, I think this really helps to deconstruct a lot of the biases we carry into fiction. Characters not having strong agency isn't inherently bad. Characters who react to their surroundings can make a good story, so saying "the characters didn't have enough agency" is kind of weak, but when you flip it to say "the characters acted misaligned from their characterization" we can now see that the *real* problem here isn't that they lacked agency but that this lack of agency is inconsistent with the type of character that they are. a character this strong-willed *should* have more agency even if a weak-willed character might not.
So it's just a really simple way of framing the way I critique books that I think has really helped to show the difference between "this book is bad" and "this book didn't meet my personal preferences", but also, as someone talking about books, I think it helps give other people a clearer idea of what the book actually looks like so they can decide for themselves if it's worth their time.
Update: This is literally just a thought exercise to help you be more intentional with how you critique media. I'm not enforcing this as some divine rule that must be followed any time you have an opinion on fiction, and I'm definitely not saying that you have to structure every single sentence in a review to contain zero negative phrases. I'm just saying that I repurposed a rule we had at that specific reviewer to be a helpful tool to check myself when writing critiques now. If you don't want to use the tool, literally no one (especially not me) can or wants to force you to use it. As with all advice, it is a totally reasonable and normal thing to not have use for every piece of it that exists from random strangers on the internet. Use it to whatever extent it helps you or not at all.

#thinking abt my screenplay and the idea of like. pitching it. sending it to someone who id want like. involved with it. SCARY!!!#drafting the kind of letter id write for such a thing. and thinking abt creating some kind of like online presence as a writer/film critic#of course stretching the truth a little abt my 'published writings' (stuff in school)#another drawback to that idea would be. i have not written any film reviews.#and how can i have TIME to write reviews when i don't have TIME to write my screenplay#and even if i did all that theres still the underlying thing that i am a nobody who still hasn't filmed anything#and no one will want to work on the film of someone who has never made a film!!! augh.#so its all giving me a headache for absolutely no reason#also just survived a work meeting that could have been a prog rock concept album#oh well. soon i can sit down and relax

Oh dear.
So as some of you may know, I love to point and laugh at bad legal arguments. And as fun as legal dumpster fires are when they are made by people who aren’t lawyers but think this whole ��law” thing seems pretty simple, it’s even funnier when an actual, barred attorney is the person dumping gallons of kerosene into the dumpster.
And oh boy folks, do I have a fun ride for y’all today. Come with me on this journey, as we watch a lawyer climb into the dumpster and deliberately pour kerosene all over himself, while a judge holds a match over his head.

For those of you who don’t enjoy reading legal briefs for cases you aren’t involved with on your day off (I can’t relate), I will go through the highlights here. I will screenshot and/or paraphrase the relevant portion of the briefs, and include a brief explainer of what’s going on (and why it’s very bad, but also extremely funny). (Also, I’m not going to repeat this throughout the whole write-up, so for the record: any statements I make about how the law or legal system works is referring exclusively to the U.S. (And since this is a federal case, we are even more specifically looking at U.S. federal law.) Also, I don’t know how you could construe any of this to be legal advice, but just in case: none of this is, is intended to be, or should be taken as, legal advice.)
First, let’s get just a quick background on the case, to help us follow along. In brief, this is a civil tort suit for personal injury based on defendant’s (alleged) negligence. The plaintiff is suing the defendant (an airline), because he says that he was injured when a flight attendant struck his knee with a metal cart, and the airline was negligent in letting this happen. The airline filed a motion to dismiss on the grounds that there is an international treaty that imposes a time bar for when these kind of cases can be brought against an airline, and the plaintiff filed this case too many years after the incident.
The fun begins when the plaintiff’s attorney filed an opposition to the motion to dismiss. (So far, a good and normal thing to do.) The opposition argues that the claim is not time-barred because 1) the time bar was tolled by the defendant’s bankruptcy proceedings (that is, the timer for the time limitation was paused when the defendant was in bankruptcy, and started again afterwords), and 2) the treaty’s time limit doesn’t apply to this case because the case was filed in state court before the state statute of limitations expired, and the state court has concurrent jurisdiction over this kind of case.
I’m struggling a bit to succinctly explain the second reason, and there’s a reason for that.
You see, the whole opposition reads a bit…oddly.
This is how the opposition begins its argument, and it’s…weird. The basic principle is...mostly correct here, but the actual standard is that when reviewing a motion to dismiss for failure to state a claim (which is what the defendant filed) the court must draw all reasonable factual inferences in the plaintiff’s favor. But even then, you don’t just put that standard in your opposition. You cite to a case that lays out the standard.
Because that’s how courts and the law work. The courts don’t operate just based on vibes. They follow statutory law (laws made by legislature) and case law (the decisions made by courts interpreting what those laws mean). You don't just submit a filing saying, "here's what the law is," without citing some authority to demonstrate that the law is what you say (or are arguing) it is.
Again, this isn’t wrong (although I'm not sure what it means by new arguments?), but it’s weird! And part of the reason it’s weird is that it is irrelevant to the defendant’s motion to dismiss. The defendant filed a motion stating that based on the facts in the complaint, the plaintiff has not stated a claim based on which relief can be granted, because the complaint is time barred by a treaty. There is no reason for this language to be in the opposition. It’s almost like they just asked a chatbot what the legal standards are for a motion to dismiss for a failure to state a claim, and just copied the answer into their brief without bother to double-check it.
The opposition then cites a bunch of cases which it claims support its position. We will skip them for now, as the defendant will respond to those citations in its reply brief.
The last thing in the brief is the signature of the lawyer who submitted the brief affirming that everything in the brief is true and correct. An extremely normal - required, even! - thing to do. This will surely not cause any problems for him later.
The next relevant filing is the defendant’s reply brief. Again, the existence of a reply brief in response to an opposition is extremely normal. The contents of this brief are…less so.
Beg pardon?
Just to be clear, this is not normal. It is normal to argue that the plaintiff’s cases are not relevant, or they aren’t applicable to this case, or you disagree with the interpretations, or whatever. It is not normal for the cases to appear to not exist.
Some highlights from the brief:
Quick lesson in how to read U.S. case citations! The italicized (or underlined) part at the beginning is the name of the case. If it is a trial court case, the plaintiff is listed first and the defendant second; if the case has been appealed, the person who lost at the lower court level (the petitioner/appellant) will be listed first, and the person who won at the lower level (the respondent/appellee) will be listed second. There are extremely specific rules about which words in these names are abbreviated, and how they are abbreviated. Next, you list the volume number and name of the reporter (the place where the case is published), again abbreviated according to very specific rules, then the page number that the case starts on. If you are citing a case for a specific quote or proposition, you then put a comma after the beginning page number, and list the page number(s) on which the quote or language you are relying on is located (this is called a “pincite”). Finally, you put in parenthesis the name of the court (if needed)(and again, abbreviated according to extremely specific rules) and the year the case was decided.
So the plaintiff’s response cited to Zicherman, which they said was a case from 2008 that was decided by the 11th Circuit Court of Appeals. However, the defendant was not able to find such a case. They were able to find a case with the same name (the same petitioner and respondent), but that case was decided by the U.S. Supreme Court in 1996, and the lower court cases associated with that case weren’t in the 11th circuit either. (The United States Reports is the only official reporter for the U.S. Supreme Court, and only includes SCOTUS decisions, so it’s not necessary to include the name of the court before the year it was decided.)
Just to be clear. The defendant’s brief is saying: the plaintiff cited and extensively quoted from these cases, and neither the cases nor the quotations appear to exist. These “cases” were not ancillary citations in the plaintiff’s brief. They were the authority it relied upon to make its arguments.
This is as close a lawyer can come, at this point in the proceedings, to saying, “opposing counsel made up a bunch of fake cases to lie to the court and pretend the law is something different than it is.”
That, “Putting aside that here is no page 598 in Kaiser Steel,” is delightfully petty lawyer speak for, “you are wrong on every possible thing there is to be wrong about.”
By page 5, the defendant has resorted to just listing all of the (apparently) made up cases in a footnote:

This is where I return to my struggle to explain the opposition’s second reason why the motion to dismiss should not be granted. I struggled to explain the argument, because they failed to explain why the argument they were making (that plaintiffs can bring lawsuits against airlines in state court, and the state court have specific statutes of limitations for general negligence claims) was relevant to the question of whether the plaintiff’s specific claim against the airline was time barred by the treaty. Because 1) this case is in federal court, not state court, and 2) federal law - including treaties - preempts state law. Again, it’s almost like plaintiff’s attorney just typed a question about the time bar into a chatbot or something, and the machine, which wasn’t able to reason or actually analyze the issues, saw a question about the time to bring a lawsuit and just wrote up an answer about the statute of limitations.
We also end with a nice little lawyerly version of “you fucked up and we are going to destroy you.” The relief requested in the defendant’s original motion to dismiss was:
In their reply to the opposition, however:
“The circumstances” in this case, being the apparent fabrication of entire cases. Because courts tend to take that pretty seriously.
And the court took it seriously indeed. The defendant’s reply was docketed on March 15th of this year. On April 11th:
AKA: you have one week (an extremely prompt time frame for federal court) to prove to me that you didn’t just make up these cases.
On April 12th, the plaintiff’s attorney requests more time because he’s on vacation:
The judge grants the motion, but adds in another case that he forgot to include in his first order.
On April 25th, the plaintiff’s attorney files the following:

But he says of all of the cases except two, that the opinions…
Which is…nonsense?
First of all: if you cited a case, you had to get it from somewhere. Even unpublished opinions, if you are citing them in a brief, you are citing them because you pulled them off of westlaw or whatever. Which means you have access to the case and can annex it for the court. (There are even formal rules for how you cite unpublished opinions! And those rules include citing to where you pulled the damn case from!)
Secondly: remember that long digression I went into about how to read case citations? Remember that bit about how you include the name of the reporter (the place the case was published)? Yes, cases are published. They are printed in physical books, and they are published online in databases (e.g. lexis or westlaw). If the specific online database you are looking in does not have the case, you look somewhere else. If you have a judge telling you to get them a copy of the case Or Else, you track down a physical copy of the reporter if you need to and scan the damn thing yourself. You - literally - can’t just not have a copy of the case! (Especially published federal circuit court opinions, which multiple of these cases are! Those aren’t hard to find!)
And what kind of “online database” doesn’t include the entire opinion anyway? I’ve literally never heard of a case research database that only included partial opinions, because that wouldn’t be useful.
Maybe if we look at the attached annexed copies of the cases, that might give us some answers.

My friends, these things are just bizarre. With two exceptions, they aren’t submitted in any sort of conventional format. Even if you’ve never seen a legal opinion before, I think you can see the difference if you just glance through the filings. They are located at Docket entry #29 on Court Listener (April 25, 2023). Compare Attachments 6 and 8 (the real cases submitted in conventional format) to the other cases. Turning to the contents of the cases:
In the first one, the factual background is that a passenger sued an airline, then the airline filed a motion to dismiss (on grounds unrelated to the treaty's time bar), then the airline went into bankruptcy, then the airline won the motion to dismiss, then the passenger appealed. And the court is now considering that appeal. But then the opinion starts talking about how the passenger was in arbitration, and it seems to be treating the passenger like he is the one who filed for bankruptcy? It’s hallucinatory, even before you get to the legal arguments. The “Court of Appeals” is making a ruling overruling the district court’s dismissal based on the time bar, but according to the factual background, the case wasn’t dismissed based on the time bar, but on entirely other grounds? Was there some other proceeding where the claim was dismissed as time barred, and it’s just not mentioned in the factual background? How? Why? What is happening? Also it says Congress enacted the treaty? But, no? That’s…that’s not how treaties work? I mean, Congress did ratify the treaty? But they didn’t unilaterally make it!
In the second case, there’s an extended discussion of which treaty applies to the appellants claims, which is bizarre because there are two relevant treaties, and one replaced the other before the conduct at issue, so only the new treaty applies? There isn’t any discussion of the issue beyond that basic principle, so there is no reason there should be multiple paragraphs in the opinion explaining it over and over? Also, it keeps referring to the appellant as the plaintiff, for some reason? And it includes this absolutely hallucinatory sentence:
…the only part this that makes sense is that the argument is without merit. I’m not going to discuss the actual merits of the legal arguments in the opinion, because they are so bizarre and disjointed that even trying to describe them would require a Pepe Silvia-sized conspiracy board. Like the previous case, both the facts and the legal posture of the case change constantly, with seemingly no rhyme or reason.
The third one…oh boy. First, large portions of the “opinion” are individual paragraphs with quotations around the whole paragraph. What’s happening there? As far as the content of the opinion itself - I can’t. I mean that, I literally can’t. What is being discussed seems to change from paragraph to paragraph, much of it contradicting. It makes the first case seem linear and rational by comparison. The court finds it doesn’t have personal jurisdiction over the defendant so dismisses the case based on a lack of subject matter jurisdiction? But also the defendant hasn’t contested jurisdiction? And also the court does hold that it has both subject matter and personal jurisdiction over the defendant? And then it denies the motion to dismiss the case? Also, at one point it cites itself?
…also, even if this was a real case, it doesn’t stand for the propositions the plaintiff cited it for in their opposition? I’m not going to go into the weeds (honestly it’s so hallucinatory I’m not sure I could if I tried), but, for example, the plaintiff’s reply brief states that the court held “that the plaintiff was not required to bring their claim in federal court.” The U.S. District Court for the District of Columbia is a federal court, and there is no discussion of any filings in state courts. The closest the “opinion” comes is with the statement, “Therefore, Petersen’s argument that the state courts of Washington have concurrent jurisdiction is unavailing.” (This statement appears to be completely disconnected from anything before or after it, so I am unsure what it is supposed to mean.)
Moving on, case number four is allegedly a decision by the Court of Appeals of Texas. It includes the following line:
Honestly, the plaintiff’s attorney best defense at this point is that he wasn’t intentionally trying to mislead the court, because if he was doing this on purpose, he would have edited the cases to make them slightly more believable. (Context in case you’ve lost track: these documents are supposed to be copies of the opinions he is citing. The screenshoted line makes it clear that what he is actually citing is, at best, someone else’s summary of an "opinion". It would be like if a teacher asked a student to photocopy a chapter of a book and bring it into class, and instead the student brought in a copy of the cliffs notes summary of that chapter. Except that the book doesn’t even exist.)
The actual contents of the “opinion” are, as is now standard, absolutely bonkers. First, the court decides that it doesn’t have personal jurisdiction over Delta because “Delta did not purposefully avail itself of the benefits of conducting business in Texas.” This was despite the fact that the factual background already included that the appellant (sorry, the plaintiff, according to the “opinion”) flew on a Delta flight originating in Texas. Like, this is just wrong? It’s not even hallucinatory nonsense, it’s just facially incorrect legal analysis. Then the court starts discussing the treaty’s time bar, for some reason? Then it goes back to talking about personal jurisdiction, but now the trial court denied the defendant’s motion to dismiss for lack of personal jurisdiction, and the appellate court agrees with the trial court that it does have personal jurisdiction, even though this is the plaintiff’s appeal from the dismissal for lack of personal jurisdiction and the court already ruled it didn’t have personal jurisdiction? And even though on page 1, the plaintiff was injured during a flight from Texas to California, now on page 7 she was injured on a flight from Shanghai to Texas? Also the trial court has gone back in time (again) to grant the motion to dismiss that it previously denied?
Also, I’ve been trying to avoid pointing out the wonky text of these submissions, but:

Case number five is similar enough to number four that it’s not worth repeating myself.
Thank god, cases six and eight, as noted above, are real cases, so I’m going to skip them. The defendant alleges that the cases do not stand for the propositions the plaintiff cited them for, and I’m going to assume that is true, given the rest of this nonsense.
Case number seven looks legitimate on the surface. But neither the defendant nor I could find the case through any legitimate search mechanisms. The defendant looked up the purported docket numbers on PACER and found completely different cases; I was able to find a case with the name “Miller v. United Airlines, Inc.,” but it was for a different Ms. Miller, it was a California state case (not a Second Circuit federal case), it was decided on a different year, and the substance of the case was entirely different from the alleged opinion filed with the court.
On top of that, this might be the most morally reprehensible fake citation of them all? Because it is about the crash of United Airlines Flight 585, a real plane crash. Everyone on board - 25 people in total - was killed.
The individual cited in this fake court case was not one of them.
I cannot imagine conducting myself in such a way where I would have to explain to a judge that I made up a fake case exploiting a real tragedy because I couldn’t be bothered to do actual legal research.
Now, I know you all have figured out what’s going on by now. And I want you to know that if your instincts are saying, “it seems like the lawyer should have just fallen on his sword and confessed that he relied on ChatGPT to write his original brief, rather than digging himself further into this hole”? Your instincts are absolutely correct.
Because obviously, the court was having none of this b.s. On May 4th, the court issued an order, beginning with the following sentence:
That is one of the worst possible opening sentences you can see in an order by the court in a situation like this. The only thing worse is when judges start quoting classic literature. If I was Mr. Peter LoDuca, counsel for the plaintiff, I would already be shitting my pants.
“I gave you an opportunity to either clear things up or come clean. Now I’m going to give you an opportunity to show why I should only come down on you like a pile of brinks, instead of a whole building.”
We are getting dangerously close to “quoting classic lit” territory here.
If I learned that the judge in my case called up the clerk of a circuit court just to confirm how full of shit I was, I would leave the legal profession forever. Also, the judge is now also putting quotes around “opinion.” When judges start getting openly sarcastic in their briefs, that means very very bad things are about to happen to someone.
So I’m guessing the delay between this filing and the court order was because the judge’s clerk was tasked with running down every single one of the additional fake citations included in the "opinions", just to make this sure this order (and the upcoming pile of bricks) are as thorough as possible.

Miguel didn’t think he’d end up in this position, nowhere in his wildest, most perverted fantasies did he think that this would actually be the outcome of him recruiting you but… here we are.
You were assigned by the higher-ups to learn from him, they thought you had potential, and honestly? Miguel hated you when he met you, he felt like they were punishing him for something, that assigning him this raw recruit was just a flaunt of power. You didn't even have a suit he had to make you one, a trial suit first, to make sure all your vitals were good, to track your movements and decide what suit material would be best- or if you would have a digital one like him.
During the weeks of his monitoring of your vitals, he began to grow a bit fond of you. You were an adorable recruit and eager to please, you were thoughtful and always gave your all, something he really appreciates. One other thing he noticed about you… your dopamine levels were elevated around him, along with your estradiol and testosterone. He ignores it when he’s writing his reports, he tells himself that he doesn’t report it because the higher-ups don't need to know, not because he knows they’d make you transfer… He should’ve requested it the first time he noticed it but the thought of you, his sweet, innocent spider, all turned on just from being around him? It ignited something in him.
He updated your suit, saying that the data he was receiving wasn't enough, he made you wear the suit as he replaced the chip and tried to hide the smile in his voice when your spine straightened under his touch. The new chip could give him real-time tracking of all your vitals, but he set his watch to alert him anytime certain hormones spiked… estradiol and testosterone. So he conducted a little experiment over the following weeks, he’d lean into you more when you speak, holding your eye contact, he even broke out the smirk he used to use on girls when he was younger, and it worked on you.
His watch vibrated every time he was near you, if he walked up to you, it started being an alert to when you were near, it’d go off before you’ve even approached him, he’d walk into a room and it’d go off before he even saw you. It started to have an effect on him, he started to feel a spark in his stomach every time it went off, every time he’d meet your eyes and you’d have that expression he’d grown to know so well. That weak, almost pleading- yet confused look in your eyes and the sheer panic before tearing them away from his. He started having to grip whatever was in his hands as tightly as he could to control himself when you’re breathing would stutter after he complimented you on your work.
He started getting hard reviewing your logs after spending the day with you, watching your heart rate stay elevated, spiking along with your hormones, he can see your breathing pattern, and how irregular it is compared to when you’re not with him. How high your body temperature was… the main areas of heat. On his more weak days, he’s gotten himself off to the diagram of you, with the burning red spot between your legs as the focus of his fantasies.
Now you’re here, avoiding his gaze as his watch vibrates like crazy. “Miguel?” He looks at you again, trying to keep his gaze neutral, hopefully, to make this a bit easier on you… and him. “Yes?”
His voice is smooth as cocoa butter and you can feel his gaze burning into you. He started this heat inside you, one you’d never encountered before. It starts when you see him in the morning and doesn’t stop until you struggle to sleep- or at least it used to. But recently it’s been non-stop, a constant distraction that you can’t pinpoint, it feels like it’s in your hips, stomach, chest, and thighs all at once. It feels like it’s in his breath when it fans over your face, it's in his eyes when they lock with yours, and somehow on his fingertips when they brush over any part of you. You’ve spent hours a night trying to figure out what you can do about it, you’ve thought about even asking Lyla but decided the risk of her telling Miguel was far too great.
This past week it’s just been building on it’s self, almost unbearable with Miguel’s new immersive training. He takes you away to some deserted, closed-off place and trains you with no distractions, giving you nothing to focus on other than him and forcing him to give all his attention to you. Miguel’s attention, his gaze is what causes the most… pain. That’s what it’s become, a dull, numb, thrumming at the base of your stomach, like an itch you can’t scratch that just becomes a nuisance. You couldn’t handle it anymore and if you asked Lyla she’d just tell Miguel- so why not just ask him directly?
So here you are, avoiding his gaze because you’ve spent the entire day with him, building enough fire inside you- you don’t need to add any more. “I think…” You take a breath and turn to him a bit before forcing the words out. “There’s something wrong with me.” He puts his clipboard down, his concern, and his thick, veiny hand that comes into view piles onto the heat over-taking your bloodstream. He takes his glasses off and sits back in his chair, reaching his leg out to pull a chair beside you closer to him. You dare a glance at him and try not to collapse at his gaze, at the way his hair moves over his face for a moment as he motions for you to sit in the provided chair.
You sigh and sit down, your legs pressed tightly together, your palms resting on your thighs and your eyes focused on the back of your hands. You stay silent, your mind racing, your body warming further at the feeling of his eyes on you. “What’s wrong, little spider?” You suppress a shiver at the nickname as goosebumps rise over your skin, it’s been a problem since he picked it. “I’m hot.” The words shoot out of your mouth before you can second-guess them again. Miguel chuckles a bit, sending embarrassment through your body, sits back in his chair, and crosses his arms, prompting you to go on.
“I can’t fix it. There’s… someone.” Miguel pretends he doesn’t notice the way your eyes flicker to him. “For some reason, something about them just- “ You pause for a moment, truly baffled by the way you feel, trying to find some way to explain it. “They just do something to me and it won’t stop.” Your words start to sound frantic, a bit panicked. Miguel leans forward, resting his elbows on his knees to examine your expression. “It’s like there's a low- like a low vibration- or a frequency? Like the ones that are so low you can barely hear but you can sorta feel them? It’s like that but- but deep inside me.”
Your eyes close and eyebrows furrow as you describe the feeling to him. He tries to keep his breathing even as he hardens uncontrollably under the suit. You don’t even realize what you’re confessing to him. “Like it’s in my bones, Miguel.” You add emphasis, your hands digging into the material of your suit before raising your head to meet his eyes, hoping he understands the state you’re in. He’s almost dizzy at the way his blood rushes to his cock. He holds your gaze and tries to convey a baffled, thoughtful expression as he tries to calm himself.
“That’s- That’s odd. Yeah, um.” He takes a few deep breaths before sitting back again, unable to stay in your space any longer. “Do- Can you tell me who’s causing it? Perhaps it’s a side effect of their powers?” Your spine straightens and you shake your head at him gently. You twist your fingers in the fabric of your suit and your feet play with each other on the lab floor. “H-have you heard of any powers like that?” You ask him, a hopeful look in your eyes.
Clever girl.
“No, I haven't.” He sits back, spreads his legs, and runs his hands down his thighs and back with a sigh. He holds back a smirk when his watch vibrates and he hears you take a sharp breath. “I- I don’t know what to do anymore. It- I can barely sleep.” You sound distraught, broken, and tired. He’d be the messed up one if he didn't help you… Right?
“I mean… I can try running some tests?” He offers, he keeps his tone light, trying to keep his dark desires off your radar. You perk up at his offer, already up and out of your seat, standing in front of him with a smile. He keeps his eyes on you, trying to ignore the way your scent is assaulting his nose, giving away how badly you need him. “You think we could?”
He nods and stands up, walking over to his lab table and clearing a few things. His head is already running wild with fantasies, ideas of what he could do to you, what he could teach you, how good he could make you feel. “Yeah, of course. C’mere, pequeña araña” You were already walking to him but your pace stutters and his watch vibrates when the nickname slips out. He truly didn’t mean to, he had gotten a bit too deep in his fantasies, and when your voice broke through he didn’t get fully pulled out. He’s never called you that in Spanish, not to your face at least, it’s fallen from his lips a few times before though, when he’s alone with his hand wrapped around his cock. But your reaction dissuades any fear that had shot through him before and he can’t help the smirk that makes its way on his face.
You’re standing silently beside him, wringing your hands together and he doesn’t think you even notice the way your thighs keep clenching together. “Get on the table.” His tone is teasing, a grin on his face as you jump and scramble onto the tabletop. You lay on your back and look over at Miguel, feeling that heat rage through you at the look on his face. It’s dark and- wanting. It’s confusing.
He takes a deep breath and your fingers try to dig into the metal table top as he walks to you. “Okay. I’m going to examine your body a bit, press into some muscles, some pressure points to see if maybe it’s a physical trigger. Is that okay with you?” Your chest is already rising and falling more rapidly at the thought, the promise of Miguel’s hands on you. You nod at him stiffly, trying to stay normal and calm as he holds your eye contact, nodding along with you. A small smile graces his face before he walks around and presses his palm into your hairline, pushing your head down to rest on the table as he stands north of you.
His hands press into your shoulders and your eyes shut tight. He can feel all your muscles tense and his watch vibrates, he sneaks a peak at his and sees the huge spike in almost all your vitals. “Do you really think I’d be a Vice Admiral if I couldn’t do that? Prominent veins popped in Doflamingo’s forehead but the blonde man stayed silent. “I think I’ll stay here for a few more months, at least. Maybe longer if I don’t have a terrible time here. Dressrosa is kind of growing on me.”
“You’re acting like I can’t keep you here by force.” Doflamingo interrupted your train of thought. “I could have Sugar turn you into a cute little doll, and then your Vice Admiral position would disappear.
